 <section id="id206E44C39CFC4E4CBE8A6735969E28F4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>State Transportation Flexibility Act</short-title></quote>.</text>
		</section><section id="id19D6C31B877C4248B3147ED113DFD280"><enum>2.</enum><header>Direct
			 Federal-aid highway program</header>
			<subsection id="id8DE4538EB7EA444A9A81840C21A18C68"><enum>(a)</enum><header>In
 general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idC289881A940146EB85343C95A595E117" style="USC">
					<section id="idFA7060F8CB0F4B598C9BFFD1764D00AD"><enum>171.</enum><header>Direct
				Federal-aid highway program</header>
						<subsection id="id9486FD8ADCE044B7B804877202CD753A"><enum>(a)</enum><header>Election by
 State not To participate</header><text>Notwithstanding any other provision of law and in accordance with this section, a State may elect not to participate in any Federal program relating to highways, including a Federal highway program under the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (<external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>; 119 Stat. 1144), the Moving Ahead for Progress in the 21st Century Act (<external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>; 126 Stat. 405), the Fixing America's Surface Transportation Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/94">Public Law 114–94</external-xref>; 129 Stat. 1312), this title, or title 49.</text>
						</subsection><subsection id="id7B6F1BB66758422DB1D329321D322BC9"><enum>(b)</enum><header>Direct
				Federal-Aid highway program</header>
							<paragraph id="id675CBA391EF24119A143CDEB5238F909"><enum>(1)</enum><header>In
 general</header><text>The Secretary shall carry out a direct Federal-aid highway program (referred to in this section as the <quote>program</quote>) in accordance with the requirements of this section under which the legislature of a State may elect, not fewer than 90 days before the beginning of a fiscal year—</text>
 <subparagraph id="id46A1DB1EE92D42D780421A74BF91C15B"><enum>(A)</enum><text>to waive the right of the State to receive amounts apportioned or allocated to the State under this chapter for the fiscal year to which the election relates; and</text>
 </subparagraph><subparagraph id="id1BDE75BDC9EA4B49AB2087CCB426343D"><enum>(B)</enum><text>to receive an amount for that fiscal year that is determined in accordance with subsection (e) for that fiscal year.</text>
 </subparagraph></paragraph><paragraph id="id59C981D76AE2492485387A203D08D644"><enum>(2)</enum><header>Effect</header><text>On making an election under paragraph (1), a State—</text>
 <subparagraph id="idA2E90853B1F2488EA595BE7BFB589921"><enum>(A)</enum><text>assumes all Federal obligations relating to each program that is the subject of the election; and</text>
 </subparagraph><subparagraph id="idFE3894D8384F418294145B49D7143716"><enum>(B)</enum><text>shall fulfill those obligations using the amounts transferred to the State under subsection (e).</text>
 </subparagraph></paragraph><paragraph id="idC6FDFA3B4C934C0090F520FB2EA15D16"><enum>(3)</enum><header>Eligible years</header><text>A State may make an election with respect to fiscal year 2020 and any fiscal year thereafter.</text> </paragraph></subsection><subsection id="id53A6C77CA12F47DEAFDBC098FC92FD13"><enum>(c)</enum><header>State responsibility</header> <paragraph id="id32119A71CE5B49D4A4B3F8161891DE20"><enum>(1)</enum><header>In general</header><text>The Governor of a State making an election under subsection (b) shall—</text>
 <subparagraph id="id616F6A6F4E0D4450873DF37BA93F7289"><enum>(A)</enum><text>agree to maintain the Interstate System in accordance with the current Interstate System program;</text>
 </subparagraph><subparagraph id="id4A564AE1DCBE4A8E910DE5794E959235"><enum>(B)</enum><text>submit a plan to the Secretary describing—</text>
 <clause id="idCD827DED90D04D6B8EF8F42187A9A860"><enum>(i)</enum><text>the purposes, projects, and uses to which amounts received under the program will be put; and</text>
 </clause><clause id="id8DBD404E6F634B6EB89999F22A72AB07"><enum>(ii)</enum><text>which programmatic requirements of this title the State elects to continue;</text>
 </clause></subparagraph><subparagraph id="id53CF2925F0C241FD9DDDA1A721B9384A"><enum>(C)</enum><text>agree to obligate or expend amounts received under the program exclusively for projects that would be eligible for funding under section 133(b) if the State was not participating in the program; and</text>
 </subparagraph><subparagraph id="id1C9FAA0E560C4C27952E8C892C62E6FA"><enum>(D)</enum><text>agree—</text> <clause id="id2A6A478811374A8C8FD2079C307BFC97"><enum>(i)</enum><text>to report annually to the Secretary on the use of amounts received under the program; and</text>
 </clause><clause id="id6018E7CD0A7C4B398981263665B667B8"><enum>(ii)</enum><text>to make the report available to the public in an easily accessible format.</text>
									</clause></subparagraph></paragraph><paragraph id="idCFC1B8A2109047E5AF6E7B9D4E62C23F"><enum>(2)</enum><header>No Federal
 limitation on use of funds</header><text>Except as provided in paragraph (1), the expenditure or obligation of funds received by a State under the program shall not be subject to any Federal requirement under this title (except for this section), title 49, or any other Federal law (including regulations).</text>
							</paragraph><paragraph id="id38EA2FA574284580B9EDE57E3A7241CB"><enum>(3)</enum><header>Election
 irrevocable</header><text>An election under subsection (b) shall be irrevocable during the applicable fiscal year.</text>
							</paragraph></subsection><subsection id="idDDF03BF4C05342C2A981D301F772EF18"><enum>(d)</enum><header>Effect on
 preexisting commitments</header><text>An election under subsection (b) shall not affect any responsibility or commitment of the State under this title for any fiscal year with respect to—</text>
 <paragraph id="id1EF07C1143054E81BE0951451AA47E95"><enum>(1)</enum><text>a project or program funded under this title (other than under this section); or</text>
 </paragraph><paragraph id="id81130F040A5C4BAABA970FFE94716507"><enum>(2)</enum><text>any project or program funded under this title in any fiscal year for which an election under subsection (b) is not in effect.</text>
							</paragraph></subsection><subsection id="idB6D72DAB60B04248A7357B72A71E85E9"><enum>(e)</enum><header>Transfers</header>
							<paragraph id="id3B6BEF65434847828F3CF2F12BBBBF6A"><enum>(1)</enum><header>In
 general</header><text>The amount to be transferred to a State under the program for a fiscal year shall be the portion of the taxes appropriated to the Highway Trust Fund (other than for the Mass Transit Account) for that fiscal year that is attributable to highway users in that State during that fiscal year, reduced by a pro rata share withheld by the Secretary to fund contract authority for programs of the National Highway Traffic Safety Administration and the Federal Motor Carrier Safety Administration.</text>
							</paragraph><paragraph id="id41CCEFF808D44815A3823D12228E40C9"><enum>(2)</enum><header>Transfers under
				program</header>
								<subparagraph id="idA5C4EA66CB774416AB1482CAB5911C16"><enum>(A)</enum><header>In
 general</header><text>Transfers under the program—</text> <clause id="id33A88C025E38411087E9887E6A79DA59"><enum>(i)</enum><text>shall be made at the same time as deposits to the Highway Trust Fund are made by the Secretary of the Treasury; and</text>
 </clause><clause id="id4B5E96242DE74308A6C639A4201A0861"><enum>(ii)</enum><text>shall—</text> <subclause id="id62E0B395943A414A9EF43CF6EC5F7479"><enum>(I)</enum><text>be made on the basis of estimates by the Secretary, in consultation with the Secretary of the Treasury, based on the most recent data available; and</text>
 </subclause><subclause id="idAB1676B6E0BF47E8BBF08E2014320FE6"><enum>(II)</enum><text>include proper adjustments in amounts subsequently transferred to the extent prior estimates were in excess of, or less than, the amounts required to be transferred.</text>
										</subclause></clause></subparagraph><subparagraph id="id17788A3200654B5EB95FA32103EAA9B8"><enum>(B)</enum><header>Limitation</header>
 <clause id="id6129AC541D074159A9EF0BABECB3783F"><enum>(i)</enum><header>In general</header><text>An adjustment under subparagraph (A)(ii)(II) to any transfer may not exceed 5 percent of the transferred amount to which the adjustment relates.</text>
 </clause><clause id="id7F02322D66144243A6AD261C4C051B72"><enum>(ii)</enum><header>Adjustment greater than 5 percent</header><text>If the adjustment required under subparagraph (A)(ii)(II) exceeds the percentage described in clause (i), the excess shall be taken into account in making subsequent adjustments under subparagraph (A)(ii)(II).</text>
									</clause></subparagraph></paragraph></subsection><subsection id="id7590A800F03C432082F5210D0DC19E11"><enum>(f)</enum><header>Application
 with other authority</header><text>Any contract authority under this chapter (and any obligation limitation) authorized for a State for a fiscal year for which an election by that State is in effect under subsection (b)—</text>
 <paragraph id="id447A0908F6174C5EB13D1F36CF08856E"><enum>(1)</enum><text>shall be rescinded or canceled; and</text>
 </paragraph><paragraph id="id16CF634934AA4239953D2923E0F06FC6"><enum>(2)</enum><text>shall not be reallocated or distributed to any other State under this chapter.</text>
							</paragraph></subsection><subsection id="ID141b1122a76d40398d17685cc38ab6df"><enum>(g)</enum><header>Maintenance of
				effort</header>
							<paragraph id="id31B3E14CAF73449080F41164540D097F"><enum>(1)</enum><header>In
 general</header><text>Not later than 30 days after the date on which an amount is distributed to a State or State agency under the program, the Governor of the State shall certify to the Secretary that the State will maintain the effort of the State with regard to State funding for the types of projects that are funded by the amounts distributed.</text>
 </paragraph><paragraph id="id464765BCE96349979DADBC1161C82DB7"><enum>(2)</enum><header>Amounts</header><text>As part of the certification under paragraph (1), the Governor shall submit to the Secretary a statement that identifies the amount of funds the State plans to expend from State sources during the covered period for the types of projects that are funded by the amounts.</text>
							</paragraph></subsection><subsection id="idF96B30F7505846699ADC6A6D2E04DDF6"><enum>(h)</enum><header>Treatment of
 general revenues</header><text>For purposes of this section, any general revenue funds appropriated to the Highway Trust Fund shall be transferred to a State under the program in the manner described in subsection (e)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id5DF9B267DDFE4BF9B566F08B95C609D1"><enum>(b)</enum><header>Conforming
 amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/23/170">section 170</external-xref> the following:</text>
				<quoted-block display-inline="no-display-inline" id="id2ABB6D046CED4648B8CF77C106CD07C0" style="OLC"><toc><toc-entry bold="off" level="section">171. Direct Federal-aid highway
				program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id092081373735413CAB8F5EE4D610FE4C"><enum>3.</enum><header>Alternative
			 funding of public transportation programs</header>
			<subsection id="id73A4777CE9FF46A6A84A7FC20475A721"><enum>(a)</enum><header>In
 general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">Chapter 53</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idBC681014373A44789E137F27B2AB804A" style="USC">
					<section id="idEE1832165A4044C2AD82193DCD21ABC2"><enum>5341.</enum><header>Alternative
				funding of public transportation programs</header>
 <subsection id="id7AA2703718B544CD8132B5A81CD6C9D1"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="id94931CD13F1F49CFB1164E6606907A81"><enum>(1)</enum><text>the term <term>alternative funding program</term> means the program established under subsection (c);</text>
 </paragraph><paragraph id="idE1486ECAC84743A4B001C61E680E72F8"><enum>(2)</enum><text>the term <term>covered program</term> means a Federal public transportation program that is funded using amounts made available from the Mass Transit Account of the Highway Trust Fund; and</text>
 </paragraph><paragraph id="idDD14E4C9E308467EB9526954E425A7A0"><enum>(3)</enum><text>the term <term>Federal public transportation program</term> means a Federal program that provides funding for public transportation, including under—</text> <subparagraph commented="no" id="idDE0C3D33E5434909954CCFBE6C075506"><enum>(A)</enum><text>the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (<external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>; 119 Stat. 1144);</text>
 </subparagraph><subparagraph id="id89461D37A7A546FE96A2E581390D4447"><enum>(B)</enum><text>the Moving Ahead for Progress in the 21st Century Act (<external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>; 126 Stat. 405);</text>
 </subparagraph><subparagraph id="idCE186579FFD94E0D97CC55E88B52B290"><enum>(C)</enum><text>the Fixing America's Surface Transportation Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/94">Public Law 114–94</external-xref>; 129 Stat. 1312);</text>
 </subparagraph><subparagraph id="id1CB4C6DAA6584743A4CCE3CB799E49AD"><enum>(D)</enum><text>title 23; or</text>
 </subparagraph><subparagraph id="id0C57EB6E0E23490186D251A3461AEADC"><enum>(E)</enum><text>this chapter.</text> </subparagraph></paragraph></subsection><subsection id="id5BE1FD3F7303415C99E07BD8A911D971"><enum>(b)</enum><header>Election by State not To participate</header><text>Notwithstanding any other provision of law and in accordance with this section, a State may elect not to participate in any covered program.</text>
						</subsection><subsection id="idBC1E025BAF1C414DB071837F23924492"><enum>(c)</enum><header>Public
				transportation alternative funding program</header>
 <paragraph id="idC3E8B0070D3D4EC88544DFA57ADFEA1F"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out a public transportation alternative funding program in accordance with the requirements of this section under which the legislature of a State may elect, not fewer than 90 days before the beginning of a fiscal year—</text>
 <subparagraph id="idED96B1E868204DCCAFFB272B6C108213"><enum>(A)</enum><text>to waive the right of the State to receive amounts apportioned or allocated to the State under the covered programs for the fiscal year to which the election relates; and</text>
 </subparagraph><subparagraph id="id99C26141D0EF4C8190E4F5AC6DDD0F2A"><enum>(B)</enum><text>to receive an amount for that fiscal year that is determined in accordance with subsection (f).</text>
 </subparagraph></paragraph><paragraph id="idA68FF37D0A2F4A7D995C7B583AF684CB"><enum>(2)</enum><header>Effect</header><text>On making an election under paragraph (1), a State—</text>
 <subparagraph id="idD72905D945E84345A4D79B5629A81358"><enum>(A)</enum><text>assumes all Federal obligations relating to each covered program; and</text>
 </subparagraph><subparagraph id="id5149CB1DFC9A496EB4FE88B2E7EA6ED3"><enum>(B)</enum><text>shall fulfill those obligations using the amounts transferred to the State under subsection (f).</text>
 </subparagraph></paragraph><paragraph id="id3004A10062AB4C2698C902767D8BD294"><enum>(3)</enum><header>Eligible years</header><text>A State may make an election with respect to fiscal year 2020 and any fiscal year thereafter.</text> </paragraph></subsection><subsection id="id760CB050FECF40FB8DF4D3E384D54E63"><enum>(d)</enum><header>State responsibility</header> <paragraph id="idC789F0FFFFB64EF48C9B8806791A5FAB"><enum>(1)</enum><header>In general</header><text>The Governor of a State that participates in the alternative funding program shall—</text>
 <subparagraph id="id37A5FFBF192143698E88A5DBD70F8E04"><enum>(A)</enum><text>submit a plan to the Secretary that describes—</text>
 <clause id="idC0352F6960ED4EC79AE50340D829F32A"><enum>(i)</enum><text>the purposes, projects, and uses to which amounts received under the alternative funding program will be put; and</text>
 </clause><clause commented="no" id="id6116DBF057ED4EFE8BCF00AF9C04A3BA"><enum>(ii)</enum><text>which programmatic requirements of the covered programs the State elects to continue;</text>
 </clause></subparagraph><subparagraph id="id1FD2B581DB3D4E15868EB3C88C51EAE3"><enum>(B)</enum><text>agree to obligate or expend amounts received under the alternative funding program exclusively for projects that would be eligible for funding under the covered programs if the State was not participating in the alternative funding program;</text>
 </subparagraph><subparagraph id="id7561B503AABE445C95AB8811D35A3662"><enum>(C)</enum><text>submit to the Secretary an annual report on the use of amounts received under the alternative funding program; and</text>
 </subparagraph><subparagraph id="id0FF4E74F90B444669A40B8334C578955"><enum>(D)</enum><text>make the annual report available to the public in an easily accessible format.</text>
								</subparagraph></paragraph><paragraph id="id1EE9DBD6A8674702B4FEA8CD294823A9"><enum>(2)</enum><header>No Federal
 limitation on use of funds</header><text>Except as provided in paragraph (1), the expenditure or obligation of funds received by a State under the alternative funding program shall not be subject to the requirements of—</text>
 <subparagraph id="idEE72C43B2CC247C38AA8F5B03DA2ABAF"><enum>(A)</enum><text>this chapter (except for this section);</text>
 </subparagraph><subparagraph id="id4EA2166FB6A54EEAB50229BC8DC8A21F"><enum>(B)</enum><text>any covered program not under this chapter;</text> </subparagraph><subparagraph id="idAC3E12E5DA8C438388406DAB2DBA3258"><enum>(C)</enum><text>title 23; or</text>
 </subparagraph><subparagraph id="idB58B82A4119A4E88AD680A03F2BF9D37"><enum>(D)</enum><text>any other Federal law (including regulations).</text>
								</subparagraph></paragraph><paragraph id="idA64FDFBDC58742E8B41C57F37490DFCC"><enum>(3)</enum><header>Election
 irrevocable</header><text>An election under subsection (c) shall be irrevocable during the applicable fiscal year.</text>
							</paragraph></subsection><subsection id="id4A8CEC271FC14589B40CFA7BB18834DD"><enum>(e)</enum><header>Effect on
 preexisting commitments</header><text>An election by a State under subsection (c) shall not affect any responsibility or commitment of the State with respect to a project or program funded under a covered program in a fiscal year for which an election under subsection (c) is not in effect.</text>
						</subsection><subsection id="id5A74ED750A1449558FEF1826B2B8DBE6"><enum>(f)</enum><header>Transfers</header>
							<paragraph id="id86B0B61693DF48DFB043F65F02168CA2"><enum>(1)</enum><header>In
 general</header><text>The amount to be transferred to a State under the alternative funding program for a fiscal year shall be the portion of the taxes transferred to the Mass Transit Account of the Highway Trust Fund under <external-xref legal-doc="usc" parsable-cite="usc/26/9503">section 9503(e)</external-xref> of the Internal Revenue Code of 1986 for that fiscal year that is attributable to highway users in that State during that fiscal year.</text>
							</paragraph><paragraph id="id9090F13AAAD1499D9649ACFFF0D8035D"><enum>(2)</enum><header>Transfers under program</header>
								<subparagraph id="id822B206050764AC0BEA1A6202BD9E390"><enum>(A)</enum><header>In
 general</header><text>Transfers under the alternative funding program—</text> <clause id="id2343F7765CA7415DA1C7AF0BF8FFE74A"><enum>(i)</enum><text>shall be made at the same time as transfers to the Mass Transit Account of the Highway Trust Fund are made by the Secretary of the Treasury; and</text>
 </clause><clause id="id178BF9C6EE984032A9DE8646F4AD47F1"><enum>(ii)</enum><text>shall—</text> <subclause id="id9BFCC983B24D4DA5A8105BAEDA81750F"><enum>(I)</enum><text>be made on the basis of estimates by the Secretary, in consultation with the Secretary of the Treasury, based on the most recent data available; and</text>
 </subclause><subclause id="id52268CC42FE9445497EA9678BA0F5B23"><enum>(II)</enum><text>include proper adjustments in amounts subsequently transferred under the alternative funding program, to the extent prior estimates were in excess of, or less than, the amounts required to be transferred under the alternative funding program.</text>
										</subclause></clause></subparagraph><subparagraph id="id4650D89E530747D5BB0C38DA06CDF3CC"><enum>(B)</enum><header>Limitation</header>
 <clause id="id7FA7D005C1174A8D9437D1F1553E9CF0"><enum>(i)</enum><header>In general</header><text>An adjustment under subparagraph (A)(ii)(II) to any transfer may not exceed 5 percent of the transferred amount to which the adjustment relates.</text>
 </clause><clause id="idC510133606164FEC9487EF6AF47EC4C6"><enum>(ii)</enum><header>Adjustment greater than 5 percent</header><text>If the adjustment required under subparagraph (A)(ii)(II) exceeds the percentage described in clause (i) of this subparagraph, the excess shall be taken into account in making subsequent adjustments under subparagraph (A)(ii)(II).</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" id="idAAC22B3C396E4A77AB460C673F2F3BA8"><enum>(g)</enum><header>Application with other
 authority</header><text>Any contract authority under a covered program (and any obligation limitation) authorized for a State for a fiscal year for which the State elects to participate in the alternative funding program shall be rescinded or canceled.</text>
						</subsection><subsection id="idE856E906534142FB8F2FF56192125497"><enum>(h)</enum><header>Maintenance of

							<paragraph id="idD350177F5F854CD28D3D43DA75E04C5D"><enum>(1)</enum><header>In
 general</header><text>Not later than 30 days after the date on which amounts are distributed to a State or State agency under the alternative funding program, the Governor of the State shall certify to the Secretary that the State will maintain the effort of the State with regard to State funding for the types of projects that are funded by the amounts distributed.</text>
 </paragraph><paragraph id="id1F38AE934B5649F79B7DCA59ADA001C8"><enum>(2)</enum><header>Amounts</header><text>As part of the certification under paragraph (1), the Governor shall submit to the Secretary a statement that identifies the amount of funds the State plans to expend from State sources for projects funded under the alternative funding program during the fiscal year for which the State elects to participate in the alternative funding program.</text>
							</paragraph></subsection><subsection id="id91E046A90A0A4D53A4ED5D9062EC1274"><enum>(i)</enum><header>Treatment of
 general revenues</header><text>For purposes of this section, any general revenue funds appropriated to the Mass Transit Account of the Highway Trust Fund shall be transferred to a State under the alternative funding program in the manner described in subsection (f)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id24653626A1EE4E058305FBB0D8FFA027"><enum>(b)</enum><header>Conforming
 amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/5340">section 5340</external-xref> the following:</text>
