		<official-title>To protect the voting rights of Native American and Alaska Native voters.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native American Voting Rights Act of 2019</short-title></quote>.</text>
		</section><section id="idd46a5b2fe96d477d93d1b9143fc0582e"><enum>2.</enum><header>Findings and purposes</header>
 <subsection id="id9bfc797838144c0ca739d900888169c0"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> <paragraph id="idefd1c60dc6dd428c8341761f9425065b"><enum>(1)</enum><text>The Constitution explicitly and implicitly grants Congress broad general powers to legislate on issues relating to Indian Tribes, powers consistently described as plenary and exclusive. These powers arise from the grant of authority in the Indian Commerce Clause and through legislative matters arising under the Treaty Clause.</text>
 </paragraph><paragraph id="id8174b20b5c6547f1bb795c4c6cf6e8f8"><enum>(2)</enum><text>The Federal Government is responsible for upholding the obligations that the Federal Government has agreed to through treaties, legislation, and executive orders, referred to as the Federal trust responsibility toward Indian Tribes and their members.</text>
 </paragraph><paragraph id="id07e4ebdc9f5040ccb18d832f46006919"><enum>(3)</enum><text>The Supreme Court has repeatedly relied on the nature of this <quote>government to government</quote> relationship between the United States and sovereign Indian Tribes for congressional authority to enact <quote>legislation that singles out Indians for particular and special treatment.</quote> Morton v. Mancari, 417 U.S. 535, 554–555 (1974).</text>
 </paragraph><paragraph id="idd3e70fa29f0342faaa47941122519dcd"><enum>(4)</enum><text>Legislation removing barriers to Native American voting is vital for the fulfillment of Congress’s <quote>unique obligation</quote> toward Indians, particularly ensuring that Native American voters are fully included as <quote>qualified members of the modern body politic.</quote> Board of County Comm’rs v. Seber, 318 U.S. 705, 715 (1943).</text> </paragraph><paragraph id="idd1da259668a248cb9c5cf3142d63cfc6"><enum>(5)</enum><text>Under the Elections Clause of article I, section 4 of the Constitution, Congress has additional power to regulate any election conducted at least in part to select Members of Congress. Taken together, the Indian Commerce Clause and the Election Clause give Congress broad authority to enact legislation to safeguard the voting rights of Native American voters.</text>
 </paragraph><paragraph id="idb0971b3d070b49e290fe2b792a1e2d3a"><enum>(6)</enum><text>Despite Congress’s decision to grant Native Americans Federal citizenship, and with it the protections of the Fifteenth Amendment, with passage of the Act of June 2, 1924 (<external-xref legal-doc="public-law" parsable-cite="pl/68/233">Public Law 68–233</external-xref>; 43 Stat. 253) (commonly known as the <quote>Indian Citizenship Act of 1924</quote>), States continued to deploy distinct methods for disenfranchising Indians by enacting statutes to exclude from voter rolls Indians living on reservations, requiring that Indians first terminate their relationship with their Indian Tribe, restricting the right to vote on account of a Tribal member’s <quote>guardianship</quote> status, and imposing literacy tests.</text>
 </paragraph><paragraph id="id97d9ca4584db4beba9573df1df391346"><enum>(7)</enum><text>Barriers to voter access for Native Americans persist today, and such barriers range from obstructing voter access, to vote dilution and intentional malapportionment of electoral districts.</text>
 </paragraph><paragraph id="ida4a79e8701344bf3908516b97b28df15"><enum>(8)</enum><text>The Native American Voting Rights Coalition’s recent 9 field hearings in Indian Country and 4-State survey of voter discrimination revealed a number of additional obstacles that Native Americans must overcome in some States, including—</text>
 <subparagraph id="id91780396d14d46879a9ffa6d4a130785"><enum>(A)</enum><text>a lack of accessible registration and polling sites, either due to conditions such as geography, lack of paved roads, the absence of reliable and affordable broadband connectivity, and restrictions on the time and place that people can register and vote, and the manner in which people can register and vote, including unequal opportunities for absentee, early, mail-in, and in-person voting;</text>
 </subparagraph><subparagraph id="id98ccb012fffa4398a7940dca28469b0f"><enum>(B)</enum><text>nontraditional addresses for residents on Indian reservations, which make voter registration, acquisition of mail-in ballots, and securing required identification difficult, if not impossible;</text>
 </subparagraph><subparagraph id="idb3c9da2f4b9843a99b32f08e7b01412f"><enum>(C)</enum><text>inadequate language assistance for Tribal members, including lack of outreach and publicity, the failure to provide complete, accurate, and uniform translations of all voting materials in the relevant Native language, and an insufficient number of trained bilingual poll workers; and</text>
 </subparagraph><subparagraph id="id4e193a38fc1d4500a6221094de2b6f94"><enum>(D)</enum><text>voter identification laws that discriminate against Native Americans.</text> </subparagraph></paragraph><paragraph id="id9609d437510c4a25b4bd7924179a0d81"><enum>(9)</enum><text>The Department of Justice and courts have also recognized that some jurisdictions have been unresponsive to reasonable requests from federally recognized Indian Tribes for more accessible voter registration sites and in-person voting locations.</text>
 </paragraph><paragraph id="id3f0f45dc88384cbd91342a77cf6c3e39"><enum>(10)</enum><text>According to the National Congress of American Indians, there is a wide gap between the voter registration and turnout rates of eligible American Indians and Alaska Natives, and the voter registration and turnout rates of non-Hispanic white and other racial and ethnic groups.</text>
 </paragraph><paragraph id="id38d0ad0e03d74acdbb975ea017bec133"><enum>(11)</enum><text>Despite these obstacles, the Native American vote continues to play a significant role in national, State, and local elections.</text>
 </paragraph><paragraph id="id016f5c90e708494d823fab98e2af629d"><enum>(12)</enum><text>In Alaska, New Mexico, Oklahoma, and South Dakota, Native Americans comprise approximately 10 percent or more of the voting population.</text>
 </paragraph><paragraph id="id59f82f05331d4a0897bd4a843eadc1e7"><enum>(13)</enum><text>The Native American vote also holds great potential, with over 1,000,000 voters who are eligible to vote, but are not registered to vote.</text>
 </paragraph></subsection><subsection id="id5001734b23ba4453b75cc47ea463c484"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text> <paragraph id="id6e182554429f47409020baed6f0ad9af"><enum>(1)</enum><text>to fulfill the Federal Government’s trust responsibility to protect and promote Native Americans’ exercise of their constitutionally guaranteed right to vote, including the right to register to vote and the ability to access all mechanisms for voting;</text>
 </paragraph><paragraph id="id46c8d61b57574e9183b078399eda1dc1"><enum>(2)</enum><text>to establish preclearance procedures for a specific subset of State actions that have been used to restrict access to the polls on Indian lands;</text>
 </paragraph><paragraph id="ida50d621fda0f4148a861bd2b63c7fd93"><enum>(3)</enum><text>to expand voter registration under the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20506">52 U.S.C. 20506</external-xref> et seq.) to cover all Federal facilities, at the request of the Indian Tribe;</text>
 </paragraph><paragraph id="id1c383e5ddc3e44da9af51ea75ffa5b8b"><enum>(4)</enum><text>to afford equal treatment to forms of identification unique to Indian Tribes and their members;</text> </paragraph><paragraph commented="no" id="ida0be2db3e72b46a58ef3548bcdc5909e"><enum>(5)</enum><text>to clarify the obligations of States and political subdivisions regarding the provision of translated voting materials for American Indians and Alaska Natives under section 203 of the Voting Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/52/10503">52 U.S.C. 10503</external-xref>);</text>
 </paragraph><paragraph commented="no" id="id4735e004b637410a90f7dd323b623ae5"><enum>(6)</enum><text>to provide Tribal leaders with a direct pathway to request Federal election observers, and to allow public access to the reports of those election observers; and</text>
 </paragraph><paragraph commented="no" id="id3391be4831c446829d468bb8e3ba140d"><enum>(7)</enum><text>to direct the Department of Justice to consult on an annual basis with Indian Tribes on issues related to voting.</text>
 </paragraph></subsection></section><section id="id2f9b057aaf6a4dea988a06581b894e67"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="idc271e45712fb477d9043f5a6094f63d5"><enum>(1)</enum><header>Indian</header><text>The term <term>Indian</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text>
 </paragraph><paragraph id="id9B0AEF09B72D4C95A42A24F6D55B6886"><enum>(2)</enum><header>Indian lands</header><text>The term <term>Indian lands</term> includes—</text> <subparagraph id="ida798da6cedd64691a9171d6d3261f7af"><enum>(A)</enum><text>any Indian country of an Indian Tribe, as defined under section 1151 of title 18, United States Code;</text>
 </subparagraph><subparagraph id="idd8821db7990a43ea98fc95fbf79cb394"><enum>(B)</enum><text>any land in Alaska owned, pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601</external-xref> et seq.), by an Indian Tribe that is a Native village (as defined in section 3 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>)) or by a Village Corporation that is associated with an Indian Tribe (as defined in section 3 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>));</text>
 </subparagraph><subparagraph id="id30ddbedc454b4c909988536d20b06f65"><enum>(C)</enum><text>any land on which the seat of the Tribal Government is located; and</text> </subparagraph><subparagraph id="id2471f30c008e4abd865d3c954af30bd0"><enum>(D)</enum><text>any land that is part or all of a Tribal designated statistical area associated with an Indian Tribe, or is part or all of an Alaska Native village statistical area associated with an Indian Tribe, as defined by the Census Bureau for the purposes of the most recent decennial census.</text>
 </subparagraph></paragraph><paragraph id="id29118a0a4a904c128837a777ac7c7eec"><enum>(3)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term> in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text>
 </paragraph><paragraph id="id1dcd47eecf354848b4c1025bee3cabf3"><enum>(4)</enum><header>Tribal Government</header><text>The term <term>Tribal Government</term> means the recognized governing body of an Indian Tribe.</text> </paragraph></section><section id="id4124816cec124796b85bca4b5e534757"><enum>4.</enum><header>Establishment of a Native American voting task force grant program</header> <subsection id="id75929252A0854BD1BD8FC9F876C20255"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Office for Civil Rights at the Office of Justice Programs of the Department of Justice (referred to in this section as the <quote>Office</quote>) shall establish and administer, in coordination with the Department of the Interior, a Native American voting task force grant program, through which the Office shall provide financial assistance to eligible applicants to enable those eligible applicants to establish and operate a Native American Voting Task Force in each State with a federally recognized Indian Tribe.</text>
 </subsection><subsection id="idabf44087a9cc4b1bb16c52a5dda7430a"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Native American voting task force grant program is to—</text>
 <paragraph id="id2e27cfa392f3453fa887a4a0d1db13f2"><enum>(1)</enum><text>increase voter outreach, education, registration, and turnout in Native American communities;</text> </paragraph><paragraph id="idf32dd41366fb40c29b0e3a3e7a25777e"><enum>(2)</enum><text>increase access to the ballot for Native American communities, including additional satellite, early voting, and absentee voting locations;</text>
 </paragraph><paragraph id="idc67d9bb7e7a64d5f9eb6cb0e6e487f12"><enum>(3)</enum><text>streamline and reduce inconsistencies in the voting process for Native Americans;</text> </paragraph><paragraph id="idf337f1afc7b140f89d4c64ec4b6432f3"><enum>(4)</enum><text>provide, in the community’s dominant language, educational materials and classes on Indian lands about candidacy filing;</text>
 </paragraph><paragraph id="idc8daddef655348948b6059086f96abd4"><enum>(5)</enum><text>train and educate State and local employees, including poll workers, about—</text> <subparagraph id="id574BA6AB4ABE438CA7D1EC4285A898E1"><enum>(A)</enum><text>the language assistance and voter assistance requirements under sections 203 and 208 of the Voting Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/52/10503">52 U.S.C. 10503</external-xref>; 10508); and</text>
 </subparagraph><subparagraph id="id1567B559B790419684441EFE92DB324C"><enum>(B)</enum><text>voter identification laws under section 8 of this Act;</text>
 </subparagraph></paragraph><paragraph id="id65088df3e45e40d890ac29c0170b70a4"><enum>(6)</enum><text>identify model programs and best practices for providing language assistance to Native American communities;</text>
 </paragraph><paragraph id="id7f50d5c2d73f4220b8ce72582c41c546"><enum>(7)</enum><text>provide non-partisan poll watchers on election day in Native American communities;</text> </paragraph><paragraph id="id4118daca263e46da8f456d089eae0baf"><enum>(8)</enum><text>participate in and evaluate future redistricting efforts;</text>
 </paragraph><paragraph id="idf6377b826f084480a37f040b46d60731"><enum>(9)</enum><text>address issues of internet connectivity as it relates to voter registration and ballot access in Native American communities; and</text>
 </paragraph><paragraph id="id4dc99403d16b4c1a9ab735c1fb3c1b2b"><enum>(10)</enum><text>facilitate collaboration between local election officials, Native American communities, and Tribal elections offices.</text>
 </paragraph></subsection><subsection id="idf7d6dab0f20544729d9ff3c68f679550"><enum>(c)</enum><header>Eligible applicant</header><text>The term <term>eligible applicant</term> means—</text> <paragraph id="id946b64a531b94650b7168dcd90b0d98e"><enum>(1)</enum><text>an Indian Tribe;</text>
 </paragraph><paragraph id="idf0b37748c5734445942afa8f0a85c88b"><enum>(2)</enum><text>a Secretary of State of a State, or another official of a State entity responsible for overseeing elections;</text>
 </paragraph><paragraph id="id9ab0970b62674182906e11a0168c4144"><enum>(3)</enum><text>a nonprofit organization that works, in whole or in part, on voting issues; or</text> </paragraph><paragraph id="id4BEFA54D48F1426F9DC0AF0B708279BB"><enum>(4)</enum><text>a consortium of one or more of the entities described in paragraphs (1) through (3).</text>
				</paragraph></subsection><subsection id="id537cf3d583014efeb2d78a1f547d0c27"><enum>(d)</enum><header>Application and selection process</header>
 <paragraph id="idF1334528DC0348F58452FE8ECBBED2EF"><enum>(1)</enum><header>In General</header><text>The Office, in coordination with the Department of the Interior and following consultation with Indian Tribes about the implementation of the Native American voting task force grant program, shall establish guidelines for the process by which eligible applicants will submit applications.</text>
 </paragraph><paragraph id="id342608FBA7354F12B51A382D1D66FBF5"><enum>(2)</enum><header>Applications</header><text>Each eligible applicant desiring a grant under this section shall submit an application, according to the process established under paragraph (1), and at such time, in such manner, and containing such information as the Attorney General may require. Such application shall include—</text>
 <subparagraph id="id1ce67b85fef144ab8dd9e8e799164dcf"><enum>(A)</enum><text>a certification that the applicant is an eligible applicant;</text> </subparagraph><subparagraph id="idd772d3ae8fcb4e6898e6279a47329710"><enum>(B)</enum><text>a proposed work plan addressing how the eligible applicant will establish and administer a Native American Voting Task Force that achieves the purposes described in subsection (b);</text>
 </subparagraph><subparagraph id="id619df850ac0e47e7b802642b70b4c6e4"><enum>(C)</enum><text>if the eligible applicant is a consortium as described in subsection (c)(4), a description of the proposed division of responsibilities between the participating entities; and</text>
 </subparagraph><subparagraph id="id581D9F86A5A54FC296CD5DFB691C7888"><enum>(D)</enum><text>an explanation of the time period that the proposed Native American Voting Task Force will cover, which shall be a time period that is not more than 3 years.</text>
 </subparagraph></paragraph></subsection><subsection id="id80b1d06696b149f08b87ae59f57c06ad"><enum>(e)</enum><header>Uses of funds</header><text>A grantee receiving funds under this section shall use such funds to carry out one or more of the activities described in subsection (b), through the grantee's Native American Voting Task Force.</text>
 </subsection><subsection id="idA9B37325017147B0BF0C2953538E932C"><enum>(f)</enum><header>Relationship with other laws</header><text>Nothing in this section reduces State or local obligations provided for by the Voting Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/52/10301">52 U.S.C. 10301</external-xref> et seq.), the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20501">52 U.S.C. 20501</external-xref> et seq.), the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/20901">52 U.S.C. 20901</external-xref> et seq.), or any other Federal law or regulation related to voting or the electoral process.</text>
 </subsection><subsection id="id58971005240c4952b7eeccde41e2a592"><enum>(g)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2020 through 2034.</text>
			</subsection></section><section id="idfa583c75a63d450f9777d7c10a1f82af"><enum>5.</enum><header>Tribal designated voter registration sites</header>
 <text display-inline="no-display-inline">Section 7(a) of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20506">52 U.S.C. 20506(a)</external-xref>) is amended—</text> <paragraph id="id2430EA302C214A06A702A40D9A805FB2"><enum>(1)</enum><text>in paragraph (2)—</text>
 <subparagraph id="id297C8A32A8E64B95B8F268DA8A4C97C1"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>and</quote> after the semicolon;</text> </subparagraph><subparagraph id="idFB647D0CDBA44B3097BBF7EF2B76A09B"><enum>(B)</enum><text>in subparagraph (B), by striking the period at the end and inserting a semicolon; and</text>
 </subparagraph><subparagraph id="idA33A986A6980452D9A35E45F83521625"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id92293f6ef7634792ba40b2c347d4e1df" style="OLC"> <subparagraph id="id0487381ddfdf4f5b87a2b237d73c4ae9"><enum>(C)</enum><text>at the request of an Indian Tribe, any Federal facility or federally funded facility that is primarily engaged in providing services to Indian Tribes and that provides such services to the requesting Indian Tribe; and</text>
 </subparagraph><subparagraph id="id98dc0be010be4e7380f00fa5154eb149"><enum>(D)</enum><text>at the request of an Indian Tribe, not less than one Federal facility or federally funded facility that is located on the Indian lands of the requesting Indian Tribe (which may be the Federal facility or federally funded facility described in subparagraph (C)).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="idD866B5E8CC414C6AB3BEBE542068E374"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id003bac39b4524be090f8fc46afa5a0e4" style="OLC"> <paragraph id="idaaa4733e7beb4fcaa7b87d363ef7c20b"><enum>(8)</enum><text>Where practicable, each Federal agency that operates a Federal facility or a federally funded facility that is subject to the provisions of paragraph (2)(C) or (D), shall designate one or more special days at a centralized location within the boundaries of the Indian lands of each applicable Indian Tribe for the purpose of informing members of the Indian Tribe of the timing, registration requirements, and voting procedures in elections for Federal office, at no cost to the Indian Tribe.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id58369be354d24cdb8dd47cb3e88fff12"><enum>6.</enum><header>Accessible Tribal designated polling sites</header>
			<subsection id="id307B5621D57F4E98BD56B043B35AC32E"><enum>(a)</enum><header>In General</header>
 <paragraph id="id67b89dc5d3d442438ff06c23a4b90690"><enum>(1)</enum><header>Designation of state officer</header><text>Each of the several States whose territory contains all or part of an Indian Tribe’s Indian lands shall designate for each Indian Tribe an officer within that State who will be responsible for compliance with the provisions of this section. The State shall provide written notice to each such Indian Tribe of the officer so designated.</text>
 </paragraph><paragraph id="id5e34498ae1c5400dbfbf50faa257883f"><enum>(2)</enum><header>Provision of polling places</header><text>For each Indian Tribe that satisfies the obligations of subsection (c), and for each election for a Federal official that is held 180 days or later after the date on which the Indian Tribe initially satisfies such obligations, any State or political subdivision whose territory contains all or part of an Indian Tribe’s Indian lands—</text>
 <subparagraph id="iddda4f603005f43f1a97997313c6458ec"><enum>(A)</enum><text>shall provide a minimum of one polling place for each precinct in which there are eligible voters who reside on Indian lands, in a location selected by the Indian Tribe and at no cost to the Indian Tribe;</text>
 </subparagraph><subparagraph commented="no" id="id1c20387af8704d1e80c8610afc5040d6"><enum>(B)</enum><text>shall provide, at no cost to the Indian Tribe, additional polling places in locations selected by an Indian Tribe if, based on the totality of circumstances described in subsection (b), it is shown that not providing those additional polling places would result in members of the Indian Tribe and individuals residing on the Indian Tribe’s Indian lands having less opportunity to vote than eligible voters in that State or political subdivision who are not members of an Indian Tribe and do not reside on Indian lands;</text>
 </subparagraph><subparagraph id="id413a5ce0f3cf42f882eeb45bcbb78e24"><enum>(C)</enum><text>shall, at each polling place located on Indian lands and at no cost to the Indian Tribe, make voting machines, tabulation machines, ballots, provisional ballots, and other voting materials available to the same extent that such equipment and materials are made available at other polling places in the State or political subdivision that are not located on Indian lands;</text>
 </subparagraph><subparagraph id="id4bf5b9211dc1425c80dfbeae6c7d92f8"><enum>(D)</enum><text>shall, at each polling place located on Indian lands, conduct the election using the same voting procedures that are used at other polling places in the State or political subdivision that are not located on Indian lands;</text>
 </subparagraph><subparagraph id="id6f9939ed6a6b4e17bc25191a0ff5b252"><enum>(E)</enum><text>shall, at each polling place located on Indian lands, provide training, compensation, and other benefits to election officials and poll workers at no cost to the Indian Tribe and to the same extent that such training, compensation, and benefits are provided to election officials and poll workers at other polling places in the State or political subdivision that are not located on Indian lands;</text>
 </subparagraph><subparagraph id="id9b1c36f417374b98a7a4d1d4dc8a883f"><enum>(F)</enum><text>shall cooperate in good faith with the efforts of the Indian Tribe to satisfy the requirements of subsection (c); and</text>
 </subparagraph><subparagraph id="id1e2cde8674cf4f9abaa41dc17aff6a4f"><enum>(G)</enum><text>may fulfill the State’s obligations under subparagraphs (A) and (B) by relocating existing polling places, by creating new polling places, or both.</text>
 </subparagraph></paragraph></subsection><subsection id="id33d8496d804140f7b0f9b3f2647ffe80"><enum>(b)</enum><header>Equitable opportunities To vote</header><text>When assessing the opportunities to vote provided to members of an Indian Tribe and to other eligible voters in the State residing on Indian lands in order to determine the number of additional polling places (if any) that a State or political subdivision must provide in accordance with subsection (a)(2)(B), the State, political subdivision, and any court applying this section, shall consider the totality of circumstances of—</text>
 <paragraph id="id1e41714d50b74b30a4a3183d835e8910"><enum>(1)</enum><text>the number of voting-age citizens assigned to each polling place;</text> </paragraph><paragraph id="id29a7206ad0ab44118c03f75715e86d6b"><enum>(2)</enum><text>the distances that voters must travel to reach the polling places;</text>
 </paragraph><paragraph id="idb2830d0dcbaa4ca5941c193c65e8f0af"><enum>(3)</enum><text>the time that voters must spend traveling to reach the polling places, including under inclement weather conditions;</text>
 </paragraph><paragraph id="id95ca2e901c8f467d9085ae140c736c93"><enum>(4)</enum><text>the modes of transportation, if any, that are available to voters to use to reach the polling places;</text>
 </paragraph><paragraph id="id9300a03f686547ab913916f271fed301"><enum>(5)</enum><text>the existence of and access to public transportation to the polling places; and</text> </paragraph><paragraph id="idaf17c64e591240b282deea8b0731bc8c"><enum>(6)</enum><text>any other factor relevant to effectuating the purposes of this Act.</text>
				</paragraph></subsection><subsection id="id2f0e52ce8df54fc69e050dd268d786d6"><enum>(c)</enum><header>Obligations of the Indian Tribe</header>
 <paragraph id="id72c7e11c26334cb684a20d9b12cca2b8"><enum>(1)</enum><header>In General</header><text>The State and political subdivision obligations under subsection (a)(2) shall apply with respect to an Indian Tribe only if that Indian Tribe files a standing request with the officer designated under subsection (a)(1) for a polling place or polling places for future elections, pursuant to subsection (a)(2)(A), or subsection (a)(2)(B) (if applicable), which—</text>
 <subparagraph id="ide1a2ff77faf64111855b276689fc4bca"><enum>(A)</enum><text>specifies the number and locations of such polling places that the Indian Tribe is requesting;</text> </subparagraph><subparagraph id="id7e71fd4c57994c1ca19e83c6f19c1540"><enum>(B)</enum><text>certifies that the Indian Tribe has arranged access to the facilities in which such polling places will be located, and that such access is in accordance with Federal and State law;</text>
 </subparagraph><subparagraph id="id5f82922cdb8748028ef7240df3df35de"><enum>(C)</enum><text>certifies that the Indian Tribe will ensure that each such polling place will be open and available to all eligible voters who reside in the precinct or other geographic area assigned to such polling place, regardless of whether such eligible voters are members of the Indian Tribe or of any other Indian Tribe; and</text>
 </subparagraph><subparagraph id="id8fdec61e0f184b2a864ff02eb450797b"><enum>(D)</enum><text>requests that the State shall designate election officials and poll workers to staff such polling places, or certifies that the Indian Tribe will designate election officials and poll workers to staff such polling places on every day that the polling places will be open.</text>
 </subparagraph></paragraph><paragraph id="id73802d914abb405aa1ba269f69f21ff1"><enum>(2)</enum><header>Opt out</header><text>At any time that is 60 days or more before the date of an election, an Indian Tribe that previously has satisfied the obligations of paragraph (1) may notify the State that the Indian Tribe intends to opt out of the standing request for one or more polling places that were requested in accordance with subsection (a)(2)(A) or subsection (a)(2)(B) for a particular election or for all future elections.</text>
 </paragraph></subsection><subsection id="id5f38752930344440a1606ca09d66e1ca"><enum>(d)</enum><header>Federal polling sites</header><text>At an Indian Tribe’s request, each State shall designate as voter polling facilities any of the facilities identified in accordance with section 7(a)(2)(C) or (D) of the of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20506">52 U.S.C. 20506(a)(2)</external-xref>), at no cost to the Indian Tribe, provided that the facility meets the requirements of Federal and State law as applied to other polling places within the State or political subdivision. The applicable agency of the Federal Government shall ensure that such designated facilities are made available as polling places.</text>
 </subsection><subsection id="id0feac1faa69f4e529478a6aaceaac4ff"><enum>(e)</enum><header>Mail-In balloting</header><text>In States or political subdivisions that permit absentee or mail-in balloting, the following shall apply with respect to an election for Federal office:</text>
 <paragraph id="id0a73a4de298b42dda206a3c8ce332ae5"><enum>(1)</enum><text>All postage shall be prepaid by the Federal Government and each ballot postmarked the day the ballot is received at a postal facility located on Indian lands.</text>
 </paragraph><paragraph id="idf2748f7366f94598ac57b69d9f3391d6"><enum>(2)</enum><text>An Indian Tribe may designate a Tribal Government building as a ballot pickup and collection location at no cost to the Indian Tribe. The applicable State or political subdivision shall collect ballots from that location.</text>
 </paragraph><paragraph id="idA693317F22EB4A8EA41315557C75A3B0"><enum>(3)</enum><text>The State or political subdivision shall provide mail-in and absentee ballots to each registered voter residing on Indian lands in the State or political subdivision without requiring a residential address, a mail-in or absentee ballot request, or an excuse for a mail-in or absentee ballot.</text>
 </paragraph><paragraph commented="no" id="id8f8589f4a22d465db3b5e10c53fb7fd5"><enum>(4)</enum><text>The address of a designated Tribal Government building that is a ballot pickup and collection location under paragraph (2) may serve as the address and mailing address for voters living on Indian lands if the designated Tribal Government building is in the same precinct as that voter. If such designated Tribal Government building is not in the same precinct as the voter, the voter may use the designated Tribal Government building as a mailing address and may separately designate the voter's appropriate precinct through a description of the voter's address, as specified in section 9428.4(a)(2) of title 11, Code of Federal Regulations.</text>
 </paragraph><paragraph commented="no" id="id577b418e4b2e4ff2940de4bf6c1bc36b"><enum>(5)</enum><text>In the case of a State or political subdivision that is a covered State or political subdivision under section 203 of the Voting Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/52/10503">52 U.S.C. 10503</external-xref>), that State or political subdivision shall provide absentee or mail-in voting materials in the language of the applicable minority group as well as in the English language, bilingual election voting assistance, and written translations of all voting materials in the language of the applicable minority group, as required by section 203 of the Voting Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/52/10503">52 U.S.C. 10503</external-xref>), as amended by this Act.</text>
 </paragraph></subsection><subsection id="id695235cda0994b7d8d848b37d9d242a4"><enum>(f)</enum><header>Early voting</header><text>In a State or political subdivision that provides for early voting, that State or political subdivision shall provide not less than one early voting location on Indian lands, upon the request of the applicable Indian Tribe and at a site selected by the applicable Indian Tribe.</text>
			</subsection><subsection id="id0d48eeb97819496a969cdf59d0cc7a07"><enum>(g)</enum><header>Enforcement</header>
 <paragraph id="iddf1eae4492a242bc8b2e9ad99d3bb979"><enum>(1)</enum><header>Attorney general</header><text>The Attorney General may bring a civil action in an appropriate district court for such declaratory or injunctive relief as is necessary to carry out this section.</text>
				</paragraph><paragraph commented="no" id="idf134cbe5fb9445e1ab7e1998e71af91f"><enum>(2)</enum><header>Private right of action</header>
 <subparagraph commented="no" id="id47dcf698e1cb4bfc9aff3ea79844ea80"><enum>(A)</enum><text>A person or Tribal Government who is aggrieved by a violation of this section may provide written notice of the violation to the chief election official of the State involved.</text>
 </subparagraph><subparagraph commented="no" id="id8f88d588ae5f48e889143c85ffd1546e"><enum>(B)</enum><text>An aggrieved person or Tribal Government may bring a civil action in an appropriate district court for declaratory or injunctive relief with respect to a violation of this section, if—</text>
 <clause commented="no" id="id00383E3663304ACCB73BC224C703D8B0"><enum>(i)</enum><text>that person or Tribal Government provides the notice described in subparagraph (A); and</text> </clause><clause commented="no" id="id9BD7BC3C999F4F31A9B0287B415E048E"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idDF58C0922417400A9F05DE3F285B550A"><enum>(I)</enum><text>in the case of a violation that occurs more than 120 days before the date of an election for Federal office, the violation remains and 90 days or more have passed since the date on which the chief election official of the State receives the notice under subparagraph (A); or</text>
 </subclause><subclause commented="no" id="id1E5E4BB23A2D460A9AD7EC885EC7EA7D" indent="up1"><enum>(II)</enum><text>in the case of a violation that occurs 120 days or less before the date of an election for Federal office, the violation remains and 20 days or more have passed since the date on which the chief election official of the State receives the notice under subparagraph (A).</text>
 </subclause></clause></subparagraph><subparagraph commented="no" id="id4d1a6054a2b2476989ef9b2df7be3e65"><enum>(C)</enum><text>In the case of a violation of this section that occurs 30 days or less before the date of an election for Federal office, an aggrieved person or Tribal Government may bring a civil action in an appropriate district court for declaratory or injunctive relief with respect to the violation without providing notice to the chief election official of the State under subparagraph (A).</text>
 </subparagraph></paragraph><paragraph commented="no" id="id5f26164517bc4756a3fc74478990ec82"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to prevent a State or political subdivision from providing additional polling places on Indian lands if no request was made by an Indian Tribe under this section.</text>
				</paragraph></subsection></section><section id="id7829609c8a92454b81fd5d0f5466f937"><enum>7.</enum><header>Tribal preclearance</header>
 <subsection id="idaa48f7088fa9474c898cec6b371512f5"><enum>(a)</enum><header>Actions requiring preclearance</header><text>No State or political subdivision may carry out any of the following activities unless the requirements of subsection (b) have been met:</text>
 <paragraph id="id39bd1d56062d49a2b2e8a3f494dd694c"><enum>(1)</enum><text>Eliminating the only polling place or voter registration site on the Indian lands of an Indian Tribe.</text>
 </paragraph><paragraph id="id2c386f53eeaf4ed89f9882580a99b4ba"><enum>(2)</enum><text>Moving or consolidating a polling place or voter registration site on the Indian lands of an Indian Tribe to a location 1 mile or further from the existing location of the polling place or voter registration site.</text>
 </paragraph><paragraph id="id0923e098020e4fe9b4fe456b461da350"><enum>(3)</enum><text>Moving or consolidating a polling place on the Indian lands of an Indian Tribe to a location across a river, lake, mountain, or other natural boundary such that it makes travel difficult for a voter, regardless of distance.</text>
 </paragraph><paragraph id="id84252d46939246a796df59f3433da903"><enum>(4)</enum><text>Eliminating in-person voting on the Indian lands of an Indian Tribe by designating an Indian reservation as a permanent absentee voting location, unless—</text>
 <subparagraph id="id0c35619e4f504446a2e7aaeaa32944ba"><enum>(A)</enum><text>the entire State is or becomes a permanent absentee voting State; or</text> </subparagraph><subparagraph id="idb392a57a102d4b078658fac132935717"><enum>(B)</enum><text>the Indian Tribe requests such a designation.</text>
 </subparagraph></paragraph><paragraph id="id5d83a8f498284745bf2068606e8ca588"><enum>(5)</enum><text>Removing an early voting location or otherwise diminishing early voting opportunities on Indian lands.</text>
 </paragraph><paragraph id="id9f14f5ef23454c469544fd39b19d127a"><enum>(6)</enum><text>Decreasing the number of days or hours that an in-person or early voting location is open on the Indian lands of an Indian Tribe or changing the dates of in-person or early voting on the Indian lands of an Indian Tribe.</text>
				</paragraph></subsection><subsection id="id8e4f41ce96884e758f20048b04285d63"><enum>(b)</enum><header>Preclearance</header>
 <paragraph id="id73e0cb09f0084774b18ec461c76b1a03"><enum>(1)</enum><header>In general</header><text>The requirements of this subsection have been met if—</text> <subparagraph commented="no" id="id4131fbf191c44490bea0b15ace4c1a51"><enum>(A)</enum><text>the impacted Tribal Government submits to the Attorney General the Tribal Government's written consent to the proposed activity described in subsection (a);</text>
 </subparagraph><subparagraph commented="no" id="id4f7b35d1437442a1b3abc6e6baed29d6"><enum>(B)</enum><text>the State or political subdivision institutes an action in the United States District Court for the District of Columbia for a declaratory judgment, and a declaratory judgment is issued, establishing that the specified activity described in subsection (a) that the State or political subdivision desires to carry out neither has the purpose nor will have the effect of denying or abridging the right to vote on account of race or color, or membership in a language minority group; or</text>
 </subparagraph><subparagraph id="idbfb7ac9cd81945ffb9f7b0ac03a46dde"><enum>(C)</enum><text>the chief legal officer or other appropriate official of such State or political subdivision submits a request to carry out the specified activity described in subsection (a) to the Attorney General and the Attorney General has not interposed an objection within 60 days after such submission, or upon good cause shown, to facilitate an expedited approval within 60 days after such submission, the Attorney General has affirmatively indicated that such objection will not be made.</text>
 </subparagraph></paragraph><paragraph id="id0374a8ff229d450fb9c5216b781f26a9"><enum>(2)</enum><header>No limitation on future actions</header><text>Neither an affirmative indication by the Attorney General that no objection will be made, nor the Attorney General’s failure to object, nor a declaratory judgment entered under this section, nor a written consent issued under paragraph (1)(A) shall bar a subsequent action to enjoin enforcement of an activity described in subsection (a). In the event the Attorney General affirmatively indicates that no objection will be made within the 60-day period following receipt of a submission, the Attorney General may reserve the right to reexamine the submission if additional information comes to the Attorney General’s attention during the remainder of the 60-day period which would otherwise require objection in accordance with this section. Any action under this section shall be heard and determined by a court of 3 judges in accordance with the provisions of section 2284 of title 28 of the United States Code and any appeal shall lie to the Supreme Court.</text>
				</paragraph></subsection></section><section id="id53ac921ad06a41379e3940df64a5a1b2"><enum>8.</enum><header>Tribal voter identification</header>
 <subsection id="idB6552BB66553427C8D2D861A456CFBD4"><enum>(a)</enum><header>Tribal government identification</header><text display-inline="yes-display-inline">If a State or political subdivision requires an individual to present identification for the purposes of voting or registering to vote in an election for Federal office, an identification card issued by a federally recognized Tribal Government, the Bureau of Indian Affairs, the Indian Health Service, or any other Tribal or Federal agency issuing identification cards to Indian voters shall be treated as a valid form of identification for such purposes.</text>
 </subsection><subsection id="id1df4f57ad98244939dae7ce79c22b19d"><enum>(b)</enum><header>Validity of tribal identification card</header><text>An individual shall not be required to show that a Tribal identification card includes a residential address or an expiration date in order for such Tribal identification card to be considered valid for purposes of voting or registering to vote. The voter may instead separately designate the voter's appropriate voting precinct through a description of the voter's address that conforms with the regulations for national mail voter registration forms, as established under section 9428.4(a)(2) of title 11, Code of Federal Regulations.</text>
 </subsection><subsection id="ideab9b93815244f99bfd9dfc9c7e8b140"><enum>(c)</enum><header>Online registration</header><text>If a State or political subdivision requires an identification card for an individual to register to vote online or to vote online, that State or political subdivision shall consider an identification card as described in subsection (a) to be a valid form of identification for the purpose of registering to vote online or voting online.</text>
 </subsection></section><section id="idc43462d25ceb4269a33c2e971abf3e3a"><enum>9.</enum><header>Bilingual election requirements</header><text display-inline="no-display-inline">Section 203 of the Voting Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/52/10503">52 U.S.C. 10503</external-xref>) is amended—</text> <paragraph id="id5a843a4655ab4fa497f9bf74de8df2f9"><enum>(1)</enum><text>in subsection (b)(3)(C), by striking <quote>1990</quote> and inserting <quote>2010</quote>; and</text>
 </paragraph><paragraph commented="no" id="ida4e9ba5988de439588c5606493181f78"><enum>(2)</enum><text>by striking subsection (c) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id3335893f4a714a0ea041fce7f7f385f0" style="OLC"> <subsection commented="no" id="id8FBE8B12A2D1413F99AC5CE705C310F7"><enum>(c)</enum><header>Provision of voting materials in the language of a minority group</header> <paragraph commented="no" id="id9103b6d58073492cb45d19bf34e0ee6d"><enum>(1)</enum><header>In General</header><text>Whenever any State or political subdivision subject to the prohibition of subsection (b) of this section provides any registration or voting notices, forms, instructions, assistance, or other materials or information relating to the electoral process, including ballots, it shall provide them in the language of the applicable minority group as well as in the English language.</text>
						</paragraph><paragraph commented="no" id="idA7FFFB54482148E69FB73CC3DAFB1EB2"><enum>(2)</enum><header>Exceptions</header>
							<subparagraph commented="no" id="ideb7a7512c6b041d2b0e3c525b271f2cb"><enum>(A)</enum><header>In General</header>
 <clause commented="no" id="id6682D86EC72D4F6E90235DC51DA89F42"><enum>(i)</enum><text>In the case of a minority group that is not American Indian or Alaska Native and the language of that minority group is oral or unwritten, the State or political subdivision shall only be required to furnish, in the covered language, oral instructions, assistance, translation of voting materials, or other information relating to registration and voting.</text>
 </clause><clause commented="no" id="id1e050be040d2498db9115a72435cda89"><enum>(ii)</enum><text>In the case of a minority group that is American Indian or Alaska Native, the State or political subdivision shall only be required to furnish in the covered language oral instructions, assistance, or other information relating to registration and voting, including all voting materials, if the Tribal Government of that minority group has certified that the language of the applicable American Indian or Alaska Native language is presently unwritten or the Tribal Government does not want written translations in the minority language.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" id="id1eb0495612014a72a19cf48a1dbea44e"><enum>(3)</enum><header>Written translations for election workers</header><text>Notwithstanding paragraph (2), the State or political division may be required to provide written translations of voting materials, with the consent of any applicable Indian Tribe, to election workers to ensure that the translations from English to the language of a minority group are complete, accurate, and uniform.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" id="id3928305f08d04e40bac16ae1409d1cb3"><enum>10.</enum><header>Federal observers to protect Tribal voting rights</header>
 <subsection commented="no" id="idbdf1216e73ae4117967c434ea67ae657"><enum>(a)</enum><header>Amendment to the Voting Rights Act of 1965</header><text>Section 8(a) of the Voting Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/52/10305">52 U.S.C. 10305(a)</external-xref>) is amended—</text> <paragraph commented="no" id="id0caa119f11f541578666f7a5217cafb7"><enum>(1)</enum><text>in paragraph (1), by striking <quote>or</quote> after the semicolon;</text>
 </paragraph><paragraph commented="no" id="id8a91228faa404025a20b52f037adeeb9"><enum>(2)</enum><text>in paragraph (2)(B), by adding <quote>or</quote> after the semicolon; and</text> </paragraph><paragraph commented="no" id="idec5effa71628402daae42029fcbc61f3"><enum>(3)</enum><text>by inserting after paragraph (2) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idD5ACF67FFF264B4AA0C1BAA9A2DEC3CD" style="OLC">
 <paragraph commented="no" id="ida6277201c2cf47d8899b5d343b3a51c3"><enum>(3)</enum><text>the Attorney General has received a written complaint from an Indian Tribe that efforts to deny or abridge the right to vote under the color of law on account of race or color, or in contravention of the guarantees set forth in section 4(f)(2), are likely to occur;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" id="id4b999a0e03b943bca850f4b4a21561e4"><enum>(b)</enum><header>Publicly available reports</header><text>The Attorney General shall make publicly available the reports of a Federal election observer appointed pursuant to section (8)(a)(3) of the Voting Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/52/10305">52 U.S.C. 10305(a)(3)</external-xref>), as added by subsection (a), not later than 6 months after the date that such reports are submitted to the Attorney General, except that any personally identifiable information relating to a voter or the substance of the voter’s ballot shall not be made public.</text>
 </subsection></section><section id="id2a3d6b1b0a0040449e046feb9fa542d4"><enum>11.</enum><header>Tribal voting consultation</header><text display-inline="no-display-inline">The Attorney General shall consult annually with Indian Tribes regarding issues related to voting in elections for Federal office.</text>
 </section><section id="id91a869763b8745f89999e675faca3096"><enum>12.</enum><header>Attorneys’ fees, expert fees, litigation expenses</header><text display-inline="no-display-inline">In a civil action under this Act, the court shall award the prevailing party, other than the United States, reasonable attorney fees, including litigation expenses, reasonable expert fees, and costs.</text>
		</section><section id="id4d1e5065c1d244edbde6dcf8a047f58c"><enum>13.</enum><header>Severability; relationship to other laws</header>
 <subsection id="id7C00F012AE7B4239BA99AFD2E643C79D"><enum>(a)</enum><header>Severability</header><text display-inline="yes-display-inline">If any provision of this Act, or the application of such a provision to any person, entity, or circumstance, is held to be invalid, the remaining provisions of this Act and the application of all provisions of this Act to any other person, entity, or circumstance shall not be affected by the invalidity.</text>
 </subsection><subsection id="idD8B7D6AAC4BD4642ACDB0F146D9D2DEC"><enum>(b)</enum><header>Relationship to other laws</header><text>Nothing in this Act shall invalidate, or limit the rights, remedies, or procedures available under, or supersede, restrict, or limit the application of, the Voting Rights Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/52/10301">52 U.S.C. 10301</external-xref> et seq.), the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20501">52 U.S.C. 20501</external-xref> et seq.), the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/20901">52 U.S.C. 20901</external-xref> et seq.), or any other Federal law or regulation related to voting or the electoral process.</text>
