			 America’s students, to eliminate educational barriers for participation in
			 a public service career, and for other purposes. </official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening American Communities Act of 2019</short-title></quote>.</text>
 </section><section id="idC076966834024B85813381C0E91282FE"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">It is the purpose of this Act to provide greater access to higher education for America’s students, to eliminate educational barriers for participation in a public service career by providing an opportunity for potential public servants to obtain an undergraduate education, and to establish an accelerated form of the public service loan forgiveness program for more immediate loan forgiveness for existing public servants holding Federal Direct Stafford Loans, Federal Direct Unsubsidized Stafford Loans, and Federal Direct PLUS Loans.</text>
		</section><title id="id3CA7B006C5214B8581EBD1239061D515" style="OLC"><enum>I</enum><header>America's College Promise </header>
 <section id="id2771EDFEB85B4929993549A77CF17970"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>America’s College Promise Act of 2019</short-title></quote>.</text> </section><section id="H260823E3B26141A39107BF14814C4437"><enum>102.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this title is to help all individuals of the United States earn the education and skills the individuals need—</text>
 <paragraph id="HAC92CC51AD6E44ACBF58805E3EDBF9F4"><enum>(1)</enum><text>by making 2 years of community college free, through a new partnership with States and Indian Tribes to help the States and Indian Tribes—</text>
 <subparagraph id="H8858081700144FD5B8B283931E83B65C"><enum>(A)</enum><text>waive resident community college tuition and fees for eligible students;</text> </subparagraph><subparagraph id="HE03CE9F7E4EB4E7789C90EE7177B59C1"><enum>(B)</enum><text>maintain State and Indian Tribe support for higher education; and</text>
 </subparagraph><subparagraph id="HEE6621C2D36B431D88C075BFA45505D6"><enum>(C)</enum><text>promote key reforms to improve student outcomes; and</text> </subparagraph></paragraph><paragraph id="H3793CBC85B3C46499D815D579941E362"><enum>(2)</enum><text>through a new partnership with minority-serving institutions to—</text>
 <subparagraph id="HC91CF39C6B964517BCFED03C15900E60"><enum>(A)</enum><text>encourage eligible students to enroll and successfully complete a baccalaureate degree at participating institutions; and</text>
 </subparagraph><subparagraph id="HAA8E2A9D1D9748688E4382DD84EA28D3"><enum>(B)</enum><text>promote key reforms to improve student outcomes.</text> </subparagraph></paragraph></section><subtitle id="H7F980ED217F2419EB05CF69BDAE01442"><enum>A</enum><header>State and Indian Tribe Grants for Community Colleges</header> <section id="HA02ED39649AC4E34B17878CBB6AF5B3C"><enum>111.</enum><header>In general</header><text display-inline="no-display-inline">From amounts appropriated under section 117(a) for any fiscal year, the Secretary shall award grants to eligible States and Indian Tribes to pay the Federal share of expenditures needed to carry out the activities and services described in section 115.</text>
				</section><section id="HC25DA1F2C4CF4BDDBC2D6D4E2C4BE899"><enum>112.</enum><header>Federal share; non-Federal share</header>
					<subsection id="H5B6FAADD89B144CABFAFB2F0330C33B6"><enum>(a)</enum><header>Federal share</header>
 <paragraph id="HB94DAEED08A148E2A8EE352F770287B7"><enum>(1)</enum><header>Formula</header><text>Subject to paragraph (2), the Federal share of a grant under this subtitle shall be based on a formula, determined by the Secretary, that—</text>
 <subparagraph id="H1DD7CAC8DD724E2C940BF8C6A8A5BED9"><enum>(A)</enum><text>accounts for the State or Indian Tribe’s share of eligible students; and</text> </subparagraph><subparagraph id="HD4E9A6E776044EBBBFC4EE55E9D35066"><enum>(B)</enum><text>provides, for each eligible student in the State or Indian Tribe, a per-student amount that is—</text>
 <clause id="HE01542FC17234B838D5776902F082297"><enum>(i)</enum><text>not less than 300 percent of the per-student amount of the State or Indian Tribe share, determined under subsection (b), subject to clause (ii); and</text>
 </clause><clause id="H0490A05B3FB84BA898B950A44E166A73"><enum>(ii)</enum><text>not greater than 75 percent of—</text> <subclause id="HD0176861962B4B249AFA19E7C80B32D7"><enum>(I)</enum><text>for the 2018–2019 award year, the average resident community college tuition and fees per student in all States for the most recent year for which data are available; and</text>
 </subclause><subclause id="H652DB50BA48E4775992B91EEEC799846"><enum>(II)</enum><text>for each subsequent award year, the average resident community college tuition and fees per student in all States calculated under this subclause for the preceding year, increased by the lesser of—</text>
 <item id="H54148D8DF9704BBB8FB21281DD0E8396"><enum>(aa)</enum><text>the percentage by which the average resident community college tuition and fees per student in all States for the most recent year for which data are available increased as compared to such average for the preceding year; or</text>
 </item><item id="H1C08175CCF5E432F812D6C8837B8F816"><enum>(bb)</enum><text>3 percent.</text> </item></subclause></clause></subparagraph></paragraph><paragraph id="H97589E91B6FC470EA60A5FCB5AFB30E3"><enum>(2)</enum><header>Exception for certain indian tribes</header><text>In any case in which not less than 75 percent of the students at the community colleges operated or controlled by an Indian Tribe are low-income students, the amount of the Federal share for such Indian Tribe shall be not less than 95 percent of the total amount needed to waive tuition and fees for all eligible students enrolled in such community colleges.</text>
						</paragraph></subsection><subsection id="HF7259179016F4DACB1CBC5AD572AA6B8"><enum>(b)</enum><header>State or tribal share</header>
						<paragraph id="H78556F856D074F6C857532DA751C77A3"><enum>(1)</enum><header>Formula</header>
 <subparagraph id="H4D2388B434954BEFA9DE0C9828F2A942"><enum>(A)</enum><header>In general</header><text>The State or Tribal share of a grant under this subtitle for each fiscal year shall be the amount needed to pay 25 percent of the average community college resident tuition and fees per student in all States in the 2018–2019 award year for all eligible students in the State or Indian Tribe, respectively, for such fiscal year, except as provided in subparagraph (B).</text>
 </subparagraph><subparagraph id="HA629BF3BA469428CAFC69061755FBD65"><enum>(B)</enum><header>Exception for certain indian tribes</header><text>In a case in which not less than 5 percent of the students at the community colleges operated or controlled by an Indian Tribe are low-income students, the amount of such Indian Tribe’s tribal share shall not exceed 5 percent of the total amount needed to waive tuition and fees for all eligible students enrolled in such community colleges.</text>
 </subparagraph></paragraph><paragraph id="H1E99FED82EA94A2298BAFFDD11A9535F"><enum>(2)</enum><header>Need-based aid</header><text>A State or Indian Tribe may include any need-based financial aid provided through State or Tribal funds to eligible students as part of the State or Tribal share.</text>
 </paragraph><paragraph id="H260E282D68F744D89110367951F6E60B"><enum>(3)</enum><header>No in-kind contributions</header><text>A State or Indian Tribe shall not include in-kind contributions for purposes of the State or Tribal share described in paragraph (1).</text>
 </paragraph></subsection></section><section id="HF6F84064304E46F085121265D6B668E8"><enum>113.</enum><header>Eligibility</header><text display-inline="no-display-inline">To be eligible for a grant under this subtitle, a State or Indian Tribe shall agree to waive community college resident tuition and fees for all eligible students for each year of the grant.</text>
				</section><section id="H98B0C7DFAAB94FB28F700FE626439736"><enum>114.</enum><header>Applications</header>
 <subsection id="H6769FE10B300410E9D5BB2E4B0306248"><enum>(a)</enum><header>Submission</header><text>For each fiscal year for which a State or Indian Tribe desires a grant under this subtitle, an application shall be submitted to the Secretary at such time, in such manner, and containing such information as the Secretary may require. Such application shall be submitted by—</text>
 <paragraph id="HA6BA6AC32AC4422285BA8315E580C68F"><enum>(1)</enum><text>in the case of a State, the Governor, the State agency with jurisdiction over higher education, or another agency designated by the Governor to administer the program under this subtitle; or</text>
 </paragraph><paragraph id="HD13977AE9D1D40D281983F8CE6B6F031"><enum>(2)</enum><text>in the case of an Indian Tribe, the governing body of such Tribe.</text> </paragraph></subsection><subsection id="H3CA86EB382294C72B5639949DD9DF624"><enum>(b)</enum><header>Contents</header><text>Each State or Indian Tribe application shall include, at a minimum—</text>
 <paragraph id="H073A80C3CE4547D6924B8C7FB0249C93"><enum>(1)</enum><text>an estimate of the number of eligible students in the State or Indian Tribe and the cost of waiving community college resident tuition and fees for all eligible students for each fiscal year covered by the grant, with annual increases of an amount that shall not exceed 3 percent of the prior year’s average resident community college tuition and fees;</text>
 </paragraph><paragraph id="H910C579D6A7D4925A63EC2C15791ED85"><enum>(2)</enum><text>an assurance that all community colleges in the State or under the jurisdiction of the Indian Tribe, respectively, will waive resident tuition and fees for eligible students in programs that are—</text>
 <subparagraph id="HB55C2AAF41C54252A2883BBC0D86DF8D"><enum>(A)</enum><text>academic programs with credits that can fully transfer via articulation agreement toward a baccalaureate degree or post­bac­ca­laur­e­ate degree at any public institution of higher education in the State; or</text>
 </subparagraph><subparagraph id="H9EE543EB8D0C46BB945FC03ACC27C058"><enum>(B)</enum><text>occupational skills training programs that lead to a recognized postsecondary credential that is in an in-demand industry sector or occupation in the State;</text>
 </subparagraph></paragraph><paragraph id="HEE85FDE2B0E749A39BBAD2F7177C3420"><enum>(3)</enum><text>a description of the promising and evidence-based institutional reforms and innovative practices to improve student outcomes, including completion or transfer rates, that have been or will be adopted by the participating community colleges, such as—</text>
 <subparagraph id="H407EA9F38EE8424FAF950310B029ACCC"><enum>(A)</enum><text>providing comprehensive academic and student support services, including mentoring and advising, especially for low-income, first-generation, adult, and other underrepresented students;</text>
 </subparagraph><subparagraph id="HE1CF9D341EB343E698531F34526BA04B"><enum>(B)</enum><text>providing accelerated learning opportunities, such as dual or concurrent enrollment programs, including early college high school programs;</text>
 </subparagraph><subparagraph id="H6F647DFD1C7945A091327C448E5CDD77"><enum>(C)</enum><text>advancing competency-based education;</text> </subparagraph><subparagraph id="H4476EEBF10CE463EA9B3EE0A4AFAF99B"><enum>(D)</enum><text display-inline="yes-display-inline">strengthening remedial education, especially for low-income, first-generation, adult and other underrepresented students;</text>
 </subparagraph><subparagraph id="H65093A4EB4164B558E2EC7E2136A1660"><enum>(E)</enum><text>implementing course redesigns of high-enrollment courses to improve student outcomes and reduce cost; or</text>
 </subparagraph><subparagraph id="HE2731A03D40A49FA94AE47300C6B469F"><enum>(F)</enum><text>utilizing career pathways or degree pathways;</text> </subparagraph></paragraph><paragraph id="HA7E6E60618214B97BFEC5257BAD018F2"><enum>(4)</enum><text>a description of how the State or Indian Tribe will promote alignment between its public secondary school and postsecondary education systems, including between 2-year and 4-year public institutions of higher education and with minority-serving institutions described in section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>), to expand awareness of and access to postsecondary education, reduce the need for remediation and repeated coursework, and improve student outcomes;</text>
 </paragraph><paragraph id="H95901C11674F45CE9C334EBC8318025E"><enum>(5)</enum><text>a description of how the State or Indian Tribe will ensure that programs leading to a recognized postsecondary credential meet the quality criteria established by the State under section 123(a) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3153">29 U.S.C. 3153(a)</external-xref>) or other quality criteria determined appropriate by the State or Indian Tribe;</text>
 </paragraph><paragraph id="H06A05DC65AA24D35BE151D4263BE2030"><enum>(6)</enum><text>an assurance that all participating community colleges in the State or under the authority of the Indian Tribe have entered into program participation agreements under section 487 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094</external-xref>); and</text>
 </paragraph><paragraph id="H8EAFA09E2262438C8CEC22CD1A17E40C"><enum>(7)</enum><text>an assurance that, for each year of the grant, the State or Indian Tribe will notify each eligible student of the student’s remaining eligibility for assistance under this subtitle.</text>
						</paragraph></subsection></section><section id="H2E4C3293E5BB4C279068016CC800E076"><enum>115.</enum><header>Allowable uses of funds</header>
 <subsection id="H6DF385B54F164A288ECB6F532BBBB4C5"><enum>(a)</enum><header>In general</header><text>A State or Indian Tribe shall use a grant under this subtitle only to provide funds to participating community colleges to waive resident tuition and fees for eligible students who are enrolled in—</text>
 <paragraph id="HCAA52FFCA88441FAA2CA005BFD3264A5"><enum>(1)</enum><text>academic programs with credits that can fully transfer via articulation agreement toward a baccalaureate degree or postbaccalaureate degree at any public institution of higher education in the State; or</text>
 </paragraph><paragraph id="H866E0608518F484EBC35927229EBC98B"><enum>(2)</enum><text>occupational skills training programs that lead to a recognized postsecondary credential that is in an in-demand industry sector or occupation in the State.</text>
 </paragraph></subsection><subsection id="H9E0ACF7F3242485DB05125B3E03AEB8B"><enum>(b)</enum><header>Additional uses</header><text>If a State or Indian Tribe demonstrates to the Secretary that it has grant funds remaining after meeting the demand for activities described in subsection (a), the State or Indian Tribe may use those funds to carry out one or more of the following:</text>
 <paragraph id="H1341CEF87D6943F89BD1E1E25BD5D0CC"><enum>(1)</enum><text>Expanding the waiver of resident tuition and fees at community college to students who are returning students or otherwise not enrolling in postsecondary education for the first time, and who meet the student eligibility requirements of clauses (i) through (v) of section 116(5)(A).</text>
 </paragraph><paragraph id="H445BF7810AED49199CF9FB57EF2683B3"><enum>(2)</enum><text>Expanding the scope and capacity of high-quality academic and occupational skills training programs at community colleges.</text>
 </paragraph><paragraph id="HB791435D706A40A08AA12A5A57387CCC"><enum>(3)</enum><text>Improving postsecondary education readiness in the State or Indian Tribe, through outreach and early intervention.</text>
 </paragraph><paragraph id="H0F6E31C54FD44FC1A1F2B32C6F90C683"><enum>(4)</enum><text>Expanding access to dual or concurrent enrollment programs, including early college high school programs.</text>
 </paragraph><paragraph id="H2BF06D6F56E842679199895621C20114"><enum>(5)</enum><text>Improving affordability at 4-year public and private, nonprofit institutions of higher education.</text> </paragraph></subsection><subsection id="H1F7DDF14C04A43D79BBD2850445BCB5D"><enum>(c)</enum><header>Use of funds for administrative purposes</header><text>A State or Indian Tribe that receives a grant under this subtitle may not use any funds provided under this subtitle for administrative purposes relating to the grant under this subtitle.</text>
					</subsection><subsection id="id0c0536036db24448a4877422fffb3bbc"><enum>(d)</enum><header>Maintenance of effort required</header>
 <paragraph id="id716EB4551E5C48EE8191657D3B39489E"><enum>(1)</enum><header>In general</header><text>A State or Indian Tribe that receives a grant under this subtitle shall provide, with respect to a fiscal year—</text>
 <subparagraph id="id808e90307f094b2797cc56f37f669575"><enum>(A)</enum><text>for public and private, nonprofit institutions of higher education in such State or Indian tribe an amount that is equal to or greater than the amount provided for non-capital and non-direct research and development expenses or costs by such State or Indian tribe to such institutions of higher education during the preceding fiscal year for which satisfactory data are available; and</text>
 </subparagraph><subparagraph id="id96ef13ce021b4a578939ab17692882a3"><enum>(B)</enum><text>for student financial aid for paying costs associated with public and private, nonprofit postsecondary education in such State or Indian tribe an amount that is equal to or greater than the amount provided for student financial aid for paying costs associated with public and private, nonprofit postsecondary education by such State or Indian tribe in the preceding fiscal year for which satisfactory data are available.</text>
 </subparagraph></paragraph><paragraph commented="no" id="id7ed2e8b5065844199e206a26051dd5f1"><enum>(2)</enum><header>Adjustments for biennial appropriations</header><text>The Secretary shall take into consideration any adjustments to the calculations under paragraph (1) that may be required to accurately reflect funding levels in States or Indian tribes with biennial appropriation cycles.</text>
 </paragraph><paragraph commented="no" id="iddc9e8fce22a74d1ea4f3a251bb99a530"><enum>(3)</enum><header>Waiver</header><text>The Secretary shall waive the requirements of paragraph (1) if the Secretary determines that such a waiver would be equitable due to exceptional or uncontrollable circumstances, such as a natural disaster or a precipitous and unforeseen decline in the financial resources of a State or Indian tribe, as appropriate.</text>
 </paragraph><paragraph commented="no" id="id793a646f48cc42ccb9fedb5677bad496"><enum>(4)</enum><header>Violation of maintenance of effort</header><text>Notwithstanding any other provision of law, the Secretary shall withhold from any State or Indian tribe that violates paragraph (1) and does not receive a waiver pursuant to paragraph (3) any amount that would otherwise be available to the State or Indian tribe under this Act until such State or Indian tribe has made significant efforts to correct such violation.</text>
						</paragraph></subsection><subsection id="HC7FB258C121442459F0B6C2237BF3A4B"><enum>(e)</enum><header>Annual report</header>
 <paragraph id="H7612180C984A4C5080A1C0A9DA228959"><enum>(1)</enum><header>In general</header><text>A State or Indian Tribe receiving a grant under this subtitle shall submit an annual report to the Secretary describing the uses of grant funds under this subtitle, the progress made in fulfilling the requirements of the grant, and rates of graduation, transfer and attainment of recognized postsecondary credentials at participating community colleges, and including any other information as the Secretary may require.</text>
 </paragraph><paragraph commented="no" id="HDBCEF406B32140F3A6D13C3E8AC00CD6"><enum>(2)</enum><header>Inclusion in HEA annual report</header><text>At the discretion of the Secretary, the information required in the report under paragraph (1) may be included in an annual report on higher education required under the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref> et seq.).</text>
 </paragraph></subsection><subsection id="H384A861E39F44621BED5D54E721A0582"><enum>(f)</enum><header>Reporting by secretary</header><text>The Secretary annually shall—</text> <paragraph id="HC94CCCBAE3194FA59895C489FD58E373"><enum>(1)</enum><text>compile and analyze the information described in subsection (e); and</text>
 </paragraph><paragraph id="HBFDBFE8DC4424E9EB32BDC12EC4A4F4A"><enum>(2)</enum><text>prepare and submit a report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Labor of the House of Representatives containing the analysis described in paragraph (1) and an identification of State and Indian Tribe best practices for achieving the purpose of this subtitle.</text>
 </paragraph></subsection><subsection id="H744AF354926B49CFBA88C05DAEC8CD16"><enum>(g)</enum><header>Technical assistance</header><text>The Secretary shall provide technical assistance to eligible States and Indian Tribes concerning best practices regarding the promising and evidence-based institutional reforms and innovative practices to improve student outcomes as described in section 114(b)(3) and shall disseminate such best practices among the States and Indian Tribes.</text>
					</subsection><subsection id="HB1D43B4131F443F7B6CDBE998DC62055"><enum>(h)</enum><header>Continuation of funding</header>
 <paragraph id="HE060EAD581AB42688CF514131DE21BF2"><enum>(1)</enum><header>In general</header><text>A State or Indian Tribe receiving a grant under this subtitle for a fiscal year may continue to receive funding under this title for future fiscal years conditioned on the availability of budget authority and on meeting the requirements of the grant, as determined by the Secretary.</text>
 </paragraph><paragraph id="HE57CBDCD719C465B8C27613DD1C5FCA6"><enum>(2)</enum><header>Discontinuation</header><text>The Secretary may discontinue funding of the Federal share of a grant under this subtitle if the State or Indian Tribe has violated the terms of the grant or is not making adequate progress in implementing the reforms described in the application submitted under section 114.</text>
 </paragraph></subsection></section><section id="H08AF4244565B4D0BACE7B7065A0B75AF"><enum>116.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph id="H1B8B094928734DD3B5A85A483FD92C63"><enum>(1)</enum><header>Career pathway</header><text>The term <term>career pathway</term> has the meaning given the term in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text>
 </paragraph><paragraph id="H51415667E50A4AA0B09E595824E55816"><enum>(2)</enum><header>Community college</header><text>The term <term>community college</term> means a public institution of higher education at which the highest degree that is predominantly awarded to students is an associate’s degree, including 2-year tribally controlled colleges under section 316 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>) and public 2-year State institutions of higher education.</text>
 </paragraph><paragraph id="H999142B5BF634189A84267740FDE81DE"><enum>(3)</enum><header>Dual or concurrent enrollment program</header><text display-inline="yes-display-inline">The term <term>dual or concurrent enrollment program</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>
 </paragraph><paragraph id="H47D61B49992C48A4B127607C20007905"><enum>(4)</enum><header>Early College High School</header><text>The term <term>early college high school</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>

 <subparagraph id="H37669ACF55144EC2BB04748FD4D9FBA6"><enum>(A)</enum><header>Definition</header><text>The term <term>eligible student</term> means a student who—</text> <clause id="HC5C3CEF083864BB6ABBBC353D68B29F3"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H09C2216C72DA4388BDB9CFB73D7BAD56"><enum>(I)</enum><text>enrolls in a community college after the date of enactment of this Act; or</text>
 </subclause><subclause id="H0D7CDF31EB2B416D99A9C6DA39C63F5B" indent="up1"><enum>(II)</enum><text>is enrolled in a community college as of the date of enactment of this Act;</text> </subclause></clause><clause id="HEA8888CCD9AC4107962590C2C38A77C6"><enum>(ii)</enum><text>attends the community college on not less than a half-time basis;</text>
 </clause><clause id="HF88B719557BD4CBAA85B4B5A257D549D"><enum>(iii)</enum><text>is maintaining satisfactory progress, as defined in section 484(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1091">20 U.S.C. 1091(c)</external-xref>), in the student’s course of study;</text>
 </clause><clause id="HBC1E11DE8D164DB3ABFD1A7AFEF78887"><enum>(iv)</enum><text>qualifies for resident tuition, as determined by the State or Indian Tribe; and</text> </clause><clause id="H4338E59665F0406FBC14E657CD9A9A93"><enum>(v)</enum><text>is enrolled in an eligible program described in section 114(b)(2).</text>
 </clause></subparagraph><subparagraph id="H84C44E97DB8243D7817EE22F729161FD"><enum>(B)</enum><header>Special rule</header><text display-inline="yes-display-inline">An otherwise eligible student shall lose eligibility 3 calendar years after first receiving benefits under this subtitle.</text>
 </subparagraph></paragraph><paragraph id="HA8B23A79648142ED9C2AB7DE54AD8A02"><enum>(6)</enum><header>In-demand industry sector or occupation</header><text>The term <term>in-demand industry sector or occupation</term> has the meaning given the term in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text>

 <paragraph commented="no" id="HFA10CB85FFEE4342A783D94B805CAC9E"><enum>(1)</enum><text>$1,515,150,000 for fiscal year 2020;</text> </paragraph><paragraph commented="no" id="HA65BF0D15E2C451BB6F45DD45A446E05"><enum>(2)</enum><text>$3,352,200,000 for fiscal year 2021;</text>

 </paragraph></subsection><subsection id="H56A19F1C9B424D3A9B3DDD3D125A60FE"><enum>(b)</enum><header>Availability</header><text>Funds appropriated under subsection (a) shall remain available to the Secretary until expended.</text> </subsection><subsection id="H0C12BEE19E554E618DD6A475AB8F8DA4"><enum>(c)</enum><header>Insufficient funds</header><text>If the amount appropriated under subsection (a) for a fiscal year is not sufficient to award each participating State and Indian Tribe a grant under this subtitle that is equal to the minimum amount of the Federal share described in section 112(a), the Secretary may ratably reduce the amount of each such grant or take other actions necessary to ensure an equitable distribution of such amount.</text>
					</subsection></section></subtitle><subtitle id="H674D045FFA9644C99D8470359149C322"><enum>B</enum><header>Grants to Historically Black Colleges and Universities, Hispanic-Serv­ing Institutions, Asian
			 American and Native American Pacific Islander-Serving Institutions, Tribal
			 Colleges and Universities, Alaska Native-Serving Institutions, Native
			 Hawaiian-Serving Institutions, Pre­dominantly Black Institutions, and
			 Native American-Serving Nontribal Institutions</header>
				<section id="HD421DD7BE4B8406892940E0B9AFC84BB"><enum>121.</enum><header>Pathways to student success for historically Black colleges and universities</header>
 <subsection id="H5E0E72FE22544BFE81F82A8658BA2396"><enum>(a)</enum><header>In general</header><text>From amounts appropriated under section 124(a) for any fiscal year, the Secretary shall award grants to participating 4-year historically Black colleges or universities that meet the requirements of subsection (b) to—</text>
 <paragraph id="HC6FF71D609D04726AC383FA21EC86E81"><enum>(1)</enum><text>encourage students to enroll and successfully complete a bachelor’s degree at institutions eligible under subsection (b);</text>
 </paragraph><paragraph id="H7FD8208532EA4E5A909160342B65B617"><enum>(2)</enum><text>provide incentives to community college students to transfer to institutions eligible under subsection (b) through strong transfer pathways to complete a bachelor’s degree program; and</text>
 </paragraph><paragraph id="H6F34F91B81C241D890CE0BEA67FFA815"><enum>(3)</enum><text>support institutions eligible under subsection (b) to better serve new and existing students by engaging in reforms and innovations designed to improve completion rates and other student outcomes.</text>
 </paragraph></subsection><subsection id="HD1BF142D059A4DE9A520DA1F7EC56294"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to receive a grant under the program under this section, an institution shall be a historically Black college or university that—</text>
 <paragraph id="H1D539A7D3363465AB09B2227D76BEDBE"><enum>(1)</enum><text>has a student body of which not less than 35 percent are low-income students;</text> </paragraph><paragraph id="HBA9E444C4DB649F980AC3B3B171862EE"><enum>(2)</enum><text>commits to maintaining or adopting and implementing promising and evidence-based institutional reforms and innovative practices to improve the completion rates and other student outcomes, such as—</text>
 <subparagraph id="H5A2CC8BE861847ACA5A40E92C8BF71D7"><enum>(A)</enum><text>providing comprehensive academic and student support services, including mentoring and advising;</text> </subparagraph><subparagraph id="H33B70C397E8D430AB3B9CA12A821E37E"><enum>(B)</enum><text>providing accelerated learning opportunities and degree pathways, such as dual or concurrent enrollment programs and pathways to graduate and professional degree programs;</text>
 </subparagraph><subparagraph id="H562499105C3645F188093FE6DFE3DABE"><enum>(C)</enum><text>advancing distance and competency-based education;</text> </subparagraph><subparagraph id="H96AE68962F4E4B40B7C7AEF61CA0FE49"><enum>(D)</enum><text>partnering with employers, industry, nonprofit associations, and other groups to provide opportunities to advance learning outside the classroom, including work-based learning opportunities such as internships or apprenticeships or programs designed to improve inter-cultural development and personal growth, such as foreign exchange and study abroad programs;</text>
 </subparagraph><subparagraph id="H3169E4C0777146AABABCCF08FABD0024"><enum>(E)</enum><text>reforming remedial education, especially for low-income students, first generation college students, adult students, and other underrepresented students; or</text>
 </subparagraph><subparagraph id="H1DD39B98BE2F42D9882CE02A9EBEC0D5"><enum>(F)</enum><text>implementing course redesigns of high-enrollment courses to improve student outcomes and reduce cost;</text>
 </subparagraph></paragraph><paragraph id="H51B99BD33F2447F7A019986AFABBC70F"><enum>(3)</enum><text>sets performance goals for improving student outcomes for the duration of the grant; and</text> </paragraph><paragraph id="HE27E8E550D4F419BA89B2EEF4C5A895D"><enum>(4)</enum><text>if receiving a grant for transfer students, has articulation agreements with community colleges at the national, State, or local level to ensure that community college credits can fully transfer to the institution.</text>
						</paragraph></subsection><subsection id="H199245298BDA4292A7A5BEF5EBF57604"><enum>(c)</enum><header>Grant amount</header>
 <paragraph id="HA78E0D48D7C3446DAC6D3F4D5668CB6E"><enum>(1)</enum><header>Initial amount</header><text>For the first year that an eligible institution, as described in subsection (b), participates in the grant program under this section and subject to paragraph (3), such eligible institution shall receive a grant in an amount based on the product of—</text>
 <subparagraph id="H7C38E4E31B31449A96208B2B9C4B4EF4"><enum>(A)</enum><text>the actual cost of tuition and fees at the eligible institution in such year (referred to in this section as the per-student rebate); multiplied by</text>
 </subparagraph><subparagraph id="HFE90BA5C6AA04E4D9C7FBB400DAB86F0"><enum>(B)</enum><text>the number of eligible students enrolled in the eligible institution for the preceding year.</text> </subparagraph></paragraph><paragraph id="H800101B1923248ADB9B0F19A7367B2A0"><enum>(2)</enum><header>Subsequent increases</header><text>For each succeeding year after the first year of the grant program under this section, each eligible institution, as described in subsection (b), that participate in the grant program shall receive a grant in the amount determined under paragraph (1) for such year, except that in no case shall the amount of the per-student rebate for an eligible institution increase by more than 3 percent as compared to the amount of such rebate for the preceding year.</text>
						</paragraph><paragraph id="HE1B227E588AF4CAA9586EB58D75E661F"><enum>(3)</enum><header>Limitations</header>
 <subparagraph id="HDD4DFC614F284945A2ADF12E11F5E9F8"><enum>(A)</enum><header>Maximum per-student rebate</header><text>No eligible institution, as described in subsection (b), participating in the grant program under this section shall receive a per-student rebate amount for any year that is greater than the national average of annual tuition and fees at public 4-year institutions of higher education for such year, as determined by the Secretary.</text>
 </subparagraph><subparagraph id="HC1ED1C4C1A8649D885A4AFF821150DA1"><enum>(B)</enum><header>First year tuition and fees</header><text>During the first year of participation in the grant program under this section, no eligible institution, as described in subsection (b), may increase tuition and fees at a rate greater than any annual increase at the eligible institution in the previous 5 years.</text>
 </subparagraph></paragraph></subsection><subsection id="HBCD5F9822B9347B7933800BA45360C46"><enum>(d)</enum><header>Application</header><text>An eligible institution, as described in subsection (b), that desires a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text>
 </subsection><subsection id="H5150C65915424EDEA85107015F152C2A"><enum>(e)</enum><header>Use of funds</header><text>Funds awarded under this section to an eligible institution, as described in subsection (b), shall be used to waive or significantly reduce tuition and fees for eligible students in an amount of not more than up to the annual per-student rebate amount for each student, for not more than the first 60 credits an eligible student enrolls in the eligible institution.</text>
					</subsection></section><section id="H5050742594F249A6A5FBA66F8EC44BB2"><enum>122.</enum><header>Pathways to Student Success for Hispanic-Serving Institutions, Asian American and Native American
			 Pacific Islander-Serving Institutions, Tribal Colleges and Universities,
			 Alaska Native-Serving Institutions, Native Hawaiian-Serving Institutions,
			 Predominantly Black Institutions, and Native American-Serving Nontribal
			 Institutions</header>
 <subsection id="H8181B0864AAC4E65BDB3F74CDC22937D"><enum>(a)</enum><header>In general</header><text>From amounts appropriated under section 124(a) for any fiscal year, the Secretary shall award grants to eligible 4-year minority-serving institutions to—</text>
 <paragraph id="HD1CA97354622468DAFCF74DD97C587CD"><enum>(1)</enum><text>encourage students to enroll and successfully complete a bachelor’s degree at institutions eligible under subsection (b);</text>
 </paragraph><paragraph id="H0A2DC70E201C487A92438450F5AA9D17"><enum>(2)</enum><text>provide incentives to community college students to transfer to institutions eligible under subsection (b) through strong transfer pathways to complete a bachelor’s degree program; and</text>
 </paragraph><paragraph id="H8F63C9AE716246A68431F9DEC45B5C27"><enum>(3)</enum><text>support institutions eligible under subsection (b) to better serve new and existing students by engaging in reforms and innovations designed to improve completion rates and other student outcomes.</text>
 </paragraph></subsection><subsection id="H09408C21DEA449FDBCDBBCB2966B4107"><enum>(b)</enum><header>Institutional eligibility</header><text>To be eligible to participate and receive a grant under this section, an institution shall be a minority-serving institution with respect to which the majority of degrees awarded are baccalaureate degrees or higher that—</text>
 <paragraph id="HCB6B12DC1914422F98771C518B501645"><enum>(1)</enum><text>has a student body of which not less than 35 percent are low-income students;</text> </paragraph><paragraph id="HD379F09CF2B64F6D8F29276D49239C2E"><enum>(2)</enum><text>commits to maintaining or adopting and implementing promising and evidence-based institutional reforms and innovative practices to improve the completion rates and other student outcomes, such as—</text>
 <subparagraph id="H13B8A685E1254E609A59512B64C09E59"><enum>(A)</enum><text>providing comprehensive academic and student support services, including mentoring and advising;</text> </subparagraph><subparagraph id="H60D474BEA7644C60A31DDDFF2E6EE679"><enum>(B)</enum><text>providing accelerated learning opportunities and degree pathways, such as dual or concurrent enrollment programs and pathways to graduate and professional degree programs;</text>
 </subparagraph><subparagraph id="H67BEDBB7F93347CDBD910823C21762A6"><enum>(C)</enum><text>advancing distance and competency-based education;</text> </subparagraph><subparagraph id="HAE3EE3B57E384A16B3FE54AEB4080A75"><enum>(D)</enum><text>partnering with employers, industry, nonprofit associations, and other groups to provide opportunities to advance learning outside the classroom, including work-based learning opportunities such as internships or apprenticeships or programs designed to improve inter-cultural development and personal growth, such as foreign exchange and study abroad programs;</text>
 </subparagraph><subparagraph id="HB720D7D738AE40C39D8FC01C0B6D42DB"><enum>(E)</enum><text>reforming remedial education, especially for low-income students, first generation college students, adult students, and other underrepresented students; and</text>
 </subparagraph><subparagraph id="HC8CB96202FC448009839BBD56C00668E"><enum>(F)</enum><text>implementing course redesigns of high-enrollment courses to improve student outcomes and reduce cost;</text>
 </subparagraph></paragraph><paragraph id="HEB58D2DA2FAC4F6B9E8971214B10A631"><enum>(3)</enum><text>sets performance goals for improving student outcomes for the duration of the grant; and</text> </paragraph><paragraph id="H068A09F05ACA45C3B06AFB453AEC77E0"><enum>(4)</enum><text>if receiving a grant for transfer students, has articulation agreements with community colleges at the national, State, or local levels to ensure that community college credits can fully transfer to the institution.</text>
						</paragraph></subsection><subsection id="H3C489F32DEDE40F0A60DF69C6B945962"><enum>(c)</enum><header>Grant amount</header>
 <paragraph id="H94147D8562E948CDA4B7D41694812191"><enum>(1)</enum><header>Initial amount</header><text>For the first year that an eligible institution, as described in subsection (b), participates in the grant program under this section and subject to paragraph (3), such eligible institution shall receive a grant in an amount based on the product of—</text>
 <subparagraph id="H97CAEFDCF39440269B22CA8DD26DB9EC"><enum>(A)</enum><text>the actual cost of tuition and fees at the eligible institution in such year (referred to in this section as the per-student rebate); multiplied by</text>
 </subparagraph><subparagraph id="HF38F891290274EED9E73C51964CB18EC"><enum>(B)</enum><text>the number of eligible students enrolled in the eligible institution for the preceding year.</text> </subparagraph></paragraph><paragraph id="H8093C7CF77374C15957CD1BABAD6FB1C"><enum>(2)</enum><header>Subsequent increases</header><text>For each succeeding year after the first year of the grant program under this section, each eligible institution, as described in subsection (b), that participate in the grant program shall receive a grant in the amount determined under paragraph (1) for such year, except that in no case shall the amount of the per-student rebate increase by more than 3 percent as compared to the amount of such rebate for the preceding year.</text>
						</paragraph><paragraph id="HEAAB084637B347B6854CB86E314388F2"><enum>(3)</enum><header>Limitations</header>
 <subparagraph id="H5877F58176654F69AA8EEECC33D1538E"><enum>(A)</enum><header>Maximum per-student rebate</header><text>No eligible institution, as described in subsection (b), participating in the grant program under this section shall receive a per-student rebate amount for a grant year greater than the national average of public 4-year institutional tuition and fees, as determined by the Secretary.</text>
 </subparagraph><subparagraph id="HAADD51D70CE6402B9762F3BC89DBA7C5"><enum>(B)</enum><header>First year tuition and fees</header><text>During the first year of participation in the grant program under this section, no eligible institution, as described in subsection (b), may increase tuition and fees at a rate greater than any annual increase made by the institution in the previous 5 years.</text>
 </subparagraph></paragraph></subsection><subsection id="H489568A684034A48A7423C966F9F7CE5"><enum>(d)</enum><header>Application</header><text>An eligible institution, as described in subsection (b), shall submit an application to the Secretary at such time, in such a manner, and containing such information as determined by the Secretary.</text>
 </subsection><subsection id="HE29F650218E346E4BE908F71EA2BC187"><enum>(e)</enum><header>Use of funds</header><text>Funds awarded under this section to an eligible institution, as described in subsection (b), shall be used to waive or significantly reduce tuition and fees for eligible students in an amount of not more than up to the annual per-student rebate amount for each student, for not more than the first 60 credits an eligible student enrolls in the eligible institution.</text>
 </subsection></section><section id="H9AE5C12DC8264A649DD74949252EEFCD"><enum>123.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph id="H843AB6713A594B1185E7E0EB33E6F59D"><enum>(1)</enum><header>Eligible student</header> <subparagraph id="HC869CCAF74264D23AA334684872ABBF5"><enum>(A)</enum><header>Definition</header><text>The term <term>eligible student</term> means a student, regardless of age, who—</text>
 <clause id="H2FCD26DCD5554F9DBD1F6BF9ED447B0D"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H60E5720A7B5F4C94B2D03A60797CC866"><enum>(I)</enum><text>enrolls in a historically Black college or university, or minority-serving institution; or</text> </subclause><subclause id="HA46E64F048434E169BDE155AC468483F" indent="up1"><enum>(II)</enum><text>transfers from a community college into a historically Black college or university, or minority-serving institution;</text>
 </subclause></clause><clause id="H8D51A6AC7A56499590F93F31DB61DC29"><enum>(ii)</enum><text>attends the historically Black college or university, or minority serving institution, on at least a half-time basis; and</text>
 </clause><clause id="H872F3B34B1E14B97BBE88DFEDF430D6C"><enum>(iii)</enum><text>is maintaining satisfactory progress, as defined in section 484(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1091">20 U.S.C. 1091(c)</external-xref>), in the student’s course of study.</text>
 </clause></subparagraph><subparagraph id="HB18475F983274F2096A49037954109C8"><enum>(B)</enum><header>Special rule</header><text>An otherwise eligible student shall lose eligibility 3 calendar years after first receiving benefits under this subtitle.</text>
 </subparagraph></paragraph><paragraph id="H3EF67CD9B2384533A27C1E45D91EFA1D"><enum>(2)</enum><header>Historically black college or university</header><text>The term <term>historically Black college or university</term> means a part B institution described in section 322(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061(2)</external-xref>).</text>
 </paragraph><paragraph commented="no" id="H001D936AB97946C4A57C5EF5F8E539C1"><enum>(3)</enum><header>Low-income student</header><text>The term <term>low-income student</term>—</text> <subparagraph commented="no" id="H4C9E8C5A62634ED59B728B105EED201E"><enum>(A)</enum><text>shall include any student eligible for a Federal Pell Grant under section 401 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a</external-xref>); and</text>
 </subparagraph><subparagraph commented="no" id="H06443F14DA804ED89EEDFD5C5CC98F77"><enum>(B)</enum><text display-inline="yes-display-inline">may include a student ineligible for a Federal Pell Grant under section 401 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a</external-xref>) who is determined by the institution of higher education in which the student is enrolled to be a low-income student based on an analysis of the student’s ability to afford the cost of attendance at the institution.</text>

 </subparagraph><subparagraph id="HAAB4F7973F604791A06EDA4A29E13CA7"><enum>(B)</enum><text>designated as a minority-serving institution by the Secretary.</text> </subparagraph></paragraph><paragraph id="id9A022E89DC1B446E99C3303A3C3D4208"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Education.</text>

 <subsection commented="no" id="HAFA63C4B6FD2414BB30586BF7AEC023C"><enum>(a)</enum><header>Authorization and appropriations for HBCU and MSI grants</header><text>For the purpose of carrying out sections 121 and 122, there are authorized to be appropriated, and there are appropriated—</text>

 </paragraph></subsection><subsection id="H88E1A7D6FB524E3EB024F7BF65D347DF"><enum>(b)</enum><header>Availability</header><text>Funds appropriated under subsection (a) are to remain available to the Secretary until expended.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="H33CDFDCA06DD400186D426AB5ECB1263"><enum>(c)</enum><header>Insufficient funds</header><text>If the amount appropriated under subsection (a) for a fiscal year is not sufficient to award each participating institution in the grant programs under sections 121 and 122 a grant under this subtitle that is equal to 100 percent of the grant amount determined under sections 121(c) and 122(c), as applicable, the Secretary may ratably reduce the amount of each such grant or take other actions necessary to ensure an equitable distribution of such amount.</text>
					</subsection></section></subtitle></title><title id="id1C9D9217053B436CBF325C3EB1A72344" style="OLC"><enum>II</enum><header>National Public Service Education Grant Program</header>
 <section id="idB03241DA2E504BEBBFC9F1474739A9C0"><enum>201.</enum><header>National Public Service Education Grant Program</header><text display-inline="no-display-inline">Part A of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070</external-xref> et seq.) is amended by adding at the end the following:</text>

					<subpart id="idF3C3E157B0784D299B431AEE4D00E4B2" style="OLC"><enum>11</enum><header>National Public Service Education Grant Program</header>
						<section id="id6CA427336A0A4ED6B2D5A08512391DF7"><enum>420T.</enum><header>National Public Service Education Grant Program</header>
 <subsection id="id78D9A69DD4414A33AC18D2007804DA44"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id35C03480EDF94C9E9FBA49D64BF479ED"><enum>(1)</enum><header>Cost of attendance</header> <subparagraph id="idC18278CB2C324C30B204EA2C4294F22D"><enum>(A)</enum><header>In general</header><text>The term <term>cost of attendance</term> means tuition, fees, on-campus room and board, books and supplies, personal expenses, and transportation.</text>
 </subparagraph><subparagraph id="id023EA61DB621495BB36B10215632A90E"><enum>(B)</enum><header>On-campus room and board</header><text>The term <term>on-campus room and board</term> means—</text> <clause id="idA7A9BE1B4268405B8E1AAAE296C0A8AC"><enum>(i)</enum><text>the cost to a student of a double room on campus; and</text>
 </clause><clause id="id16D77396F1764EBAA203333018849526"><enum>(ii)</enum><text>the cost of a resident student meal plan.</text> </clause></subparagraph></paragraph><paragraph id="id1473388CF2AB4D1384F87894F49DE887"><enum>(2)</enum><header>Eligible institution</header><text>The term <term>eligible institution</term> means a public 4-year institution of higher education or a private, nonprofit 4-year institution of higher education.</text>
 </paragraph><paragraph id="id955BDDC197BA4D90AB1843F1FC5EDE63"><enum>(3)</enum><header>Eligible student</header><text>The term <term>eligible student</term> means a student who—</text> <subparagraph id="id8B25ED4D12F44461B0512FFF763A812A"><enum>(A)</enum><text>has received an associate's degree or has earned not less than 60 credits toward a baccalaureate degree;</text>
 </subparagraph><subparagraph id="idf5839d99b6cc46cfa5c5e4a86ad02a6a"><enum>(B)</enum><text>is enrolled, at an eligible institution awarded a grant under this section, on a full-time basis in a course of study that will lead to employment in a public service job; and</text>
 </subparagraph><subparagraph id="id3BAB66A0C47B44D08560C2C2745B41A7"><enum>(C)</enum><text>has submitted a Free Application for Federal Student Aid (FAFSA) to the Department.</text> </subparagraph></paragraph><paragraph id="idBA39E8470F1C4C1B88DB45244951F5C1"><enum>(4)</enum><header>Public service job</header><text>The term <term>public service job</term> has the meaning given the term in section 455(m)(3)(B).</text>
 </paragraph></subsection><subsection id="idDC088F44A8804380BC79BC443B1ACF7E"><enum>(b)</enum><header>Establishment of program</header><text>The Secretary shall establish a National Public Service Education Grant program to assist in paying for the cost of attendance for an undergraduate education to students who commit to work for not less than 3 years in a public service job upon completion of their baccalaureate degree.</text>
							</subsection><subsection id="idDBD350A262904035B62E9E46AFB0CA9E"><enum>(c)</enum><header>Grants from the department to eligible institutions</header>
 <paragraph id="id6D79F2569FD448968018FB08B7EA4D37"><enum>(1)</enum><header>In general</header><text>The Secretary shall award grants to eligible institutions to enable the eligible institutions to award grants to eligible students who commit to work for not less than 3 years in a public service job upon completion of their baccalaureate degree.</text>
 </paragraph><paragraph id="idA28D8BFD34C649D789FEF8F1A7362AD1"><enum>(2)</enum><header>Duration</header><text>Grants awarded to eligible institutions under this subsection shall be 5 years in duration. Subject to subsection (e), such a grant may be extended for additional 5-year periods.</text>
								</paragraph><paragraph id="id76385D36C12842FC99396ABC01C22F30"><enum>(3)</enum><header>Amounts</header>
 <subparagraph id="id7180A34E0AA94539B9A35DFB6BD8EEB3"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Secretary shall award a grant to an eligible institution under this subsection for a fiscal year in an amount equal to the lesser of—</text>
 <clause id="id9951E285D660439B8B347EC1479DA23E"><enum>(i)</enum><text>the average annual cost of in-State tuition, fees, and on-campus room and board in the State in which the institution is located at a public 4-year institution of higher education during the fiscal year multiplied by the number of eligible students enrolled at the institution who apply for a grant under this section during the fiscal year; or</text>
 </clause><clause id="id5573F3A8569646D599EC1F932936C4EA"><enum>(ii)</enum><text>the actual annual cost of tuition, fees, and on-campus room and board at the eligible institution during the fiscal year multiplied by the number of eligible students enrolled at the institution who apply for a grant under this section during the fiscal year.</text>
 </clause></subparagraph><subparagraph id="idDBEFA0984463405185BF4B5929CB029D"><enum>(B)</enum><header>Nontraditional calendar</header><text>The calculation of the cost of tuition, fees, and on-campus room and board under subparagraph (A) with respect to an eligible student who applies for a grant under this section for enrollment during the summer or other nontraditional period shall be the cost of the cost of tuition, fees, and on-campus room and board for such summer or other nontraditional period.</text>
 </subparagraph></paragraph><paragraph id="id72091EE36B8C46C1B268712A89507FB1"><enum>(4)</enum><header>Applications</header><text>The Secretary shall design an application for eligible institutions to participate in the grant program under this subsection that includes a description of how the eligible institution, if awarded a grant under this subsection, will provide services to students as follows:</text>
 <subparagraph id="idef36988fb3544445913d78a5f813f3f7"><enum>(A)</enum><text>Provide comprehensive academic and student support services for eligible students awarded grants under this section, including mentoring and advising, particularly for first-generation and minority students.</text>
 </subparagraph><subparagraph id="idbd7fac032dd24077a684dd0c32773a27"><enum>(B)</enum><text>Provide accelerated learning opportunities for eligible students awarded grants under this section to receive their baccalaureate degree and any required certificate or license to work in their respective public service job in less than 2 years if an eligible student seeks to complete the degree in less than 2 years.</text>
 </subparagraph><subparagraph id="id90663ea6c95544cfb6549d381ca8b31f"><enum>(C)</enum><text>Foster opportunities for eligible students awarded grants under this section to connect with potential public service job employers through the Corporation for National and Community Service.</text>
 </subparagraph><subparagraph id="id631283a7896548a2aaf199913ebd052b"><enum>(D)</enum><text>Any additional information determined necessary by the Secretary.</text> </subparagraph></paragraph></subsection><subsection id="id1FE1410EA94043C588129A77FECEC76B"><enum>(d)</enum><header>Grants to eligible students</header> <paragraph id="id91B75CBA0DF04E9D8425D54A8054A882"><enum>(1)</enum><header>In general</header><text>Each eligible institution that receives a grant under subsection (c) shall award grants to eligible students enrolled at the institution.</text>
 </paragraph><paragraph id="id6F6307A8DC734FC8AB572A1994E12C6F"><enum>(2)</enum><header>Application</header><text>An eligible student who desires to receive a grant under this section shall submit an application to the eligible institution that includes the following:</text>
 <subparagraph id="id2092BD7CEFF74D81B36AE068B67F7D95"><enum>(A)</enum><text>An agreement to work for not less than 3 years in a public service job upon completion of their baccalaureate degree.</text>
 </subparagraph><subparagraph id="idD2B2EF55DCAD4A519F34A7ECEF2E8206"><enum>(B)</enum><text>Information that demonstrates that the student is an eligible student for purposes of section 484.</text> </subparagraph><subparagraph id="id165E0C0390014F36B172058A8B1A2DF9"><enum>(C)</enum><text>Information that demonstrates that the student has received counseling from the Department that explains the terms and conditions of the grant award.</text>
 </subparagraph><subparagraph id="id1AE58F1021484811BFAA81BC2AC76DC3"><enum>(D)</enum><text>Any additional information determined necessary by the Secretary.</text> </subparagraph></paragraph><paragraph id="idBE10AB54AF614138AF5A09A225D1207A"><enum>(3)</enum><header>Grant amount</header> <subparagraph id="id822B428CCAB1472F95E088B071AFD149"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), an eligible institution shall award a grant to an eligible student enrolled at the institution for an academic year in an amount equal to the total grant amount received by the eligible institution under subsection (c) for the fiscal year preceding the academic year divided by the number of students to whom the eligible institution awards grants under this subsection for such academic year.</text>
 </subparagraph><subparagraph commented="no" id="id448F7BCA11B34B3FACFBC2E93CDCD989"><enum>(B)</enum><header>Nontraditional calendar</header><text>An eligible institution shall award a grant to an eligible student who applies for a grant under this section for enrollment during the summer or other nontraditional period in an amount, from the total grant amount received by the eligible institution under subsection (c), that is prorated to reflect the cost of tuition, fees, and on-campus room and board for such summer or other nontraditional period.</text>
									</subparagraph></paragraph><paragraph id="id23056C97DC534127906B27A834A331A9"><enum>(4)</enum><header>Cost of attendance beyond grant amount</header>
									<subparagraph id="iddf8e60ea803749b9b90fddf54fb59138"><enum>(A)</enum><header>Amounts not covered by NPSEG grants</header>
										<clause id="idDA72064376C74C91A5FEDCFCAEFADAEA"><enum>(i)</enum><header>Public institutions</header>
 <subclause id="id25703FAD718D48F0962EDDC3A51EF933"><enum>(I)</enum><header>In general</header><text>An eligible institution that is a public institution of higher education shall cover the excess costs to meet the difference between the in-State tuition, fees, and on-campus room and board at the institution and the amount awarded to the eligible student through the grant award under paragraph (3), through a combination of grant and work-study awards under this title for which the eligible student may be eligible, campus-based aid programs, State-based merit or need-based aid, or other institutional-based merit- or need-based aid. An eligible institution that is a public institution of higher education may cover, with respect to an eligible student, any amounts of the cost of attendance that are in excess of the total amount awarded to the eligible student through the grant award under paragraph (3) and the amount of excess costs provided under this subclause based on the demonstrated financial need of the student.</text>
 </subclause><subclause id="id0DDBBCC528F44DD0A90E10ECB87D8388"><enum>(II)</enum><header>Student contribution</header><text>The eligible student shall be responsible for any amounts of the cost of attendance that are in excess of the total amount awarded to the eligible student through the grant award under paragraph (3) and the amount of excess costs provided under subclause (I). The eligible student may be eligible for Federal student aid in accordance with subparagraph (B) for the remaining cost of attendance amount for which the student is responsible.</text>
											</subclause></clause><clause id="idC62A95B790724CCAADDA0A39D034D44B"><enum>(ii)</enum><header>Private institution</header>
											<subclause id="idC01F04C5326543EC8CCB6A8102DC6BC4"><enum>(I)</enum><header>Matching amount</header>
 <item id="idD67A82BBC6BD4AFC84874B5D6FBA48A9"><enum>(aa)</enum><header>In general</header><text>An eligible institution that is a private, nonprofit institution of higher education shall—</text> <subitem id="id31206DC901044840A300325E44327325"><enum>(AA)</enum><text>with respect to an eligible student described in item (bb), cover excess costs toward meeting an eligible student’s cost of attendance in an amount equal to or greater than the amount of the grant award to the eligible student described in paragraph (3); and</text>
 </subitem><subitem id="id1C1178B8C17349C4A3336ACB14717F7B"><enum>(BB)</enum><text>with respect to an eligible student not described in item (bb), not be obligated to provide additional institutional-based financial aid to such student.</text>
 </subitem></item><item id="idA6EE4ECA29874F1D8F295DC82933B59E"><enum>(bb)</enum><header>Eligible students</header><text>An eligible student is described in this item if the student's (or the student's parents' in the case of a dependent student) adjusted gross income for the taxable year that is 1 year prior to the taxable year that ends immediately prior to the beginning of the first award year of the program under this section is equal to or less than $125,000, indexed for inflation by regulation of the Secretary.</text>
 </item><item id="id7C4B6B64C03945CEB769C21085C0243A"><enum>(cc)</enum><header>Source of aid</header><text>The required amount described in item (aa)(AA) may be provided through a combination of grant and work-study awards under this title for which the eligible student may be eligible, campus-based aid programs, State-based merit or need-based aid, or other institutional-based merit- or need-based aid.</text>
 </item></subclause><subclause id="id50883BF0B5AD46EDA4485EC9093BC162"><enum>(II)</enum><header>Student contribution</header><text>The eligible student shall be responsible for any amounts of the cost of attendance that are in excess of the total amount awarded to that eligible student through the grant award under paragraph (3) and the amount of excess costs provided under subclause (I). The eligible student may be eligible for Federal student aid in accordance with subparagraph (B) for the remaining cost of attendance amount for which the student is responsible.</text>
 </subclause></clause><clause id="id12DC84D9E2CE40AEB5D105EC5B0F9C16"><enum>(iii)</enum><header>Student choice</header><text>An eligible student who receives a Federal work-study award by an eligible institution to meet the cost of attendance beyond a grant awarded under this section may choose to decline the Federal work-study award and take out a Federal Direct Unsubsidized Stafford Loan. An eligible institution shall be considered to have met the institution's responsibilities if a student chooses to take out such a loan in lieu of a Federal work-study award.</text>
 </clause></subparagraph><subparagraph id="id96e545a0b8784d3a81d2fa28d20e7e83"><enum>(B)</enum><header>First dollar award</header><text>An eligible institution shall consider the grant award under this subsection as the first dollar award, to be available prior to other funds awarded by the Department of Education under this title, the State involved, or the institution.</text>
 </subparagraph><subparagraph id="id462711910bf349dc8b27ffa72e45ff47"><enum>(C)</enum><header>Housing</header><text>An eligible student who receives a grant under this subsection may use the grant amounts for off-campus housing but the student may not use such grant amounts for any amounts for such off-campus housing that are in excess of the cost of on-campus room and board.</text>
 </subparagraph></paragraph><paragraph id="id024C446E41ED456AABDE00CA2586CAE0"><enum>(5)</enum><header>Classes in nontraditional calendars</header><text>An eligible student who receives a grant under this subsection may use the grant amounts for enrollment during any period of study.</text>
								</paragraph></subsection><subsection id="idBB05DE6DA82A4ABDA0C43E1F76F1A761"><enum>(e)</enum><header>Institutional accountability</header>
 <paragraph id="id1705A77D47EC45349F2BD78BA52C6A87"><enum>(1)</enum><header>In general</header><text>Each eligible institution that receives a grant under subsection (c) shall—</text> <subparagraph id="id4c2ca7ce9f2745fbae621036b7c1031c"><enum>(A)</enum><text>provide comprehensive academic and student support services for eligible students awarded grants under this section, including mentoring and advising, particularly for first-generation and minority students;</text>
 </subparagraph><subparagraph id="ide348942436024d4aac60e4ab1cffc039"><enum>(B)</enum><text>provide accelerated learning opportunities for eligible students awarded grants under this section to receive their baccalaureate degree and any required certificate or license to work in their respective public service job in less than 2 years if an eligible student seeks to complete the degree in less than 2 years; and</text>
 </subparagraph><subparagraph id="id9a964404298a4fbbb592615c578b3c9a"><enum>(C)</enum><text>foster opportunities for eligible students awarded grants under this section to connect with potential public service job employers through the Corporation for National and Community Service.</text>
									</subparagraph></paragraph><paragraph id="id54fd60e951fa453abd5fb04ca2d130be"><enum>(2)</enum><header>Biennial report</header>
 <subparagraph id="id120D016F6AAF4109BD95EF172863992F"><enum>(A)</enum><header>In general</header><text>Each eligible institution that receives a grant under subsection (c) shall submit a biennial report to the Secretary describing the following:</text>
 <clause id="ide795d380d43d48a5b1df1b08d50c0acf"><enum>(i)</enum><text>Academic and student support services offered to eligible students awarded grants under this section.</text>
 </clause><clause id="ide60d2dbcef8b46bf85036e44764ae609"><enum>(ii)</enum><text>Such students' progress towards baccalaureate degree completion and graduation.</text> </clause><clause id="id1cd5601d9a4b48b5a04eaa31ea385b35"><enum>(iii)</enum><text>Outreach to potential public service job employers for the eligible students awarded grants under this section.</text>
 </clause></subparagraph><subparagraph id="id89D516C3AB784DA882DEAB4507C7BE2C"><enum>(B)</enum><header>Continuing grant awards to eligible institutions</header><text>The Secretary may continue grant awards to an eligible institution under subsection (c) after the initial 5-year grant period for additional 5-year periods if—</text>
 <clause id="id10DAC12CB2644625A4FB42C69B49F1DB"><enum>(i)</enum><text>the institution complies with the requirements of paragraph (1); and</text> </clause><clause id="id9658A9DFD09547C6BECD107EF3F60432"><enum>(ii)</enum><text>the eligible students awarded grants under this section who are enrolled at the institution have a baccalaureate degree graduation rate that meets or exceeds a rate determined appropriate by the Secretary.</text>
										</clause></subparagraph><subparagraph id="id68ECF3A748AB4946A729233567AA5ADB"><enum>(C)</enum><header>Discontinuing grant awards to eligible institutions</header>
 <clause id="id822e06967f224a80b6944b0deeba1ee4"><enum>(i)</enum><header>In general</header><text>The Secretary may discontinue grant awards to an eligible institution under subsection (c) after the initial 5-year grant period based on the outcome of the biennial reports under subparagraph (A).</text>
 </clause><clause id="id687BBC0517F64A83B586C9DE0817D4AB"><enum>(ii)</enum><header>Notification</header><text>Prior to the Secretary discontinuing a grant award under clause (i), the Secretary shall notify the institution, prior to the start of the 5th year of the 5-year grant period, in a publically available format, that the institution is, or is potentially, out of compliance with the requirements of the grant award and may have the institution's grant awards discontinued.</text>
 </clause><clause id="id1D425C02133B44D79FD1DF47DFF0CFA0"><enum>(iii)</enum><header>Modifications</header><text>In the 5th year of the 5-year grant period, an eligible institution may make modifications to the institution's grant program and appeal to the Secretary for a renewal of the institution's grant.</text>
 </clause><clause id="id59D92C601BB846588B18236EBDF9533E"><enum>(iv)</enum><header>Decision</header><text>The Secretary, prior to the conclusion of the 5-year grant period, shall render a decision on whether to continue grant awards to an eligible institution.</text>
 </clause><clause id="id5b79ef78030b4871913f576018a1d843"><enum>(v)</enum><header>Remaining responsibility</header><text>If the Secretary discontinues grant awards to an eligible institution under subsection (c), the institution shall be responsible for maintaining academic and student support services and providing the full remaining costs for eligible students awarded a grant under this section prior to such discontinuation to receive their baccalaureate degree debt free.</text>
 </clause></subparagraph></paragraph><paragraph id="id964A182DCDCB4CB5BE4C23FD030113B0"><enum>(3)</enum><header>Institutional prohibitions</header><text>Each eligible institution that receives a grant under subsection (c) may not—</text> <subparagraph id="idd9e9f6cc70a746069c59cafcc4c10d65"><enum>(A)</enum><text>use grant funds for administrative purposes; or</text>
 </subparagraph><subparagraph id="idBDFCA032E7B142EBB95E9B3993942DF0"><enum>(B)</enum><text>establish different tuition prices between eligible students who receive grants under this section and students who do not receive grants under this section for pursing the same course of study.</text>
									</subparagraph></paragraph></subsection><subsection id="idE23F6DE626CA4A84AA2C3453036FC380"><enum>(f)</enum><header>Student accountability</header>
								<paragraph id="id2C85D28E23CB499CB1EEC74E9B38DC36"><enum>(1)</enum><header>Enrollment; GPA; service</header>
 <subparagraph id="id4540F9585523406F8A37654FEC1766FE"><enum>(A)</enum><header>In general</header><text>An eligible student awarded a grant under this section shall—</text> <clause id="id0b8a9815965140cabf39973f76794dfa"><enum>(i)</enum><text>maintain full-time enrollment in order to complete the student's baccalaureate degree in not more than 2 years; and</text>
 </clause><clause id="idba3f7593db9342aba416ac3f96be097c"><enum>(ii)</enum><text>maintain satisfactory academic progress, defined as a 3.0 grade point average (GPA) or higher, and meet all other institutional standards for academic progress.</text>
										</clause></subparagraph><subparagraph id="ida7c53e0283134755bda6188c6ba5d252"><enum>(B)</enum><header>Two weeks of service</header>
 <clause id="idED6785BBB40645BB9725B115470C789C"><enum>(i)</enum><header>In general</header><text>Except as otherwise provided in this subparagraph, an eligible student awarded a grant under this section shall serve for 80 hours as a participant in a Corporation for National and Community Service national service project for each year the eligible student receives the grant. The eligible institution shall assist in placing the eligible student in such a project relevant to the eligible student’s course of study. Such required hours may be completed at any point during the student's enrollment but shall be completed prior to the date the eligible student receives the student's baccalaureate degree.</text>
 </clause><clause commented="no" id="id395806f85e9e4479b379c4b2eaaae189"><enum>(ii)</enum><header>Other project</header><text>If an eligible student resides in an area without a local Corporation for National and Community Service national service project available, the student may instead participate in a service project with a community action agency, a local government agency, or an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986.</text>
 </clause><clause commented="no" id="idf56f292a447d43ceb219c25f68cf9dd1"><enum>(iii)</enum><header>Medical exemption</header><text>The Secretary may grant an eligible student a medical exemption from the service commitment under this subparagraph if the student becomes medically unable to complete the service commitment over the course of the academic year. An eligible student granted such an exemption shall complete the service commitment upon recovery without risking eligibility status in the grant program under this section.</text>
										</clause></subparagraph></paragraph><paragraph id="id92b9cea3bd0d4bfcb9fb0eeb703f2a14"><enum>(2)</enum><header>Satisfactory progress</header>
 <subparagraph id="id4B1C8B448F8B408A80F452D5F20F9EA3"><enum>(A)</enum><header>After one year</header><text>In the case in which an eligible student awarded a grant under this section does not maintain satisfactory academic progress, as described in paragraph (1)(A)(ii), after the first academic year for which the student received the grant, the student shall—</text>
 <clause id="id6591EA206E804D7BB98F2BF417C4D23B"><enum>(i)</enum><text>serve an additional year in a public service job beyond the 3-year commitment upon receiving the student's baccalaureate degree; and</text>
 </clause><clause id="idE86BEE324E4347748FA910CA85DF86FC"><enum>(ii)</enum><text>receive additional academic supports from the eligible institution in which the student is enrolled.</text>
 </clause></subparagraph><subparagraph id="id8f66bf0ce5da4059b5c03f40a08471e4"><enum>(B)</enum><header>After two years</header><text>In the case in which an eligible student awarded a grant under this section does not receive a baccalaureate degree after the second academic year for which the student received the grant, the total of the grant award amount and remaining funds provided by the institution shall be treated as a Federal Direct Unsubsidized Stafford Loan under part D of title IV, and shall be subject to repayment, as described in paragraph (4).</text>
 </subparagraph><subparagraph id="ida7cdbc63b37f40cb9f449709265cc6a8"><enum>(C)</enum><header>Appeals</header><text>In the case in which an eligible student awarded a grant under this section does not maintain satisfactory academic progress, as described in paragraph (1)(A)(ii), after the first academic year for which the student received the grant, the student may appeal the decision to serve an additional year, as described in subparagraph (A)(i). The appeal shall be made in writing to the eligible institution and include an academic plan approved by the student’s adviser. The academic plan shall show a clear pathway to graduation within 1 year.</text>
									</subparagraph></paragraph><paragraph id="id4f15907d81194bbaa4107e65c7a6a3f0"><enum>(3)</enum><header>Public service job work obligation</header>
 <subparagraph id="idE669DEE21A584C21A3C9BD8FD5EFD6D4"><enum>(A)</enum><header>In general</header><text>Except as provided in paragraph (2)(A)(i) and subparagraph (C), an eligible student awarded a grant under this section shall work for not less than 3 years in a public service job after receiving the student's baccalaureate degree. Such 3 years (or 4 years, in the case of a scenario described in paragraph (2)(A)(i)) may be consecutive or nonconsecutive but shall be completed not later than 5 years (or 6 years, in the case of a scenario described in paragraph (2)(A)(i)) after the date the student receives the student's baccalaureate degree.</text>
 </subparagraph><subparagraph id="id4A0EA665F95C4980B56D19F8E2832DC3"><enum>(B)</enum><header>Notification</header><text>An eligible student awarded a grant under this section shall notify the Department, utilizing a form designed by the Secretary, of the student's compliance or noncompliance with subparagraph (A) annually until such student completes the student's work obligation.</text>
 </subparagraph><subparagraph id="id07A138FC19544EDB8E6DFD36797D2562"><enum>(C)</enum><header>Deferment for graduate school</header><text>The work obligation described in subparagraph (A) of an eligible student awarded a grant under this section who enrolls as a full-time student in a post-baccalaureate degree program not later than 3 years after the date the student receives the student's baccalaureate degree shall be deferred during the period of such full-time enrollment. Any years of service completed prior to full-time enrollment in a post-baccalaureate degree program shall count toward such work obligation.</text>
 </subparagraph></paragraph><paragraph id="id8362A897522A4D71A76B151E5AD5EA3F"><enum>(4)</enum><header>Repayment for noncompliance</header><text>In the event that an eligible student awarded a grant under this section fails or refuses to comply with the work obligation as described in paragraph (3), or the student does not receive a baccalaureate degree after the second academic year for which the student received the grant, as described in paragraph (2)(B), the sum of the amounts of any grants received by the student shall, upon a determination of such a failure or refusal in such service obligation or failure to receive a baccalaureate degree, be treated as a Federal Direct Unsubsidized Stafford Loan under part D of title IV, and shall be subject to repayment, together with interest thereon accruing from the date of the grant award, in accordance with terms and conditions specified by the Secretary in regulations under this section.</text>
 </paragraph><paragraph id="id91fca414d8564c428764fde9f9538611"><enum>(5)</enum><header>Medical exemption</header><text>The Secretary may grant an eligible student awarded a grant under this section a medical exemption—</text> <subparagraph id="idC41948F94CCE4DAB996BB52664E17950"><enum>(A)</enum><text>from the requirement of maintaining satisfactory academic progress under paragraph (1)(A)(ii); or</text>
 </subparagraph><subparagraph id="id8F9341B373914F10B5C5945D4DFAF5B0"><enum>(B)</enum><text>from a term or condition of the work obligation of the student if the student becomes medically unable to complete the student's studies or public service job work obligation.</text>
									</subparagraph></paragraph></subsection></section><section id="id53DD5FC475C94ED794FD9B725AA07C14"><enum>420U.</enum><header>National Public Service Education Grant Program for Minority-Serving Institutions and HBCUs</header>
 <subsection id="idACE8F56844CE4A099AD15E3108E29973"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="idB7765BFAC49540E7B7A12CD71D5F594A"><enum>(1)</enum><header>Eligible institution</header><text>The term <term>eligible institution</term> means a minority-serving institution or historically black college or university that is a public 4-year institution of higher education or a private, nonprofit 4-year institution of higher education.</text>
 </paragraph><paragraph id="id979AA70741FC456BB3BF727664E6F61E"><enum>(2)</enum><header>Eligible student</header><text>The term <term>eligible student</term> means a student who—</text> <subparagraph id="id28CBD47366604887A512CF43F7E7689E"><enum>(A)</enum><text>has received an associate's degree or has earned not less than 60 credits toward a baccalaureate degree;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC44B8F1C800D48C584F31A3314D43AD8"><enum>(B)</enum><text display-inline="yes-display-inline">is enrolled, at an eligible institution awarded a grant under this section, on a full-time basis in a course of study that will lead to employment in a public service job; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8F83182365C7412D9AED147884578083"><enum>(C)</enum><text>has submitted a Free Application for Federal Student Aid (FAFSA) to the Department.</text> </subparagraph></paragraph><paragraph id="H8C4AE9282AA046E7B7850B051B5C5733"><enum>(3)</enum><header>Historically black college or university</header><text display-inline="yes-display-inline">The term <term>historically black college or university</term> means a part B institution described in section 322(2).</text>
 </paragraph><paragraph id="H21D3AEC172B94D13A3359B7E678DD064"><enum>(4)</enum><header>Minority-serving institution</header><text display-inline="yes-display-inline">The term <term>minority-serving institution</term> means any public or nonprofit institution of higher education—</text> <subparagraph id="HB0F5C42FF63D45DEB4F9E21503DBD6A9"><enum>(A)</enum><text>described in paragraphs (2) through (7) of section 371(a); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6C6AF4571B834B33BEFBFF3C97BD1371"><enum>(B)</enum><text>designated as a minority-serving institution by the Secretary.</text> </subparagraph></paragraph><paragraph id="id05027E9BF14640B0B690F1AF58A0AD5D"><enum>(5)</enum><header>On-campus room and board</header><text>The term <term>on-campus room and board</term> means—</text>
 <subparagraph id="id2B2F54DE973A4553B2F0A00F7D1ABEB3"><enum>(A)</enum><text>the cost to a student of a double room on campus; and</text> </subparagraph><subparagraph id="id4CF4C93C9A1F43A19992F8D63C0E0D73"><enum>(B)</enum><text>the cost of a resident student meal plan.</text>
 </subparagraph></paragraph><paragraph id="id98E224DC29054BF4A8D92AA5D836844D"><enum>(6)</enum><header>Public service job</header><text>The term <term>public service job</term> has the meaning given the term in section 455(m)(3)(B).</text> </paragraph></subsection><subsection id="idEE9EB1F03A8F40E6A55A4FDAF226E7D1"><enum>(b)</enum><header>Establishment of program</header><text>The Secretary shall establish a National Public Service Education Grant program for eligible institutions to provide a debt-free undergraduate education to students who commit to work for not less than 3 years in a public service job upon completion of their baccalaureate degree.</text>
							</subsection><subsection id="id057E65BD963D4EABB0619C27AF55F0EB"><enum>(c)</enum><header>Grants from the department to eligible institutions</header>
 <paragraph id="id4374AB9E0A7E423C84911B1FA6E13F07"><enum>(1)</enum><header>In general</header><text>The Secretary shall award grants to eligible institutions to enable the eligible institutions to award grants to eligible students who commit to work for not less than 3 years in a public service job upon completion of their baccalaureate degree.</text>
 </paragraph><paragraph id="idAD11F8EE516446098B81258EFCA513D3"><enum>(2)</enum><header>Duration</header><text>Grants awarded to eligible institutions under this subsection shall be 5 years in duration. Subject to subsection (e), such a grant may be extended for additional 5-year periods.</text>
								</paragraph><paragraph id="idE4EA5B79D3604774A8512D53D2544FA3"><enum>(3)</enum><header>Amounts</header>
 <subparagraph id="id44BE9F29EE3B4ED496981832715EA2AC"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Secretary shall award a grant to an eligible institution under this subsection for a fiscal year in an amount equal to the actual annual cost of in-State tuition, fees, and on-campus room and board at the eligible institution during the fiscal year multiplied by the number of eligible students enrolled at the institution who apply for a grant under this section during the fiscal year.</text>
 </subparagraph><subparagraph id="idF2D669E2F54C489EACF91FBBEF20A598"><enum>(B)</enum><header>Nontraditional calendar</header><text>The calculation of the cost of tuition, fees, and on-campus room and board under subparagraph (A) with respect to an eligible student who applies for a grant under this section for enrollment during the summer or other nontraditional period shall be the cost of the cost of tuition, fees, and on-campus room and board for such summer or other nontraditional period.</text>
 </subparagraph></paragraph><paragraph id="idDF52AA5596924D47B194553BF9D5F26F"><enum>(4)</enum><header>Applications</header><text>The Secretary shall design an application for eligible institutions to participate in the grant program under this subsection that includes a description of how the eligible institution, if awarded a grant under this subsection, will provide services to students as follows:</text>
 <subparagraph id="idA6347C260DDA4F11A6B01941C963985E"><enum>(A)</enum><text>Provide comprehensive academic and student support services for eligible students awarded grants under this section, including mentoring and advising, particularly for first-generation and minority students.</text>
 </subparagraph><subparagraph id="id6FA7217048DC4D3580D6708D254E6182"><enum>(B)</enum><text>Provide accelerated learning opportunities for eligible students awarded grants under this section to receive their baccalaureate degree and any required certificate or license to work in their respective public service job in less than 2 years if an eligible student seeks to complete the degree in less than 2 years.</text>
 </subparagraph><subparagraph id="id96A655AFDAE44CB5854CF87C03917F9E"><enum>(C)</enum><text>Foster opportunities for eligible students awarded grants under this section to connect with potential public service job employers through the Corporation for National and Community Service.</text>
 </subparagraph><subparagraph id="id01284502052C40C0822649D23B0CEFA8"><enum>(D)</enum><text>Any additional information determined necessary by the Secretary.</text> </subparagraph></paragraph></subsection><subsection id="idBA7139B125024CBF8BEC306FE01F3F42"><enum>(d)</enum><header>Grants to eligible students</header> <paragraph id="idAA24B2DBDA98416FB7F0B52678A2CCB5"><enum>(1)</enum><header>In general</header><text>Each eligible institution that receives a grant under subsection (c) shall award grants to eligible students enrolled at the institution.</text>
 </paragraph><paragraph id="idAD6E9A7E374D4A1D9BFB283BC9300EE5"><enum>(2)</enum><header>Application</header><text>An eligible student who desires to receive a grant under this section shall submit an application to the eligible institution that includes the following:</text>
 <subparagraph id="id15B484A379724772B27643ED53A2A2A8"><enum>(A)</enum><text>An agreement to work for not less than 3 years in a public service job upon completion of their baccalaureate degree.</text>
 </subparagraph><subparagraph id="idAFD00D88537F4CDD82AE6C3D28D80170"><enum>(B)</enum><text>Information that demonstrates that the student is an eligible student for purposes of section 484.</text> </subparagraph><subparagraph id="id26F2B014E451486CB1989A3458B42F29"><enum>(C)</enum><text>Information that demonstrates that the student has received counseling from the Department that explains the terms and conditions of the grant award.</text>
 </subparagraph><subparagraph id="idDD894F108BB04933A9949ACDFA0D4D37"><enum>(D)</enum><text>Any additional information determined necessary by the Secretary.</text> </subparagraph></paragraph><paragraph id="id7269D73A5D324E789845088A1F61BDAF"><enum>(3)</enum><header>Grant amount</header> <subparagraph id="idC4D1BCAC72204C1FB001C044D1CF55B6"><enum>(A)</enum><header>In general</header><text>An eligible institution shall award a grant to an eligible student enrolled at the institution for an academic year in an amount equal to the total grant amount received by the eligible institution under subsection (c) for the fiscal year preceding the academic year divided by the number of students to whom the eligible institution awards grants under this subsection for such academic year.</text>
 </subparagraph><subparagraph commented="no" id="id6AE8CED162F143DE913851AD7B259E94"><enum>(B)</enum><header>Nontraditional calendar</header><text>An eligible institution shall award a grant to an eligible student who applies for a grant under this section for enrollment during the summer or other nontraditional period in an amount, from the total grant amount received by the eligible institution under subsection (c), that is prorated to reflect the cost of tuition, fees, and on-campus room and board for such summer or other nontraditional period.</text>
									</subparagraph></paragraph><paragraph id="idec8d127533b44f029afc2b5fb9770cee"><enum>(4)</enum><header>Cost of attendance beyond grant amount</header>
									<subparagraph id="id0fb441e1494346cfa368b341b55a0181"><enum>(A)</enum><header>Amounts not covered by npseg grants</header>
 <clause commented="no" id="idb1461330696149bd88df6f8ca50af7ca"><enum>(i)</enum><header>Public institution</header><text>An eligible institution that is a public institution of higher education may cover, with respect to an eligible student, any amounts of the cost of attendance that are in excess of the total amount awarded to the eligible student through the grant award under paragraph (3), based on the demonstrated financial need of the student. For the remaining costs, the eligible student enrolled at an eligible institution that is a public institution shall be responsible for any amounts of the cost of attendance that are in excess of the total amount awarded to that eligible student through the grant award under paragraph (3) and any amount provided pursuant to the preceding sentence. The eligible student may be eligible for Federal student aid in accordance with subparagraph (B) for the remaining cost of attendance amount for which the student is responsible.</text>
										</clause><clause commented="no" id="id20b39127ae0e4ddfbdf57505a7d1460f"><enum>(ii)</enum><header>Private institution</header>
 <subclause id="idCC3BC77F683F43D3AF1E4D35E0E8535D"><enum>(I)</enum><header>In general</header><text>An eligible institution that is a private, nonprofit institution of higher education shall—</text> <item id="id35094341EFD943BBBBAC95F8461A8975"><enum>(aa)</enum><text>with respect to an eligible student described in subclause (II), cover excess costs toward meeting an eligible student’s cost of attendance in an amount equal to or greater than the amount of the grant award to the eligible student described in paragraph (3); and</text>
 </item><item id="id0FA223402E8440E3898D7B311407BF31"><enum>(bb)</enum><text>with respect to an eligible student not described in subclause (II), not be obligated to provide additional institutional-based financial aid to such student.</text>
 </item></subclause><subclause id="idDFA75BD637754BE3A520710D0BD26D0D"><enum>(II)</enum><header>Eligible students</header><text>An eligible student is described in this subclause if the student's (or the student's parents' in the case of a dependent student) adjusted gross income for the taxable year that is 1 year prior to the taxable year that ends immediately prior to the beginning of the first award year of the program under this section is equal to or less than $125,000, indexed for inflation by regulation of the Secretary.</text>
 </subclause><subclause id="id84BF7EAEEC264AF6A5D6CD81F0904EB6"><enum>(III)</enum><header>Source of aid</header><text>The required amount described in subclause (I)(aa) may be provided through a combination of grant and work-study awards under this title for which the eligible student may be eligible, campus-based aid programs, State-based merit or need-based aid, or other institutional-based merit- or need-based aid.</text>
 </subclause><subclause commented="no" id="id21d8622ef35b43a39c731cbd68afed15"><enum>(IV)</enum><header>Student contribution</header><text>The eligible student shall be responsible for any amounts of the cost of attendance that are in excess of the total amount awarded to that eligible student through the grant award under paragraph (3) and the amount of excess costs provided under subclause (I). The eligible student may be eligible for Federal student aid in accordance with subparagraph (B) for the remaining cost of attendance amount for which the student is responsible.</text>
 </subclause></clause><clause id="id1473E25E29294FF09D46FAB211382A61"><enum>(iii)</enum><header>Student choice</header><text>An eligible student who receives a Federal work-study award by an eligible institution to meet the cost of attendance beyond a grant awarded under this section may choose to decline the Federal work-study award and take out a Federal Direct Unsubsidized Stafford Loan. An eligible institution shall be considered to have met the institution's responsibilities if a student chooses to take out such a loan in lieu of a Federal work-study award.</text>
 </clause></subparagraph><subparagraph id="id51f545c3edda4f1db011bb24deb0efbc"><enum>(B)</enum><header>First dollar award</header><text>In calculating an eligible student’s financial need to cover excess costs described in subparagraph (A), the eligible institution shall consider the grant award under this subsection as the first dollar award, to be available prior to other funds awarded by the Department of Education under this title, the State involved, or the institution. If a grant awarded to an eligible student under this section is equal to the cost of tuition, fees, and on-campus room and board for such student, the eligible institution shall not be required to provide additional institutional scholarship or grant based aid to the eligible student.</text>
 </subparagraph><subparagraph id="id651A8B0B9285494DB18C4167742C2F25"><enum>(C)</enum><header>Housing</header><text>An eligible student who receives a grant under this subsection may use the grant amounts for off-campus housing but the student may not use such grant amounts for any amounts for such off-campus housing that are in excess of the cost of on-campus room and board.</text>
 </subparagraph></paragraph><paragraph id="id2592938ACADF45279362DF2150564EFC"><enum>(5)</enum><header>Classes in nontraditional calendars</header><text>An eligible student who receives a grant under this subsection may use the grant amounts for enrollment during any period of study.</text>
								</paragraph></subsection><subsection id="id7A6A9AE61E504E108987CDE7F9374DCA"><enum>(e)</enum><header>Institutional accountability</header>
 <paragraph id="idF3DD23FFBDDF4DF1AADA975FA2FEA2F8"><enum>(1)</enum><header>In general</header><text>Each eligible institution that receives a grant under subsection (c) shall—</text> <subparagraph id="id29BE3C9444594AADA16EE18164CDFB09"><enum>(A)</enum><text>provide comprehensive academic and student support services for eligible students awarded grants under this section, including mentoring and advising, particularly for first-generation and minority students;</text>
 </subparagraph><subparagraph id="id5A5EFFD466A749BE8B1C6BC65FFFD2A1"><enum>(B)</enum><text>provide accelerated learning opportunities for eligible students awarded grants under this section to receive their baccalaureate degree and any required certificate or license to work in their respective public service job in less than 2 years if an eligible student seeks to complete the degree in less than 2 years; and</text>
 </subparagraph><subparagraph id="idA245D1C59A0149B6AF19975DEC213493"><enum>(C)</enum><text>foster opportunities for eligible students awarded grants under this section to connect with potential public service job employers through the Corporation for National and Community Service.</text>
									</subparagraph></paragraph><paragraph id="id3E8C573F89344089945A195A62B24071"><enum>(2)</enum><header>Biennial report</header>
 <subparagraph id="id751E8E2A78A949D3B22709CB3F7E8CDB"><enum>(A)</enum><header>In general</header><text>Each eligible institution that receives a grant under subsection (c) shall submit a biennial report to the Secretary describing the following:</text>
 <clause id="idE073CFAD6B204D5CB9E57B182878AEAB"><enum>(i)</enum><text>Academic and student support services offered to eligible students awarded grants under this section.</text>
 </clause><clause id="idD00794FB396C4BAEBCBE3E69EDA77442"><enum>(ii)</enum><text>Such students' progress towards baccalaureate degree completion and graduation.</text> </clause><clause id="id67C54C8B399C491EA782F75C799DF234"><enum>(iii)</enum><text>Outreach to potential public service job employers for the eligible students awarded grants under this section.</text>
 </clause></subparagraph><subparagraph id="id78841CAB987D414EB1C5716BA3210C4C"><enum>(B)</enum><header>Continuing grant awards to eligible institutions</header><text>The Secretary may continue grant awards to an eligible institution under subsection (c) after the initial 5-year grant period for additional 5-year periods if—</text>
 <clause id="idE9BFE73EB15048179C575588ACFAD724"><enum>(i)</enum><text>the institution complies with the requirements of paragraph (1); and</text> </clause><clause id="id62F1240F6BDC4281A591CC415267D2AC"><enum>(ii)</enum><text>the eligible students awarded grants under this section who are enrolled at the institution have a baccalaureate degree graduation rate that meets or exceeds a rate determined appropriate by the Secretary.</text>
										</clause></subparagraph><subparagraph id="idFC53B9ADDA0746898E6FFECDCF384201"><enum>(C)</enum><header>Discontinuing grant awards to eligible institutions</header>
 <clause id="idBEAA055046AC46E5819CB315D166649E"><enum>(i)</enum><header>In general</header><text>The Secretary may discontinue grant awards to an eligible institution under subsection (c) after the initial 5-year grant period based on the outcome of the biennial reports under subparagraph (A).</text>
 </clause><clause id="idFAC8761C45CC404AA1DA3A5E83E9C9A2"><enum>(ii)</enum><header>Notification</header><text>Prior to the Secretary discontinuing a grant award under clause (i), the Secretary shall notify the institution, prior to the start of the 5th year of the 5-year grant period, in a publically available format, that the institution is, or is potentially, out of compliance with the requirements of the grant award and may have the institution's grant awards discontinued.</text>
 </clause><clause id="id41828D4A9A594AD4AA61D919378325CB"><enum>(iii)</enum><header>Modifications</header><text>In the 5th year of the 5-year grant period, an eligible institution may make modifications to the institution's grant program and appeal to the Secretary for a renewal of the institution's grant.</text>
 </clause><clause id="idF82671E35E9C47469267E409FD9F675B"><enum>(iv)</enum><header>Decision</header><text>The Secretary, prior to the conclusion of the 5-year grant period, shall render a decision on whether to continue grant awards to an eligible institution.</text>
 </clause><clause id="id40CF543375764A35AC66A3663320F2BB"><enum>(v)</enum><header>Remaining responsibility</header><text>If the Secretary discontinues grant awards to an eligible institution under subsection (c), the institution shall be responsible for maintaining academic and student support services and providing the full remaining costs for eligible students awarded a grant under this section prior to such discontinuation to receive their baccalaureate degree debt free.</text>
 </clause></subparagraph></paragraph><paragraph id="idB1C81143F270432F8CE85D14C434EDCE"><enum>(3)</enum><header>Institutional prohibitions</header><text>Each eligible institution that receives a grant under subsection (c) may not—</text> <subparagraph id="id69ACF5288120432383B88FED38C8344A"><enum>(A)</enum><text>use grant funds for administrative purposes; or</text>
 </subparagraph><subparagraph id="id538DCAAA744C48C396723790E6C082E6"><enum>(B)</enum><text>establish different tuition prices between eligible students who receive grants under this section and students who do not receive grants under this section for pursing the same course of study.</text>
									</subparagraph></paragraph></subsection><subsection id="idADB2E4B43E8746A29B5433E07C33CE0F"><enum>(f)</enum><header>Student accountability</header>
								<paragraph id="id6922A032C9DC41D9B0C225673CB66D65"><enum>(1)</enum><header>Enrollment; GPA; service</header>
 <subparagraph id="id9AD3851BD7094CA8AA44A7D5BE89FBDB"><enum>(A)</enum><header>In general</header><text>An eligible student awarded a grant under this section shall—</text> <clause id="id063C45C6AFDC4F5DA15D9E17AA9A75BB"><enum>(i)</enum><text>maintain full-time enrollment in order to complete the student's baccalaureate degree in not more than 2 years; and</text>
 </clause><clause id="id7258C681A2614A88B485E4F580B51ED4"><enum>(ii)</enum><text>maintain satisfactory academic progress, defined as a 3.0 grade point average (GPA) or higher, and meet all other institutional standards for academic progress.</text>
										</clause></subparagraph><subparagraph id="id7860B09C290D491CB325263DA0FD0C5C"><enum>(B)</enum><header>Two weeks of service</header>
 <clause id="id94D08CD0F50E41A5A01449B07F8AA406"><enum>(i)</enum><header>In general</header><text>Except as otherwise provided in this subparagraph, an eligible student awarded a grant under this section shall serve for 80 hours as a participant in a Corporation for National and Community Service national service project for each year the eligible student receives the grant. The eligible institution shall assist in placing the eligible student in such a project relevant to the eligible student’s course of study. Such required hours may be completed at any point during the student's enrollment but shall be completed prior to the date the eligible student receives the student's baccalaureate degree.</text>
 </clause><clause commented="no" id="idF5EC4FC3E4D34875ADF5217D499FB09B"><enum>(ii)</enum><header>Other project</header><text>If an eligible student resides in an area without a local Corporation for National and Community Service national service project available, the student may instead participate in a service project with a community action agency, a local government agency, or an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986.</text>
 </clause><clause commented="no" id="idB769CAA7111947818BDEB258F8E1508C"><enum>(iii)</enum><header>Medical exemption</header><text>The Secretary may grant an eligible student a medical exemption from the service commitment under this subparagraph if the student becomes medically unable to complete the service commitment over the course of the academic year. An eligible student granted such an exemption shall complete the service commitment upon recovery without risking eligibility status in the grant program under this section.</text>
										</clause></subparagraph></paragraph><paragraph id="id9E151DDEA4DE4060B49520CEB45BAD17"><enum>(2)</enum><header>Satisfactory progress</header>
 <subparagraph id="id5FF2DE516B6642C285CC27119035B81D"><enum>(A)</enum><header>After one year</header><text>In the case in which an eligible student awarded a grant under this section does not maintain satisfactory academic progress, as described in paragraph (1)(A)(ii), after the first academic year for which the student received the grant, the student shall—</text>
 <clause id="id2066982A5B3E42198DD30336897A3720"><enum>(i)</enum><text>serve an additional year in a public service job beyond the 3-year commitment upon receiving the student's baccalaureate degree; and</text>
 </clause><clause id="id4C5C84D68B7E4CF6B8343257AA401168"><enum>(ii)</enum><text>receive additional academic supports from the eligible institution in which the student is enrolled.</text>
 </clause></subparagraph><subparagraph id="id616238CBA6034D99B5C0AD77A2A39A37"><enum>(B)</enum><header>After two years</header><text>In the case in which an eligible student awarded a grant under this section does not receive a baccalaureate degree after the second academic year for which the student received the grant, the total of the grant award amount and remaining funds provided by the institution shall be treated as a Federal Direct Unsubsidized Stafford Loan under part D of title IV, and shall be subject to repayment, as described in paragraph (4).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8537338C2D7940FEA09706A17B4218EC"><enum>(C)</enum><header display-inline="yes-display-inline">Appeals</header><text display-inline="yes-display-inline">In the case in which an eligible student awarded a grant under this section does not maintain satisfactory academic progress, as described in paragraph (1)(A)(ii), after the first academic year for which the student received the grant, the student may appeal the decision to serve an additional year, as described in subparagraph (A)(i). The appeal shall be made in writing to the eligible institution and include an academic plan approved by the student’s adviser. The academic plan shall show a clear pathway to graduation within 1 year.</text>
									</subparagraph></paragraph><paragraph id="id2B75069EA1914912BE4D1D210119125B"><enum>(3)</enum><header>Public service job work obligation</header>
 <subparagraph id="idCC3D3E72D30D4522B7B75E440258326F"><enum>(A)</enum><header>In general</header><text>Except as provided in paragraph (2)(A)(i) and subparagraph (C), an eligible student awarded a grant under this section shall work for not less than 3 years in a public service job after receiving the student's baccalaureate degree. Such 3 years (or 4 years, in the case of a scenario described in paragraph (2)(A)(i)) may be consecutive or nonconsecutive but shall be completed not later than 5 years (or 6 years, in the case of a scenario described in paragraph (2)(A)(i)) after the date the student receives the student's baccalaureate degree.</text>
 </subparagraph><subparagraph id="id7E129AE61EDB47F5BF0C5E45B8A3105F"><enum>(B)</enum><header>Notification</header><text>An eligible student awarded a grant under this section shall notify the Department, utilizing a form designed by the Secretary, of the student's compliance or noncompliance with subparagraph (A) annually until such student completes the student's work obligation.</text>
 </subparagraph><subparagraph id="idA9238CED5EEF4245801C1BF8C65A1E3B"><enum>(C)</enum><header>Deferment for graduate school</header><text>The work obligation described in subparagraph (A) of an eligible student awarded a grant under this section who enrolls as a full-time student in a post-baccalaureate degree program not later than 3 years after the date the student receives the student's baccalaureate degree shall be deferred during the period of such full-time enrollment. Any years of service completed prior to full-time enrollment in a post-baccalaureate degree program shall count toward such work obligation.</text>
 </subparagraph></paragraph><paragraph id="id3BD470EA316C4283A303B3BAD5B4A3CC"><enum>(4)</enum><header>Repayment for noncompliance</header><text>In the event that an eligible student awarded a grant under this section fails or refuses to comply with the work obligation as described in paragraph (3), or the student does not receive a baccalaureate degree after the second academic year for which the student received the grant, as described in paragraph (2)(B), the sum of the amounts of any grants received by the student shall, upon a determination of such a failure or refusal in such service obligation or failure to meet satisfactory academic progress, be treated as a Federal Direct Unsubsidized Stafford Loan under part D of title IV, and shall be subject to repayment, together with interest thereon accruing from the date of the grant award, in accordance with terms and conditions specified by the Secretary in regulations under this section.</text>
 </paragraph><paragraph id="id0C5F9FB83D634E0A911096AAA8407095"><enum>(5)</enum><header>Medical exemption</header><text>The Secretary may grant an eligible student awarded a grant under this section a medical exemption—</text> <subparagraph id="idD1FA6FC21FD1498AA72E6059594BB33D"><enum>(A)</enum><text>from the requirement of maintaining satisfactory academic progress under paragraph (1)(A)(ii); or</text>
 </subparagraph><subparagraph id="idF98A4ECC87A84A0F99F2C1E9EF145F14"><enum>(B)</enum><text>from a term or condition of the work obligation of the student if the student becomes medically unable to complete the student's studies or public service job work obligation.</text></subparagraph></paragraph></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="idCAD0C166B85946B5B777B9DB3470E27E" style="OLC"><enum>III</enum><header>Debt-Free Public Service Loan Forgiveness Program</header>
			<section commented="no" display-inline="no-display-inline" id="id61DE2FE427DD43978546118F065339E6"><enum>301.</enum><header>Debt-Free Public Service
			 Loan Forgiveness Program</header>
 <subsection commented="no" display-inline="no-display-inline" id="idB5E46159C88B4E48B76EEB3D146AB730"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 455(m) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(m)</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idA851746337714B978D2556C27AD28387" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id72D6CDB3DEDE454FBEA8E263A1B5A64A"><enum>(5)</enum><header>Debt-Free Public Service Loan Forgiveness Program</header>
 <subparagraph id="id398ac044aa7f4212b4d73af22a815422"><enum>(A)</enum><header>In general</header><text>Beginning after the date of enactment of the <short-title>Strengthening American Communities Act of 2019</short-title>, after the conclusion of each employment period in a public service job, as described in subparagraph (B), the Secretary shall cancel the percent specified in such subparagraph of the total amount due on any eligible Federal Direct Loan made after the date of enactment of the <short-title>Strengthening American Communities Act of 2019</short-title> for a borrower who—</text>
 <clause commented="no" display-inline="no-display-inline" id="idA07747C12D53496EA873BFFB88E8BC5C"><enum>(i)</enum><text>is employed in such public service job;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idA4466F5481604F47A4F1FF5AF289CE87"><enum>(ii)</enum><text>submits an employment certification form described in subparagraph (C);</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idA773376A040641C2AA2D05A6A9510DAF"><enum>(iii)</enum><text>is enrolled in a repayment plan described in paragraph (1)(A); and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id599DD3F8F5C449E9A07EEBFD980B13D4"><enum>(iv)</enum><text>notifies the Department that the borrower seeks loan cancellation under this paragraph.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5CA5D38B2E9042D790873104DF560260"><enum>(B)</enum><header>Percent
 amount</header><text>The percent of a loan that shall be canceled under subparagraph (A) is as follows:</text>
 <clause commented="no" display-inline="no-display-inline" id="id516A3F7C3EDC43BD9B36514163B44145"><enum>(i)</enum><text>In the case of a borrower who completes 2 years of employment in a public service job, 15 percent of the total amount due on the eligible Federal Direct Loan on the date the borrower commenced employment in such public service job.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idA69B38AC72A34637929D98C665063F13"><enum>(ii)</enum><text>In the case of a borrower who completes 4 years of employment in a public service job, 15 percent of the total amount due on the eligible Federal Direct Loan on the date the borrower commenced employment in such public service job.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id9EA2A9C572264D7FAB1D58D695BFD671"><enum>(iii)</enum><text>In the case of a borrower who completes 6 years of employment in a public service job, 20 percent of the total amount due on the eligible Federal Direct Loan on the date the borrower commenced employment in such public service job.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id41DCCFC31B9E49C9A76B5EE28AF63C85"><enum>(iv)</enum><text>In the case of a borrower who completes 8 years of employment in a public service job, 20 percent of the total amount due on the eligible Federal Direct Loan on the date the borrower commenced employment in such public service job.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idC9E5ACADFD5641A997474D69008C108A"><enum>(v)</enum><text>In the case of a borrower who completes 10 years of employment in a public service job, 30 percent of the total amount due on the eligible Federal Direct Loan on the date the borrower commenced employment in such public service job.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id367F0B875CE94309967D8558A1730CEB"><enum>(C)</enum><header>Employment certification form</header>
 <clause commented="no" display-inline="no-display-inline" id="idD8F18A0C13954C7085B171FF24C62553"><enum>(i)</enum><header>In general</header><text>In order to receive loan cancellation under this paragraph, a borrower shall submit to the Secretary an employment certification form that is developed by the Secretary and includes at least self-certification of employment, a separate part for employer certification that indicates the dates of employment, and any additional information required by the Secretary.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idEC5B253063694956A670EFA2A78CB013"><enum>(ii)</enum><header>Deferment</header><text>If a borrower submits to the Secretary the employment certification form described in clause (i), during the period in which the borrower is employed in a public service job for which loan cancellation is eligible under this paragraph, the borrower's eligible Federal Direct Loan shall be placed in deferment.</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB6EC5B940A3E411BA9C6F28CF1DCFE68"><enum>(D)</enum><header>Interest canceled</header><text>If a portion of a loan is canceled under this paragraph for any year, the entire amount of interest on such loan that accrues for such year shall be canceled.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE63C1323F5CF4A70B28BAA20042B044A"><enum>(E)</enum><header>No retroactivity</header><text>A borrower may not receive credit for purposes of loan forgiveness under this paragraph for years of employment in a public service job that occurred before the date of enactment of the <short-title>Strengthening American Communities Act of 2019</short-title>.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8E3FC0604854475AAF8546AA8694A73D"><enum>(F)</enum><header>Leaving public service</header>
 <clause commented="no" display-inline="no-display-inline" id="id74CAE5419B964FF59CB4042CDF8BAE1E"><enum>(i)</enum><header>In general</header><text>If a borrower who receives loan cancellation under this paragraph leaves the public service job, either voluntarily or involuntarily, for which the borrower received loan cancellation before the total amount due on the eligible Federal Direct Loan is canceled under this paragraph, such borrower shall retain eligibility for accelerated loan cancellation under this paragraph for such eligible Federal Direct Loan if the borrower commences employment in a public service job not later than 3 years after the date the borrower left the public service job for which the borrower received loan cancellation.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id6686DF2906F848F2A5ABDA46F8997E86"><enum>(ii)</enum><header>Eligibility status</header><text>If a borrower described in clause (i) commences employment in a public service job within the time period described in clause (i), such borrower shall resume eligibility for accelerated loan cancellation under this paragraph for such eligible Federal Direct Loan. Such borrower upon resumption of eligibility shall be considered to have completed the number of years of employment in a public service job at the last completed loan cancellation period described in subparagraph (B) for such borrower, even if the borrower had actually completed an additional year of employment in a public service job.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idB91FAD68CB3745818006B23D0C0B1CB4"><enum>(iii)</enum><header>Loss of eligibility</header><text>If a borrower described in clause (i) does not commence employment in a public service job within the time period described in clause (i), such borrower shall no longer be eligible for loan cancellation under this paragraph but may be eligible for loan cancellation for such loan under paragraph (1).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id8E4F0B900B6F45AB9B722E32DAFF7F3F"><enum>(b)</enum><header>Notification of program</header><text>The Secretary of Education, in order to inform public servants of the benefits of the debt-free public service loan cancellation program established under section 455(m)(5) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(m)</external-xref>)—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id5EC5BEA6B6704899AFB58C4B7ADDCFF6"><enum>(1)</enum><text>shall make guidance publicly available to the employers of public servants to make public servants aware of such program; and</text>
 </paragraph><paragraph id="id2e89b0d311e74339bc9dd1cd8ec8c059"><enum>(2)</enum><text>is encouraged to work in partnership with State licensing agencies to make recently licensed public servants aware of such program.</text></paragraph></subsection></section></title></legis-body></bill>
