<section id="id79DBDA04B8D941968430CD2D2E0D2B96"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> <paragraph id="id3d14f5a29b9a452ca8971a9bd0e517ed"><enum>(1)</enum><text>as established by Federal law, a national monument may only be reduced, diminished, or revoked by an Act of Congress;</text> </paragraph>
<paragraph id="idb729b0ee71924a148a1722439306977e"><enum>(2)</enum><text>the national monuments under review under Executive Order 13792 (82 Fed. Reg. 20429 (May 1, 2017)) have delivered economic, cultural, and ecological benefits to local communities and the United States; and</text> </paragraph> <paragraph id="idFD17146D7CCA49AEAA2BEC57A4AAD1BD"><enum>(3)</enum><text>legislative actions subsequent to Presidential declarations, such as the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 991), have ratified certain national monuments under review and other national monuments.</text> </paragraph></section>
<title id="id34776F3969C541E99611A25160E0DCF9" style="OLC"><enum>I</enum><header>Administration of certain national monuments </header> 
<section id="idCE3CACA73AFC41FF91C23C16FC0FC494"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="id0E7075C29AFD4F62A48101206F1CD221"><enum>(1)</enum><header>Covered national monument</header><text>The term <quote>covered national monument</quote> means a national monument described in section 103.</text> </paragraph>
<paragraph id="idB59C4BFBC8814F3FA05EFD24A070F6EE"><enum>(2)</enum><header>Secretary concerned</header><text>The term <quote>Secretary concerned</quote> means—</text> <subparagraph id="id88900C3C0F5348DBA8470100619E1C20"><enum>(A)</enum><text>the Secretary of the Interior, with respect to a covered national monument under the joint or exclusive jurisdiction of the National Park Service, the Bureau of Land Management, or the United States Fish and Wildlife Service;</text> </subparagraph>
<subparagraph id="id1B9BF8D0BF2C4B5793036980BEEF0E74"><enum>(B)</enum><text>the Secretary of Agriculture, with respect to a covered national monument under the joint or exclusive jurisdiction of the Forest Service; and</text> </subparagraph> <subparagraph id="id3300B6E7637B429CBBC27433A6B46933"><enum>(C)</enum><text>the Secretary of Commerce, with respect to a covered national monument under the joint or exclusive jurisdiction of the National Oceanic and Atmospheric Administration.</text> </subparagraph></paragraph></section>
<section id="id208413614B6A40A8AE622B2493B1BD01"><enum>102.</enum><header>Administration of covered national monuments</header> 
<subsection id="id98298C869E724120BA9595B9C0C4AFDD"><enum>(a)</enum><header>In general</header><text>The Secretary concerned shall administer each national monument described in section 103 in accordance with—</text> <paragraph id="id0365C9987AF0464A84B76D2ECB4371FA"><enum>(1)</enum><text>the one or more applicable Presidential proclamations specified in that section that apply to the applicable covered national monument;</text> </paragraph>
<paragraph id="idA53C4FF138804E71B7C86B4433EBA638"><enum>(2)</enum><text>any Act of Congress enacted before December 4, 2017, that provides for an adjustment to the boundary of, or a requirement with respect to the administration of, the applicable covered national monument; and</text> </paragraph> <paragraph id="id790E34950773463B9920A62A116A7BA7"><enum>(3)</enum><text>this Act.</text> </paragraph></subsection>
<subsection id="idfc83b29d7d254f95892b10803ece22f7"><enum>(b)</enum><header>Maps and legal descriptions</header> 
<paragraph id="id7bb41120ab2945b6ae8b169c75c03314"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary concerned shall—</text> <subparagraph id="idC73F01E441E94685B5BEA73D4C18A211"><enum>(A)</enum><text>conduct a survey of the boundaries of each covered national monument; and</text> </subparagraph>
<subparagraph id="id09DD959BF88445838039982B9858BB94"><enum>(B)</enum><text>file a map and legal description of each covered national monument with—</text> <clause id="idd4e3c0e1b45d4cf99ad55b540039aecc"><enum>(i)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text> </clause>
<clause id="id679dff8b13074c4e99b98d99f652b203"><enum>(ii)</enum><text>the Committee on Natural Resources of the House of Representatives.</text> </clause></subparagraph></paragraph> <paragraph id="id3c5b5c3e10dc499dbe0a0e38ade310cb"><enum>(2)</enum><header>Force of law</header><text>The maps and legal descriptions filed under paragraph (1)(B) shall have the same force and effect as if included in this Act, except that the Secretary concerned may correct errors in the legal descriptions and maps.</text> </paragraph>
<paragraph id="ide63b1eebd2f9453985040a6bf85323df"><enum>(3)</enum><header>Public availability</header><text>The maps and legal descriptions filed under paragraph (1)(B) shall be on file and available for public inspection in the appropriate offices of the Secretary concerned.</text> </paragraph></subsection> <subsection id="id9c226e84905a43bb98f1a08f0fd00902"><enum>(c)</enum><header>Management plan</header><text>If a management plan has not been prepared for a covered national monument as of the date of enactment of this Act, not later than 2 years after the date of enactment of this Act, the Secretary concerned shall prepare a management plan for the covered national monument, in accordance with—</text> 
<paragraph id="id1402169E30EB4B869827B55CF2E77336"><enum>(1)</enum><text>the one or more Presidential proclamations specified in section 103 that apply to the applicable covered national monument; and</text> </paragraph> <paragraph id="id360EE30A68804DAAAC1170A60E82570A"><enum>(2)</enum><text>any other applicable Federal law (including regulations).</text> </paragraph></subsection>
<subsection id="id2349bc4e07e24de198562e1dd60a882b"><enum>(d)</enum><header>Funding</header><text>A covered national monument shall be eligible to receive funds from the National Monument Enhancement Fund established by section 201(a).</text> </subsection></section> <section id="id922A2E9D3B984109B91C2A0C91083623"><enum>103.</enum><header>Description of covered national monuments</header><text display-inline="no-display-inline">The following are the national monuments referred to in section 102(a):</text> 
<paragraph id="id40A2C631583D483CB0BE191C2137DA43"><enum>(1)</enum><header>Birmingham Civil Rights National Monument, Alabama</header><text display-inline="yes-display-inline">The Birmingham Civil Rights National Monument established in the State of Alabama by Presidential Proclamation 9565, as issued on January 12, 2017 (<external-xref legal-doc="usc" parsable-cite="usc/54/320301">54 U.S.C. 320301</external-xref> note).</text> </paragraph> <paragraph id="id950A599F2F7E483C86D6447C61DABFAB"><enum>(2)</enum><header>Freedom Riders National Monument, Alabama</header><text display-inline="yes-display-inline">The Freedom Riders National Monument established in the State of Alabama by Presidential Proclamation 9566, as issued on January 12, 2017 (<external-xref legal-doc="usc" parsable-cite="usc/54/320301">54 U.S.C. 320301</external-xref> note).</text> </paragraph>
<paragraph id="id211C512471F64F35BFE893AAB1C71A84"><enum>(3)</enum><header>Agua Fria National Monument, Arizona</header><text display-inline="yes-display-inline">The Agua Fria National Monument established in the State of Arizona by Presidential Proclamation 7263, as issued on January 11, 2000 (<external-xref legal-doc="usc" parsable-cite="usc/54/320301">54 U.S.C. 320301</external-xref> note).</text> </paragraph> <paragraph id="idEB520B0ECA4041C59DEC1C646F79754A"><enum>(4)</enum><header>Grand Canyon-Parashant National Monument, Arizona</header><text display-inline="yes-display-inline">The Grand Canyon-Parashant National Monument established in the State of Arizona by Presidential Proclamation 7265, as issued on January 11, 2000 (<external-xref legal-doc="usc" parsable-cite="usc/54/320301">54 U.S.C. 320301</external-xref> note).</text> </paragraph>

<subsection id="id1649A2FC4D8C49A2A57DF2A8D861B072"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury a fund, to be known as the <quote>National Monument Enhancement Fund</quote> (referred to in this title as the <quote>Fund</quote>), consisting of such amounts as are appropriated to the Fund under section 202.</text> </subsection> <subsection id="idCAADDE45F38F4D63B6D7767530DD015A"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the Fund are—</text> 
<paragraph id="idad72bc3a3a45401dbbe73bb9dfb90c26"><enum>(1)</enum><text>to provide funds to the Bureau of Land Management, the Forest Service, the National Park Service, the United States Fish and Wildlife Service, and the National Oceanographic and Atmospheric Administration for the development of management plans for national monuments designated under section 320301 of title 54, United States Code;</text> </paragraph> <paragraph id="idbac283d4f1c447d1adf5ccfb4d7acd65"><enum>(2)</enum><text>to provide funds for the Federal acquisition and development of certain land and other areas; and</text> </paragraph>

<paragraph id="id73E61DBB62BA4F248E7AC98A13142CD9"><enum>(2)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text> </paragraph> <paragraph id="id70d800b91d474bfe9aaa1cf024b0d5d9"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means the State of New Mexico.</text> </paragraph>
<paragraph id="id3e30105bd83d49c780635ca46771721e"><enum>(4)</enum><header>Wilderness area</header><text>The term <term>wilderness area</term> means a wilderness area designated by subsection (b)(1).</text> </paragraph></subsection> <subsection id="idf48262b8348b4ea1ba3c11f352032eff"><enum>(b)</enum><header>Designation of wilderness areas</header> <paragraph id="id0e702a7d584742dbb0da17903ce0abe0"><enum>(1)</enum><header>In general</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), the following areas in the State are designated as wilderness and as components of the National Wilderness Preservation System:</text> 
<subparagraph id="idee3d283f775d40208203dea1755844a5"><enum>(A)</enum><header>Aden lava flow wilderness</header><text>Certain land administered by the Bureau of Land Management in Doña Ana County comprising approximately 27,673 acres, as generally depicted on the map entitled <quote>Potrillo Mountains Complex</quote> and dated September 27, 2018, which shall be known as the <quote>Aden Lava Flow Wilderness</quote>.</text> </subparagraph> <subparagraph id="id6debe3c4faa7410db61e7f2cea7ad6a5"><enum>(B)</enum><header>Broad canyon wilderness</header><text>Certain land administered by the Bureau of Land Management in Doña Ana County comprising approximately 13,902 acres, as generally depicted on the map entitled <quote>Desert Peaks Complex</quote> and dated October 1, 2018, which shall be known as the <quote>Broad Canyon Wilderness</quote>.</text> </subparagraph>

<subparagraph id="idcb70085a645e4163a08263ecb7e7f5cb"><enum>(A)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall file maps and legal descriptions of the wilderness areas with—</text> <clause id="ida08468768ec443cabd9f498cbad8ee75"><enum>(i)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text> </clause>
<clause id="id8dd2bf1151fd475db7f918efb68362cb"><enum>(ii)</enum><text>the Committee on Natural Resources of the House of Representatives.</text> </clause></subparagraph> <subparagraph id="ida2404116e94c42abaa034da0e540affa"><enum>(B)</enum><header>Force of law</header><text>The maps and legal descriptions filed under subparagraph (A) shall have the same force and effect as if included in this Act, except that the Secretary may correct errors in the maps and legal descriptions.</text> </subparagraph>
<subparagraph id="ide31f3a90f4a1438db41f081cc910c6e1"><enum>(C)</enum><header>Public availability</header><text>The maps and legal descriptions filed under subparagraph (A) shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management.</text> </subparagraph></paragraph> <paragraph id="id4125a2bb570f43b188bbd644d4b5d2c7"><enum>(3)</enum><header>Management</header><text>Subject to valid existing rights, the wilderness areas shall be administered by the Secretary—</text> 
<subparagraph id="idc48250f038a342aabc5d4100bc12e197"><enum>(A)</enum><text>as components of the National Landscape Conservation System; and</text> </subparagraph> <subparagraph id="idad7ac01ff94e48a8831c497642467061"><enum>(B)</enum><text>in accordance with—</text> 
<clause id="id31b0055865f04590a8242b7f6edc171e"><enum>(i)</enum><text>this section; and</text> </clause> <clause id="id927d9bb233a24b998bec0f8e9f4534b2"><enum>(ii)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), except that—</text> 
<subclause id="id1c87f43a37624c169f24dda439e0c9a6"><enum>(I)</enum><text>any reference in the Wilderness Act to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act; and</text> </subclause> <subclause id="id751f5c5d39154047badfabc359d78747"><enum>(II)</enum><text>any reference in the Wilderness Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary.</text> </subclause></clause></subparagraph></paragraph>
<paragraph id="idb44dd6c4484f445f8a91cf23ec3a5374"><enum>(4)</enum><header>Incorporation of acquired land and interests in land</header><text>Any land or interest in land that is within the boundary of a wilderness area that is acquired by the United States shall—</text> <subparagraph id="id7b518b6582844b32b4668832097e8552"><enum>(A)</enum><text>become part of the wilderness area within the boundaries of which the land is located; and</text> </subparagraph>
<subparagraph id="idb7917cca10e8411fb9cc16fbd9359a88"><enum>(B)</enum><text>be managed in accordance with—</text> <clause id="id8bc2e6db0d944c669dc11489f42de4cd"><enum>(i)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.);</text> </clause>
<clause id="id2e0a76c1f53748ad9e8c1e5aade08a30"><enum>(ii)</enum><text>this section; and</text> </clause> <clause id="idc928d31d9be04f9489cfd85616a16208"><enum>(iii)</enum><text>any other applicable laws.</text> </clause></subparagraph></paragraph>
<paragraph id="idbe1cb62cf92f434a934dea171634c35f"><enum>(5)</enum><header>Grazing</header><text>Grazing of livestock in the wilderness areas, where established before the date of enactment of this Act, shall be administered in accordance with—</text> <subparagraph id="id74b5913b5cdf4b4a973eba6beaeb05aa"><enum>(A)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>); and</text> </subparagraph>
<subparagraph id="idaaf94235a2744bb4895681da863cbca1"><enum>(B)</enum><text>the guidelines set forth in Appendix A of the Report of the Committee on Interior and Insular Affairs to accompany H.R. 2570 of the 101st Congress (H. Rept. 101–405).</text> </subparagraph></paragraph> <paragraph id="idc5478737f3044e30ad005ad9ce12cb72"><enum>(6)</enum><header>Military overflights</header><text>Nothing in this subsection restricts or precludes—</text> 
<subparagraph id="id3d3fe77cb9074e2da31f93bb9000b752"><enum>(A)</enum><text>low-level overflights of military aircraft over the wilderness areas, including military overflights that can be seen or heard within the wilderness areas;</text> </subparagraph> <subparagraph id="id8c7ef6b16c6e4c3c828fb4d212f89d8c"><enum>(B)</enum><text>the designation of new units of special airspace over the wilderness areas; or</text> </subparagraph>
<subparagraph id="idcf0082073fff4d95afb7c1b046f0d2b6"><enum>(C)</enum><text>the use or establishment of military flight training routes over the wilderness areas.</text> </subparagraph></paragraph> <paragraph id="id94ad0e91509245df83e881ac87bd134f"><enum>(7)</enum><header>Buffer zones</header> <subparagraph id="id576ccb172f754ff69e932aaf76abf3cd"><enum>(A)</enum><header>In general</header><text>Nothing in this subsection creates a protective perimeter or buffer zone around any wilderness area.</text> </subparagraph>
<subparagraph id="id2f835bdb922f43c9ad567605e8c96fa1"><enum>(B)</enum><header>Activities outside wilderness areas</header><text>The fact that an activity or use on land outside any wilderness area can be seen or heard within the wilderness area shall not preclude the activity or use outside the boundary of the wilderness area.</text> </subparagraph></paragraph> <paragraph id="idbf8a2f7f35f84218bbaa30441213ac10"><enum>(8)</enum><header>Paragliding</header><text>The use of paragliding within areas of the East Potrillo Mountains Wilderness designated by paragraph (1)(D) in which the use has been established before the date of enactment of this Act, shall be allowed to continue in accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>), subject to any terms and conditions that the Secretary determines to be necessary.</text> </paragraph>
<paragraph id="id6133e1f89a6a402bb1d6ef277285bfe3"><enum>(9)</enum><header>Climatologic data collection</header><text>Subject to such terms and conditions as the Secretary may prescribe, nothing in this section precludes the installation and maintenance of hydrologic, meteorologic, or climatologic collection devices in wilderness areas if the facilities and access to the facilities are essential to flood warning, flood control, or water reservoir operation activities.</text> </paragraph> <paragraph id="id2c98adb568d045aaabf67c63534c233b"><enum>(10)</enum><header>Fish and wildlife</header><text>Nothing in this section affects the jurisdiction of the State with respect to fish and wildlife located on public land in the State, except that the Secretary, after consultation with the New Mexico Department of Game and Fish, may designate zones where, and establish periods during which, no hunting or fishing shall be permitted for reasons of public safety, administration, or compliance with applicable law.</text> </paragraph>
<paragraph id="id10348ab67e3f49df8eb88a03ee6c8fbd"><enum>(11)</enum><header>Withdrawals</header> 
<subparagraph id="id16ed2de5479a4d619b3437c387ba2739"><enum>(A)</enum><header>In general</header><text>Subject to valid existing rights, the Federal land within the wilderness areas and any land or interest in land that is acquired by the United States in the wilderness areas after the date of enactment of this Act is withdrawn from—</text> <clause id="idbb64bd12ae0d47f197e19df13b9211e4"><enum>(i)</enum><text>entry, appropriation, or disposal under the public land laws;</text> </clause>
<clause id="id3696c91368c24a50b235ba16623b2626"><enum>(ii)</enum><text>location, entry, and patent under the mining laws; and</text> </clause> <clause id="idad7479500d124eeb9562ab456e65ed68"><enum>(iii)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text> </clause></subparagraph>
<subparagraph id="idc4b2d1a56c0d4cc4b55eb52ba8c66d42"><enum>(B)</enum><header>Parcel b</header><text>The approximately 6,498 acres of land generally depicted as <quote>Parcel B</quote> on the map entitled <quote>Organ Mountains Area</quote> and dated September 21, 2016, is withdrawn in accordance with subparagraph (A), except that the land is not withdrawn for purposes of the issuance of oil and gas pipeline or road rights-of-way.</text> </subparagraph> <subparagraph id="ide87d892a6f81498bb2b64aee3ba2fbf2"><enum>(C)</enum><header>Parcel c</header><text>The approximately 1,297 acres of land generally depicted as <quote>Parcel C</quote> on the map entitled <quote>Organ Mountains Area</quote> and dated September 21, 2016, is withdrawn in accordance with subparagraph (A), except that the land is not withdrawn from disposal under the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869</external-xref> et seq.).</text> </subparagraph>
<subparagraph id="id8ba7b55513d34f5695298751dacc8752"><enum>(D)</enum><header>Parcel d</header> 
<clause id="idcaafe0b719e0435c8b98fbf3b1484086"><enum>(i)</enum><header>In general</header><text>The Secretary of the Army shall allow for the conduct of certain recreational activities on the approximately 2,035 acres of land generally depicted as <quote>Parcel D</quote> on the map entitled <quote>Organ Mountains Area</quote> and dated September 21, 2016 (referred to in this subparagraph as the <quote>parcel</quote>), which is a portion of the public land withdrawn and reserved for military purposes by Public Land Order 833 dated May 21, 1952 (17 Fed. Reg. 4822).</text> </clause> <clause id="id11039ffd771e4d87b1836a3b55570309"><enum>(ii)</enum><header>Outdoor recreation plan</header> <subclause id="idcedfbd196de843f8bb0f8b5ff50a6ab2"><enum>(I)</enum><header>In general</header><text>The Secretary of the Army shall develop a plan for public outdoor recreation on the parcel that is consistent with the primary military mission of the parcel.</text> </subclause>
<subclause id="id66bbf165a2884173b9e134cb6b83bda4"><enum>(II)</enum><header>Requirement</header><text>In developing the plan under subclause (I), the Secretary of the Army shall ensure, to the maximum extent practicable, that outdoor recreation activities may be conducted on the parcel, including hunting, hiking, wildlife viewing, and camping.</text> </subclause></clause> <clause id="idd563180bd9c2472fb1d493ad3e33beac"><enum>(iii)</enum><header>Closures</header><text>The Secretary of the Army may close the parcel or any portion of the parcel to the public as the Secretary of the Army determines to be necessary to protect—</text> 
<subclause id="id7c747d9c8b3e4f0c8ad032c40e75de91"><enum>(I)</enum><text>public safety; or</text> </subclause> <subclause id="id28a55b9416774f02b07dc672b8fece3b"><enum>(II)</enum><text>the safety of the military members training on the parcel.</text> </subclause></clause>
<clause id="id9126aaf4c4a34ea7b6fbefb1c5009461"><enum>(iv)</enum><header>Transfer of administrative jurisdiction; withdrawal</header> 
<subclause id="id0f9a866583474e4a96d04d148e203141"><enum>(I)</enum><header>In general</header><text>On a determination by the Secretary of the Army that military training capabilities, personnel safety, and installation security would not be hindered as a result of the transfer to the Secretary of administrative jurisdiction over the parcel, the Secretary of the Army shall transfer to the Secretary administrative jurisdiction over the parcel.</text> </subclause> <subclause id="idc945fad08a444cb6bf4e62deb2cd651c"><enum>(II)</enum><header>Withdrawal</header><text>On transfer of the parcel under subclause (I), the parcel shall be—</text> 
<item id="idee73d5b0bd024741a5c426baa0c2bafd"><enum>(aa)</enum><text>under the jurisdiction of the Director of the Bureau of Land Management; and</text> </item> <item id="id8378e5b2f62e47559ea6013b72120295"><enum>(bb)</enum><text>withdrawn from—</text> 
<subitem id="id2ec6b572e721456b860986f1615ac00b"><enum>(AA)</enum><text>entry, appropriation, or disposal under the public land laws;</text> </subitem> <subitem id="id9ca398295ba641689dcbc0138e9a033e"><enum>(BB)</enum><text>location, entry, and patent under the mining laws; and</text> </subitem>
<subitem id="id58c93a8e78f54d0bb68cd8e8fa380081"><enum>(CC)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text> </subitem></item></subclause> <subclause id="iddf3c940129894bc7af90c4e432956bf4"><enum>(III)</enum><header>Reservation</header><text>On transfer under subclause (I), the parcel shall be reserved for management of the resources of, and military training conducted on, the parcel in accordance with a memorandum of understanding entered into under clause (v).</text> </subclause></clause>
<clause id="idb35ed0be1dc6444181369705471412f5"><enum>(v)</enum><header>Memorandum of understanding relating to military training</header> 
<subclause id="id044bc1a19e58441596847f382331b1d0"><enum>(I)</enum><header>In general</header><text>If, after the transfer of the parcel under clause (iv)(I), the Secretary of the Army requests that the Secretary enter into a memorandum of understanding, the Secretary shall enter into a memorandum of understanding with the Secretary of the Army providing for the conduct of military training on the parcel.</text> </subclause> <subclause id="idb6f8ca09523f4170b3c74afb639ca244"><enum>(II)</enum><header>Requirements</header><text>The memorandum of understanding entered into under subclause (I) shall—</text> 
<item id="id8e48cb4823d140f1a44ab7b11f8ff110"><enum>(aa)</enum><text>address the location, frequency, and type of training activities to be conducted on the parcel;</text> </item> <item id="id2c04a0021d9844ef91edc55ad2e081df"><enum>(bb)</enum><text>provide to the Secretary of the Army access to the parcel for the conduct of military training;</text> </item>
<item id="idabdc8ba155524743aa228f37e986cd72"><enum>(cc)</enum><text>authorize the Secretary or the Secretary of the Army to close the parcel or a portion of the parcel to the public as the Secretary or the Secretary of the Army determines to be necessary to protect—</text> <subitem id="id791d44f71f5c45e48b5724a43edb2eb4"><enum>(AA)</enum><text>public safety; or</text> </subitem>
<subitem id="id3625c8b43f1442cf8381433f1a8a2db3"><enum>(BB)</enum><text>the safety of the military members training; and</text> </subitem></item> <item id="id991daddd01cc4b89bd0675cee24b36c8"><enum>(dd)</enum><text>to the maximum extent practicable, provide for the protection of natural, historic, and cultural resources in the area of the parcel.</text> </item></subclause></clause>
<clause id="id378c6a119dd648c1aa3f094f4eea356b"><enum>(vi)</enum><header>Military overflights</header><text>Nothing in this subparagraph restricts or precludes—</text> <subclause id="idf39ebe9c18dc4fbe8a20ba2e0ae7d55d"><enum>(I)</enum><text>low-level overflights of military aircraft over the parcel, including military overflights that can be seen or heard within the parcel;</text> </subclause>
<subclause id="id9fed7a1f45ae4b1fb19ab50f82ddd1b0"><enum>(II)</enum><text>the designation of new units of special airspace over the parcel; or</text> </subclause> <subclause id="id9fb425972a2f4c60bb6dd07b8948c036"><enum>(III)</enum><text>the use or establishment of military flight training routes over the parcel.</text> </subclause></clause></subparagraph></paragraph>
<paragraph id="idae1dd4066f734693bab5ce0a640c49fa"><enum>(12)</enum><header>Robledo mountains</header> 
<subparagraph id="id6fe73045b9114299937d62f7767dc481"><enum>(A)</enum><header>In general</header><text>The Secretary shall manage the Federal land described in subparagraph (B) in a manner that preserves the character of the land for the future inclusion of the land in the National Wilderness Preservation System.</text> </subparagraph> <subparagraph id="idf7b1c9ab96cd4b7d88d703295d4baf2f"><enum>(B)</enum><header>Land description</header><text>The land referred to in subparagraph (A) is certain land administered by the Bureau of Land Management, comprising approximately 100 acres as generally depicted as <quote>Lookout Peak Communication Site</quote> on the map entitled <quote>Desert Peaks Complex</quote> and dated October 1, 2018.</text> </subparagraph>
<subparagraph id="id44e8fd2000024d5ab3bd7a99c4d9d487"><enum>(C)</enum><header>Uses</header><text>The Secretary shall permit only such uses on the land described in subparagraph (B) as were permitted on the date of enactment of this Act.</text> </subparagraph></paragraph> <paragraph id="id7afc6dc4d1e64b4a951219384d2fb948"><enum>(13)</enum><header>Release of wilderness study areas</header><text>Congress finds that, for purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the public land in Doña Ana County administered by the Bureau of Land Management not designated as wilderness by paragraph (1) or described in paragraph (12)—</text> 
<subparagraph id="id61c5df7dc8e341c58af95a5221f5afbe"><enum>(A)</enum><text>has been adequately studied for wilderness designation;</text> </subparagraph> <subparagraph id="id75fb2e28624f497a9f5e432b61f0cd1f"><enum>(B)</enum><text>is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>); and</text> </subparagraph>
<subparagraph id="id959086e84b6e49a28b88bd6238b8d519"><enum>(C)</enum><text>shall be managed in accordance with—</text> <clause id="id60d1444135cc4767a91411be793daeae"><enum>(i)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.);</text> </clause>
<clause id="ida557bdf9b34f43a6932939debcf288d0"><enum>(ii)</enum><text>this section; and</text> </clause> <clause id="id742a27c904a14681bb28d6d84b5131c8"><enum>(iii)</enum><text>any other applicable laws.</text> </clause></subparagraph></paragraph>
<paragraph id="idb9f330e3b6c44e80bd8377eaf2350605"><enum>(14)</enum><header>Private land</header><text>In accordance with section 5 of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1134">16 U.S.C. 1134</external-xref>), the Secretary shall ensure adequate access to non-Federal land located within the boundary of a wilderness area.</text> </paragraph></subsection> <subsection id="ide41050af2ad8434bb83aa1dbb48b7661"><enum>(c)</enum><header>Border security</header> <paragraph id="id6e853cf688af4c45940e306747ab9644"><enum>(1)</enum><header>In general</header><text>Nothing in this section—</text> 
<subparagraph id="idd2999a41ad0842e8828d42d2de63559d"><enum>(A)</enum><text>prevents the Secretary of Homeland Security from undertaking law enforcement and border security activities, in accordance with section 4(c) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(c)</external-xref>), within the wilderness areas, including the ability to use motorized access within a wilderness area while in pursuit of a suspect;</text> </subparagraph> <subparagraph id="idffbb133e7a0f4139b3cf9f8cfe0319a8"><enum>(B)</enum><text>affects the 2006 Memorandum of Understanding among the Department of Homeland Security, the Department of the Interior, and the Department of Agriculture regarding cooperative national security and counterterrorism efforts on Federal land along the borders of the United States; or</text> </subparagraph>
<subparagraph id="id7904549b8b2d46cb9f70e18b45dc73a8"><enum>(C)</enum><text>prevents the Secretary of Homeland Security from conducting any low-level overflights over the wilderness areas that may be necessary for law enforcement and border security purposes.</text> </subparagraph></paragraph> <paragraph id="id2a7dbfa74db84733b88d7f58912139de"><enum>(2)</enum><header>Withdrawal and administration of certain area</header> <subparagraph id="idbd1300df43844f9a9e95965b6dfa0359"><enum>(A)</enum><header>Withdrawal</header><text>The area identified as <quote>Parcel A</quote> on the map entitled <quote>Potrillo Mountains Complex</quote> and dated September 27, 2018, is withdrawn in accordance with subsection (b)(11)(A).</text> </subparagraph>
<subparagraph id="id2946d95b46224798833edd4d8cdf03f2"><enum>(B)</enum><header>Administration</header><text>Except as provided in subparagraphs (C) and (D), the Secretary shall administer the area described in subparagraph (A) in a manner that, to the maximum extent practicable, protects the wilderness character of the area.</text> </subparagraph> <subparagraph id="id8cf38d1fe5a142a49624fb89920c3ac6"><enum>(C)</enum><header>Use of motor vehicles</header><text>The use of motor vehicles, motorized equipment, and mechanical transport shall be prohibited in the area described in subparagraph (A) except as necessary for—</text> 
<clause id="idaa6a8909d7e0429294f444a45d10c3a2"><enum>(i)</enum><text>the administration of the area (including the conduct of law enforcement and border security activities in the area); or</text> </clause> <clause id="id90453990548548d6ad640526b560ff83"><enum>(ii)</enum><text>grazing uses by authorized permittees.</text> </clause></subparagraph>
<subparagraph id="iddfd828ca33e54b5b96424bd45b854ad7"><enum>(D)</enum><header>Effect of subsection</header><text>Nothing in this paragraph precludes the Secretary from allowing within the area described in subparagraph (A) the installation and maintenance of communication or surveillance infrastructure necessary for law enforcement or border security activities.</text> </subparagraph></paragraph> <paragraph id="idd1e6df391481402db39e549feb269c4c"><enum>(3)</enum><header>Restricted Route</header><text>The route excluded from the Potrillo Mountains Wilderness identified as <quote>Restricted—Administrative Access</quote> on the map entitled <quote>Potrillo Mountains Complex</quote> and dated September 27, 2018, shall be—</text> 
<subparagraph id="idb8fafc3398a14bd9889d40f3774032ee"><enum>(A)</enum><text>closed to public access; but</text> </subparagraph> <subparagraph id="id5671acec970c46018777b8d816d0d28b"><enum>(B)</enum><text>available for administrative and law enforcement uses, including border security activities.</text> </subparagraph></paragraph></subsection>
<subsection id="iddf6b2e61eca44199909b1226bc1fe716"><enum>(d)</enum><header>Organ Mountains-Desert Peaks National Monument</header> 
<paragraph id="id59419787d6a245e48b00b32a7fe18cfb"><enum>(1)</enum><header>Management plan</header><text>In preparing and implementing the management plan for the Monument, the Secretary shall include a watershed health assessment to identify opportunities for watershed restoration.</text> </paragraph> <paragraph id="idfd1d16d48ce1420a99d586661223a043"><enum>(2)</enum><header>Incorporation of acquired state trust land and interests in state trust land</header> <subparagraph id="iddcfa29db2a9c480c8d714fc23672f723"><enum>(A)</enum><header>In general</header><text>Any land or interest in land that is within the State trust land described in subparagraph (B) that is acquired by the United States shall—</text> 
<clause id="id32cb6136c06f43b39a9d3edf60a2e033"><enum>(i)</enum><text>become part of the Monument; and</text> </clause> <clause id="id29447467ff5246feb6a7441809a7aaa0"><enum>(ii)</enum><text>be managed in accordance with—</text> 
<subclause id="idfa029e7ff20444b09f011bb3b6d6f748"><enum>(I)</enum><text>Presidential Proclamation 9131, as issued on May 21, 2014 (<external-xref legal-doc="usc" parsable-cite="usc/54/320301">54 U.S.C. 320301</external-xref> note);</text> </subclause> <subclause id="id4579fec3fc2b4a4e9ef0ef5968bd4198"><enum>(II)</enum><text>this section; and</text> </subclause>
<subclause id="id012f13b546f746f5b80a98ab85213349"><enum>(III)</enum><text>any other applicable laws.</text> </subclause></clause></subparagraph> <subparagraph id="id0a81c2a5d7a746b9ac21fe6cb8f59f37"><enum>(B)</enum><header>Description of state trust land</header><text>The State trust land referred to in subparagraph (A) is the State trust land in T. 22 S., R. 01 W., New Mexico Principal Meridian and T. 22 S., R. 02 W., New Mexico Principal Meridian.</text> </subparagraph></paragraph>
<paragraph id="idb91eaee411844a2b9acde9e7c4fd2281"><enum>(3)</enum><header>Land exchanges</header> 
<subparagraph id="idf7cfb0b4b8c6409796dc674c02bcc5c2"><enum>(A)</enum><header>In general</header><text>Subject to subparagraphs (C) through (F), the Secretary shall attempt to enter into an agreement to initiate an exchange under section 2201.1 of title 43, Code of Federal Regulations (or successor regulations), with the Commissioner of Public Lands of New Mexico, by the date that is 18 months after the date of enactment of this Act, to provide for a conveyance to the State of all right, title, and interest of the United States in and to Bureau of Land Management land in the State identified under subparagraph (B) in exchange for the conveyance by the State to the Secretary of all right, title, and interest of the State in and to parcels of State trust land within the boundary of the Monument identified under that subparagraph or described in paragraph (2)(B).</text> </subparagraph> <subparagraph id="id13c952225e564bd690d42e27e96c552c"><enum>(B)</enum><header>Identification of land for exchange</header><text>The Secretary and the Commissioner of Public Lands of New Mexico shall jointly identify the Bureau of Land Management land and State trust land eligible for exchange under this paragraph, the exact acreage and legal description of which shall be determined by surveys approved by the Secretary and the New Mexico State Land Office.</text> </subparagraph>
<subparagraph id="idc967912d3c9d405eb39cfe4dcb5ae93d"><enum>(C)</enum><header>Applicable law</header><text>A land exchange under subparagraph (A) shall be carried out in accordance with section 206 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716</external-xref>).</text> </subparagraph> <subparagraph id="idbb3b7c353e92426495d858d90c35d90b"><enum>(D)</enum><header>Conditions</header><text>A land exchange under subparagraph (A) shall be subject to—</text> 
<clause id="idc3d30bec08d145b098cbf02de525e297"><enum>(i)</enum><text>valid existing rights; and</text> </clause> <clause id="id35918d6534d7426aa1da066c18bdfe7a"><enum>(ii)</enum><text>such terms as the Secretary and the State shall establish.</text> </clause></subparagraph>
<subparagraph id="idb701a241e0cf4efc8fea195d1ed653b0"><enum>(E)</enum><header>Valuation, appraisals, and equalization</header> 
<clause id="ide2822d26a8374065b91ba6ce08a49774"><enum>(i)</enum><header>In general</header><text>The value of the Bureau of Land Management land and the State trust land to be conveyed in a land exchange under this paragraph—</text> <subclause id="id6991de107d1c4d01b74d6994516a376a"><enum>(I)</enum><text>shall be equal, as determined by appraisals conducted in accordance with clause (ii); or</text> </subclause>
<subclause id="ida57ebea57c214c31ac208f82d0c74680"><enum>(II)</enum><text>if not equal, shall be equalized in accordance with clause (iii).</text> </subclause></clause> <clause id="id89e2a23c9be844c8acc12a88ef02f656"><enum>(ii)</enum><header>Appraisals</header> <subclause id="idf48ab34a47aa40e59252595289ca0a8a"><enum>(I)</enum><header>In general</header><text>The Bureau of Land Management land and State trust land to be exchanged under this paragraph shall be appraised by an independent, qualified appraiser that is agreed to by the Secretary and the State.</text> </subclause>
<subclause id="id91d6b8bce86d4cc98533d2a11cf4779b"><enum>(II)</enum><header>Requirements</header><text>An appraisal under subclause (I) shall be conducted in accordance with—</text> <item id="id5f93e65e9d6947e199f4511b8e987d10"><enum>(aa)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and</text> </item>
<item id="idbcd8c3d0c1064da0afd0e6bdad7d6194"><enum>(bb)</enum><text>the Uniform Standards of Professional Appraisal Practice.</text> </item></subclause></clause> <clause id="id8cfadc45569149d484f32bd70c173f8b"><enum>(iii)</enum><header>Equalization</header> <subclause id="ide96dea73eb5549d09acded2af9b7e12d"><enum>(I)</enum><header>In general</header><text>If the value of the Bureau of Land Management land and the State trust land to be conveyed in a land exchange under this paragraph is not equal, the value may be equalized by—</text> 
<item id="idc175614718db4b4784eb0522627999c5"><enum>(aa)</enum><text>making a cash equalization payment to the Secretary or to the State, as appropriate, in accordance with section 206(b) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(b)</external-xref>); or</text> </item> <item id="id4f540feae6234f1091f6ee3575a11739"><enum>(bb)</enum><text>reducing the acreage of the Bureau of Land Management land or State trust land to be exchanged, as appropriate.</text> </item></subclause>
<subclause id="id852791bb20dd4bb9982272bfedd03250"><enum>(II)</enum><header>Cash equalization payments</header><text>Any cash equalization payments received by the Secretary under subclause (I)(aa) shall be—</text> <item id="idbd686f210c8441e89196ca102f32a577"><enum>(aa)</enum><text>deposited in the Federal Land Disposal Account established by section 206(a) of the Federal Land Transaction Facilitation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/2305">43 U.S.C. 2305(a)</external-xref>); and</text> </item>
<item id="id53c604db10eb40a2b25bee9e38aeca77"><enum>(bb)</enum><text>used in accordance with that Act.</text> </item></subclause></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id3677ab2b30164a39be7a2327cab17768"><enum>(F)</enum><header>Limitation</header><text>No exchange of land shall be conducted under this paragraph unless mutually agreed to by the Secretary and the State.</text> </subparagraph></paragraph></subsection></section>
<section id="id85E533E9C5AA478C99B2E9A58E8F1B8F"><enum>302.</enum><header>Cerro del Yuta and Río San Antonio Wilderness Areas</header> 
<subsection id="id230E7183C2B04D658AEE4AC1B80AACDC"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="id8241d67e-416b-40c3-827e-bc92b4a59299"><enum>(1)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Río Grande del Norte National Monument Proposed Wilderness Areas</quote> and dated July 28, 2015.</text> </paragraph>
<paragraph id="id1d8e0ba4-3ba3-4301-ac67-5ca5bd8c6c8a"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph> <paragraph id="id142876A2563746248C3F15CF1161B5E1"><enum>(3)</enum><header>Wilderness area</header><text>The term <quote>wilderness area</quote> means a wilderness area designated by subsection (b)(1).</text> </paragraph></subsection>
<subsection id="id6725ce3e-922f-4706-8b20-602ae25f6639"><enum>(b)</enum><header>Designation of Cerro del Yuta and Río San Antonio Wilderness Areas</header> 
<paragraph id="id0e4cd064-3b4b-43fc-88c5-deeb4605846b"><enum>(1)</enum><header>In general</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), the following areas in the Río Grande del Norte National Monument are designated as wilderness and as components of the National Wilderness Preservation System:</text> <subparagraph id="id6f85ff6c-302a-4108-9660-1f99800dafce"><enum>(A)</enum><header>Cerro del yuta wilderness</header><text>Certain land administered by the Bureau of Land Management in Taos County, New Mexico, comprising approximately 13,420 acres as generally depicted on the map, which shall be known as the <quote>Cerro del Yuta Wilderness</quote>.</text> </subparagraph>
<subparagraph id="id486b9056-e6dc-43d3-a5d5-31b484327207"><enum>(B)</enum><header>Río san antonio wilderness</header><text>Certain land administered by the Bureau of Land Management in Río Arriba County, New Mexico, comprising approximately 8,120 acres, as generally depicted on the map, which shall be known as the <quote>Río San Antonio Wilderness</quote>.</text> </subparagraph></paragraph> <paragraph id="ida72f0d9f-e29b-4839-b6fb-77fde3cac9a2"><enum>(2)</enum><header>Management of wilderness areas</header><text>Subject to valid existing rights, the wilderness areas shall be administered in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.) and this section, except that with respect to the wilderness areas designated by this section—</text> 
<subparagraph id="id54931d33-0b1e-4340-a70c-cbb872206e6f"><enum>(A)</enum><text>any reference to the effective date of the Wilderness Act shall be considered to be a reference to the date of enactment of this Act; and</text> </subparagraph> <subparagraph id="idb701f05a-f108-495a-82e2-b2c361d92617"><enum>(B)</enum><text>any reference in the Wilderness Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary.</text> </subparagraph></paragraph>
<paragraph id="id62fab9d2-291b-4aea-8488-d08ea58337a3"><enum>(3)</enum><header>Incorporation of acquired land and interests in land</header><text>Any land or interest in land within the boundary of the wilderness areas that is acquired by the United States shall—</text> <subparagraph id="idb2e9cdce-32f2-4f7f-a951-b005eefc4f6d"><enum>(A)</enum><text>become part of the wilderness area in which the land is located; and</text> </subparagraph>
<subparagraph id="id7aff5ebc-6cd0-4bcf-857f-2b3b691d975c"><enum>(B)</enum><text>be managed in accordance with—</text> <clause id="id349163dd-d042-47e7-b91a-bb753a3cdf56"><enum>(i)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.);</text> </clause>
<clause id="ide48652af-b2e6-4c46-8a59-79d629512921"><enum>(ii)</enum><text>this section; and</text> </clause> <clause id="id2b7cf092-9874-42d0-bee1-95bd3d3c0e9c"><enum>(iii)</enum><text>any other applicable laws.</text> </clause></subparagraph></paragraph>
<paragraph id="id2b9ba390-7d1a-4d2b-8752-000a2f5ae8bc"><enum>(4)</enum><header>Grazing</header><text>Grazing of livestock in the wilderness areas, where established before the date of enactment of this Act, shall be administered in accordance with—</text> <subparagraph id="id244f5341-5813-4fad-aeb9-c7efc42f8903"><enum>(A)</enum><text>section 4(d)(4) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(4)</external-xref>); and</text> </subparagraph>
<subparagraph id="id905f3d4f-ec5e-41af-bc56-c6837b3c51cb"><enum>(B)</enum><text>the guidelines set forth in appendix A of the Report of the Committee on Interior and Insular Affairs to accompany H.R. 2570 of the 101st Congress (H. Rept. 101–405).</text> </subparagraph></paragraph> <paragraph id="id617e884c-e334-4494-8aef-8aef0faa4d5f"><enum>(5)</enum><header>Buffer zones</header> <subparagraph id="ida7a2b9fa-cd1d-4869-95e7-c4956a69c98b"><enum>(A)</enum><header>In general</header><text>Nothing in this section creates a protective perimeter or buffer zone around the wilderness areas.</text> </subparagraph>
<subparagraph id="id62175c8e-557b-4d85-a293-76850950b058"><enum>(B)</enum><header>Activities outside wilderness areas</header><text>The fact that an activity or use on land outside a wilderness area can be seen or heard within the wilderness area shall not preclude the activity or use outside the boundary of the wilderness area.</text> </subparagraph></paragraph> <paragraph id="id8b518b12-96f9-4b9c-85a9-00f09f47011b"><enum>(6)</enum><header>Release of wilderness study areas</header><text>Congress finds that, for purposes of section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>), the public land within the San Antonio Wilderness Study Area not designated as wilderness by this subsection—</text> 
<subparagraph id="id6ca4d0ec-bb08-4acf-a3a9-3509d7f5a319"><enum>(A)</enum><text>has been adequately studied for wilderness designation;</text> </subparagraph> <subparagraph id="id88fbedf5-2c46-44bd-b374-dd7dbbad82f2"><enum>(B)</enum><text>is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>); and</text> </subparagraph>
<subparagraph id="id55b9b505-5e2d-4a6a-94cc-f961add5e401"><enum>(C)</enum><text>shall be managed in accordance with title I.</text> </subparagraph></paragraph> <paragraph id="id95d60977-cdc2-4e2d-8fa8-61b671396568"><enum>(7)</enum><header>Maps and legal descriptions</header> <subparagraph id="idfcad4d81-6005-400b-b1f2-77a773bb85e2"><enum>(A)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall file the map and legal descriptions of the wilderness areas with—</text> 
<clause id="id4cf6b40d-7c19-43a0-9f06-06d08ed01e5a"><enum>(i)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text> </clause> <clause id="idd0111fd2-a27f-4c95-8601-e3a36fbe2bc7"><enum>(ii)</enum><text>the Committee on Natural Resources of the House of Representatives.</text> </clause></subparagraph>
<subparagraph id="idf1fd46bd-158d-43b0-8856-498b68138db6"><enum>(B)</enum><header>Force of law</header><text>The map and legal descriptions filed under subparagraph (A) shall have the same force and effect as if included in this Act, except that the Secretary may correct errors in the legal description and map.</text> </subparagraph> <subparagraph id="id48fc884f-aab4-42c8-ac70-c3cbabe11d12"><enum>(C)</enum><header>Public availability</header><text>The map and legal descriptions filed under subparagraph (A) shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management.</text> </subparagraph></paragraph>
<paragraph id="id26ba09b3-da89-4ed5-a71b-92ce3719c945"><enum>(8)</enum><header>National landscape conservation system</header><text>The wilderness areas shall be administered as components of the National Landscape Conservation System.</text> </paragraph> <paragraph id="id8ab9b2f4-9ddf-407d-9dd0-f791ec2db42a"><enum>(9)</enum><header>Fish and wildlife</header><text>Nothing in this section affects the jurisdiction of the State of New Mexico with respect to fish and wildlife located on public land in the State.</text> </paragraph>
<paragraph id="id4ca8d3bd-b99c-4a50-b903-176ed13633a9"><enum>(10)</enum><header>Withdrawals</header><text>Subject to valid existing rights, any Federal land within the wilderness areas designated by paragraph (1), including any land or interest in land that is acquired by the United States after the date of enactment of this Act, is withdrawn from—</text> <subparagraph id="id96d3374c-2902-4cee-a546-12db3aba646b"><enum>(A)</enum><text>entry, appropriation, or disposal under the public land laws;</text> </subparagraph>
<subparagraph id="id20f34ef3-0c46-4bda-b41c-7905b36ee6ef"><enum>(B)</enum><text>location, entry, and patent under the mining laws; and</text> </subparagraph> <subparagraph id="id658e3835-35dc-4312-acce-2011abdd1139"><enum>(C)</enum><text>operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idfc9c7aeb-0240-4f22-8675-36acc13b73ea"><enum>(11)</enum><header>Treaty rights</header><text>Nothing in this section enlarges, diminishes, or otherwise modifies any treaty rights.</text> </paragraph></subsection></section></title> <title commented="no" id="id597BAE3CAF364B148F7A38357EA43F08" level-type="subsequent"><enum>IV</enum><header display-inline="yes-display-inline">Designation of wilderness areas in Clark County, Nevada</header> <section commented="no" display-inline="no-display-inline" id="ID62c6edcc06894c73825ebc3724811e42" section-type="subsequent-section"><enum>401.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="IDb19762578bf24e8b8a57f3e1a0024d13"><enum>(1)</enum><text display-inline="yes-display-inline">public land administered by the Bureau of Land Management in the County contains unique and spectacular natural, cultural, and historical resources, including—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDf29615b561704c4c8bfc830a74c7d2bc"><enum>(A)</enum><text display-inline="yes-display-inline">priceless habitat for numerous species of plants and wildlife;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID6c8d994d26b8467786e61404c1eacf3e"><enum>(B)</enum><text display-inline="yes-display-inline">thousands of acres of land that remain in a natural state; and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="ID6a3c21ad3a2e4897816ee5cb5c026240"><enum>(C)</enum><text display-inline="yes-display-inline">numerous sites containing significant cultural and historical artifacts; and</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID207aaa680309484c8888c917b7ab2334"><enum>(2)</enum><text display-inline="yes-display-inline">continued preservation of the public land would benefit the County and all of the United States by—</text> <subparagraph commented="no" display-inline="no-display-inline" id="IDba4de3d439f74c6cb1ce0f994a026adc"><enum>(A)</enum><text display-inline="yes-display-inline">ensuring the conservation of ecologically diverse habitat;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID044c03a290064404ad1e4238170affff"><enum>(B)</enum><text display-inline="yes-display-inline">protecting prehistoric cultural resources;</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="IDa44ab6a4dfef434781a24da204aaf32f"><enum>(C)</enum><text display-inline="yes-display-inline">conserving primitive recreational resources; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID1f78f36fb917494f9f7cb54a5c2bdd91"><enum>(D)</enum><text display-inline="yes-display-inline">protecting air and water quality.</text> </subparagraph></paragraph></section> <section commented="no" display-inline="no-display-inline" id="idD697A57D99E54AC9B97081B2FD2C9797" section-type="subsequent-section"><enum>402.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title:</text>

<subsection commented="no" display-inline="no-display-inline" id="ID472d996294a84954bf17b490702a98e5"><enum>(a)</enum><header display-inline="yes-display-inline">Additions</header><text display-inline="yes-display-inline">In furtherance of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), the following public land administered by the Bureau of Land Management in the County is designated as wilderness and as components of the National Wilderness Preservation System:</text> <paragraph commented="no" display-inline="no-display-inline" id="ID890784940f45487697857e36692dbe3f"><enum>(1)</enum><header display-inline="yes-display-inline">Virgin peak wilderness</header><text display-inline="yes-display-inline">Certain public land managed by the Bureau of Land Management, comprising approximately 18,296 acres, as generally depicted on the Map, which shall be known as the <quote>Virgin Peak Wilderness</quote>.</text> </paragraph>

<paragraph commented="no" display-inline="no-display-inline" id="ID1f41df80395b4bf58a5a19012fbcf7e1"><enum>(6)</enum><header display-inline="yes-display-inline">Million hills wilderness</header><text display-inline="yes-display-inline">Certain public land managed by the Bureau of Land Management, comprising approximately 24,818 acres, as generally depicted on the Map, which shall be known as the <quote>Million Hills Wilderness</quote>.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="IDe9a034fba44a469c82798ab5c3b49cb3"><enum>(7)</enum><header display-inline="yes-display-inline">Lime canyon wilderness additions</header><text display-inline="yes-display-inline">Certain public land managed by the Bureau of Land Management, comprising approximately 10,069 acres, as generally depicted on the Map, which is incorporated in, and shall be managed as part of, the <quote>Lime Canyon Wilderness</quote> designated by section 202(a)(9) of the Clark County Conservation of Public Land and Natural Resources Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/107/282">Public Law 107–282</external-xref>).</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="IDfcc0a57828c8420fa3314398f5cb1668"><enum>(b)</enum><header display-inline="yes-display-inline">National landscape conservation system</header><text display-inline="yes-display-inline">The wilderness areas shall be administered as components of the National Landscape Conservation System.</text> </subsection> <subsection commented="no" display-inline="no-display-inline" id="IDab563855daf74aab98ffa27b5b74717e"><enum>(c)</enum><header display-inline="yes-display-inline">Road offset</header><text display-inline="yes-display-inline">The boundary of any portion of a wilderness area that is bordered by a road shall be at least 100 feet away from the centerline of the road so as not to interfere with public access.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID5c70c47bba6e4ad098a4dccd11144b97"><enum>(d)</enum><header display-inline="yes-display-inline">Map and legal description</header> 
<paragraph commented="no" display-inline="no-display-inline" id="ID8ea0a610e66a432cb18fa5fd5393803c"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary shall file a map and legal description of each wilderness area with the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="IDe6ceedf437ad419cb4c1256ee15c2064"><enum>(2)</enum><header display-inline="yes-display-inline">Effect</header><text display-inline="yes-display-inline">Each map and legal description under paragraph (1) shall have the same force and effect as if included in this title, except that the Secretary may correct clerical and typographical errors in the map or legal description.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID94c650cb96d94ae2a1ccd2f7541ca757"><enum>(3)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">Each map and legal description under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the Bureau of Land Management.</text> </paragraph></subsection></section> <section commented="no" display-inline="no-display-inline" id="ID0b864fff692a4379b328ff9521114a9e" section-type="subsequent-section"><enum>404.</enum><header display-inline="yes-display-inline">Administration</header> <subsection commented="no" display-inline="no-display-inline" id="ID7c0cc0bbd36b43be934830ea9a4d062e"><enum>(a)</enum><header display-inline="yes-display-inline">Management</header><text display-inline="yes-display-inline">Subject to valid existing rights, the wilderness areas shall be administered by the Secretary in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), except that—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="ID51866b1b1db343f3b3e80e2e16418c6b"><enum>(1)</enum><text display-inline="yes-display-inline">any reference in that Act to the effective date of that Act shall be considered to be a reference to the date of enactment of this Act; and</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="ID74587c0ff45144d0bb1d91f54d85f858"><enum>(2)</enum><text display-inline="yes-display-inline">any reference in that Act to the Secretary of Agriculture shall be considered to be a reference to the Secretary.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID6bed6c843bef4a6da511d286a3890b02"><enum>(b)</enum><header display-inline="yes-display-inline">Incorporation of acquired land and interests</header><text display-inline="yes-display-inline">Any land or interest in land within the boundaries of a wilderness area that is acquired by the United States after the date of enactment of this Act shall be added to, and administered as part of, the wilderness area within which the acquired land or interest is located.</text> </subsection> <subsection commented="no" display-inline="no-display-inline" id="IDe5bb65964f414f53980c56643eaac2ed"><enum>(c)</enum><header display-inline="yes-display-inline">Water rights</header> <paragraph commented="no" display-inline="no-display-inline" id="ID864acb90828a48c69bd26c418fad7441"><enum>(1)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds that—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="ID03a8b0aab656445b89f86714b50d1da8"><enum>(A)</enum><text display-inline="yes-display-inline">the land designated as a wilderness area—</text> <clause commented="no" display-inline="no-display-inline" id="idB12A53A0074248629BE447CEF875D590"><enum>(i)</enum><text display-inline="yes-display-inline">is within the Mojave Desert;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="id357EBE5CBE6D46B3AE854A8FA5DBCAD3"><enum>(ii)</enum><text display-inline="yes-display-inline">is arid in nature; and</text> </clause> <clause commented="no" display-inline="no-display-inline" id="id338DD70B7AB84DBF9182AA30BCA1F226"><enum>(iii)</enum><text display-inline="yes-display-inline">includes ephemeral streams;</text> </clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="IDfabd06ddf3c6403eaec57b19c6181da1"><enum>(B)</enum><text display-inline="yes-display-inline">the hydrology of the land designated as a wilderness area is locally characterized by complex flow patterns and alluvial fans with impermanent channels;</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="ID29462df017fb49439bd7acada49b3797"><enum>(C)</enum><text display-inline="yes-display-inline">the subsurface hydrogeology of the region within which the land designated as a wilderness area is located is characterized by ground water subject to local and regional flow gradients and artesian aquifers;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID1c54086e24c0472ea7d8ee7856b615f6"><enum>(D)</enum><text display-inline="yes-display-inline">the land designated as a wilderness area is generally not suitable for use or development of new water resource facilities;</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idB9B36C45901F463CBB849C6E2A448677"><enum>(E)</enum><text display-inline="yes-display-inline">there are no actual or proposed water resource facilities and no opportunities for diversion, storage, or other uses of water occurring outside the land designated as a wilderness area that would adversely affect the wilderness or other values of the land; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID6636620501b84a7d8b582b2dbb873ee7"><enum>(F)</enum><text display-inline="yes-display-inline">because of the unique nature and hydrology of the desert land designated as a wilderness area and the existence of the Clark County Multi-Species Habitat Conservation Plan, it is possible to provide for proper management and protection of the wilderness, perennial springs, and other values of the land in ways different than the methods used in other laws.</text> </subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="IDbe0de0a0b08441c08f25c51b7e0f89aa"><enum>(2)</enum><header display-inline="yes-display-inline">Statutory construction</header> <subparagraph commented="no" display-inline="no-display-inline" id="ID22deef139ce94276862a5dab709e62fb"><enum>(A)</enum><header display-inline="yes-display-inline">No reservation</header><text display-inline="yes-display-inline">Nothing in this title constitutes an express or implied reservation by the United States of any water or water rights with respect to the land designated as a wilderness area.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID1670a8ddea2a439b8804bcf16dac939c"><enum>(B)</enum><header display-inline="yes-display-inline">State rights</header><text display-inline="yes-display-inline">Nothing in this title affects any water rights in the State existing on the date of enactment of this Act, including any water rights held by the United States.</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="IDdcbf70d7966043ccad9269f1dec20b15"><enum>(C)</enum><header display-inline="yes-display-inline">No precedent</header><text display-inline="yes-display-inline">Nothing in this subsection establishes a precedent with regard to any future wilderness designations.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID59b25d34911647638a33626183833622"><enum>(D)</enum><header display-inline="yes-display-inline">No effect on compacts</header><text display-inline="yes-display-inline">Nothing in this title limits, alters, modifies, or amends any of the interstate compacts or equitable apportionment decrees that apportion water among and between the State and other States.</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="ID79aa13156d0342e697eafb6be7880e6c"><enum>(E)</enum><header display-inline="yes-display-inline">Clark county multi-species habitat conservation plan</header><text display-inline="yes-display-inline">Nothing in this title limits, alters, modifies, or amends the Clark County Multi-Species Habitat Conservation Plan with respect to the land designated as a wilderness area, including specific management actions for the conservation of perennial springs.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID2cc891b39d2a4323afc8552a9e99fc50"><enum>(3)</enum><header display-inline="yes-display-inline">Nevada water law</header><text display-inline="yes-display-inline">The Secretary shall follow the procedural and substantive requirements of State law in order to obtain and hold any water rights not in existence on the date of enactment of this Act with respect to the land designated as a wilderness area.</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="IDe4268482149c45cc958f0c5cffa66f3b"><enum>(4)</enum><header display-inline="yes-display-inline">New projects</header> <subparagraph commented="no" display-inline="no-display-inline" id="ID76280c932e0142b7b7e9abe251d12ff5"><enum>(A)</enum><header display-inline="yes-display-inline">Definition</header> <clause commented="no" display-inline="no-display-inline" id="idBE23082D2B994391832283BDFEA3E81F"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In this paragraph, the term <term>water resource facility</term> means irrigation and pumping facilities, reservoirs, water conservation works, aqueducts, canals, ditches, pipelines, wells, hydropower projects, and transmission and other ancillary facilities, and other water diversion, storage, and carriage structures.</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="id7A55DC6B5E544872A4D9B46673C8640D"><enum>(ii)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">In this paragraph, the term <quote>water resource facility</quote> does not include wildlife guzzlers.</text> </clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="IDc576057b52fa42f9968bbf250bc9f660"><enum>(B)</enum><header display-inline="yes-display-inline">No licenses or permits</header><text display-inline="yes-display-inline">Except as otherwise provided in this title, on and after the date of enactment of this Act, neither the President nor any other officer, employee, or agent of the United States shall fund, assist, authorize, or issue a license or permit for the development of any new water resource facility within the land designated as a wilderness area.</text> </subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="IDc415e0d698c04c7e867b988f2fbcf2cc"><enum>(d)</enum><header display-inline="yes-display-inline">Withdrawal</header><text display-inline="yes-display-inline">Subject to valid existing rights, any Federal land within the wilderness areas, including any land or interest in land that is acquired by the United States within the Gold Butte National Monument after the date of enactment of this Act, is withdrawn from—</text> <paragraph commented="no" display-inline="no-display-inline" id="ID4147c1cfc0a34806868ff2a8ba2bd060"><enum>(1)</enum><text display-inline="yes-display-inline">entry, appropriation, or disposal under the public land laws;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID7be6deb9252a4929b029b864f3d32646"><enum>(2)</enum><text display-inline="yes-display-inline">location, entry, and patent under the mining laws; and</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="ID0c60ad837bf24eec80877654cf0ad193"><enum>(3)</enum><text display-inline="yes-display-inline">operation of the mineral leasing, mineral materials, and geothermal leasing laws.</text> </paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="ID380d0dbb83ef4d8c9d35cb034ae926a2" section-type="subsequent-section"><enum>405.</enum><header display-inline="yes-display-inline">Adjacent management</header> 
<subsection commented="no" display-inline="no-display-inline" id="ID47292e6ec2b64781bfb20e2f80332a6e"><enum>(a)</enum><header display-inline="yes-display-inline">No buffer zones</header><text display-inline="yes-display-inline">Congress does not intend for the designation of land as wilderness areas to lead to the creation of protective perimeters or buffer zones around the wilderness areas.</text> </subsection> <subsection commented="no" display-inline="no-display-inline" id="IDc6804cd02eaf4e29ba41b802da945a29"><enum>(b)</enum><header display-inline="yes-display-inline">Nonwilderness activities</header><text display-inline="yes-display-inline">The fact that nonwilderness activities or uses can be seen or heard from areas within a wilderness area shall not preclude the conduct of those activities or uses outside the boundary of the wilderness area.</text> </subsection></section>
<section commented="no" display-inline="no-display-inline" id="ID4a724107a76f46f49c739259d9685886" section-type="subsequent-section"><enum>406.</enum><header display-inline="yes-display-inline">Military, law enforcement, and emergency overflights</header><text display-inline="no-display-inline">Nothing in this title restricts or precludes—</text> <paragraph commented="no" display-inline="no-display-inline" id="ID76e666ebadb44e8392bd300c901a3b0d"><enum>(1)</enum><text display-inline="yes-display-inline">low-level overflights of military, law enforcement, or emergency medical services aircraft over the area designated as wilderness by this title, including military, law enforcement, or emergency medical services overflights that can be seen or heard within the wilderness area;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="IDc8985ec88bac4a7c8c3da1ddd51b6379"><enum>(2)</enum><text display-inline="yes-display-inline">flight testing and evaluation; or</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="IDff45c00e5a5949e4b854aa07f8551922"><enum>(3)</enum><text display-inline="yes-display-inline">the designation or creation of new units of special use airspace, or the establishment of military, law enforcement, or emergency medical services flight training routes, over the wilderness area.</text> </paragraph></section>
<section commented="no" display-inline="no-display-inline" id="ID2c734116befa4759a187f5e547d81f5a" section-type="subsequent-section"><enum>407.</enum><header display-inline="yes-display-inline">Release of wilderness study areas</header> 
<subsection commented="no" display-inline="no-display-inline" id="ID2546dcbcd13f43f09ae521b793c29198"><enum>(a)</enum><header display-inline="yes-display-inline">Finding</header><text display-inline="yes-display-inline">Congress finds that, for the purposes of section 603 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782</external-xref>), the Bureau of Land Management land in any portion of the wilderness study areas located within the Gold Butte National Monument not designated as a wilderness area has been adequately studied for wilderness designation.</text> </subsection> <subsection commented="no" display-inline="no-display-inline" id="ID168c6730a4d2474db5bd6d6a83bfd163"><enum>(b)</enum><header display-inline="yes-display-inline">Release</header><text display-inline="yes-display-inline">Any Bureau of Land Management land described in subsection (a) that is not designated as a wilderness area—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="IDa646596d4fc943f58ec881375c232fb9"><enum>(1)</enum><text display-inline="yes-display-inline">is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>);</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="IDcafa043a580c4307ae2856d73b60422a"><enum>(2)</enum><text display-inline="yes-display-inline">shall be managed in accordance with—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="ID5d0e9601c84e4d83a5695b7910d41cb7"><enum>(A)</enum><text display-inline="yes-display-inline">the land management plans adopted under section 202 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>); and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="ID9db434c76d8e4014929f2aef22a38ad4"><enum>(B)</enum><text display-inline="yes-display-inline">cooperative conservation agreements in existence on the date of enactment of this Act; and</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID5721dfbc08e647f38907aaf81179cde3"><enum>(3)</enum><text display-inline="yes-display-inline">shall be subject to—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id55A3517D8ABD4587ACAFB0491424FF3B"><enum>(A)</enum><text display-inline="yes-display-inline">the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.); and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idC6F06E4840A54016975714DEE9666162"><enum>(B)</enum><text>title I.</text> </subparagraph></paragraph></subsection></section> <section commented="no" display-inline="no-display-inline" id="IDc326591af92b41ffb27e288bad249891" section-type="subsequent-section"><enum>408.</enum><header display-inline="yes-display-inline">Native American cultural and religious uses</header><text display-inline="no-display-inline">Nothing in this title diminishes—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="id2A88C5A22DD34127AF854C73DFA78D0B"><enum>(1)</enum><text display-inline="yes-display-inline">the rights of any Indian Tribe; or</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idC92AA863A5E54F8DBE6FD79447AF417C"><enum>(2)</enum><text display-inline="yes-display-inline">Tribal rights regarding access to Federal land for Tribal activities, including spiritual, cultural, and traditional food-gathering activities.</text> </paragraph></section>
<section commented="no" display-inline="no-display-inline" id="ID13ea338ac15e4358a8185f25619d6992" section-type="subsequent-section"><enum>409.</enum><header display-inline="yes-display-inline">Wildlife management</header> 
<subsection commented="no" display-inline="no-display-inline" id="IDe4889edb0b1544e5a004f74c3b22f8c2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with section 4(d)(7) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(7)</external-xref>), nothing in this title affects or diminishes the jurisdiction of the State with respect to fish and wildlife management, including the regulation of hunting, fishing, and trapping, in the wilderness areas.</text> </subsection> <subsection commented="no" display-inline="no-display-inline" id="ID05064781c55c40989ea059305d6e30d4"><enum>(b)</enum><header display-inline="yes-display-inline">Management activities</header> <paragraph commented="no" display-inline="no-display-inline" id="id201CB2BF9164417AB19CC95923EC9750"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In furtherance of the purposes and principles of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.), management activities to maintain or restore fish and wildlife populations and the habitats to support the populations may be carried out within the wilderness areas, if the activities—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="id278E3AD9F8624CC099256D645FFD857D"><enum>(A)</enum><text display-inline="yes-display-inline">are consistent with relevant wilderness management plans; and</text> </subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id6269EC1874B1471A8F2051F075D7ECED"><enum>(B)</enum><text display-inline="yes-display-inline">are carried out in accordance with appropriate policies, such as those set forth in Appendix B of House Report 101–405.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id5FB10589E1E4460190A2C76D6FE77D0B"><enum>(2)</enum><header display-inline="yes-display-inline">Use of motorized vehicles</header><text display-inline="yes-display-inline">The management activities under paragraph (1) may include the occasional and temporary use of motorized vehicles, if the use, as determined by the Secretary, would—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id6EC95BD52830468785B9F6287D86A83D"><enum>(A)</enum><text display-inline="yes-display-inline">promote healthy, viable, and more naturally distributed wildlife populations that would enhance wilderness values; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idA4C2975937F74ECE88B68CC1340EF69A"><enum>(B)</enum><text display-inline="yes-display-inline">accomplish the purposes described in subparagraph (A) with the minimum impact necessary to reasonably accomplish the task.</text> </subparagraph></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="IDdf6758372e1b4433bb8b6e9cc9847a97"><enum>(c)</enum><header display-inline="yes-display-inline">Existing activities</header><text display-inline="yes-display-inline">Consistent with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>) and in accordance with appropriate policies such as those set forth in Appendix B of House Report 101–405, the State may continue to use aircraft (including helicopters) to survey, capture, transplant, monitor, and provide water for wildlife populations, including bighorn sheep, and feral stock, horses, and burros.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID082f654c15b64a5f8cfba10a532b3e25"><enum>(d)</enum><header display-inline="yes-display-inline">Wildlife water development projects</header><text display-inline="yes-display-inline">Subject to subsection (f), the Secretary shall authorize structures and facilities, including existing structures and facilities, for wildlife water development projects, including guzzlers, in the wilderness areas if—</text> <paragraph commented="no" display-inline="no-display-inline" id="IDe715a698bc604841be00e49865254235"><enum>(1)</enum><text display-inline="yes-display-inline">the structures and facilities will, as determined by the Secretary, enhance wilderness values by promoting healthy, viable and more naturally distributed wildlife populations; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID6daf7f5aabc14879a9b3b20dec97e5c0"><enum>(2)</enum><text display-inline="yes-display-inline">the visual impacts of the structures and facilities on the wilderness areas can reasonably be minimized.</text> </paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="IDf547011770de4f36945361407bcc33a7"><enum>(e)</enum><header display-inline="yes-display-inline">Hunting, fishing, and trapping</header> <paragraph commented="no" display-inline="no-display-inline" id="ID2097e05173834723bec2873d8e94015e"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may designate, by regulation, areas in which, and establish periods during which, for reasons of public safety, administration, or compliance with applicable laws, no hunting, fishing, or trapping will be permitted in the wilderness areas.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="IDe986e99929464e5f85de78dffe07ebed"><enum>(2)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">Except in emergencies, the Secretary shall consult with the appropriate State agency before promulgating regulations under paragraph (1).</text> </paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="ID1f18ae2dd22649528a1df5652b713a2c"><enum>(f)</enum><header display-inline="yes-display-inline">Cooperative agreement</header><text display-inline="yes-display-inline">The State, including a designee of the State, may conduct wildlife management activities in the wilderness areas—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="IDa0c2c205265a4ba094a041580efb3281"><enum>(1)</enum><text display-inline="yes-display-inline">in accordance with the terms and conditions specified in the cooperative agreement between the Secretary and the State entitled <quote>Memorandum of Understanding between the Bureau of Land Management and the Nevada Department of Wildlife Supplement No. 9</quote> and signed November and December 2003, including any amendments to the cooperative agreement agreed to by the Secretary and the State; and</text> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="ID642b5818ba6f4592a4fa4fc36e95de09"><enum>(2)</enum><text display-inline="yes-display-inline">subject to all applicable laws (including regulations).</text> </paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="IDfc46cfed067b48c5ae5605d1d9e9d66c" section-type="subsequent-section"><enum>410.</enum><header display-inline="yes-display-inline">Wildfire, insect, and disease management</header> 
<subsection commented="no" display-inline="no-display-inline" id="id7A0D8CF29EE944D6AF27CC0863C55005"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>), the Secretary may take such measures in each wilderness area as the Secretary determines to be necessary for the control of fire, insects, and diseases (including, as the Secretary determines to be appropriate, the coordination of the activities with a State or local agency).</text> </subsection> <subsection commented="no" display-inline="no-display-inline" id="ID79c24d10ac2f45eb84799c81840a3a7d"><enum>(b)</enum><header display-inline="yes-display-inline">Effect</header><text display-inline="yes-display-inline">Nothing in this title precludes a Federal, State, or local agency from conducting wildfire management operations (including operations using aircraft or mechanized equipment) in accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>).</text> </subsection></section>
<section commented="no" display-inline="no-display-inline" id="ID7557976a491549249820515c11049866" section-type="subsequent-section"><enum>411.</enum><header display-inline="yes-display-inline">Climatological data collection</header><text display-inline="no-display-inline">Subject to such terms and conditions as the Secretary may require, nothing in this title precludes the installation and maintenance of hydrologic, meteorologic, or climatological collection devices in the wilderness areas if the facilities and access to the facilities are essential to flood warning, flood control, and water reservoir operation activities.</text></section></title> </legis-body> </bill>
