			 lymphedema compression treatment items as items of durable medical
			 equipment.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H4692DB76EA3D4077A75B9D15E79502F8" style="OLC">
 <section id="HB450AE12FA9D433EAC586B0BE1604EDE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lymphedema Treatment Act</short-title></quote>.</text> </section><section id="HDBB7574BBD0B46FFB843E26129110309"><enum>2.</enum><header>Medicare coverage of certain lymphedema compression treatment items as items of durable medical equipment</header> <subsection id="H6294150656F94BC0A13C88288D397ADA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended—</text>
 <paragraph id="H10CF09A318A641958694678CCBDA0FA2"><enum>(1)</enum><text>in subsection (n), in the first sentence, by inserting before the semicolon the following: <quote>and includes lymphedema compression treatment items (as defined in subsection (kkk))</quote>; and</text> </paragraph><paragraph id="H6A7BCE0D4409426BBA9A496D33C0BE75"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>
 <quoted-block display-inline="no-display-inline" id="H4D4DC38345634D58AD362779B93D67CB" other-style="archaic" style="other"><subsection display-inline="no-display-inline" id="H82A77653A3874DCEBE1280DD15D81821"><enum>(kkk)</enum><header>Lymphedema compression treatment items</header><text display-inline="yes-display-inline">The term <term>lymphedema compression treatment items</term>—</text> <paragraph id="HA25A008E72D540B9A8F49D957893597A"><enum>(1)</enum><text>means, with respect to an individual, compression garments, devices, bandaging systems, components, and supplies—</text>
 <subparagraph id="H34DF9AD12DBA4D1688D4FB102A7EF06F"><enum>(A)</enum><text>that are primarily and customarily used in the medical treatment of lymphedema;</text> </subparagraph><subparagraph id="HCC4D9BD5B1A84D3A9ECFE6907213B447"><enum>(B)</enum><text>as prescribed by a physician (or a physician assistant, nurse practitioner, or a clinical nurse specialist (as those terms are defined in section 1861(aa)(5)) to the extent authorized under State law); and</text>
 </subparagraph><subparagraph id="HEA26918A57BB4251977210DEBE2A00CF"><enum>(C)</enum><text>which would not, other than under subsection (s)(6), be included as medical and other health services under this title; and</text>
 </subparagraph></paragraph><paragraph id="HC6DF62DDD3D44FF8B8379250159CBA14"><enum>(2)</enum><text>includes—</text> <subparagraph id="HA16364CABCF44DDA9DDA91523F73B2E1"><enum>(A)</enum><text>multilayer compression bandaging systems;</text>
 </subparagraph><subparagraph id="H6984482B9EC3465983CAE5F8CAA233B6"><enum>(B)</enum><text>custom or standard fit gradient compression garments;</text> </subparagraph><subparagraph id="H90B9F580D8654593A38710DDDDCE6A1D"><enum>(C)</enum><text>non-elastic and low-elastic compression garments and compression wraps and directional flow pads; and</text>
 </subparagraph><subparagraph id="H0EC25A355CB3475A8CDFFB4E6315F79A"><enum>(D)</enum><text>any other compression garments, bandaging systems, devices, and aids determined by the Secretary to be effective in the prevention or treatment of lymphedema.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H49723D0C249248A693A72B9428003B02"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to lymphedema compression treatment items furnished on or after January 1, 2021.</text></subsection></section></legis-body></bill>
