R. 6166</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20200310">March 10, 2020</action-date><action-desc><sponsor name-id="K000394">Mr. Kim</sponsor> (for himself and <cosponsor name-id="B001282">Mr. Barr</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to authorize and support the creation and dissemination of cardiomyopathy education, awareness, and risk assessment materials and resources to identify more at-risk families, to authorize research and surveillance activities relating to cardiomyopathy, and for other purposes.</official-title></form><legis-body id="H685E878588364678853C0FCA9CC5245D" style="OLC"><section id="H878DE13002224B8EBE43A94FDC17683D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cardiomyopathy Health Education, Awareness, Research, and Training in the Schools Act of 2020</short-title></quote> or the <quote><short-title>HEARTS Act of 2020</short-title></quote>.</text></section><section id="H63906E4474B040AF8600BFE5E4E07414"><enum>2.</enum><header>Materials and resources to increase education and awareness of cardiomyopathy among school administrators, educators, and families</header><text display-inline="no-display-inline">Part P of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g">42 U.S.C. 280g</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H993DBB251E8548EABD5AD434EC681534" style="OLC"><section id="HF992EE17201F4B729A854DFB7397A44B"><enum>399V–7.</enum><header>Materials and resources to increase education and awareness of cardiomyopathy among school administrators, educators, and families</header><subsection id="H6FD6CAABF5E84F5FB06A30FF0B136BDC"><enum>(a)</enum><header>Materials and resources</header><text>Not later than 18 months after the date of the enactment of this section, the Secretary, in conjunction with the Director of the Centers for Disease Control and Prevention (in this section referred to as the <quote>Director</quote>) shall develop public education materials and resources to be disseminated to school administrators, educators, school health professionals, coaches, families, guardians, caregivers, and other appropriate individuals. The materials and resources shall include—</text><paragraph id="H9F3F482563634222A1D5C268E3B8900C"><enum>(1)</enum><text>background information to increase education and awareness of cardiomyopathy among school administrators, educators, and families;</text></paragraph><paragraph id="HB1F2E22B1F6C406B898A33EBA0E30248"><enum>(2)</enum><text>guidelines regarding the placement of automated external defibrillators in schools, early childhood education programs, and child care centers;</text></paragraph><paragraph id="H7FAFCC806E7142B6A8814B1BFF8CFD20"><enum>(3)</enum><text>training information on automated external defibrillators and cardiopulmonary resuscitation; and</text></paragraph><paragraph id="HD0C6E012FE4046A883E8B4A2220F35AC"><enum>(4)</enum><text>recommendations for how schools, early childhood education programs, and child care centers can develop and implement a cardiac emergency response plan.</text></paragraph></subsection><subsection id="HA6D3D1BD3D9147D88AF1EAAD162C1CBA"><enum>(b)</enum><header>Dissemination of materials and resources</header><text>Not later than 30 months after the date of the enactment of this section, the Secretary, through the Director, shall disseminate the materials and resources developed under subsection (a) in accordance with the following:</text><paragraph id="H74E7643EE5A545A48D728349CB8D7BBB"><enum>(1)</enum><header>Distribution by State educational agencies</header><text>The Secretary shall make available such materials and resources to State educational agencies to distribute—</text><subparagraph id="H5961AF5AB50A4D3387DD5F5F29B6B125"><enum>(A)</enum><text>to school administrators, educators, school health professionals, coaches, families, guardians, caregivers, and other appropriate individuals, the cardiomyopathy education and awareness materials and resources developed under subsection (a)(1);</text></subparagraph><subparagraph commented="no" id="HE2742C20E73242F4A32CEBC2AAD6EC09"><enum>(B)</enum><text>to parents, guardians, or other caregivers, the risk assessment for individuals with or at risk for cardiomyopathy developed pursuant to section 399V–8(b)(1); and</text></subparagraph><subparagraph commented="no" id="HA21043FBB31347049996ED124290B6B1"><enum>(C)</enum><text>to school administrators, educators, school health professionals, and coaches—</text><clause commented="no" id="H89683B413FB545019A68BD31F8B85C0B"><enum>(i)</enum><text>the guidelines described in subsection (a)(2);</text></clause><clause commented="no" id="HB2B974237F1C4792A1F4E9FCCFF108D5"><enum>(ii)</enum><text>the training information described in subsection (a)(3); and</text></clause><clause commented="no" id="H1EDC96C717FF4494A1212D901C26D82B"><enum>(iii)</enum><text>the recommendations described in subsection (a)(4).</text></clause></subparagraph></paragraph><paragraph id="H37CC74E94C2740EFA80DBC1061AA4253"><enum>(2)</enum><header>Dissemination to health departments and professionals</header><text>The Secretary shall make available the materials and resources developed under subsection (a) to State and local health departments, pediatricians, hospitals, and other health professionals, such as nurses and first responders.</text></paragraph><paragraph id="H17B1DED0204444A69A998F55F6618DF0"><enum>(3)</enum><header>Posting on website</header><subparagraph id="H7819131E681742D886E323E9BD75007A"><enum>(A)</enum><header>CDC</header><clause id="H95D2FA19C410495A9975FDC7DBD138E6"><enum>(i)</enum><header>In general</header><text>The Secretary, through the Director, shall post the materials and resources developed under subsection (a) on the public internet website of the Centers for Disease Control and Prevention.</text></clause><clause id="H79643EBCF98C4F53A4802A626514B8F4"><enum>(ii)</enum><header>Additional information</header><text>The Director is encouraged to maintain on such public internet website such additional information regarding cardiomyopathy as deemed appropriate by the Director.</text></clause></subparagraph><subparagraph id="H74C58FAD7275422EA68F22EAEA44FC27"><enum>(B)</enum><header>State educational agencies</header><text>State educational agencies are encouraged to create public internet webpages dedicated to cardiomyopathy and post the materials and resources developed under subsection (a) on such webpages.</text></subparagraph></paragraph></subsection><subsection id="H0B8DB7FE03DA4DA7B83E7F7F2448F7CE"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="H72364D31DDEF41BDA501C2F558AB893B"><enum>(1)</enum><text>The term <term>school administrator</term> means a principal, director, manager, or other supervisor or leader within an elementary school, secondary school, State-based early childhood education program, or child care center.</text></paragraph><paragraph id="H772027DCC04344A3B78B90480CD2B2EA"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>school health professional</term> means a health professional serving at an elementary school, secondary school, State-based early childhood education program, or child care center.</text></paragraph><paragraph id="HB661AA03F60D4A7A992314990527B918"><enum>(3)</enum><text display-inline="yes-display-inline">The terms <term>early childhood education program</term>, <term>elementary school</term>, and <term>secondary school</term> have the meanings given to those terms in section 8101 of the Elementary and Secondary Education Act of 1965.</text></paragraph></subsection><subsection id="HB82D87AE115F4A33AA49886364803E04"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">For carrying out this section and section 399V–8, there is authorized to be appropriated $1,000,000 for each of fiscal years 2021 through 2025.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HEA7AE47288CC4A7BA6757131C8E4C85F" section-type="subsequent-section"><enum>3.</enum><header>Research and surveillance activities relating to cardiomyopathy</header><subsection id="HE38879B0A4324D8C816CCC1C6B7D7319"><enum>(a)</enum><header>CDC research and surveillance</header><text display-inline="yes-display-inline">Part P of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g">42 U.S.C. 280g</external-xref> et seq.), as amended by section 2, is further amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="HFD3BE2DFAFDF47C7BB7B1ED7E6D907E1" style="OLC"><section id="HB89710328C464C588A3B2D05FDFBE634"><enum>399V–8.</enum><header>Research and surveillance activities relating to cardiomyopathy</header><subsection id="H93C4682B64A24622AEF4E3F7FEC83A91"><enum>(a)</enum><header>Reports on CDC national cardiomyopathy surveillance research activities</header><paragraph commented="no" id="H99D452E6793645FB91CC542E9C0C33A2"><enum>(1)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not later than June 1, 2021, the Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall submit to Congress an initial report on findings and data generated from surveillance and research activities conducted by the Centers for Disease Control and Prevention to improve the understanding of the prevalence and epidemiology of cardiomyopathy across the lifespan, from birth to adulthood, with particular interest in the following:</text><subparagraph commented="no" id="HBDB968EF613D45C9BC1596C4DE4F58CC"><enum>(A)</enum><text>The health care costs, utilization, and natural history of individuals with cardiomyopathy, in both the pediatric and adult population.</text></subparagraph><subparagraph commented="no" id="H2C6DFFA6BD224EB99C51E77C4FBC1EF2"><enum>(B)</enum><text>The number of adults and children affected by cardiomyopathy, as well as age-specific mortality.</text></subparagraph></paragraph><paragraph id="H5209EC0864884A6D8D8842CCFD82FCBB"><enum>(2)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than January 1, 2026, the Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall submit to Congress a final report on the content described in paragraph (1).</text></paragraph><paragraph id="H9713AAEBC07B4623AAE873EBC85FD90A"><enum>(3)</enum><header>Public access</header><text display-inline="yes-display-inline">Subject to paragraph (4), the reports submitted under this subsection shall be made available to the public.</text></paragraph><paragraph id="HC488A429D48F46828705841A36C831DD"><enum>(4)</enum><header>Patient privacy</header><text display-inline="yes-display-inline">The Secretary shall ensure that this subsection is carried out in a manner that complies with the requirements applicable to a covered entity under the regulations promulgated pursuant to section 264(c) of the Health Insurance Portability and Accountability Act of 1996.</text></paragraph></subsection><subsection id="H0E0BBC8725C44D08AE14481DDB053F1D"><enum>(b)</enum><header>Improving risk assessments for individuals with cardiomyopathy</header><paragraph commented="no" id="H7A90E676689B49F0A9731370F8515E81"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall develop and make publicly available a risk assessment for individuals with or at risk for cardiomyopathy. Such risk assessment shall, at a minimum, include the following:</text><subparagraph commented="no" id="H6347548678F1452B940E1507439C513E"><enum>(A)</enum><text>Background information of the prevalence, incidence, and health impact of cardiomyopathy, including all forms of cardiomyopathy and their effects on pediatric, adolescent, and adult individuals.</text></subparagraph><subparagraph commented="no" id="HB955C30003E6465A86819C7F5205A6FC"><enum>(B)</enum><text display-inline="yes-display-inline">A worksheet with variables and conditions for an individual or health care provider to use in assessing whether the individual is at risk for cardiomyopathy.</text></subparagraph><subparagraph commented="no" id="H179BFB950A264AF5A0A49BE8D0CF4FDA"><enum>(C)</enum><text>A worksheet with variables and stages of progression for an individual or health care provider to use in assessing whether and to what extent cardiomyopathy has progressed in the individual.</text></subparagraph><subparagraph commented="no" id="H25361A32A5F04D9ABAC6A1D38D9026FC"><enum>(D)</enum><text>Guidelines on cardiomyopathy screenings for individuals who are at risk for, or have a family history of, cardiomyopathy.</text></subparagraph></paragraph><paragraph id="H8E83BD9380C5480C98C915D0BC2CAA6E"><enum>(2)</enum><header>Stakeholder Input</header><text>In carrying out paragraph (1), the Director of the Centers for Disease Control and Prevention shall seek input from external stakeholders including—</text><subparagraph id="H10DD1822A9AA4410B2D222696F12E292"><enum>(A)</enum><text>representatives from national patient advocacy organizations expert in all forms of cardiomyopathy;</text></subparagraph><subparagraph id="H8A1C063DB6A349A3ABC9FDBE62622ADD"><enum>(B)</enum><text>representatives from medical professional societies that specialize in the care of adults and pediatrics with cardiomyopathy; and</text></subparagraph><subparagraph id="HD73DA6B8EF5744428C0C1C4BA3D9FED5"><enum>(C)</enum><text>representatives from other relevant Federal agencies.</text></subparagraph></paragraph></subsection><subsection id="H39E81FBC333C45B480C57E5AFB42C65D"><enum>(c)</enum><header>Cardiomyopathy defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>cardiomyopathy</term> means a heart disease that affects the heart’s muscle (myocardium)—</text><paragraph id="H8745EEAF574345B08D29641F5EF02D5F"><enum>(1)</enum><text>the symptoms of which may vary from case to case, including—</text><subparagraph id="H8CC78F79D2E34FECB9A084CDC2FF32DD"><enum>(A)</enum><text>cases in which no symptoms are present (asymptomatic); and</text></subparagraph><subparagraph id="HCA306D8C8283463A8BA5933E96486576"><enum>(B)</enum><text>cases in which there are symptoms of a progressive condition that may result from an impaired ability of the heart to pump blood, such as fatigue, irregular heartbeats (arrhythmia), heart failure, and, potentially, sudden cardiac death; and</text></subparagraph></paragraph><paragraph id="H34E48E0C7B734207AC27581858277158"><enum>(2)</enum><text>the recognized types of which include dilated, hypertrophic, restrictive, arrhythmogenic right ventricular dysplasia, and left ventricular non-compaction.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE7D37CFA5C274A95A81147CE0F85CD20"><enum>(b)</enum><header>Federal working group</header><paragraph id="H2B34DB774DA848ADB1CAB23FA32E161E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Health and Human Services shall convene an interdisciplinary working group for the purpose of expanding cardiomyopathy research.</text></paragraph><paragraph id="HFF7369B2E22E48C1BA7EF354E41B4E0B"><enum>(2)</enum><header>Duties</header><text display-inline="yes-display-inline">The working group shall—</text><subparagraph id="H777434FF9B98474D91B2D8FC0A26FD0C"><enum>(A)</enum><text>develop a research strategy to address the gaps in knowledge on the molecular and genetic causes of cardiomyopathy in children; </text></subparagraph><subparagraph id="H760B4F00BDE142DAACF477E96116313D"><enum>(B)</enum><text>identify approaches that could result in the development of preventive and disease-directed therapies specific to pediatric car­di­o­my­op­a­thies and heart failure; and</text></subparagraph><subparagraph id="H4237333748AD4B888BAA2DC73624385A"><enum>(C)</enum><text>explore novel clinical trial methodologies and end points in an effort to optimize successful completion of clinical trials in this rare patient population.</text></subparagraph></paragraph><paragraph id="H433B30F253E646F58ED8B90214FFED16"><enum>(3)</enum><header>Membership</header><text display-inline="yes-display-inline">The Secretary shall appoint to the working group members representing a range of stakeholders outside of the Federal Government with subject matter expertise relating to cardiomyopathy, including—</text><subparagraph id="H6FAFDAF057054730A0D1839A468890C1"><enum>(A)</enum><text>pediatric cardiologists with expertise in the diagnosis and treatment of children with cardiomyopathies and heart failure and clinical trials related to the pediatric population;</text></subparagraph><subparagraph id="H13ECD32EB0794D14BEF0E4E76AFAA5D9"><enum>(B)</enum><text>geneticists with expertise in pediatric cardiomyopathy and heart failure; </text></subparagraph><subparagraph id="H72F908A7706B46AAB3D9E51992BF26A5"><enum>(C)</enum><text>cardiovascular molecular biologists;</text></subparagraph><subparagraph id="HB69BDBDBC9F942768E349941ADDC155B"><enum>(D)</enum><text>pharmacologists;</text></subparagraph><subparagraph id="H4DE2080CB03541A7ADE07CF118C79EA1"><enum>(E)</enum><text>research scientists with expertise in cardiomyopathy and heart failure; and</text></subparagraph><subparagraph id="H7F8D93FB21C64C61A086E1E96659A46C"><enum>(F)</enum><text>other stakeholders with relevant expertise, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="HF738CB9627A6438686C9BFB48D5BB13F"><enum>(4)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Working Group shall publish and submit to Congress a report that contains—</text><subparagraph id="H19A293DF6A054A1B8286CB7AA28FBD7C"><enum>(A)</enum><text>a description of the activities of the working group;</text></subparagraph><subparagraph id="H51CBA0FDF74E4D58BFD2FDE9028DA2DD"><enum>(B)</enum><text>the findings and recommendations of the working group with respect to each of the topics described in paragraph (2); and</text></subparagraph><subparagraph id="H827FDF6E4FA84E5F94B194A18BD0DF5E"><enum>(C)</enum><text>the recommendations of the working group relating to actions that Federal agencies and Congress can take to implement the recommendations described in subparagraph (B).</text></subparagraph></paragraph><paragraph id="H68F398544D3E484281C5832FA91EE47D"><enum>(5)</enum><header>No compensation</header><text display-inline="yes-display-inline">A member of the working group shall serve without compensation.</text></paragraph><paragraph id="H99D1ED36F02F42A1A7DA1082A85804CF"><enum>(6)</enum><header>Termination</header><text display-inline="yes-display-inline">The working group shall terminate on the date on which the working group submits the report under paragraph (4).</text></paragraph><paragraph id="H10663E122BD5477FB23F4689C3B9F1C8"><enum>(7)</enum><header>Cardiomyopathy defined</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>cardiomyopathy</term> means a heart disease that affects the heart’s muscle (myocardium)—</text><subparagraph id="H6F5A2FB1A8E247C19C6294DC304AE40F"><enum>(A)</enum><text>the symptoms of which may vary from case to case, including—</text><clause id="H72C141CACAC642B4B3C7063EE4F28A30"><enum>(i)</enum><text>cases in which no symptoms are present (asymptomatic); and</text></clause><clause id="H491F1C02008A4705B0F01D2670D6B86E"><enum>(ii)</enum><text>cases in which there are symptoms of a progressive condition that may result from an impaired ability of the heart to pump blood, such as fatigue, irregular heartbeats (arrhythmia), heart failure, and, potentially, sudden cardiac death; and</text></clause></subparagraph><subparagraph id="HA3C47E68F5DF4A95AD9AB1443BB1CBE4" display-inline="no-display-inline"><enum>(B)</enum><text>the recognized types of which include dilated, hypertrophic, restrictive, ar­rhyth­mo­gen­ic right ventricular dysplasia, and left ventricular non-compaction.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
