<official-title>To provide access to counsel for unaccompanied alien children.</official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Day in Court for Kids Act of 2019</short-title></quote>.</text> </section> <section id="id43ea4babc8cf49b5bf8cb78257382721"><enum>2.</enum><header>Improving immigration court efficiency and reducing costs by increasing access to legal information</header> <subsection id="idE8F2C47C87724EDE959D378C47A828DE"><enum>(a)</enum><header>Appointment of counsel in removal proceedings; right To review certain documents in removal proceedings</header><text>Section 240(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a(b)</external-xref>) is amended—</text> 
<paragraph id="id79dcb26453694a62bf04ba24b6a5f334"><enum>(1)</enum><text>in paragraph (4)—</text> <subparagraph id="ida4c921e444d04fadb486fcb8accae926"><enum>(A)</enum><text>in subparagraph (A)—</text> 
<clause id="id4E7EB59913FF49859B3CEE8259AAD7BE"><enum>(i)</enum><text>by striking <quote>, at no expense to the Government,</quote>; and</text> </clause> <clause id="id0E90E19D7E674108AE9D6CE03D1D45DA"><enum>(ii)</enum><text>by striking the comma at the end and inserting a semicolon;</text> </clause></subparagraph>
<subparagraph id="id5d2979fe1a2a41fc99612e8385ee919a"><enum>(B)</enum><text>by redesignating subparagraphs (B) and (C) as subparagraphs (D) and (E), respectively;</text> </subparagraph> <subparagraph id="idea3eeaa12fc14ea69e3c014e5870d6be"><enum>(C)</enum><text>by inserting after subparagraph (A) the following:</text> 
<quoted-block display-inline="no-display-inline" id="id60040bbafc024fe782cc097fbe9f5841" style="OLC"> 
<subparagraph id="id6333f915bcba4570a687fd69dfab7b76"><enum>(B)</enum><text>the Attorney General may appoint or provide counsel, at Government expense, to aliens in immigration proceedings;</text> </subparagraph> <subparagraph id="id839CD141F5D347688537A852CEC960D9"><enum>(C)</enum><text>the alien, or the alien’s counsel, not later than 7 days after receiving a notice to appear under section 239(a), shall receive a complete copy of the alien’s immigration file (commonly known as an <quote>A-file</quote>) in the possession of the Department of Homeland Security (other than documents protected from disclosure under section 552(b) of title 5, United States Code);</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph>
<subparagraph id="idD8377C4A24C345ECBE5A1494D2E25CFA"><enum>(D)</enum><text>in subparagraph (D), as redesignated, by striking <quote>, and</quote> and inserting <quote>; and</quote>; and</text> </subparagraph></paragraph> <paragraph id="id849bb91627984e26b2b2436fd3b05217"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="idee46fe7d23e243ad8d6c065421f493b0" style="OLC"> 
<paragraph id="id53ccc7bfcbac4b3c9b570008756bd560"><enum>(8)</enum><header>Failure to provide alien required documents</header><text>A removal proceeding may not proceed until the alien, or the alien’s counsel if the alien is represented—</text> <subparagraph id="id764D23E05D83439B8318C657ADD5C196"><enum>(A)</enum><text>has received the documents required under paragraph (4)(C); and</text> </subparagraph>
<subparagraph id="id94875EACA5FB41C0A5DAD78EE5B6B736"><enum>(B)</enum><text>has been provided at least 10 days to review and assess such documents.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> <subsection id="id76d80cdd651d43d5871b19b48aa8605a"><enum>(b)</enum><header>Clarification regarding the authority of the Attorney General To appoint counsel to aliens in immigration proceedings</header> <paragraph id="idC7931ECA4BD943A188BFABF21E481087"><enum>(1)</enum><header>In general</header><text>Section 292 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1362">8 U.S.C. 1362</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="id23C9DECC19F64160BAC5B4F03D288587" style="OLC"> 
<section id="idF255F3EEAD494DE1A24AC60C8FF5A550"><enum>292.</enum><header>Right to counsel</header> 
<subsection id="id75B06630A3A048A38929624ECE720553"><enum>(a)</enum><header>In general</header><text>Except as provided in subsections (b) and (c), in any removal proceeding and in any appeal proceeding before the Attorney General from any such removal proceeding, the subject of the proceeding shall have the privilege of being represented by such counsel as may be authorized to practice in such proceeding as he or she may choose. This subsection shall not apply to screening proceedings described in section 235(b)(1)(A).</text> </subsection> <subsection commented="no" display-inline="no-display-inline" id="id5B50F8BB38C341E59651B8B2CB7041FF"><enum>(b)</enum><header display-inline="yes-display-inline">Access to counsel for unaccompanied alien children</header> <paragraph commented="no" display-inline="no-display-inline" id="id1F4440E72B48408DAD1984718D5FEF9F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In any removal proceeding and in any appeal proceeding before the Attorney General from any such removal proceeding, an unaccompanied alien child (as defined in section 462(g) of the Homeland Security Act on 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)</external-xref>)) shall be represented by Government-appointed counsel, at Government expense.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idBAAC532BA8024CF1A15FADCAFDD0EADE"><enum>(2)</enum><header>Length of representation</header><text display-inline="yes-display-inline">Once a child is designated as an unaccompanied alien child under paragraph (1), the child shall be represented by counsel at every stage of the proceedings from the child’s initial appearance through the termination of immigration proceedings, and any ancillary matters appropriate to such proceedings even if the child attains 18 years of age or is reunified with a parent or legal guardian while the proceedings are pending.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id7A1866FCD6FC449C99F54A48F30BA957"><enum>(3)</enum><header>Notice</header><text>Not later than 72 hours after an unaccompanied alien child is taken into Federal custody, the alien shall be notified that he or she will be provided with legal counsel in accordance with this subsection.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id77C078EC5CAA40DBAD9746D01033E1D0"><enum>(4)</enum><header>Within detention facilities</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall ensure that unaccompanied alien children have access to counsel inside all detention, holding, and border facilities.</text> </paragraph></subsection> <subsection id="id4a3bfe54892b42828f3335bd17424938"><enum>(c)</enum><header>Pro bono representation</header> <paragraph id="id4f75213773b643698a7592def6003e1d"><enum>(1)</enum><header>In general</header><text>To the maximum extent practicable, the Attorney General shall make every effort to utilize the services of competent counsel who agree to provide representation to such children under subsection (b) without charge.</text> </paragraph>
<paragraph id="id98269434b69c4f38870cc234e24291a2"><enum>(2)</enum><header>Development of necessary infrastructures and systems</header><text>The Attorney General shall develop the necessary mechanisms to identify counsel available to provide pro bono legal assistance and representation to children under subsection (b) and to recruit such counsel.</text> </paragraph></subsection> <subsection id="id869731e5fb0b4313977068869542fba7"><enum>(d)</enum><header>Contracts; grants</header><text>The Attorney General may enter into contracts with, or award grants to, nonprofit agencies with relevant expertise in the delivery of immigration-related legal services to children to carry out the responsibilities under this section, including providing legal orientation, screening cases for referral, recruiting, training, and overseeing pro bono attorneys. Nonprofit agencies may enter into subcontracts with, or award grants to, private voluntary agencies with relevant expertise in the delivery of immigration-related legal services to children in order to carry out this section.</text> </subsection>
<subsection id="id93f1cb7849d74591a7dee84c238cf773"><enum>(e)</enum><header>Model guidelines on legal representation of children</header> 
<paragraph id="id1f6e6b57d9924cf2b17b6a707257343d"><enum>(1)</enum><header>Development of guidelines</header><text>The Executive Office for Immigration Review, in consultation with voluntary agencies and national experts, shall develop model guidelines for the legal representation of alien children in immigration proceedings, which shall be based on the children’s asylum guidelines, the American Bar Association Model Rules of Professional Conduct, and other relevant domestic or international sources.</text> </paragraph> <paragraph id="id32c854d551b6448db3ff2ae66fd8e6bb"><enum>(2)</enum><header>Purpose of guidelines</header><text>The guidelines developed under paragraph (1) shall be designed to help protect each child from any individual suspected of involvement in any criminal, harmful, or exploitative activity associated with the smuggling or trafficking of children, while ensuring the fairness of the removal proceeding in which the child is involved.</text> </paragraph></subsection>
<subsection id="id8c48225096af48c3840f2b2092819cbe"><enum>(f)</enum><header>Duties of counsel</header><text>Counsel provided under this section shall—</text> <paragraph id="ida712a4e1ab144ac4999b8cfe9e19a555"><enum>(1)</enum><text>represent the unaccompanied alien child in all proceedings and matters relating to the immigration status of the child or other actions involving the Department of Homeland Security;</text> </paragraph>
<paragraph id="idbd8a2da2695946f194c4313617df1d22"><enum>(2)</enum><text>appear in person for all individual merits hearings before the Executive Office for Immigration Review and interviews involving the Department of Homeland Security;</text> </paragraph> <paragraph id="id0be81e0c22be497ba65a999fb4aa16da"><enum>(3)</enum><text>owe the same duties of undivided loyalty, confidentiality, and competent representation to the child as is due to an adult client; and</text> </paragraph>
<paragraph id="idac4413340a084a2d89545b0d1b16ea6c"><enum>(4)</enum><text>carry out other such duties as may be proscribed by the Attorney General or the Executive Office for Immigration Review.</text> </paragraph></subsection> <subsection id="id383529F6AF5944F1A890A30B0E1F3AC0"><enum>(g)</enum><header>Savings provision</header><text>Nothing in this section may be construed to supersede—</text> 
<paragraph id="idD428EEA0CB894DFB97559511D80D2F01"><enum>(1)</enum><text>any duties, responsibilities, disciplinary, or ethical responsibilities an attorney may have to his or her client under State law;</text> </paragraph> <paragraph id="idF37CF56FDF474BC68A61EF3E2F8DB43B"><enum>(2)</enum><text>the admission requirements under State law; or</text> </paragraph>
<paragraph id="id9A1335B6301543FDBE4A50B07A65C155"><enum>(3)</enum><text>any other State law pertaining to the admission to the practice of law in a particular jurisdiction.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> <paragraph id="id19d1e211a5b64cb18ae747e803b4e062"><enum>(2)</enum><header>Rulemaking</header><text>The Attorney General shall promulgate regulations to implement section 292 of the Immigration and Nationality Act, as added by paragraph (1), in accordance with the requirements set forth in section 3006A of title 18, United States Code.</text> </paragraph></subsection></section>
<section id="idba2e953d7bcc4b6d8dd917b31f0c6a54"><enum>3.</enum><header>Access by counsel at detention facilities</header><text display-inline="no-display-inline">The Secretary of Homeland Security shall provide access to counsel for all aliens detained in a facility under the supervision of U.S. Immigration and Customs Enforcement, U.S. Customs and Border Protection, or the Department of Health and Human Services, or in any private facility that contracts with the Federal Government to house, detain, or hold aliens.</text> </section> <section id="id331f0af39d224c30853120991d17c6a3"><enum>4.</enum><header>Report on access to counsel</header> <subsection id="id2f81a59a140a4822aa3d094e8c037b34"><enum>(a)</enum><header>Report</header><text>Not later than December 31 of each year, the Secretary of Homeland Security, in consultation with the Attorney General, shall prepare and submit a report to the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name> and the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name> regarding the extent to which aliens described in section 292(b) of the Immigration and Nationality Act, as added by section 2(b), have been provided access to counsel.</text> </subsection>
<subsection id="idd38eb9bb69964f5d9ce576501fa5594c"><enum>(b)</enum><header>Contents</header><text>Each report submitted under paragraph (a) shall include, for the immediately preceding 1-year period—</text> <paragraph id="ide07f8f7851eb4a3681bd796257830f8d"><enum>(1)</enum><text>the number and percentage of aliens described in section 292(b) of the Immigration and Nationality Act, as added by section 2(b), who were represented by counsel, including information specifying—</text> 
<subparagraph id="id6AE3B14FB4FF4555AAFEA79BD2A0400B"><enum>(A)</enum><text>the stage of the legal process at which each such alien was represented;</text> </subparagraph> <subparagraph id="id57E5E5B42D6D41118F74BD8A43FBE032"><enum>(B)</enum><text>whether the alien was in government custody; and</text> </subparagraph>
<subparagraph id="idA6A4568B4C4F4439926E7D6BF7353FF2"><enum>(C)</enum><text>the nationality and ages of such aliens; and</text> </subparagraph></paragraph> <paragraph id="id45d5a4e817d240afbe70e8fc5e41ab07"><enum>(2)</enum><text>the number and percentage of aliens who received legal orientation presentations, including the nationality and ages of such aliens.</text> </paragraph></subsection></section>
<section id="id86FA0C083DAF48E1959FC60E4EC3C598"><enum>5.</enum><header>Authorization of appropriations</header> 
<subsection id="id55A15008149E4D3BBC99D5870041928A"><enum>(a)</enum><header>In general</header><text>There is authorized to be appropriated to the Executive Office for Immigration Review of the Department of Justice such sums as may be necessary to carry out this Act.</text> </subsection> <subsection id="idf8ec11af2caf4a9a9ab01fee5272ac37"><enum>(b)</enum><header>Budgetary effects</header><text>The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the Senate Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></subsection></section>
