Full reimbursement for qualified retiree prescription drug plans.</toc-entry> </toc> </subsection></section><title id="id060EAD6E50DA40A8BF045498E74FDA4D" style="OLC"><enum>I</enum><header>Marketplace stability and security</header> <section id="H6BDBCB2E8FE441419981616BFF256E0E"><enum>101.</enum><header>Public health insurance option</header> <subsection id="H5F95DFD3211D435281037E6D956C1BB0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part 3 of subtitle D of title I of the Patient Protection and Affordable Care Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>) is amended by adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H65ADEE0A1ABD4CBCA0AF7A310F8EC768" style="OLC">
						<section id="H502E2384882948C898AEDA9E43DDECAD"><enum>1325.</enum><header>Public health insurance option</header>
							<subsection id="H2B57EB3E2A304568A32D58BF5FEE433F"><enum>(a)</enum><header>Establishment and administration of a public health insurance option</header>
 <paragraph id="H3A137706C6BA49DF9FA17A10DE7B7244"><enum>(1)</enum><header>Establishment</header><text>For years beginning with 2020, the Secretary of Health and Human Services (in this section referred to as the <term>Secretary</term>) shall provide for the offering through Exchanges established under this title of a health benefits plan (in this Act referred to as the <term>public health insurance option</term>) that ensures choice, competition, and stability of affordable, high-quality coverage throughout the United States in accordance with this section. In designing the option, the Secretary’s primary responsibility is to create a low-cost plan without compromising quality or access to care.</text>
								</paragraph><paragraph display-inline="no-display-inline" id="HE432812E9C27447AA8F17030836DE0D1"><enum>(2)</enum><header>Offering through Exchanges</header>
 <subparagraph id="HAE27465E44274144A85D4CAD067FCC24"><enum>(A)</enum><header>Exclusive to Exchanges</header><text>The public health insurance option shall be made available only through Exchanges established under this title.</text>
 </subparagraph><subparagraph commented="no" id="H30CB31B31C7441EDB3CD154C4F148581"><enum>(B)</enum><header>Ensuring a level playing field</header><text display-inline="yes-display-inline">Consistent with this section, the public health insurance option shall comply with requirements that are applicable under this title to health benefits plans offered through such Exchanges, including requirements related to benefits, benefit levels, provider networks, notices, consumer protections, and cost sharing.</text>
 </subparagraph><subparagraph display-inline="no-display-inline" id="H9B17A0454B884B6D888952B33CF7EEA4"><enum>(C)</enum><header>Provision of benefit levels</header><text>The public health insurance option—</text> <clause id="H3F1C21FBFCE744C4ADF05BA6DA6352CE"><enum>(i)</enum><text display-inline="yes-display-inline">shall offer bronze, silver, and gold plans; and</text>
 </clause><clause id="HDD3F3B53CE53415C8C8C9E297D4C0BF9"><enum>(ii)</enum><text>may offer platinum plans.</text> </clause></subparagraph></paragraph><paragraph id="HA77F97A13B674894B3585513FEDF2E57"><enum>(3)</enum><header>Administrative contracting</header><text display-inline="yes-display-inline">The Secretary may enter into contracts for the purpose of performing administrative functions (including functions described in subsection (a)(4) of section 1874A of the Social Security Act) with respect to the public health insurance option in the same manner as the Secretary may enter into contracts under subsection (a)(1) of such section. The Secretary has the same authority with respect to the public health insurance option as the Secretary has under subsections (a)(1) and (b) of section 1874A of the Social Security Act with respect to title XVIII of such Act. Contracts under this subsection shall not involve the transfer of insurance risk to such entity.</text>
 </paragraph><paragraph id="H5CFC1543CE614ABFB6F2FCC011ADF8B2"><enum>(4)</enum><header>Ombudsman</header><text display-inline="yes-display-inline">The Secretary shall establish an office of the ombudsman for the public health insurance option which shall have duties with respect to the public health insurance option similar to the duties of the Medicare Beneficiary Ombudsman under section 1808(c)(2) of the Social Security Act. In addition, such office shall work with States to ensure that information and notice is provided that the public health insurance option is one of the health plans available through an Exchange.</text>
 </paragraph><paragraph id="H1E5D22EF1A104BA691A1CEDC31A8C3EE"><enum>(5)</enum><header>Data collection</header><text display-inline="yes-display-inline">The Secretary shall collect such data as may be required to establish premiums and payment rates for the public health insurance option and for other purposes under this section, including to improve quality and to reduce racial, ethnic, and other disparities in health and health care.</text>
 </paragraph><paragraph id="H16DA6D286EC446CD90A1D9E9EAC68413"><enum>(6)</enum><header>Access to Federal courts</header><text>The provisions of Medicare (and related provisions of title II of the Social Security Act) relating to access of Medicare beneficiaries to Federal courts for the enforcement of rights under Medicare, including with respect to amounts in controversy, shall apply to the public health insurance option and individuals enrolled under such option under this title in the same manner as such provisions apply to Medicare and Medicare beneficiaries.</text>
								</paragraph></subsection><subsection id="H8BA3312950DC47A9ADA2E7C5AE6795AE"><enum>(b)</enum><header>Premiums and financing</header>
								<paragraph commented="no" id="H304D5C5419BC42AE9ADB10436763B8A7"><enum>(1)</enum><header>Establishment of premiums</header>
 <subparagraph id="H54474E32A4E0478B86E00DCEF5749FD3"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish geographically adjusted premium rates for the public health insurance option—</text>
 <clause commented="no" id="H49B08783FD40478F83B12989171D3D6F"><enum>(i)</enum><text>in a manner that complies with the premium rules under paragraph (3); and</text> </clause><clause commented="no" id="H84FB579B4AFF4ED2A4DBA4B3FA662CFF"><enum>(ii)</enum><text>at a level sufficient to fully finance the costs of—</text>
 <subclause commented="no" id="H4FBAFC0816A14FB39C938F1E61C6AAC4"><enum>(I)</enum><text>health benefits provided by the public health insurance option; and</text> </subclause><subclause commented="no" id="H62906C0AADE14E9892F6D600442F3B3D"><enum>(II)</enum><text>administrative costs related to operating the public health insurance option.</text>
 </subclause></clause></subparagraph><subparagraph id="H322ADE17330C4C7682D3DAB23286A681"><enum>(B)</enum><header>Contingency margin</header><text>In establishing premium rates under subparagraph (A), the Secretary shall include an appropriate amount for a contingency margin.</text>
									</subparagraph></paragraph><paragraph commented="no" id="HD366E0003D524BED8279274AC3707F63"><enum>(2)</enum><header>Account</header>
 <subparagraph commented="no" id="H637803CCEF65417082DC31029647855B"><enum>(A)</enum><header>Establishment</header><text>There is established in the Treasury of the United States an account for the receipts and disbursements attributable to the operation of the public health insurance option, including the start-up funding under subparagraph (B). Section 1854(g) of the Social Security Act shall apply to receipts described in the previous sentence in the same manner as such section applies to payments or premiums described in such section.</text>
									</subparagraph><subparagraph commented="no" id="H7A73F7B5339D4A3CBE2954C1FA66D5E2"><enum>(B)</enum><header>Start-up funding</header>
 <clause id="H3673BABB156543DD8D7BF495F51CBF25"><enum>(i)</enum><header>In general</header><text>In order to provide for the establishment of the public health insurance option there is hereby appropriated to the Secretary, out of any funds in the Treasury not otherwise appropriated, $2,000,000,000. In order to provide for initial claims reserves before the collection of premiums, there is hereby appropriated to the Secretary, out of any funds in the Treasury not otherwise appropriated, such sums as necessary to cover 90 days worth of claims reserves based on projected enrollment.</text>
 </clause><clause id="H98E467C9F4764793A8EEE1D0A2995E92"><enum>(ii)</enum><header>Amortization of start-up funding</header><text display-inline="yes-display-inline">The Secretary shall provide for the repayment of the startup funding provided under clause (i) to the Treasury in an amortized manner over the 10-year period beginning with 2020.</text>
 </clause><clause id="H0533EB3718D640018AA34C29CCE93327"><enum>(iii)</enum><header>Limitation on funding</header><text>Nothing in this subsection shall be construed as authorizing any additional appropriations to the account, other than such amounts as are otherwise provided with respect to other health benefits plans participating under the Exchange involved.</text>
 </clause></subparagraph></paragraph><paragraph id="H5DFF65D665DB4B2194B726A7DA7A12AE"><enum>(3)</enum><header>Insurance rating rules</header><text display-inline="yes-display-inline">The premium rate charged for the public health insurance option may not vary except as provided under section 2701 of the Public Health Service Act.</text>
								</paragraph></subsection><subsection id="HA39CAEE3CBF347309F829AFFC727AA1F"><enum>(c)</enum><header>Payment rates for items and services</header>
								<paragraph commented="no" id="H1E42AA0466DC4C239E446F81E2AEF39F"><enum>(1)</enum><header>Rates established by Secretary</header>
 <subparagraph commented="no" id="H132111226B374A11855957BF12AD5D00"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish payment rates for the public health insurance option for services and health care providers consistent with this subsection and may change such payment rates in accordance with subsection (d).</text>
									</subparagraph><subparagraph id="HE64D335F915C4B6BA8BD7635F68CD656"><enum>(B)</enum><header>Initial payment rules</header>
 <clause commented="no" id="HAC0B53E15E6849D294F80457AF2901FE"><enum>(i)</enum><header>In general</header><text>During 2020, 2021, and 2022, the Secretary shall set the payment rates under this subsection for services and providers described in subparagraph (A) equal to the payment rates for equivalent services and providers under parts A and B of Medicare, subject to clause (ii), paragraph (4), and subsection (d).</text>
 </clause><clause commented="no" id="H2E94065640214C14BF7EB3920F98CA70"><enum>(ii)</enum><header>Exceptions</header><text>The Secretary may determine the extent to which Medicare adjustments applicable to base payment rates under parts A and B of Medicare for graduate medical education and disproportionate share hospitals shall apply under this section.</text>
 </clause></subparagraph><subparagraph id="H9B8ED9D2E63749F5BDD10DB345042359"><enum>(C)</enum><header>For new services</header><text>The Secretary shall modify payment rates described in subparagraph (B) in order to accommodate payments for services, such as well-child visits, that are not otherwise covered under Medicare.</text>
 </subparagraph><subparagraph commented="no" id="HB609BB6450D040C4A131BADFDA0878CC"><enum>(D)</enum><header>Prescription drugs</header><text>Payment rates under this subsection for prescription drugs that are not paid for under part A or part B of Medicare shall be at rates negotiated by the Secretary.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAB758E994F174C389DB674286FCA0053"><enum>(2)</enum><header>Subsequent periods; provider network</header>
 <subparagraph commented="no" id="HFFF2760B8DF44302BBA210147EB79C6E"><enum>(A)</enum><header>Subsequent periods</header><text display-inline="yes-display-inline">Beginning with 2023 and for subsequent years, the Secretary shall continue to use an administrative process to set such rates in order to promote payment accuracy, to ensure adequate beneficiary access to providers, and to promote affordability and the efficient delivery of medical care consistent with subsection (a)(1). Such rates shall not be set at levels expected to increase average medical costs per enrollee covered under the public health insurance option beyond what would be expected if the process under paragraph (1)(B) were continued, as certified by the Office of the Actuary of the Centers for Medicare &amp; Medicaid Services.</text>
 </subparagraph><subparagraph commented="no" id="H221C8A02B66A4F1BB11654222B441A6B"><enum>(B)</enum><header>Establishment of a provider network</header><text display-inline="yes-display-inline">Health care providers participating under Medicare are participating providers in the public health insurance option unless they opt out in a process established by the Secretary.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H17B8CC1AE5494655AB803BFB574F9305"><enum>(3)</enum><header>Administrative process for setting rates</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">Chapter 5</external-xref> of title 5, United States Code shall apply to the process for the initial establishment of payment rates under this subsection but not to the specific methodology for establishing such rates or the calculation of such rates.</text>
 </paragraph><paragraph commented="no" id="HAD7EA9C43A244DCB9BBCAD3B8AD7C633"><enum>(4)</enum><header>Construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed as limiting the Secretary’s authority to correct for payments that are excessive or deficient, taking into account the provisions of subsection (a)(1) and any appropriate adjustments based on the demographic characteristics of enrollees covered under the public health insurance option, but in no case shall the correction of payments under this paragraph result in a level of expenditures per enrollee that exceeds the level of expenditures that would have occurred under paragraph (1)(B), as certified by the Office of the Actuary of the Centers for Medicare &amp; Medicaid Services.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9029795C13A14603881A89AA36A425D0"><enum>(5)</enum><header>Construction</header><text>Nothing in this section shall be construed as affecting the authority of the Secretary to establish payment rates, including payments to provide for the more efficient delivery of services, such as the initiatives provided for under subsection (d).</text>
 </paragraph><paragraph id="HF317771CCC9040CDA82E64BA6CF8A318"><enum>(6)</enum><header>Limitations on review</header><text display-inline="yes-display-inline">There shall be no administrative or judicial review of a payment rate or methodology established under this subsection or under subsection (d).</text>
								</paragraph></subsection><subsection display-inline="no-display-inline" id="H6DD2B00AA9DF46D4B4F4E4360D512673"><enum>(d)</enum><header>Modernized payment initiatives and delivery system reform</header>
 <paragraph display-inline="no-display-inline" id="HEC42F0331BC94C2FB3F2A464D3466139"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For plan years beginning with 2020, the Secretary may utilize innovative payment mechanisms and policies to determine payments for items and services under the public health insurance option. The payment mechanisms and policies under this subsection may include patient-centered medical home and other care management payments, accountable care organizations, value-based purchasing, bundling of services, differential payment rates, performance or utilization based payments, partial capitation, and direct contracting with providers. Payment rates under such payment mechanisms and policies shall not be set at levels expected to increase average medical costs per enrollee covered under the public health insurance option beyond what would be expected if the process under subsection (c)(1)(B) were continued, as certified by the Office of the Actuary of the Centers for Medicare &amp; Medicaid Services.</text>
 </paragraph><paragraph id="H8EDB5E9F93844DF5BD890A581ED03ECD"><enum>(2)</enum><header>Requirements for innovative payments</header><text display-inline="yes-display-inline">The Secretary shall design and implement the payment mechanisms and policies under this subsection in a manner that—</text>
 <subparagraph id="H8A1052F4E2754CCBA5F6F557CADC6CEE"><enum>(A)</enum><text display-inline="yes-display-inline">seeks to—</text> <clause id="H153DEDF9B32547FEAD7EBD9B97FED048"><enum>(i)</enum><text>improve health outcomes;</text>
 </clause><clause id="HD4E3BE14822E4F61988E21578395D426"><enum>(ii)</enum><text>reduce health disparities (including racial, ethnic, and other disparities);</text> </clause><clause id="H10BCC336845E49F1945E878615AA433A"><enum>(iii)</enum><text>provide efficient and affordable care;</text>
 </clause><clause id="HC07FB1DB2DB1443E8F088C981CA5151E"><enum>(iv)</enum><text>address geographic variation in the provision of health services; or</text> </clause><clause id="HE6BAED859EA54B6C976D9D1DF66224B1"><enum>(v)</enum><text>prevent or manage chronic illness; and</text>
 </clause></subparagraph><subparagraph id="H5CCC1636A14244FFAF1EC8409B2057EE"><enum>(B)</enum><text>promotes care that is integrated, patient-centered, high-quality, and efficient.</text> </subparagraph></paragraph><paragraph id="H84278F8501CE47089C833F6BD491EEF1"><enum>(3)</enum><header>Encouraging the use of high value services</header><text>To the extent allowed by the benefit standards applied to all health benefits plans participating under the Exchange involved, the public health insurance option may modify cost sharing and payment rates to encourage the use of services that promote health and value.</text>
 </paragraph><paragraph id="H512E686017904DB69FAEB28D9AF79944"><enum>(4)</enum><header>Non-uniformity permitted</header><text display-inline="yes-display-inline">Nothing in this section shall prevent the Secretary from varying payments based on different payment structure models (such as accountable care organizations and medical homes) under the public health insurance option for different geographic areas.</text>
								</paragraph></subsection><subsection display-inline="no-display-inline" id="H24712A3FCF5942589894D2618BD8F330"><enum>(e)</enum><header>Provider participation</header>
 <paragraph id="HD37AC689EAF74D7C8C18A19BB9A9D0B1"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish conditions of participation for health care providers under the public health insurance option.</text>
 </paragraph><paragraph display-inline="no-display-inline" id="H156777DB86E54068BEE5BE51C9B26592"><enum>(2)</enum><header>Licensure or certification</header><text>The Secretary shall not allow a health care provider to participate in the public health insurance option unless such provider is appropriately licensed or certified under State law.</text>
								</paragraph><paragraph commented="no" id="H8C01698858B946AA8A34D4058F9022D6"><enum>(3)</enum><header>Payment terms for providers</header>
 <subparagraph id="HA12E4CC0C9C0407BAD8DE166B3DAE2E4"><enum>(A)</enum><header>Physicians</header><text>The Secretary shall provide for the annual participation of physicians under the public health insurance option, for which payment may be made for services furnished during the year, in one of 2 classes:</text>
 <clause id="H1188DC19D928493487AB5D95BA870562"><enum>(i)</enum><header>Preferred physicians</header><text>Those physicians who agree to accept the payment rate established under this section (without regard to cost-sharing) as the payment in full.</text>
 </clause><clause id="H5370A65C1FF34EF4B5E9CBB7059760A7"><enum>(ii)</enum><header>Participating, non-preferred physicians</header><text display-inline="yes-display-inline">Those physicians who agree not to impose charges (in relation to the payment rate described in subsection (c) for such physicians) that exceed the ratio permitted under section 1848(g)(2)(C) of the Social Security Act.</text>
 </clause></subparagraph><subparagraph commented="no" id="H3BF6B36FD1E5440A84BCF4B79F656B59"><enum>(B)</enum><header>Other providers</header><text display-inline="yes-display-inline">The Secretary shall provide for the participation (on an annual or other basis specified by the Secretary) of health care providers (other than physicians) under the public health insurance option under which payment shall only be available if the provider agrees to accept the payment rate established under subsection (c) (without regard to cost-sharing) as the payment in full.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HB8D6016B30934CF692AE2BB77B050F08"><enum>(4)</enum><header>Exclusion of certain providers</header><text>The Secretary shall exclude from participation under the public health insurance option a health care provider that is excluded from participation in a Federal health care program (as defined in section 1128B(f) of the Social Security Act).</text>
 </paragraph></subsection><subsection commented="no" id="H3A7233DE8C914A5B9F00E7AE59215108"><enum>(f)</enum><header>Application of fraud and abuse provisions</header><text>Provisions of law (other than criminal law provisions) identified by the Secretary by regulation, in consultation with the Inspector General of the Department of Health and Human Services, that impose sanctions with respect to waste, fraud, and abuse under Medicare, such as the False Claims Act (<external-xref legal-doc="usc" parsable-cite="usc/31/3729">31 U.S.C. 3729</external-xref> et seq.), shall also apply to the public health insurance option.</text>
 </subsection><subsection id="HFC75D5F45BA24DC4982DC3E1B90769D9"><enum>(g)</enum><header>Medicare defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>Medicare</term> means the health insurance programs under title XVIII of the Social Security Act.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection commented="no" id="HE1A23D47642343BB963601FE676CEC91"><enum>(b)</enum><header>Conforming amendments</header> <paragraph commented="no" id="H4AA1C5490A1C4DF796B2EF62C8279AAE"><enum>(1)</enum><header>Treatment as qualified health plan</header><text display-inline="yes-display-inline">Section 1301(a)(2) of the Patient Protection and Affordable Care Act is amended—</text>

			 individuals</header>
				<subsection commented="no" id="H86F381BE33DF4C8F861464E4E9229A0F"><enum>(a)</enum><header>In
 general</header><text display-inline="yes-display-inline">Section 1860D–2 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102</external-xref>) is amended—</text>
 <paragraph commented="no" id="H8C77DC2CD9504E559497311D3F4571FF"><enum>(1)</enum><text>in subsection (e)(1), in the matter preceding subparagraph (A), by inserting <quote>and subsection (f)</quote> after <quote>this subsection</quote>; and</text>

				drug rebate agreement for rebate eligible individuals</header>
								<paragraph commented="no" display-inline="no-display-inline" id="HF15D7EF3CDA44A2698E8BA0F30D2C214"><enum>(1)</enum><header>Requirement</header>
									<subparagraph commented="no" id="H38216F8846F449A2B86BFEC2D70B2DF8"><enum>(A)</enum><header>In
 general</header><text>For plan years beginning on or after January 1, 2021, in this part, the term <term>covered part D drug</term> does not include any drug or biological product that is manufactured by a manufacturer that has not entered into and have in effect a rebate agreement described in paragraph (2).</text>
									</subparagraph><subparagraph commented="no" id="H94402FF8FD6F4E16BD1BDF1581792420"><enum>(B)</enum><header>2020 plan year
 requirement</header><text display-inline="yes-display-inline">Any drug or biological product manufactured by a manufacturer that declines to enter into a rebate agreement described in paragraph (2) for the period beginning on January 1, 2020, and ending on December 31, 2020, shall not be included as a <quote>covered part D drug</quote> for the subsequent plan year.</text>
									</subparagraph></paragraph><paragraph commented="no" id="H0BEC892645E0403B92B937803B5793B9"><enum>(2)</enum><header>Rebate
 agreement</header><text display-inline="yes-display-inline">A rebate agreement under this subsection shall require the manufacturer to provide to the Secretary a rebate for each rebate period (as defined in paragraph (6)(B)) ending after December 31, 2019, in the amount specified in paragraph (3) for any covered part D drug of the manufacturer dispensed after December 31, 2019, to any rebate eligible individual (as defined in paragraph (6)(A)) for which payment was made by a PDP sponsor or MA organization under this part for such period, including payments passed through the low-income and reinsurance subsidies under sections 1860D–14 and 1860D–15(b), respectively. Such rebate shall be paid by the manufacturer to the Secretary not later than 30 days after the date of receipt of the information described in section 1860D–12(b)(8), including as such section is applied under section 1857(f)(3), or 30 days after the receipt of information under subparagraph (D) of paragraph (3), as determined by the Secretary. Insofar as not inconsistent with this subsection, the Secretary shall establish terms and conditions of such agreement relating to compliance, penalties, and program evaluations, investigations, and audits that are similar to the terms and conditions for rebate agreements under paragraphs (3) and (4) of section 1927(b).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD73A1F2EEAC544CAA97A63295226021D"><enum>(3)</enum><header>Rebate for
				rebate eligible Medicare drug plan enrollees</header>
									<subparagraph commented="no" id="H420E56CD099D4A2E9D57DEEE2CDBD42F"><enum>(A)</enum><header>In
 general</header><text display-inline="yes-display-inline">The amount of the rebate specified under this paragraph for a manufacturer for a rebate period, with respect to each dosage form and strength of any covered part D drug provided by such manufacturer and dispensed to a rebate eligible individual, shall be equal to the product of—</text>
 <clause commented="no" id="H8093C10086CF4B1D9F4306874DDE5F27"><enum>(i)</enum><text display-inline="yes-display-inline">the total number of units of such dosage form and strength of the drug so provided and dispensed for which payment was made by a PDP sponsor or an MA organization under this part for the rebate period, including payments passed through the low-income and reinsurance subsidies under sections 1860D–14 and 1860D–15(b), respectively; and</text>
 </clause><clause commented="no" id="H2719EBC18BA74410848AEB7755ADFB4F"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount (if any) by which—</text> <subclause commented="no" id="H74CA293666794753861340375C5CB751"><enum>(I)</enum><text>the Medicaid rebate amount (as defined in subparagraph (B)) for such form, strength, and period, exceeds</text>
 </subclause><subclause commented="no" id="HD99B9255A61F4B23B4996E82F82DB1B4"><enum>(II)</enum><text display-inline="yes-display-inline">the average Medicare drug program rebate eligible rebate amount (as defined in subparagraph (C)) for such form, strength, and period.</text>
											</subclause></clause></subparagraph><subparagraph commented="no" id="HDEEEFC5EA04D470BB7D8A63A75579879"><enum>(B)</enum><header>Medicaid rebate
 amount</header><text>For purposes of this paragraph, the term <term>Medicaid rebate amount</term> means, with respect to each dosage form and strength of a covered part D drug provided by the manufacturer for a rebate period—</text>
 <clause commented="no" id="H1CBAAEAFD8554C73AA879537529BB8B1"><enum>(i)</enum><text>in the case of a single source drug or an innovator multiple source drug, the amount specified in paragraph (1)(A)(ii)(II) or (2)(C) of section 1927(c) plus the amount, if any, specified in subparagraph (A)(ii) of paragraph (2) of such section, for such form, strength, and period; or</text>
 </clause><clause commented="no" id="HB7E70DE8FD0F4F45A989C93C7E73ED6C"><enum>(ii)</enum><text>in the case of any other covered outpatient drug, the amount specified in paragraph (3)(A)(i) of such section for such form, strength, and period.</text>
										</clause></subparagraph><subparagraph commented="no" id="HC91E341D6CCD4937A0E6EE30055FD3A8"><enum>(C)</enum><header>Average Medicare
 drug program rebate eligible rebate amount</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>average Medicare drug program rebate eligible rebate amount</term> means, with respect to each dosage form and strength of a covered part D drug provided by a manufacturer for a rebate period, the sum, for all PDP sponsors under part D and MA organizations administering an MA–PD plan under part C, of—</text>
 <clause commented="no" id="H130CE45DF1994CA689211D831CA49309"><enum>(i)</enum><text>the product, for each such sponsor or organization, of—</text>
 <subclause commented="no" id="HBF4D2813F185475DAFC4F3E2B11084C9"><enum>(I)</enum><text display-inline="yes-display-inline">the sum of all rebates, discounts, or other price concessions (not taking into account any rebate provided under paragraph (2) or any discounts under the program under section 1860D–14A) for such dosage form and strength of the drug dispensed, calculated on a per-unit basis, but only to the extent that any such rebate, discount, or other price concession applies equally to drugs dispensed to rebate eligible Medicare drug plan enrollees and drugs dispensed to PDP and MA–PD enrollees who are not rebate eligible individuals; and</text>
 </subclause><subclause commented="no" id="HF28CC1ABAF3E4C2ABC276A1465362AD9"><enum>(II)</enum><text display-inline="yes-display-inline">the number of the units of such dosage and strength of the drug dispensed during the rebate period to rebate eligible individuals enrolled in the prescription drug plans administered by the PDP sponsor or the MA–PD plans administered by the MA organization; divided by</text>
 </subclause></clause><clause commented="no" id="HDF4A85246F294B2594E4562FFAFB6EF5"><enum>(ii)</enum><text display-inline="yes-display-inline">the total number of units of such dosage and strength of the drug dispensed during the rebate period to rebate eligible individuals enrolled in all prescription drug plans administered by PDP sponsors and all MA–PD plans administered by MA organizations.</text>
										</clause></subparagraph><subparagraph commented="no" id="HA563681C4CDA43EBB1562E72C21B12A8"><enum>(D)</enum><header>Use of
 estimates</header><text display-inline="yes-display-inline">The Secretary may establish a methodology for estimating the average Medicare drug program rebate eligible rebate amounts for each rebate period based on bid and utilization information under this part and may use these estimates as the basis for determining the rebates under this section. If the Secretary elects to estimate the average Medicare drug program rebate eligible rebate amounts, the Secretary shall establish a reconciliation process for adjusting manufacturer rebate payments not later than 3 months after the date that manufacturers receive the information collected under section 1860D–12(b)(8)(B).</text>
									</subparagraph></paragraph><paragraph commented="no" id="HD1E967730CB9409F9BB3C96B792D432B"><enum>(4)</enum><header>Length of
 agreement</header><text display-inline="yes-display-inline">The provisions of paragraph (4) of section 1927(b) (other than clauses (iv) and (v) of subparagraph (B)) shall apply to rebate agreements under this subsection in the same manner as such paragraph applies to a rebate agreement under such section.</text>
								</paragraph><paragraph commented="no" id="H4875A5A3EB604CF5B854188DDA8280DD"><enum>(5)</enum><header>Other terms and
 conditions</header><text>The Secretary shall establish other terms and conditions of the rebate agreement under this subsection, including terms and conditions related to compliance, that are consistent with this subsection.</text>
 </paragraph><paragraph commented="no" id="H6735DFFE46D441988AFAEA41FA4CA695"><enum>(6)</enum><header>Definitions</header><text>In this subsection and section 1860D–12(b)(8):</text>
									<subparagraph commented="no" id="HC95BC8CE14234E929D99F27B0E189DAB"><enum>(A)</enum><header>Rebate eligible
 individual</header><text>The term <term>rebate eligible individual</term> means—</text>
 <clause commented="no" id="H90000463F9F54DEEB06DD697E3DB20EB"><enum>(i)</enum><text display-inline="yes-display-inline">a subsidy eligible individual (as defined in section 1860D–14(a)(3)(A));</text>
 </clause><clause commented="no" id="HAD3DE21B2D1642689DC064DDA8FD3A13"><enum>(ii)</enum><text display-inline="yes-display-inline">a Medicaid beneficiary treated as a subsidy eligible individual under clause (v) of section 1860D–14(a)(3)(B); and</text>
 </clause><clause commented="no" id="H710B2BE0EA1C4B98B083A6C4EB422011"><enum>(iii)</enum><text display-inline="yes-display-inline">any part D eligible individual not described in clause (i) or (ii) who is determined for purposes of the State plan under title XIX to be eligible for medical assistance under clause (i), (iii), or (iv) of section 1902(a)(10)(E).</text>
										</clause></subparagraph><subparagraph commented="no" id="H9247DD75A3CC4FC3A18BFD41E04A2EB5"><enum>(B)</enum><header>Rebate
 period</header><text>The term <term>rebate period</term> has the meaning given such term in section 1927(k)(8).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H71B829CD44604A5C958DE49F334F8287"><enum>(b)</enum><header>Reporting
			 requirement for the determination and payment of rebates by manufacturers
			 related to rebate for rebate eligible Medicare drug plan enrollees</header>
					<paragraph commented="no" id="HD45F56161C9247A8B1D9A4E6A807B385"><enum>(1)</enum><header>Requirements for
 PDP sponsors</header><text>Section 1860D–12(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-112">42 U.S.C. 1395w–112(b)</external-xref>) is amended by adding at the end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="H412CE7EA4B5740D88EE21E928623BA13" style="OLC">
							<paragraph commented="no" id="H37A8377FE4584ED6836A36AB1AADE346"><enum>(8)</enum><header>Reporting
				requirement for the determination and payment of rebates by
			 manufacturers
				related to rebate for rebate eligible Medicare drug plan enrollees</header>
								<subparagraph commented="no" id="H93ECEE47D7B34117965CFB4973F30554"><enum>(A)</enum><header>In
 general</header><text>For purposes of the rebate under section 1860D–2(f) for contract years beginning on or after January 1, 2021, each contract entered into with a PDP sponsor under this part with respect to a prescription drug plan shall require that the sponsor comply with subparagraphs (B) and (C).</text>
								</subparagraph><subparagraph commented="no" id="HC5E2957947CB47D68F8CE5EDFEF0E022"><enum>(B)</enum><header>Report form and
 contents</header><text display-inline="yes-display-inline">Not later than a date specified by the Secretary, a PDP sponsor of a prescription drug plan under this part shall report to each manufacturer—</text>
 <clause commented="no" id="H261A91BEB6FC4F9CA0C9B8FF16F17E17"><enum>(i)</enum><text display-inline="yes-display-inline">information (by National Drug Code number) on the total number of units of each dosage, form, and strength of each drug of such manufacturer dispensed to rebate eligible Medicare drug plan enrollees under any prescription drug plan operated by the PDP sponsor during the rebate period;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H960A27118FA147088D05445033F98DCA"><enum>(ii)</enum><text>information on the price discounts, price concessions, and rebates for such drugs for such form, strength, and period;</text>
 </clause><clause commented="no" id="H592A54AE831740F1A5751F4EDA25FEC3"><enum>(iii)</enum><text display-inline="yes-display-inline">information on the extent to which such price discounts, price concessions, and rebates apply equally to rebate eligible Medicare drug plan enrollees and PDP enrollees who are not rebate eligible Medicare drug plan enrollees; and</text>
 </clause><clause commented="no" id="H9D8373140095454B8CA592BC97E6E42B"><enum>(iv)</enum><text display-inline="yes-display-inline">any additional information that the Secretary determines is necessary to enable the Secretary to calculate the average Medicare drug program rebate eligible rebate amount (as defined in paragraph (3)(C) of such section), and to determine the amount of the rebate required under this section, for such form, strength, and period.</text>
									</clause><continuation-text commented="no" continuation-text-level="subparagraph">Such report shall be in a form
				consistent with a standard reporting format established by the
				Secretary.</continuation-text></subparagraph><subparagraph commented="no" id="HC3BE899B7CED4C7084675D62A741E2DE"><enum>(C)</enum><header>Submission to
 Secretary</header><text display-inline="yes-display-inline">Each PDP sponsor shall promptly transmit a copy of the information reported under subparagraph (B) to the Secretary for the purpose of audit oversight and evaluation.</text>
								</subparagraph><subparagraph commented="no" id="HB12164F01BD8418D934D41D4B27A4F4A"><enum>(D)</enum><header>Confidentiality
 of information</header><text display-inline="yes-display-inline">The provisions of subparagraph (D) of section 1927(b)(3), relating to confidentiality of information, shall apply to information reported by PDP sponsors under this paragraph in the same manner that such provisions apply to information disclosed by manufacturers or wholesalers under such section, except—</text>
 <clause commented="no" id="HAB82C59FAB964B86BAED803EE3D82355"><enum>(i)</enum><text>that any reference to <quote>this section</quote> in clause (i) of such subparagraph shall be treated as being a reference to this section;</text>
 </clause><clause commented="no" id="HB71C4E529FFE47E4A7621F546CC15685"><enum>(ii)</enum><text display-inline="yes-display-inline">the reference to the Director of the Congressional Budget Office in clause (iii) of such subparagraph shall be treated as including a reference to the Medicare Payment Advisory Commission; and</text>
 </clause><clause commented="no" id="HD5DC58B0F2FF42E387C80F3B7B5A4622"><enum>(iii)</enum><text display-inline="yes-display-inline">clause (iv) of such subparagraph shall not apply.</text>
 </clause></subparagraph><subparagraph commented="no" id="H53FF2E3808B84B4F8DFD23DB1412066C"><enum>(E)</enum><header>Oversight</header><text display-inline="yes-display-inline">Information reported under this paragraph may be used by the Inspector General of the Department of Health and Human Services for the statutorily authorized purposes of audit, investigation, and evaluations.</text>
								</subparagraph><subparagraph commented="no" id="H4459729CA6CC4D0CA32624C3A719710E"><enum>(F)</enum><header>Penalties for
				failure to provide timely information and provision of false
 information</header><text>In the case of a PDP sponsor—</text> <clause commented="no" id="HEBDDA0C1299D440481D771AC2E1CD965"><enum>(i)</enum><text display-inline="yes-display-inline">that fails to provide information required under subparagraph (B) on a timely basis, the sponsor is subject to a civil money penalty in the amount of $10,000 for each day in which such information has not been provided; or</text>
 </clause><clause commented="no" id="HBB307CD9A09A457EB853F4C0DFFA3AD1"><enum>(ii)</enum><text>that knowingly (as defined in section 1128A(i)) provides false information under such subparagraph, the sponsor is subject to a civil money penalty in an amount not to exceed $100,000 for each item of false information.</text>
									</clause><continuation-text commented="no" continuation-text-level="subparagraph">Such civil money penalties are in
				addition to other penalties as may be prescribed by law. The
			 provisions of
				section 1128A (other than subsections (a) and (b)) shall apply to a
			 civil money
				penalty under this subparagraph in the same manner as such
			 provisions apply to
				a penalty or proceeding under section
				1128A(a).</continuation-text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

 prescription drugs</header><text display-inline="no-display-inline">Section 1860D–11 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-111">42 U.S.C. 1395w–111</external-xref>) is amended by striking subsection (i) (relating to noninterference) and inserting the following:</text>

					<subsection commented="no" display-inline="no-display-inline" id="id3899F7C4AF414D53B6E3D59051A5DC44"><enum>(i)</enum><header display-inline="yes-display-inline">Negotiation; no national formulary or price

						<paragraph commented="no" display-inline="no-display-inline" id="IDb7124033671c4c569696a062629b031e"><enum>(1)</enum><header display-inline="yes-display-inline">Negotiation of prices with
 manufacturers</header><text display-inline="yes-display-inline">In order to ensure that beneficiaries enrolled under prescription drug plans and MA–PD plans pay the lowest possible price, the Secretary shall have and exercise authority similar to that of other Federal entities that purchase prescription drugs in bulk to negotiate contracts with manufacturers of covered part D drugs, consistent with the requirements and in furtherance of the goals of providing quality care and containing costs under this part.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID467dccbb1283457396d50371cfa721a8"><enum>(2)</enum><header display-inline="yes-display-inline">No national formulary or price
 structure</header><text display-inline="yes-display-inline">In order to promote competition under this part and in carrying out this part, the Secretary may not require a particular formulary or institute a price structure for the reimbursement of covered part D drugs.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="H0DC4A99D61B044F4B1006EFCA28803CD" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Guaranteed prescription drug
			 benefits</header>
 <subsection commented="no" display-inline="no-display-inline" id="HBEC6CDDC96EF441781783CF9D23E03B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1860D–3 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-103">42 U.S.C. 1395w–103</external-xref>) is amended to read as follows:</text>
					<quoted-block act-name="Social Security Act" display-inline="no-display-inline" id="H8CFDBC7273F242D09361BC64DF4000FF" other-style="archaic" style="traditional"><section commented="no" display-inline="no-display-inline" id="H0C00D0DBFEF04B0E87A5B3F2E993BBF9" section-type="subsequent-section"><enum>1860D–3.</enum><header>Access to a choice
		  of qualified prescription drug coverage</header><subsection commented="no" display-inline="yes-display-inline" id="H039E3A5E2CA340EA9EDDA384EE9BA77B"><enum>(a)</enum>
								<header>Assuring access to a choice of coverage</header>
								<paragraph commented="no" display-inline="no-display-inline" id="HEBED0DAE57B749148957F16600B2533F"><enum>(1)</enum><header display-inline="yes-display-inline">Choice of at least three plans in each
 area</header><text display-inline="yes-display-inline">Beginning on January 1, 2021, the Secretary shall ensure that each part D eligible individual has available, consistent with paragraph (2), a choice of enrollment in—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H3875B48FF0074B82B41DBF7F5F5244E7"><enum>(A)</enum><text display-inline="yes-display-inline">a nationwide prescription drug plan offered by the Secretary in accordance with subsection (b); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCFDED4FA5542479D9DD1A4F70559FAB3"><enum>(B)</enum><text display-inline="yes-display-inline">at least 2 qualifying plans (as defined in paragraph (3)) in the area in which the individual resides, at least one of which is a prescription drug plan.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE7D7C480C67A4C0FAF239D67EB3FBA4E"><enum>(2)</enum><header display-inline="yes-display-inline">Requirement for different plan
 sponsors</header><text display-inline="yes-display-inline">The requirement in paragraph (1)(B) is not satisfied with respect to an area if only one entity offers all the qualifying plans in the area.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H623546DA646A4342BB8299C3E508AF68"><enum>(3)</enum><header display-inline="yes-display-inline">Qualifying plan defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>qualifying plan</term> means—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HFC2D315BC37743B190C1C6DE9DC82B29"><enum>(A)</enum><text display-inline="yes-display-inline">a prescription drug plan;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD70E3D860B294F548FF131A8DEEA6551"><enum>(B)</enum><text display-inline="yes-display-inline">an MA–PD plan described in section 1851(a)(2)(A)(i) that provides—</text>
 <clause commented="no" display-inline="no-display-inline" id="H2BEFC29F74A04E6F87289BFC0746446"><enum>(i)</enum><text display-inline="yes-display-inline">basic prescription drug coverage; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="H42A1773600DD4B38902B43CDFBA8FA37"><enum>(ii)</enum><text display-inline="yes-display-inline">qualified prescription drug coverage that provides supplemental prescription drug coverage so long as there is no MA monthly supplemental beneficiary premium applied under the plan, due to the application of a credit against such premium of a rebate under section 1854(b)(1)(C); or</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7FDB8221E7734D0BA973CF7996846E68"><enum>(C)</enum><text display-inline="yes-display-inline">a nationwide prescription drug plan offered by the Secretary in accordance with subsection (b).</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF2B4794176A74D85A27FC4D6B600D4F7"><enum>(b)</enum>
								<header>HHS as PDP sponsor for a nationwide
		  prescription drug plan</header>
 <paragraph commented="no" display-inline="no-display-inline" id="H94C1451062344D61BD279BD6DDF57CC"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Administrator of the Centers for Medicare &amp; Medicaid Services, shall take such steps as may be necessary to qualify and serve as a PDP sponsor and to offer a prescription drug plan that offers basic prescription drug coverage throughout the United States. Such a plan shall be in addition to, and not in lieu of, other prescription drug plans offered under this part.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H92557A7B1FB64D93BD6DF956E2758CF2"><enum>(2)</enum><header display-inline="yes-display-inline">Premium; solvency;
 authorities</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Secretary—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HB5B7C63987104529A3D52BE7F124DB3B"><enum>(A)</enum><text display-inline="yes-display-inline">shall establish a premium in the amount of $37 for months in 2021 and, for months in subsequent years, in the amount specified in this paragraph for months in the previous year increased by the annual percentage increase described in section 1860D–2(b)(6) (relating to growth in Medicare prescription drug costs per beneficiary) for the year involved;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7ABB0524C52C4141B3A6B0AE9974C1D2"><enum>(B)</enum><text display-inline="yes-display-inline">is deemed to have met any applicable solvency and capital adequacy standards; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC8FABA02B1754025AEB99253A5D931ED"><enum>(C)</enum><text display-inline="yes-display-inline">shall exercise such authorities (including the use of regional or other pharmaceutical benefit managers) as the Secretary determines necessary to offer the prescription drug plan in the same or a comparable manner as is the case for prescription drug plans offered by private PDP sponsors.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDEA4CE910A2C404EBC28D7642F495788"><enum>(c)</enum><header>Flexibility in risk
 assumed</header><text display-inline="yes-display-inline">In order to ensure access pursuant to subsection (a) in an area the Secretary may approve limited risk plans under section 1860D–11(f) for the area.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="H2B2A35CD188D4E57A3B5FD8266DB7E5E"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 1860D–11(g) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-111">42 U.S.C. 1395w–111(g)</external-xref>) is amended by adding at the end the following new paragraph:</text>

 <paragraph commented="no" display-inline="no-display-inline" id="id072EAE2A4F344C32BDAD17CFFF5E31C8"><enum>(8)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">This subsection shall not apply on or after January 1, 2021.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id28B164E14E9243C692D056A9E81469BD"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to plan years beginning on or after January 1, 2021.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="HF91324C805494844988700565C9BEDCA" section-type="subsequent-section"><enum>304.</enum><header display-inline="yes-display-inline">Full reimbursement for qualified retiree
			 prescription drug plans</header>
				<subsection commented="no" display-inline="no-display-inline" id="HA1D594B908494C29A6DE17B673A5B9E7"><enum>(a)</enum><header display-inline="yes-display-inline">Elimination of true Out-of-Pocket
 limitation</header><text display-inline="yes-display-inline">Section 1860D–2(b)(4)(C)(iii) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(b)(4)(C)(iii)</external-xref>) is amended—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id3736F95F5BF34FDEA89D14DB68B215CC"><enum>(1)</enum><text>in subclause (III), by striking <quote>or</quote> at the end;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFBDEFD7DF664451D8BCDEC2D44A006A0"><enum>(2)</enum><text>in subclause (IV), by striking the period at the end and inserting <quote>; or</quote>; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE0770A170CAB415182811A92DE7AD99F"><enum>(3)</enum><text>by adding at the end the following new subclause:</text> <quoted-block display-inline="no-display-inline" id="idF0E5EA2458E74DA4B488788EB3555DF8" style="OLC"> <subclause commented="no" display-inline="no-display-inline" id="id4BA861DC8DBE48A1A0F3DA32E6FA5ACA"><enum>(V)</enum><text>under a qualified retiree prescription drug plan (as defined in section 1860D–22(a)(2)).</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDA6068FDAA7C4D7FAF60763179B60036"><enum>(b)</enum><header display-inline="yes-display-inline">Equalization of subsidies</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of Health and Human Services shall provide for such increase in the special subsidy payment amounts under section 1860D–22(a)(3) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-132">42 U.S.C. 1395w–132(a)(3)</external-xref>) as may be appropriate to provide for payments in the aggregate equivalent to the payments that would have been made under section 1860D–15 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-115">42 U.S.C. 1395w–115</external-xref>) if the individuals were not enrolled in a qualified retiree prescription drug plan. In making such computation, the Secretary shall not take into account the application of the amendments made by section 1202 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>; 117 Stat. 2480).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id26AE19F5506E4270818260B34B52C54C"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
 date</header><text display-inline="yes-display-inline">This section, and the amendments made by this section, shall take effect on January 1, 2021.</text>
