			 Elimination Provisions under the Social Security Act.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Social Security Fairness for Firefighters and Police Officers Act</short-title></quote>.</text>
 </section><section id="idDED054CC9B92409898F2B626B489A84F"><enum>2.</enum><header>Exception from Government Pension Offset provision for firefighters and police officers</header><text display-inline="no-display-inline">Clause (i) of section 202(k)(5)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(k)(5)(B)</external-xref>) is amended by striking <quote>monthly periodic benefits</quote> and all that follows through the period and inserting the following:</text>

 <text>monthly periodic benefits—</text><subclause id="id1D66874374F04DDA8A6814DB0813E161" indent="up4"><enum>(I)</enum><text display-inline="yes-display-inline">based wholly on service as a member of a uniformed service (as defined in section 210(m)), or</text> </subclause><subclause id="id861BEA41E0C64F49B49FBAF63BC59615" indent="up4"><enum>(II)</enum><text display-inline="yes-display-inline">with respect to which the period of service taken into account in determining the amount of the benefit includes at least 5 years of service of the individual as a firefighter (as defined in paragraph (4) of section 1204 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10284">34 U.S.C. 10284</external-xref>)) or a law enforcement officer (as defined in paragraph (6) of such section).</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="id8ECBDBBAA1054258B4686E9F2673E5F7"><enum>3.</enum><header>Exception from Windfall Elimination Provisions for firefighters and police officers</header><text display-inline="no-display-inline">Subsections (a)(7)(A) and (d)(3) of section 215 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C. 415</external-xref>) are amended by striking <quote>section 233, and (III)</quote> each place it appears and inserting <quote>section 233, (III) a payment based on service described in section 202(k)(5)(B)(i)(II), and (IV)</quote>.</text>
 </section><section id="idC87A246ADA4F47B3A050CFA92B585C3E"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to monthly insurance benefits payable under title II of the Social Security Act for months after December 2019. Notwithstanding section 215(f) of the Social Security Act, the Commissioner of Social Security shall adjust primary insurance amounts to the extent necessary to take into account the amendments made by section 3.</text></section></legis-body></bill>
