<section id="HF54DC86AD6A6403D881F8AB5954937B0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PFAS Safe Disposal Act</short-title></quote>. </text></section> <section id="H300AEEEBA9A14CC19DC010258F0D8F0D"><enum>2.</enum><header>Prohibition on waste incineration of PFAS</header><text display-inline="no-display-inline">Section 3004 of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6924">42 U.S.C. 6924</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H64719D50D3954E8A98A201B95FFDA2BD" style="OLC"> 
<subsection id="H29EB4B482A5D4A26A79F7DD04A778C3E"><enum>(z)</enum><header>PFAS wastes</header> 
<paragraph id="HBA33E46564734C67A71B8F488CE154C9"><enum>(1)</enum><header>Firefighting foam</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this subsection, the Administrator shall promulgate regulations requiring that when materials containing perfluoroalkyl and polyfluoroalkyl substances or aqueous film forming foam are disposed—</text> <subparagraph id="H2AAC63E46F0B4AA2ABE60CD60682CBB7"><enum>(A)</enum><text display-inline="yes-display-inline">all incineration is conducted in a manner that eliminates perfluoroalkyl and polyfluoroalkyl substances while also minimizing perfluoroalkyl and polyfluoroalkyl substances emitted into the air to the extent feasible; </text></subparagraph> 
<subparagraph id="H1BFDF86147B547C88F191FD53AA38BE9"><enum>(B)</enum><text>all incineration is conducted in accordance with the requirements of the Clean Air Act, including controlling hydrogen fluoride; </text></subparagraph> <subparagraph id="H7064CB14AB284853952721DB4B7EECEC"><enum>(C)</enum><text display-inline="yes-display-inline">any materials containing perfluoroalkyl and polyfluoroalkyl substances that are designated for disposal are stored in accordance with the requirement under part 264 of title 40, Code of Federal Regulations; and </text></subparagraph> 
<subparagraph id="H2DF58F7C88BA479AAF7ED4E0CA3972E5"><enum>(D)</enum><text>all incineration is conducted at a facility that has been permitted to receive waste regulated under this subtitle.</text></subparagraph></paragraph> <paragraph id="HE94FE94F251B47EEBA888E2AD20096D7"><enum>(2)</enum><header>Penalties</header><text display-inline="yes-display-inline">For purposes of section 3008(d), a waste subject to a prohibition under this subsection shall be considered a hazardous waste identified or listed under this subtitle.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
