R. 5985</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20200227">February 27, 2020</action-date><action-desc><sponsor name-id="B001305">Mr. Budd</sponsor> (for himself, <cosponsor name-id="B001311">Mr. Bishop of North Carolina</cosponsor>, and <cosponsor name-id="C001049">Mr. Clay</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Federal Communications Commission to establish an interagency taskforce on unlawful robocalls.</official-title></form><legis-body id="HC308B47DC0154FEB8B1616005B11965B" style="OLC"><section id="H028D987157244F7790FC0EBC3F83154C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign Robocall Elimination Act</short-title></quote>.</text></section><section id="H4DC70378AB18442DB8FF4374CF4BD066"><enum>2.</enum><header>Interagency taskforce on unlawful robocalls</header><subsection id="H4E78DAE3800C4039BBFBF45AF17F73DB"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Federal Communications Commission, in consultation with the Federal Trade Commission and the Attorney General, shall establish an interagency taskforce on unlawful robocalls.</text></subsection><subsection id="HA3ADCD37D1F04A678D6D8D085A7E3B7A"><enum>(b)</enum><header>Membership</header><paragraph id="H4952B84193AD43FC9ED62D7FD1481F6A"><enum>(1)</enum><header>In general</header><text>The taskforce shall be composed of the following members:</text><subparagraph id="H2A5B13FF2FBA43C09FD545CECDF568F5" commented="no"><enum>(A)</enum><text>A representative of each Federal agency that the Federal Communications Commission, in consultation with the Federal Trade Commission and the Attorney General, considers appropriate, to be appointed by the head of such agency.</text></subparagraph><subparagraph id="H89458F7431674199A7ACA4BDA4A327E3"><enum>(B)</enum><text>Three representatives of private-sector entities, to be appointed as described in paragraph (2)—</text><clause id="HB73812B113D3483ABAB8CAAB14C6CB3E"><enum>(i)</enum><text>one of whom is a representative of a provider of telephone service; and</text></clause><clause id="H56EB7BE4F94C49F0A899A2C0125D0048"><enum>(ii)</enum><text>two of whom are representatives of other private-sector entities with expertise in combating unlawful robocalls and who may be technologists and technology experts.</text></clause></subparagraph></paragraph><paragraph id="H0C22E60B5364458788C6A9554386AB67"><enum>(2)</enum><header>Appointment of representatives of private-sector entities</header><text display-inline="yes-display-inline">The members of the taskforce described in paragraph (1)(B) shall be jointly appointed by the Chairman of the Federal Communications Commission, the Chairman of the Federal Trade Commission, and the Attorney General. If the Chairman of the Federal Communications Commission, the Chairman of the Federal Trade Commission, and the Attorney General cannot reach agreement regarding such an appointment, as determined by the Chairman of the Federal Communications Commission, the Chairman of the Federal Communications Commission shall make such appointment.</text></paragraph></subsection><subsection id="HD2F4F00E5F45488C8F1EB99E95ECC2E8"><enum>(c)</enum><header>Study</header><paragraph id="HAD792DA5BAB64165BA2F272F69C92538"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The taskforce shall conduct a study on unlawful robocalls, including the most effective ways to combat unlawful robocalls made into the United States from outside the United States.</text></paragraph><paragraph id="HA994C610C77C4A909E49E5DF9724C9F6"><enum>(2)</enum><header>Matters to be studied</header><text>In conducting the study required by paragraph (1), the taskforce shall—</text><subparagraph id="H4FEDDFBEF5304E3FAF5E4ECFE76C4E27"><enum>(A)</enum><text display-inline="yes-display-inline">compare the number of unlawful robocalls made within the United States and the number of unlawful robocalls made into the United States from outside the United States;</text></subparagraph><subparagraph id="HBD74835534D146BBA5E45E1501F27598"><enum>(B)</enum><text display-inline="yes-display-inline">examine methods for encouraging adoption of caller authentication technology in foreign countries;</text></subparagraph><subparagraph id="H451328D2C1E0492EB46BA713D50AC498"><enum>(C)</enum><text display-inline="yes-display-inline">examine and provide information on options for countries to share caller authentication information for international calls;</text></subparagraph><subparagraph id="H0078D2753092484D94546F6AF8FF89C1"><enum>(D)</enum><text display-inline="yes-display-inline">examine how technical solutions such as caller authentication technology would improve coordination between the United States and foreign countries in combating unlawful robocalls;</text></subparagraph><subparagraph id="H8C5C02419546478A9D70C52330F2E011" commented="no"><enum>(E)</enum><text>examine ways to incentivize foreign countries to cooperate with United States law enforcement efforts to combat unlawful ro­bo­calls;</text></subparagraph><subparagraph id="H747B914A1EF24FDAA840D85BCE82320C"><enum>(F)</enum><text>examine ways to incentivize providers of telephone service to take measures to combat unlawful robocalls placed across international borders; and</text></subparagraph><subparagraph id="H54D6D860F37C466DAE1F91886377C76B"><enum>(G)</enum><text>examine whether or not additional resources are needed by any Federal agency that combats unlawful robocalls or any other organization that combats unlawful robocalls, in order to more effectively combat unlawful robocalls made into the United States from outside the United States.</text></subparagraph></paragraph><paragraph id="H0518174C4FAF496695C761F95598DD22"><enum>(3)</enum><header>Collaboration with private sector</header><text>In conducting the study required by paragraph (1), the taskforce shall collaborate with technologists and private-sector innovators, including through the members of the taskforce appointed under subsection (b)(2), to find solutions for combating unlawful robocalls.</text></paragraph></subsection><subsection id="H7917BF3193214070BF272E13F7E70EEA"><enum>(d)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 10 months after the date of the enactment of this Act, the taskforce shall submit to Congress a report on the findings of the study required by subsection (c)(1).</text></subsection><subsection id="H60E610726EA5426C8C49C4FD58CF5D08"><enum>(e)</enum><header>Termination</header><text>The taskforce shall terminate on the date that is 90 days after the taskforce submits the report required by subsection (d).</text></subsection><subsection id="HE553B2C2A41D464CB6F9CDD4D4E088D5"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HEAFDCC51708F4AA191435380626AE3AF"><enum>(1)</enum><header>Federal agency</header><text display-inline="yes-display-inline">The term <quote>Federal agency</quote> has the meaning given the term <quote>agency</quote> in section 551 of title 5, United States Code.</text></paragraph><paragraph id="HE2988C53FF57417E9BD5F57A136070CE" commented="no"><enum>(2)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means each State of the United States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text></paragraph><paragraph id="H6B98573ADDE645CC9D6CD8EAA34E0DDD"><enum>(3)</enum><header>Taskforce</header><text>The term <quote>taskforce</quote> means the taskforce on unlawful robocalls established under subsection (a). </text></paragraph><paragraph id="H334B5B4F587C42EEBC8994A67A673771"><enum>(4)</enum><header>Unlawful robocall</header><text>The term <quote>unlawful robocall</quote> means a telephone call made in violation of—</text><subparagraph id="HC6830501E0F747B0ABE8A728053094CC"><enum>(A)</enum><text>section 227(b) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(b)</external-xref>); or</text></subparagraph><subparagraph id="H0EE64BAC261140219DDDD7068F9C6DBB" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a similar law of a State or a foreign country that prohibits calls made using an automatic telephone dialing system or an artificial or prerecorded voice.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
