			 of Venezuela to be eligible for temporary protected status under such
			 section.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Venezuela Temporary Protected Status Act of 2019</short-title></quote>.</text>
 </section><section id="id7eac503c4d78464b8639ca250c70e370"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> <paragraph id="iddc5af8d95bdd457db39e03439f0e8a86"><enum>(1)</enum><text>Venezuela is enduring an unprecedented economic, humanitarian, security, and refugee crisis, consisting of extreme food and medicine shortages, severe infant and child malnutrition, rampant crime, and government-sponsored repression.</text>
 </paragraph><paragraph id="id377acea7d7b44799b6e2884551bde746"><enum>(2)</enum><text>Venezuela’s economic crisis continues unabated and the International Monetary Fund projects that inflation in Venezuela could reach an annual rate of 10,000,000 percent in 2019.</text>
 </paragraph><paragraph id="idbd600a918ff74710ad07b885fbf88a27"><enum>(3)</enum><text>As evidence of the humanitarian crisis created by Venezuela’s systemic economic turmoil—</text> <subparagraph id="idCB076A71D0414903AB5240B676C43139"><enum>(A)</enum><text>more than 9,000,000 people in Venezuela are eating 2 or fewer meals a day; and</text>
 </subparagraph><subparagraph id="id2442AABC1805428E9DAE8027D879DB43"><enum>(B)</enum><text>approximately 75 percent of the population have reported losing an average of—</text>
 <clause id="idAD9DDE412AC349F8A00890D963A2DD0F"><enum>(i)</enum><text>19 pounds in 2016; and</text>
 </clause><clause id="id74270BE456DA4B26ADFEFA7BAA0B5693"><enum>(ii)</enum><text>24 pounds in 2017.</text> </clause></subparagraph></paragraph><paragraph id="idb6891ad8b6f545c990c31b7176f2db06"><enum>(4)</enum><text>Moderate to severe malnutrition among Venezuelan children under 5 years of age increased by more than 50 percent in 2017, and approximately 300,000 Venezuelan children are at risk of dying from malnutrition, according to Cáritas de Venezuela, a Catholic humanitarian organization.</text>
 </paragraph><paragraph id="id4d2ab68262404e8d874c09fe40307920"><enum>(5)</enum><text>Pharmacies in Venezuela have shortages of approximately 85 percent of needed medicines and 76 percent of public hospitals lack the basic medicines that should be available in any functional public hospital, including those that are on the World Health Organization’s List of Essential Medicines.</text>
 </paragraph><paragraph id="id4b72d26d57df469c84d7d46b54354c66"><enum>(6)</enum><text>As evidence of the significant effect that Venezuela’s economic crisis on public health, Venezuela’s Health Ministry reported that in 2016—</text>
 <subparagraph id="id0F93DAC28B5D467781386255B63F1FC2"><enum>(A)</enum><text>there was a 30-percent increase in the infant mortality rate; and</text> </subparagraph><subparagraph id="id10F2D1BF277C4DEFAAA50255B3BC41B5"><enum>(B)</enum><text>there was a 65-percent increase in the maternal mortality rate.</text>
 </subparagraph></paragraph><paragraph id="idf984832a3d4a49788a8bba82976835f7"><enum>(7)</enum><text>Violent crime in Venezuela has risen sharply and the Venezuelan Violence Observatory, an independent nongovernmental organization, calculated the national per capita murder rate to be 89 per 100,000 people in 2017.</text>
 </paragraph><paragraph id="id547c0816afa049ddaabf7372fedd6ba6"><enum>(8)</enum><text>According to Citizens Council for Public Safety and Criminal Justice, Caracas was the most dangerous capital city in the world in 2017, with 111 murders per 100,000 residents.</text>
 </paragraph><paragraph id="idb421c5c6308f40b490002f2ac3a65fe8"><enum>(9)</enum><text>According to the United Nations Human Rights Office of the High Commissioner—</text>
 <subparagraph id="idA107762031534667A41F2674AD2AE87F"><enum>(A)</enum><text>Venezuelan intelligence and security forces have increasingly used arbitrary arrests and detentions to repress and intimidate civil society, political opponents, and any voices of dissent; and</text>
 </subparagraph><subparagraph id="id0E258697D25A4026936A8F8A0230F215"><enum>(B)</enum><text>between 2015 and 2017, at least 505 people including 24 children, were executed by Venezuelan security forces, leading the International Criminal Court prosecutor to announce a preliminary investigation into the use of excessive force in Venezuela.</text>
 </subparagraph></paragraph><paragraph id="id5e6cd7a11796487ba944fddab83eafd1"><enum>(10)</enum><text>Zeid Ra’ad Al Hussein, the United Nations High Commissioner for Human Rights, stated, <quote>The failure to hold security forces accountable for such serious human rights violations suggests that the rule of law is virtually absent in Venezuela.</quote>.</text>
 </paragraph><paragraph id="ida720dbcfbb1c40afab2eda2603326051"><enum>(11)</enum><text>According to the United Nations High Commissioner for Human Rights, more than 3,400,000 Venezuelans have left their country for reasons such as violence, political oppression, economic hardship, and the ongoing humanitarian crisis.</text>
 </paragraph></section><section id="idb31b5fc5bdab4aa6adad24fd440dc1db"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of the Congress that—</text> <paragraph id="id4e418d4fc6b84cae93b55293e5968824"><enum>(1)</enum><text>Venezuela’s economic, humanitarian, security, and refugee crisis has resulted in extraordinary and temporary conditions that currently prevent Venezuelan nationals from safely returning to Venezuela; and</text>
 </paragraph><paragraph id="ide871aea2f42b4eeaa8e10aeda4076753"><enum>(2)</enum><text>Venezuela should be designated under subsection (b)(1)(C) of section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>) for a period of 18 months to permit nationals of Venezuela to be eligible for temporary protected status in accordance with such section.</text>
			</paragraph></section><section id="idf383e85031844d5da6710e5476800060"><enum>4.</enum><header>Designation for purposes of granting temporary protected status</header>
			<subsection id="id676090d1df6b4c9298fa432d9766f106"><enum>(a)</enum><header>Designation</header>
 <paragraph id="id5053555a3ca9415b9d13682313e4f618"><enum>(1)</enum><header>In general</header><text>For purposes of section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>), Venezuela shall be treated as if it had been designated under subsection (b)(1)(C) of that section, subject to the provisions of this section.</text>
 </paragraph><paragraph id="idbc50ca3d951f4f00bd95d6add43b6bd1"><enum>(2)</enum><header>Period of designation</header><text>The initial period of the designation referred to in paragraph (1) shall be for the 18-month period beginning on the date of the enactment of this Act.</text>
 </paragraph></subsection><subsection id="id7b73d29fdc394e7b82acacd3fb0465c9"><enum>(b)</enum><header>Aliens eligible</header><text>As a result of the designation made under subsection (a), an alien who is a national of Venezuela is deemed to satisfy the requirements under paragraph (1) of section 244(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(c)</external-xref>), subject to paragraph (3) of such section, if the alien—</text>
 <paragraph id="id15e19c40cd184c4f834935e8475d30fe"><enum>(1)</enum><text>has been continuously physically present in the United States since the date of the enactment of this Act;</text>
 </paragraph><paragraph id="id22021a1110974852934c1e48ecb099d5"><enum>(2)</enum><text>is admissible as an immigrant, except as otherwise provided in paragraph (2)(A) of such section, and is not ineligible for temporary protected status under paragraph (2)(B) of such section; and</text>
 </paragraph><paragraph id="id47a2bcf955c74cea9e23ce9bc00f06e0"><enum>(3)</enum><text>registers for temporary protected status in a manner established by the Secretary of Homeland Security.</text>
				</paragraph></subsection><subsection id="id47546da4d17b4cd1845c52fc5a2abfd3"><enum>(c)</enum><header>Consent To travel abroad</header>
 <paragraph id="id621070AB938147F19FA4A6945B1AB18A"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security shall give prior consent to travel abroad, in accordance with section 244(f)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a(f)(3)</external-xref>), to an alien who is granted temporary protected status pursuant to the designation made under subsection (a) if the alien establishes to the satisfaction of the Secretary of Homeland Security that emergency and extenuating circumstances beyond the control of the alien require the alien to depart for a brief, temporary trip abroad.</text>
 </paragraph><paragraph id="idB3169B63F3F24D34A26BD54622886664"><enum>(2)</enum><header>Treatment upon return</header><text>An alien returning to the United States in accordance with an authorization described in paragraph (1) shall be treated as any other returning alien provided temporary protected status under section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>).</text>
				</paragraph></subsection></section><section id="id0728086f96d74311a5d50f60f0b0202c"><enum>5.</enum><header>Improving internal migration systems in countries surrounding Venezuela</header>
 <subsection id="id63ea7a7bf736433f9ece8270fccfe4e1"><enum>(a)</enum><header>In general</header><text>The Secretary of State, in consultation with the Secretary of Homeland Security, shall work with international partners, including the United Nations High Commissioner for Refugees, to support and provide technical assistance to improve the domestic capacity of countries surrounding Venezuela and in the region to provide migration services and asylum to eligible Venezuelan citizens—</text>
 <paragraph id="id7ea8987f8bd84d3d94a88b5e76cc65aa"><enum>(1)</enum><text>by establishing and expanding temporary and long-term, in-country reception centers and shelter capacity in those surrounding countries to meet the humanitarian needs of Venezuelan migrants or Venezuelans seeking asylum or other forms of international protection;</text>
 </paragraph><paragraph id="id3af7fad6deb845be9d6e2aacd6df9592"><enum>(2)</enum><text>by improving migration and asylum registration systems in those surrounding countries to ensure that Venezuelan migrants and Venezuelans seeking asylum or other humanitarian protection—</text>
 <subparagraph id="ide9907928132a48bf8090b73ed2df9132"><enum>(A)</enum><text>receive due process and meaningful access to legal protections; and</text> </subparagraph><subparagraph id="idb282e6afd6bb4be69a1780eceaf8d114"><enum>(B)</enum><text>receive proper documents in order to prevent fraud and facilitate freedom of movement and access to basic social services;</text>
 </subparagraph></paragraph><paragraph id="id858bcc4b4c04411a8e991c804fb1b26d"><enum>(3)</enum><text>by supporting the creation or expansion of a corps of trained migration and asylum officers from those countries who are capable of—</text>
 <subparagraph id="idb809f83117b54e38ac9aecf9ee4d78ae"><enum>(A)</enum><text>providing migration services; and</text> </subparagraph><subparagraph id="idbf3041b2e1184bdda3726466e8763149"><enum>(B)</enum><text>evaluating and deciding individual asylum claims consistent with international law and obligations; and</text>
 </subparagraph></paragraph><paragraph id="id7bbcc030b27741209156ecdadaf7f401"><enum>(4)</enum><text>by developing the capacity to conduct best interest determinations for Venezuelan migrants to ensure that their needs are properly met.</text>
 </paragraph></subsection><subsection id="id68ac08432aed4a39870a075f37228381"><enum>(b)</enum><header>Strategy</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State, in consultation with the Secretary of Homeland Security, shall submit a strategy describing plans for assisting the development of the international asylum processing capabilities described in subsection (a) to—</text>
 <paragraph id="idacc0f86d9d25498f85671488a9d8d07d"><enum>(1)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text> </paragraph><paragraph id="id070eac6a0cba46529ae9544bf49391db"><enum>(2)</enum><text>the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>;</text>
 </paragraph><paragraph id="id8e17c5489083490c8d3e531b2f3a9bc0"><enum>(3)</enum><text>the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>;</text> </paragraph><paragraph id="idB46BBC493F3E4DCBB95B4938FD6FAFD0"><enum>(4)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>;</text>
 </paragraph><paragraph id="idb1c2ae1504624f2c8a820467e12550c9"><enum>(5)</enum><text>the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>; and</text> </paragraph><paragraph id="id0F9062AF3D744BC88ED151C3D359B476"><enum>(6)</enum><text>the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name>.</text>
				</paragraph></subsection><subsection id="id2a5105880d5546338e41182241410cfd"><enum>(c)</enum><header>Authorization of appropriations</header>
 <paragraph id="id00b4cd0f2e04462590c1b893cafd6590"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary of State $10,000,000 for fiscal year 2019 to carry out the activities set forth in subsection (b), in accordance with this section.</text>
				</paragraph><paragraph id="id53c5b4e8e37f4e81b181a6b3d3ced701"><enum>(2)</enum><header>Notification requirement</header>
 <subparagraph id="ida0aa535ee91846b0a2ec357e136095c2"><enum>(A)</enum><header>In general</header><text>Except as provided under subparagraph (B), amounts appropriated or otherwise made available pursuant to paragraph (1) may not be obligated until 15 days after the date on which the President provides notice to the committees listed in subsection (b) of the intent to obligate such funds.</text>
					</subparagraph><subparagraph id="iddfe02b52be944164aca6a556bdfdff5b"><enum>(B)</enum><header>Waiver</header>
 <clause id="id35606232e57e4297b3106a08224f4f77"><enum>(i)</enum><header>In general</header><text>The Secretary of State may waive the requirement under subparagraph (A) if the Secretary of State determines that such waiver is in the national interest of the United States.</text>
 </clause><clause id="id79aa67fd9ede40c3b39d1ea74d648419"><enum>(ii)</enum><header>Notification requirement</header><text>If a waiver is invoked under clause (i), the President shall notify the committees listed in subsection (b) of the intention to obligate funds under this section as early as practicable, but not later than 3 days after taking the action to which such notification requirement was applicable in the context of the circumstances necessitating such waiver.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
