			 operations safety risk reduction programs, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H8EEB74BBF29B4026876CC1E415778E7C" style="OLC">
 <section id="H0CFA7EC29DCF444DB4DA34E27C2AC9B6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transit Worker and Pedestrian Protection Act</short-title></quote>.</text> </section><section id="H4CE2B5DE3C284A42B8A7FACCFF7B722A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
 <paragraph id="H2BC7023BA5CB41CFA7607D3AAF04672C"><enum>(1)</enum><text>Public transportation workers are vital to the safe, efficient, and affordable movement of people and to the economic prosperity of the country.</text>
 </paragraph><paragraph id="H680F64872E974F54A0DF39C523DDB757"><enum>(2)</enum><text display-inline="yes-display-inline">Assaults on public transportation workers are a growing problem, with daily reports of bus operators and rail transit employees being beaten, having items thrown at them, being spat upon, and being verbally abused.</text>
 </paragraph><paragraph id="H5ABECE7A47E64E0B98D589EE1626C5C5"><enum>(3)</enum><text>This is not only a tragic situation for public transportation workers, but also a major safety risk for passengers, other motorists, and pedestrians.</text>
 </paragraph><paragraph id="HA23BFC1EE5E6400EB9DFED7DDE8AD8BC"><enum>(4)</enum><text>An additional risk to safe bus operation is the existence of blind spots in the view from a bus operator workstation that—</text>
 <subparagraph id="H545DD349C80A458AAF9B0A5E8C7A1673"><enum>(A)</enum><text>prevent a driver from fully seeing the driver’s surroundings; and</text> </subparagraph><subparagraph id="HA189AEC31D974D78970E83E1568E1DE9"><enum>(B)</enum><text>have caused serious accidents with pedestrians.</text>
 </subparagraph></paragraph><paragraph id="H0ACDCC1380B74AA38EF97CE906A1C519"><enum>(5)</enum><text>Blind spots are avoidable, and buses can be designed to provide the bus operator a clear view outside the vehicle.</text>
 </paragraph><paragraph id="HCC84268406B54BFDBAEFF18710E27C9B"><enum>(6)</enum><text>Section 3022 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/49/5329">49 U.S.C. 5329</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/94">Public Law 114–94</external-xref>) required the Secretary of Transportation to issue a notice of proposed rulemaking to address protection of public transportation operators from the risk of assault.</text>
 </paragraph><paragraph id="H6229882493DE4EF18D572254A24158A1"><enum>(7)</enum><text>The Secretary of Transportation has failed to issue a notice of proposed rulemaking as required under section 3022 of the FAST Act.</text>
 </paragraph></section><section id="H2E17BF19D8864D238927BCA23376535E"><enum>3.</enum><header>Bus operations safety risk reduction program</header><text display-inline="no-display-inline">Section 5329 of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block id="HA59451E8E0CA47D2ABAD83346E17C63A" style="OLC"> <subsection id="H0A4A2D10EFE3446385930091D6D72791"><enum>(l)</enum><header>Bus operations safety risk reduction program</header> <paragraph id="H7A7FB7E0425A4D92AB7179F4F8B34EE3"><enum>(1)</enum><header>Requirements</header><text>Not later than 2 years after the date of enactment of this subsection, the Secretary shall require each recipient that operates fixed route bus service to—</text>
 <subparagraph id="H86828AE24464472F94AC99CB7FBD2EC9"><enum>(A)</enum><text>develop a risk reduction program for bus operations under paragraph (2) to improve safety by reducing the number and rates of accidents, injuries, assaults on bus operators, and fatalities;</text>
 </subparagraph><subparagraph id="H1E1445FEC41E42A99748EF37EA9E4DC6"><enum>(B)</enum><text>submit the program required under subparagraph (A), including the implementation plan required under paragraph (3), to the Secretary for review and approval; and</text>
 </subparagraph><subparagraph id="HE11612FB994E40D9BB3C2D0B806BE96C"><enum>(C)</enum><text>implement the program and plan approved by the Secretary.</text> </subparagraph></paragraph><paragraph id="H9695E7D7EA8E4D07B3B8A3C149D0C235"><enum>(2)</enum><header>Development of program</header><text>A recipient required to develop and submit a risk reduction program for bus operations under paragraph (1)—</text>
 <subparagraph id="H0FAD07B251C1418E8DEDF31698E30368"><enum>(A)</enum><text>shall develop the program by conducting risk analysis on the bus operations of the recipient;</text> </subparagraph><subparagraph id="H760945658D0B4742B3EF2A616C1CA7B0"><enum>(B)</enum><text>may incorporate the program into an applicable comprehensive safety plan that the recipient prepares under subsection (d), if the plan addresses each requirement under this subsection; and</text>
 </subparagraph><subparagraph id="HA2CEFB11FB4F41A4B5A98C7D4C8C31AB"><enum>(C)</enum><text>shall develop the program in cooperation with bus operators and collective bargaining representatives of bus operators, including the development of—</text>
 <clause id="H4FBDFD657D1C49E2B9C6466BFE46186B"><enum>(i)</enum><text>the risk analysis required under subparagraph (A); and</text> </clause><clause id="H9CD43763CD8C485F96ADEBDFCC9B1A4C"><enum>(ii)</enum><text>the implementation plan required under paragraph (3).</text>
 </clause></subparagraph></paragraph><paragraph id="H7544CEBB23694A0C9005A46E3DB443D2"><enum>(3)</enum><header>Implementation plan</header><text>Each risk reduction program for bus operations under paragraph (1) shall include an implementation plan for—</text>
 <subparagraph id="HCDABA769F24347C5B806B1674B56943F"><enum>(A)</enum><text>reduction of vehicular and pedestrian accidents involving buses that includes—</text> <clause id="H4336C9BFACD346ADA29B49887D221C4C"><enum>(i)</enum><text>deployment of driver assistance technologies for bus operators that reduce or prevent accidents; and</text>
 </clause><clause id="H41456977C4D64B54B30D8CEAC1E74526"><enum>(ii)</enum><text>measures to reduce visibility impairments for bus operators that contribute to accidents, including retrofits to buses in revenue service and specifications for future procurements that reduce visibility impairments;</text>
 </clause></subparagraph><subparagraph id="H110AA85A6D234ADE8346EC088747B718"><enum>(B)</enum><text>bus operator assault mitigation, including—</text> <clause id="HDC9FCDD59AE942F08CC505B7969C9C74"><enum>(i)</enum><text>the deployment of assault mitigation infrastructure and technology on buses, including barriers to restrict the unwanted entry of individuals and objects into bus operators’ workstations when a recipient’s risk analysis determines that such barriers would reduce assaults on and injuries to bus operators; and</text>
 </clause><clause id="HD8F65629E72E4A94A3D7EC885D0CD9B7"><enum>(ii)</enum><text>conflict de-escalation training for bus operators;</text> </clause></subparagraph><subparagraph id="H2B0748A13FBE4FA29DC90252E9F56042"><enum>(C)</enum><text>installation of seating and modification to design specifications of bus operator workstations that reduce or prevent injuries from ergonomic risks; and</text>
 </subparagraph><subparagraph id="HB56633F149CD44AF84B8613A25A73D1E"><enum>(D)</enum><text>other measures that the Secretary determines would significantly reduce the number and rate of accidents, injuries, assaults on bus operators, and fatalities related to bus operations.</text>
 </subparagraph></paragraph><paragraph id="H600997881D8045DCB4547C9F43756881"><enum>(4)</enum><header>Updating requirements</header><text>The Secretary shall require each recipient required to develop a program under paragraph (1) to—</text> <subparagraph id="H42958201E23B40679A52CFBAFDA11EF3"><enum>(A)</enum><text>update the program annually; and</text>
 </subparagraph><subparagraph id="H70E6396EE37641AB826ADA602818867F"><enum>(B)</enum><text>resubmit the program for approval by the Secretary not less than once every 3 years.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="H9234E6BC793244A0B35885E96B34BB6B"><enum>4.</enum><header>Rail operations worker assault risk reduction program</header> <subsection id="HB9114FA0FEDD49D89E38835C29FE8782"><enum>(a)</enum><header>Public transportation safety program section</header><text>Section 5329 of title 49, United States Code, as amended by section 3, is further amended by adding at the end the following:</text>
				<quoted-block id="H14253D8B6471435092C81D4F10332F91" style="OLC">
					<subsection id="H6F26E5DDCBE943969E62472195E92857"><enum>(m)</enum><header>Rail operations worker assault risk reduction program</header>
 <paragraph id="H6A951732F5FD411ABFD183D7F5B54F10"><enum>(1)</enum><header>Requirements</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this subsection, the Secretary shall require each recipient that operates a rail fixed guideway public transportation system that is not subject to regulation by the Federal Railroad Administration to—</text>
 <subparagraph id="H2AB4A0396E7347A099462FE184D5584F"><enum>(A)</enum><text>develop a risk reduction program for assaults on rail workers under paragraph (2) to improve safety by reducing the number and severity of assaults on rail workers, including operators and station personnel;</text>
 </subparagraph><subparagraph id="H75A3FEA67A7A4E6E9AF3AB62782CC822"><enum>(B)</enum><text>submit the program required under subparagraph (A), including the implementation plan required under paragraph (3), to the Secretary for review and approval; and</text>
 </subparagraph><subparagraph id="HC9FF4F7FC31D44AFB83C6D6525ED34AC"><enum>(C)</enum><text>implement the program and plan approved by the Secretary.</text> </subparagraph></paragraph><paragraph id="H0035B1DB1A5C4FFF91497B85CCDA9C36"><enum>(2)</enum><header>Development of program</header><text>A recipient required to develop and submit a risk reduction program for assaults on rail workers under paragraph (1)—</text>
 <subparagraph id="H052AF836ABD54831850ECA22E2F3F772"><enum>(A)</enum><text>shall develop the program by conducting risk analysis on assaults on workers serving the rail operations of the recipient;</text>
 </subparagraph><subparagraph id="HCA73795F631E4BBBAC8E5A4BC67735EB"><enum>(B)</enum><text>may incorporate the program into an applicable comprehensive safety plan that the recipient prepares under subsection (d), if the plan addresses each requirement under this subsection; and</text>
 </subparagraph><subparagraph id="H2FAB2F4761064F43981D3DADD07D5A79"><enum>(C)</enum><text>shall develop the program in cooperation with rail workers and collective bargaining representatives of rail workers, including the development of—</text>
 <clause id="HA6B80994D501410796DDBA2E5CA17FB5"><enum>(i)</enum><text>the risk analysis required under subparagraph (A); and</text> </clause><clause id="HFFB9C6CFDD564BEFA776B205747589E4"><enum>(ii)</enum><text>the implementation plan required under paragraph (3).</text>
 </clause></subparagraph></paragraph><paragraph id="HF54D87DDD7C4409A9DAAC1FCAADF1F93"><enum>(3)</enum><header>Implementation plan</header><text>Each risk reduction program for assaults on rail workers under paragraph (1) shall include an implementation plan for rail worker assault mitigation.</text>
 </paragraph><paragraph id="HB169318CBC6E4E7395C74CEE7E82AC6B"><enum>(4)</enum><header>Updating requirements</header><text>The Secretary shall require each recipient required to develop a program under paragraph (1) to—</text> <subparagraph id="H538691FD53F54A749202DDA10979A6A3"><enum>(A)</enum><text>update the program annually; and</text>
 </subparagraph><subparagraph id="HCBFDDC5ABA694B9EB620B54C1932F3A4"><enum>(B)</enum><text>resubmit the program for approval by the Secretary not less than once every 3 years.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section><section id="HEAB037872B634671B7C01889131BB5F2"><enum>5.</enum><header>Authorization of appropriations</header> <subsection id="HBC32BA0B687E405C89B48DAD320B57D7"><enum>(a)</enum><header>Amount and duration</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out implementation plans under the bus operations safety risk reduction program described in subsection (l) of section 5329 of title 49, United States Code (as added by section 3 of this Act), $25,000,000 for each of fiscal years 2019 through 2023.</text>
 </subsection><subsection id="HF0CA1026731D4437B7A8A4CDC422C090"><enum>(b)</enum><header>Formula</header><text>Of the amounts made available to carry out subsection (l) of section 5329 of title 49, United States Code, for a fiscal year—</text>
 <paragraph id="HBE3DF08F98A94435863A66112BCF8794"><enum>(1)</enum><text>80 percent shall be distributed under the formula set forth in section 5336 of title 49, United States Code, other than subsection (b) of that section; and</text>
 </paragraph><paragraph id="H8A297A081BBD4DCBA61D242A7036AD64"><enum>(2)</enum><text>20 percent shall be distributed under the formula set forth in section 5311(c)(3) of that title.</text> </paragraph></subsection></section><section id="H80097067FBDA4E30BCAA77BB9E3D2E37"><enum>6.</enum><header>Transit worker assault data</header><text display-inline="no-display-inline">Section 5335 of title 49, United States Code, is amended by adding at the end the following:</text>

				<subsection id="H0C6ED2A653D24DE1A0842CE83F0207BF"><enum>(d)</enum><header>Transit worker assault data</header>
 <paragraph id="H92E459FE54414A62B43E0B23D8F31B4B"><enum>(1)</enum><header>Report</header><text>A recipient shall report to the Secretary, for inclusion in the National Transit Database, any information on each assault on a transit worker.</text>
 </paragraph><paragraph id="H4326549B5ED14BAAA071140C4827CDEA"><enum>(2)</enum><header>Other reports</header><text>A report required under paragraph (1) shall be separate from the reporting on other safety incidents in the National Transit Database.</text>
 </paragraph><paragraph id="HD8060B801E5D4CCFABE95FB66C64ED13"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="H97662FE6ED2F4C64B72FBA50BFF2017D"><enum>(A)</enum><header>Assault on a transit worker</header><text>The term <term>assault on a transit worker</term> means any circumstance in which an individual knowingly, without lawful authority or permission, and with intent to endanger the safety or health of any individual, or with a reckless disregard for the safety or health of human life, interferes with, disables, or incapacitates any transit worker while the transit worker is performing his or her duties, including circumstances that do not require immediate medical attention or that do not result in a fatality.</text>
 </subparagraph><subparagraph id="H2E51E41C9F244A228A9FCFE936D96F8E"><enum>(B)</enum><header>Recipient</header><text>The term <term>recipient</term> has the meaning given the term in section 5329(a).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
