 <section id="H46ECBBC54B18436B99C48051EB79125D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Older Workers Against Discrimination Act</short-title></quote>.</text> </section><section id="H8F375890AC8D47D6802DEE4BDA3F954A"><enum>2.</enum><header>Standards of proof</header> <subsection id="H49D0EF682B994948BF7E50E5EC2AA3AA"><enum>(a)</enum><header>Age discrimination in employment Act of 1967</header> <paragraph id="HA542C905897E4240BDF2A6FCF30263E3"><enum>(1)</enum><header>Clarifying prohibition against impermissible consideration of age in employment practices</header><text>Section 4 of the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/623">29 U.S.C. 623</external-xref>) is amended by inserting after subsection (f) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H0BD4C26C20914F7F89E286BD169AD1BE" style="OLC">
						<subsection id="HFAC9F331CFA845119A137DCB7CCFA79A"><enum>(g)</enum>
 <paragraph commented="no" display-inline="yes-display-inline" id="H2F73EF65FE1A45F887A98DF958CA8BD9"><enum>(1)</enum><text>Except as otherwise provided in this Act, an unlawful practice is established under this Act when the complaining party demonstrates that age or an activity protected by subsection (d) was a motivating factor for any practice, even though other factors also motivated the practice.</text>
 </paragraph><paragraph id="H447BDDE05256494BB4B3C3025AFA4AD3" indent="up1"><enum>(2)</enum><text>In establishing an unlawful practice under this Act, including under paragraph (1) or by any other method of proof, a complaining party—</text>
 <subparagraph id="HBACDB36E614F4B1A97EC48ACE230770E"><enum>(A)</enum><text>may rely on any type or form of admissible evidence and need only produce evidence sufficient for a reasonable trier of fact to find that an unlawful practice occurred under this Act; and</text>
 </subparagraph><subparagraph id="H7D0BE71DCDFD436F859FD3BFF8368554"><enum>(B)</enum><text>shall not be required to demonstrate that age or an activity protected by subsection (d) was the sole cause of a practice.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H57D71995374940B4805F708C6516D0F6"><enum>(2)</enum><header>Remedies</header><text>Section 7 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/626">29 U.S.C. 626</external-xref>) is amended—</text> <subparagraph id="H63D6C6E37AE0445E81B4D6327712DCC9"><enum>(A)</enum><text>in subsection (b)—</text>
 <clause id="H50A4E7C442C44C9D9C9FB7993EE0E921"><enum>(i)</enum><text>in the first sentence, by striking <quote>The</quote> and inserting <quote>(1) The</quote>;</text> </clause><clause id="H92B4A328EE62453DB76DE710FC6D8649"><enum>(ii)</enum><text>in the third sentence, by striking <quote>Amounts</quote> and inserting the following:</text>

 <paragraph id="HEA80C03D412241C5BBFDF2F56C799C83" indent="up1"><enum>(2)</enum><text>Amounts</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </clause><clause id="HB75C51EFC20D48AFA6D14C921A6412A1"><enum>(iii)</enum><text>in the fifth sentence, by striking <quote>Before</quote> and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="HD974C2F16D664BD6817102DAEB2C804D" style="OLC">
 <paragraph id="H8BF6BBBB94EC473F97A1B51EB8CF2AB6" indent="up1"><enum>(4)</enum><text>Before</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </clause><clause id="H76322D8824634B9C976AF6772CBE61CC"><enum>(iv)</enum><text>by inserting before paragraph (4), as designated by clause (iii) of this subparagraph, the following:</text>
							<quoted-block display-inline="no-display-inline" id="H64F5C331F37D4A089F7D9C51579E40BF" style="OLC">
 <paragraph id="H9E31F9DF4A9D4E94ADA8B43FE67F0850" indent="up1"><enum>(3)</enum><text>On a claim in which an individual demonstrates that age was a motivating factor for any employment practice, under section 4(g)(1), and a respondent demonstrates that the respondent would have taken the same action in the absence of the impermissible motivating factor, the court—</text>
 <subparagraph id="HFCBA122F14994BA7AC75C449777AFC47"><enum>(A)</enum><text>may grant declaratory relief, injunctive relief (except as provided in subparagraph (B)), and attorney’s fees and costs demonstrated to be directly attributable only to the pursuit of a claim under section 4(g)(1); and</text>
 </subparagraph><subparagraph id="H86E9799F051D4FEFB23911D3264AFCA3"><enum>(B)</enum><text>shall not award damages or issue an order requiring any admission, reinstatement, hiring, promotion, or payment.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="H28BCF09F7F3C475397C7771F0A7AD5D5"><enum>(B)</enum><text>in subsection (c)(1), by striking <quote>Any</quote> and inserting <quote>Subject to subsection (b)(3), any</quote>.</text> </subparagraph></paragraph><paragraph id="H4DFD24CDA3C74A46B404BC4EFB873A8B"><enum>(3)</enum><header>Definitions</header><text>Section 11 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/630">29 U.S.C. 630</external-xref>) is amended by adding at the end the following:</text>

 <subsection id="HF180C787EEE94F25B3DDEF9F70BE9A1E"><enum>(m)</enum><text>The term <term>demonstrates</term> means meets the burdens of production and persuasion.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph><paragraph id="H585AABFB1777464381B98614821891CF"><enum>(4)</enum><header>Federal employees</header><text>Section 15 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/633a">29 U.S.C. 633a</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC591A41C716B4DDB9DA80B64E7E59D1F" style="OLC">
 <subsection id="H0ADED1C5912F47EAB6FE802871EDFA45"><enum>(h)</enum><text>Sections 4(g) and 7(b)(3) shall apply to mixed motive claims (involving practices described in section 4(g)(1)) under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HEC74ADC4DB504C8D947EB3F0C72CEDDD"><enum>(b)</enum><header>Title VII of the Civil Rights Act of 1964</header>
				<paragraph id="HBD08C66E23EF48CB9B0B6EEBD6F743E2"><enum>(1)</enum><header>Clarifying prohibition against impermissible consideration of race, color, religion, sex, or
 national origin in employment practices</header><text>Section 703 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-2">42 U.S.C. 2000e–2</external-xref>) is amended by striking subsection (m) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H46F2614FCBB14A00BB9D8BEFA7FE5B27" style="OLC">
 <subsection id="HC84A4B5A78094B129FBE1BEF2A3465D9"><enum>(m)</enum><text>Except as otherwise provided in this title, an unlawful employment practice is established when the complaining party demonstrates that race, color, religion, sex, or national origin or an activity protected by section 704(a) was a motivating factor for any employment practice, even though other factors also motivated the practice.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block>
 </paragraph><paragraph id="H73494F8ECC7043A2BD42CA5071670D26"><enum>(2)</enum><header>Federal employees</header><text>Section 717 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-16">42 U.S.C. 2000e–16</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H04C4FC3D160A47648B08C6B0D1989891" style="OLC"> <subsection id="H0628CEDA0792442FAB4D1EE2AB20645B"><enum>(g)</enum><text>Sections 703(m) and 706(g)(2)(B) shall apply to mixed motive cases (involving practices described in section 703(m)) under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H0AA48A9D42E548B1AD90F8EF0E90D47E"><enum>(c)</enum><header>Americans With Disabilities Act of 1990</header>
 <paragraph id="H9DA954365D5441B08F940DE50AAB82CA"><enum>(1)</enum><header>Definitions</header><text>Section 101 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12111">42 U.S.C. 12111</external-xref>) is amended by adding at the end the following:</text>

 <paragraph id="H90E70CF16A984E6E980F932496A1D3CA"><enum>(11)</enum><header>Demonstrates</header><text>The term <term>demonstrates</term> means meets the burdens of production and persuasion.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph><paragraph id="HBFC85D65E761481195FCF495AAD661B9"><enum>(2)</enum><header>Clarifying prohibition against impermissible consideration of disability in employment practices</header><text>Section 102 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12112">42 U.S.C. 12112</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HA008EF3BA5514C229E18E2D4E419BB59" style="OLC">
						<subsection id="HA053155042C8458E8D45D95DAE1D5983"><enum>(e)</enum><header>Proof</header>
 <paragraph id="HFA22E74C4B13455EA03D8C47550E42BC"><enum>(1)</enum><header>Establishment</header><text>Except as otherwise provided in this Act, a discriminatory practice is established under this Act when the complaining party demonstrates that disability or an activity protected by subsection (a) or (b) of section 503 was a motivating factor for any employment practice, even though other factors also motivated the practice.</text>
 </paragraph><paragraph id="HF0ECF2B0BE2C42B0A78D1434A7B9E386"><enum>(2)</enum><header>Demonstration</header><text>In establishing a discriminatory practice under paragraph (1) or by any other method of proof, a complaining party—</text>
 <subparagraph id="H9707A616FD8C4955803AA5FC08111E3F"><enum>(A)</enum><text>may rely on any type or form of admissible evidence and need only produce evidence sufficient for a reasonable trier of fact to find that a discriminatory practice occurred under this Act; and</text>
 </subparagraph><subparagraph id="H220D3442E1EE4214B563EFFD3EA44328"><enum>(B)</enum><text>shall not be required to demonstrate that disability or an activity protected by subsection (a) or (b) of section 503 was the sole cause of an employment practice.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H7C15617CD920454FB9C776D41780C751"><enum>(3)</enum><header>Certain anti-retaliation claims</header><text>Section 503(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12203">42 U.S.C. 12203(c)</external-xref>) is amended—</text> <subparagraph id="HF4FE4F05697345859D311C23F4211F18"><enum>(A)</enum><text>by striking <quote>The remedies</quote> and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H1D4742FD3C8E4F73AD86C35F050F1B69" style="OLC">
 <paragraph id="H9EABE8CCC73C4DD696F56E144874FF70"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the remedies</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph><subparagraph id="HA8ED1119249C477784C0063B0A692A6E"><enum>(B)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H96D78D5F71A04E4F87D9172342F3DB90" style="OLC">
 <paragraph id="H1AF5AFFF4DA247258604CCEB511BA689"><enum>(2)</enum><header>Certain anti-retaliation claims</header><text>Section 107(c) shall apply to claims under section 102(e)(1) with respect to title I.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="HB60F0BAD270C45D4B7744D1A23410D75"><enum>(4)</enum><header>Remedies</header><text>Section 107 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12117">42 U.S.C. 12117</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HF043D6E361F0427DB839800DAC2F2486" style="OLC">
 <subsection id="H427DF3AFF359415EAE76A64438DB7ACE"><enum>(c)</enum><header>Discriminatory motivating factor</header><text>On a claim in which an individual demonstrates that disability was a motivating factor for any employment practice, under section 102(e)(1), and a respondent demonstrates that the respondent would have taken the same action in the absence of the impermissible motivating factor, the court—</text>
 <paragraph id="HC9CE7AE36E724D4E90AEFDAD18902728"><enum>(1)</enum><text>may grant declaratory relief, injunctive relief (except as provided in paragraph (2)), and attorney’s fees and costs demonstrated to be directly attributable only to the pursuit of a claim under section 102(e)(1); and</text>
 </paragraph><paragraph id="H28A72D028E384ED2B4E72FD2E1F14EDE"><enum>(2)</enum><text>shall not award damages or issue an order requiring any admission, reinstatement, hiring, promotion, or payment.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC2EF5B6FE3DD49C3BE7ED2B7E744E36B"><enum>(d)</enum><header>Rehabilitation Act of 1973</header>
 <paragraph id="H2F6397D50EF241248128706CCE9481D1"><enum>(1)</enum><header>In general</header><text>Sections 501(f), 503(d), and 504(d) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/791">29 U.S.C. 791(f)</external-xref>, 793(d), and 794(d)), are each amended by adding after <quote>title I of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12111">42 U.S.C. 12111</external-xref> et seq.)</quote> the following: <quote>, including the standards of causation or methods of proof applied under section 102(e) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12112">42 U.S.C. 12112(e)</external-xref>),</quote>.</text>
 </paragraph><paragraph id="H51BC33401CBA496EA469FE319CED5038"><enum>(2)</enum><header>Federal employees</header><text>The amendment made by paragraph (1) to section 501(f) shall be construed to apply to all employees covered by section 501.</text>
 </paragraph></subsection></section><section id="H607267C0D663446E88B046E01A8282D0"><enum>3.</enum><header>Application</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall apply to all claims pending on or after the date of enactment of this Act.</text>
 </section><section id="HC50E3E8366DC4D6A91350FC385B63685"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision or portion of a provision of this Act, an amendment or portion of an amendment made by this Act, or the application of any provision or portion thereof or amendment or portion thereof to particular persons or circumstances is held invalid or found to be unconstitutional, the remainder of this Act, the amendments made by this Act, or the application of that provision or portion thereof or amendment or portion thereof to other persons or circumstances shall not be affected.</text>
 </section><section id="H4C754E968339480FA274CEC7C9280D58"><enum>5.</enum><header>Report by Government Accountability Office</header><text display-inline="no-display-inline">Not later than 2 years after the date of the enactment of this Act, the Government Accountability Office shall submit to the Congress a report analyzing how the Equal Employment Opportunity Commission investigates mixed motive age discrimination claims arising under the Acts amended by this Act, focusing on—</text>
 <paragraph id="HB039D3B5A6934A4CA0C3196F5219C552"><enum>(1)</enum><text>the ability of the Commission to meet the demands of its workload under such Acts;</text> </paragraph><paragraph id="H8E751CD82E7146E0A77FC2DFD2DD903D"><enum>(2)</enum><text>the plans of the Commission for investigating systemic age discrimination in violation of such Acts;</text>
 </paragraph><paragraph id="HB84D1F614B044A809F6079CBDCE9EFC8"><enum>(3)</enum><text>the plans of the Commission for litigation under such Acts; and</text> </paragraph><paragraph id="H7EE23496DBCE444FADA32F9B363B7C54"><enum>(4)</enum><text>the options for improving the ability of the Commission to respond to allegations of age discrimination in violation of such Acts.</text>
 </paragraph></section><section id="H773B36F6C17E48DE8277D7AADDB9B183"><enum>6.</enum><header>Study and report to Congress</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Labor and the Equal Opportunity Employment Commission shall jointly conduct a study to determine the number of claims pending or filed, in addition to cases closed, by women who may have been adversely impacted by age discrimination as a motivating factor in workplace discrimination or employment termination. The Secretary of Labor and Chairman of the Commission shall jointly submit to the Congress, and make available to the public, a report that contains the results of the study, including recommendations for best practices to prevent and to combat gender and age discrimination as it relates to women in the workplace.</text>
 </section><section id="H536C2E32173949079C9F6DFACCAAF24A"><enum>7.</enum><header>Reports</header><text display-inline="no-display-inline">For the 5-year period beginning on the date of the enactment of this Act, the Chairman of Equal Employment Opportunity Commission shall submit to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report at 1-year intervals on the number of age discrimination in employment claims brought under this Act with the Equal Employment Opportunity Commission in the period for which such report is submitted.</text>
		</section><section id="HCC3E21D374984CB3A504760EBDAB4E88"><enum>8.</enum><header>Report by the United States Commission on Civil Rights</header>
 <subsection id="H825FE1AC40294449B6EC1F053AECB935"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">With funds appropriated in advance to carry out this section, and consistent with the operational and procedural requirements of the United States Commission on Civil Rights, the Commission shall submit to the appropriate committees of the Congress a report containing an analysis of the status of Federal mixed motive age discrimination in employment claims made against Federal agencies, including—</text>
 <paragraph id="H6C3C940F028B4BC9AAF5FC6928B3AD9F"><enum>(1)</enum><text>the number of such claims, specified by the Federal agency against which such claims are made; and</text> </paragraph><paragraph id="H36EDBB7F32364E19934E4B61FBAB4DFB"><enum>(2)</enum><text>other related information the Commission determines to be appropriate.</text>
 </paragraph></subsection><subsection id="HB67AA8FA4CF84438A4B9ACFBF2A73BF7"><enum>(b)</enum><header>Submission of report</header><text display-inline="yes-display-inline">The report required by subsection (a) shall be submitted not later that 5 years after the date of the enactment of this Act.</text>
			</subsection></section></legis-body>
