<section id="HE8102D06BD0143AF9187D787B8D6447B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Water Quality Protection and Job Creation Act of 2019</short-title></quote>.</text></section> <section id="HF787609E8D7B43CEAE456749E1CFFFCD" commented="no"><enum>2.</enum><header>Wastewater infrastructure workforce investment</header><text display-inline="no-display-inline">Section 104(g) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254(g)</external-xref>) is amended— </text> 
<paragraph id="H176F72B925B14BB4BB33736E54746C40"><enum>(1)</enum><text>in paragraph (1), by striking <quote>manpower</quote> each place it appears and inserting <quote>workforce</quote>; and</text></paragraph> <paragraph id="HB395191805574F4EA2566035D7416981"><enum>(2)</enum><text>by amending paragraph (4) to read as follows:</text>

<paragraph id="H125BE327AF5241A584A55A05B9A2E3D9" commented="no"><enum>(4)</enum><header>Report to Congress on publicly owned treatment works workforce development</header><text>Not later than 2 years after the date of enactment of the <short-title>Water Quality Protection and Job Creation Act of 2019</short-title>, the Administrator shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a report containing—</text> <subparagraph id="HCF97A1D3A79741559C2502EA37A9E962" commented="no"><enum>(A)</enum><text>an assessment of the current and future workforce needs for publicly owned treatment works, including an estimate of the number of future positions needed for such treatment works and the technical skills and education needed for such positions;</text></subparagraph> 
<subparagraph id="HF678B857D69A4DEFB57CA1A45EE55EBD" commented="no"><enum>(B)</enum><text>a summary of actions taken by the Administrator, including Federal investments under this Act, that promote workforce development to address such needs; and</text></subparagraph> <subparagraph id="H9D74A650355549BCA98F5FAB5783FE30" commented="no"><enum>(C)</enum><text>any recommendations of the Administrator to address such needs.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HF4AE0D3FF88C448C83C6205929D3B37A" commented="no"><enum>3.</enum><header>State management assistance</header> 
<subsection id="HE5FC408920E04213872BEA1F3B508251" commented="no"><enum>(a)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Section 106(a) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1256">33 U.S.C. 1256(a)</external-xref>) is amended—</text> <paragraph id="H939455E8041D493DA9792BA89353E4F8" commented="no"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (1); and</text></paragraph> 
<paragraph id="H03A461A979CC44F4950DD96F6D49574E" commented="no"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text> <quoted-block id="H2011CFA593404418B28721CCA5AF957D" style="OLC"> <paragraph id="H0C5276E54CFF4B09AAFDABC6BE2F69F9" commented="no"><enum>(3)</enum><text>such sums as may be necessary for each of fiscal years 1991 through 2020;</text></paragraph> 
<paragraph id="HBCBC7B10372B44E49B13C0F382B35EF3" commented="no"><enum>(4)</enum><text>$240,000,000 for fiscal year 2021;</text></paragraph> <paragraph id="H4A3E23B2EAF949C7A86CE4AE804B3FD8" commented="no"><enum>(5)</enum><text>$250,000,000 for fiscal year 2022;</text></paragraph> 
<paragraph id="HB3CB1D8AEAE3461589ED5BF065C96268" commented="no"><enum>(6)</enum><text>$260,000,000 for fiscal year 2023;</text></paragraph> <paragraph id="H8AFD28B9483846BBB61C944EC4559908" commented="no"><enum>(7)</enum><text>$270,000,000 for fiscal year 2024; and</text></paragraph> 
<paragraph id="HE70AB55F6E7743A3B7EA6A34586BEE4B" commented="no"><enum>(8)</enum><text>$275,000,000 for fiscal year 2025;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H6A095F136CE1405DA4729DF64C647249" commented="no"><enum>(b)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">Section 106(e) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1256">33 U.S.C. 1256(e)</external-xref>) is amended by striking <quote>Beginning in fiscal year 1974 the</quote> and inserting <quote>The</quote>.</text></subsection></section> 
<section id="H50F97C1631A2421DB07DE14F11635F14" section-type="subsequent-section"><enum>4.</enum><header>Watershed, wet weather, and resiliency projects</header> 
<subsection id="H4AF1DBB146F14B1F97D707B84B29A26B"><enum>(a)</enum><header>Increased resilience of treatment works</header><text display-inline="yes-display-inline">Section 122(a)(6) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1274">33 U.S.C. 1274(a)(6)</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" id="H61F4F16D4C834F46A31CA80A6368CCC3" display-inline="no-display-inline"> <paragraph id="H9C4B3C284FF348BE8086C302B0D7BDBB"><enum>(6)</enum><header>Increased resilience of treatment works</header><text display-inline="yes-display-inline">Efforts—</text> 
<subparagraph id="HE2FD340D9D624178B196E9F8B31B6CAD"><enum>(A)</enum><text>to assess future risks and vulnerabilities of publicly owned treatment works to manmade or natural disasters, including extreme weather events and sea level rise; and</text></subparagraph> <subparagraph id="HCE272E8E43C14615945940366862B214"><enum>(B)</enum><text>to carry out the planning, designing, or constructing of projects, on a systemwide or areawide basis, to increase the resilience of publicly owned treatment works through—</text> 
<clause id="H7BE26CB5E7804461A64CFFF90A33E5CF"><enum>(i)</enum><text>the conservation of water or the enhancement of water use efficiency;</text></clause> <clause id="H8A357CEBCF014F9DB73756AC0D88CEA3"><enum>(ii)</enum><text>the enhancement of wastewater (including stormwater) management by increasing watershed preservation and protection, including through—</text> 
<subclause id="H823DA246A3CB43B898ED16FCE3920FE9"><enum>(I)</enum><text>the use of green infrastructure; or</text></subclause> <subclause id="H10919E42391F4FFC896914061C6C1A40"><enum>(II)</enum><text>the reclamation and reuse of wastewater (including stormwater), such as through aquifer recharge zones;</text></subclause></clause> 
<clause id="H747B73E23CE9400E8095718EA9705CEC"><enum>(iii)</enum><text>the modification or relocation of an existing publicly owned treatment works at risk of being significantly impaired or damaged by a manmade or natural disaster; or</text></clause> <clause id="HFB497D4125074D9BA68D89FF0BF9366C"><enum>(iv)</enum><text>the enhancement of energy efficiency, or the use or generation of recovered or renewable energy, in the management, treatment, or conveyance of wastewater (including stormwater).</text></clause></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></subsection> 
<subsection id="H9DE84925F5204F23A1B21E6E84E3A40D"><enum>(b)</enum><header>Requirements; authorization of appropriations</header><text display-inline="yes-display-inline">Section 122 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1274">33 U.S.C. 1274</external-xref>) is amended by striking subsection (c) and inserting the following:</text> <quoted-block style="OLC" id="HE0E0A2A094EE494B96B69EF817FA9E33" display-inline="no-display-inline"> <subsection id="H4E2A6FBF0E384F72922CBB389ED6957B" commented="no"><enum>(c)</enum><header>Requirements</header><text display-inline="yes-display-inline">The requirements of section 608 shall apply to any construction, alteration, maintenance, or repair of treatment works receiving a grant under this section.</text></subsection> 
<subsection id="H90522A08EF6949A29EE2AAAF2ED7CB0F" commented="no"><enum>(d)</enum><header>Assistance</header><text display-inline="yes-display-inline">The Administrator shall use not less than 15 percent of the amounts appropriated pursuant to this section in a fiscal year to provide assistance to municipalities with a population of less than 10,000, to the extent there are sufficient eligible applications.</text></subsection> <subsection id="H03AFD8121593466BA66CC9A5CF3DA19D" commented="no"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $110,000,000, to remain available until expended.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H413A88A9D79F497EA8F6A1509E3E9FA5"><enum>(c)</enum><header>Technical and conforming amendments</header> 
<paragraph id="H9A40EEFACB9B459BB78CC9E0DC1995E9"><enum>(1)</enum><header>Watershed pilot projects</header><text display-inline="yes-display-inline">Section 122 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1274">33 U.S.C. 1274</external-xref>) is amended—</text> <subparagraph id="H13E9F722D6324CD38EE0CBA480F8F3A7"><enum>(A)</enum><text display-inline="yes-display-inline">in the section heading, by striking <quote><header-in-text level="section" style="OLC">Watershed pilot projects</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Watershed, wet weather, and resiliency projects</header-in-text></quote>; and</text></subparagraph> 
<subparagraph id="H53D52076D61B4F91B1CEDF8509F86A79"><enum>(B)</enum><text>by striking <quote>pilot</quote> each place it appears.</text></subparagraph></paragraph> <paragraph id="H709593D6E0FF4A39BCA95193BF7FF480"><enum>(2)</enum><header>Water pollution control revolving loan funds</header><text display-inline="yes-display-inline">Section 603(c)(7) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(c)(7)</external-xref>) is amended by striking <quote>watershed</quote>.</text></paragraph></subsection></section> 
<section id="HA252A34E1C5B44A6B0AAB4A16A1B2F1B" commented="no"><enum>5.</enum><header>Pilot program for alternative water source projects</header> 
<subsection id="H26C8BDDACCB043C6867F81BEC844869A" commented="no"><enum>(a)</enum><header>Selection of projects</header><text>Section 220(d) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1300">33 U.S.C. 1300(d)</external-xref>) is amended—</text> <paragraph id="H602B3C7DD6F54EB5826B935E5EB5C569" commented="no"><enum>(1)</enum><text>by amending paragraph (1) to read as follows:</text> 
<quoted-block style="OLC" id="H1CEE079BD6444463BA8E46EE8A5A6F00" display-inline="no-display-inline"> 
<paragraph id="H52DA970675014FC7BC1D1C2E3F6C6F59" commented="no"><enum>(1)</enum><header>Limitation on eligibility</header><text>A project that has received construction funds under the Reclamation Projects Authorization and Adjustment Act of 1992 shall not be eligible for grant assistance under this section.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H8C6046144ED14D3FB85F523D334523BB" commented="no"><enum>(2)</enum><text>by striking paragraph (2) and redesignating paragraph (3) as paragraph (2).</text></paragraph></subsection> 
<subsection id="H89485904AD56485B93094B4B45723CD0" commented="no"><enum>(b)</enum><header>Committee resolution procedure; assistance</header><text>Section 220 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1300">33 U.S.C. 1300</external-xref>) is amended by striking subsection (e) and inserting the following:</text> <quoted-block style="OLC" id="H22AD48E1EEA445EDAE703992D122207D" display-inline="no-display-inline"> <subsection id="H2C1FC3811C4748FCBBDB84C8F92DABDE" commented="no"><enum>(e)</enum><header>Assistance</header><text>The Administrator shall use not less than 15 percent of the amounts appropriated pursuant to this section in a fiscal year to provide assistance to eligible entities for projects designed to serve fewer than 10,000 individuals, to the extent there are sufficient eligible applications. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H61DC2F04BDC3420EAB7024F484DB109C" commented="no"><enum>(c)</enum><header>Cost sharing</header><text display-inline="yes-display-inline">Section 220(g) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1300">33 U.S.C. 1300(g)</external-xref>) is amended—</text> <paragraph id="H4DA179E24A5B48C3892B9CBD52387BDD" commented="no"><enum>(1)</enum><text>by striking <quote>The Federal share</quote> and inserting the following: </text>

<paragraph id="HA19D21A653F84F4A92440F0A711B9E30" commented="no"><enum>(2)</enum><header>Reclamation and reuse projects</header><text display-inline="yes-display-inline">For an alternative water source project that has received funds under the Reclamation Projects Authorization and Adjustment Act of 1992 (other than funds referred to in subsection (d)(1)), the total Federal share of the costs of the project shall not exceed 25 percent or $20,000,000, whichever is less.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HFB66D4F7BE374D239D4D4F2CBEEF6A56" commented="no"><enum>(d)</enum><header>Requirements</header><text display-inline="yes-display-inline">Section 220 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1300">33 U.S.C. 1300</external-xref>) is amended by redesignating subsections (i) and (j) as subsections (j) and (k), respectively, and inserting after subsection (h) the following:</text>

<subsection id="HE448417CD1A9462B92ECF9679F849B9A" commented="no"><enum>(i)</enum><header>Requirements</header><text display-inline="yes-display-inline">The requirements of section 608 shall apply to any construction of an alternative water source project carried out using assistance made available under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H3CF2552BA9B64BD39614539928FAF055" commented="no"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 220(j)(1) of the Federal Water Pollution Control Act (as redesignated by subsection (d) of this section) is amended by striking <quote>or wastewater or by treating wastewater</quote> and inserting <quote>, wastewater, or stormwater or by treating wastewater or stormwater</quote>.</text></subsection> 
<subsection id="H03FAD34F1F4346F688BC4E6F356103D1" commented="no"><enum>(f)</enum><header>Authorization of appropriations</header><text>Section 220(k) of the Federal Water Pollution Control Act (as redesignated by subsection (d) of this section) is amended by striking <quote>$75,000,000 for fiscal years 2002 through 2004</quote> and inserting <quote>$150,000,000</quote>.</text></subsection></section> <section id="H765C5928A2344C5B8E44A27144116B24"><enum>6.</enum><header>Sewer overflow and stormwater reuse municipal grants</header><text display-inline="no-display-inline">Section 221 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1301">33 U.S.C. 1301</external-xref>) is amended—</text>

<section id="H97AE940A21C04ED8A83E37CD2E1E6F3A" section-type="subsequent-section"><enum>7.</enum><header>National pollutant discharge elimination system</header> 
<subsection id="H97E58815D8294D949201F9BDBDCAF2F4"><enum>(a)</enum><header>Terms</header><text>Section 402(b)(1) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(b)(1)</external-xref>) is amended—</text> <paragraph id="H4E97DE68A17C4F8A94AB6BDAD1802EC7"><enum>(1)</enum><text>by amending subparagraph (B) to read as follows:</text> 
<quoted-block id="HAB6A7C2B6DA34385B9A39EC5E094AABD" style="OLC">

<subparagraph id="HBB287DEE99A8452B8A4C7DA1019637E0" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 30 days after such last day of the term of the permit, the State shall notify the Administrator, the Committee on Transportation and Infrastructure of the House of Representatives, and the Committee on Environment and Public Works of the Senate of such failure to make a final administrative disposition;</text></subparagraph> <subparagraph id="HEBE4A32E8E494B07A558845F55907752" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">if the State does not make a final administrative disposition of the application by the date that is 180 days after the last day of the term of the permit, the Administrator shall make a final administrative disposition of the application not later than 180 days after such date; and</text></subparagraph> 
<subparagraph id="HBB22E95481AE4DA0B69A946DA6082FA1" commented="no"><enum>(C)</enum><text>the permit shall continue in effect until the date on which a final administrative disposition of the application is made.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H84745B3D9578413E8CDB80B5DC361E8C"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H807B5B4C099C443CA78EA9899F236499" style="OLC"> 
<subsection id="HF716FD97E23E4CD8BE4F95AB23BDD3B2"><enum>(t)</enum><header>Extended term for certain permits</header> 
<paragraph id="H4CD51F9536704553A8A00F6B3D984BB0"><enum>(1)</enum><header>In general</header><text>A State with an approved permit program under subsection (b) may issue a permit under this section with a term authorized under subsection (b)(1)(B)(i) to an eligible municipality for a covered discharge.</text></paragraph> <paragraph id="H718D67A0C1904692B3E853503554A720"><enum>(2)</enum><header>Review and modification of permit</header> <subparagraph id="H093F3B89FB6D454495485535766B3153"><enum>(A)</enum><header>State action</header> <clause id="H3ED4458127F04E91A577AA2D7A50AAA7"><enum>(i)</enum><header>Review</header><text>Not later than 60 days after a triggering event occurs with respect to a permit issued by a State pursuant to this subsection, the State shall review the permit and make publicly available a determination of whether any modifications to the permit are necessary to address the triggering event.</text></clause> 
<clause id="H0312E9416D66405E8CA069056B2FAA3B"><enum>(ii)</enum><header>Modification</header><text display-inline="yes-display-inline">Not later than 90 days after making publicly available a determination under clause (i) that modifications to a permit are necessary, the State shall make such modifications in accordance with the requirements of this section.</text></clause></subparagraph> <subparagraph id="HF1FA27C867D546FC9A8AD0B7951CD8F2" commented="no"><enum>(B)</enum><header>EPA action</header> <clause id="HDA5EDC80B0244A5BA59C317478958476" commented="no"><enum>(i)</enum><header>Review</header><text display-inline="yes-display-inline">If a State fails to make publicly available a determination by the deadline required under subparagraph (A), the Administrator shall make publicly available such a determination not later than 30 days after such deadline.</text></clause> 
<clause id="H49A9634227914F72B2BDA0655D87F824" commented="no"><enum>(ii)</enum><header>Modification</header><text display-inline="yes-display-inline">If a State fails to modify a permit by the deadline required under subparagraph (A), or if the Administrator makes publicly available under this subparagraph a determination that modifications to a permit are necessary, the Administrator shall make such modifications in accordance with the requirements of this section not later than 90 days after the deadline required under subparagraph (A), or 90 days after the date on which the Administrator makes publicly available such determination under this subparagraph, as applicable.</text></clause> <clause id="HD22FF8E028584D28B6DA2E97A458E5F8" commented="no"><enum>(iii)</enum><header>Effect on State authority</header><text display-inline="yes-display-inline">A permit modified by the Administrator under clause (ii) shall be considered to be a permit issued by the State for the purposes of permit administration, and such modification shall not affect any other authority or responsibility of the State relating to the permit. </text></clause></subparagraph> 
<subparagraph id="HFBD8B34306D0421AB630B95CFDBD3C96" commented="no"><enum>(C)</enum><header>Right of action</header><text display-inline="yes-display-inline">A determination under this paragraph by a State or the Administrator of whether modifications to a permit are necessary to address a triggering event is a final agency action subject to judicial review in the same manner as a review under section 509(b)(1).</text></subparagraph></paragraph> <paragraph id="H463F6E7F4429489DB4CF0D503360E0C4"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> 
<subparagraph id="H30054316E22E489190610804A47DD39A" commented="no"><enum>(A)</enum><header>Covered discharge</header><text display-inline="yes-display-inline">The term <term>covered discharge</term> means a discharge from a publicly owned treatment works, which consists of municipal sewage treated, recycled, or reclaimed in accordance with this Act (and may include a municipal combined sewer overflow that is in compliance with the requirements of subsection (q))—</text> <clause id="H82067041BD3A43DFAF3B244BAB3E74E5" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">into a navigable water that is not identified by the State issuing the permit under section 303(d) as impaired for a pollutant specifically addressed by the permit; or</text></clause> 
<clause id="HED7BBEBC0F3A489D99D202C68A37A0FB" commented="no"><enum>(ii)</enum><text>in the case of a discharge into a navigable water that is so identified, that is subject to, and in compliance with, permit limits that are consistent with—</text> <subclause id="H48427A0E46CE4EB7ABF46F962A71CE2C" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">a judicial order or consent decree resolving an enforcement action related to such discharge under this Act; or </text></subclause> 
<subclause id="H2C0C25BB5DC14194B1D2C1EEB80CB341" commented="no"><enum>(II)</enum><text>for each such pollutant, any applicable approved total maximum daily load allocation, or, if no such approved allocation exists, any applicable water quality standard for the pollutant (including any such standard as addressed in an integrated plan incorporated into a permit under subsection (s)).</text></subclause></clause></subparagraph> <subparagraph id="H8AE0AE673C6943A5967E3207A4B03ADE"><enum>(B)</enum><header>Eligible municipality</header><text display-inline="yes-display-inline">The term <term>eligible municipality</term> means a municipality with a history of compliance with this Act, as determined in accordance with standards established by the Administrator.</text></subparagraph> 
<subparagraph id="HE581D66F47C34FBA9DE4387AEE57A942"><enum>(C)</enum><header>Triggering event</header><text>The term <term>triggering event</term> means, with respect to a permit issued pursuant to this subsection, any of the following that happens after the date on which the permit is issued:</text> <clause id="H78B0EB6C7E814F68803A62A8DAC2B5A4" commented="no"><enum>(i)</enum><text>The State receives information that there may be a cause for modification, as identified in section 122.62 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this subsection), of the permit.</text></clause> 
<clause id="HD02F6CD556064CC497A5E91D425F2424" commented="no"><enum>(ii)</enum><text>The State identifies under section 303(d) the navigable water into which a discharge is permitted pursuant to the permit as impaired for a pollutant known to be present in the discharge. </text></clause> <clause id="HB19D9AC8F5354542AC685B6F228A4F73" commented="no"><enum>(iii)</enum><text>The Administrator approves a new or modified total maximum daily load that applies with respect to a pollutant known to be present in a discharge permitted pursuant to the permit.</text></clause> 
<clause id="H5DEF2A32656748B09D406D6778016539"><enum>(iv)</enum><text>The Administrator or the State determines that—</text> <subclause id="HC0C7C01425B74C49BD49E424C25814E1"><enum>(I)</enum><text>a pollutant known to be discharged under the permit is directly related to the contamination of a water designated for use as a public water supply source pursuant to section 303; and</text></subclause> 
<subclause id="HD41C5A5571CD4716953958C9C71C7048"><enum>(II)</enum> 
<item id="H5185E785D97E4DDEB0A42B0F58755AB8" commented="no" display-inline="yes-display-inline"><enum>(aa)</enum><text>the discharge of such pollutant is related to a violation of an applicable water quality standard; or</text></item> <item id="HE1991EC1F5DE426F9194D8F89D03E816" indent="up1"><enum>(bb)</enum><text>such pollutant is subject to a health advisory published by the Administrator under section 1412(b)(1)(F) of the Safe Drinking Water Act.</text></item></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HF8C565E443E94F93BA26CD40A3B7AFED"><enum>(c)</enum><header>Implementation rule</header> 
<paragraph id="H11CDEBD4022B421DA1C5A9B8701FF674"><enum>(1)</enum><header>Deadline</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall publish in the Federal Register a rule to implement the amendments made by this section, including establishing standards for determining a history of compliance with the Federal Water Pollution Control Act for purposes of section 402(t) of such Act (as added by this section).</text></paragraph> <paragraph id="HCD1F367B6DC340A1A3B050A90C062B42"><enum>(2)</enum><header>Consultation</header><text>In carrying out this subsection, the Administrator shall consult with representatives of States, municipalities (as such term is defined in section 502 of the Federal Water Pollution Control Act), and other stakeholders and interested parties.</text></paragraph></subsection></section> 
<section id="HD0722FF9AA4049B0AB6C3DFEF30CF362" commented="no"><enum>8.</enum><header>Reports to Congress</header><text display-inline="no-display-inline">Section 516(b)(1) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1375">33 U.S.C. 1375(b)(1)</external-xref>) is amended—</text> <paragraph id="H1D6821E6902348DCAC405C662D4023F7"><enum>(1)</enum><text>by striking <quote>, of the cost of construction</quote> and inserting <quote>, of (i) the cost of construction</quote>; and</text></paragraph> 
<paragraph id="HB5969E39B784406783DF7EECBAC73ECC"><enum>(2)</enum><text>by striking <quote>each of the States;</quote> and inserting <quote>each of the States, and (ii) the costs to implement measures necessary to address the resilience and sustainability of publicly owned treatment works to manmade or natural disasters;</quote>.</text></paragraph></section> <section id="HE8662AC1A3BA4D4985A6B6F65E4F9779" section-type="subsequent-section"><enum>9.</enum><header>Indian Tribes</header><text display-inline="no-display-inline">Section 518(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1377">33 U.S.C. 1377(c)</external-xref>) is amended—</text> 
<paragraph id="H1FFCA299007D478FB0DF3F6B886F874A"><enum>(1)</enum><text>by striking paragraphs (1) and (2) and inserting the following:</text> <quoted-block style="OLC" id="H0E8E3A3EE295429486CA67255D247289" display-inline="no-display-inline"> <paragraph id="HF3E37D3245CF4403956B11068847DBD8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For each fiscal year, the Administrator shall reserve, of the funds made available to carry out title VI (before allotments to the States under section 604(a)), the greater of—</text> 
<subparagraph id="HC0AC3661B2114AA6BEF07011CCAC1125"><enum>(A)</enum><text>2 percent of such funds; or</text></subparagraph> <subparagraph id="H86E731FE9D1E4B7A8F41FC5E7034B425"><enum>(B)</enum><text>$30,000,000.</text></subparagraph></paragraph> 
<paragraph id="H35861107D42A48DA88C5187B59473DDB"><enum>(2)</enum><header>Use of funds</header> 
<subparagraph id="HF3195AB4617F41AF89DC77898D95F5D8"><enum>(A)</enum><header>Grants</header><text>Funds reserved under this subsection shall be available only for grants to entities described in paragraph (3) for—</text> <clause id="H67849240C2B9447E9C101F2982651981"><enum>(i)</enum><text>projects and activities eligible for assistance under section 603(c); and</text></clause> 
<clause id="HCFC258F5DD734C4E9B520724C6DDA17E"><enum>(ii)</enum><text>training, technical assistance, and educational programs relating to the operation and management of treatment works eligible for assistance pursuant to section 603(c).</text></clause></subparagraph> <subparagraph id="H8B4BD95D568C43D3BE163610DD8A9632"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">Not more than $2,000,000 of the reserved funds may be used for grants under subparagraph (A)(ii).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H783F3E0AC6C9498ABF7246774B9D757E"><enum>(2)</enum><text>in paragraph (3)—</text> <subparagraph id="HCCD92524545242459DD1977F57F9251D"><enum>(A)</enum><text display-inline="yes-display-inline">in the header, by striking <quote><header-in-text level="paragraph" style="OLC">Use of funds</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Eligible entities</header-in-text></quote>; and</text></subparagraph>

<section id="H09B0E37FFC3C42228681F3357CE49984" section-type="subsequent-section"><enum>11.</enum><header>Water pollution control revolving loan funds</header><text display-inline="no-display-inline">Section 603(i) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(i)</external-xref>) is amended—</text> <paragraph id="H24574C9068AE480B8543112AF0CE5493"><enum>(1)</enum><text>in paragraph (1)—</text>

<paragraph id="H1C31CAE2F5164A5786330873D15711EF"><enum>(2)</enum><text>by amending paragraph (3) to read as follows:</text> <quoted-block style="OLC" id="H9D2774AC350C4B6AB8BA7F5006A8F33B" display-inline="no-display-inline"> <paragraph id="H22FCA08C207341BC85E6311CF7F40FFA" commented="no"><enum>(3)</enum><header>Subsidization amounts</header> <subparagraph id="H1787859F1BEE44C0AEC80E9350933F5D" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A State may use for providing additional subsidization in a fiscal year under this subsection an amount that does not exceed the greater of—</text> 
<clause id="H9773B3333852429499D26A2F54EDD43B" commented="no"><enum>(i)</enum><text>30 percent of the total amount received by the State in capitalization grants under this title for the fiscal year; or</text></clause> <clause id="H3B592531ABD2418E9FF4F0027EBBED56" commented="no"><enum>(ii)</enum><text>the annual average over the previous 10 fiscal years of the amounts deposited by the State in the State water pollution control revolving fund from State moneys that exceed the amounts required to be so deposited under section 602(b)(2).</text></clause></subparagraph> 
<subparagraph id="H4ED58577FE0B45D9A9DB2F3D6AE387B1" commented="no"><enum>(B)</enum><header>Minimum</header><text display-inline="yes-display-inline">For each of fiscal years 2021 through 2025, to the extent there are sufficient applications for additional subsidization under this subsection that meet the criteria under paragraph (1)(A), a State shall use for providing additional subsidization in a fiscal year under this subsection an amount that is not less than 10 percent of the total amount received by the State in capitalization grants under this title for the fiscal year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H99E88981933548A28DA72E2342E3B3E6"><enum>12.</enum><header>Allotment of funds</header> <subsection id="H248A2DA4897B49A486BB212E40959F92"><enum>(a)</enum><header>Formula</header><text display-inline="yes-display-inline">Section 604(a) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1384">33 U.S.C. 1384(a)</external-xref>) is amended by striking <quote>each of fiscal years 1989 and 1990</quote> and inserting <quote>each fiscal year</quote>.</text></subsection> 
<subsection id="H84FC7FE16BD2435F9055BEA66F05284B" commented="no"><enum>(b)</enum><header>Wastewater infrastructure workforce development</header><text>Section 604 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1384">33 U.S.C. 1384</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H96BEA79905304A888E46488CD00A57AA"> <subsection id="HE6C35D901AE94AB39C8650494BA24C95" commented="no"><enum>(d)</enum><header>Wastewater infrastructure workforce development</header><text>A State may reserve each fiscal year up to 1 percent of the sums allotted to the State under this section for the fiscal year to carry out workforce development, training, and retraining activities described in section 104(g).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H3684B787273D4466BBE8D18B98A86566" section-type="subsequent-section"><enum>13.</enum><header>Reservation of funds for Territories of the United States</header><text display-inline="no-display-inline">Title VI of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381</external-xref> et seq.) is amended by striking section 607 and inserting the following:</text> <quoted-block style="OLC" id="H5CB25692FF244B1499E579FCFB024CC5" display-inline="no-display-inline"> <section id="H8A32B664BC1D4AB4BFD99EA12B99AE2F"><enum>607.</enum><header>Reservation of funds for Territories of the United States</header> <subsection id="H6FC47C47BF1346EC8007BACBCA312F56" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"></text> 
<paragraph id="H2E2937C592524F37B432B2AC86CF27F1" commented="no"><enum>(1)</enum><header>Reservation</header><text>For each fiscal year, the Administrator shall reserve 1.5 percent of available funds, as calculated in accordance with paragraph (2).</text></paragraph> <paragraph id="H4907DAC923FB44C3817DB33EA0C65650" commented="no"><enum>(2)</enum><header>Calculation of available funds</header><text display-inline="yes-display-inline">The amount of available funds shall be calculated by subtracting the amount of any funds reserved under section 518(c) from the amount of funds made available to carry out this title (before allotments to the States under section 604(a)).</text></paragraph></subsection> 
<subsection id="H21C25996D9DA48F4A4526E27CA430A1D"><enum>(b)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Funds reserved under this section shall be available only for grants to American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, and the Virgin Islands for projects and activities eligible for assistance under section 603(c).</text></subsection> <subsection id="HE86505572D254D2FBE0090C0817A7850" commented="no"><enum>(c)</enum><header>Limitation</header><text display-inline="yes-display-inline">American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, and the Virgin Islands may not receive funds allotted under section 604(a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>

<paragraph id="HA66971491D7241D794A62A4DFFF79C68"><enum>(1)</enum><text display-inline="yes-display-inline">technical and planning assistance to support municipalities, including municipalities that are rural, small, and tribal communities, in achieving and maintaining compliance with enforceable deadlines, goals, and requirements of the Federal Water Pollution Control Act; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HFFA33AEE499742619E775F4BD3F7EE0C"><enum>16.</enum><header>Report on financial capability of municipalities</header> <subsection id="H9844D3A6788E4EE1AC5B5508093F9B89"><enum>(a)</enum><header>Review</header><text>The Administrator of the Environmental Protection Agency shall conduct a review of existing implementation guidance of the Agency for evaluating the financial resources a municipality has available to implement the requirements of the Federal Water Pollution Control Act to determine whether, and if so, how, such guidance needs to be revised.</text></subsection> 
<subsection id="HE31DB42A616A41918C971E8B3B6AA90F" commented="no"><enum>(b)</enum><header>Considerations</header><text>In conducting the review under subsection (a), the Administrator shall consider—</text> <paragraph id="H0782379C3AAA439AB7199E72D663E81C" commented="no"><enum>(1)</enum><text>the report by the National Academy of Public Administration prepared for the Environmental Protection Agency entitled <quote>Developing a New Framework for Community Affordability of Clean Water Services</quote>, dated October 2017;</text></paragraph> 
<paragraph id="H06FF31EFC7D34B1DAECA88C3D668753F" commented="no"><enum>(2)</enum><text>the report developed by the National Environmental Justice Advisory Council entitled <quote>EPA’s Role in Addressing the Urgent Water Infrastructure Needs of Environmental Justice Communities</quote>, dated August 2018, and made available on the website of the Administrator in March 2019;</text></paragraph> <paragraph id="H03F1F0ACFA714445A6F3081EF97F4695" commented="no"><enum>(3)</enum><text>the report prepared for the American Water Works Association, the National Association of Clean Water Agencies, and the Water Environment Federation entitled <quote>Developing a New Framework for Household Affordability and Financial Capability Assessment in the Water Sector</quote>, dated April 17, 2019;</text></paragraph> 
<paragraph id="HC6F6BDC26F4D46168323E34E7AC911CD" commented="no"><enum>(4)</enum><text>the recommendations of the Environmental Financial Advisory Board related to municipal financial capability assessments, prepared at the request of the Administrator; and</text></paragraph> <paragraph id="H72E9B8D323C64491BB6783ADC6E8BBDA" commented="no"><enum>(5)</enum><text>any other information the Administrator considers appropriate.</text></paragraph></subsection> 
<subsection id="H09A0D42229AE400BBFAF4FBB6DE6DFEA"><enum>(c)</enum><header>Engagement and transparency</header><text>In conducting the review under subsection (a), the Administrator shall—</text> <paragraph id="HCB12BC4C5B96436AA20E081386C249A6"><enum>(1)</enum><text>after providing public notice, consult with, and solicit advice and recommendations from, State and local governmental officials and other stakeholders, including nongovernmental organizations; and</text></paragraph> 
<paragraph id="H4EEC47767C26429187103DB5EC696C2B"><enum>(2)</enum><text>ensure transparency in the consultation process.</text></paragraph></subsection> <subsection id="H6B11C34195354DDA941160F0C7B616C7"><enum>(d)</enum><header>Report</header><text>Not later than 18 months after the date of enactment of this Act, the Administrator shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate, and make publicly available, a report on the results of the review conducted under subsection (a), including any recommendations for revisions to the guidance.</text></subsection></section> 
<section id="HC1CCF4C36B704CFBB0D3E835E4BF77AC"><enum>17.</enum><header>Review of secondary treatment technologies</header> 
<subsection id="H068AB8C41AE148A19BE1DC89CD74B26D" commented="no"><enum>(a)</enum><header>In general</header> 
<paragraph id="H25CBFD03DC114AA2A3527A503127B06F" commented="no"><enum>(1)</enum><header>Development of data collection means</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall publish in the Federal Register a notice to solicit public comment (including the opportunity for public hearings and listening sessions) on the collection of data regarding the existing capabilities of publicly owned treatment works to reduce the effluent concentration of pathogens (or pathogen indicators) in the discharge of such treatment works, in order to determine an appropriate means to collect such data in a sufficient amount, and of a sufficient quality, to develop a representational sample of such capabilities.</text></paragraph> <paragraph id="HA526AC94C21740CE88921221919B4936" commented="no"><enum>(2)</enum><header>Data collection</header><text>Not later than 18 months after the date of enactment of this Act, the Administrator shall publish in the Federal Register the data collection means determined appropriate pursuant to paragraph (1) and initiate the collection of data using such means.</text></paragraph> 
<paragraph id="H363E125AC28E47D18E2D50EB6126EC4A" commented="no"><enum>(3)</enum><header>Determination on secondary treatment regulations</header><text>Upon completion of data collection pursuant to paragraph (2), the Administrator shall make the data available to the public and make a determination whether such data support a revision to the secondary treatment standard for pathogens (or pathogen indicators) pursuant to section 304(d)(1) of the Federal Water Pollution Control Act.</text></paragraph> <paragraph id="HB70D0CC7D63E4D3BB46EFD4B54EF6787" commented="no"><enum>(4)</enum><header>Limitation</header><text>The Administrator may not propose or finalize any modifications to requirements pursuant to section 402 of the Federal Water Pollution Control Act related to wastewater blending, bypass, or peak wet weather discharges from publicly owned treatment works until after the date on which the Administrator makes a determination under paragraph (3).</text></paragraph></subsection> 
<subsection id="H6FE9773E7A5D464BB42671BAAA5E93DC" commented="no"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HF1AD507CFDD04E86909E864308B28534" commented="no"><enum>(1)</enum><header>Bypass</header><text>The term <term>bypass</term> has the meaning given that term in section 122.41(m) of title 40, Code of Federal Regulations.</text></paragraph>
