			 immunity as a defense in certain actions before the United States Patent
			 and Trademark Office, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preserving Access to Cost Effective Drugs Act</short-title></quote> or the <quote><short-title>PACED Act</short-title></quote>.</text>
		</section><section id="idF81500931F0D4C368E33C65FF4F52D2B"><enum>2.</enum><header>Abrogation of sovereign immunity</header>
 <subsection id="id2EDA196BF4C24AC1AD3491CE6493319C"><enum>(a)</enum><header>In general</header><text>Title 35, United States Code, is amended—</text> <paragraph id="idAF35BA9EFCEF4C1781073CA400AC8C30"><enum>(1)</enum><text>in section 135, by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id7E4C6696EFD4475B98D2FB5286E0F394" style="OLC">
						<subsection id="id2BA4986249F7451C882C8CCF29FFE3D2"><enum>(g)</enum><header>Sovereign immunity</header>
 <paragraph id="id56CDE671307F44BBA5BEBD9EADB9D584"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text> <subparagraph id="idE7CCB94423FF470E83204588C9ED102C"><enum>(A)</enum><text>the term <term>foreign state</term> has the meaning given the term in section 1603(a) of title 28; and</text>
 </subparagraph><subparagraph id="id58A1A22CBB0946529443D7AD0CF8167E"><enum>(B)</enum><text>the term <term>Indian tribe</term> has the meaning given the term in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="id38259D9AE3A545E0948E1FDB1D7D7B26"><enum>(2)</enum><header>Abrogation of sovereign immunity</header><text>Except as provided in paragraph (3), and subject to paragraph (4), a patent owner may not assert sovereign immunity, including the sovereign immunity accorded to an Indian tribe, as a defense in—</text>
 <subparagraph id="id617B9A649AE1485892F6B7F93A5F8325"><enum>(A)</enum><text>a derivation proceeding instituted under subsection (a); or</text> </subparagraph><subparagraph id="idB68919D84F00436FB4B071775B3E234B"><enum>(B)</enum><text>a review by a court of the United States with respect to a decision reached in a proceeding described in subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="id65DF911C59F9489E8FE59CBB79A5441C"><enum>(3)</enum><header>Immunity of foreign states</header><text>If a patent owner is a foreign state, for the purposes of any proceeding described in paragraph (2)(A), the Patent Trial and Appeal Board shall determine whether the patent owner is immune from the jurisdiction of the Patent Trial and Appeal Board, in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/97">chapter 97</external-xref> of title 28 as if the Patent Trial and Appeal Board were a court of the United States.</text>
 </paragraph><paragraph id="id8288D811756B4873AD92DA3D9F749D00"><enum>(4)</enum><header>Limitation</header><text>This subsection shall apply only to the extent permitted under the 11th amendment to the Constitution of the United States.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="idC6DB425EA6734890AD7C975620255AF0"><enum>(2)</enum><text>in section 296—</text> <subparagraph id="idD643E913846944A2AE58F9BFD62D2F45"><enum>(A)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">and State officials</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">, State officials, and Indian tribes</header-in-text></quote>; and</text>
 </subparagraph><subparagraph id="id15F1DC72D50B4886B8EF55DA6B0049EC"><enum>(B)</enum><text>by adding at the end the following:</text> <quoted-block act-name="" id="id0BD970E25BB24C4D83854DA32E4D4085" style="OLC"> <subsection id="idFA19EB9B1E854DB2B79F21C63FACC1C6"><enum>(c)</enum><header>Abrogation of tribal sovereign immunity</header> <paragraph id="id2971008CD1ED48438C2CA1A3645CAAC7"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text>
 <subparagraph id="id2E7F98AEF1D5473993D65A19CB5F44D6"><enum>(A)</enum><text>the term <term>covered claim</term> means any claim, counterclaim, or third-party claim that arises under—</text> <clause id="id157253CE687E47099876B4074A0219AA"><enum>(i)</enum><text>this title relating to infringement of a patent; or</text>
 </clause><clause id="id7E340D51439948D0BDAD8EDDCF3D2C45"><enum>(ii)</enum><text>section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>); and</text> </clause></subparagraph><subparagraph id="id0E79C0FDDF07480F91727328745E7632"><enum>(B)</enum><text>the term <term>Indian tribe</term> has the meaning given the term in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="idD7541C93F0C04DEEB65904233D73512D"><enum>(2)</enum><header>Abrogation</header><text>In any action that involves a covered claim that is otherwise within the jurisdiction of a court of the United States, an Indian tribe may not assert sovereign immunity as a defense.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="idB44259D2C568418396421C79B5D2259F"><enum>(3)</enum><text>in section 305—</text> <subparagraph id="id7D54B4CC45684D8DAB5EBE0468685F47"><enum>(A)</enum><text>in the first sentence, by striking <quote>After the</quote> and inserting the following:</text>

 <paragraph id="id4271654266954ED78A4EE713290ED434"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text> <subparagraph id="id04631AC5636746DDB7592927D6D61DAA"><enum>(A)</enum><text>the term <term>foreign state</term> has the meaning given the term in section 1603(a) of title 28; and</text>
 </subparagraph><subparagraph id="id9CC74A9E09424D33901C9CD6C78AF2A3"><enum>(B)</enum><text>the term <term>Indian tribe</term> has the meaning given the term in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="idAC8151997ACA449CB847697C94CC73D8"><enum>(2)</enum><header>Abrogation of sovereign immunity</header><text>Except as provided in paragraph (3), and subject to paragraph (4), a patent owner may not assert sovereign immunity, including the sovereign immunity accorded to an Indian tribe, as a defense in—</text>
 <subparagraph id="id8EF8E4DE20F840F7A957EC57870648D9"><enum>(A)</enum><text>any reexamination proceeding under this section, including any appeal to the Patent Trial and Appeal Board; or</text>
 </subparagraph><subparagraph id="idEE5205363AEF462CA2C723503B645EBB"><enum>(B)</enum><text>a review by a court of the United States with respect to a decision reached in a proceeding described in subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="id62F0F00A452E4B97ADBFED454C925E14"><enum>(3)</enum><header>Immunity of foreign states</header><text>If a patent owner is a foreign state, for the purposes of any proceeding described in paragraph (2)(A), the Office or the Patent Trial and Appeal Board, as applicable, shall determine whether the patent owner is immune from the jurisdiction of the Office or the Patent Trial and Appeal Board, as applicable, in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/97">chapter 97</external-xref> of title 28 as if the Office or the Patent Trial and Appeal Board, as applicable, were a court of the United States.</text>
 </paragraph><paragraph id="id8FABB838404D4353A478D1B6FD5B1884"><enum>(4)</enum><header>Limitation</header><text>This subsection shall apply only to the extent permitted under the 11th amendment to the Constitution of the United States.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="idEC9684AE026244DD8335BD0EFCC443D2"><enum>(4)</enum><text>in section 316, by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idC6B4ADA2404D4C43B1BCE3B67526EC79" style="OLC"> <subsection id="id24328C148392482EBD0A631C0283CFC2"><enum>(f)</enum><header>Sovereign immunity</header> <paragraph id="idB4977E5CB29A44DA95DF9CD6D7CB6810"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text>
 <subparagraph id="idA7F04E9EDC834DF7A806EFF8AA44CE37"><enum>(A)</enum><text>the term <term>foreign state</term> has the meaning given the term in section 1603(a) of title 28; and</text> </subparagraph><subparagraph id="id30866AD8768F45CB87D2B9FD3BF8F716"><enum>(B)</enum><text>the term <term>Indian tribe</term> has the meaning given the term in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="id46681B48946F4EBB83D60CAAAA799BDE"><enum>(2)</enum><header>Abrogation of sovereign immunity</header><text>Except as provided in paragraph (3), and subject to paragraph (4), a patent owner may not assert sovereign immunity, including the sovereign immunity accorded to an Indian tribe, as a defense in—</text>
 <subparagraph id="id702E8A2AC73E4B439E31122D62738115"><enum>(A)</enum><text>an inter partes review instituted under this chapter; or</text> </subparagraph><subparagraph id="idDB7399B1DB954806A4B8180E36E81F63"><enum>(B)</enum><text>a review by a court of the United States with respect to a decision reached in a proceeding described in subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="idA9054D9F1BD64193A11918F3725A3ABC"><enum>(3)</enum><header>Immunity of foreign states</header><text>If a patent owner is a foreign state, for the purposes of any review described in paragraph (2)(A), the Patent Trial and Appeal Board shall determine whether the patent owner is immune from the jurisdiction of the Patent Trial and Appeal Board, in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/97">chapter 97</external-xref> of title 28 as if the Patent Trial and Appeal Board were a court of the United States.</text>
 </paragraph><paragraph id="id69598827F1F74A9EBA565EE80EB50FC6"><enum>(4)</enum><header>Limitation</header><text>This subsection shall apply only to the extent permitted under the 11th amendment to the Constitution of the United States.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id7D735C4FFC1A4D52911E2939A3C2EDC4"><enum>(5)</enum><text>in section 326, by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idA5689373856A4F1081751FB7C51C1648" style="OLC"> <subsection id="idF7489B10FB81457194CB086302D9C3F0"><enum>(f)</enum><header>Sovereign immunity</header> <paragraph id="id96807F0886A846318A7D192C33357C01"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text>
 <subparagraph id="idBB36186967B746339980F532965A2C52"><enum>(A)</enum><text>the term <term>foreign state</term> has the meaning given the term in section 1603(a) of title 28; and</text> </subparagraph><subparagraph id="idC3C7F1FF846346BFB5913B6147EBE3F9"><enum>(B)</enum><text>the term <term>Indian tribe</term> has the meaning given the term in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="id688E2EC989314E5F993D114F76664C75"><enum>(2)</enum><header>Abrogation of sovereign immunity</header><text>Except as provided in paragraph (3), and subject to paragraph (4), a patent owner may not assert sovereign immunity, including the sovereign immunity accorded to an Indian tribe, as a defense in—</text>
 <subparagraph id="idCCCDE2B149CB4DCEAE301A8653B9BA1D"><enum>(A)</enum><text>a post-grant review instituted under this chapter; or</text> </subparagraph><subparagraph id="idD54B351911554335AB50C1090F57B5E2"><enum>(B)</enum><text>a review by a court of the United States with respect to a decision reached in a proceeding described in subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="id2C0BBE9CF6E7446A977D19EDA8A5562F"><enum>(3)</enum><header>Immunity of foreign states</header><text>If a patent owner is a foreign state, for the purposes of any review described in paragraph (2)(A), the Patent Trial and Appeal Board shall determine whether the patent owner is immune from the jurisdiction of the Patent Trial and Appeal Board, in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/97">chapter 97</external-xref> of title 28 as if the Patent Trial and Appeal Board were a court of the United States.</text>
 </paragraph><paragraph id="id764C95CED1924D338BA337BBA8D60D64"><enum>(4)</enum><header>Limitation</header><text>This subsection shall apply only to the extent permitted under the 11th amendment to the Constitution of the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id0DF8995588D54E23AA10CC527C464762"><enum>(b)</enum><header>Amendments to the Tariff Act of 1930</header><text>Section 337 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1337">19 U.S.C. 1337</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block act-name="" id="id74E13DCD8AC64A3AB183C9CE9E517AF7" style="OLC">
					<subsection id="idB1E8CA539C5B479795A5756026B7DD73"><enum>(o)</enum><header>Abrogation of tribal sovereign immunity</header>
 <paragraph id="idE23E3192DCF5476FA7BBDA83414688F4"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text> <subparagraph id="id423F801FEED949B5BFC18A768ACD1E27"><enum>(A)</enum><text>the term <term>covered person</term>—</text>
 <clause id="id93780321CFFD4FD1AF47FC705EBB09E4"><enum>(i)</enum><text>means a person; and</text> </clause><clause id="idD2C04AB8A084419DAF6BB343D92F4308"><enum>(ii)</enum><text>includes—</text>
 <subclause id="id40F07AD4EE6E4873BAC9284E7B3263F9"><enum>(I)</enum><text>an Indian tribe; and</text> </subclause><subclause id="id57FFFEA0A2564763ABE0F5FDBFBA768A"><enum>(II)</enum><text>any other person that claims immunity on account of the sovereign status of an Indian tribe; and</text>
 </subclause></clause></subparagraph><subparagraph id="idEDA8CA32449D4CD89E410FB4E7ED5C8A"><enum>(B)</enum><text>the term <term>Indian tribe</term> has the meaning given the term in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="id22D3535F0E2F4767B7E269A2749B66C3"><enum>(2)</enum><header>Abrogation</header><text>In any proceeding under this section, no covered person may assert as a defense the sovereign immunity that is accorded to an Indian tribe.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idDE3AB842E2EB41AD971B2F7E21B95B85"><enum>(c)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/29">chapter 29</external-xref> of title 35, United States Code, is amended by striking the item relating to section 296 and inserting the following:</text>
