	<legis-body id="HB7A11AD701404AAEBDF388372B004270" style="OLC">
 <section id="H96CB590B222E488ABB215628E0B18A6D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Crime Victims’ Rights Act of 2020</short-title></quote>.</text> </section><section id="HFBAA6E44EA764FC0A91A9B866EF1F0DE"><enum>2.</enum><header>Crime Victims’ rights</header><text display-inline="no-display-inline">Section 3771 of title 18, United States Code, is amended—</text>
 <paragraph id="HA26382F1CEA049319D32CD402ABC20A7"><enum>(1)</enum><text>in subsection (c)—</text> <subparagraph id="H7AEFD7B6579D489C8EFD9DCDC384EDE6"><enum>(A)</enum><text display-inline="yes-display-inline">in the heading, strike <quote><header-in-text level="subsection" style="OLC">Best</header-in-text></quote>;</text>
 </subparagraph><subparagraph id="HD825C3E7D4A64F879EB60E5B0C0D40E2"><enum>(B)</enum><text>in paragraph (1), by striking <quote>shall make their best efforts to see</quote> and all that follows through the period at the end and insert the following:</text> <quoted-block display-inline="yes-display-inline" id="HDC3CDC8C9586400F91931369DC7229F1" style="USC"> <text>shall—</text><subparagraph id="H7DAE517507D34808847BF3AE89DAD747"><enum>(A)</enum><text display-inline="yes-display-inline">ensure that crime victims are notified of, and accorded, the rights described in subsection (a); or</text> </subparagraph><subparagraph id="H7638DC844C2D44AEB7065CCA655B9B0B"><enum>(B)</enum><text display-inline="yes-display-inline">in the case that officers and employees of the Department of Justice are unable meet the requirements of subparagraph (A), attempt to notify the crime victim or the legal representative of the crime victim on not less than 3 occasions in which the mode of contact is valid, including outreach by means of telephone, electronic mail, or certified mail;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="HA58998E265F34B4793057B548970E20D"><enum>(2)</enum><text>in subsection (d)—</text> <subparagraph id="H51632D446E52498EBBE91D014196CE18"><enum>(A)</enum><text>in paragraph (2), strike <quote>reasonable procedure</quote> and insert <quote>reasonable procedure, in writing,</quote>; and</text>
 </subparagraph><subparagraph id="H428D605496554322A6E2BB9A861F1563"><enum>(B)</enum><text>in paragraph (3), by adding at the end the following: <quote>Relief under this subsection with respect to the conduct of an attorney for the Government may include the disqualification of the attorney from the proceeding, and such other sanctions or penalties as the court determines appropriate.</quote>; and</text>
 </subparagraph></paragraph><paragraph id="H5334AFE8BB35495C9B6FE8BF9DF40170"><enum>(3)</enum><text>by repealing subsection (f).</text> </paragraph></section><section id="HF7F06A4ADEDB4A9A981B15261836895D"><enum>3.</enum><header>Office of Crime Victims' Rights</header> <subsection id="HE643E2323F5F460F9C7F927E95EF3E04"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/237">Chapter 237</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H63DBE7C333E44678863DAABA86C4E959" style="USC">
					<section id="HCA6E96A4A4094248B97FCFA225C0E50F"><enum>3772.</enum><header>Office of Crime Victims' Rights</header>
 <subsection id="H553178CAD9D84341B0C5F6665E74B81D"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established within the Office of Professional Responsibility of the Department of Justice the Office of Crime Victims’ Rights, which shall receive, investigate, and adjudicate complaints relating to the violation of the rights of a crime victim under section 3771.</text>
 </subsection><subsection id="H94BC59ED07AE4A378B0CFA6D0EC2AC61"><enum>(b)</enum><header>Crime Victims’ Rights Coordinator</header><text display-inline="yes-display-inline">The Office of Crime Victims’ Rights shall be headed by the Crime Victims’ Rights Coordinator (in this section referred to as the <quote>Coordinator</quote>). The Coordinator shall be a civil servant appointed to the Senior Executive Service. The Coordinator may be removed from office, other than by impeachment and conviction, only by the personal action of the Attorney General and only for good cause, physical or mental disability (if not prohibited by law protecting persons from discrimination on the basis of such disability), or any other condition that substantially impairs the performance of his or her duties.</text>
 </subsection><subsection id="HDCEEAA9BE5834D1CABC37B30C3BB3456"><enum>(c)</enum><header>Complaints</header><text display-inline="yes-display-inline">A crime victim or the legal representative of a crime victim may submit to the Office of Crime Victims’ Rights a complaint alleging that an attorney for the Government violated the rights of a crime victim under section 3771, which shall include the following:</text>
 <paragraph id="H2BF93221470649618DCDB78166E94641"><enum>(1)</enum><text>The full name, address, telephone number, and electronic mail address of the complainant.</text> </paragraph><paragraph id="HC23EF230EBC245848E4E4DC0F96D8D1A"><enum>(2)</enum><text>The name and title of the individual who violated the rights of the crime victim.</text>
 </paragraph><paragraph id="H7C7CDE00061D47F899D859ECFBD4DA92"><enum>(3)</enum><text>The right of the crime victim that was allegedly violated.</text> </paragraph><paragraph id="H15F03751379D48CA9A73466DA4633693"><enum>(4)</enum><text>The details of the allegation, including the name of the court case and the jurisdiction in which the misconduct occurred, if applicable.</text>
 </paragraph><paragraph id="HDCD2036551754690AC4B4261D665BBCD"><enum>(5)</enum><text>Copies of any document that supports the complainant’s allegation.</text> </paragraph><paragraph id="H4182B8DE30784CCCAA38174C7C094A3C"><enum>(6)</enum><text>Any other information relevant to the complaint.</text>
 </paragraph></subsection><subsection id="HFC2D2A0E446243518FEBB4788FF4AC8A"><enum>(d)</enum><header>Period To submit complaints</header><text>A complaint under subsection (c) may be submitted beginning on the date of the violation and ending on the date that is 180 days after a final judgment is entered in the underlying criminal proceeding (including any appeal), except that the Coordinator may extend such filing period for good cause.</text>
 </subsection><subsection id="HC4CCEF2AA66A4B7293C69413B7AC4B82"><enum>(e)</enum><header>Log of complaints</header><text>The Coordinator shall maintain a log of each complaint submitted under subsection (c).</text> </subsection><subsection id="H75CB88905A0545DA908AB0A4A3F2D701"><enum>(f)</enum><header>Complaint process</header> <paragraph id="HA0CBDF1A12A04F8E8516ADF0EDE0FB6D"><enum>(1)</enum><header>Investigation</header><text display-inline="yes-display-inline">Not later than 180 days after receiving a complaint under subsection (c), the Coordinator shall complete an investigation and issue a final order with respect to an alleged violation. At the request of the Coordinator, the Attorney General may grant one extension of not more than 60 days under this paragraph.</text>
 </paragraph><paragraph id="HB3ACB36A12C648068272DB9766104E5C"><enum>(2)</enum><header>Hearing</header><text display-inline="yes-display-inline">In conducting an investigation under paragraph (1), the Coordinator may hold a hearing, and shall hold a hearing at the written request of the complainant submitted not later than 15 days after the Coordinator acknowledges receipt of the complaint.</text>
 </paragraph><paragraph id="H6C288E9D09D04B43BEDDB170BBBCDF67"><enum>(3)</enum><header>Standard</header><text>If the Coordinator determines, by a preponderance of the evidence, that the attorney for the Government knowingly violated the rights of a crime victim under section 3771, the Coordinator shall impose appropriate disciplinary action against the attorney under paragraph (4)(A) and, except as provided in paragraph (4)(B)(iii), make the final order issued under paragraph (4) available to the public.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="HAC678558C365406BB8C7C16496124E28"><enum>(4)</enum><header>Order of decision</header>
 <subparagraph id="HA42DB6EABA5D4339AE51829781F01F93"><enum>(A)</enum><header>In general</header><text>The Coordinator shall issue an order with respect to a complaint filed under this section, and shall provide the order to the complainant and to the attorney for the Government.</text>
								</subparagraph><subparagraph id="H89E28412729346E0A39959280913EC1B"><enum>(B)</enum><header>Contents of order</header>
 <clause id="HFA1833C75E81486B89AD0BC4CC32B99A"><enum>(i)</enum><header>Violation of rights</header><text display-inline="yes-display-inline">In the case that the Coordinator determines that the attorney for the Government violated the rights of a crime victim under section 3771, the Coordinator may impose disciplinary action which may consist of—</text>
 <subclause id="H15267BA956674AB3BABC008E0FF6EEF6"><enum>(I)</enum><text>referral to each State bar association of which the attorney is a member in good standing not later than 30 days after the date on which the final order is made available;</text>
 </subclause><subclause id="H383528D9DA224356BAE07F3A69FC91CE"><enum>(II)</enum><text>suspension or termination from employment;</text> </subclause><subclause id="HDDFDCB2C235E48DFBCC6A1F7034EB606"><enum>(III)</enum><text>suspension from practicing law on behalf of the United States; and</text>
 </subclause><subclause id="H99279D1309384F7DB8D80D14DF607753"><enum>(IV)</enum><text>referral to the appropriate United States Attorney if there is evidence of criminal misconduct.</text> </subclause></clause><clause id="H9EEFE4F0A1DD490DA53AD1D0735E040B"><enum>(ii)</enum><header>Lesser violations</header><text>In the case that there is substantial evidence of an ethical violation by the attorney for the Government that does not amount to a violation of the rights of a crime victim under section 3771, the Coordinator may refer such violation—</text>
 <subclause id="H493A8F9E1B494C80B0AD9002E626CB65"><enum>(I)</enum><text display-inline="yes-display-inline">to the Director of Office of Professional Responsibility for adjudication;</text> </subclause><subclause display-inline="no-display-inline" id="H05420DEEC87548138B97DBE73B2B856B"><enum>(II)</enum><text>to each State bar association of which the attorney is a member in good standing; and</text>
 </subclause><subclause id="H9EB73170CCEF45D18EB7D0272448D492"><enum>(III)</enum><text>to the appropriate supervisor of the attorney.</text> </subclause></clause><clause id="H7BC393EBED4F492B965D015EEEDFDD6D"><enum>(iii)</enum><header>No violation or insufficient evidence</header><text>In the case that the Coordinator determines that the attorney for the Government did not violate section 3771 or that there is insufficient evidence to determine whether the attorney for the Government violated section 3771, the Coordinator shall enter an order to such effect. An order under this clause shall not be made available to the public.</text>
 </clause><clause commented="no" id="HCF37248C9EB14CBBB74555153AB2FCD8"><enum>(iv)</enum><header>Delayed effect</header><text>Any sanctions imposed pursuant to an order under this section may not take effect until after the expiration of the time period to file an appeal, or in the case that an appeal is pending, until after the appeal is final.</text>
 </clause><clause commented="no" id="HC08885AEDA9142298322594216AF0464"><enum>(v)</enum><header>Notice of determination</header><text display-inline="yes-display-inline">Not later than 30 days after the date of which the period to seek a review expires, notice of the issuance of a final order shall be made publicly available on the website of the Office of Crime Victims’ Rights.</text>
									</clause></subparagraph></paragraph><paragraph id="H9989D345CAC5438A9DB75F5ED91FC16A"><enum>(5)</enum><header>Appeal to the Attorney General</header>
 <subparagraph id="H6027648988314E8BB54D0FA272713F58"><enum>(A)</enum><header>In general</header><text>Not later than 10 business days after the issuance of an order under paragraph (4), the complainant or the attorney for the Government may appeal the order to the Attorney General.</text>
 </subparagraph><subparagraph id="HE706CB13D84541409FC0A81D77BBEA2C"><enum>(B)</enum><header>Time for review</header><text>Not later than 30 days after an appeal is filed under this paragraph, the Attorney General shall review the order.</text>
 </subparagraph><subparagraph id="H9102D2FB41BF406085AA0DE59AF9E6D9"><enum>(C)</enum><header>Notice to Congress</header><text>In the case that the Attorney General does not uphold the decision of the Coordinator, the Attorney General shall notify Congress as soon as practicable, but in no case later than 10 business days after completing review.</text>
 </subparagraph><subparagraph commented="no" id="HB35CEDD95804409F8865569A295FB299"><enum>(D)</enum><header>Failure to review</header><text display-inline="yes-display-inline">If the Attorney General fails to review an order pursuant to an appeal filed under this paragraph, the order shall be deemed to have been upheld by the Attorney General on the date that is 45 days after the appeal is filed.</text>
 </subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H89370B1F1BB64359803BB3F0AA89BC72"><enum>(g)</enum><header>Rights of complainant</header><text>The complainant shall have the following rights:</text> <paragraph id="H5103D15C9A4247289AAA3E1570A786EF"><enum>(1)</enum><header>Notice of receipt</header><text display-inline="yes-display-inline">The Coordinator shall provide to the complainant notice of receipt of a complaint not later than 10 days after the date of such receipt.</text>
							</paragraph><paragraph id="HB95620E6BBF744E5AA8D34698CDBC123"><enum>(2)</enum><header>Right to Counsel</header>
 <subparagraph id="HF5866CDF2C7844FDBC14782DC2514599"><enum>(A)</enum><header>In general</header><text>The complainant shall have the right to be represented by legal counsel in any hearing under this section.</text>
 </subparagraph><subparagraph id="H16621A3F125243BBB37D6B8D930F95FA"><enum>(B)</enum><header>Pro bono representation</header><text display-inline="yes-display-inline">The Coordinator shall submit to the complainant a list of persons (updated not less often than quarterly) who have indicated their availability to represent crime victims on a pro bono basis.</text>
 </subparagraph><subparagraph id="H357CC07E04DE482984E2804F3ACB4687"><enum>(C)</enum><header>Contact information of counsel</header><text>In the case that a complainant is represented by legal counsel in a hearing convened under this section, the contact information of such attorney shall be included on the complaint.</text>
 </subparagraph><subparagraph id="HF944AC54D8FD43E78FE7219A3F49ACD8"><enum>(D)</enum><header>Notice of withdrawal</header><text>In the case that legal counsel for a complainant withdraws from such representation, the attorney shall provide notice to the Coordinator.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H585C381725DA4BBBB8D77172DBD17105"><enum>(3)</enum><header>Right to present evidence</header><text>The complainant shall have the right to present evidence and witnesses at any hearing under this section.</text>
 </paragraph></subsection><subsection id="H9B9417B107DE44CCBF17AA40F778E76D"><enum>(h)</enum><header>Rights of attorney for the Government</header><text display-inline="yes-display-inline">Any attorney for the Government against whom a complaint has been submitted to the Office of Crime Victims’ Rights is entitled to—</text>
 <paragraph id="HDE7B430260CE439BBDDE76D90C80E96E"><enum>(1)</enum><text display-inline="yes-display-inline">receive notice of a complaint against the attorney not later than 10 days after such complaint is received by the Office of Crime Victims’ Rights;</text>
 </paragraph><paragraph id="H589D86AB2CBB4E7F86A71962066A1D37"><enum>(2)</enum><text>a reasonable time to answer in writing and to furnish affidavits and other documentary evidence in support of the answer;</text>
 </paragraph><paragraph id="H9569CC321893414C90B81B0E10DF27F8"><enum>(3)</enum><text>be represented by legal counsel;</text> </paragraph><paragraph id="H977E9B5587C2449F83F6094F80828FD6"><enum>(4)</enum><text>be present at any hearing under this section;</text>
 </paragraph><paragraph commented="no" id="H442CB4BE68674BE492566B238F68939F"><enum>(5)</enum><text>present evidence and witnesses in their defense;</text> </paragraph><paragraph id="H9D8F1EA663954E9CA1154A361061D86A"><enum>(6)</enum><text>a copy of any final order imposing disciplinary action not later than the date on which the order is issued;</text>
 </paragraph><paragraph id="H3ACEE394718A42FA9A43DE37F88219A2"><enum>(7)</enum><text display-inline="yes-display-inline">end the complaint process by voluntarily forfeiting the attorney’s bar license in each jurisdiction in which the attorney is licensed; and</text>
 </paragraph><paragraph id="HFF8880294B994C228FA6A8484EACF42C"><enum>(8)</enum><text display-inline="yes-display-inline">reasonable and timely access to access records of the Department of Justice related to the complaint.</text>
 </paragraph></subsection><subsection id="H2694124B41854ED9A109A71947CE77B7"><enum>(i)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of enactment of this section, and each year thereafter, the Attorney General, acting through the Chief Counsel of the Office of Professional Responsibility of the Department of Justice, shall submit to Congress a report that includes—</text>
 <paragraph id="HE639506B08B3477495971003341ADD1E"><enum>(1)</enum><text>the number of complaints filed with the Office of Crime Victims’ Rights;</text> </paragraph><paragraph id="HF90E6FE3244646BDA6F368739B8F4E78"><enum>(2)</enum><text>the number of complaints that are investigated;</text>
 </paragraph><paragraph id="H97DFFDC5C9B84E1BA29834A57C7CD320"><enum>(3)</enum><text>the number of complaints that were referred to a State bar association;</text> </paragraph><paragraph id="HEDBF932F5F0A4CE39C42FD49EA812862"><enum>(4)</enum><text>a list of Federal districts in which misconduct was alleged to have occurred and the number of complaints from each such district;</text>
 </paragraph><paragraph id="HBFF89D0586C84E56890DCA6D3EFE7734"><enum>(5)</enum><text>a list of attorneys against whom more than 5 complaints have been submitted to the Office of Crime Victims’ Rights; and</text>
 </paragraph><paragraph id="H1568867797CC4CCCAE9873C67268A7A9"><enum>(6)</enum><text>a list of each alleged violation under section 3771 and information on how frequently each such violation was reported.</text>
							</paragraph></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block>
 </subsection><subsection id="HC408921C05F3423083953692A7C6C806"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/237">chapter 237</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>
