and</text></subparagraph><subparagraph commented="no" id="HC7266D6C97F54720B277C9C3973F3B24"><enum>(D)</enum><text>$175,700,000 for fiscal year 2023, of which $10,000,000 shall be expended for carrying out such section 12 and $65,560,000 shall be expended for making grants.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H1A87F595718B4FED868221DFB4A0F973"><enum>(3)</enum><text>in paragraph (3) by striking <quote>$8,000,000 for each of fiscal years 2017 through 2019</quote> and inserting <quote>$9,000,000 for each of fiscal years 2020 through 2023</quote>.</text></paragraph></subsection><subsection id="H4432616B8D4A46229F95043CC7933B47"><enum>(c)</enum><header>Emergency response grants</header><text>Section 60125(b)(2) of title 49, United States Code, is amended by striking <quote>$10,000,000 for each of fiscal years 2012 through 2015</quote> and inserting <quote>$12,000,000 for each of fiscal years 2020 through 2023</quote>.</text></subsection><subsection id="HCBB2796709254F26A09FAF42CE5A6A7D"><enum>(d)</enum><header>Pipeline safety information grants to communities</header><text>Section 60130(c) of title 49, United States Code, is amended by striking <quote>section 2(b) of the PIPES Act of 2016, the Secretary shall expend $1,500,000 for each of fiscal years 2016 through 2019 to carry out this section. Such amounts shall not be derived from user fees collected under section 60301</quote> and inserting <quote>section 2(a) of the <short-title>SAFER Pipelines Act of 2019</short-title>, the Secretary shall expend $2,000,000 for each of fiscal years 2020 through 2023 to carry out this section</quote>.</text></subsection><subsection commented="no" id="H1DEB00A6B0B94889BC589DD2AD66F307"><enum>(e)</enum><header>State damage prevention programs</header><text>Section 60134(i) of title 49, United States Code, is amended by striking <quote>$1,500,000 for each of fiscal years 2012 through 2015</quote> and inserting <quote>$2,000,000 for each of fiscal years 2020 through 2023</quote>.</text></subsection><subsection commented="no" id="H9BFAC0291C9F4F299C87EA0C7D3E1FCF"><enum>(f)</enum><header>One-Call notification programs</header><text display-inline="yes-display-inline">Section 6107 of title 49, United States Code, is amended by striking <quote>$1,058,000 for each of fiscal years 2016 through 2019</quote> and inserting <quote>$2,000,000 for each of fiscal years 2020 through 2023</quote>.</text></subsection></section><section id="HEAE867300A644075AA6482B1D9C52C09"><enum>3.</enum><header>Purpose and general authority</header><subsection commented="no" id="H82C80249E8E646BE88E2790C5AF72AF8"><enum>(a)</enum><header>Cost-Benefit analysis</header><text display-inline="yes-display-inline">Section 60102(b) of title 49, United States Code, is amended—</text><paragraph id="H8AFDDD8FA78247A5944F6B50A93CB44B"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="HEBC75343E8B44111910C4222E05DF9D3"><enum>(A)</enum><text>by striking subparagraphs (C) through (E); and</text></subparagraph><subparagraph id="HA289A3AE967E4138B4A962FAA10733F1"><enum>(B)</enum><text>by redesignating subparagraphs (F) and (G) as subparagraphs (C) and (D), respectively; and</text></subparagraph></paragraph><paragraph id="H9D6FD25935C84DFDBC010AEF3EAFFFA4"><enum>(2)</enum><text>by striking paragraphs (3) through (7).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H17EC9FEB9FB6413AB713B5572EB0CD71"><enum>(b)</enum><header>Safety-Related condition reporting</header><paragraph commented="no" id="HE46E7DA027B1492990F5BC0DBE022292"><enum>(1)</enum><header>Availability of information to first responders</header><text>Section 60102(h) of title 49, United States Code, is amended—</text><subparagraph commented="no" id="H9FE23C5A0DFD489193A1BB9248CDB20E"><enum>(A)</enum><text>in paragraph (2) by striking <quote>Notice of the condition shall be given concurrently to appropriate State authorities.</quote>; and</text></subparagraph><subparagraph commented="no" id="H54F75F6233EA4CBE8DA2287E46BDF830"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="H9FBF6F2B991244599B7614A5BCC50AD1" style="OLC" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph commented="no" id="H1B9389B8EB3442C3B7BF59AE3E0166EB" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H482FADF29CC247A5B2AF9C0702F9316E"><enum>(A)</enum><text>Notice of the condition of an intrastate or interstate pipeline facility shall be given concurrently to appropriate State authorities.</text></subparagraph><subparagraph commented="no" id="H8050AB3DC348479DBB2C42477372E341" indent="up1"><enum>(B)</enum><text>The Secretary shall require that, upon receipt of a report on a safety-related condition submitted under this section, a State agency shall provide the report, upon request, to any relevant State emergency response commission, tribal emergency response commission, tribal emergency planning committee, local emergency planning committee, local government, or public agency responsible for emergency response, including any updates to the report received by the State agency.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="H259C98C9D5864B94A705FA1F069A8472"><enum>(2)</enum><header>Exemption removal</header><text>Section 60102(h) of title 49, United States Code, is further amended by adding at the end the following:</text><quoted-block id="H137101A53AB9423AADFF36C0CC1C0438" style="OLC" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph commented="no" id="HD1B8E57BA2524901AD050DA4E32B7C08" indent="up1"><enum>(4)</enum><text>Regulations prescribed by the Secretary under this section may not exempt a condition from being subject to reporting requirements if the exemption of such condition would reduce or eliminate the value of the reports as leading indicators of safety or environmental hazards.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H1BD8087A75524CF59368164863ED3695"><enum>(c)</enum><header>Automatic or remote-Controlled shut-Off valves</header><text>Section 60102(n)(1) of title 49, United States Code, is amended to read as follows:</text><quoted-block id="H7D5306A367F44962BBA6300002E2FD38" style="USC" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph commented="no" id="H5FE5CA34C0544D74BC7B9EBF4F6959D1"><enum>(1)</enum><header>High consequence areas</header><subparagraph id="H11B51569A8C84FE58A57E887713001C9"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of the <short-title>SAFER Pipelines Act of 2019</short-title>, the Secretary shall issue regulations to require operators of transmission pipeline facilities to install and use automatic or remote-controlled shut-off valves for such pipeline facilities that are located in high consequence areas (as defined in part 192 or 195 of title 49, Code of Federal Regulations, as applicable).</text></subparagraph><subparagraph commented="no" id="H95EFF6231E7C4DD3BD29552AB1DC52EB"><enum>(B)</enum><header>Other areas</header><text display-inline="yes-display-inline">The Secretary may issue regulations to require operators of transmission pipeline facilities to install and use automatic or remote-controlled shut-off valves for such pipeline facilities that are not located in areas described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="H22DDF3734B484222BAE53C4CB72D822D"><enum>(d)</enum><header>Crack management</header><text>Section 60102 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block id="H506BFB4BACA54382A40E98E6D2451734" style="USC" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection commented="no" id="HFB3D657DDEA34C0CA8EA4D5C900E0807"><enum>(q)</enum><header>Crack management</header><paragraph commented="no" display-inline="no-display-inline" id="HF57CA5F2CAE0483CB9E48CFFB1197E23"><enum>(1)</enum><header>In general</header><subparagraph commented="no" id="HF4AF8239FB11472AB03772A92055A4F8"><enum>(A)</enum><header>High consequence areas</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this subsection, the Secretary shall issue regulations to require operators of gas pipeline facilities and hazardous liquid pipeline facilities that are located in high consequence areas (as defined in part 192 or 195 of title 49, Code of Federal Regulations, as applicable) to address and repair cracks in such facilities.</text></subparagraph><subparagraph commented="no" id="HE04CC4AAFFE0425790847478250DA01D"><enum>(B)</enum><header>Other areas</header><text display-inline="yes-display-inline">The Secretary may issue regulations to require operators of gas pipeline facilities and hazardous liquid pipeline facilities that are not located in areas described in subparagraph (A) to address and repair cracks in such facilities.</text></subparagraph></paragraph><paragraph commented="no" id="HF79E6FB25B6E45898CF479B40302341A"><enum>(2)</enum><header>Requirements</header><text>Regulations issued under paragraph (1) shall specify—</text><subparagraph commented="no" id="H4FBD7ABEDBDF442CAE2746DDC96836DB"><enum>(A)</enum><text>under what conditions an engineering assessment of cracks, including environmentally assisted cracks, must be performed;</text></subparagraph><subparagraph commented="no" id="HF75BF2B0B3B8436CAFF2887230E2DD01"><enum>(B)</enum><text display-inline="yes-display-inline">acceptable methods for performing an engineering assessment on a pipeline, including the assessment of cracks coinciding with corrosion;</text></subparagraph><subparagraph commented="no" id="H93369F86922D46558F74808F2BAF821D"><enum>(C)</enum><text>criteria for determining whether the excavation of a pipeline segment is required due to a probable crack, and deadlines for completing any excavation so required;</text></subparagraph><subparagraph commented="no" id="HEB338532A7FC42C29118AECA68582706"><enum>(D)</enum><text>pressure restriction limits for pipelines for which a determination is made to excavate such pipeline pursuant to the requirements of subparagraph (C); and</text></subparagraph><subparagraph commented="no" id="H4E28913752E84FB78A6BE58D6887A089"><enum>(E)</enum><text>acceptable methods for determining crack growth for any cracks not required to be repaired under the regulations, including growth caused by fatigue, corrosion fatigue, or stress corrosion cracking, as applicable.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" id="H5FDD485ACFE54E66BE3B559BA1B7DFA3"><enum>4.</enum><header>State pipeline safety program certifications</header><text display-inline="no-display-inline">Section 60105(e) of title 49, United States Code, is amended—</text><paragraph commented="no" id="H53D6618927C9425B972ED0338CE1D08B"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>In carrying out this subsection, the Secretary may request that a State authority provide records of any inspection of a pipeline facility made by the State authority or any investigation described in subsection (c)(1)(B).</quote> after <quote>with the certification.</quote>; and</text></paragraph><paragraph commented="no" id="H00FB91C9BD6246218EE2F697927382DF"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after <quote>under this subsection</quote> the following: <quote>, including, upon request by the Secretary, by authorizing the Secretary to participate in such an inspection or investigation</quote>.</text></paragraph></section><section commented="no" id="HAD78E82DCF744B40A44C87C6E1C7EDFA"><enum>5.</enum><header>State pipeline safety grants</header><text display-inline="no-display-inline">Section 60107 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block id="HC702A9139A6A40439A019C956CC4CEFF" style="OLC" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection commented="no" id="HCBA1763433FC4E538EFB9A461ED380DB"><enum>(f)</enum><header>Grants for rendering aid</header><text>The Secretary may make an additional payment, to a State receiving a payment under subsection (a), to pay the costs incurred by the State in rendering aid to another State to respond to a natural disaster or major pipeline incident.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" id="H9035F250D3A242CFA70D3DC2D43DE526"><enum>6.</enum><header>Inspection and maintenance</header><text display-inline="no-display-inline">Section 60108 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block id="H238CC315EDDF4411AC8AB46E536C4CC1" style="OLC" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection commented="no" id="H26F98859036C426099DEF043DD924BDB"><enum>(f)</enum><header>Pipeline construction project data collection</header><text display-inline="yes-display-inline">The Secretary may require the owner or operator of a pipeline facility to provide to the Secretary information the Secretary determines appropriate regarding construction of the pipeline facility, including relating to any shutdown of such construction.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" id="HE2D59EACB0AA4D1CA24D85606DE4B59E"><enum>7.</enum><header>Risk analysis and integrity management programs</header><text display-inline="no-display-inline">Section 60109(c) of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H7981CDE9098B467D8EBBB0A0BAEC9A48" style="OLC" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph commented="no" id="HA3CF4ED3428C4ACEB091020550A695FC"><enum>(12)</enum><header>Use of direct assessments</header><subparagraph id="H14C3D6779BAF4A2BAD5CC570FB3C55E4"><enum>(A)</enum><header>Transmission pipeline facilities regulation</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this paragraph, the Secretary shall issue regulations for appropriate methods of assessment of transmission pipeline facilities under paragraph (3) that prioritize the use of other inspection methods before, in tandem with, or in lieu of, the use of direct assessment, including internal inspection devices or pressure testing, to provide a greater level of safety.</text></subparagraph><subparagraph commented="no" id="HBFF4BB013EAF486687E911CEA9B1864A"><enum>(B)</enum><header>Distribution pipelines study</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this paragraph, the Secretary shall submit to the Committees on Energy and Commerce and Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report containing—</text><clause commented="no" id="H5EE4419406324083B7D62F13F106C1A5"><enum>(i)</enum><text>the results of a study of methods of assessment of distribution pipelines that may be used under paragraph (3), other than direct assessment, to determine whether any such methods—</text><subclause commented="no" id="HD0936FC38AFF4255A8CAE58ABF348E20"><enum>(I)</enum><text display-inline="yes-display-inline">would provide a greater level of safety than direct assessment of such pipelines; and</text></subclause><subclause commented="no" id="H143060CDEE5142E6840D9B4C5ECFAD98"><enum>(II)</enum><text>are feasible; and</text></subclause></clause><clause commented="no" id="H4FC3D16F41D844DC857CAD12623CF17E"><enum>(ii)</enum><text>any recommendations based on such study.</text></clause></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></section><section commented="no" id="H3DA08A45F5314002B70539840B4F3D54"><enum>8.</enum><header>Community right-to-know and emergency preparedness</header><subsection commented="no" id="H852DFB4EB8F543538E0EB4BB8C192926"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 60116 of title 49, United States Code, is amended to read as follows:</text><quoted-block id="H71C8CB9B522049099EE4E1EFF7DA0901" style="USC" changed="added" reported-display-style="italic" committee-id="HPW00"><section commented="no" id="HF47F2D63C51D4BF3A4DE49989EEF45C7"><enum>60116.</enum><header>Community right-to-know and emergency preparedness</header><subsection commented="no" id="HAFC16279E960417AB2A2B22FB8CA5EA7"><enum>(a)</enum><header>Public education programs</header><paragraph commented="no" id="H5F417230E813407C8F8F98A55EEF576F"><enum>(1)</enum><header>In general</header><text>Each owner or operator of a gas or hazardous liquid pipeline facility shall carry out a continuing program to educate the public on—</text><subparagraph commented="no" id="HE19C9748862340C8BFFEFE140C843DA5"><enum>(A)</enum><text>the use of a one-call notification system prior to excavation and other damage prevention activities;</text></subparagraph><subparagraph commented="no" id="H9A0E4BF6B4BB4D0998543506207057F4"><enum>(B)</enum><text>the possible hazards associated with unintended releases from the pipeline facility; and</text></subparagraph><subparagraph commented="no" id="H95873AE92E814BD48043022830EDB07B"><enum>(C)</enum><text>the physical indications that a release from a pipeline facility may have occurred, the steps that should be taken for public safety in the event of such a release, and how to report such a release.</text></subparagraph></paragraph><paragraph commented="no" id="H794C4B1150924BF1B5E9DA111F08D63E"><enum>(2)</enum><header>Review and modification of existing programs</header><text>Not later than 1 year after the date of enactment of the <short-title>SAFER Pipelines Act of 2019</short-title>, each owner or operator of a gas or hazardous liquid pipeline facility shall—</text><subparagraph commented="no" id="H380B293A3E924EF19FA1F36902524519"><enum>(A)</enum><text>review its existing public education program for effectiveness, and modify the program as necessary; and</text></subparagraph><subparagraph commented="no" id="H3356BE318FFD435A812CA5D9206F6543"><enum>(B)</enum><text>submit to the Secretary for review a detailed description of its public education program, including any modifications made to the program under subparagraph (A).</text></subparagraph></paragraph><paragraph commented="no" id="H7B7D5C76FD62435DA31EFA48B8E96444"><enum>(3)</enum><header>Standards; material</header><text display-inline="yes-display-inline">The Secretary may—</text><subparagraph commented="no" id="HAF841522A4C04927BC44870F38A2C5B4"><enum>(A)</enum><text>issue standards for public education programs under this subsection, including standards providing for periodic review of such programs and modification of such programs as needed; and</text></subparagraph><subparagraph commented="no" id="HAB534F17946948B390C039FEC55EAE8B"><enum>(B)</enum><text>develop material for use in the programs.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H1F30BB221E0D4300957A7657D62307A2"><enum>(b)</enum><header>Liaison with State, local, and Tribal emergency response entities</header><paragraph commented="no" id="HCC4476932B104B4C864144A2ACA86F68"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>SAFER Pipelines Act of 2019</short-title>, an operator of a gas or hazardous liquid pipeline facility shall establish liaison with—</text><subparagraph commented="no" id="HAB0C5036EE9144A8916048F6DDBB1EBD"><enum>(A)</enum><text display-inline="yes-display-inline">any State entity with responsibility for pipeline emergency response in each State in which the pipeline facility is located;</text></subparagraph><subparagraph commented="no" id="H148EBBE2CE50490E80966D67E78B0DA8"><enum>(B)</enum><text>the appropriate local emergency planning entity in each emergency planning district in which the pipeline facility is located; and</text></subparagraph><subparagraph id="H17A2D23778F344DBB96673F90AC4008F"><enum>(C)</enum><text display-inline="yes-display-inline">any Tribal entity with responsibility for pipeline emergency response or planning in the area in which the pipeline facility is located.</text></subparagraph></paragraph><paragraph commented="no" id="HD6D2AB997DF14F8DB26706F8CF787879"><enum>(2)</enum><header>Communities without local or Tribal emergency planning or response entities</header><text display-inline="yes-display-inline">In a community for which a local or Tribal entity described in paragraph (1) does not exist, the operator of a gas or hazardous liquid pipeline facility shall liaise, to the extent practicable, with the local fire, police, and other emergency response entities.</text></paragraph><paragraph commented="no" id="H079E92012A01421889FC318CA578F45F"><enum>(3)</enum><header>Availability of information</header><subparagraph id="H36FC464CEAF74205948CFFD3DABA4189"><enum>(A)</enum><header>Evaluation</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of the <short-title>SAFER Pipelines Act of 2019</short-title>, and based on the consultation required under subparagraph (C), the Secretary shall conduct an evaluation and determine whether State, local, and Tribal entities described in paragraphs (1) and (2) have sufficient access to pipeline emergency response information.</text></subparagraph><subparagraph id="H9EEC29BD94AE420CA4CE40DF1530DB03"><enum>(B)</enum><header>Regulation</header><text display-inline="yes-display-inline">If the Secretary determines under subparagraph (A) that State, local, and Tribal entities described in paragraphs (1) and (2) do not have sufficient access to pipeline emergency response information, the Secretary shall issue regulations not later than 3 years after the date of enactment of the <short-title>SAFER Pipelines Act of 2019</short-title> specifying relevant emergency response information and requiring each operator of a gas or hazardous liquid pipeline facility to make such information available to the applicable State, local, and Tribal entities described in paragraphs (1) and (2).</text></subparagraph><subparagraph id="HBF6863BDE58C4D9CAFC94112CBFD40C1"><enum>(C)</enum><header>Consultation</header><text display-inline="yes-display-inline">In conducting the evaluation under subparagraph (A), the Secretary shall consult with national organizations representing State, local, and Tribal entities described in paragraphs (1) and (2) and the technical safety standards committees described in section 60115.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="H30A6C8085F2B4713AF4EB4D394F52B48"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/601">chapter 601</external-xref> of title 49, United States Code, is amended by striking the item relating to section 60116 and inserting the Community right-to-know and emergency preparedness.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="HF26ED15401254803B1CD8163A4D5F1A0" section-type="subsequent-section"><enum>9.</enum><header>Cost recovery for design reviews</header><text display-inline="no-display-inline">Section 60117(n)(1)(B)(i) of title 49, United States Code, is amended by striking <quote>$2,500,000,000</quote> and inserting <quote>$250,000,000</quote>.</text></section><section id="HBAF5D9E7F4024325A5D10917F1528936"><enum>10.</enum><header>Actions by private persons</header><text display-inline="no-display-inline">Section 60121 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H974C529393C74B678C969600690E9464" style="OLC" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="H45FBC65579C04E49BF819B6CA7ADA336"><enum>(e)</enum><header>Mandamus</header><text display-inline="yes-display-inline">A person may bring a civil action in an appropriate district court of the United States to compel the Secretary to perform a nondiscretionary duty under this chapter that the Secretary has failed to perform.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section display-inline="no-display-inline" id="H5D3120D88EAF40CD96FD6891A31FFF7B"><enum>11.</enum><header>Civil penalties</header><subsection id="HBA71A49233524450AB9F436223A0761A"><enum>(a)</enum><header>Increased penalties</header><text display-inline="yes-display-inline">Section 60122(a) of title 49, United States Code, is amended—</text><paragraph id="H2A0A39CD099E493AAADA714C68C7E7B7"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="HC8378B07E197409E89BB65FBB3686C97"><enum>(A)</enum><text>by striking <quote>$200,000</quote> and inserting <quote>$20,000,000</quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph commented="no" id="HF1E0A706CBE94E4DADDDF59F9B1AE332"><enum>(2)</enum><text>in paragraph (2) by striking the period at the end and inserting <quote>; and</text></paragraph><paragraph id="H2DCB698849EA4FAABD95A9C4621C95C8"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H0A73107988B541DEA925ADC492E4B794" style="USC" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="H6A014D7B1AFA40258670E3B4C820DBC0"><enum>(g)</enum><header>Requirements for covered facilities</header><text>Not later than 1 year after a pipeline facility described in subsection (a) becomes covered by such subsection, the operator of such facility shall provide to the Secretary the information required under paragraphs (1) through (4) of such subsection with respect to such facility.</text></subsection><subsection id="HCEC4F7859E244CF98F74B46D18F6D930"><enum>(h)</enum><header>Additional information on distribution lines</header><text display-inline="yes-display-inline">Not later than 2 years after a distribution line becomes covered by subsection (a), the operator of such distribution line shall provide to the Secretary, in addition to the information required under paragraphs (1) through (4) of subsection (a), information on the distribution systems that could lead to a point of failure, including—</text><paragraph id="HD1904334AA5847809664A4E962990AD3"><enum>(1)</enum><text>sensing lines;</text></paragraph><paragraph id="HA6B20972E86B49D493B0557DD8E3B51E"><enum>(2)</enum><text>regulator stations;</text></paragraph><paragraph id="H793DA43E42A04D4C969239B126F0A230"><enum>(3)</enum><text>automatic or remote-controlled shut-off valves; and</text></paragraph><paragraph id="HEF5D04DF19244FBAADE2051D28ADE4FD"><enum>(4)</enum><text>any other distribution pipeline technology or feature that the Secretary determines is appropriate to ensure safety.</text></paragraph></subsection><subsection commented="no" id="H48A3AA2C078443D9931F26B341896EB2"><enum>(i)</enum><header>Update to system</header><paragraph commented="no" id="H5F628F38DE5D4BDDB9BD3091FBAD7445"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this subsection—</text><subparagraph id="H683EF73C768C4F4A90073C505B0F6B16"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary shall determine whether the inclusion of additional information in the National Pipeline Mapping System would improve the preparation and response efforts of emergency responders with access to the System; and</text></subparagraph><subparagraph id="H4166F5092D2E44A691646D9718E43B5C"><enum>(B)</enum><text display-inline="yes-display-inline">if the Secretary determines under subparagraph (A) that inclusion of additional information in the National Pipeline Mapping System would improve the preparation and response efforts of emergency responders with access to the System, the Secretary shall issue regulations—</text><clause id="H6ED5B235DE5C41B29340C5E5594464B9"><enum>(i)</enum><text display-inline="yes-display-inline">identifying such additional information as the Secretary determines would improve emergency preparedness and response efforts; and</text></clause><clause id="HF2635400AED048CDBEA1CE9F57CC8B33"><enum>(ii)</enum><text>requiring each person providing information under subsection (a) to provide such additional information.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H95B6554F9F03458697311775A3B25674"><enum>(2)</enum><header>Considerations</header><text>In carrying out paragraph (1), the Secretary shall consider inclusion, to the extent practicable, of the following information:</text><subparagraph commented="no" id="H483E14BAD1F543119D4A5B699D6CEDC9"><enum>(A)</enum><text>A description of the pipeline facility, including the length of the facility and origin and termination points.</text></subparagraph><subparagraph commented="no" id="H2F778F9A536143DAB6E7E8C0B3DB176F"><enum>(B)</enum><text>A 5-year incident, and inspection and enforcement, history for the pipeline facility.</text></subparagraph><subparagraph commented="no" id="H9101B0E15A5F4BA89EBCB7385BA0ED40"><enum>(C)</enum><text>If applicable, a summary of any integrity management program activities related to the pipeline facility.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD835FD7FE14241F7BBAE01D1E71B42B1"><enum>(c)</enum><header>Additional information on distribution lines</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall issue such regulations as are necessary to specify the information required to be provided pursuant to section 60132(h) of title 49, United States Code.</text></subsection></section><section id="H44F87F976B124FDE90FBA75561BCC9F2"><enum>16.</enum><header>Congressional access to oil spill response plans</header><text display-inline="no-display-inline">Section 60138(a) of title 49, United States Code, is amended—</text><paragraph id="HED3C15F198544384A15E12531BD04217"><enum>(1)</enum><text>in paragraph (1) by striking <quote>and</quote>;</text></paragraph><paragraph id="HD13771FCC4494407871ED8334133A916"><enum>(2)</enum><text>in paragraph (2)(D) by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H2D5052E29E2B439CBB3BF5E099D77CCB"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="HE75C1C20BB2840B59325F32D761397EE" style="OLC" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="HA0E027319E4A48D582481EE2557EDB9A"><enum>(3)</enum><text>provide to a Member of Congress, upon request from such Member, a copy of any such plan, the contents of which the Secretary may not redact but may note, as the Secretary determines appropriate—</text><subparagraph id="HBDEF239654A54AE9A00B2B334D6F8E82"><enum>(A)</enum><text>proprietary information; and</text></paragraph><paragraph id="H34C7A9807AB54B6D876B204E3582D290"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="H3616849044144B76A4066949E666FA59" style="OLC" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="HB314129BFF054F608B5E8CEA38C3C533"><enum>(c)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text><paragraph id="H50D1F86ABB0D4E3F8F0214DE979C4787"><enum>(1)</enum><header>Coastal beaches</header><text>The term <term>coastal beaches</term> means the land between high and low water marks of coastal waters.</text></paragraph><paragraph id="H680BAEBC34754DA8B170D52CC0D2D8C3"><enum>(2)</enum><header>Coastal waters</header><text>The term <term>coastal waters</term> has the meaning given such term in section 4101 of the Shore Protection Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/33/2601">33 U.S.C. 2601</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H9C8BACE6E3BE4AB3A3E8FBE8F94A5CA1"><enum>(b)</enum><header>Coastal waters</header><text>Section 60109(b)(2) of title 49, United States Code, is amended by striking <quote>marine coastal waters</quote> and inserting <quote>coastal waters</quote>.</text></subsection><subsection id="HCCFB604292F94172825EBCDE4C655064"><enum>(c)</enum><header>Updates</header><text>Not later than 90 days after the date of enactment of this section, the Secretary of Transportation shall complete the revision required under section 19(b) of the PIPES Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/49/60109">49 U.S.C. 60109</external-xref> note), as amended by this section.</text></subsection></section><section id="H2C9B00B7881F43FB9ECDC02A6B3CD47B"><enum>21.</enum><header>User fees for underground natural gas storage facilities</header><text display-inline="no-display-inline">Section 60302 of title 49, United States Code, is amended—</text><paragraph id="HD1E51400728249B48FB30B205DC427E6"><enum>(1)</enum><text>in subsection (c)(2)—</text><subparagraph id="H5871959A46214827BC7602833EA5399C"><enum>(A)</enum><text>in subparagraph (A) by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HA7F9AFEDD22F44D392A8975F4FA61BE1"><enum>(B)</enum><text>in subparagraph (B) by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H5B27532521C7423F916E02A089613319"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="HDAF6797ABBA443C5BC7F99EE8056E8F0" style="OLC" changed="added" reported-display-style="italic" committee-id="HPW00"><subparagraph id="H6F7AF6AA9AB34DEC86B35AB5FD5C19D3"><enum>(C)</enum><text>may only be used to the extent provided in advance in an appropriations Act.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H29B7D635A8754859BC7D4FAC4449588C"><enum>(2)</enum><text>by striking paragraph (3) of subsection (c); and</text></paragraph><paragraph id="H6CE9DD82664F44D1A058AD40D463282D"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H39EE3B9CC83146C0BDCD53765583E080" style="OLC" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="HD262F2FE7F8D4EA786A8249729340F01"><enum>(d)</enum><header>Limitations</header><text>Fees imposed under subsection (a) shall be sufficient to pay for the costs of activities described in subsection (c), except that the total amount collected for a fiscal year may not be more than 105 percent of the total amount of the appropriations made for the fiscal year activities to be financed by fees.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section display-inline="no-display-inline" id="H436D6E6625854F74A423E4521CE65D9F"><enum>22.</enum><header>Seismicity</header><subsection id="HAA94F86768A5467DB2437E7AA0E860B6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this section, the Secretary of Transportation, in consultation with the Federal Energy Regulatory Commission, shall enter into an agreement with the National Academy of Sciences under which the National Academy of Sciences shall prepare a report containing—</text><paragraph id="H2DB1FD1DBEB2407B8D092E6963287CE3"><enum>(1)</enum><text>the results of a study that—</text><subparagraph id="HEDAED21DF53B452E961E801104ED8D7E"><enum>(A)</enum><text display-inline="yes-display-inline">evaluates the current Federal requirements for pipeline facility design, siting, construction, operation and maintenance, and integrity management, relating to seismicity, land subsidence, landslides, slope instability, frost heave, soil settlement, erosion, and other dynamic geologic conditions that may pose a safety risk;</text></subparagraph><subparagraph id="HD88C9B4207AD4AEC9551C25CC756B8E6"><enum>(B)</enum><text display-inline="yes-display-inline">identifies any discrepancy in such requirements that apply to operators of gas pipeline facilities and hazardous liquid pipeline facilities; and</text></subparagraph><subparagraph id="H4A6CD76CBE3F484AA7794779977BA60C"><enum>(C)</enum><text>identifies any deficiencies in industry practices related to such requirements; and</text></subparagraph></paragraph><paragraph id="H85EFF6FBC57B474DA8DD2C48E9A5690B"><enum>(2)</enum><text>any recommendations of the National Academy of Sciences based on such results.</text></paragraph></subsection><subsection id="H35124344987F43F2BCF0D1B78979BB13"><enum>(b)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Upon completion of the report prepared pursuant to subsection (a), the National Academy of Sciences shall submit to the Secretary of Transportation, the Committee on Transportation and Infrastructure of the House of Representatives, the Committee on Energy and Commerce of the House of Representatives, and the Committee on Commerce, Science, and Transportation of the Senate the report.</text></subsection><subsection id="H86CBCB36BB8046709ECD1F6F3009150A"><enum>(c)</enum><header>Pipeline facilities</header><text>In this section, the term <term>pipeline facility </term> has the meaning given that term in section 60101 of title 49, United States Code.</text></subsection></section><section id="H94AB98B837394527A83E8CF00D96C93F"><enum>23.</enum><header>Advancement of new pipeline safety technologies and approaches</header><subsection id="HE5941EAD05214086A38EEFA35D665435"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/601">Chapter 601</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H313A71D19B7E4546AA86B6482B7141D7" style="USC" changed="added" reported-display-style="italic" committee-id="HPW00"><section id="H30209424531448E0BA9D0E1B90DA3CD8"><enum>60145.</enum><header>Pipeline safety enhancement programs</header><subsection id="H43DC1AD68A2642949CB352E76D4579E2"><enum>(a)</enum><header>In general</header><text>The Secretary may establish and carry out limited safety-enhancing testing programs during the period of fiscal years 2020 through 2026 to evaluate innovative technologies and operational practices testing the safe operation of—</text><paragraph id="H8DA5104F51A6440EA5DD7FCAF3410AB0"><enum>(1)</enum><text>a natural gas pipeline facility; or</text></paragraph><paragraph id="HE668506EFCD44F358C01E0E8858DE37C"><enum>(2)</enum><text>a hazardous liquid pipeline facility.</text></paragraph></subsection><subsection id="H8C3DD2D5A46B4D53924E3CE2B9E3733D"><enum>(b)</enum><header>Limitations</header><paragraph id="H61A24FE288CF4F65BC90B1F42B0B6237"><enum>(1)</enum><header>In general</header><text>Such testing programs may not exceed—</text><subparagraph id="H32CE725CA3494B8EABCF216A91B218A6"><enum>(A)</enum><text>5 percent of the total miles of hazardous liquid pipelines in the United States; and</text></subparagraph><subparagraph id="HB21B7AB19E2E4D02B5E1272356C9329C"><enum>(B)</enum><text>5 percent of the total miles of natural gas pipelines in the United States.</text></subparagraph></paragraph><paragraph id="HC65C8E0FD15A46E184E8670EC22FAD53"><enum>(2)</enum><header>Individual operator mileage limitation</header><text>The Secretary shall limit the mileage an individual operator can test under each program established under subsection (a) to the lesser of—</text><subparagraph id="HFEC7981EF93243B098E2E3462FC6C9C6"><enum>(A)</enum><text>50 percent of the total pipeline mileage in the operator’s system; or</text></subparagraph><subparagraph id="HEFA35943A1414AF69905A798C050F345"><enum>(B)</enum><text>1,000 miles. </text></subparagraph></paragraph><paragraph id="HBEFDB6D3D911489694B7168A034E8A36"><enum>(3)</enum><header>High population areas; high consequence areas</header><text display-inline="yes-display-inline">Any program established under subsection (a) shall not be located in a high population area (as defined in section 195.450 of title 49, Code of Federal Regulations) or a high consequence area (as defined in section 192.903 of title 49, Code of Federal Regulations).</text></paragraph><paragraph id="H979EBA91D6D34425B2D909F25863A84B"><enum>(4)</enum><header>Unusually sensitive areas</header><text>Any program established under subsection (a) shall not be located in an unusually sensitive area (as described in section 60109(b)).</text></paragraph><paragraph id="H0CCED0E61CB646349DB275E055163EA3"><enum>(5)</enum><header>High consequence areas for hazardous liquid pipelines</header><subparagraph id="H7276F6DD416A4DDF9A018C2FF218D9C5"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this section, the Secretary shall submit to Congress a report containing an examination of the benefits and costs of prohibiting testing in high consequence areas (as defined in section 195.450 of title 49, Code of Federal Regulations) for hazardous liquid pipelines.</text></subparagraph><subparagraph id="H02B18BFAFDE24553A764EFA3F5CAC1C5"><enum>(B)</enum><header>Contents of report</header><text>The report described in subparagraph (A) shall examine the safety benefits of allowing testing for hazardous liquid pipelines in high consequence areas and whether additional testing conditions are required to protect such areas while conducting the program established under subsection (a) in such areas. </text></subparagraph></paragraph><paragraph id="H492311BF79004C48B65B7FC5B06A5DC6"><enum>(6)</enum><header>Restriction</header><subparagraph id="H3BA841F42DEF49FEB00EC242467C5A9E"><enum>(A)</enum><header>In general</header><text>The Secretary shall not approve a program under this section until the report required under paragraph (5) is submitted to Congress.</text></subparagraph><subparagraph id="H4F68EC67F2C24F9C980339F8FD225347"><enum>(B)</enum><header>Exception</header><text>The limitation in subparagraph (A) shall not apply if—</text><clause id="H1FA2642EC0964BA78CFBA305264FAD55"><enum>(i)</enum><text>the Secretary determines that there is a need for a program under this section; and</text></clause><clause id="H03F9CD8B44BF4B96A790FA53916F7B2F"><enum>(ii)</enum><text display-inline="yes-display-inline">more than 1 year has passed since the date of enactment of this section. </text></clause></subparagraph></paragraph></subsection><subsection id="H083399B1C8DF42348792969069FEC80E"><enum>(c)</enum><header>Duration</header><text>The term of a testing program established under subsection (a) shall be not more than a period of 4 years beginning on the date of approval of the program.</text></subsection><subsection id="H39593108BF0F4B54915E7148D0A5E2BD"><enum>(d)</enum><header>Safety standards</header><paragraph id="HE0C01EB45C904679848968D537F1881D"><enum>(1)</enum><header>In general</header><text>The Secretary shall require, as a condition of approval of a testing program under subsection (a), that the safety measures in the testing program are designed to achieve a level of safety that is greater than, or equivalent to, the level of safety required by this chapter.</text></paragraph><paragraph id="H8457F3463B214DCFA06F426FCDD29DBC"><enum>(2)</enum><header>Determination</header><subparagraph id="H4E2BE3DED5D3456ABAE399E22C3138D6"><enum>(A)</enum><header>In general</header><text>The Secretary may issue an order under subparagraph (A) of section 60118(c)(1) to accomplish the purpose of a testing program for a term not to exceed the time period described in subsection (c) if the condition described in paragraph (1) is met, as determined by the Secretary.</text></subparagraph><subparagraph id="HC3301609BB264C32B105754C9F549A0A"><enum>(B)</enum><header>Limitation</header><text>An order under subparagraph (A) shall pertain only to those regulations that would otherwise prevent the use of the safety technology to be tested under the testing program.</text></subparagraph></paragraph></subsection><subsection id="H940F0AD311F74FC3AE49D9A4EA37AE5E"><enum>(e)</enum><header>Considerations</header><text>In establishing a testing program under subsection (a), the Secretary shall consider—</text><paragraph id="H2B5034125AB34E23B5F6766458846683"><enum>(1)</enum><text display-inline="yes-display-inline">the accident or incident record of the owners or operators participating in the program;</text></paragraph><paragraph id="HA5A03853689B4F259749F950B7810258"><enum>(2)</enum><text>whether the owners or operators participating in the program have a safety management system in place and how the application for such program proposes to eliminate or mitigate any potential safety risks;</text></paragraph><paragraph id="HC408A3914C8D4126A8609CFE05E7C491"><enum>(3)</enum><text>a description of any measures or activities the owners or operators participating in the program propose to eliminate or mitigate any environmental risks; </text></paragraph><paragraph id="H0A1168C78D604959BF060971C5037235"><enum>(4)</enum><text>a description of any previous testing and the outcome of such testing of the proposed safety technology through a research and development program carried out by—</text><subparagraph id="H6AC2AA40A18D44A385C3FB329CBE53BF"><enum>(A)</enum><text>the Secretary;</text></subparagraph><subparagraph id="H06AEFD02456E4F288CBEC86B40E9A529"><enum>(B)</enum><text>collaborative research development organizations; or</text></subparagraph><subparagraph id="H3918B97C065249E9978C9097C8DCD751"><enum>(C)</enum><text>other institutions;</text></subparagraph></paragraph><paragraph id="H9E48E349DE184011BB12451D7107F3AC"><enum>(5)</enum><text>whether there have been other testing programs granted under subsection (a) similar to the proposed safety technology and the outcome of such programs; and</text></paragraph><paragraph id="H53CD8A2FADB44EEC943F7E4B06F93700"><enum>(6)</enum><text display-inline="yes-display-inline">whether the pipeline segments tested by the program could affect, or are outside of, a high consequence areas (as defined in sections 192.903 and 195.450 of title 49, Code of Federal Regulations) and unusually sensitive areas (as described in section 60109(b)).</text></paragraph></subsection><subsection id="H3DCDBDC7E0854650BC3D2F9889D54ADD"><enum>(f)</enum><header>Multiple operators</header><paragraph id="H81B5BB246FE941AC89B96BA326F95391"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may select up to 5 owners or operators to carry out a testing program under subsection (a) in a single application.</text></paragraph><paragraph id="H9F4737F3D44C42568A3B942E7F55D2EA"><enum>(2)</enum><header>Determination</header><text display-inline="yes-display-inline">In selecting owners or operators under paragraph (1), the Secretary shall determine that each testing program proposed by such owners or operators—</text><subparagraph id="HC2DD69D6B29B45C0955599FC05E3A07E"><enum>(A)</enum><text>meet the requirements of subsection (d)(1);</text></subparagraph><subparagraph id="H19C70BAEFC6249AAACA33C4651F9E716"><enum>(B)</enum><text>test a similar technology, best practice, or related set of technologies and best practices; and</text></subparagraph><subparagraph id="HE72541889043468C86A00A5A36047ECF"><enum>(C)</enum><text>provides appropriate testing conditions for the technologies or practices being used. </text></subparagraph></paragraph><paragraph id="H35801E403C6348BE9935EBE6823B3D61"><enum>(3)</enum><header>Authority to revoke participation</header><text display-inline="yes-display-inline">If an owner or operator participating in a program established under subsection (a), the Secretary may revoke permission to participate in such program if—</text><subparagraph id="H62E6129A269D464983EBE01B71D17F0B"><enum>(A)</enum><text>the owner or operator is involved in an accident or incident and the testing program is determined to be the cause or a contributing factor of such accident or incident; or</text></subparagraph><subparagraph id="HCAFC9E95B5694236A29C790F3B91BB2E"><enum>(B)</enum><text>the Secretary determines revocation of permission is warranted for public safety reasons. </text></subparagraph></paragraph></subsection><subsection id="H796C000930A94E64BF9713453C9ACD27"><enum>(g)</enum><header>Data and findings</header><paragraph id="H81E1E3F31BBA4925BFFFF49D8CA8D772"><enum>(1)</enum><header>In general</header><text>As a participant in a testing program established under subsection (a), an owner or operator shall submit to the Secretary detailed findings and a summary of data collected as a result of participation in the testing program.</text></paragraph><paragraph id="HC34E1BAC02A14F04AB325C364BC814DF"><enum>(2)</enum><header>Public report</header><text display-inline="yes-display-inline">To the extent practicable, the Secretary shall make a yearly interim report publicly available on the website of the Department of Transportation for any ongoing testing program established under subsection (a) summarizing the progress of such program.</text></paragraph></subsection><subsection id="H23F6D9B210814D6A924CFE79A52F68DB"><enum>(h)</enum><header>Authority to revoke participation</header><text display-inline="yes-display-inline">The Secretary shall immediately revoke participation in a testing program under subsection (a) if—</text><paragraph id="HDF85B9DC1A6245129CC521B1E5161638"><enum>(1)</enum><text display-inline="yes-display-inline">the participant has an accident or incident involving a death, or personal injury necessitating in-patient hospitalization and the testing program is determined to be the cause or a contributing factor to such accident or incident;</text></paragraph><paragraph id="HF9A443B2D7464D00B2176F3DC4A047DD"><enum>(2)</enum><text display-inline="yes-display-inline">the participant fails to comply with the terms and conditions of the testing program; or</text></paragraph><paragraph id="H663DF1431A7A4946952135EE99F629BF" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">in the determination of the Secretary, continued participation in the testing program by the participant would be unsafe.</text></paragraph></subsection><subsection id="HE8587BBB9C5642548F00EC849DF9AC09"><enum>(i)</enum><header>Authority to terminate program</header><text>The Secretary shall immediately terminate a testing program under subsection (a) if continuation of the testing program would not be consistent with the goals and objectives of this chapter.</text></subsection><subsection id="H41AF8B1956B04DA08636EAA2ED3564F1"><enum>(j)</enum><header>State rights</header><paragraph id="H1B7369A117B44AE597D1B4911C375650"><enum>(1)</enum><header>Exemption</header><text>Except as provided in paragraph (2), if a State submits to the Secretary notice that the State requests an exemption from any testing program considered for establishment under this section, the State shall be exempt.</text></paragraph><paragraph id="H25E3266B86A94A8D898E876F42396213"><enum>(2)</enum><header>Limitations</header><subparagraph id="H8419A88D5AEC43DEA626B34C8D0680EA"><enum>(A)</enum><header>In general</header><text>The Secretary shall not grant a requested exemption under paragraph (1) after a testing program is established.</text></subparagraph><subparagraph id="H382BC358E1E84D16B9545447BC8633E1"><enum>(B)</enum><header>Late notice</header><text>The Secretary shall not grant a requested exemption under paragraph (1) if the notice submitted under that paragraph is submitted to the Secretary more than 10 days after the date on which the Secretary issues an order providing an effective date for the testing program.</text></subparagraph></paragraph><paragraph id="H9DDC1186D0D44733A2DAED0DDB14F1D2"><enum>(3)</enum><header>Exception</header><text display-inline="yes-display-inline">A State shall be eligible to withdraw from a testing program if an owner or operator conducting such testing program in such State has an incident involving a death, a personal injury necessitating in-patient hospitalization, or a reportable accident (within the meaning of sections 195.50 and 191.3 of title 49, Code of Federal Regulations), and the testing program is determined to be the cause or a contributing factor to such incident.</text></paragraph><paragraph id="H5300CE55F879450BB8EC9A91BC476BA7"><enum>(4)</enum><header>Effect</header><text>If a State has not submitted a notice requesting an exemption under paragraph (1), the State shall not enforce any law (including regulations) that is inconsistent with a testing program in effect in the State under this section.</text></paragraph></subsection><subsection id="H64327E390D284715A75681FBA5F132E1"><enum>(k)</enum><header>Program review process and public notice</header><paragraph id="HE5E9C029A2DD43F1A66A3F605EA604F6"><enum>(1)</enum><header>In general</header><text>The Secretary shall publish in the Federal Register a notice of each testing program under subsection (a), including the order to be considered, and provide an opportunity for public comment for not less than 60 days.</text></paragraph><paragraph id="HE97076F21D4944F2AEC9DC6572E775F4"><enum>(2)</enum><header>Communication with States</header><subparagraph id="HE8CADC11C5444EAD9611F8DDF906C1B0"><enum>(A)</enum><header>In general</header><text>As part of carrying out the process described in paragraph (1), the Secretary shall individually notify, at the time described in paragraph (1), the relevant authorities in the States such testing programs would be conducted in.</text></subparagraph><subparagraph id="HACD7CBDC73764B04B649429BD1A2EBEC"><enum>(B)</enum><header>Notification contents</header><text>The notification described in subparagraph (A) shall include a specific list of the laws or regulations that the State would not be allowed to enforce pursuant to subsection (j)(4) should such testing program go into effect, and the ability of the State to request an exemption from the program.</text></subparagraph></paragraph><paragraph id="HC8F7CF1AA3AC43F4B5C6453184420B68"><enum>(3)</enum><header>Response from Secretary</header><text>Not later than the date on which the Secretary issues an order providing an effective date of a testing program noticed under paragraph (1), the Secretary shall respond to each comment submitted under that paragraph.</text></paragraph></subsection><subsection id="H65DAF4AD79A440F5B272C14D50842C81"><enum>(l)</enum><header>Report to Congress</header><text>At the conclusion of each testing program, the Secretary shall make publicly available on the website of the Department of Transportation a report containing—</text><paragraph id="HFAC9E2E64ED44D8E954B875D87718D19"><enum>(1)</enum><text>the findings and conclusions of the Secretary with respect to the testing program; and</text></paragraph><paragraph id="HD1F6672684BD4922B4892E1014C2B368"><enum>(2)</enum><text>any recommendations of the Secretary with respect to the testing program, including any recommendations for amendments to laws (including regulations) and the establishment of standards, that—</text><subparagraph id="H9E19F88DA4134E2CB2B114C44B6BC39E"><enum>(A)</enum><text>would enhance the safe operation of interstate gas or hazardous liquid pipeline facilities; and</text></subparagraph><subparagraph id="H0B0ACF86BA544F10AD5D15B168EC5449"><enum>(B)</enum><text>are technically, operationally, and economically feasible.</text></subparagraph></paragraph></subsection><subsection id="H7C8C887DE18340BF8D01B5C69BC72466"><enum>(m)</enum><header>Standards</header><text>If a report under subsection (l) indicates that it is practicable to establish technically, operationally, and economically feasible standards for the use of a safety-enhancing technology and any corresponding operational practices tested by the testing program described in the report, the Secretary, as soon as practicable after submission of the report, may promulgate regulations consistent with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5 (commonly known as the <quote>Administrative Procedures Act</quote>) that—</text><paragraph id="HBA980311C96B459C89E420D6FF651B5B"><enum>(1)</enum><text>allow operators of interstate gas or hazardous liquid pipeline facilities to use the relevant technology or practice to the extent practicable; and</text></paragraph><paragraph id="H794D812C09124E21B3526545F096222B"><enum>(2)</enum><text>establish technically, operationally, and economically feasible standards for the capability and deployment of the technology or practice.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2956752F04DF44FAB317CFC22211D33F"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/601">chapter 601</external-xref> of title 49, United States Code, is further amended by adding at the end:</text><quoted-block id="H835E8C5AE0E04DBDA75B1F8FB5BB91CB" style="USC" changed="added" reported-display-style="italic" committee-id="HPW00"><toc changed="added" reported-display-style="italic" committee-id="HPW00"><toc-entry level="section">60145. Pipeline safety enhancement programs.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H91FA0B56AFCB4B6C827580699DFDFA13"><enum>24.</enum><header>Workforce</header><subsection id="HF91BB3F6202046A29F9DFD817AE6C99A"><enum>(a)</enum><header>Staffing</header><paragraph id="HB27FA0D2B8CD4E88AC4E8732A1157ACC"><enum>(1)</enum><header>In general</header><text>The Secretary of Transportation shall increase the number of full-time equivalent employees (as compared to the number of positions on the date of enactment of this Act) by—</text><subparagraph id="H9E91F7009A864F249B170F0BF3CCF1B4"><enum>(A)</enum><text>8 full-time employees with subject matter expertise in pipeline safety, pipeline facilities, and pipeline systems to finalize outstanding rulemakings and fulfill mandates for the Office of Pipeline Safety of the Pipeline and Hazardous Materials Safety Administration; and</text></subparagraph><subparagraph id="H1BB190F592924092A7775F55FD16CA8D"><enum>(B)</enum><text>3 full-time attorneys, with environmental expertise, in the Office of Chief Counsel of the Pipeline and Hazardous Materials Safety Administration.</text></subparagraph></paragraph><paragraph id="H1286F763D7A44C08BE5668CBEF2BAD44"><enum>(2)</enum><header>Pipeline inspection and enforcement personnel</header><text>The Secretary shall ensure that the number of positions for pipeline inspection and enforcement personnel in the Office of Pipeline Safety of the Pipeline and Hazardous Materials Safety Administration does not fall below the following:</text><subparagraph id="H0E716FCFBC5C4005873B62CEAD1F2789"><enum>(A)</enum><text>222 for fiscal year 2020.</text></subparagraph><subparagraph id="H1617650BAAE3405F82B3C2F3B5E1314E"><enum>(B)</enum><text>233 for fiscal year 2021.</text></subparagraph><subparagraph id="H6E4BA0A8A17E4E849A59D1B012EE5254"><enum>(C)</enum><text>245 for fiscal year 2022.</text></subparagraph><subparagraph id="HBED5D40214D348A49A273DDB9C51025E"><enum>(D)</enum><text>258 for fiscal year 2023.</text></subparagraph><subparagraph id="H770FE4FD6CC94C8185F03504A8FAA443"><enum>(E)</enum><text>272 for fiscal year 2024.</text></subparagraph></paragraph></subsection><subsection id="H1892AF78F0BA437FAC136959DD552F31"><enum>(b)</enum><header>Recruitment and retention authorities</header><text display-inline="yes-display-inline">The Secretary shall request authority from the Office of Personnel Management to use incentives, as necessary, to recruit and retain a qualified workforce, including for inspection and enforcement personnel and subject matter experts dedicated to rulemaking activities in the Office of Pipeline Safety of the Pipeline and Hazardous Materials Safety Administration—</text><paragraph id="HF67284061C7F4516A3444A5E26C167DA"><enum>(1)</enum><text display-inline="yes-display-inline">special pay rates permitted under section 5305 of title 5, United States Code; and</text></paragraph><paragraph id="H9F5454C7E0744FB6B71B82AEC591DCF9"><enum>(2)</enum><text>repayment of student loans accompanied by a continued service agreement, permitted under section 5379 of title 5, United States Code.</text></paragraph></subsection></section><section id="H9DDB4128A8024C138F3E1EECCB027BC3"><enum>25.</enum><header>Hiring report</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, and annually thereafter through calendar year 2023, the Administrator of the Pipeline and Hazardous Materials Safety Administration shall submit to Congress a report on the efforts of the Administration to hire women, minorities, and veterans as inspectors since January 1, 2012.</text></section><section commented="no" id="H4A24AA60748244CBA8E54727D78A75B2"><enum>26.</enum><header>Plan to combine State damage prevention and one-call notification programs</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall submit to the Committees on Energy and Commerce and Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a plan to combine the activities carried out by the Secretary under sections 6106 and 60134 of title 49, United States Code.</text></section><section display-inline="no-display-inline" id="HD6358CF1F6E3483791D71F14EFB185ED" section-type="subsequent-section"><enum>27.</enum><header>Gas gathering lines</header><subsection id="H65502671EE5D4D37A330C79F07BAD451"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary of Transportation shall issue final regulations on gas gathering lines based on the notice of proposed rulemaking published on April 8, 2016, titled <quote>Pipeline Safety: Safety of Gas Transmission and Gathering Pipelines</quote> (81 Fed. Reg. 20722).</text></subsection><subsection id="HD319343DF1974F348183D841F737A192"><enum>(b)</enum><header>Regulations</header><text>The final regulations issued under subsection (a) shall cover—</text><paragraph id="H470D7E1B9AF2429EA22B1AB39BEB8024"><enum>(1)</enum><text>all gas gathering lines in class 4, class 3, and class 2 locations, as classified in section 192.5 of title 49, Code of Federal Regulations; and</text></paragraph><paragraph id="HDCDFE02A68F54D709F51D3FB824E6D8C"><enum>(2)</enum><text>gas gathering lines with a diameter of at least 8 inches that are located in a class 1 location, as classified in section 192.5 of title 49, Code of Federal Regulations.</text></paragraph></subsection></section><section id="HF3BD2AD1AD3C41CABB0245E65520417D"><enum>28.</enum><header>Regulatory updates</header><subsection id="H2F967CC1874446CF9AA425CF1884EA2C"><enum>(a)</enum><header>Definition of outstanding regulation</header><text>In this section, the term <term>outstanding regulation</term> means—</text><paragraph id="HD483CC756BD44787B211035CFCA7D2FC"><enum>(1)</enum><text>a final rule required to be issued under the Pipeline Safety, Regulatory Certainty, and Job Creation Act of 2011 (<external-xref legal-doc="public-law" parsable-cite="pl/112/90">Public Law 112–90</external-xref>; 125 Stat. 1904) that has not been published in the Federal Register;</text></paragraph><paragraph id="H26AFFB95C5FA4323B36C4458CD9510C1"><enum>(2)</enum><text display-inline="yes-display-inline">a final rule required to be issued under the Protecting our Infrastructure of Pipelines and Enhancing Safety Act of 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/183">Public Law 114–183</external-xref>; 130 Stat. 514) that has not been published in the Federal Register; and</text></paragraph><paragraph id="H51335743CE6847EFA4A247FFCFEF5465"><enum>(3)</enum><text>any other final rule regarding gas or hazardous liquid pipeline facilities required to be issued under this Act or an Act enacted before the date of enactment of this Act that has not been published by the date required in such Act in the Federal Register.</text></paragraph></subsection><subsection id="HF9442BD844014EC796DEA4A376556200"><enum>(b)</enum><header>Requirement</header><text>Not later than 5 days after the date of enactment of this Act, and every 30 days thereafter until an outstanding regulation is published in the Federal Register, the Secretary of Transportation shall provide an update on the status of each outstanding regulation by—</text><paragraph id="H975F00684CA74A8F90D3D0DA23C892FB"><enum>(1)</enum><text>publishing on a publicly available website of the Department of Transportation information regarding the status of each outstanding regulation; and</text></paragraph><paragraph id="HAF643E5D11594D05948254D94B11D589"><enum>(2)</enum><text display-inline="yes-display-inline">submitting notification to the Committee on Transportation and Infrastructure of the House of Representatives, the Committee on Energy and Commerce of the House of Representatives, and the Committee on Commerce, Science, and Transportation of the Senate.</text></paragraph></subsection><subsection id="H1823722E52D54D9D96618BCEF66780A2"><enum>(c)</enum><header>Contents</header><text>The information described in section (b)(1) shall include—</text><paragraph id="H6056C8B57C764727924CEF7ECD6A2D39"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to an outstanding regulation under review by the Office of the Secretary for not more than 45 days—</text><subparagraph id="HB7BA7FCDD3064542933ABFE550F9D416"><enum>(A)</enum><text>the date that such outstanding regulation was submitted to the Office of the Secretary for review; and</text></subparagraph><subparagraph id="H25C2895C41734227BBEB689CB54C0C62"><enum>(B)</enum><text>the staff allocations within the Office of the Secretary with respect to each such outstanding regulation and any resource constraints affecting the review;</text></subparagraph></paragraph><paragraph id="HA228D15CF47248539B82D704B99797B3"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to an outstanding regulation under review by the Office of the Secretary for more than 45 days—</text><subparagraph id="H5107BDF370F34776B61C96995F2C0C72"><enum>(A)</enum><text>the information described in paragraph (1);</text></subparagraph><subparagraph id="H3B1C83CCD8E9486D9030A43E24570643"><enum>(B)</enum><text display-inline="yes-display-inline">a description of why such outstanding regulation is under extended review;</text></subparagraph><subparagraph id="H3E8CB14BC5BE44D3A200EE5D6A1B91DD"><enum>(C)</enum><text display-inline="yes-display-inline">a work plan for finalizing review of such outstanding regulation; and</text></subparagraph><subparagraph id="H3937F4E6772E40FC8A2D8BC0455BC2C7"><enum>(D)</enum><text>the date of anticipated completion of such review;</text></subparagraph></paragraph><paragraph id="H8BFF155560DF45079040FAA23881272D"><enum>(3)</enum><text display-inline="yes-display-inline">with respect to an outstanding regulation that has been transmitted to neither the Office of Management and Budget nor the Office of the Secretary—</text><subparagraph id="HAA12E1B589874598BD11971889AA4550"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the work plan for such outstanding regulation;</text></subparagraph><subparagraph id="H8878651765A14182B69F2A4442E0123A"><enum>(B)</enum><text>the anticipated date on which such regulation will be transmitted to the Office of Management and Budget and the Office of the Secretary;</text></subparagraph><subparagraph id="HDB860D15F6304E3C91E3D2D2C00136F5"><enum>(C)</enum><text>the staff allocations with respect to such outstanding regulation;</text></subparagraph><subparagraph id="HB48FF05C98FA421F84DED6356E56636E"><enum>(D)</enum><text>any resource constraints affecting the rulemaking process for such outstanding regulation; and</text></subparagraph><subparagraph id="H1BA8234313A549DBAFC1FDE835AEE6B7"><enum>(E)</enum><text>any other details associated with the development of such outstanding regulation that affect the progress of the rulemaking process with respect to such outstanding regulation; and</text></subparagraph></paragraph><paragraph id="H8D8F0B946BD24A118A057CBC3E50FB48"><enum>(4)</enum><text display-inline="yes-display-inline">with respect to an outstanding regulation that has been transmitted to the Office of Management and Budget—</text><subparagraph id="H1D87B031C7F24904AD1F68C1C5BCDD42"><enum>(A)</enum><text>the date such outstanding regulation was submitted to the Office of Management and Budget for review; and</text></subparagraph><subparagraph id="HEBEC91504896411E889C92AD19C37004"><enum>(B)</enum><text>a statement of whether the outstanding regulation remains under review by the Office of Management and Budget or has been transmitted for further review by the Office of the Secretary or the Administrator of the Pipeline and Hazardous Materials Safety Administration.</text></subparagraph></paragraph></subsection></section><section id="H2B38633712D248F4A2B51A1E2C2DCAA8" section-type="subsequent-section"><enum>29.</enum><header>Component verification</header><subsection id="HDA809A1E6E004ADFB1D56E4B0A23DA8D"><enum>(a)</enum><header>In general</header><paragraph id="H51907D5ECC064A67BFFD53C7383A6F6C"><enum>(1)</enum><header>Verification</header><text>Section 60102(e) of title 49, United States Code, is amended—</text><subparagraph id="H635DF8BE1B77488CBCC85EAE39884DE0"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H42A7C9E0BC914B278497D3002C83E3FA"><enum>(i)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end; and</text></clause><clause id="H009123DF0BA0466C8B7D35CEB6431B3F" indent="up1"><enum>(ii)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; </text></clause></subparagraph><subparagraph id="H35B3C5B005AE47DFB1EA3D9892C66838"><enum>(B)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively (and by adjusting the margins accordingly);</text></subparagraph><subparagraph id="H88D9CE7C62A04091AEC17A69BA3746EC"><enum>(C)</enum><text>by striking <quote>The Secretary shall</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HA358F9D7B6DD406AA4F4227628A4E727" style="USC" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="HC4C86287997D4B5DA56CDDEB66DCA678"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HA015FEFD15B1450A8691879A607414E9"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H943DFF928DCD43D5866A497AE9EC8497" style="USC" changed="added" reported-display-style="italic" committee-id="HPW00"><subparagraph id="H256A61B3CCF3427899E3F2740125CCCC"><enum>(C)</enum><text display-inline="yes-display-inline">for facilities identified under subparagraphs (A) and (B), shall include, for all pipes and related components for which the regulations of the Pipeline and Hazardous Materials Safety Administration require compliance with a standard incorporated by reference for such pipe or related component, documentation of verification that such pipe or related component meets such standard.</text></subparagraph><paragraph id="H4ECAE55AE974455CA9BDFD65699AA585"><enum>(2)</enum><header>Verification</header><text display-inline="yes-display-inline">The verification described in paragraph (1)(C) shall be conducted by—</text><subparagraph id="HBF3BA0D2239C457E8D2FA4C427B1DE90"><enum>(A)</enum><text display-inline="yes-display-inline">an independent third party on behalf of the operator;</text></subparagraph><subparagraph id="H568755EC1F48482A9DAB63054733AF01"><enum>(B)</enum><text display-inline="yes-display-inline">the operator, so long as such operator does not pay, or receive payment from, a manufacturer, distributor, or supplier of a pipe or related component described in paragraph (1)(C) for such verification; or</text></subparagraph><subparagraph id="H780ACCF86F744375BBBA665BF8A96761"><enum>(C)</enum><text display-inline="yes-display-inline">a United States manufacturer of a pipe or related component described in paragraph (1)(C) that is accredited by the International Organization for Standardization.</text></subparagraph></paragraph><paragraph id="H5D8CA250EE5648A7B7C570EFDA63DFE2"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph id="H2767A160EE034028BC6EE1982FEE35C4"><enum>(A)</enum><header>Verification</header><text display-inline="yes-display-inline">The term <term>verification</term> means sufficient testing and auditing to confirm that a standard has been met in the production of a pipe or related component.</text></subparagraph><subparagraph id="HF38BF657394B412DB8D1D9E5038B84C7"><enum>(B)</enum><header>Independent third party</header><text>The term <term>independent third party</term> means an entity that—</text><clause id="HC76375EE197D45AE93AB2E85FC3FB64C"><enum>(i)</enum><text display-inline="yes-display-inline">does not have a commercial relationship with the manufacturer or supplier of a pipe or related component; and</text></clause><clause id="HB2CD540D555D4F21A2D99AB1847FAF80"><enum>(ii)</enum><text>is accredited by the International Organization for Standardization.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HEE3AC7542024463FBF54CF253C8486E5"><enum>(2)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by this subsection shall only apply to pipes and components that are—</text><subparagraph id="H6D558F4BD9054DE58A521E4D0965B51C"><enum>(A)</enum><text>covered by the amendments made by such subsection; and</text></subparagraph><subparagraph id="HEDD0B56D3CED4CE78ED50F5AC2560C8C"><enum>(B)</enum><text>purchased on or after the date of enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="H3CB45C36F7914C0EB30DA63EC628AF21"><enum>(b)</enum><header>Review of compliance of flanges and fittings</header><paragraph id="H49CE4FA5787E4D6CB72691B22749494A"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States shall complete a review of the compliance of flanges and fittings of a pipeline facility (as such term is defined in section 60101 of title 49, United States Code) with Federal requirements.</text></paragraph><paragraph id="HDEB23386CF22450389D8D0FA237C8263"><enum>(2)</enum><header>Contents of review</header><text>The review required under paragraph (1) shall include—</text><subparagraph id="H9AE5B1BAD6D646FAB37E4478075A3FC0"><enum>(A)</enum><text display-inline="yes-display-inline">a compilation of the existing standards that are incorporated by reference in regulations of the Pipeline and Hazardous Materials Safety Administration and apply to the manufacturing, operation, and maintenance of such flanges and fittings;</text></subparagraph><subparagraph id="H18B9D219BD844E8BBBE2AA9B337AF0AA"><enum>(B)</enum><text>a review of the existing oversight authority of the Secretary of Transportation over manufacturers and distributors of such flanges and fittings and any lack of oversight authority that could lead to incidents or accidents;</text></subparagraph><subparagraph id="H1471F9576448476DB6F05B05AA6C0D29"><enum>(C)</enum><text>an analysis of the degree of compliance by such manufacturers and distributors with the standards described in subparagraph (A), the identification of any instances of non-compliance with such standards, and the form, degree, and scope of such non-compliance;</text></subparagraph><subparagraph commented="no" id="H30B86BE11606402990E14A86D19A05F0"><enum>(D)</enum><text>a review of the extent to which verification (as such term is defined in section 60102(e) of title 49, United States Code, as added by this section) by operators of pipeline facilities of whether such flanges and fittings of pipeline facilities meet the applicable standards described in subparagraph (A) is occurring;</text></subparagraph><subparagraph id="H6ED8A9C401914230911140DB10C05500"><enum>(E)</enum><text>a review of the safety benefits of requiring pipeline incident reports to include the identification of the manufacturer of the flanges and fittings involved in those incidents; and</text></subparagraph><subparagraph id="HA7EF60E8FEDD4F238CC66F2349AC38B7"><enum>(F)</enum><text>an identification and recommendation of any additional authorities or responsibilities for the Secretary of Transportation, or additional standards, necessary to improve the safety and integrity of flanges and fittings through manufacturing and distribution.</text></subparagraph></paragraph><paragraph id="HB4D3D47C05AC4A48B7767ADE0CC0BACC"><enum>(3)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 210 days after the date of enactment of this Act, the Comptroller General shall submit to the Committee on Commerce, Science, and Transportation of the Senate, the Committee on Transportation and Infrastructure of the House of Representatives, and the Secretary of Transportation a report containing the results of the review completed under paragraph (1) and any recommendations for legislation or changes to existing regulations.</text></paragraph><paragraph id="H80BCF16FDDED4BBDBB370B2A4BCA56EE"><enum>(4)</enum><header>Public comment process</header><subparagraph id="H6B8BAADBF3FD46A6B3DD444DC7DD5E4F"><enum>(A)</enum><header>In general</header><text>Not later than 30 days after submission of the report required under paragraph (3) to the Secretary, the Secretary shall provide a period of not fewer than 60 days for public comment regarding such report.</text></subparagraph><subparagraph id="H0B0B087B2B8C4232AE3A2F2EEF024788"><enum>(B)</enum><header>Report</header><text>Not later than 180 days after the end of the public comment period described in subparagraph (A), the Secretary shall publish in the Federal Register a report responding to the public comments submitted.</text></subparagraph><subparagraph id="H144DF8F59B4A4824B6A189BCA0E706EA"><enum>(C)</enum><header>Contents of report</header><text>In the report described in subparagraph (B), the Secretary shall indicate any anticipated actions the Secretary will take with respect to flanges and fittings of a pipeline facility based on the comments submitted under this paragraph and the report under paragraph (3).</text></subparagraph></paragraph></subsection></section><section commented="no" id="H41E26BB929D945F8B83906446299B98D"><enum>30.</enum><header>Codification of final rule</header><text display-inline="no-display-inline">The amendments to the Code of Federal Regulations made pursuant to the final rule of the Environmental Protection Agency, titled <quote>Oil and Natural Gas Sector: Emission Standards for New, Reconstructed, and Modified Sources</quote> and published in the Federal Register on June 3, 2016 (81 Fed. Reg. 35824), shall have the same force and effect of law as if such amendments had been enacted by an Act of Congress, except that the Administrator of the Environmental Protection Agency may revise such regulations, as provided for under the Clean Air Act, if such revision would result in a reduction in gas release.</text></section><section id="HF0393519499F4C7C81461EC373C8E1C8"><enum>31.</enum><header>Threatening safe operations of pipeline infrastructure</header><text display-inline="no-display-inline">Section 60123 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H639F52C6C71842B082CE890D67586491" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="H58B63987581243D59DC3D2E14E51025F"><enum>(e)</enum><header>Penalty for threatening the safe operations of pipeline infrastructure</header><paragraph id="HBA1B7E75075F46EAA5F1756B76AE030D"><enum>(1)</enum><header>In general</header><text>A person knowingly and willfully engaging in the unauthorized turning or manipulation of a valve of any pipeline facility described in subsection (b) shall be fined under title 18, imprisoned for not more than 5 years, or both.</text></paragraph><paragraph id="H34F25458A237453D9A9A421E96484FD7"><enum>(2)</enum><header>Rule of statutory construction</header><text>Nothing in this subsection abridges the exercise of rights guaranteed under the First Amendment to the Constitution of the United States. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H47CFA90686884B5D96151A527F5C6EF3"><enum>32.</enum><header>Penalty for causing a defect in pipeline infrastructure under construction</header><text display-inline="no-display-inline">Section 60123 changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="H40F7987059084F08927297063652F5CD"><enum>(f)</enum><header>Penalty for causing a defect in pipeline infrastructure causing a defect in a pipe, pump, or valve intended to be used in any pipeline facility described in subsection (b) that would affect the integrity or safe operation of any such facility shall be fined under title 18, imprisoned for not more than 5 years, or both.</text></paragraph><paragraph id="HD39A141D66FD4039BF7D3EF0DD01BF92"><enum>(2)</enum><header>Rule of statutory construction</header><text>Nothing in this subsection abridges the exercise of rights guaranteed under the First Amendment to the Constitution of the United States. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HFBA535284DE4426DA6A3B7461BBEF86C"><enum>33.</enum><header>Use of a firearm to damage pipeline infrastructure under construction</header><text display-inline="no-display-inline">Section 60123 of title 49, United States Code, is further amended by adding at the end the following: id="H48C94DAB37774885B4960B5B9464DBF3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A person knowingly and willfully using a firearm to puncture or damage a pipe, pump, or valve intended to be used in any pipeline facility described in subsection (b) shall be fined under title 18, imprisoned for not more than 5 years, or both.</text></paragraph><paragraph id="HC7BF5018D03D4CCF92F7B45A0B2E2715"><enum>(2)</enum><header>Rule of statutory construction</header><text>Nothing in this subsection abridges the exercise of rights guaranteed under the First Amendment to the Constitution of the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF72E11568E414C62A29D9361B859C865"><enum>34.</enum><header>Pipeline safety voluntary information-sharing system</header><subsection id="H6250A49DF7FD4F1E9E3014C72AE2718C"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/601">Chapter 601</external-xref> of title 49, United States Code, is further amended by adding at the end the following:</text><quoted-block id="H1CC3683E9B2D463DA5724AA470FA8D94" style="USC" changed="added" reported-display-style="italic" committee-id="HPW00"><section id="HAE5C98551154489A8814F22460964132"><enum>60146.</enum><header>Voluntary information-sharing system</header><subsection id="H53004243F2E145569F2E94E48B0D6065"><enum>(a)</enum><header>Establishment</header><paragraph id="H0BCCCE39C6DF472FACBF788D9C12BD82"><enum>(1)</enum><header>In general</header><text>Subject to the availability of funds, the Secretary may establish a confidential and nonpunitive voluntary information-sharing system (referred to in this section as the <quote>System</quote>) to encourage collaborative efforts to improve inspection information feedback and information sharing, with the purpose of improving natural gas transmission and hazardous liquid pipeline safety.</text></paragraph><paragraph id="HBA1DB3F4EF9E4D3EBABBD532CBE66716"><enum>(2)</enum><header>Components</header><text>The System—</text><subparagraph id="H1D0280C4571349E5A100AEF9524F190C"><enum>(A)</enum><text>shall include pipeline integrity risk analysis information; and</text></subparagraph><subparagraph id="HB1B7FFF8882E4B9196E372A2B2272613"><enum>(B)</enum><text>may include other information relating to reducing pipeline incidents, such as—</text><clause id="H1E7F26E858304D75B2A7B0BFD7CEEE6C"><enum>(i)</enum><text>lessons learned from accidents and near misses;</text></clause><clause id="HE7F508FC25AF4AC7B4C2EEF1296FDB42"><enum>(ii)</enum><text>process improvements;</text></clause><clause id="HD335F82947A442898D578188E7D66424"><enum>(iii)</enum><text>technology deployments; and</text></clause><clause id="H85643ABF63DA463080EA782539F80C0C"><enum>(iv)</enum><text>other voluntary information-sharing systems.</text></clause></subparagraph></paragraph><paragraph id="HADB950BBB37E4584BD664B3DDCC4CD86"><enum>(3)</enum><header>Requirement</header><text>The System shall protect proprietary information while encouraging the exchange of data, including in-line inspection and dig verification data, among operators, tool vendors, and the representatives of the Secretary to facilitate the development of—</text><subparagraph id="HAA2EC4ABB0EF4704BC27A64B7AB7A573"><enum>(A)</enum><text>advanced pipeline-inspection technologies; and</text></subparagraph><subparagraph id="H3B85C7FABC3E4EB99F497B34F3478329"><enum>(B)</enum><text>enhanced risk analysis.</text></subparagraph></paragraph><paragraph id="H79CCE7CA39F548E394B6177F01AC6CB5"><enum>(4)</enum><header>Consultation</header><text>If appropriate, the Secretary may involve other public and private stakeholders in establishing and maintaining the System.</text></paragraph></subsection><subsection id="H91BF5939DDAB4961A475662B440186E7"><enum>(b)</enum><header>Data manager</header><text>In carrying out this section, the Secretary may engage a partner agency or nongovernmental entity to receive, store, manage, and provide for the use of—</text><paragraph id="H28B608CD82CF49568A54A0EAC52B41C6"><enum>(1)</enum><text>system data; and</text></paragraph><paragraph id="HA861200C574F464D94ED571E16DAA481"><enum>(2)</enum><text>information submitted to the System.</text></paragraph></subsection><subsection id="H3F44A176EAE84D1B8166D7AE70D1DC74"><enum>(c)</enum><header>Limitation on disclosure</header><paragraph id="HDBA478C120024753978D298AA5C33196"><enum>(1)</enum><header>Applicability of FOIA</header><text>Any part of any record (including, but not limited to an analysis by a pipeline operator of the safety risks of the pipeline operator and a statement of the mitigation measures identified by the pipeline operator to address those risks) provided to the Secretary and retained in the System is exempt from the requirements of section 552 of title 5, and specifically exempt from release under subsection (b)(3) of that section, if the record is—</text><subparagraph id="HC996F3E2A405490EB2E58367681A091E"><enum>(A)</enum><text>supplied to the Secretary for purposes of the System; or</text></subparagraph><subparagraph id="H22D39B1139D241A1A1F563721C7BA3F9"><enum>(B)</enum><text>made available for inspection and copying by an officer, employee, or agent of the Secretary for purposes of the System.</text></subparagraph></paragraph><paragraph id="HF15247460B0849D3ADD90902ADA8872A"><enum>(2)</enum><header>Exception</header><text>Notwithstanding paragraph (1), the Secretary in consultation with the information owner, may disclose deidentified material or any part of any record comprised of facts otherwise available to the public if, in the sole discretion of the Secretary, the Secretary determines that disclosure would be consistent with the confidentiality needed for the System and improve pipeline safety.</text></paragraph></subsection><subsection id="H214F0B0F9F1D4D74A5058CA7AB029DC8"><enum>(d)</enum><header>Excluded evidence</header><text>Except as provided in subsection (f), any data or information submitted to or stored, managed, analyzed, or produced by the System shall not be used—</text><paragraph id="H83A4360D1852490996CEF5F4876A2F2B"><enum>(1)</enum><text>as evidence for any purpose in any Federal, State, local, Tribal, or private litigation, including any action or proceeding; or</text></paragraph><paragraph id="H0D0158F70D1A40C79EAE0FA32F451B05"><enum>(2)</enum><text>to support any corrective action relating to a probable violation under this chapter (including any regulation promulgated or order issued under this chapter).</text></paragraph></subsection><subsection id="H3CDE98F59428420EAC72AFCCF01E8819"><enum>(e)</enum><header>Exclusion from discovery</header><text>Except as provided in subsection (f), any data or information submitted to or stored, managed, analyzed, or produced by the System shall not be subject to discovery in any Federal, State, local, Tribal, or private litigation or other proceeding.</text></subsection><subsection id="H57628614D440492799A7E3ACF8162D91"><enum>(f)</enum><header>Limitations on exclusion</header><text>The exclusions described in subsections (d) and (e) shall not apply to—</text><paragraph id="H6D2414B2613F48CDA2367325CDFB0AC0"><enum>(1)</enum><text>evidence of a knowing and willful violation;</text></paragraph><paragraph id="H878C733410794E9AB0433409D6AF07F1"><enum>(2)</enum><text>a reportable release under sections 191.7 or 195.50 of title 49, Code of Federal Regulations (or a successor regulation);</text></paragraph><paragraph id="H0B8DF6F732A84EF1A1FB598F3066054E"><enum>(3)</enum><text>a safety-related condition under sections 191.7 or 195.55 of title 49, Code of Federal Regulations (or a successor regulation); or</text></paragraph><paragraph id="HE15961D79C524D94AE4C2F2ACD2003FB"><enum>(4)</enum><text>data or information obtained by the Secretary independently of the System.</text></paragraph></subsection><subsection id="HE491B68B74494E4587FE6DB0F81B5EEC"><enum>(g)</enum><header>Governing board</header><text>Not later than 180 days after the date of enactment of this section, the Administrator shall establish a governing board co-chaired by the Administrator and a representative of the pipeline industry to—</text><paragraph id="H7E2F610E0F6045E998B10CEDB989C090"><enum>(1)</enum><text>govern the System through consensus of the board and co-chairs;</text></paragraph><paragraph id="HE45668C502B4405297675E7B44C6E514"><enum>(2)</enum><text>develop governance documents and oversee their enforcement; and</text></paragraph><paragraph id="H9A5868339C344494A477FA86DFACBCF3"><enum>(3)</enum><text>establish and appoint members of issue analysis teams;</text></paragraph></subsection><subsection id="HBF6638C39D154DECB5BDB2206508A0BB"><enum>(h)</enum><header>Confidentiality</header><text display-inline="yes-display-inline">No person, including any System governing board member, program manager, third-party data manager, issue analysis team member, nor any Federal, State, local or tribal agency, having or obtaining access to any data or information submitted to, stored, managed, analyzed or produced by the System, shall release or communicate that information to any person outside the System, with the sole exception being the publication of reports by the System based on analysis of de-identified information and safety related findings that the System governing board in its sole discretion determines to publish or authorize the Administration to publish.</text></subsection><subsection id="HBBC35ACCB9C843B28D334469BE5C5F01"><enum>(i)</enum><header>Voluntary participation</header><text>No person may be compelled to participate in or submit data or information to the System.</text></subsection><subsection id="H7BAF85453FAD41C29EE3B194F1DEE783"><enum>(j)</enum><header>Sustainable funding</header><text>The Secretary shall explore sustainable funding sources for the System, including public-private partnerships.</text></subsection><subsection id="H9637FA7A11994547929DDAD7EF46E32A"><enum>(k)</enum><header>Effect</header><text>Nothing in this section affects any Federal or State pipeline safety law.</text></subsection><subsection id="H8C0C52260EA44D58812707367B148884"><enum>(l)</enum><header>Limitation on funding</header><text>The Secretary may expend not more than $1,000,000 for each of the fiscal years 2020 through 2024 to establish the System.</text></subsection><subsection id="H7D98DB5944E84DEC9F7418CED8D61A36"><enum>(m)</enum><header>Savings clause</header><text>Notwithstanding the protections provided under this section, no pipeline operator may use the submission of information to the System as protection against enforcement actions or corrective orders that are based on information or evidence obtained outside of the System.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA2609C8A77784131AF7E20187ABF065D"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/601">chapter 601</external-xref> of title 49, United States Code, is further
