			 withhold bilateral assistance from countries that do not have emergency
			 scheduling procedures for new illicit drugs, cannot prosecute criminals
			 for the manufacture or distribution of controlled substance analogues, or
			 do not require the registration of tableting machines and encapsulating
			 machines.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="id603F1F2B27264EC38081FAA3CAE4B141" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Blocking Deadly Fentanyl Imports Act</short-title></quote>.</text> </section><section id="id7C68F1ABCE3345E9BCB88A0CF3BF6CEF" section-type="subsequent-section"><enum>2.</enum><header>Amendment to definition of major illicit drug producing country</header><text display-inline="no-display-inline">Section 481(e)(2) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291">22 U.S.C. 2291(e)(2)</external-xref>) is amended—</text>
 <paragraph id="id3EEF556935A44212961784508CC12AB3"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>in which</quote>;</text> </paragraph><paragraph id="idAEC3F601B5F14FFB9B0D4D9FD186F1C2"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>in which</quote> before <quote>1,000</quote>;</text>
 </paragraph><paragraph id="id577CD82075B3449FB8131A55C39A2490"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text> <subparagraph id="idD49A0C8809FD488CAC7231CDFBEE7D2C"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>in which</quote> before <quote>1,000</quote>; and</text>
 </subparagraph><subparagraph id="id1607EC74BF3645A9BF046ED97072C8D8"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote> at the end;</text> </subparagraph></paragraph><paragraph id="id3136428E814A4D4894EA59168805D4A2"><enum>(4)</enum><text display-inline="yes-display-inline">in subparagraph (C)—</text>
 <subparagraph id="id5D8BCB6721234743A2BC5EBC8ADA28D8"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>in which</quote> before <quote>5,000</quote>; and</text> </subparagraph><subparagraph id="idA8585C885346463CBCCA8F16316E82D5"><enum>(B)</enum><text>by inserting <quote>or</quote> after the semicolon; and</text>
 </subparagraph></paragraph><paragraph id="idAEEE2D8B27E44A01BD8280C86FF727F3"><enum>(5)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id0A91713EA8CC466E8071EA02C2C589A9" style="OLC"> <subparagraph id="id3b093a52aa8640c780a5c7ffe5935c89"><enum>(D)</enum><text>that is a significant source of illicit fentanyl, fentanyl analogues, or the precursors of fentanyl and fentanyl analogues;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="id882571A6150D4ED9ABDCFAC884558A0F"><enum>3.</enum><header>International narcotics control strategy report</header><text display-inline="no-display-inline">Section 489(a) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291h">22 U.S.C. 2291h(a)</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idE9E05BFBB12C46A6A1F29024801259BF" style="OLC">
 <paragraph id="idabd51f2a736943daa853098dbf8550b6"><enum>(9)</enum><text>A separate section that contains the following:</text> <subparagraph id="idD24CBE07F58B4E2886B55D7F6DC7989F"><enum>(A)</enum><text>An identification of the countries that are the most significant exporters of illicit fentanyl, fentanyl analogues, and fentanyl precursor chemicals during the preceding calendar year.</text>
 </subparagraph><subparagraph id="id0CF0B034BABD4A6C8A8BA70A25819CA9"><enum>(B)</enum><text>An identification of the countries that are the most significant sources of diversion or chemicals described in subparagraph (A) for illicit uses.</text>
 </subparagraph><subparagraph id="idE52A6DB63D2241C88B9E4A85E7C3B65D"><enum>(C)</enum><text>A description of the extent to which each country identified pursuant to subparagraphs (A) and (B) has cooperated with the United States to prevent the chemicals described in subparagraph (A) from being exported from such country to the United States.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id51328A8EF27049F3A49CF3A8A52D9DFF"><enum>4.</enum><header>Withholding of bilateral and multilateral assistance</header>
 <subsection id="id6FD1FD26710C4233907BAAE92C13121E"><enum>(a)</enum><header>In general</header><text>Section 490(a) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291j">22 U.S.C. 2291j(a)</external-xref>) is amended—</text> <paragraph id="idEE31D6807D574E71A0C33DD0F6165453"><enum>(1)</enum><text>in paragraph (1), by striking <quote>clause (i) or (ii) of section 489(a)(8)(A) of this Act</quote> and inserting <quote>paragraph (8)(A) or (9) of section 489(a)</quote>; and</text>
 </paragraph><paragraph id="idEC08CE2349A248008767D15D26C4831B"><enum>(2)</enum><text>in paragraph (2), by striking <quote>clause (i) or (ii) of section 489(a)(8)(A) of this Act</quote> and inserting <quote>paragraph (8)(A) or (9) of section 489(a)</quote>.</text> </paragraph></subsection><subsection id="idCB8DBD2755D6412785CF5A219A148289"><enum>(b)</enum><header>Designation of countries without emergency scheduling procedures</header><text display-inline="yes-display-inline">Section 706(2) of the Foreign Relations Authorization Act, Fiscal Year 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291j-1">22 U.S.C. 2291j–1(2)</external-xref>) is amended—</text>
 <paragraph id="idEABA5211B490475C98D9ECECC1410C43"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>also</quote>;</text> </paragraph><paragraph id="id2ED42E5F2087420893936930A1D398C2"><enum>(2)</enum><text>in subparagraph (A)(ii), by striking <quote>and</quote> at the end;</text>
 </paragraph><paragraph id="id7ADA3CB0F0294C8AB7746EDB48DC9ECB"><enum>(3)</enum><text>by redesignating subparagraph (B) as subparagraph (E);</text> </paragraph><paragraph id="idDD85A32E8482453BB097FE4E79D20535"><enum>(4)</enum><text>by inserting after subparagraph (A) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idEF501890B00B4EA6A81E80B0B66932D8" style="OLC">
 <subparagraph id="id28D8C31BEC1C410CAD87EB4F479CA78E"><enum>(B)</enum><text>designate each country, if any, identified in such report that has failed to adopt and utilize emergency scheduling procedures for new illicit drugs and other synthetics that are comparable to the procedures authorized under title II of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/811">21 U.S.C. 811</external-xref> et seq.) for adding drugs and other substances to the controlled substances schedules;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id4D5E7F80C2604ABE8B1EC438ADB73859"><enum>(5)</enum><text>in subparagraph (E), as redesignated, by striking <quote>so designated</quote> and inserting <quote>designated under subparagraph (A), (B), (C), or (D)</quote>.</text> </paragraph></subsection><subsection id="id7598526227b144bd8e8a44839dd0923e"><enum>(c)</enum><header>Designation of countries without ability To prosecute criminals for the manufacture or distribution of fentanyl analogues</header><text>Section 706(2) of the Foreign Relations Authorization Act, Fiscal Year 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291j-1">22 U.S.C. 2291j–1(2)</external-xref>), as amended by subsection (b), is further amended by inserting after subparagraph (B) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id34A09F2A48444EF68DE215D6ABF4BF52" style="OLC">
 <subparagraph id="idD0AB10B2BD89444F9926B224833430AB"><enum>(C)</enum><text>designate each country, if any, identified in such report that is incapable of prosecuting criminals for the manufacture or distribution of controlled substance analogues (as defined in section 102(32) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(32)</external-xref>) in the same manner as criminals are prosecuted for the manufacture or distribution of controlled substances;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id41C87B0157C54A4FAFA768E665A12BF8"><enum>(d)</enum><header>Designation of countries that do not require the registration of pill presses and tableting
 machines</header><text>Section 706(2) of the Foreign Relations Authorization Act, Fiscal Year 2003 (<external-xref legal-doc="usc" parsable-cite="usc/22/2291j-1">22 U.S.C. 2291j–1(2)</external-xref>), as amended by subsections (b) and (c), is further amended by inserting after subparagraph (C) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id6563B4B23E19472D936CD93A74EB4DE4" style="OLC">
 <subparagraph id="idE7DE33BAF29F4408A61C7C23AA8DB40E"><enum>(D)</enum><text>designate each country, if any, identified in such report that does not require the registration of tableting machines and encapsulating machines in a manner comparable to the registration requirements set forth in part 1310 of title 21, Code of Federal Regulations; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
