			 others, or law enforcement, with new tools to prevent gun violence.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="HED91ECF3D6AE4AD491EA91E5DA59498B" style="OLC">
 <section id="H88C132EE0D4D4EBC8F9FF8CA8ADAC23D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Extreme Risk Protection Order and Violence Prevention Act of 2019</short-title></quote>.</text> </section><section id="idB9698A9EFF90459AA43FE0DB3773B35E"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
 <paragraph id="id1843ABF6BFD34CA7932895C1D61B9C97"><enum>(1)</enum><text display-inline="yes-display-inline">each State and Indian tribe should enact extreme risk protection order legislation described in part NN of title I of the Omnibus Crime Control and Safe Streets Act of 1968, as added by section 3; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id93C8F4043AFC4A2FA5A7525107E3A09B"><enum>(2)</enum><text display-inline="yes-display-inline">such extreme risk protection order legislation is an important tool in the efforts of States and Indian tribes to ensure that firearms and ammunition are kept out of the hands of individuals whom a court has determined to be a significant danger to themselves or others.</text>
			</paragraph></section><section id="id1B31AEC8F74F4399B9281527BC7B7297"><enum>3.</enum><header>Extreme Risk Protection Order Grant Program</header>
 <subsection id="idC05CCCC4F24B41E9A3D9E9E3DB36CB7B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10101">34 U.S.C. 10101</external-xref> et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id5A212AA23F1B47E4A0EFD66D79F7ED38" style="OLC">
					<part id="idA9E1683BF90A47B690DFC66A7A9F919A" style="OLC"><enum>NN</enum><header>Extreme Risk Protection Order Grant Program</header>
 <section id="H38EA2F7561D24C8091385A2356A8E57F"><enum>3041.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title—</text> <paragraph id="idA30C7260FAEB47F5BFF2F11907AF8772"><enum>(1)</enum><text display-inline="yes-display-inline">the terms <term>ammunition</term> and <term>firearm</term> have the meanings given those terms in section 921(a) of title 18, United States Code;</text>
 </paragraph><paragraph id="idA309080491114E29B9D449D884D4D057"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>extreme risk protection order</term> means a written order, issued by a State or tribal court or signed by a magistrate that, for a period not to exceed 12 months—</text>
 <subparagraph id="H91A1684C6DD14E5AA09517620E243F83"><enum>(A)</enum><text>prohibits the individual named in the order from having under the custody or control of the individual, purchasing, possessing, or receiving any firearms; and</text>
 </subparagraph><subparagraph id="HB101DF1CDE484AD0BA586C5E982F55F4"><enum>(B)</enum><text>requires a firearm be removed;</text> </subparagraph></paragraph><paragraph id="idE88F4810E65446DF9D1A654D2756031F"><enum>(3)</enum><text>the term <term>family or household member</term> means, with respect to an individual, any—</text>
 <subparagraph id="id7DF94612E5194E6EB8AE63FC7628D4A9"><enum>(A)</enum><text>individual related by blood, marriage, or adoption to the respondent;</text> </subparagraph><subparagraph id="id4F0C9968BBC449F4B661E5846B93F8A7"><enum>(B)</enum><text>dating partner (as defined in section 2266 of title 18, United States Code) of the respondent;</text>
 </subparagraph><subparagraph id="id1C87048370F640D39F68C5B40DC6495E"><enum>(C)</enum><text>individual who has a child in common with the respondent, regardless of whether the individual has—</text> <clause id="id9FB5240A2DAD443D8C0F04224C449036"><enum>(i)</enum><text>been married to the respondent; or</text>
 </clause><clause id="idF2A96DE92EC04C4288F58B17A6B96BBF"><enum>(ii)</enum><text>lived together with the respondent at any time;</text> </clause></subparagraph><subparagraph id="id2D082DB596DE4CD3B4321AC249995A59"><enum>(D)</enum><text>an individual who resides or has resided with the respondent during the past year;</text>
 </subparagraph><subparagraph id="idE262AA4E4E0F43E9A6A8117FFAD311FC"><enum>(E)</enum><text>a spouse or intimate partner (as defined in section 2266 of title 18, United States Code) of the respondent;</text>
 </subparagraph><subparagraph id="iddc59637ad5a9467eb1a031cb9a8d5afa"><enum>(F)</enum><text>individual who has a biological or legal parent-child relationship with the respondent, including a stepparent-stepchild and grandparent-grandchild relationship; and</text>
 </subparagraph><subparagraph id="id0D29208543054286BC71C4FF4E6BF290"><enum>(G)</enum><text>any individual who is acting or has acted as the legal guardian of the respondent;</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89911C2411674E249F40F322F9E486EB"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>Indian tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>);</text>
 </paragraph><paragraph id="id9DCB969A4B9B4EC08765EA64A3BF3572"><enum>(5)</enum><text>the term <term>petitioner</term> means the law enforcement officer, or family or household member of an individual, who submits a petition for an extreme risk protection order under section 3042(b)(1);</text>
 </paragraph><paragraph id="id062C8F49D5174A74A56B9064B2B46943"><enum>(6)</enum><text>the term <term>qualifying State or tribal law</term> means a law of a State or Indian tribe that the Attorney General has determined to be in compliance with the minimum requirements described in section 3042;</text>
 </paragraph><paragraph id="idC71946FB0F7D4607B3153FA243D65887"><enum>(7)</enum><text>the term <term>respondent</term> means an individual who is named in a petition for an extreme risk protection order under section 3042(b)(1);</text>
 </paragraph><paragraph id="id10546639FA13435797401A29C34AFC7B"><enum>(8)</enum><text>the term <term>State</term> means—</text> <subparagraph id="ID1AA0C8024B5B488EA17F81A36FBC1821"><enum>(A)</enum><text>a State;</text>
 </subparagraph><subparagraph id="ID792A8B98FE9C42679797E3F1D68FC25F"><enum>(B)</enum><text>the District of Columbia;</text> </subparagraph><subparagraph id="ID28D43A31F3264D79A65D4436F400AF2F"><enum>(C)</enum><text>the Commonwealth of Puerto Rico; and</text>
 </subparagraph><subparagraph id="ID4912258B462B4AAD8DC29F5610699D3D"><enum>(D)</enum><text>any other territory or possession of the United States; and</text> </subparagraph></paragraph><paragraph id="idB13F7824C0D5403F9304BA99072914AD"><enum>(9)</enum><text>the term <term>temporary ex parte extreme risk protection order</term> means a written order, issued by a State court or signed by a magistrate prohibiting a named individual from possessing, purchasing, receiving, or transporting a firearm after the date on which the order is issued until the date on which the hearing for the extreme risk protection order is held.</text>
							</paragraph></section><section id="id48BBB5B24C9D4B7196B4CD7A2AE2D09C"><enum>3042.</enum><header>Extreme risk protection order legislation</header>
 <subsection id="HED1D1F3E435C40BE8901E25500F2B19B"><enum>(a)</enum><header>Enactment of extreme risk protection order legislation</header><text>In order to receive a grant under section 3043, each State or Indian tribe shall have in effect a qualifying State or tribal law.</text>
 </subsection><subsection id="id89049A6B78F84385BCAEF16421AF0C0F"><enum>(b)</enum><header>Minimum requirements for extreme risk protection orders</header><text>A qualifying State or tribal law shall have in effect the following minimum requirements for the issuance of an extreme risk protection order:</text>
								<paragraph id="HC24DD8EBF0344F5CAA677917A4E957E6"><enum>(1)</enum><header>Petition for extreme risk protection order</header>
 <subparagraph id="idFB23E9B837CC4603A49A8A05751E7B1C"><enum>(A)</enum><header>In general</header><text>A law enforcement officer, or family or household member of an individual, may submit a petition to a State or tribal court, on a form designed by the courts administrator of the State or similar office, that—</text>
 <clause id="H78E587EBE03E429BA5EE9FDB006F0E54"><enum>(i)</enum><text>describes the facts and circumstances necessitating that an extreme risk protection order be issued against the respondent because the respondent poses a significant danger of causing personal injury to himself or herself or others by—</text>
 <subclause id="id49920F0959724D068C222C85E9B9F190"><enum>(I)</enum><text>having a firearm or ammunition in his or her custody or control; or</text> </subclause><subclause id="id48D66D7D80904EBD8F28D3A2358DA541"><enum>(II)</enum><text>purchasing, possessing, or receiving a firearm or ammunition;</text>
 </subclause></clause><clause id="HE6CCAD38AEFC4B328DF94FFC38739353"><enum>(ii)</enum><text>is accompanied by a sworn affidavit, signed by the petitioner, stating the specific facts that give rise to reasonable fear of significant dangerous acts by the respondent;</text>
 </clause><clause id="id97952B19CF2E46B187C2BA1A937498AC"><enum>(iii)</enum><text>identifies the quantities, types, and locations of all firearms and ammunition the petitioner believes to be in the current ownership, possession, custody, or control of the respondent; and</text>
 </clause><clause id="id889DC854C9574459875C156B2D62F57C"><enum>(iv)</enum><text>identifies whether there is a known extreme risk protection order already in effect against the respondent.</text>
 </clause></subparagraph><subparagraph id="id0C7F5896497B44C995BB65A9D2FED955"><enum>(B)</enum><header>Good faith notice</header><text>A petitioner who submits a petition under subparagraph (A) shall be required to make a good faith effort to provide notice to other family or household members of the respondent, or to any other known third party, who may be at risk of violence because of the submission of such petition.</text>
									</subparagraph></paragraph><paragraph id="id700A53D178F9438F981F30DBE70EE9C4"><enum>(2)</enum><header>Issuance of extreme risk protection orders</header>
									<subparagraph id="idAC17D36E83DA4BCB9A625F7F4F1D18FC"><enum>(A)</enum><header>Hearing</header>
 <clause id="idC791AE3645CA4ABF8AB07BD13FDD6107"><enum>(i)</enum><header>In general</header><text>Upon receipt of a petition under paragraph (1), the court shall—</text> <subclause id="idB5E1647B740240778BCA4196306699D1"><enum>(I)</enum><text>order a hearing to be held not later than 14 days after the date of such order; and</text>
 </subclause><subclause id="id826214E9EF9F40C1AEB036DC18B3ADA5"><enum>(II)</enum><text>issue a notice of the hearing ordered under subclause (I) to the respondent.</text> </subclause></clause><clause id="id85D08ACA9081491D813E48A4DF778502"><enum>(ii)</enum><header>Telephone hearing</header><text>A court may conduct the hearing required under clause (i) by telephone, pursuant to local court rules.</text>
 </clause><clause id="id3A957CFFFD5E424EB918380F15F11FB8"><enum>(iii)</enum><header>Determination</header><text>If the court finds by clear and convincing evidence that the respondent poses a significant danger of causing personal injury to himself or herself or others by having in his or her custody or control, or by purchasing, possessing, or receiving, a firearm or ammunition, the court shall issue an extreme risk protection order for a period the court determines is appropriate, which may not exceed 12 months.</text>
										</clause></subparagraph><subparagraph id="idECB8DBE0CCB545EBAC010C7394FA4578"><enum>(B)</enum><header>Consideration of evidence</header>
 <clause id="idC84A1223151342EE85C47CC17EC48C34"><enum>(i)</enum><header>In general</header><text>In determining whether to issue an extreme risk protection order, the court—</text> <subclause id="idB86251967E484D77B9F6E70982CAE2CF"><enum>(I)</enum><text>may consider relevant evidence, such as—</text>
 <item id="idC5EDB5AB56354DF2AE859DB910A6FB3A"><enum>(aa)</enum><text>a recent threat or act of violence by the respondent against himself or herself or others;</text> </item><item id="idD508B69695254F018A7E9183166E18F4"><enum>(bb)</enum><text>a threat or act of violence by the respondent against himself or herself or others in the past 12 months;</text>
 </item><item id="idF97A2683A62F4E2A841C01A1611BF741"><enum>(cc)</enum><text>evidence of a serious mental illness;</text> </item><item id="id16B128EEB2B64939959401F498128065"><enum>(dd)</enum><text>a previously issued extreme risk protection order or a violation of a previously issued extreme risk protection order;</text>
 </item><item id="id71FC83CD078E40FD8BC9A79C809E842A"><enum>(ee)</enum><text>whether the respondent has been convicted of a crime of domestic violence or other violence;</text> </item><item id="idFEABFB1A1F1C4B258ACCA6BF521583CC"><enum>(ff)</enum><text>whether the respondent has used or threatened to use weapons against himself or herself or others;</text>
 </item><item id="id37F14191379946FA866F898D72BF9B80"><enum>(gg)</enum><text>the unlawful use of a firearm by the respondent;</text> </item><item id="id95C00EC7E0D14E9797EA553AA48C25E0"><enum>(hh)</enum><text>the recurring use or threat of use of physical force against another person or stalking another person;</text>
 </item><item id="id1506782503FD4EE083BA3B35CBCA6477"><enum>(ii)</enum><text>corroborated evidence of the abuse of controlled substances or alcohol by the respondent;</text> </item><item id="id1EAE6FFE291947D8AD2622E291D3397E"><enum>(jj)</enum><text>relevant information from family or household members concerning the respondent; and</text>
 </item><item id="id64D7CE02B51C41E890DBC9A5EF02B959"><enum>(kk)</enum><text>witness testimony taken while the witness is under oath relating to the matter before the court; and</text>
 </item></subclause><subclause id="idE82B27106FB246AB9B7FFAEE234F0E76"><enum>(II)</enum><text>shall consider whether a mental health evaluation or chemical dependency evaluation is appropriate.</text> </subclause></clause><clause id="idDA7CBBCBD04C4683A109BF6FBA9DAC71"><enum>(ii)</enum><header>Presentation of evidence</header><text>Anyone who offers evidence or rec­om­men­da­tions relating to the petition submitted under paragraph (1) shall—</text>
 <subclause id="idDFDA0E0ABB8E469F895FD022585ED786"><enum>(I)</enum><text>present the evidence or recommendations in writing to the court and submit a copy of such evidence or recommendations to each party or the attorney for a party; or</text>
 </subclause><subclause id="idCD2F2900D90249C6824604DD714DFA84"><enum>(II)</enum><text>present the evidence under oath at a hearing at which all parties are present.</text> </subclause></clause><clause id="id4B483F64DDA24F27A11F60BE0F50B02B"><enum>(iii)</enum><header>Mental health and chemical dependency evaluations</header><text>If a court determines that a mental health evaluation or chemical dependency evaluation is appropriate under clause (i)(II), the court may order the appropriate evaluation.</text>
 </clause></subparagraph><subparagraph id="id1C7AA293C820419C8879AC3BD4FF1767"><enum>(C)</enum><header>Contents of order</header><text>If a court issues an extreme risk protection order, the order shall contain—</text> <clause id="id44a9cc00b7a748648854dc0bcdea1c1b"><enum>(i)</enum><text>a statement on the grounds supporting the issuance of the order;</text>
 </clause><clause id="id81a2b66028234d179ddf6b2d8e09686e"><enum>(ii)</enum><text>the date on which the order was issued;</text> </clause><clause id="id653ee17678c34f11b947b3b04be4cf95"><enum>(iii)</enum><text>the date on which the order expires;</text>
 </clause><clause id="ide0c67d7d6e0f4c7bbf96ca9dce901dc1"><enum>(iv)</enum><text>whether a mental health evaluation or chemical dependency evaluation of the respondent is required;</text> </clause><clause id="id168e300b411349a9b061bce56a398fe4"><enum>(v)</enum><text>the address of the court in which a responsive pleading may be filed;</text>
 </clause><clause id="id2a27e69eda454cecb3248333490a3f56"><enum>(vi)</enum><text>a description of the requirements for surrender of all firearms and ammunition owned by the respondent; and</text>
 </clause><clause id="id36f2f2ebf3664a018e8d9622b1d99c4e"><enum>(vii)</enum><text>a clear statement of instruction on surrendering to the appropriate local law enforcement agency all firearms and ammunition owned by the respondent or in the custody, control, or possession of the respondent and any license to carry a concealed weapon or firearm issued pursuant to the laws of the State or Indian tribe, which shall include—</text>
 <subclause id="idface0c51c4fc4ac481d464115f55d5e3"><enum>(I)</enum><text>a clear statement that the respondent may not, during the period for which the order is in effect—</text> <item id="id6C90100223344811973A378E5153A33A"><enum>(aa)</enum><text>have in the control or custody of the respondent a firearm or ammunition; or</text>
 </item><item id="idFE2C587722C943439CC66423877BA38D"><enum>(bb)</enum><text>purchase, possess, or receive, or attempt to do so, a firearm or ammunition; and</text> </item></subclause><subclause id="id71F938E577F346A38361A089A1DA4DCA"><enum>(II)</enum><text>a clear description of the right of the respondent to request not less than 1 hearing to vacate the order and, if the order is renewed, to request a hearing to vacate such renewal.</text>
 </subclause></clause></subparagraph><subparagraph id="idF8AABC9C83E5433A82B811E5205710C8"><enum>(D)</enum><header>Denial of extreme risk protection order</header><text>If a court declines to issue an extreme risk protection order applied for under this paragraph, the court shall issue a written statement describing the specific reasons for declining to issue such order.</text>
									</subparagraph></paragraph><paragraph id="idD1322F484EFD442587F87EE2585FDD17"><enum>(3)</enum><header>Temporary ex parte extreme risk protection order</header>
 <subparagraph id="id2E9D47D585EB47CDA01A3E6006BE2EB4"><enum>(A)</enum><header>In general</header><text>Upon receipt of a petition under paragraph (1), the court may issue a temporary ex parte extreme risk protection order before conducting the hearing required under paragraph (2), if—</text>
 <clause id="idB80A5CD77ED84C3EBC2F42275D35F39F"><enum>(i)</enum><text>a request for a temporary ex parte extreme risk protection order is included in the petition and includes detailed allegations based on personal knowledge that the respondent poses a significant danger of causing personal injury to himself or herself or others in the near future by having in his or her custody or control, or by purchasing, possessing, or receiving, a firearm or ammunition; and</text>
 </clause><clause id="idB517E81209BE4E068C54646798C7E9A8"><enum>(ii)</enum><text>the court finds there is probable cause to believe that the respondent poses a significant danger of causing personal injury to himself or herself or others in the near future by having in his or her custody or control, or by purchasing, possessing, or receiving, a firearm or ammunition.</text>
 </clause></subparagraph><subparagraph id="idD9811AD1EC154ED69A25D4DA692C1A3C"><enum>(B)</enum><header>Requirements</header><text>In determining whether to issue a temporary ex parte extreme risk protection order, the court shall—</text>
 <clause id="idAB0B985A907A4CD5BC85430D1A6936AB"><enum>(i)</enum><text>conduct a hearing, either in person or by telephone, pursuant to local court rules, on the date on which the petition is filed or on the business day immediately following such date; and</text>
 </clause><clause id="idA73AF39039834F5C86CCEF7114749B9D"><enum>(ii)</enum><text>consider all relevant evidence, such as—</text> <subclause id="id045363FFD4AA4622A3541C7E8CBE6CC3"><enum>(I)</enum><text>a recent threat or act of violence by the respondent against himself or herself or others;</text>
 </subclause><subclause id="idE4E436DF94E54821B5A7FD74B662E9F7"><enum>(II)</enum><text>a threat or act of violence by the respondent against himself or herself or others in the past 12 months;</text>
 </subclause><subclause id="idCE4EB2A3848541E688927CDA45D37469"><enum>(III)</enum><text>evidence of a serious mental illness;</text> </subclause><subclause id="idB9673E3835434603A85F2A43548964E3"><enum>(IV)</enum><text>a previously issued extreme risk protection order or a violation of a previously issued extreme risk protection order;</text>
 </subclause><subclause id="id618A8FA9DF2C4B1EA1202B6A55E7D300"><enum>(V)</enum><text>whether the respondent has been convicted of a crime of domestic violence or other violence;</text> </subclause><subclause id="idEB5A713121104EEFAA96F28BFFDF96F7"><enum>(VI)</enum><text>whether the respondent has used or threatened to use weapons against himself or herself or others;</text>
 </subclause><subclause id="id52269C9CC761438887B469C3D46F2E6A"><enum>(VII)</enum><text>the unlawful use of a firearm by the respondent;</text> </subclause><subclause id="id321B6AC6B3C14286BC50937471A46BCE"><enum>(VIII)</enum><text>the recurring use or threat of use of physical force against another person or stalking another person;</text>
 </subclause><subclause id="idE6C0F6E0D6A44AF4A2D86E4FF6C30D6E"><enum>(IX)</enum><text>corroborated evidence of the abuse of controlled substances or alcohol by the respondent;</text> </subclause><subclause id="idC11DE027A5C545AF948E3D022E8F9524"><enum>(X)</enum><text>relevant information from family or household members concerning the respondent; and</text>
 </subclause><subclause id="id88667670C3D148D6A159678563506353"><enum>(XI)</enum><text>witness testimony taken while the witness is under oath relating to the matter before the court.</text> </subclause></clause></subparagraph><subparagraph id="id81E9D2311EAB4393AC75C79126851DFB"><enum>(C)</enum><header>Notice</header><text>If a court issues a temporary ex parte extreme risk protection order, the court shall provide notice of the temporary ex parte firearm violence order to the respondent concurrently with the notice of hearing required under paragraph (2)(A)(i)(II).</text>
 </subparagraph><subparagraph id="id83335803AAE243E8B5861091CA2DA2CA"><enum>(D)</enum><header>Contents of order</header><text>If a court issues a temporary ex parte extreme risk protection order, the order shall include, at a minimum—</text>
 <clause id="idc0684f5299d04ccb8e603517344dd1bb"><enum>(i)</enum><text>a statement for the grounds of the order;</text> </clause><clause id="id55BF92ED0FC14221BC0F14CF39620C7B"><enum>(ii)</enum><text>the date on which the order was issued;</text>
 </clause><clause id="id2E143132133948C28822FA3D2963B636"><enum>(iii)</enum><text>the date and time of the hearing on the extreme risk protection order;</text> </clause><clause id="idDA7C0B3FBF7243AD943D886B4AFDA268"><enum>(iv)</enum><text>the address of the court in which a responsive pleading may be filed;</text>
 </clause><clause id="idC13954EFB9474022AC05B010D6BCCD10"><enum>(v)</enum><text>a clear description of the requirements and process for surrender of firearms and ammunition; and</text> </clause><clause id="id7D31489D957641D68A347B364533D027"><enum>(vi)</enum><text>a clear statement outlining the prohibitions and rights of the respondent under the order, including—</text>
 <subclause id="id0504D838058D4C95A59500C89B353CD8"><enum>(I)</enum><text>a clear statement that the respondent may consult an attorney; and</text> </subclause><subclause id="idFFC6E0998DE14AE98057C22233295EAF"><enum>(II)</enum><text>a clear statement that failure of the respondent to appear at the hearing described in clause (iii) may result in an extreme risk protection order being issued for a period not to exceed 12 months.</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="idECFC2E9F87004B5A9230BDA06CFE30D5"><enum>(4)</enum><header>Termination and extension of extreme risk protection orders</header>
									<subparagraph id="id9816459208A74E6499B2F65B5066A206"><enum>(A)</enum><header>Hearing to vacate order</header>
 <clause id="idE0C0E5972E4E41F397645A926C553FF3"><enum>(i)</enum><header>In general</header><text>A respondent may request not less than 1 hearing to vacate an extreme risk protection order issued against the respondent.</text>
 </clause><clause id="idCA2257F2507445F5A5CF01D26B43F90E"><enum>(ii)</enum><header>Hearing</header><text>Not later than 30 days after the date on which a petitioner is notified of the request of the respondent to vacate an extreme risk protection order, the court shall conduct a hearing on the request.</text>
										</clause><clause id="id933A2C580C974D5CB58F723DACB3E0EC"><enum>(iii)</enum><header>Determination</header>
 <subclause id="id5B8A02B5E66A4ACBA0323E24DE55EE10"><enum>(I)</enum><header>In general</header><text>The court shall vacate an extreme risk protection order if the respondent demonstrates by clear and convincing evidence that the respondent does not pose a significant danger of causing personal injury to himself or herself or others by having in his or her custody or control, or by purchasing, possessing, or receiving, a firearm or ammunition.</text>
 </subclause><subclause id="id4F43267438F54155B31045AC56FFA95C"><enum>(II)</enum><header>Considerations</header><text>In making a determination under this subparagraph, the court may consider relevant evidence, such as—</text>
 <item id="id4F1F3CD8ECD34DC490C6CA01FB6CB984"><enum>(aa)</enum><text>a recent threat or act of violence by the respondent against himself or herself or others;</text> </item><item id="idE4616B23FED24E0BA4C951C1DAD18755"><enum>(bb)</enum><text>a threat or act of violence by the respondent against himself or herself or others in the past 12 months;</text>
 </item><item id="idEFAC7E261ADD415CA7F0370698F19BB6"><enum>(cc)</enum><text>evidence of a serious mental illness;</text> </item><item id="id9556BEF90A87459E80EC7D6F208EFBAE"><enum>(dd)</enum><text>a previously issued extreme risk protection order or a violation of a previously issued extreme risk protection order;</text>
 </item><item id="id651EFED5032F45738AF1AFD08AF153FD"><enum>(ee)</enum><text>whether the respondent has been convicted of a crime of domestic violence or other violence;</text> </item><item id="id4BED383AFA9A4DDCBA24F326B4763084"><enum>(ff)</enum><text>whether the respondent has used or threatened to use weapons against himself or herself or others;</text>
 </item><item id="id2C9F3492349B4F54A8ACBA3A247918D6"><enum>(gg)</enum><text>the unlawful use of a firearm by the respondent;</text> </item><item id="idE886F194A00E4B58BD6921B0EC4AADC3"><enum>(hh)</enum><text>the recurring use or threat of use of physical force against another person or stalking another person;</text>
 </item><item id="id2D29677817D642E2B08310F8195152BF"><enum>(ii)</enum><text>corroborated evidence of the abuse of controlled substances or alcohol by the respondent;</text> </item><item id="idE203A8656EEA4C678B1729315E75F0BC"><enum>(jj)</enum><text>relevant information from family or household members concerning the respondent; and</text>
 </item><item id="idEE7BEBBCEAAA4EC1A5C64933934E9A0E"><enum>(kk)</enum><text>witness testimony taken while the witness is under oath relating to the matter before the court.</text> </item></subclause></clause><clause id="id264F0D1DAA914782A0627CF373FF0CEE"><enum>(iv)</enum><header>Notice to law enforcement officials</header><text>If a court vacates an extreme risk protection order under this subparagraph, the court shall provide notice to the relevant law enforcement agency of such determination and the law enforcement agency shall promptly return any surrendered firearms and ammunition to the respondent.</text>
										</clause></subparagraph><subparagraph id="idDE6B229D92704899A125B69FEAC07287"><enum>(B)</enum><header>Extension of order</header>
 <clause id="id9E7C320A12CB4580A209677F8662F3A2"><enum>(i)</enum><header>Notice to petitioner</header><text>Not later than 30 days before the date on which an extreme risk protection order is set to expire, the court shall provide notice to the petitioner of such expiration date.</text>
 </clause><clause id="idACDA0BA30C494BA9A2B7A92DB4A1BEBC"><enum>(ii)</enum><header>Request for extension</header><text>During the 30-day period described in clause (i), a petitioner may submit a request to extend the extreme risk protection order.</text>
 </clause><clause id="idBB7CEC5C95FF4A87B5A0A11B3B9CB39B"><enum>(iii)</enum><header>Hearing</header><text>Upon receipt of a request for an extension under clause (ii), the court shall schedule, provide notice for, and conduct a hearing in accordance with the requirements described in paragraph (2)(A).</text>
 </clause><clause id="id42A20D957432478283BBAFD79B3A9A94"><enum>(iv)</enum><header>Determination</header><text>If a court finds that there is clear and convincing evidence that the respondent poses a significant danger of causing personal injury to himself or herself or others by having in his or her custody or control, or by purchasing, possessing, or receiving, a firearm or ammunition, the court shall extend the extreme risk protection order for a period the court determines is appropriate, which may not exceed 12 months.</text>
 </clause></subparagraph></paragraph><paragraph id="idFFB7CFC52B7E4436A6D0689D64B0254E"><enum>(5)</enum><header>Authority to submit petition</header><text>For purposes of this subsection, a qualifying State or Tribal law shall be considered to have met the minimum requirement described in paragraph (1)(A) if, under the qualifying State or Tribal law, only a law enforcement officer is authorized to submit a petition for an extreme risk protection order.</text>
 </paragraph></subsection><subsection id="id832DB0332FB9472A9FF304427FC517C4"><enum>(c)</enum><header>Minimum requirements for surrender of firearms and ammunition</header><text>A qualifying State or tribal law shall have in effect the following minimum requirements for the surrender of firearms and ammunition:</text>
 <paragraph id="id03E9E3A1232C41B6B483E83C4F915035"><enum>(1)</enum><header>Surrender of firearms and ammunition</header><text>Upon issuance of a temporary ex parte extreme risk protection order or extreme risk protection order under subsection (b), a respondent shall surrender all firearms and ammunition in the custody or control of the respondent to the appropriate local law enforcement agency, as determined by the State or Indian tribe.</text>
 </paragraph><paragraph id="id301890a354984bffa5a032bafc284ab6"><enum>(2)</enum><header>Receipt for surrendered firearms and ammunition</header><text>The local law enforcement agency that takes custody of any firearms or ammunition surrendered under paragraph (1) shall—</text>
 <subparagraph id="idD6B8C4254CA24BFCA238C7E554934B1C"><enum>(A)</enum><text>issue to the respondent a receipt identifying all firearms and ammunition that have been surrendered; and</text>
 </subparagraph><subparagraph id="id53DB91B0B3004F458BE9B1E229F65348"><enum>(B)</enum><text>not later than 72 hours after taking custody of the firearms and ammunition, file a copy of such receipt with the court.</text>
 </subparagraph></paragraph><paragraph id="id2E643A86B5554108BA4281CEA162880D"><enum>(3)</enum><header>Issuance of warrant</header><text>If a court receives sworn testimony from an individual alleging that not all firearms required to be surrendered by a respondent under a temporary ex parte extreme risk protection order or extreme risk protection order have been surrendered, the court shall issue a warrant for the seizure of the remaining firearms or ammunition if the court determines that probable cause exists to believe the respondent has failed to surrender any firearms or ammunition.</text>
 </paragraph></subsection><subsection id="id08494C54B6BB470EA793F11489A7359F"><enum>(d)</enum><header>Other requirements</header><text display-inline="yes-display-inline">A qualifying State or tribal law shall—</text> <paragraph id="idd244b782f41d407180bee03d5d62b083"><enum>(1)</enum><text>make clear accommodations for the case in which an individual other than the respondent claims title to any firearms or ammunition required to be surrendered under a temporary ex parte extreme risk protection order or extreme risk protection order;</text>
 </paragraph><paragraph id="idb391eed5e1d54e5ba986ad72a0c54f9a"><enum>(2)</enum><text>have clear instruction about the immediate return of firearms to a respondent upon the expiration of a temporary ex parte extreme risk protection order or extreme risk protection order;</text>
 </paragraph><paragraph id="id7861c4e4a1614ec5ab5b969f50da004a"><enum>(3)</enum><text>provide clear instructions for the reporting of a temporary ex parte extreme risk protection order or extreme risk protection order to the appropriate Federal, State, and tribal databases;</text>
 </paragraph><paragraph id="id43ea0ff53a904a4ebd905f76d80e3b31"><enum>(4)</enum><text>establish a felony criminal offense for knowingly making a false statement under oath in a hearing relating to a temporary ex parte extreme risk protection order or extreme risk protection order regarding any material matter;</text>
 </paragraph><paragraph id="idec04d79c8eab4367a03e6adc207b4624"><enum>(5)</enum><text>establish a felony criminal offense for an individual to receive or possess a firearm or ammunition with knowledge that the individual is subject to a temporary ex parte extreme risk protection order or extreme risk protection order;</text>
 </paragraph><paragraph id="id9140273f320f47659ddd21a24bb09243"><enum>(6)</enum><text>a clear statement that use of the authority in the qualifying State or tribal law does not affect the ability of a law enforcement officer to use any other lawful authority to effect the surrender of a firearm, ammunition, or concealed carry permit; and</text>
 </paragraph><paragraph id="id593cbec0c23c44e4b47fbb8fbb7e6a2d"><enum>(7)</enum><text>clear direction for State or tribal courts to implement the procedures described in this section.</text> </paragraph></subsection><subsection id="idDF2065D18B374C0C9D28F19F877C605D"><enum>(e)</enum><header>Additional authority</header><text>A qualifying State or tribal law may provide for—</text>
 <paragraph id="id0d2af6c16fd54f26baef551dc7854081"><enum>(1)</enum><text>notice and hearing requirements in addition to the requirements described in this section;</text> </paragraph><paragraph id="id0b3f255491a84e0a8e6a19d53dbe96c8"><enum>(2)</enum><text>a timely background check under Federal and State law before a law enforcement agency returns any surrendered firearms and ammunition to a respondent after the expiration of a temporary ex parte extreme risk protection order or extreme risk protection order;</text>
 </paragraph><paragraph id="id847c197993f44f5bb4d10096a9f91578"><enum>(3)</enum><text>a requirement that family or household members of a respondent be notified before a law enforcement agency returns any surrendered firearms and ammunition to the respondent; and</text>
 </paragraph><paragraph id="id6e2442630a2f433ebf8f22a3ea3dfdca"><enum>(4)</enum><text>an option for a respondent to elect to transfer all firearms and ammunition owned by the respondent that have been ordered to be surrendered or seized to another individual who is willing to receive them, if such individual—</text>
 <subparagraph id="id36FCD9366E894A63A7D667B4CD7EE2B7"><enum>(A)</enum><text>is currently eligible to own or possess such firearms and ammunition under Federal and State law, and a background check is conducted;</text>
 </subparagraph><subparagraph id="id67BCFE9626A04F23A149EA33A5FE8FC2"><enum>(B)</enum><text>attests to storing the firearms or ammunition in a manner so that respondent does not have access; and</text>
 </subparagraph><subparagraph id="id5C6B91F56B2F4AC6A1586368620B8F6B"><enum>(C)</enum><text>attests to not transfer the firearms or ammunition back to respondent until after the date on which the order expires or is vacated.</text>
 </subparagraph></paragraph></subsection><subsection id="idBC1C3142DDFF4B488A71A8FE84C7E034"><enum>(f)</enum><header>Limitations</header><text>A qualifying State or tribal law may not—</text> <paragraph id="idf271d793df9e43e69afb65bdf9fbd2eb"><enum>(1)</enum><text>at any point require or allow for the surrender of any firearm or ammunition without the issuance of a court order;</text>
 </paragraph><paragraph id="idb34159a87e3748e09e9e0d8d3ac54201"><enum>(2)</enum><text>provide for the issuance of a temporary ex parte extreme risk protection order or extreme risk protection order without sworn affidavits or testimony;</text>
 </paragraph><paragraph id="id0cd48dc764204abf8a3aa0ea36455a73"><enum>(3)</enum><text>establish criminal penalties for false allegations or false testimony in connection with a temporary ex parte extreme risk protection order or extreme risk protection order that are less than a felony under State or tribal law;</text>
 </paragraph><paragraph id="iddf10484268034994a79d70eaae7e1cbc"><enum>(4)</enum><text>allow for witness testimony in connection with a temporary ex parte extreme risk protection order or extreme risk protection order that is not sworn or under oath;</text>
 </paragraph><paragraph id="iddd5cfd67032841f88c803226cceef323"><enum>(5)</enum><text>prohibit or otherwise discourage the respondent from consulting or retaining an attorney;</text> </paragraph><paragraph id="id6B2E9036455D4929AC1A9384D1F2DC37"><enum>(6)</enum><text>allow a law enforcement officer or other custodian of a firearm or any ammunition surrendered pursuant to a court order under the qualifying State or tribal law to destroy, disable, sell, assert ownership over, dispose of, use or otherwise employ, harm, or dispense with the firearm or ammunition; or</text>
 </paragraph><paragraph id="id06AC0FAF269049DD9CE050B16ACAE427"><enum>(7)</enum><text>allow for the ordering of a sequential series of ex parte extreme risk protection orders against a respondent based on the same evidence used to order the initial ex parte extreme risk protection order against the respondent.</text>
 </paragraph></subsection><subsection id="idA13EC30FF2AD46D0B92202E9824B37F0"><enum>(g)</enum><header>Rule of construction</header><text>Nothing in subsection (f)(1) shall be construed to limit or have an effect on any State or Federal law other than a qualifying State or tribal law.</text>
							</subsection></section><section id="HE26591423B2C478FA9DB796BF0EEECA0"><enum>3043.</enum><header>Violence Prevention Grant Program</header>
 <subsection id="H3708F4A55E9D4E768A1723BBB4B2B775"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Attorney General shall make grants to an eligible State or Indian tribe to assist the State or Indian tribe in carrying out the provisions of a qualifying State or tribal law.</text>
							</subsection><subsection id="H58560DE044CD4EA08AD172FBA0ECB06B"><enum>(b)</enum><header>Eligible State or Indian tribe</header>
 <paragraph id="idC2AB2403F0624CCAB6382B5D56BAF8C2"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a State or Indian tribe shall be eligible to receive grants under this section on and after the date on which—</text>
 <subparagraph id="HF9AEFB3502324881B9EEBF8E9DC298BC"><enum>(A)</enum><text>the State or Indian tribe enacts a qualifying State or tribal law; and</text> </subparagraph><subparagraph id="H98A7501D3F144F8DB3CEE009B276783F"><enum>(B)</enum><text>the Attorney General determines that the State or tribal law complies with the requirements of section 3042.</text>
									</subparagraph></paragraph><paragraph id="idCFE954818C384975B54FCB008572801F"><enum>(2)</enum><header>First year eligibility exception</header>
 <subparagraph id="idEF2B6BBA544E4B78A8874C82E971940E"><enum>(A)</enum><header>In general</header><text>A covered State or Indian tribe shall be eligible to receive a grant under this section during the 1-year period beginning on the date of enactment of this part.</text>
 </subparagraph><subparagraph id="idBA40AD5C7DB94A82BD644FEC739E277B"><enum>(B)</enum><header>Covered State or Indian tribe</header><text>In this paragraph, the term <term>covered State or Indian tribe</term> means a State or Indian tribe that, before the date of enactment of this part, enacted legislation that—</text>
 <clause id="idCBA8BFC6AA5446BB8626F97EDAD2637B"><enum>(i)</enum><text>authorizes the issuance of a gun violence restraining order or extreme risk protection order similar to a violence prevention order described in this part; and</text>
 </clause><clause id="idE3EF1775BE0A4A32B58C4CC4EECF291A"><enum>(ii)</enum><text>requires a standard of proof for the issuance of a gun violence restraining order or extreme risk protection order described in clause (i) that is substantially similar to the standard of proof required under this part.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="HF5CA97B095A740ECA1D245569FEE620F"><enum>(c)</enum><header>Use of funds</header><text>Funds awarded under this section may be used by a State or Indian tribe to assist law enforcement agencies or the courts of the State or Indian tribe in carrying out the provisions of the qualifying State or tribal law.</text>
 </subsection><subsection id="H0BC67DE95D6F49BFACBE2CAB373F0A1D"><enum>(d)</enum><header>Application</header><text>An eligible State or Indian tribe desiring a grant under this section shall submit to the Assistant Attorney General an application at such time, in such manner, and containing or accompanied by such information, as the Assistant Attorney General may reasonably require.</text>
 </subsection><subsection id="id95c70e9453254d7c95f17124a3c5e6f5"><enum>(e)</enum><header>Incentives</header><text>For each of fiscal years 2019 through 2023, the Attorney General shall give affirmative preference to all Bureau of Justice Assistance discretionary grant applications of a State or Indian tribe that has enacted a qualifying State or tribal law.</text>
 </subsection></section><section id="idCB29484676DA4BD9BDD27F333AF4D1FA"><enum>3044.</enum><header>Full faith and credit</header><text display-inline="no-display-inline">Any violence prevention order issued under a State or tribal law enacted in accordance with this part shall have the same full faith and credit in every court within the United States as they have by law or usage in the courts of such State or Indian tribe from which they are issued.</text></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idE8B12FCE4638496B9E8DD8745EA6F8AF"><enum>(b)</enum><header>Authorization of appropriations</header><text>Section 1001(a) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10261">34 U.S.C. 10261(a)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idBD3FC534585D489EB3C566CAD38260E7" style="OLC">
 <paragraph commented="no" display-inline="no-display-inline" id="idE01FAA6628F44901A3DC4B1F98F46D4A" indent="up1"><enum>(28)</enum><text>There are authorized to be appropriated to carry out part NN $20,000,000 for each of fiscal years 2019 through 2023.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section id="id2F88F9BF57E5442BAB79F9C0D4B9CD79"><enum>4.</enum><header>Federal firearms prohibition</header><text display-inline="no-display-inline">Section 922 of title 18, United States Code, is amended—</text> <paragraph id="H8C6AB1792D9D4C6DAE048424EDA5323E"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d)—</text>
 <subparagraph id="HBEE5015D25BA41808FB5ABDCF47BED1F"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (8)(B)(ii), by striking <quote>or</quote> at the end;</text> </subparagraph><subparagraph id="H9E748F0C532044589AB1DD064BBFEA01"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (9), by striking the period at the end and inserting <quote>; or</quote>; and</text>
 </subparagraph><subparagraph id="H59F0C0AFA5B34F96B5807EF81DDBA1E0"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after paragraph (9) the following:</text> <quoted-block display-inline="no-display-inline" id="HEAD4ADC53F6843959C79C3F4963D84FB" style="OLC"> <paragraph id="H0573D6D0F8A9421F9D1C9D5559871381"><enum>(10)</enum><text>is subject to a court order that—</text>
 <subparagraph id="id8C2E7C800514414B833A5F46659EF3E1"><enum>(A)</enum><text>was issued after a hearing of which such person received actual notice, and at which such person had an opportunity to participate;</text>
 </subparagraph><subparagraph id="id053E95094A4D4C85B4315299ED8D9DCA"><enum>(B)</enum><text>restrains such person from possessing and purchasing a firearm; and</text> </subparagraph><subparagraph id="id7713973297FA4C1BBA9F4025C7FE47C5"><enum>(C)</enum><text>includes a finding that such person poses a significant danger of causing personal injury to himself or herself or other persons.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H2C11ED15072F41FB80AAC71D42ACBEB9"><enum>(2)</enum><text>in subsection (g)—</text> <subparagraph id="H1A7E61EE7E0240D09CE4690CDBE36152"><enum>(A)</enum><text>in paragraph (8)(C)(ii), by striking <quote>or</quote> at the end;</text>
 </subparagraph><subparagraph id="H8124B715A80040C4BEB0EE791A80F865"><enum>(B)</enum><text>in paragraph (9), by striking the comma at the end and inserting <quote>; or</quote>; and</text> </subparagraph><subparagraph id="H3678459A845C48368C274761602E016A"><enum>(C)</enum><text>by inserting after paragraph (9) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H128DBAF91D154E869EEB6F0694A5FEC3" style="OLC">
 <paragraph id="H442754420A404CAC958D5F351092B91D"><enum>(10)</enum><text>who is subject to a court order that—</text> <subparagraph id="id126E906FF52D427F8D8A60C74E2AB504"><enum>(A)</enum><text>was issued after a hearing of which such person received actual notice, and at which such person had an opportunity to participate;</text>
 </subparagraph><subparagraph id="id7C4E77AF2A3E435AA699104BC77710AD"><enum>(B)</enum><text>restrains such person from possessing and purchasing a firearm; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE2EE487BB2DE4AADADDCF374112C6A24"><enum>(C)</enum><text>includes a finding that such person poses a significant danger of causing personal injury to himself or herself or other persons,</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="HF96D83566138401CB7CEC3C3AE2C6EAF"><enum>5.</enum><header>Severability; rules of construction</header>
 <subsection id="id40896092541C431EB382A5BDD67D5D8C"><enum>(a)</enum><header>Severability</header><text display-inline="yes-display-inline">If any provision of this Act, or an amendment made by this Act, or the application of such provision to any person or circumstance, is held to be invalid, the remainder of this Act, or an amendment made by this Act, or the application of such provision to other persons or circumstances, shall not be affected.</text>
 </subsection><subsection id="idfbd31ed0f7364d5a92e88f96796e9f73"><enum>(b)</enum><header>Rules of construction</header><text>Nothing in this Act, or an amendment made by this Act, shall be construed to—</text> <paragraph id="id458ADB3E976C4E38A1344F429EF5CE95"><enum>(1)</enum><text>limit the ability of a State or Indian tribe to enact legislation with additional due process protections, additional rights for a respondent or subject of an extreme risk protection order, or higher standards of proof; or</text>
 </paragraph><paragraph id="idF51F4AACA676423B8E96602BE307090D"><enum>(2)</enum><text>supersede or contradict any State or tribal law enacted before or after the date of enactment of this Act relating to the removal of firearms from individuals determined to be a danger to themselves or others.</text></paragraph></subsection></section></legis-body></bill>
