	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Residential Rent to Own Protection Act</short-title></quote>.</text>
		</section><section id="id66169C81268A4863BE7D0C8670BA18B2"><enum>2.</enum><header>Regulation of land contracts</header>
 <subsection id="id7FBEAB87DCDD4112A56006FB93B078BF"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id0FC03467143943618F5074F1E59FB0FA"><enum>(1)</enum><header>Bureau</header><text>The term <term>Bureau</term> means the Bureau of Consumer Financial Protection.</text>
 </paragraph><paragraph id="idF308EA58D889418689D1826E75911F6A"><enum>(2)</enum><header>Covered contract</header><text>The term <term>covered contract</term> means a land contract, contract for deed, agreement for deed, rent to own contract, lease purchase, lease option, hybrid lease, or other similar instrument related to a property located in a State.</text>
 </paragraph><paragraph id="idBAECCE95BA8D4829969AC24DE7609145"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Trust Territory of the Pacific Islands, the United States Virgin Islands, the Commonwealth of the Northern Mariana Islands, and any other territory or possession of the United States.</text>
				</paragraph></subsection><subsection id="idD313892BDF464BCD8427EE248132A9C5"><enum>(b)</enum><header>Rental habitability requirement</header>
 <paragraph id="idA6EBB6B57C574F85A4832462331E31BC"><enum>(1)</enum><header>In general</header><text>Any property that is the subject of a covered contract shall be maintained in a habitable state, as determined by applicable State and local habitability requirements, by the seller of the property at all times until the purchaser of the property—</text>
 <subparagraph id="id85CD0375BD8E4F629ABB244E32D6ABA8"><enum>(A)</enum><text>has fully paid the obligations of the purchaser under the covered contract; and</text> </subparagraph><subparagraph id="id8F970807ADD34C2B9A62857171AE4868"><enum>(B)</enum><text>obtains title to the property.</text>
 </subparagraph></paragraph><paragraph id="idE128CA2619F64E17B50763FE79D52EB7"><enum>(2)</enum><header>Refund remedy</header><text>If a property that is the subject of a covered contract does not comply with paragraph (1)—</text> <subparagraph id="idAB1C1D0311F44F25A463A6F10F962D87"><enum>(A)</enum><text>the fair rental value of the property shall be deemed to be zero; and</text>
 </subparagraph><subparagraph id="id2B8A1FDC628A4A31B88B2D03814F5684"><enum>(B)</enum><text>the purchaser of the property shall be entitled to a refund from the seller of all amounts paid pursuant to the covered contract for the period during which the property was not habitable.</text>
 </subparagraph></paragraph></subsection><subsection id="id98da6a9cfc1b48328abd73b6bef030be"><enum>(c)</enum><header>Relief to seller only available through a judicial proceeding</header><text>Notwithstanding any other provision of law, the seller in a covered contract may terminate the purchaser’s right to purchase the property that is the subject of the covered contract or right of possession only upon determination by a court of competent jurisdiction that the purchaser is in material breach of the contract.</text>
			</subsection><subsection id="id1F5BBD3E55EB4C1EAAA6C1F627F82D09"><enum>(d)</enum><header>Prohibition on eviction or ejectment</header>
 <paragraph id="id0A8A899D90BA4C32BC34F9230736FF6E"><enum>(1)</enum><header>In general</header><text>Except as may be ordered in a judicial proceeding, the purchaser in a covered contract may not be evicted or otherwise ejected from the property that is the subject of the covered contract.</text>
				</paragraph><paragraph id="idFBE9AAA7C6784E2285273D19B850B098"><enum>(2)</enum><header>Damages</header>
 <subparagraph id="idC0F9901EF32A45A18B907C943CBE7D47"><enum>(A)</enum><header>In general</header><text>A purchaser with respect to a covered contract that is terminated through a judicial proceeding may bring a claim or counterclaim to enforce a violation of paragraph (1) in a civil proceeding.</text>
 </subparagraph><subparagraph id="id2843A82B61B44A5589FFE4D19106CE4B"><enum>(B)</enum><header>Amount</header><text>If a purchaser described in subparagraph (A) is the prevailing party, the court shall award actual damages and attorney's fees to the purchaser.</text>
 </subparagraph></paragraph></subsection><subsection id="id76F6FAA5179A4E88A33F317C2A50ECA4"><enum>(e)</enum><header>Recording</header><text>Not later than 45 days after the date on which a covered contract is signed, the seller in the covered contract shall record the covered contract in the applicable local governmental office that records land records.</text>
 </subsection><subsection id="id611BF89969704BAD905DF0F0BD5AEAC0"><enum>(f)</enum><header>State laws</header><text>Nothing in this section shall be construed to annul, alter, or affect any provision of State law if the protection that the provision of State law provides to purchasers in covered contracts is greater than the protection provided to those purchasers under this section.</text>
 </subsection><subsection id="idea2742a1d43b48279d81bf8a62047fd8"><enum>(g)</enum><header>Application</header><text>This section shall not apply to a covered contract if—</text> <paragraph id="idf16867eaaac844ed8ec54b2e4ad4835c"><enum>(1)</enum><text>the seller in the covered contract is a person described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 for the 3-year period before the date on which the seller enters into the covered contract;</text>
 </paragraph><paragraph id="ide6c8f10c7e6841ca8050214743b054ac"><enum>(2)</enum><text>the sale price is not higher than the amount the seller paid for the property that is the subject of the covered contract; and</text>
 </paragraph><paragraph id="id1ca9119295ed49fe922c0e13e216668e"><enum>(3)</enum><text>no interest is charged.</text> </paragraph></subsection><subsection id="idf45976a2c04249f49a3bb16f42995f44"><enum>(h)</enum><header>Civil penalty</header><text>A seller with respect to a covered contract that violates the requirements of this section shall be liable to the purchaser in the covered contract in an amount equal to—</text>
 <paragraph id="ida7f1c789396744d18e70ad8bac0e5a15"><enum>(1)</enum><text>the greater of—</text> <subparagraph id="id9de09bc7b11e4ca78a1407cd887125cb"><enum>(A)</enum><text>the actual damage caused to the purchaser by reason of the violation; and</text>
 </subparagraph><subparagraph id="idec55da6609c94fe49bc76e6f6fadd11c"><enum>(B)</enum><text>$10,000; and</text> </subparagraph></paragraph><paragraph id="id478e4e349af34e78a4ce68f9c40f7cc1"><enum>(2)</enum><text>the costs of any civil action and attorney’s fees.</text>
 </paragraph></subsection><subsection id="id51F1C054075F478AA1F02835A22DC69D"><enum>(i)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this Act, the Bureau shall promulgate regulations to carry out this section.</text>
 </subsection><subsection id="id5D28020603AB4716892EC88F7F5C7ADE"><enum>(j)</enum><header>GAO study</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study and submit to Congress a report on—</text>
 <paragraph id="id3B557C91F0B84B839EB68B8B8E336B7F"><enum>(1)</enum><text display-inline="yes-display-inline">the size and scope of the covered contract market; and</text>
 </paragraph><paragraph id="ida98452fae497467a8989b29f9e58f3db"><enum>(2)</enum><text>the predatory practices occurring within the covered contract market.</text></paragraph></subsection></section></legis-body></bill>
