			 and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>America's Public Land Act of 2019</short-title></quote>.</text>
 </section><section id="id1b5720523ab94d038261621b79f15d28"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> <paragraph id="id157ce4c29a684b4093e5f48cda674f1e"><enum>(1)</enum><text>public land in the United States is—</text>
 <subparagraph id="id5DD89C8923EA47708EFBAC4E615FE2B4"><enum>(A)</enum><text>iconic, including national parks, wildlife refuges, and national forests; and</text> </subparagraph><subparagraph id="idBCFFFD621B6F497781D009BC2FE9E428"><enum>(B)</enum><text>irreplaceable, including wildlife habitat, archaeological resources, and other national treasures;</text>
 </subparagraph></paragraph><paragraph id="id182384cac72749c6a588576966cf79ea"><enum>(2)</enum><text>public land—</text> <subparagraph id="id2790269DBEFF4675AD212F4A148BD4A8"><enum>(A)</enum><text>provides unrivaled recreational opportunities; and</text>
 </subparagraph><subparagraph id="id8B108C0AF22E40E3B6D02CE79592F5D5"><enum>(B)</enum><text>is enjoyed by hundreds of millions of people in the United States each year;</text> </subparagraph></paragraph><paragraph id="id74145ca19ccb45999aef7d64062b063e"><enum>(3)</enum><text>public land—</text>
 <subparagraph id="idD0CEB857676144899EEC70AC8E720260"><enum>(A)</enum><text>strengthens the United States economy; and</text> </subparagraph><subparagraph id="idFFE0175256C34542B22E84A889FF3224"><enum>(B)</enum><text>powers a recreation industry that supports—</text>
 <clause id="id2507DF91DEBE4A5BACACE64DFE60EFEB"><enum>(i)</enum><text>7,600,000 jobs; and</text> </clause><clause id="id6BBF2BC417FF49218CD96D70D2F60AFE"><enum>(ii)</enum><text>nearly $900,000,000,000 in direct spending annually;</text>
 </clause></subparagraph></paragraph><paragraph id="idd5fb0f2b88034d7f82865c797d6e8d95"><enum>(4)</enum><text>United States public land provides numerous other benefits to the people of the United States, including—</text>
 <subparagraph id="id6DCAC7C73E704E2092FF7772AC40B170"><enum>(A)</enum><text>clean air and water;</text> </subparagraph><subparagraph id="id765CF5EDE20D460F976F4B2FE316E2E1"><enum>(B)</enum><text>public health gains; and</text>
 </subparagraph><subparagraph id="id464A2B65D78C459790E6806D0CC4C324"><enum>(C)</enum><text>access to the outdoors;</text> </subparagraph></paragraph><paragraph id="id778f35ecb0164d57b49d30527eb12b99"><enum>(5)</enum><text>retaining United States public land is in the public interest; and</text>
 </paragraph><paragraph id="idf03f903da6ea4d68a5efbdbd9f12309d"><enum>(6)</enum><text>except as expressly authorized by Congress, United States public land should be retained under the ownership of the United States.</text>
 </paragraph></section><section id="id8b2b17760fb74187bfe2c0ecbc5d4029"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="id9c715a96eb6b4d348bd0a2980e779d30"><enum>(1)</enum><header>Management authority</header><text>The term <term>management authority</term> means—</text>
 <subparagraph id="idc2fcbc4cd1fc4a18917d0a7212518fb2"><enum>(A)</enum><text>the ability to determine—</text> <clause id="ide277a61d5835431e89420b6750c7de3a"><enum>(i)</enum><text>which uses to permit on public land, including uses relating to—</text>
 <subclause id="id22891FC1020441258A2D985BB4148174"><enum>(I)</enum><text>timber;</text> </subclause><subclause id="idFDCF9B94A1754A3186E3A806A3985992"><enum>(II)</enum><text>grazing;</text>
 </subclause><subclause id="idE54CEE70D9DA4C429D4CB10C1037210C"><enum>(III)</enum><text>renewable and nonrenewable energy and mineral resources;</text> </subclause><subclause id="idB1DA481954D2434C98F40FB93B510419"><enum>(IV)</enum><text>recreation; and</text>
 </subclause><subclause id="id1328228C3EDD4F2C975EE5F94725E06A"><enum>(V)</enum><text>vegetation management; or</text> </subclause></clause><clause id="id3c6c377a6c844a048e153ce9b1bfc952"><enum>(ii)</enum><text>where and how those uses of public land take place; and</text>
 </clause></subparagraph><subparagraph id="id2f25e0ddbf5548cabee3a059a9bef289"><enum>(B)</enum><text>the ability to regulate, permit, or authorize use of public land.</text> </subparagraph></paragraph><paragraph id="ida99774c0b74b444c89ca0d10eee2f0a7"><enum>(2)</enum><header>Public land</header> <subparagraph id="id144335A50807472D95CE090DE4673426"><enum>(A)</enum><header>In general</header><text>The term <term>public land</term> means any land or interest in land—</text>
 <clause id="id433913B03E1C442D9D403914DA217AE3"><enum>(i)</enum><text>owned by the United States; and</text> </clause><clause id="idC6067C953AA949158ABE0D78022A6807"><enum>(ii)</enum><text>administered by—</text>
 <subclause id="idb6314a6d5c85418cb0e9f45bc1bbcfa1"><enum>(I)</enum><text>the Secretary of the Interior, acting through—</text> <item id="id443DF99F0F60440F8C1AFB37B5601C03"><enum>(aa)</enum><text>the Director of the Bureau of Land Management;</text>
 </item><item id="idDD51E51EA9D14DB29F0A0518EADA909C"><enum>(bb)</enum><text>the Director of the National Park Service; or</text> </item><item id="idC6E2504C758B45E083CEF24C8A69C8BD"><enum>(cc)</enum><text>the Director of the United States Fish and Wildlife Service; or</text>
 </item></subclause><subclause id="idf120b64c5ea746aa9dad42cb11504627"><enum>(II)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service.</text> </subclause></clause></subparagraph><subparagraph id="id629734FC96CF45D29A8394031D56019C"><enum>(B)</enum><header>Exclusion</header><text>The term <term>public land</term> does not include land held in trust for the benefit of an Indian Tribe.</text>
 </subparagraph></paragraph><paragraph id="idaa5710d0e06e49aeb32bdbe930d19387"><enum>(3)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text> <subparagraph id="id951afa6230b949f49d3668fac7e3260e"><enum>(A)</enum><text>the Secretary of the Interior, with respect to land or an interest in land under the jurisdiction of the Department of the Interior; and</text>
 </subparagraph><subparagraph id="id6c5680350c11408a9a9388b7bef0a593"><enum>(B)</enum><text>the Secretary of Agriculture, with respect to land or an interest in land under the jurisdiction of the Department of Agriculture.</text>
 </subparagraph></paragraph></section><section id="id50eb989161174df3815d74ec75ca08cf"><enum>4.</enum><header>Reaffirmation of policy</header><text display-inline="no-display-inline">Congress reaffirms that the policy of the United States is—</text> <paragraph id="idec1a8c5e69da440e9962e669c7839f32"><enum>(1)</enum><text>to retain public land in Federal ownership unless the disposal of public land has been authorized by an Act of Congress;</text>
 </paragraph><paragraph id="id58ec7bafcce4420cbaad17e53bc0b522"><enum>(2)</enum><text>to retain management authority over public land, except in any case in which a non-Federal individual or entity is authorized to exercise management authority pursuant to—</text>
 <subparagraph id="id84600ED3197C4CAA87871326BB4A436D"><enum>(A)</enum><text>an Act of Congress; or</text> </subparagraph><subparagraph id="id9FA36D06482742F6B5B87AF8A14C8E42"><enum>(B)</enum><text>another applicable law; and</text>
 </subparagraph></paragraph><paragraph id="id3910ba17b24346788ce423682dccefdd"><enum>(3)</enum><text>that retention of public land and the management authority over public land is in the public interest.</text>
			</paragraph></section><section id="idbf63dd558c7c4f5781482c7cc22c673c"><enum>5.</enum><header>Retention requirements</header>
 <subsection id="id966D79546FF54E0AB8B47FA9BB494418"><enum>(a)</enum><header>Public land</header><text display-inline="yes-display-inline">Except as authorized by an Act of Congress, the Secretary concerned shall not approve or permit the conveyance of public land to any non-Federal individual or entity.</text>
 </subsection><subsection id="id5d6fa66d1506492eb2abcf9de8349650"><enum>(b)</enum><header>Management authority</header><text display-inline="yes-display-inline">Except as authorized by an Act of Congress or other applicable law, the Secretary concerned shall not approve or permit the granting of management authority over public land to any non-Federal individual or entity.</text>
 </subsection></section><section id="id61de246927444ce5804b7dc6f13eb1f8"><enum>6.</enum><header>Effect of Act</header><text display-inline="no-display-inline">Nothing in this Act—</text> <paragraph id="idbde5c6d79842453fb85393243be9c8db"><enum>(1)</enum><text>affects the jurisdiction of any State with respect to the management of fish or wildlife on public land;</text>
 </paragraph><paragraph id="ida9582f1c0a3740f998dc5771594d8429"><enum>(2)</enum><text>diminishes the rights of any Indian Tribe, including rights regarding access to public land for Tribal activities (including spiritual, cultural, and traditional food-gathering activities);</text>
 </paragraph><paragraph id="idba32aaeef50e43f19ff36d5cd4acb319"><enum>(3)</enum><text>alters, modifies, enlarges, diminishes, or abrogates the treaty rights of any Indian Tribe, including off-reservation reserved rights;</text>
 </paragraph><paragraph id="idda84e79cbcab499da3ec8a0c2e5cc50e"><enum>(4)</enum><text>creates an express or implied reservation by the United States of any water or water right for any purpose;</text>
 </paragraph><paragraph id="id728369679f4a48a994c4b5280b80bf1f"><enum>(5)</enum><text>affects, modifies, or affects the use or allocation, as in existence on the date of enactment of this Act, of any water, water right, or interest in water; or</text>
 </paragraph><paragraph id="idcaff703cb2c94c1082ecad21d4af7f9e"><enum>(6)</enum><text>affects any interstate water compact in existence on the date of enactment of this Act.</text></paragraph></section></legis-body></bill>
