			 internet, television, and voice services, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="HD587F4FBB4B24A8A98283AE59D7BAE7A" style="OLC">
 <section id="HEFCDCA1254B4418999CE3E523C1B57F4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Truth-in-Billing, Remedies, and User Empowerment over Fees Act of 2019</short-title></quote> or the <quote><short-title>TRUE Fees Act of 2019</short-title></quote>.</text> </section><section id="H19555824F380411892F4A5990B8F3258"><enum>2.</enum><header>Requirements relating to charges for covered services</header> <subsection id="H43A593571ED64395A58D34ED9FBF8A7B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title VII of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/601">47 U.S.C. 601</external-xref> et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H87D786F7089548819ADA25CB55B400A6" style="OLC">
					<section id="H35385A830D25419CA2297325FE83FEC3"><enum>723.</enum><header>Requirements relating to charges for covered services</header>
 <subsection id="H4F47E56D58E54ACB8130F526E744C3E8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H4E027844B330401F9C8EFF063AFBA242"><enum>(1)</enum><header>Alternative dispute resolution</header><text>The term <term>alternative dispute resolution</term> has the meaning given the term in section 3 of the Y2K Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6602">15 U.S.C. 6602</external-xref>).</text>
 </paragraph><paragraph commented="no" id="H8280545573664233A62581F8AD216E80"><enum>(2)</enum><header>Covered dispute</header><text display-inline="yes-display-inline">The term <term>covered dispute</term> means a dispute between a provider of a covered service and a consumer in which the consumer alleges that—</text>
 <subparagraph commented="no" id="HAF251F180D724DAF9A10F793A476AB46"><enum>(A)</enum><text>the amount charged by the provider for or relating to the provision of the covered service (including any related taxes, administrative fees, equipment rental fees, or other charges)—</text>
 <clause commented="no" id="HC6D4F5A5E27346BAB6C62951255AD1BE"><enum>(i)</enum><text>was increased without notice being provided to the consumer as required by subsection (d)(1)(A)(i); or</text>
 </clause><clause commented="no" id="HA8F32B30D3844FB182A9F989E050E70C"><enum>(ii)</enum><text>during the period covered by any promotional rate or other discount that was included in the price that the consumer agreed to pay for or relating to the provision of the covered service, did not reflect the promotional rate or other discount; or</text>
 </clause></subparagraph><subparagraph commented="no" id="HECBE846F8CD14E08A0AE9E6078A68FE9"><enum>(B)</enum><text display-inline="yes-display-inline">the provider billed the consumer—</text> <clause id="H14E0AB9E5FFE477D8E6928A333026FA0"><enum>(i)</enum><text>for the provision of a service or for any related taxes, administrative fees, or other charges to which the consumer did not subscribe during the period covered by the bill; or</text>
 </clause><clause id="H435887DB3F5946C1820B2F1F73746413"><enum>(ii)</enum><text>for rental of equipment or for any related taxes, administrative fees, or other charges that the consumer did not rent during the period covered by the bill.</text>
 </clause></subparagraph></paragraph><paragraph id="H8C5534F5FC8649AE93A0B193D10D5904"><enum>(3)</enum><header>Covered service</header><text>The term <term>covered service</term>—</text> <subparagraph id="HFD51CD027C3D42B4BF26A1BB2974F045"><enum>(A)</enum><text display-inline="yes-display-inline">means—</text>
 <clause id="HCC9AC7683A38489C86112FA5413287A7"><enum>(i)</enum><text>internet access service;</text> </clause><clause id="HC740BD749DFE4BE98B3F4BC962766F24"><enum>(ii)</enum><text>voice service, as defined in section 227(e)(8);</text>
 </clause><clause id="H1A5CA1DA01CC4603BC793205A7AD6BFB"><enum>(iii)</enum><text>commercial mobile service, as defined in section 332(d);</text> </clause><clause id="HF8E721443766486DB3CCE98789073BC6"><enum>(iv)</enum><text>commercial mobile data service, as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>); and</text>
 </clause><clause id="H58B8119326F8460F94E0BF5A55CA5CC1"><enum>(v)</enum><text>service provided by a multichannel video programming distributor, as defined in section 602, to the extent the distributor is acting as a multichannel video programming distributor; and</text>
 </clause></subparagraph><subparagraph commented="no" id="H5907B6684380440186505183E518E8F9"><enum>(B)</enum><text>includes any other service offered or provided as part of a bundle or package with any service referred to in subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="H1F4BB3C9E39445229FED5A746AE7403D"><enum>(4)</enum><header>Internet access service</header><text display-inline="yes-display-inline">The term <term>internet access service</term>—</text> <subparagraph id="H3E87D046455D4EF281FF7135A622EAC0"><enum>(A)</enum><text>means a mass-market retail service by wire or radio that provides the capability to transmit data to and receive data from all or substantially all internet endpoints, including any capabilities that are incidental to and enable the operation of the communications service; and</text>
 </subparagraph><subparagraph commented="no" id="H57007C6292C94BC9A0FC8F46AB1EFDC9"><enum>(B)</enum><text>includes any service that—</text> <clause commented="no" id="HDBCB556536B74A16A6267579A678F388"><enum>(i)</enum><text>the Commission finds to be providing a functional equivalent of the service described in subparagraph (A); or</text>
 </clause><clause commented="no" id="HDC4FF651027F43F4908E7B5B98148408"><enum>(ii)</enum><text>is used to evade the protections set forth in this section.</text> </clause></subparagraph></paragraph></subsection><subsection id="H5398A62CC7904316A764F4D4688EAFB1"><enum>(b)</enum><header>Transparency in advertising</header> <paragraph id="HD3E680839BBE4C4580FA9E528CC71E7A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a provider of a covered service may not advertise the price of the covered service unless the advertised price is the total amount that the provider will charge for or relating to the provision of the covered service, including any related taxes, administrative fees, equipment rental fees, or other charges, to a consumer who accepts the offer made in the advertisement.</text>
 </paragraph><paragraph id="HD8CD1FD2CD7A4AE7B75C297CB0ED9954"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) does not require a provider of a covered service to include in the advertised price of the covered service any tax, fee, or other charge that—</text>
 <subparagraph id="HE2CCFA12276640948CDD68E953D7DAE1"><enum>(A)</enum><text>the provider is required to charge under any provision of Federal law or of the law of a State or political subdivision of a State; and</text>
 </subparagraph><subparagraph id="HC0E2A1C2B1AE4EAF8B6F6325C05601E8"><enum>(B)</enum><text>is not uniform throughout the United States.</text> </subparagraph></paragraph></subsection><subsection id="HA8B35E23DCE3469F8B37F63E4F6F9041"><enum>(c)</enum><header>Transparency in e-billing</header><text display-inline="yes-display-inline">A provider of a covered service may not provide a bill to a consumer in an electronic format unless the provider—</text>
 <paragraph id="H10C02ACEC9234ED0A38A1AF0C40F5943"><enum>(1)</enum><text>provides the bill, or a notification that the bill is available, by email or a functional equivalent of email that permits the consumer to view the bill or notification without having to access an online account or the functional equivalent of an online account or to take any similar additional steps; and</text>
 </paragraph><paragraph id="H812D838011224494B9DAF3532677608B"><enum>(2)</enum><text>includes in the bill or notification provided in accordance with paragraph (1) an itemized statement that breaks down the total amount charged for or relating to the provision of the covered service by the amount charged for the provision of the covered service itself and the amount of any related taxes, administrative fees, equipment rental fees, or other charges, in the same level of detail as would be provided in a paper bill.</text>
							</paragraph></subsection><subsection id="H222E2D2F192D4AE5AE971E542A82B6B1"><enum>(d)</enum><header>Requirements for increases in charges</header>
 <paragraph id="H75C96966C6EC452CB7F169430136A2CC"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), in the case of a provider of a covered service that enters into a contract with a consumer for the provision of the covered service—</text>
 <subparagraph id="H796801DC052E449C96AB48B1958E77B9"><enum>(A)</enum><text display-inline="yes-display-inline">if the provider increases the total amount charged for or relating to the provision of the covered service under the contract, regardless of the amount of the increase or whether the increase is in the amount charged for the provision of the covered service itself or in any related taxes, administrative fees, equipment rental fees, or other charges, the provider shall—</text>
 <clause id="H3F7C750996024ADDA037A626B11103DE"><enum>(i)</enum><text>provide the consumer with clear notice of the increase not later than 21 days before the increase takes effect, in the same manner in which the provider provides to the consumer a notification that the consumer’s bill is available or, if no separate notification is provided, in the same manner as the provider provides the consumer’s bill to the consumer; and</text>
 </clause><clause id="HDE50B112705340ACB784F1EC3651A4C2"><enum>(ii)</enum><text>permit the consumer to terminate the contract without paying any early termination fee or other penalty; and</text>
 </clause></subparagraph><subparagraph id="HCC4584300CE14C22AD2BA2298C41BCB2"><enum>(B)</enum><text>the provider may not increase any fee or other charge for equipment rental unless the equipment is upgraded, whether through a hardware or software upgrade, so as to provide a substantial increase in functionality.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H0623C343438F4B40A7588EBE7E6622D3"><enum>(2)</enum><header>Exception for additional or upgraded service requested by consumer</header><text display-inline="yes-display-inline">Paragraph (1)(A) does not apply with respect to an increase resulting from the provision, at the request of the consumer, of a service that is in addition to, or an upgrade of, a service covered by the contract.</text>
							</paragraph></subsection><subsection commented="no" id="HE36950BFD7644CB192868375F2B3977B"><enum>(e)</enum><header>Prohibition on compulsory alternative dispute resolution</header>
 <paragraph commented="no" id="H70491992B7964458A4D73E4BF42F6A6E"><enum>(1)</enum><header>Prohibition on contractual provision</header><text display-inline="yes-display-inline">A provider of a covered service may not include in a contract with a consumer for the provision of the covered service a provision that requires the consumer to resolve a covered dispute with the provider through alternative dispute resolution.</text>
 </paragraph><paragraph commented="no" id="H75DC80AD4917481F8B5292DE9C1A22FE"><enum>(2)</enum><header>Unenforceability of contractual provision</header><text display-inline="yes-display-inline">Any alternative dispute resolution provision included in a contract in violation of paragraph (1) shall be void and unenforceable.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HF2486947B8934FD5A5091EC715399AF3"><enum>(b)</enum><header>Transitional rule relating to definition of voice service</header><text display-inline="yes-display-inline">Subsection (e)(3)(A)(ii) of section 723 of the Communications Act of 1934, as added by subsection (a) of this section, shall apply before the effective date of the amendment made to subsection (e)(8) of section 227 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>) by section 503(a)(2)(C) of division P of the Consolidated Appropriations Act, 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>) as if such amendment was already in effect.</text>
 </subsection><subsection id="H7C43456C835C488D918DC4BE2B76BD09"><enum>(c)</enum><header>Effective date</header><text>Section 723 of the Communications Act of 1934, as added by subsection (a) of this section, shall apply beginning on the date that is 180 days after the date of enactment of this Act, except that subsections (d) and (e) of such section 723 shall not apply with respect to a contract entered into, and as in effect, before the date that is 180 days after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
