 <section id="HE344BE675C6A4DB3B9B967EBEA3C985E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Medicaid Provides Opportunities for Widespread Equity, Resources, and Care Act</short-title></quote> or the <quote><short-title>EMPOWER Care Act</short-title></quote>.</text> </section><section id="H8221C715E60D4D51923BBDA31DE8C329"><enum>2.</enum><header>Extension of Money Follows the Person Rebalancing demonstration</header> <subsection id="HC70CD4687C9A47319CFCEB49E5EA3123"><enum>(a)</enum><header>Funding</header><text display-inline="yes-display-inline">Section 6071(h) of the Deficit Reduction Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note) is amended—</text>
 <paragraph id="H1D5BCCE4549C4852A2A4AD83D6D103E0"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph id="H3C8F6573D52B4CF3B0C9E117AC6364F0"><enum>(A)</enum><text>in subparagraph (E), by striking <quote>and</quote> after the semicolon;</text>
 </subparagraph><subparagraph id="H3A12479338924EF6B6BFE7196B3D7223"><enum>(B)</enum><text>in subparagraph (F)—</text> <clause id="H4FF761D2A57840C79995CB64BA85FBB2"><enum>(i)</enum><text>by striking <quote>subject to subparagraph (3), $112,000,000</quote> and inserting <quote>$450,000,000</quote>; and</text>
 </clause><clause id="H78176D7243B34659B98D47422FD62D30"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text> </clause></subparagraph><subparagraph id="H1DA0999A575E41568780A75D86FDB48C"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text>

 <subparagraph id="H604B20A690C0489491C80D85D749AB5E"><enum>(A)</enum><text>by striking <quote>Subject to paragraph (3), amounts</quote> and inserting <quote>Amounts</quote>; and</text> </subparagraph><subparagraph id="H66772D4B251D4B8DAB1F4ED42D0A3C8D"><enum>(B)</enum><text>by striking <quote>2021</quote> and inserting <quote>2023</quote>; and</text>
 </subparagraph></paragraph><paragraph id="HD5E406913C374F1DA5C8EC584CACC776"><enum>(3)</enum><text>by striking paragraph (3).</text> </paragraph></subsection><subsection id="HF4020228259F4D2396DC4EBC0BF2456D"><enum>(b)</enum><header>Research and evaluation</header><text>Section 6071(g) of the Deficit Reduction Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note) is amended—</text>
 <paragraph id="H1DDDFC6C50DD49D6B6A7BCA534533A21"><enum>(1)</enum><text>in paragraph (2), by striking <quote>2016</quote> and inserting <quote>2023</quote>; and</text> </paragraph><paragraph id="H7EC9FA5495984FB9923F337BC08692FA"><enum>(2)</enum><text>in paragraph (3), by inserting <quote>and for each of fiscal years 2019 through 2023,</quote> after <quote>2016,</quote>.</text>
				</paragraph></subsection></section><section id="HC06826DE0D624994933E138ACD952BE8"><enum>3.</enum><header>Changes to institutional residency period requirement</header>
 <subsection id="H45CB346E4C8445ADA79640BCC33E37F5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 6071(b)(2) of the Deficit Reduction Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note) is amended—</text> <paragraph id="HAD72A0ED47DE417681D01F898AF7E2EC"><enum>(1)</enum><text>in subparagraph (A)(i), by striking <quote>90</quote> and inserting <quote>60</quote>; and</text>
 </paragraph><paragraph id="HA80A34800A744947BFE45D586E00F757"><enum>(2)</enum><text>by striking the flush sentence after subparagraph (B).</text> </paragraph></subsection><subsection id="HA01543FB252544479FC52F112E7B5021"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on the date that is 30 days after the date of enactment of this Act.</text>
 </subsection></section><section id="HD851F44A8CDA4219A0BAD170B8D1AE5B"><enum>4.</enum><header>Updates to State application requirements</header><text display-inline="no-display-inline">Section 6071(c) of the Deficit Reduction Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note) is amended—</text> <paragraph commented="no" id="H05005316F4C341FEAF85126C2AFC7A0B"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>, which shall include</quote> and all that follows through <quote>2007</quote>;</text>
 </paragraph><paragraph commented="no" id="H9E00D22AE05843ECA5E9EDCB7EED868A"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (7)—</text> <subparagraph commented="no" id="H04E9E37CE073445591A850A4325A9103"><enum>(A)</enum><text display-inline="yes-display-inline">in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">Rebalancing</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Expenditures</header-in-text></quote>; and</text>
 </subparagraph><subparagraph commented="no" id="HD81C583CD6D04646938E37FA9BD57995"><enum>(B)</enum><text>in subparagraph (B)—</text> <clause commented="no" id="HD79736C4CE164A73B120ADA741A05A00"><enum>(i)</enum><text>in clause (i), by striking <quote>and</quote> after the semicolon;</text>
 </clause><clause commented="no" id="HAEA85E10FF1B47C98FB768CFD764D8AC"><enum>(ii)</enum><text>in clause (ii), by striking the period at the end and inserting a semicolon; and</text> </clause><clause commented="no" id="H77AF5F7AD5954EA180B2C3946C59B54E"><enum>(iii)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H9A2A08D66A9D4DEFA25DC32CF40023E8" style="OLC">
 <clause commented="no" id="H11CE4DD6460E4DD496B2E35D059B9D23" indent="up1"><enum>(iii)</enum><text>include a work plan that describes for each Federal fiscal year that occurs during the proposed MFP demonstration project—</text>
 <subclause commented="no" id="HC11450DE15E94F4B80FFFA55E3D96D59"><enum>(I)</enum><text>the use of grant funds for each proposed initiative that is designed to accomplish the objective described in subsection (a)(1), including a funding source for each activity that is part of each such proposed initiative;</text>
 </subclause><subclause commented="no" id="HD96EC59A53E046F5A5152049D457CA74"><enum>(II)</enum><text>an evaluation plan that identifies expected results for each such proposed initiative; and</text> </subclause><subclause commented="no" id="H4DAD49976EA9462A8B3D14D1C31897B2"><enum>(III)</enum><text>a sustainability plan for components of such proposed initiatives that are intended to improve transitions, which shall be updated with actual expenditure information for each Federal fiscal year that occurs during the MFP demonstration project; and</text>
 </subclause></clause><clause commented="no" id="H13E217A873DD41CE981E6B8E836B8BF2" indent="up1"><enum>(iv)</enum><text>contain assurances that grant funds used to accomplish the objective described in subsection (a)(1) shall be obligated not later than 24 months after the date on which the funds are awarded and shall be expended not later than 60 months after the date on which the funds are awarded (unless the Secretary approves a waiver of either such requirement).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </clause></subparagraph></paragraph><paragraph id="H2D97FAEDD75E40479E41372C750AC1A1"><enum>(3)</enum><text>in paragraph (13)—</text> <subparagraph id="HFCC5C77FE34646F1876EDAE63C9F91CA"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>; and</quote> and inserting <quote>, and in such manner as will meet the reporting requirements set forth for the Transformed Medicaid Statistical Management Information System (T–MSIS);</quote>;</text>
 </subparagraph><subparagraph id="H6C66C929A244448F969FD7D99FF45CED"><enum>(B)</enum><text>by redesignating subparagraph (B) as subparagraph (D); and</text> </subparagraph><subparagraph id="HF1A5098956984CB19358155860C17ADD"><enum>(C)</enum><text>by inserting after subparagraph (A) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H9C65673E79944A779B5ED9F2425094E2" style="OLC">
 <subparagraph id="H348CE0F9E440430793F2ABBE81AA51CC"><enum>(B)</enum><text>the State shall report on a quarterly basis on the use of grant funds by distinct activity, as described in the approved work plan, and by specific population as targeted by the State;</text>
 </subparagraph><subparagraph id="H2417B4DEAAC440C889618F7E10E6E03E"><enum>(C)</enum><text>if the State fails to report the information required under subparagraph (B), fails to report such information on a quarterly basis, or fails to make progress under the approved work plan, the State shall implement a corrective action plan and any lack of progress under the approved work plan may result in withholding of grant funds made available to the State; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></section><section id="H106A9C1B5D58407FBD85C3BE9C54CA6F"><enum>5.</enum><header>Funding for quality assurance and improvement; technical assistance; oversight</header><text display-inline="no-display-inline">Section 6071(f) of the Deficit Reduction Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note) is amended by striking paragraph (2) and inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="H003905A3264A42B5BAB195D4499C1BB9" style="OLC">
 <paragraph id="HA08145A6088F4BA7827766F380556A95"><enum>(2)</enum><header>Funding</header><text>From the amounts appropriated under subsection (h)(1) for each of fiscal years 2019 through 2023, $1,000,000 shall be available to the Secretary for each such fiscal year to carry out this subsection.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H2A9048F67D1C41F6AA6303169729E713"><enum>6.</enum><header>Best practices evaluation</header><text display-inline="no-display-inline">Section 6071 of the Deficit Reduction Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HD52FC4E52054486CBEB622B79E792DD5" style="OLC">
				<subsection id="H6F5DAACF61514AC48F5B4F71BECE53A2"><enum>(i)</enum><header>Best practices</header>
 <paragraph id="H6ECE6FDC359D4279859F354A388DD89C"><enum>(1)</enum><header>Report</header><text>The Secretary, directly or through grant or contract, shall submit a report to the President and Congress not later than September 30, 2020, that contains findings and conclusions on best practices from the State MFP demonstration projects carried out with grants made under this section. The report shall include information and analyses with respect to the following:</text>
 <subparagraph id="HE874E41417BC456AB384530F0B15E7E5"><enum>(A)</enum><text>The most effective State strategies for transitioning beneficiaries from institutional to qualified community settings carried out under the State MFP demonstration projects and how such strategies may vary for different types of beneficiaries, such as beneficiaries who are aged, physically disabled, intellectually or developmentally disabled, or individuals with serious mental illnesses, and other targeted waiver beneficiary populations.</text>
 </subparagraph><subparagraph id="HFBD42CB06BBC4F78BC136F6559589C3E"><enum>(B)</enum><text>The most common and the most effective State uses of grant funds carried out under the State MFP demonstration projects for transitioning beneficiaries from institutional to qualified community settings and improving health outcomes, including differentiating funding for current initiatives that are designed for such purpose and funding for proposed initiatives that are designed for such purpose.</text>
 </subparagraph><subparagraph id="H85BAFF5C41E942DCAA27FB30D58E2518"><enum>(C)</enum><text>The most effective State approaches carried out under State MFP demonstration projects for improving person-centered care and planning.</text>
 </subparagraph><subparagraph id="H771B9B6BBB0146F88E482F020EBFFEA0"><enum>(D)</enum><text>Identification of program, financing, and other flexibilities available under the State MFP demonstration projects, that are not available under the traditional Medicaid program, and which directly contributed to successful transitions and improved health outcomes under the State MFP demonstration projects.</text>
 </subparagraph><subparagraph id="H3852778C56FB4B7F8DA9331CCF08B0F4"><enum>(E)</enum><text>State strategies and financing mechanisms for effective coordination of housing financed or supported under State MFP demonstration projects with local housing authorities and other resources.</text>
 </subparagraph><subparagraph id="H4EF55D3AFB8943029D295D95D59A1DB2"><enum>(F)</enum><text>Effective State approaches for delivering Money Follows the Person transition services through managed care entities.</text>
 </subparagraph><subparagraph id="H06D7B8880CBC4F21BC656D4A9CFD5C89"><enum>(G)</enum><text>Other best practices and effective transition strategies demonstrated by States with approved MFP demonstration projects, as determined by the Secretary.</text>
 </subparagraph><subparagraph id="H367921AE7A89413283571C1CC97F01CE"><enum>(H)</enum><text>Identification and analyses of opportunities and challenges to integrating effective Money Follows the Person practices and State strategies into the traditional Medicaid program.</text>
 </subparagraph></paragraph><paragraph id="H5DC9A733D42048DFB5E021F4E8E70EF3"><enum>(2)</enum><header>Collaboration</header><text>In preparing the report required under this subsection, the Secretary shall collect and incorporate information from States with approved MFP demonstration projects and beneficiaries participating in such projects, and providers participating in such projects.</text>
 </paragraph><paragraph id="H29A4F6AE67F04F8284F0CEF98D8E65CF"><enum>(3)</enum><header>Funding</header><text>From the amounts appropriated under subsection (h)(1) for each of fiscal years 2019 through 2020, not more than $300,000 shall be available to the Secretary for each such fiscal year to carry out this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section commented="no" id="H869471061CA8413583CA9D688B714F64"><enum>7.</enum><header>MACPAC report on qualified settings criteria</header><text display-inline="no-display-inline">Section 6071 of the Deficit Reduction Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note), as amended by section 6, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HB6611488E1774F469B49119A6DCD82BC" style="OLC">
 <subsection commented="no" id="H7F7851A5FFA447FC9B35F23F05C9F43A"><enum>(j)</enum><header>MACPAC report</header><text display-inline="yes-display-inline">Prior to the final implementation date established by the Secretary for the criteria established for home and community-based settings in section 441.301(c)(4) of title 42, Code of Federal Regulations, as part of final implementation of the Home and Community Based Services (HCBS) Final Rule published on January 16, 2014 (79 Fed. Reg. 2947) (referred to in this subsection as the <term>HCBS final rule</term>), the Medicaid and CHIP Payment and Access Commission (MACPAC) shall submit to Congress a report that—</text>
 <paragraph commented="no" id="HC595A7E6EF1A4161B5715583A1AB55D1"><enum>(1)</enum><text>identifies the types of home and community-based settings and associated services that are available to eligible individuals in both the MFP demonstration program and sites in compliance with the HCBS final rule; and</text>
 </paragraph><paragraph commented="no" id="HCBBFA3BB57424DE19A10698E8BE88EA5"><enum>(2)</enum><text>if determined appropriate by the Commission, recommends policies to align the criteria for a qualified residence under subsection (b)(6) (as in effect on October 1, 2017) with the criteria in the HCBS final rule.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H65D4F8C75C544787A5DE462527353D75"><enum>8.</enum><header>Application to current projects</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, any State with an approved MFP demonstration project under section 6071 of the Deficit Reduction Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note) on the date of enactment of this Act shall submit a revised application to the Secretary that contains the same information and assurances as are required for any new State applicant under the amendments made by this Act.</text></section></legis-body></bill>
