<official-title display="yes">To amend title XVIII of the Social Security Act to waive coinsurance under Medicare for colorectal cancer screening tests, regardless of whether therapeutic intervention is required during the screening, and for other purposes.</official-title>

<section id="H8C4A199B964D4B6087C1DC1212BF3CF1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Removing Barriers to Colorectal Cancer Screening Act of 2020</short-title></quote>.</text> </section> <section id="H3130E6FD2A9C446AB3DC1CDF981DCCE3"><enum>2.</enum><header>Waiving medicare coinsurance for certain colorectal cancer screening tests</header> <subsection id="H32918989C31A49819AF84806807DB5BC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1833(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)</external-xref>) is amended—</text> 
<paragraph id="HC07E7E2352764473855A712B50CE3A5B"><enum>(1)</enum><text display-inline="yes-display-inline">in the second sentence, by striking <quote>section 1834(0)</quote> and inserting <quote>section 1834(o)</quote>;</text></paragraph> <paragraph id="HCEA0830C1F114656994E35C69BF2A8DB"><enum>(2)</enum><text display-inline="yes-display-inline">by moving such second sentence 2 ems to the left; and</text></paragraph> 
<paragraph id="HF77BCF0E2B114DAEB74661376F1395AD"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting the following third sentence following such second sentence: <quote>For services furnished on or after January 1, 2022, paragraph (1)(Y) shall apply with respect to a colorectal cancer screening test regardless of the code that is billed for the establishment of a diagnosis as a result of the test, or for the removal of tissue or other matter or other procedure that is furnished in connection with, as a result of, and in the same clinical encounter as the screening test.</quote>.</text></paragraph></subsection> <subsection id="H2E01A1BE286640C3A82AF7444EBC4398"><enum>(b)</enum><header>Special coinsurance rule for certain tests</header><text display-inline="yes-display-inline">Section 1833 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l</external-xref>) is amended—</text> 
<paragraph id="H53ED782AD14A41DC8D421525DE27EE0A"><enum>(1)</enum><text>in subsection (a)(1)(Y), by inserting <quote>subject to subsection (dd),</quote> before <quote>with respect to</quote>; and</text></paragraph> <paragraph id="H096CD800432C48178B82E2E20DFA2A6C"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="HF8FED69E17B74FDB9B2E8D1DA932AB6C"><enum>(dd)</enum><header>Special coinsurance rule for certain colorectal cancer screening tests</header> 
<paragraph id="H0D8BE2BDDB0447E3B2E572F93E74DDC5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a colorectal cancer screening test to which paragraph (1)(Y) of subsection (a) would not apply but for the third sentence of such subsection that is furnished during a year beginning on or after January 1, 2022, and before January 1, 2030, the amount paid shall be equal to the specified percent (as defined in paragraph (2)) for such year of the lesser of the actual charge for the service or the amount determined under the fee schedule that applies to such test under this part (or, in the case such test is a covered OPD service (as defined in subsection (t)(1)(B)), the amount determined under subsection (t)).</text></paragraph> <paragraph id="HF2D8D17C3E794C6199460490F34B39CF"><enum>(2)</enum><header>Specified percent defined</header><text>For purposes of paragraph (1), the term <quote>specified percent</quote> means—</text> 
<subparagraph id="H46CCEC05D0DE4588B7B6568FA7D07713"><enum>(A)</enum><text>for 2022 and 2023, 80 percent;</text></subparagraph> <subparagraph id="HE483573831DE4CF1A84D0227184580C7"><enum>(B)</enum><text>for 2024 and 2025, 85 percent;</text></subparagraph> 
<subparagraph id="H6756C9C7F6594AD696BB717541C6D142"><enum>(C)</enum><text>for 2026 and 2027, 90 percent; and</text></subparagraph> <subparagraph id="H4166A67F6EB141ADB4C90B680C32030E"><enum>(D)</enum><text>for 2028 and 2029, 95 percent.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H4F6350D01D4A47EC820F518CF8BDD475"><enum>(c)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Paragraphs (2) and (3) of section 1834(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(d)</external-xref>) are each amended—</text> <paragraph id="H627C569007554F52A3D9EF65F591ADCF"><enum>(1)</enum><text>in subparagraph (C)(ii), in the matter preceding subclause (I), by striking <quote>Notwithstanding</quote> and inserting <quote>Subject to section 1833(a)(1)(Y), but notwithstanding</quote>; and</text></paragraph> 
<paragraph id="HB4CA3647DF4048B0A7C3C69B551D649C"><enum>(2)</enum><text>in subparagraph (D), by striking <quote>If during</quote> and inserting <quote>Subject to section 1833(a)(1)(Y), if during</quote>. </text></paragraph></subsection></section> <section id="H0D5E1BB46A1F4A1F973CAD84F1A6BCA6"><enum>3.</enum><header>Requiring certain manufacturers to report drug pricing information with respect to drugs under the Medicare program</header> <subsection id="HE378CC2CEE5C4020B2491D14651C2641"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1847A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3a">42 U.S.C. 1395w–3a</external-xref>) is amended—</text> 
<paragraph id="H0C573DCFC2644E7E868F7F97AEDC2696"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph id="HA9CB1EFC96024AA693775DAB902C157D"><enum>(A)</enum><text>in paragraph (2)(A), by inserting <quote>or subsection (f)(2), as applicable</quote> before the period at the end;</text> </subparagraph> 
<subparagraph id="HC035D336EC8F4994B62A4F38D5A8F533"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3), in the matter preceding subparagraph (A), by inserting <quote>or subsection (f)(2), as applicable,</quote> before <quote>determined by</quote>; and</text> </subparagraph> <subparagraph id="HD0B7709D02D34F25877FEE7B8DF70AD8"><enum>(C)</enum><text>in paragraph (6)(A), in the matter preceding clause (i), by inserting <quote>or subsection (f)(2), as applicable,</quote> before <quote>determined by</quote>; and</text> </subparagraph></paragraph> 
<paragraph id="H3F28393C0C244207BDD28BBC073B26FA"><enum>(2)</enum><text>in subsection (f)—</text> <subparagraph id="H01EFF40D863E40E2BBC7CE2F31D423F1"><enum>(A)</enum><text>by striking <quote>For requirements</quote> and inserting the following:</text>

<paragraph id="H3394D97756004ED09A74194FCBB3F064"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For requirements</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph> <subparagraph id="HF2B9B0FAB5A949CCB77E8D83FEFE5C58"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H1C5735C3E9BA4A4AB1EA160432E3190C" style="OLC"> 
<paragraph id="HC7AA341B03434058B204AF8EA970B48E"><enum>(2)</enum><header>Manufacturers without a rebate agreement under title XIX</header> 
<subparagraph id="H2DCF5CB84D764D0588EC71725C87E0E9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If the manufacturer of a drug or biological described in subparagraph (C), (E), or (G) of section 1842(o)(1) or in section 1881(b)(14)(B) that is payable under this part has not entered into and does not have in effect a rebate agreement described in subsection (b) of section 1927, for calendar quarters beginning with the second calendar quarter beginning on or after the date of the enactment of this paragraph, such manufacturer shall report to the Secretary the information described in subsection (b)(3)(A)(iii) of such section 1927 with respect to such drug or biological in a time and manner specified by the Secretary. For purposes of applying this paragraph, a drug or biological described in the previous sentence includes items, services, supplies, and products that are payable under this part as a drug or biological.</text> </subparagraph> <subparagraph id="HE2AC29F381B242C4AED3B5EB75ECA57F"><enum>(B)</enum><header>Audit</header><text display-inline="yes-display-inline">Information reported under subparagraph (A) is subject to audit by the Inspector General of the Department of Health and Human Services.</text> </subparagraph> 
<subparagraph id="H186C9524CDAB46DF8FA154B86D00E770"><enum>(C)</enum><header>Verification</header><text display-inline="yes-display-inline">The Secretary may survey wholesalers and manufacturers that directly distribute drugs described in subparagraph (A), when necessary, to verify manufacturer prices and manufacturer’s average sales prices (including wholesale acquisition cost) if required to make payment reported under subparagraph (A). The Secretary may impose a civil monetary penalty in an amount not to exceed $100,000 on a wholesaler, manufacturer, or direct seller, if the wholesaler, manufacturer, or direct seller of such a drug refuses a request for information about charges or prices by the Secretary in connection with a survey under this subparagraph or knowingly provides false information. The provisions of section 1128A (other than subsections (a) (with respect to amounts of penalties or additional assessments) and (b)) shall apply to a civil money penalty under this subparagraph in the same manner as such provisions apply to a penalty or proceeding under section 1128A(a).</text> </subparagraph> <subparagraph commented="no" id="H392C684C28634CD0B0578E3FC9BCCC15"><enum>(D)</enum><header>Confidentiality</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, information disclosed by manufacturers or wholesalers under this paragraph (other than the wholesale acquisition cost for purposes of carrying out this section) is confidential and shall not be disclosed by the Secretary in a form which discloses the identity of a specific manufacturer or wholesaler or prices charged for drugs by such manufacturer or wholesaler, except—</text> 
<clause id="H8D3A9DEB4C1F4B2F9BDA8B7E739F22F4"><enum>(i)</enum><text display-inline="yes-display-inline">as the Secretary determines to be necessary to carry out this section (including the determination and implementation of the payment amount), or to carry out section 1847B;</text> </clause> <clause id="H81644CD0DF2C46269E955C3D03805704"><enum>(ii)</enum><text display-inline="yes-display-inline">to permit the Comptroller General of the United States to review the information provided; and</text> </clause> 
<clause id="H9E56CB4BF51E42A1B607A6B74A890A43"><enum>(iii)</enum><text display-inline="yes-display-inline">to permit the Director of the Congressional Budget Office to review the information provided.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph></subsection> <subsection id="H60800D5D40C04C9CACD291FC28EA0784"><enum>(b)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Section 1847A of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3a">42 U.S.C. 1395w–3a</external-xref>) is further amended—</text> 
<paragraph id="H88CFA8DD346542358763B7ECDEC6C66A"><enum>(1)</enum><text>in subsection (d)(4)—</text> <subparagraph id="H8F49D2723A6E4B05AF7C80B8E0C28438"><enum>(A)</enum><text>in subparagraph (A), by striking <quote><header-in-text level="subparagraph" style="OLC">In general</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">Misrepresentation</header-in-text></quote>;</text> </subparagraph> 
<subparagraph id="H1C2890FFD7424B9D8AD1AA05CB125505"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>subparagraph (B)</quote> and inserting <quote>subparagraph (A), (B), or (C)</quote>;</text> </subparagraph> <subparagraph id="H80A72FD241C14C329E4EAB94824D34B2"><enum>(C)</enum><text>by redesignating subparagraph (B) as subparagraph (D); and</text> </subparagraph> 
<subparagraph id="H5C21BF42B4DF43BDBAE15D31BB638D70"><enum>(D)</enum><text>by inserting after subparagraph (A) the following new subparagraphs:</text> <quoted-block display-inline="no-display-inline" id="H612417526D0145ED9B7EEF7791CD4B78" style="OLC"> <subparagraph id="H15807D88323F401E925B91A440051D8B"><enum>(B)</enum><header>Failure to provide timely information</header><text display-inline="yes-display-inline">If the Secretary determines that a manufacturer described in subsection (f)(2) has failed to report on information described in section 1927(b)(3)(A)(iii) with respect to a drug or biological in accordance with such subsection, the Secretary shall apply a civil money penalty in an amount of $10,000 for each day the manufacturer has failed to report such information and such amount shall be paid to the Treasury.</text> </subparagraph> 
<subparagraph id="H6F317CD8803D4A908EC743E628D29A4C"><enum>(C)</enum><header>False information</header><text display-inline="yes-display-inline">Any manufacturer required to submit information under subsection (f)(2) that knowingly provides false information is subject to a civil money penalty in an amount not to exceed $100,000 for each item of false information. Such civil money penalties are in addition to other penalties as may be prescribed by law.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph> <paragraph id="HF38F08FB539045A18BDA14624DF13051"><enum>(2)</enum><text>in subsection (c)(6)(A), by striking the period at the end and inserting <quote>, except that, for purposes of subsection (f)(2), the Secretary may, if the Secretary determines appropriate, exclude repackagers of a drug or biological from such term.</quote>.</text> </paragraph></subsection> 
<subsection id="H90B1B2406E5149028A1DA7E06B6457E3"><enum>(c)</enum><header>Manufacturers with a rebate agreement</header> 
<paragraph id="H2B71A17D1CB244DFB400677CDFDCD096"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1927(b)(3)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-8">42 U.S.C. 1396r-8(b)(3)(A)</external-xref>) is amended by adding at the end the following new sentence: <quote>For purposes of applying clause (iii), a drug or biological described in the flush matter following such clause includes items, services, supplies, and products that are payable under this part as a drug or biological.</quote>.</text> </paragraph> <paragraph id="H8A23BB7DE24A482581A7754574807459"><enum>(2)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">Section 1927(b)(3)(A)(iii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-8">42 U.S.C. 1396r-8(b)(3)(A)(iii)</external-xref>) is amended by striking <quote>section 1881(b)(13)(A)(ii)</quote> and inserting <quote>section 1881(b)(14)(B)</quote>.</text> </paragraph></subsection> 
<subsection display-inline="no-display-inline" id="H0A59463C963545F886F6A06CB757A70A"><enum>(d)</enum><header>Report</header><text>Not later than January 1, 2023, the Inspector General of the Department of Health and Human Services shall assess and submit to Congress a report on the accuracy of average sales price information submitted by manufacturers under section 1847A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-3a">42 U.S.C. 1395w–3a</external-xref>). Such report shall include any recommendations on how to improve the accuracy of such information.</text></subsection></section> <section id="H455F561B9EEA4F3A803F74406099871C"><enum>4.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text> </section>
