	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="id5FF304EDC8594127B34C7403CB88860F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Trafficking Victims Protection and Welfare Act of 2019</short-title></quote>.</text> </section><section id="id814F6D6A3B6D4E2492F6584D9FB5E46C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="id1809F7A2F3CB47BC9267D004D5285F77"><enum>(1)</enum><header>Apprehended parent or legal guardian</header><text>The term <term>apprehended parent or legal guardian</term> means an individual who is—</text> <subparagraph id="id357EFD8EEF8F4D4A8D4508A81055A48F"><enum>(A)</enum><text>the parent or legal guardian of a child; and</text>
 </subparagraph><subparagraph id="id2E693182459441CAAF821B53556C385B"><enum>(B)</enum><text>apprehended by the Secretary or the personnel of a cooperating entity.</text>
 </subparagraph></paragraph><paragraph id="id77A0EBAA38D14CE6844F59AC37F17CBC"><enum>(2)</enum><header>Border</header><text>The term <term>border</term> means an international border of the United States.</text> </paragraph><paragraph id="id3DAA44F07CF640ABB595CABC7C97A8DB"><enum>(3)</enum><header>Child</header><text>The term <term>child</term> means an individual who—</text>
 <subparagraph id="idF4618A74F2FA4673A9905D4919ACE225"><enum>(A)</enum><text>has not reached the age of 18 years; and</text> </subparagraph><subparagraph id="id968EB94AB62547FC9611E36AE96F1AAC"><enum>(B)</enum><text>has no permanent immigration status in the United States.</text>
 </subparagraph></paragraph><paragraph id="idE8D9185CF980405EB1EC4C251AEF3BB4"><enum>(4)</enum><header>Child welfare professional</header><text>The term <term>child welfare professional</term> means an individual who—</text> <subparagraph id="id6A671D4DDED74CB694C0535601E862B7"><enum>(A)</enum><text>is licensed in social work by the State welfare agency, and, if applicable, county welfare agency, of the State and county in which the port of entry or Border Patrol station at which such individual available pursuant to section 3 is located;</text>
 </subparagraph><subparagraph id="idE06726FAA011498AA8F5ABA8C5F57B1B"><enum>(B)</enum><text>has direct experience working with children; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7CDAABC46D914584BC7BC82E9C7BA5E3"><enum>(C)</enum><text>is proficient in one or more of the most common languages spoken by children apprehended at the applicable port of entry or Border Patrol station.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9190CA68CB564CEFA6AB9859BCAAA9F7"><enum>(5)</enum><header>Commissioner</header><text>The term <term>Commissioner</term> means the Commissioner of U.S. Customs and Border Protection.</text> </paragraph><paragraph id="id0EA114F416154B8EBCD8C3F64DA84564"><enum>(6)</enum><header>Cooperating entity</header><text>The term <term>cooperating entity</term> means a State or local entity acting pursuant to an agreement with the Secretary.</text>
 </paragraph><paragraph id="idD279F5AAE40D49EB9AE85191C0EEA232"><enum>(7)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Homeland Security.</text> </paragraph><paragraph id="id8a8a149cd7384a85bb9468047dfedb02"><enum>(8)</enum><header>Expert in child development</header><text>The term <term>expert in child development</term> means an individual who has significant education and expertise on infant, child, and adolescent development, and on the effects of trauma on children.</text>
 </paragraph><paragraph id="id5a4de743123b47e9924d4fc85d5e8b4f"><enum>(9)</enum><header>Expert in child welfare</header><text>The term <term>expert in child welfare</term> means an individual who has—</text> <subparagraph id="id5F94C0D5B20B42AD8D4DCBAEE22FBA18"><enum>(A)</enum><text>knowledge of Federal and State child welfare laws and standards; and</text>
 </subparagraph><subparagraph id="id9377CC00FD1242EBAD9B76E138A288E3"><enum>(B)</enum><text>not less than 15 years of experience in the field of child and adolescent development or child welfare.</text>
 </subparagraph></paragraph><paragraph id="id81075afc42284cee9d8cdfcd8f074ec3"><enum>(10)</enum><header>Expert in pediatric medicine</header><text>The term <term>expert in pediatric medicine</term> means—</text> <subparagraph id="id15D9AC1400D144D596468BC1A57B2BCC"><enum>(A)</enum><text>an individual who is board-certified in pediatric medicine in one or more States; or</text>
 </subparagraph><subparagraph id="idDC1E3241E2B64554948B4A7476EBAA63"><enum>(B)</enum><text>an individual with an advanced degree in pediatric medicine on the faculty of an institution of higher education in the United States.</text>
 </subparagraph></paragraph><paragraph id="idEA754F88AF0B4FD58F6189E0A04ADC5B"><enum>(11)</enum><header>Migration deterrence program</header><text>The term <term>migration deterrence program</term> means an action relating to the repatriation or referral for prosecution of one or more individuals apprehended by the Secretary or a cooperating entity for a suspected or confirmed violation of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.).</text>
 </paragraph><paragraph id="idD50972FE5BBF41CA9C46D446676F413F"><enum>(12)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1F98E064A35345A1ABA7ED3FB0CB5EC3"><enum>(13)</enum><header>Unaccompanied alien child</header><text>The term <term>unaccompanied alien child</term> has the meaning given the term in section 462(g) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/279">6 U.S.C. 279(g)</external-xref>).</text>
			</paragraph></section><section id="id4B4024D58E874129A4C7A9C04E63F7EE"><enum>3.</enum><header>Child welfare at the border</header>
 <subsection id="id20A2E55F955C47229F5B11EEAA1F2ACF"><enum>(a)</enum><header>Guidelines</header><text>The Secretary, in consultation with the Secretary of Health and Human Services, experts in child development, experts in child welfare, experts in pediatric medicine, and the American Bar Association Center on Children and the Law, shall develop guidelines for the treatment of children in the custody of the Commissioner.</text>
 </subsection><subsection id="id3E7B670596DE49E188C81C6B861ED171"><enum>(b)</enum><header>Mandatory training</header><text>The Secretary, in consultation with the Secretary of Health and Human Services, shall—</text> <paragraph id="id855a3a2e2d30464aba2916fb938c8a47"><enum>(1)</enum><text>require all U.S. Customs and Border Protection personnel, and cooperating entity personnel, who have contact with a child at a port of entry or Border Patrol station to undergo appropriate training, which shall include live training, on—</text>
 <subparagraph id="idE312F6D3C6B54796AA86792C1676E6E7"><enum>(A)</enum><text>the applicable legal authorities, policies, practices, and procedures relating to children; and</text>
 </subparagraph><subparagraph id="id500D3D019B3A4BA499B3CDD408252B2D"><enum>(B)</enum><text>child development, trauma, and the manner in which trauma affects the health and behavior of children; and</text>
 </subparagraph></paragraph><paragraph id="idecb6d557a8154e629d2671aaceeb927f"><enum>(2)</enum><text>require U.S. Customs and Border Protection personnel, not less frequently than annually, to undertake continuing training on—</text>
 <subparagraph id="idB40132682AF942CBA4C5B4E28428D21D"><enum>(A)</enum><text>identifying and responding to common signs and symptoms of medical distress in children;</text> </subparagraph><subparagraph id="idE30927811B0B4EAE864C86F2C72AE97B"><enum>(B)</enum><text>best practices with respect to the guidelines developed under subsection (a); and</text>
 </subparagraph><subparagraph id="id7374DD8CB25042108C08B847DD9BFB40"><enum>(C)</enum><text>changes in the legal authorities, policies, and procedures described in paragraph (1)(A).</text>
					</subparagraph></paragraph></subsection><subsection id="id7732A64E8FD24930B757A42A1B78B7CA"><enum>(c)</enum><header>Qualified resources</header>
 <paragraph id="idFEC1A7B9532D48A783BD23BFB8A32535"><enum>(1)</enum><header>In general</header><text>In accordance with subsection (d), the Secretary shall provide resources and staff, including child welfare professionals, who are adequately trained and qualified to address the needs of children at each port of entry and Border Patrol station.</text>
 </paragraph><paragraph id="id5116fa535ad5481abdc379ad71ebde72"><enum>(2)</enum><header>Sufficient staffing</header><text>The Secretary shall ensure that sufficient qualified child welfare professionals and qualified experts in pediatric medicine are available at each port of entry and Border Patrol station to accomplish the duties described in this section without prolonging the time children and apprehended parents and legal guardians remain in the custody of the Commissioner.</text>
 </paragraph><paragraph id="id9B957C93508B45E99400642F1A05EFF8"><enum>(3)</enum><header>Child welfare expertise</header><text>The Secretary, in consultation with the Secretary of Health and Human Services, shall hire, or seek to enter into contracts with, independent child welfare professionals in order to do the following:</text>
 <subparagraph id="idAC1688AF78244B81A4C90D55EC127EA6"><enum>(A)</enum><text>To provide child welfare expertise on-site on a full-time basis at any port of entry or Border Patrol station that has had not fewer than 25 children in custody—</text>
 <clause id="idBA859092A4914C158008EF7D9E458806"><enum>(i)</enum><text>on any day during the preceding fiscal year; or</text> </clause><clause commented="no" id="id7E6E9BEAC21F4913AAC6EFB8D227E11E"><enum>(ii)</enum><text>during the current fiscal year, based on a review of monthly statistical reports during the current fiscal year.</text>
 </clause></subparagraph><subparagraph id="id864be000e5634e1bbce58fb195b03b8c"><enum>(B)</enum><text>To provide child welfare expertise by telephone on an on-call basis, and on-site as necessary, to U.S. Customs and Border Protection staff at any port of entry or Border Patrol station that is not described in subparagraph (A).</text>
 </subparagraph><subparagraph id="id414A56364D914E08A4AF7AA7F43210DC"><enum>(C)</enum><text>With respect to a port of entry or Border Patrol station that is described in subparagraph (A) but is without on-site expertise as required by such subparagraph during a period of not more than 90 days in which the Secretary, in consultation with the Secretary of Health and Human Services, is in the process of hiring or seeking to enter into a contract with an onsite independent child welfare professional, to provide child welfare expertise by telephone on an on-call basis to U.S. Customs and Border Protection staff.</text>
					</subparagraph></paragraph></subsection><subsection id="ida48b69f172d94856abc9aac9fcc157fe"><enum>(d)</enum><header>Child welfare professionals and experts in pediatric medicine</header>
 <paragraph id="id6b06cfea5e8e4c3f9387930b6d0b4b03"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Secretary of Health and Human Services, shall ensure the availability at each port of entry and Border Patrol station of not fewer than—</text>
 <subparagraph id="id95040BCAA7004178A79516F0D2AD043E"><enum>(A)</enum><text>one qualified child welfare professional with expertise in culturally competent, trauma-centered, and developmentally appropriate interviewing skills; and</text>
 </subparagraph><subparagraph id="id849E07851E714CDEA762D3DEB45DBD1A"><enum>(B)</enum><text>one qualified expert in pediatric medicine.</text> </subparagraph></paragraph><paragraph id="idB03B5042B0D94DC09A5237D7E7977048"><enum>(2)</enum><header>Medical assessments</header><text>On obtaining custody of a child, the Commissioner shall ensure that the child undergoes a medical assessment carried out by, or in consultation with, the expert in pediatric medicine at the applicable port of entry or Border Patrol Station, in accordance with the guidelines developed under subsection (a).</text>
 </paragraph><paragraph commented="no" id="idF2611BE0F6724117B53C96E9D2C05060"><enum>(3)</enum><header>Interpreter required</header><text>In the case of a child welfare professional or an expert in pediatric medicine at a port of entry or Border Patrol station who does not speak the language of a child in custody at such port of entry or station, the Secretary shall provide an interpreter.</text>
 </paragraph><paragraph id="idc6eac139130c4a0b88cb3ad4b5a77a87"><enum>(4)</enum><header>Duties</header><text>A child welfare professional described in paragraph (1)(A) shall—</text> <subparagraph id="idbef5a2fbaf684c5fa8a9ccb352f4de64"><enum>(A)</enum><text>ensure that—</text>
 <clause id="id0501FAB870DC493783384E4CE29D8FA8"><enum>(i)</enum><text>any allegation of abuse or mistreatment of a child in the custody of the Commissioner is referred to the appropriate Federal and State authorities;</text>
 </clause><clause id="idF0BA8763607441348BC9B59B192DB15E"><enum>(ii)</enum><text>any investigation of an allegation described in clause (i)—</text> <subclause id="id58083D76395646949F1C50E513CFA5DD"><enum>(I)</enum><text>receives support from the child welfare professional, who shall follow up on the referral under that clause and coordinate with the investigation until the completion of the investigation; and</text>
 </subclause><subclause id="id0D36B20509FF402CA58995F23EB6C30E"><enum>(II)</enum><text>is conducted by a multidisciplinary team that uses a trauma-informed approach to investigation, such as Children's Advocacy Centers, to the maximum extent practicable; and</text>
 </subclause></clause><clause id="idFAEF6E6BDBD34756B1B3B378F5826746"><enum>(iii)</enum><text>the Commissioner and the Director of the Office of Refugee Resettlement comply with applicable child abuse reporting laws, including by—</text>
 <subclause id="id87e9d19d382a4b63b8f2174502e19735"><enum>(I)</enum><text>ensuring that children in such custody have access to applicable complaint mechanisms to report abuse or misconduct;</text>
 </subclause><subclause id="idb96b0cf36a4b4edea463c43d17a2ca9e"><enum>(II)</enum><text>reporting any allegation of abuse or mistreatment to—</text> <item id="id5BEACC5699A9454F85B9401990A7C5CB"><enum>(aa)</enum><text>the applicable Federal and State authorities;</text>
 </item><item id="idA432590BEC1B4C24B6AE9A14F0BB4CD1"><enum>(bb)</enum><text>the Office of Inspector General of the Department;</text> </item><item id="id36BCDD5B200644F49F17552C562767E8"><enum>(cc)</enum><text>the Office for Civil Rights and Civil Liberties of the Department;</text>
 </item><item id="idC582B46DEB4F482EA465C9081C4C89D3"><enum>(dd)</enum><text>the Internal Affairs Office of U.S. Customs and Border Protection; and</text> </item><item id="idBBB41AACBCC54956A05E8ADE10DDFA81"><enum>(ee)</enum><text>the Office of Refugee Resettlement;</text>
 </item></subclause><subclause id="idd937d6061791447087ac32de7350929f"><enum>(III)</enum><text>providing notice to federally subcontracted legal service providers in the applicable geographical area with respect to any child in such custody who has made an allegation of abuse or mistreatment; and</text>
 </subclause><subclause id="idBB904554D1F640E0B2084F4BA28FAF75"><enum>(IV)</enum><text>directing the legal service providers described in subclause (III) to relevant information relating to the availability of immigration and administrative relief for individuals with pending civil rights complaints;</text>
 </subclause></clause></subparagraph><subparagraph id="id07f0d42ddd444f92855968ed704fe443"><enum>(B)</enum><text>conduct screening of each child in such custody in accordance with section 235(a)(4) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(a)(4)</external-xref>);</text>
 </subparagraph><subparagraph id="id685b34e322e5473ab58b464a01f8ee6b"><enum>(C)</enum><text>with respect to a child who may meet the notification and transfer requirements under subsections (a) and (b) of section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232</external-xref>), including a child for whom a determination cannot be made, notify the Secretary and the Director of the Office of Refugee Resettlement of the presence of such child at the port of entry or Border Patrol station;</text>
 </subparagraph><subparagraph id="id830d6544b9624e2b971196ef0bf873e3"><enum>(D)</enum><text>provide to the Director of U.S. Immigration and Customs Enforcement a best interest placement recommendation for each accompanied child and family that—</text>
 <clause id="id2ED72E53362A4D7A95AA8CA02BA4F5D4"><enum>(i)</enum><text>considers—</text> <subclause id="idA506B2C49C2346BA94736C9071E760A2"><enum>(I)</enum><text>the best interests of the child; and</text>
 </subclause><subclause id="id25E1998F583A4BFDA9DF05F43FBBC233"><enum>(II)</enum><text>applicable law; and</text> </subclause></clause><clause id="idC6FD1D1CEE2C4B26B61A8514437DCDB4"><enum>(ii)</enum><text>favors a policy of release;</text>
 </clause></subparagraph><subparagraph id="id6c65b4144bd64ca1b56f21ed6d4d534e"><enum>(E)</enum><text>interview any adult relative accompanying a child, including any sibling, grandparent, aunt, uncle, or cousin of the child;</text>
 </subparagraph><subparagraph id="id4981385f81b14e41a92e72dd7f4155c5"><enum>(F)</enum><text>for each unaccompanied alien child in such custody, provide to the Director of the Office of Refugee Resettlement—</text>
 <clause id="id36642AFB4EBB48FA9F28EA25AA8924FC"><enum>(i)</enum><text>an initial family relationship and trafficking assessment, which shall be conducted in accordance with the timeframe under subsections (a)(4) and (b)(3) of section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232</external-xref>); and</text>
 </clause><clause id="id2538496CA5B240BE8DB34295CD9D4F40"><enum>(ii)</enum><text>recommendations for the initial placement of the child;</text> </clause></subparagraph><subparagraph id="id6e1158c0d93c4b0a9b67eca775542668"><enum>(G)</enum><text>pursuant to procedures developed by the Secretary, maintain the best interests of children in any migration deterrence program for family units carried out at a border, including by—</text>
 <clause id="id4ffaa38cab7847308ea08efc09ed4ed1"><enum>(i)</enum><text>inquiring whether a child is traveling with a parent, sibling, or legal guardian;</text> </clause><clause id="id87d7da7c042246e5ba7429f53f324a1e"><enum>(ii)</enum><text>ascertaining whether the detention or removal from the United States of an apprehended parent or legal guardian of a child presents a humanitarian concern or a concern relating to the physical safety of the apprehended parent or legal guardian;</text>
 </clause><clause id="id9016E326D9454878AD577C2476657A47"><enum>(iii)</enum><text>in the case of a family separation, ensuring that—</text> <subclause id="id9DFD2E5B7EE74917928F018F8D3A5EF5"><enum>(I)</enum><text>each member of the family is provided with a telephone number for each other member of the family;</text>
 </subclause><subclause id="id689825E7C3E14B5BA22D344BE365E47F"><enum>(II)</enum><text>the apprehended parent or legal guardian is afforded the opportunity to speak with the child of the apprehended parent or legal guardian not fewer than three times weekly, including not fewer than 1 video conference;</text>
 </subclause><subclause id="idCEFA5D5296E84BE88403E9CA23A3B0AE"><enum>(III)</enum><text>for each child of the apprehended parent or legal guardian, the apprehended parent or legal guardian—</text>
 <item id="id67E9ADC30C1E40F49DB7E8F9D13CF337"><enum>(aa)</enum><text>knows—</text> <subitem id="id8C80453F00C249D1B9AE7F24632740E8"><enum>(AA)</enum><text>the location of the child; and</text>
 </subitem><subitem id="id3F66745F50B44108A2FCC84ED0C6CEA3"><enum>(BB)</enum><text>the date and location of each scheduled immigration court proceeding of the child; and</text> </subitem></item><item id="id65BCCF9688A3449CBFE53828BCD2B71C"><enum>(bb)</enum><text>is provided with updated information if the location of the child or a scheduled immigration court proceeding of the child changes;</text>
 </item></subclause><subclause id="id92113F9A19FC43EBB3E5AF2673BC267F"><enum>(IV)</enum><text>the location and contact information for the apprehended parent or legal guardian is maintained on file;</text>
 </subclause><subclause id="id75A1D06AC9DB4F1C8BD10B13A7FD2EAE"><enum>(V)</enum><text>before separation, each child is provided with an opportunity to say goodbye to the apprehended parent or legal guardian; and</text>
 </subclause><subclause id="id5826B2889D374D88AF1E18BC50B7B2B0"><enum>(VI)</enum><text>with respect to the health of the child, the apprehended parent or legal guardian—</text> <item id="idA6F99AA2925F4C369F72624E527132D2"><enum>(aa)</enum><text>is able, before separation, to communicate to personnel of the Department the medical history and any known illness of the child; and</text>
 </item><item id="idB10357E977F2442CA253D86D28D706C3"><enum>(bb)</enum><text>is informed of any medical treatment administered to the child, including psychotropic drugs, during the period in which the child is in the custody of the Director of the Office of Refugee Resettlement; and</text>
 </item></subclause></clause><clause id="id5136dc87f37343ddbdddf2dfe0f0c13d"><enum>(iv)</enum><text>ensuring that, with respect to a decision relating to the removal from the United States or referral for prosecution of an apprehended parent or legal guardian—</text>
 <subclause id="idC23209112DA24B148638E54299B9BB49"><enum>(I)</enum><text>consideration is given to—</text>
 <item id="id71001a4d41e34d93a428f1126bb7a07c"><enum>(aa)</enum><text>the best interests of the child of the apprehended parent or legal guardian;</text> </item><item id="id1f2fa15843f44a8e89da1d454af02dda"><enum>(bb)</enum><text>family unity, to the maximum extent possible; and</text>
 </item><item id="id67ea11d70ec649a5a96c5acada8201c9"><enum>(cc)</enum><text>any other public interest factor, including a humanitarian concern and a concern relating to the physical safety of the apprehended parent or legal guardian; and</text>
 </item></subclause><subclause id="id75931D82AA1D418BAF652AC1D8C14877"><enum>(II)</enum><text>the apprehended parent or legal guardian and the child have access to legal counsel; and</text> </subclause></clause></subparagraph><subparagraph id="idca6a92ab238e42ad848ec2ba71d2e4c8"><enum>(H)</enum><text>coordinate with the Consulate of Mexico to ensure the safe repatriation of any child who is a citizen of Mexico.</text>
 </subparagraph></paragraph><paragraph id="id2477564efa48410e8bb375df8b38472f"><enum>(5)</enum><header>Preservation of confidentiality</header><text>Each child welfare professional shall maintain the privacy and confidentiality of all information gathered in the course of providing care, custody, placement, and follow-up services to a child pursuant to this subsection, consistent with the best interest of the child, by not disclosing such information to other Federal agencies or nonparental third parties unless such disclosure—</text>
 <subparagraph id="idb41da0e42a304f7282e8ef0ad388063c"><enum>(A)</enum><text>is in the best interest of the child;</text> </subparagraph><subparagraph id="id19501D31782E49949EC5693F845206CF"><enum>(B)</enum><text>is in writing;</text>
 </subparagraph><subparagraph id="id3CCC98CC80844884B0228755A43554C0"><enum>(C)</enum><text>includes an explanation of the justification for the disclosure;</text> </subparagraph><subparagraph id="id70CD000740214F37B5E646F1D8CBD8C0"><enum>(D)</enum><text>is included in the file of the child; and</text>
 </subparagraph><subparagraph id="id6d6b2809d3af4353997a349596fa2abe"><enum>(E)</enum><text>is—</text> <clause id="idAEF1A4EB2F1F4595BF92435077432766"><enum>(i)</enum><text>authorized by the child or an approved sponsor of the child, in accordance with section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232</external-xref>) and the Health Insurance Portability and Accountability Act (<external-xref legal-doc="public-law" parsable-cite="pl/104/191">Public Law 104–191</external-xref>; 110 Stat. 1936); or</text>
 </clause><clause id="idb4c18681902447469a2a7af859a633b0"><enum>(ii)</enum><text>provided to a duly recognized law enforcement entity to prevent imminent and serious harm to another individual.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="id48ddcd5694ca4926bf308dd8c2aa0f1f"><enum>(e)</enum><header>Prohibition on separation</header><text>The Secretary may not remove a child from a parent or legal guardian solely for a purpose as follows:</text>
 <paragraph id="id71A4DD5C80564E89A2279FBA3E483E9C"><enum>(1)</enum><text>The purpose of furthering the policy objective of deterring individuals from migrating to the United States.</text>
 </paragraph><paragraph id="idE50EFBC1064D4383AFB065120ED0E54F"><enum>(2)</enum><text>The purpose of furthering the policy objective of promoting compliance with the immigration laws.</text> </paragraph></subsection><subsection id="id64025FF38E89487AA81199048EA232E2"><enum>(f)</enum><header>Family unit tracking number</header> <paragraph id="id6279D0E5CCA143B99CD60A96A8B3C61B"><enum>(1)</enum><header>In general</header><text>The Secretary shall assign a family unit tracking number to each member of an apprehended family unit, including—</text>
 <subparagraph id="id95BF492BEFEB46D697D483566F95C2A4"><enum>(A)</enum><text>an apprehended spouse;</text> </subparagraph><subparagraph id="idEEF8396C143147538EDB568BAAC21D17"><enum>(B)</enum><text>an apprehended parent or legal guardian;</text>
 </subparagraph><subparagraph id="id391FFE75D52A41418FD21F9DA20B4921"><enum>(C)</enum><text>a child of an apprehended parent or legal guardian; and</text> </subparagraph><subparagraph id="id55AB25029E604311A3D4786FADA3E44E"><enum>(D)</enum><text>each member of a sibling group.</text>
 </subparagraph></paragraph><paragraph id="idfd9d1fa474324717808ac0b618780329"><enum>(2)</enum><header>Requirements</header><text>The Secretary shall ensure that a family unit tracking number—</text> <subparagraph id="idE79D36DAD6824029950E8662D2178CE5"><enum>(A)</enum><text>is transferrable;</text>
 </subparagraph><subparagraph id="idEC7ACC5F414D48F989E53D6B6F5F2153"><enum>(B)</enum><text>may be shared easily among the data systems of—</text> <clause id="idDE0AC8BF8926499A9CEC11BEEDD918D3"><enum>(i)</enum><text>U.S. Customs and Border Protection;</text>
 </clause><clause id="id03B57D1F5F6C42DDB77044B3FD24E611"><enum>(ii)</enum><text>U.S. Immigration and Customs Enforcement; and</text> </clause><clause id="idDAB6B2777B504A29A76D006BDAADF274"><enum>(iii)</enum><text>the Office of Refugee Resettlement; and</text>
 </clause></subparagraph><subparagraph id="id089AE4FFEAF94BD4BF8216B5A70968C9"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="idB428E1D6B6AF43C9AEC9DFBA261EA8E7"><enum>(i)</enum><text>is included on the paperwork of each member of an apprehended family unit; and</text> </clause><clause id="id219064BAEDA1485A96956754D763E9D7" indent="up1"><enum>(ii)</enum><text>is not deleted or altered.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="id90CE617A1D204824A75AEAF04877A3CD"><enum>(g)</enum><header>Monitoring</header><text>The Secretary shall—</text> <paragraph id="id460CF7D04774491F9DF12E1260B36F36"><enum>(1)</enum><text>allow nongovernmental organizations and State and local child welfare agencies in the jurisdiction in which an apprehended child is located to conduct not less than one monthly unannounced, independent inspection of any Department facility that houses one or more children; and</text>
 </paragraph><paragraph id="id3CD4226513634057999595B112146A14"><enum>(2)</enum><text>in consultation with one or more child welfare professionals and 1 or more experts in pediatric medicine, for the purpose of human rights monitoring, develop procedures to provide nongovernmental organizations regular and full access to any facility in which one or more children is housed.</text>
				</paragraph></subsection><subsection id="id4b0cae39af0d49f9bb67e2accedf701d"><enum>(h)</enum><header>Report</header>
 <paragraph id="id03AA9CBB87374A7DA72A72122C131594"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of the enactment of this Act, and every fiscal quarter thereafter, the Secretary shall submit to the Committee on the Judiciary, the Committee on Homeland Security and Governmental Affairs, and the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on the Judiciary, the Committee on Oversight and Reform, and the Committee on Education and Labor of the House of Representatives a report that, for the preceding fiscal quarter—</text>
 <subparagraph id="ideee2abc7245e4ae88b530e048ee322a5"><enum>(A)</enum><text>describes the procedures used by child welfare professionals under this section to screen unaccompanied alien children and children accompanied by a parent or legal guardian;</text>
 </subparagraph><subparagraph id="id2bd85d0f09ce498586d744dc618c15df"><enum>(B)</enum><text>assesses the effectiveness of such screenings;</text> </subparagraph><subparagraph id="id31fc1204073a4d24b299bb7b79d0fa02"><enum>(C)</enum><text>includes data on all children screened by child welfare professionals under this section, including—</text>
 <clause id="id04E7668CAD7B427CA7A2FABAE8EC0C22"><enum>(i)</enum><text>the number and location of children in the physical custody of the Department;</text> </clause><clause id="id0c7fc56259df469dad9f2f334fb3ee72"><enum>(ii)</enum><text>the number of children transferred to the custody of the Secretary of Health and Human Services;</text>
 </clause><clause id="id9739372db6ac40c19236103f6ce6835c"><enum>(iii)</enum><text>the number of children apprehended together with a parent or legal guardian;</text> </clause><clause id="id53eef0969d6c42b6ab415516be015f5c"><enum>(iv)</enum><text>the number of children separated from a parent or legal guardian by the Department and the reason for such separation; and</text>
 </clause><clause id="id764a7761d3e549ffb3642e0df6d34f0f"><enum>(v)</enum><text>the number of children removed from the United States and the countries of nationality of such children; and</text>
 </clause></subparagraph><subparagraph id="id17D3B9CA80384B65BEB2A604A97A4CA5"><enum>(D)</enum><text>includes documentation of—</text> <clause id="id18240621db9d40508a490ad16eaf9e2c"><enum>(i)</enum><text>compliance with the guidelines developed pursuant to this section;</text>
 </clause><clause id="idbccc640fe82f492893ef0b1e844cf3aa"><enum>(ii)</enum><text>instances of noncompliance with such guidelines; and</text> </clause><clause id="id3333a1a74e5d4dcbae99eb964d521c51"><enum>(iii)</enum><text>actions taken to correct noncompliance with such guidelines.</text>
 </clause></subparagraph></paragraph><paragraph id="id396FE163443E4BA1838AEC3E1CEC6656"><enum>(2)</enum><header>Limitation</header><text>The data under paragraph (1)(C) shall not include the personally identifiable information of any child.</text>
 </paragraph></subsection><subsection id="id04fba1573c4a446cb370366a8e741258"><enum>(i)</enum><header>Immediate notification</header><text>With respect to a child in the custody of the Secretary, to effectively and efficiently coordinate the transfer of the child to and placement of the child with the Director of the Office of Refugee Resettlement, the Secretary shall notify the Director of the Office of Refugee Resettlement as soon as practicable, but not later than 48 hours after the time at which the Secretary encounters the child.</text>
			</subsection><subsection id="idadc0478dc00644d08e77f54087ee25d6"><enum>(j)</enum><header>Standards of care for short-Term custody of children</header>
 <paragraph id="id2e17806d45c44a00aa4bcec9942a5b95"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary, in consultation with the head of the Office for Civil Rights and Civil Liberties of the Department, shall promulgate regulations establishing basic standards of care for the short-term custody of children by the Commissioner.</text>
 </paragraph><paragraph id="id72617da4eede4a44b27e3e19cff76684"><enum>(2)</enum><header>Requirements</header><text>The regulations promulgated pursuant to paragraph (1) shall ensure that all children in the custody of the Commissioner, while in such custody—</text>
 <subparagraph id="id8129bc8422284083bc704158c1bc81ec"><enum>(A)</enum><text>receive a health interview, a medical assessment, and all necessary medical treatment, including emergency medical care, as necessary;</text>
 </subparagraph><subparagraph id="id2661c8dadca748c4884d36a45658c7b7"><enum>(B)</enum><text>receive emergency medical and mental health care in compliance with section 8(c) of the Prison Rape Elimination Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/42/15607">42 U.S.C. 15607(c)</external-xref>), as necessary, including in any case in which a child is at risk of harming himself or herself or others;</text>
 </subparagraph><subparagraph id="id15a00077a9984b7da10e5b67d137213a"><enum>(C)</enum><text>are provided—</text> <clause id="id48FCB52B4012458D9CB880A41BE5F1EB"><enum>(i)</enum><text>continual access to potable water;</text>
 </clause><clause id="idc9a69e9e39e4441cbb1427a3a8f61976"><enum>(ii)</enum><text>a climate-appropriate environment;</text> </clause><clause id="idf69ef6b2f3f94739969ad2dc6ad90136"><enum>(iii)</enum><text>climate-appropriate clothing and shoes;</text>
 </clause><clause id="id2f123ace14cd46beb9be342092bbb0b6"><enum>(iv)</enum><text>access to bathroom facilities and hygiene items, including soap, feminine hygiene products, toothpaste, toothbrushes and towels, and, in the case of any child in such custody for more than 24 hours, showers;</text>
 </clause><clause id="id21207520cdef41d69c24fe87aee1c8f8"><enum>(v)</enum><text>a pillow;</text> </clause><clause id="idc3662324816e4943a24e2fdfb897efe3"><enum>(vi)</enum><text>linens;</text>
 </clause><clause id="idca4350c6462e437da0408d3db2b532e0"><enum>(vii)</enum><text>sufficient blankets to rest at a comfortable temperature;</text> </clause><clause id="id52DA9609152C46C9B738D37F3B9006D2"><enum>(viii)</enum><text>diapers, diapering supplies, infant formula, and infant feeding supplies, as necessary;</text>
 </clause><clause id="id400b1f9961d147aba584aaaf315625ec"><enum>(ix)</enum><text>in the case of any child in such custody for more than 12 hours, access to a bed and adequate bedding; and</text>
 </clause><clause id="idB49D588CE5DE47248250532F5FC82CA9"><enum>(x)</enum><text>a location to sleep in which the lights are dimmed;</text> </clause></subparagraph><subparagraph id="id829a63dc9d9340aca914aef62b0c97e3"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="idD002FAD459FB4DE3A20C31BCB50FA68A"><enum>(i)</enum><text>are offered food at the time at which the Commissioner obtains custody of the child; and</text>
 </clause><clause id="id5A48226115B4403CA96AC3F892EB0581" indent="up1"><enum>(ii)</enum><text>receive adequate nutrition, including not fewer than three daily meals that include 1 or more fruits or vegetables;</text>
 </clause></subparagraph><subparagraph id="id324ec98a1f20401bb4f95e3c6d11d5e2"><enum>(E)</enum><text>have a safe and sanitary living environment;</text> </subparagraph><subparagraph id="id1deb942ec77640049f75a8b81248275e"><enum>(F)</enum><text>in the case of any child in such custody for more than 24 hours, have access to daily recreational programs and activities, including recreational time outdoors;</text>
 </subparagraph><subparagraph id="idd58ad9e32cf84fa5b849134cfd584e2c"><enum>(G)</enum><text>have regular access to legal services and consular officials in person and telephonically; and</text> </subparagraph><subparagraph id="id04b4ec4186c043f8a4a1321610a832b6"><enum>(H)</enum><text>are permitted to make supervised video conference calls, if available, and telephone calls to family members.</text>
					</subparagraph></paragraph></subsection><subsection id="id1793029556bb43cb84f1709918b5b715"><enum>(k)</enum><header>Ensuring children have access to legal rights</header>
 <paragraph id="idc57e24a827b14065b5eb7e84aded06d0"><enum>(1)</enum><header>In general</header><text>The Secretary shall ensure that each child, on apprehension, is provided—</text> <subparagraph id="id279479d8126844e78bc38dd71816b483"><enum>(A)</enum><text>an interview and screening with a child welfare professional as described in subsection (d); and</text>
 </subparagraph><subparagraph id="id6f5f0bed978249c3905019c8de4da21b"><enum>(B)</enum><text>a video orientation and oral and written notice, in a language understood by the child, of the rights of the child under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.), including—</text>
 <clause id="id511006ab71ee4ab79cbd81caf542f35f"><enum>(i)</enum><text>the right to relief from removal;</text> </clause><clause id="idd7932aa73c744658b85a589f5c7549bc"><enum>(ii)</enum><text>the right—</text>
 <subclause id="id6D28298DE0AF48A3B5E3B43DAB295D6E"><enum>(I)</enum><text>to confer with counsel under section 292 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1362">8 U.S.C. 1362</external-xref>); and</text> </subclause><subclause id="id9DABE0DEFAC94CF59E7541CD5928B78C"><enum>(II)</enum><text>to have access to family or friends while in the temporary custody of the Department; and</text>
 </subclause></clause><clause id="id1c304bc59a1a431799921370e0d814e3"><enum>(iii)</enum><text>the applicable complaint mechanism to report any abuse, mistreatment, or misconduct.</text> </clause></subparagraph></paragraph><paragraph id="id6b11b5e83c2f48cc9b2ef4e0198159d9"><enum>(2)</enum><header>Languages</header><text>The Secretary shall ensure that, at each location at which one or more children are held in custody, the video orientation described in paragraph (1)(B) is available in English and the five most common native languages spoken by children held in custody at that location during the preceding fiscal year.</text>
 </paragraph><paragraph id="id0CD087D4BDF44796A2B77D1AAEC7C379"><enum>(3)</enum><header>Access to legal counsel</header><text>The Secretary shall ensure that each apprehended parent or legal guardian and each child is provided access to one or more nongovernmental organizations that provide legal assistance.</text>
 </paragraph></subsection><subsection id="id83b6a17163fa4d6183c591bc4026f257"><enum>(l)</enum><header>Child protection policies</header><text display-inline="yes-display-inline">With respect to children, the Secretary shall adopt fundamental child protection policies and procedures—</text>
 <paragraph id="idca1cccabda5e4d348e56ac93abdc7be5"><enum>(1)</enum><text>to make reliable age determinations, developed in consultation with experts in the physiological, cognitive, and emotional development of children and experts in pediatric medicine, which shall exclude the use of fallible forensic testing of the bones and teeth of children;</text>
 </paragraph><paragraph id="id53dc168c801346c9ab3385e33d37bc11"><enum>(2)</enum><text>to use all legal authorities to defer the removal from the United States of a child who faces a risk of life-threatening harm on return, including harm due to the mental health or medical condition of the child; and</text>
 </paragraph><paragraph id="id01cde2f54ba7435b96e1e0088d2b8ac4"><enum>(3)</enum><text>to ensure, in accordance with the Juvenile Justice and Delinquency Prevention Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5601">42 U.S.C. 5601</external-xref> et seq.), that a child in custody of the Secretary is separated physically, and by sight and sound, from any—</text>
 <subparagraph id="id1e93c2c2b1604c009bdda58a74b1d2cc"><enum>(A)</enum><text>immigration detainee or inmate with a criminal conviction;</text> </subparagraph><subparagraph id="id0d4af4794be14ba39c464afcfe2284e7"><enum>(B)</enum><text>pretrial inmate facing criminal prosecution; and</text>
 </subparagraph><subparagraph id="id87c238acbac44a83a85215d53ae68c54"><enum>(C)</enum><text>inmate exhibiting violent behavior.</text> </subparagraph></paragraph></subsection><subsection id="id99eae80e5c7d41f2bf9223e2d63cb2d5"><enum>(m)</enum><header>Preservation of records</header><text>The Secretary shall preserve all records associated with children in the custody of the Commissioner, including records as follows:</text>
 <paragraph id="id45713D3E2AB147E987232070D2A6A2A9"><enum>(1)</enum><text>Records containing information on the identity of any child, and, if accompanied by any family member, on the identity of such family member.</text>
 </paragraph><paragraph id="id1ec9805e97264b558745a85c4ed8619c"><enum>(2)</enum><text>Records associated with reported incidents of abuse of children while in custody.</text> </paragraph></subsection><subsection id="idd53475af13f74a36a5be49aa86523a86"><enum>(n)</enum><header>Transfer of funds</header> <paragraph id="ide50a74de6c6c42fabfd112aba68a797d"><enum>(1)</enum><header>Authorization</header><text>The Secretary, in accordance with a written agreement between the Secretary and the Secretary of Health and Human Services, to the extent and in such amounts as are provided in advance in appropriations Acts, shall transfer from amounts appropriated for U.S. Customs and Border Protection to the Department of Health and Human Services such amounts as may be necessary to carry out the duties described in subsections (c) and (d)(4).</text>
 </paragraph><paragraph id="id118fa81c1cef4b679575b38cbcaa6af3"><enum>(2)</enum><header>Report</header><text>Not later than 15 days before the date of any proposed transfer under paragraph (1), the Secretary of Health and Human Services, in consultation with the Secretary, shall submit to the Committee on Appropriations of the Senate and the Committee on Appropriations of the House of Representatives a detailed expenditure plan that describes the actions proposed to be taken with the amounts transferred under such paragraph.</text>
				</paragraph></subsection></section><section id="ida5a0de24d09140ec8e43f511de3062f6"><enum>4.</enum><header>Savings provisions</header>
 <subsection id="id04cb705a475941d68d87ac525b1d92dc"><enum>(a)</enum><header>Federal law</header><text>Nothing in this Act may be construed to supersede or modify—</text> <paragraph id="id1d0341acbaba44a3887736424e515183"><enum>(1)</enum><text>the William Wilberforce Trafficking Victims Protection Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232</external-xref> et seq.);</text>
 </paragraph><paragraph id="idd8460f2b27e24ceda04095354bef56a3"><enum>(2)</enum><text>the Stipulated Settlement Agreement filed in the United States District Court for the Central District of California on January 17, 1997 (CV 85–4544–RJK) (commonly known as the <quote>Flores Settlement Agreement</quote>);</text>
 </paragraph><paragraph id="id0076d98a5a8b4c1b879198caeead2aa0"><enum>(3)</enum><text>the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref> et seq.); or</text> </paragraph><paragraph id="id986d34b03d824b12bc902430d60d2de3"><enum>(4)</enum><text>any applicable Federal child welfare law, including the Adoption and Safe Families Act of 1997 (<external-xref legal-doc="public-law" parsable-cite="pl/105/89">Public Law 105–89</external-xref>).</text>
 </paragraph></subsection><subsection id="id2919f11025064016900b2ecd5d69f818"><enum>(b)</enum><header>State law</header><text>Nothing in this Act may be construed to supersede or modify any applicable State child welfare law.</text></subsection></section></legis-body></bill>
