		<official-title>To require the treatment of a lapse in appropriations as a mitigating condition when assessing
			 financial considerations for security clearances, and for other purposes.</official-title>

 <section id="id0C11D2FD033D4D9381B5E590180C5731" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Employees’ Security Clearances Act of 2019</short-title></quote>.</text> </section><section id="idE722ADABA83C4A4FA0CA0D3FD7661293" section-type="subsequent-section"><enum>2.</enum><header>Treatment of lapse in appropriations as mitigating condition in financial consideration for security clearances</header> <subsection id="id4A612559367442C4AF205A0D66EF1DDE"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id53140B4B0A6442DEB23320AFAFF762AC"><enum>(1)</enum><header display-inline="yes-display-inline">Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given the term <quote>Executive agency</quote> in section 105 of title 5, United States Code.</text> </paragraph><paragraph id="id6AC5EDB7984E4195A2043ADFB7CEE9BA"><enum>(2)</enum><header>Covered employee</header><text display-inline="yes-display-inline">the term <term>covered employee</term>—</text>
					<subparagraph id="idB2279F62DDF543CFA9C7167D4E30D69A"><enum>(A)</enum>
 <text>means—</text> <clause id="idC11EEC76CFEC4317928A9101ECC76432"><enum>(i)</enum><text>an officer or employee of the United States Government furloughed during a lapse in appropriations; and</text>
 </clause><clause id="idB326B8CDD35840A592D8E4B87BEEE359"><enum>(ii)</enum><text>an excepted employee or an employee performing emergency work, as such terms are defined by the Office of Personnel Management; and</text>
 </clause></subparagraph><subparagraph id="idCCD7D472713D41E9B95EF01940D6C481"><enum>(B)</enum><text>includes a contractor of an agency subject to a lapse in appropriations.</text> </subparagraph></paragraph><paragraph id="idD84EB81DD29641478D48099F8D00C00A"><enum>(3)</enum><header>National security eligibility</header><text>The term <term>national security eligibility</term> has the meaning given such term in Security Executive Agent Directive 4 (relating to National Security Adjudicative Guidelines), as in effect on the day before the date of the enactment of this Act.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFBADEC8B1317438E8DE793A4C2CDA7BC"><enum>(4)</enum><header>Security Executive Agent</header><text>The term <term>Security Executive Agent</term> means the official acting as the Security Executive Agent in accordance with Executive Order 13467 (73 Fed. Reg. 38103; <external-xref legal-doc="usc" parsable-cite="usc/50/3161">50 U.S.C. 3161</external-xref> note; relating to reforming processes related to suitability for government employment, fitness for contractor employees, and eligibility for access to classified national security information), or successor order.</text>
 </paragraph></subsection><subsection id="id17DF6E1A77B143C49C57224691FAA01A"><enum>(b)</enum><header>In general</header><text>Whenever the head of an agency determines whether to grant a covered employee national security eligibility or continue a covered employee's national security eligibility, the head shall consider a lapse in appropriations a condition that could mitigate a security concern with respect to financial considerations.</text>
 </subsection><subsection id="idB1E887BBE6124E18BAD78AB4832D3E00"><enum>(c)</enum><header>Credit scores or negative information in a consumer credit file</header><text display-inline="yes-display-inline">No head of an agency may revoke the national security eligibility of a covered employee because of a reduction in the credit score or negative information in a consumer credit file of the covered employee that is attributable to disrupted income payments as a result of a lapse in appropriations.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idA47820889CDC4DEA8B3AC5CDB81256E9"><enum>(d)</enum><header>Modification of policies, guidelines, and directives</header><text>Not later than 60 days after the date of the enactment of this Act, the Security Executive Agent shall revise such policies, guidelines, and directives, including the Security Executive Agent Directive 4 (relating to National Security Adjudicative Guidelines), or successor directive, as may be necessary to carry out this section.</text>
