		<official-title>To enable Federal employees and contractors to correct their credit reports to remove adverse items
			 of information reported as a result of a shutdown, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Federal Workers' Credit Act</short-title></quote>.</text>
 </section><section id="id0AE7D27EC526449D87916301BB080C4F"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 603 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id0B2EBBEFF03141F3BF5D1FA610ED5DC9" style="OLC">
 <subsection id="id5B638ACBFD28409AAE3A142FD2B2D2A5"><enum>(bb)</enum><header>Contractor</header><text>The term <term>contractor</term> has the meaning given the term in section 7101 of title 41, United States Code.</text> </subsection><subsection id="id151DBD6421DC4FB1B90243D0BF7FD1E8"><enum>(cc)</enum><header>Covered period</header><text>The term <term>covered period</term> means—</text>
 <paragraph id="idBBFF4E76FD524302B43E4FAF1A9F5847"><enum>(1)</enum><text>the period beginning on the date on which a shutdown begins and ending on the date that is 30 days after the date on which the shutdown ends; and</text>
 </paragraph><paragraph id="id89A9B0FFC7B0453C88540555230A7269"><enum>(2)</enum><text>with respect to the shutdown that began on December 21, 2018, and ended on January 25, 2019, the 60-day period beginning on the date of enactment of this Act.</text>
 </paragraph></subsection><subsection id="id9c636bb14d854c55b888da09f3180050"><enum>(dd)</enum><header>Federal worker</header><text>The term <term>Federal worker</term>—</text> <paragraph id="idAF77D218EFD5418A9CD362678ED0D78C"><enum>(1)</enum><text>means an employee of a Government agency that had a lapse in appropriations as a result of a shutdown; and</text>
 </paragraph><paragraph id="id76921EAB7B08409FA6F805EE4E8C3002"><enum>(2)</enum><text>includes an employee of a contractor that has a contract with a Government agency that had a lapse in appropriations as a result of a shutdown.</text>
 </paragraph></subsection><subsection id="id8BACF830B9CB4EBEB37EBE92F70B0307"><enum>(ee)</enum><header>Shutdown</header><text>The term <term>shutdown</term> means any period in which there is more than a 24-hour lapse in appropriations for any Government agency or Federal department as a result of a failure to enact a regular appropriations bill or continuing resolution that results in a delay or loss of payment or wages to a Federal worker.</text>
 </subsection><subsection id="id354C25A82BC34D7AB8086118132BD769"><enum>(ff)</enum><header>Small business concern</header><text>The term <term>small business concern</term> has the meaning given the term in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="idAD3E01AAD78E42B2BB3D05AEB700BFDC"><enum>3.</enum><header>Limitation on furnishing an adverse item of information resulting from the shutdown</header><text display-inline="no-display-inline">Section 623 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681s-2">15 U.S.C. 1681s–2</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id982C2C022AEB4DCA8272EE7535213B96" style="OLC">
 <subsection id="idE092644425154ADDB293040E1B695F72"><enum>(f)</enum><header>Limitation on furnishing adverse information resulting from a shutdown</header><text display-inline="yes-display-inline">A person shall not furnish any adverse item of information relating to a consumer during a covered period to any consumer reporting agency if the person has been notified by the consumer that—</text>
 <paragraph id="id4669e57a27ac488e99ed4ff8568f5810"><enum>(1)</enum><text>the ability of the consumer to make an on-time payment during the covered period has been materially affected by a shutdown; or</text>
 </paragraph><paragraph id="id53a58d92360f42c38572d031fb591ed5"><enum>(2)</enum><text>the late or missed payment by the consumer during the covered period was a result of a shutdown.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="idB0470F6E048F4C929993B1FB6EA01759"><enum>4.</enum><header>Prohibition on including an adverse item of information in consumer reports</header><text display-inline="no-display-inline">Section 605(a) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c">15 U.S.C. 1681c(a)</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idC118FB0CE29B4C739F0D76080FE098AA" style="OLC">
 <paragraph id="idD36D190E33FE49DC805AD716ED4AFA94"><enum>(9)</enum><text>An adverse item of information reported to the consumer reporting agency relating to a consumer during a covered period if—</text>
 <subparagraph id="id8DBE1C762C91459D9AAA06E8691B2490"><enum>(A)</enum><text>the consumer is a Federal worker listed in the database described in section 611(h)(2); or</text> </subparagraph><subparagraph id="id57CF750CA5864E1893A94C7C46E0B7A1"><enum>(B)</enum><text>the consumer has successfully requested the removal of an adverse item of information contained in the consumer's file pursuant to the process described in section 611(h)(4).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="idFFAD5334876841169E9870F3100F3906"><enum>5.</enum><header>Process for deleting negative information from consumer reports</header><text display-inline="no-display-inline">The Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681</external-xref> et seq.) is amended—</text> <paragraph id="id8FF700E8CEAD40BBA06315B867672731"><enum>(1)</enum><text>in section 609(c)(1)(B) (<external-xref legal-doc="usc" parsable-cite="usc/15/1681g">15 U.S.C. 1681g(c)(1)(B)</external-xref>)—</text>
 <subparagraph id="id10A7987D28BE418D8E5C109E1C63BBF7"><enum>(A)</enum><text>in clause (v), by striking <quote>and</quote> at the end;</text> </subparagraph><subparagraph id="id87B3956F3915490491BA7F89EAEE11A3"><enum>(B)</enum><text>in clause (vi), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </subparagraph><subparagraph id="id903E7BF906C14FACA7530B865DF2E396"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idC761E8205DD54D329962D537B12B6D52" style="OLC"> <clause id="id9477494DB5574769B7AEFAEADC5EB867"><enum>(vi)</enum><text>the right of a consumer to—</text>
 <subclause commented="no" display-inline="no-display-inline" id="id9AD742E31FF84D729DC2DE4C1746A5AF"><enum>(I)</enum><text display-inline="yes-display-inline">request the deletion of adverse items of information under section 611(h)(4); and</text> </subclause><subclause commented="no" display-inline="no-display-inline" id="id9C8D305A23CE4E3A96B96437E60D78AB"><enum>(II)</enum><text display-inline="yes-display-inline">request 2 consumer reports, without charge to the consumer, under section 611(h)(5).</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="id01062D2EEF324333B66C7CDF828228BC"><enum>(2)</enum><text>in section 611 (<external-xref legal-doc="usc" parsable-cite="usc/15/1681i">15 U.S.C. 1681i</external-xref>)—</text> <subparagraph id="idEE03EA55332A4C6092FF77460A4BE5EA"><enum>(A)</enum><text>in subsection (a)(1)(A), by inserting <quote>and subsection (h)</quote> before <quote>, if the completeness</quote>; and</text>
 </subparagraph><subparagraph id="id8152C8C4C5F4494F819C4D657A6D23FF"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id36094449471B42AFACCE15784750FF95" style="OLC"> <subsection id="id183ACF6D266B471A9F22D7E47987C700"><enum>(h)</enum><header>Deletion of adverse items of information resulting from a shutdown</header> <paragraph id="id72678B04810E44918017EC916A736AED"><enum>(1)</enum><header>Requirement to provide list of impacted Federal workers</header> <subparagraph id="idFF3C506B40D34C94A5AA1BDE61FA6368"><enum>(A)</enum><header>Recent shutdown</header><text>Not later than 30 days after the date of enactment of this subsection—</text>
 <clause id="id661AC09AE8F04EB9A6CB27BCFFE740DB"><enum>(i)</enum><text>each Government agency for which there was a lapse in appropriations during the shutdown that ended on January 25, 2019, shall provide to the Bureau a list of each Federal worker who was furloughed or required to work without pay for any period of time during a shutdown; and</text>
 </clause><clause id="id277E030E26BB4164ACE6707B978F85EC"><enum>(ii)</enum><text>each Federal contractor impacted by the shutdown that ended on January 25, 2019, shall provide to the Bureau a list of each employee whose pay was reduced or delayed as a result of a shutdown.</text>
 </clause></subparagraph><subparagraph id="idC225DB0B4C194B77A1A03392299BCC2B"><enum>(B)</enum><header>Subsequent shutdowns</header><text>With respect to a shutdown beginning after January 25, 2019, not later than 3 days after the date on which the shutdown ends—</text>
 <clause id="id375C230D661445F8AD826CBFF4575BA6"><enum>(i)</enum><text>each Government agency for which there was a lapse in appropriations shall provide to the Bureau a list of each Federal worker who was furloughed or required to work without pay for any period of time during the shutdown; and</text>
 </clause><clause id="iddcde279eb3994d5f8cce7ea690c315d7"><enum>(ii)</enum><text>each Federal contractor impacted by the shutdown shall provide to the Bureau a list of each employee whose pay was reduced or delayed as a result of the shutdown.</text>
 </clause></subparagraph></paragraph><paragraph id="id5B81F5F724E94F9FA2368CAC1FAC6A7C"><enum>(2)</enum><header>Database</header><text>The Bureau shall establish and maintain a secure database that—</text> <subparagraph id="id12B6F9ABBAC0408E9769298F0769A9B6"><enum>(A)</enum><text>is accessible to consumer reporting agencies described in section 603(p) and nationwide specialty consumer reporting agencies to check and automatically delete any adverse item of information reported during a covered period with respect to a Federal worker under paragraph (3); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0CE7571A094E4034A454E45EF0067445"><enum>(B)</enum><text>contains the information reported under paragraph (1).</text> </subparagraph></paragraph><paragraph id="idA6B7E7BB0DFC4C98BD2EFBE827570676"><enum>(3)</enum><header>Deletion of adverse items of information by nationwide consumer reporting and nationwide specialty consumer reporting agencies</header> <subparagraph id="id7A7EBB16A90C4782A8675690C9BEB3FA"><enum>(A)</enum><header>In general</header><text>Each consumer reporting agency described in section 603(p) and each nationwide specialty consumer reporting agency shall, using the information contained in the database established under paragraph (2), delete from the file of each Federal worker named in the database each adverse item of information reported to the agency during the covered period.</text>
 </subparagraph><subparagraph id="idF650BC3100B447F99E553A4826AE19EE"><enum>(B)</enum><header>Timeline</header><text>Each agency described in subparagraph (A) shall—</text> <clause id="idCA613CB5CD5043DB946CF8C25CCDB8AC"><enum>(i)</enum><text>delete adverse items of information as soon as practicable after information that is reported under paragraph (1) appears in the database established under paragraph (2); and</text>
 </clause><clause id="idD68EEB5776994BB8B53530C17B657B0D"><enum>(ii)</enum><text>not later than the date that is 3 days after the end of a covered period, delete any remaining adverse items of information that were reported between the date on which adverse items of information were deleted under clause (i) and the end of the covered period.</text>
									</clause></subparagraph></paragraph><paragraph id="id7F12411526084BF1BD97552E60D88430"><enum>(4)</enum><header>Request for deletion of adverse items of information</header>
 <subparagraph id="idBFA4BB235B0B411AB2209F8C7BF7DD4C"><enum>(A)</enum><header>In general</header><text>A consumer who is an employee or owner of a small business concern and who was materially affected by a shutdown may submit a request, without charge to the consumer, to a consumer reporting agency to delete from the consumer's file an adverse item of information reported to the consumer reporting agency during the covered period.</text>
 </subparagraph><subparagraph id="idC8B62A4ECEB048159168F37E7D486925"><enum>(B)</enum><header>Timing</header><text>A consumer may submit a request under subparagraph (A)—</text> <clause id="id5991D2A3AFDF4B5BB6C2E87D07D304C5"><enum>(i)</enum><text>with respect to the shutdown that ended on January 25, 2019, not later than 90 days after the date of enactment of this subsection; and</text>
 </clause><clause id="id53B5AC48AD844759BD46525ED38DD854"><enum>(ii)</enum><text>with respect to a shutdown beginning after January 25, 2019, not later than 90 days after the date on which the shutdown ends.</text>
 </clause></subparagraph><subparagraph id="idBF564AD460C24155BE1B22A48BB85C52"><enum>(C)</enum><header>Removal and notification</header><text>Upon receiving a request under this paragraph to delete an adverse item of information, a consumer reporting agency shall—</text>
 <clause id="idABBDEE8A4CB1427EB9BCEFD17CBFC047"><enum>(i)</enum><text>delete the adverse item of information from the consumer's file if the consumer provides documentation to the consumer reporting agency that the consumer is—</text>
 <subclause id="id0C5B4EEF817D413CB5DD41200B37FF9E"><enum>(I)</enum><text>a Federal worker whose pay was delayed or reduced during the covered period; or</text> </subclause><subclause id="id4BE78EEAC4DE4273914298ABEE99208D"><enum>(II)</enum><text>an employee or owner of a small business concern who was materially affected by a shutdown; and</text>
 </subclause></clause><clause id="id536A3495B31940849276FFEA03BFB623"><enum>(ii)</enum><text>notify the consumer and the furnisher of the adverse item of information of the deletion.</text> </clause></subparagraph></paragraph><paragraph id="id8F360F99B042406E8D9F4C0F01384AF2"><enum>(5)</enum><header>Free credit reports</header> <subparagraph id="idADB54720689E49DA927067238C91736C"><enum>(A)</enum><header>In general</header><text>A consumer reporting agency shall make all disclosures pursuant to section 609 twice during the 12-month period following the end of a shutdown upon request by a consumer impacted by the shutdown and without charge to the consumer—</text>
 <clause id="idD3F93AD1293C4FA2882BEE7F7C4F3800"><enum>(i)</enum><text>with respect to the shutdown that ended on January 25, 2019, if the consumer makes a request within 180 days after the date of enactment of this subsection; and</text>
 </clause><clause id="id0006FE46AFC9431A8C38AD43B5E74E78"><enum>(ii)</enum><text>with respect to a shutdown beginning after January 25, 2019, if the consumer makes a request within 180 days after the date on which the shutdown ends.</text>
 </clause></subparagraph><subparagraph id="id7537FBD1A28A4ADC914517B3F2CC7FF0"><enum>(B)</enum><header>Timing</header><text>A consumer reporting agency shall provide a consumer report under subparagraph (A) not later than 15 days after the date on which the request is received under subparagraph (A).</text>
 </subparagraph><subparagraph id="idF6B2D812892F4AF5B613FA744D63A0F5"><enum>(C)</enum><header>Additional reports</header><text>A consumer report provided under subparagraph (A) shall be in addition to any report requested by the consumer under section 612(a).</text>
 </subparagraph><subparagraph id="idE310FD6275924E0581398433F7D5C47D"><enum>(D)</enum><header>Prohibition</header><text>A consumer reporting agency that receives a request under subparagraph (A) may not request or require any documentation from the consumer that demonstrates that the consumer was impacted by a shutdown as a condition of receiving the consumer report.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC605125614AB45058A555A8F46F26CE6"><enum>(6)</enum><header display-inline="yes-display-inline">Posting of rights</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, and immediately after the beginning of a shutdown, each consumer reporting agency shall prominently post and maintain a direct link on the homepage of the public website of the consumer reporting agency information relating to the right of consumers to—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id7E2616268F5946D1BD29486CBC5A9E9E"><enum>(A)</enum><text display-inline="yes-display-inline">request the deletion of adverse items of information under paragraph (4); and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3E59377754D74CF29FF93971B05E336D"><enum>(B)</enum><text display-inline="yes-display-inline">request 2 consumer reports, without charge to the consumer, under paragraph (5).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
