			 other purposes.</official-title></form>
	<legis-body>
 <section id="id5b40b718707e4c83914023675b9150a6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Red River Gradient Boundary Survey Act</short-title></quote>.</text> </section><section id="id626c492617a14d4c8130830f4893fb57"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idede89301665f46218369b36a43567ce2"><enum>(1)</enum><header>Affected area</header>
 <subparagraph id="id65a3de8df4564fb19c62800aed60694a"><enum>(A)</enum><header>In general</header><text>The term <term>affected area</term> means land along the approximately 116-mile stretch of the Red River, from its confluence with the north fork of the Red River on the West to the 98th meridian on the east.</text>
 </subparagraph><subparagraph id="id32c9edc1bc2d428d8302283ed03b5054"><enum>(B)</enum><header>Exclusions</header><text>The term <term>affected area</term> does not include the portion of the Red River within the boundary depicted on the survey prepared by the Bureau of Land Management entitled <quote>Township 5 South, Range 14 West, of the Indian Meridian, Oklahoma, Dependent Resurvey and Survey</quote> and dated February 28, 2006.</text>
 </subparagraph></paragraph><paragraph id="id49524b8e81fd4ab9bb68a2f05a547b06"><enum>(2)</enum><header>Gradient boundary survey method</header><text>The term <term>gradient boundary survey method</term> means the measurement technique used to locate the South Bank boundary line in accordance with the methodology established in Oklahoma v. Texas, 261 U.S. 340 (1923) (recognizing that the boundary line along the Red River is subject to change due to erosion and accretion).</text>
 </paragraph><paragraph id="id32ed1460a9864c76893fa6cbab45531d"><enum>(3)</enum><header>Landowner</header><text>The term <term>landowner</term> means any individual, group, association, corporation, federally recognized Indian tribe or member of such an Indian tribe, or other private or governmental legal entity that owns an interest in land in the affected area.</text>
 </paragraph><paragraph id="ide8242c34dd70436d82b8e9dd4572bee2"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the Bureau of Land Management.</text> </paragraph><paragraph id="ida7b48191cf954f61879d30e2bcbf7689"><enum>(5)</enum><header>South bank</header><text>The term <term>South Bank</term> means the water-washed and relatively permanent elevation or acclivity (commonly known as a <quote>cut bank</quote>) along the southerly or right side of the Red River that—</text>
 <subparagraph id="id3cb64f30901244559555ec619406e602"><enum>(A)</enum><text>separates the bed of that river from the adjacent upland, whether valley or hill; and</text> </subparagraph><subparagraph id="id123b675c54274aaebf9f7b16f0b126a2"><enum>(B)</enum><text>usually serves, as specified in the fifth paragraph of Oklahoma v. Texas, 261 U.S. 340 (1923)—</text>
 <clause id="id6e2a7fc8097d47f78aa4ad75a79b8452"><enum>(i)</enum><text>to confine the waters within the bed; and</text> </clause><clause id="id5d41f10f88f3419983611aec8ea3bd8a"><enum>(ii)</enum><text>to preserve the course of the river.</text>
 </clause></subparagraph></paragraph><paragraph id="id8e6ca3de76234a779be4c7edc2776180"><enum>(6)</enum><header>South bank boundary line</header><text>The term <term>South Bank boundary line</term> means the boundary, with respect to title and ownership, between the States of Oklahoma and Texas identified through the gradient boundary survey method that does not impact or alter the permanent political boundary line between the States along the Red River, as outlined under article II, section B of the Red River Boundary Compact enacted by the States and consented to by Congress pursuant to <external-xref legal-doc="public-law" parsable-cite="pl/106/288">Public Law 106–288</external-xref> (114 Stat. 919).</text>
			</paragraph></section><section id="id60077eee83fa41ca9d2cf18a81246939"><enum>3.</enum><header>Survey of south bank boundary line</header>
			<subsection id="id693b454fab57404ca658b295b7efcf4e"><enum>(a)</enum><header>Survey required</header>
 <paragraph id="id2b1c472f50694e83870d839c340f5c44"><enum>(1)</enum><header>In general</header><text>The Secretary shall commission a survey to identify the South Bank boundary line in the affected area.</text>
 </paragraph><paragraph id="id5c773f0a9f0744ad8ff30ab9c991df3d"><enum>(2)</enum><header>Requirements</header><text>The survey shall—</text> <subparagraph id="id9bcfb6b78ccc414cb821ba03cd052660"><enum>(A)</enum><text>adhere to the gradient boundary survey method;</text>
 </subparagraph><subparagraph id="id8954c7024dfd46ef92fa4d06151d5bf0"><enum>(B)</enum><text>span the length of the affected area;</text> </subparagraph><subparagraph id="idb05d9a98efbf4dd8a14ec038cacfc464"><enum>(C)</enum><text>be conducted by 1 or more independent third-party surveyors that are—</text>
 <clause id="id2e0d55f5a1834198adef117ab1127246"><enum>(i)</enum><text>licensed and qualified to conduct official gradient boundary surveys; and</text> </clause><clause id="idfe0aaf816b654847811fd2b5a0b04796"><enum>(ii)</enum><text>selected by the Secretary, in consultation with—</text>
 <subclause id="idc06b572d3f454d12909c771be7eeb70f"><enum>(I)</enum><text>the Texas General Land Office;</text> </subclause><subclause id="idbf6d40afba604281b3fcbbadc5ba2d71"><enum>(II)</enum><text>the Oklahoma Commissioners of the Land Office, in consultation with the attorney general of the State of Oklahoma; and</text>
 </subclause><subclause id="id772ca12668f7435790ce178aa909ab32"><enum>(III)</enum><text>each affected federally recognized Indian Tribe; and</text> </subclause></clause></subparagraph><subparagraph id="idf8883f14573040f982554926f7182541"><enum>(D)</enum><text>subject to the availability of appropriations, be completed not later than 2 years after the date of enactment of this Act.</text>
					</subparagraph></paragraph></subsection><subsection id="ida40c2ce3956f4f7ab30813953c40aa00"><enum>(b)</enum><header>Approval of the boundary survey</header>
 <paragraph id="id162c15d8c65144d7ae2b9d6f6913ba6f"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date on which the survey or a portion of the survey under subsection (a)(1) is completed, the Secretary shall submit the survey for approval to—</text>
 <subparagraph id="id249387fce6c742a3b3e948be2c57eaa5"><enum>(A)</enum><text>the Texas General Land Office;</text> </subparagraph><subparagraph id="iddfe06686a294421c9a277891d9602347"><enum>(B)</enum><text>the Oklahoma Commissioners of the Land Office, in consultation with the attorney general of the State of Oklahoma; and</text>
 </subparagraph><subparagraph id="id4a2cc0b2c149480ea4d0cf49f0662b57"><enum>(C)</enum><text>each affected federally recognized Indian Tribe.</text> </subparagraph></paragraph><paragraph id="id70bacb5cd58147e1ba42c850ae3b15cc"><enum>(2)</enum><header>Timing of approval</header><text>Not later than 60 days after the date on which each of the Texas General Land Office, the Oklahoma Commissioners of the Land Office, in consultation with the attorney general of the State of Oklahoma, and each affected federally recognized Indian Tribe notify the Secretary of the approval of the boundary survey or a portion of the survey by the applicable office or federally recognized Indian Tribe, the Secretary shall determine whether to approve the survey or portion of the survey, subject to paragraph (4).</text>
 </paragraph><paragraph id="id4b1e035c6c3548a083447f9b27445da2"><enum>(3)</enum><header>Submission of portions of survey for approval</header><text>As portions of the survey are completed, the Secretary may submit the completed portions of the survey for approval under paragraph (1).</text>
 </paragraph><paragraph id="id3fd7baa5e3604013b5033f00c674c694"><enum>(4)</enum><header>Written approval</header><text>The Secretary shall only approve the survey, or a portion of the survey, that has the written approval of each of—</text>
 <subparagraph id="idb6960ee295054cf9aa1716d82b03a854"><enum>(A)</enum><text>the Texas General Land Office;</text> </subparagraph><subparagraph id="id3756b897e53d41e991bdd602efcb7eb3"><enum>(B)</enum><text>the Oklahoma Commissioners of the Land Office, in consultation with the attorney general of the State of Oklahoma; and</text>
 </subparagraph><subparagraph id="idc4bfeaadcae64a679b8a59079c83281f"><enum>(C)</enum><text>each affected federally recognized Indian Tribe.</text> </subparagraph></paragraph></subsection></section><section id="id6033830753244aa28623c771bc987aa1"><enum>4.</enum><header>Survey of individual parcels</header><text display-inline="no-display-inline">Surveys of individual parcels in the affected area shall be conducted in accordance with the boundary survey approved under section 3(b).</text>
 </section><section id="idf8e9e4d80ec243488fa5f889505cbbee"><enum>5.</enum><header>Notice and availability of survey</header><text display-inline="no-display-inline">Not later than 60 days after the date on which the boundary survey is approved under section 3(b), the Secretary shall—</text>
 <paragraph id="idf7797586fb5142b8aa8dc2ba5111cff3"><enum>(1)</enum><text>publish notice of the approval of the survey in—</text> <subparagraph id="idA3A3DE16A5FA490BA0779E5562A1AD5D"><enum>(A)</enum><text>the Federal Register; and</text>
 </subparagraph><subparagraph id="idDF839FD287724859B2559B6844525B82"><enum>(B)</enum><text>1 or more local newspapers; and</text> </subparagraph></paragraph><paragraph id="id74e31b03dc5b4955b9da84b728252011"><enum>(2)</enum><text>on request, furnish to any landowner a copy of—</text>
 <subparagraph id="id654136d3b11e4ac5af4722f69c9ba5f9"><enum>(A)</enum><text>the survey; and</text> </subparagraph><subparagraph id="id64a6f5b106d4471780f62db39f919ab2"><enum>(B)</enum><text>any field notes relating to—</text>
 <clause id="id82EA2236082247A59350A20C3CEC2C90"><enum>(i)</enum><text>the individual parcel of the landowner; or</text> </clause><clause id="id0546A26C17844B95BB6F7A6F2B0EC568"><enum>(ii)</enum><text>any individual parcel adjacent to the individual parcel of the landowner.</text>
 </clause></subparagraph></paragraph></section><section id="id3d4ea2ebf8b041b0940b087727cd3bfc"><enum>6.</enum><header>Effect of Act</header><text display-inline="no-display-inline">Nothing in this Act—</text> <paragraph id="id7baafc4c337747b2ab53e4c28cc24e32"><enum>(1)</enum><text>modifies any interest of the State of Oklahoma or Texas, or the sovereignty, property, or trust rights of any federally recognized Indian Tribe, relating to land located north of the South Bank boundary line, as established by the survey;</text>
 </paragraph><paragraph id="id846b94e09de54205a80cdd2a204c198f"><enum>(2)</enum><text>modifies any land patented under the Act of December 22, 1928 (45 Stat. 1069, chapter 47; <external-xref legal-doc="usc" parsable-cite="usc/43/1068">43 U.S.C. 1068</external-xref>) (commonly known as the <quote>Color of Title Act</quote>), before the date of enactment of this Act;</text>
 </paragraph><paragraph id="idfa47b99095af40c8a3233b0d5c8bb2de"><enum>(3)</enum><text>modifies or supersedes the Red River Boundary Compact enacted by the States of Oklahoma and Texas and consented to by Congress pursuant to <external-xref legal-doc="public-law" parsable-cite="pl/106/288">Public Law 106–288</external-xref> (114 Stat. 919);</text>
 </paragraph><paragraph id="id3a0e1c15245f4907b1970a7ab4ad8450"><enum>(4)</enum><text>creates or reinstates any Indian reservation or any portion of such a reservation;</text> </paragraph><paragraph id="id90c59f5f6365418590507c5eb8f617d3"><enum>(5)</enum><text>modifies any interest or any property or trust rights of any individual Indian allottee; or</text>
 </paragraph><paragraph id="ida980f0d6c7174455a493693d4a2a0b7f"><enum>(6)</enum><text>alters any valid right of the State of Oklahoma or the Kiowa, Comanche, or Apache Indian tribes to the mineral interest trust fund established under the Act of June 12, 1926 (44 Stat. 740, chapter 572).</text>
 </paragraph></section><section id="id697b041f47784e1fbbda651db843e7a4"><enum>7.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Secretary to carry out this Act $1,000,000.</text></section></legis-body></bill>
