			 Dry-Redwater Regional Water Authority System in the States of Montana and
			 North Dakota, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="id3a67ec1e9994424392f47764d804ab1d" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Water for Rural Communities Act</short-title></quote>.</text> </section><section id="idcd924522f6b24e80afa2ee249ccc2856"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to ensure a safe and adequate municipal, rural, and industrial water supply for the citizens of—</text>
 <paragraph id="id026e7e2cd5634205901b8b2923e5e3f6"><enum>(1)</enum><text>Dawson, Garfield, McCone, Prairie, Richland, Judith Basin, Wheatland, Golden Valley, Fergus, Yellowstone, and Musselshell Counties in the State of Montana; and</text>
 </paragraph><paragraph id="id9388d37f11104c12aaa091920c868002"><enum>(2)</enum><text>McKenzie County, North Dakota.</text> </paragraph></section><section id="id738235eeef714aaba869c85a1a10f3b5"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="iddf17484800594b68aad0ea3a769d28c3"><enum>(1)</enum><header>Authority</header><text>The term <term>Authority</term> means—</text> <subparagraph id="id87e3a454bdad4b9dba643e3cc96e89e9"><enum>(A)</enum><text>the Central Montana Regional Water Authority, a publicly owned nonprofit water authority formed in accordance with Mont. Code Ann. Sec. 75–6–302 (2007); and</text>
 </subparagraph><subparagraph id="id76c5ef2be7c141b8b1b884648d986c48"><enum>(B)</enum><text>any nonprofit successor entity to the Authority described in subparagraph (A).</text> </subparagraph></paragraph><paragraph id="id8c003e170a334da29357971b3e0b4492"><enum>(2)</enum><header>Musselshell-Judith Rural Water System</header><text>The term <term>Musselshell-Judith Rural Water System</term> means the Musselshell-Judith Rural Water System authorized under section 4(a), with a project service area that includes—</text>
 <subparagraph id="ide31b5923a6ce4d75a683187b1f336865"><enum>(A)</enum><text>Judith Basin, Wheatland, Golden Valley, and Musselshell Counties in the State;</text> </subparagraph><subparagraph id="id947033f07c894b40a752f56b609c8d42"><enum>(B)</enum><text>the portion of Yellowstone County in the State within 2 miles of State Highway 3 and within 4 miles of the county line between Golden Valley and Yellowstone Counties in the State, inclusive of the Town of Broadview, Montana; and</text>
 </subparagraph><subparagraph id="id105c692eca484b76a24f4d0a055bde95"><enum>(C)</enum><text>the portion of Fergus County in the State within 2 miles of U.S. Highway 87 and within 4 miles of the county line between Fergus and Judith Basin Counties in the State, inclusive of the Town of Moore, Montana.</text>
 </subparagraph></paragraph><paragraph id="id9985e074941c46648b572c01ab012e93"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph><paragraph id="id70b7cc0da6704a7f9ed562902f736e81"><enum>(4)</enum><header>State</header><text>The term <term>State</term> means the State of Montana.</text>
			</paragraph></section><section id="idde787286c3664cbe9d34c68d6a3b69d3"><enum>4.</enum><header>Musselshell-Judith Rural Water System</header>
 <subsection id="idb53b40c1b7014c139837e25addbb645e"><enum>(a)</enum><header>Authorization</header><text>The Secretary may carry out the planning, design, and construction of the Musselshell-Judith Rural Water System in a manner that is substantially in accordance with the feasibility report entitled <quote>Musselshell-Judith Rural Water System Feasibility Report</quote> (including any and all revisions of the report).</text>
 </subsection><subsection id="iddf9b41cf1b6b45f995089a92d9f5eb5a"><enum>(b)</enum><header>Cooperative agreement</header><text>The Secretary shall enter into a cooperative agreement with the Authority to provide Federal assistance for the planning, design, and construction of the Musselshell-Judith Rural Water System.</text>
			</subsection><subsection id="id120a0e3b2aef4fa7a523276823c4a4c8"><enum>(c)</enum><header>Cost-Sharing requirement</header>
				<paragraph id="ida7d5d96830714944917fcfce60de292d"><enum>(1)</enum><header>Federal share</header>
 <subparagraph id="id04a319f8a92741619344fb1ada3aefb8"><enum>(A)</enum><header>In general</header><text>The Federal share of the costs relating to the planning, design, and construction of the Musselshell-Judith Rural Water System shall not exceed 65 percent of the total cost of the Musselshell-Judith Rural Water System.</text>
 </subparagraph><subparagraph id="id0711a174bdf54789aca3a1ac0a03f631"><enum>(B)</enum><header>Limitation</header><text>Amounts made available under subparagraph (A) shall not be returnable or reimbursable under the reclamation laws.</text>
					</subparagraph></paragraph><paragraph id="id6ba3c8177a6548eda3fa73c80cf72385"><enum>(2)</enum><header>Use of Federal funds</header>
 <subparagraph id="id7c381312e59d4b4d858cce43eb633ab0"><enum>(A)</enum><header>General uses</header><text>Subject to subparagraph (B), the Musselshell-Judith Rural Water System may use Federal funds made available to carry out this section for—</text>
 <clause id="id1ced08fd5fd64e449bc1737b0d13863e"><enum>(i)</enum><text>facilities relating to—</text> <subclause id="id657bb3296ee8498cac19752775f2cd55"><enum>(I)</enum><text>water pumping;</text>
 </subclause><subclause id="ida8a1b3a377c945a1b112e1f854c3fc4a"><enum>(II)</enum><text>water treatment;</text> </subclause><subclause id="id471aca3c149b40bca765270b2d9c568e"><enum>(III)</enum><text>water storage;</text>
 </subclause><subclause commented="no" id="idaa40c385aebb4705ad178500425507a0"><enum>(IV)</enum><text>water supply wells;</text> </subclause><subclause commented="no" id="idc2651a43861c4331b05e908b7b01bec0"><enum>(V)</enum><text>distribution pipelines; and</text>
 </subclause><subclause commented="no" id="id0618bac2680e4603906663611d50651b"><enum>(VI)</enum><text>control systems;</text> </subclause></clause><clause id="id6720bb6dc641411eb14706c99a5ceaac"><enum>(ii)</enum><text>transmission pipelines;</text>
 </clause><clause id="idb07238e0e7d74caa8002926cba3a4305"><enum>(iii)</enum><text>pumping stations;</text> </clause><clause id="idfb8163bc95d140f0992eeeb41fdd1afc"><enum>(iv)</enum><text>appurtenant buildings, maintenance equipment, and access roads;</text>
 </clause><clause id="id2dcdd954d71b48b8a7049a94876e2962"><enum>(v)</enum><text>any interconnection facility that connects a pipeline of the Musselshell-Judith Rural Water System to a pipeline of a public water system;</text>
 </clause><clause id="idc2335cfd6abe403c893b22104a267784"><enum>(vi)</enum><text>electrical power transmission and distribution facilities required for the operation and maintenance of the Musselshell-Judith Rural Water System;</text>
 </clause><clause id="id5f6e54e6ee874dd68c5a54470adadb4d"><enum>(vii)</enum><text>any other facility or service required for the development of a rural water distribution system, as determined by the Secretary; and</text>
 </clause><clause id="id8f50003a367f4857bae9394e0e95433d"><enum>(viii)</enum><text>any property or property right required for the construction or operation of a facility described in this subsection.</text>
 </clause></subparagraph><subparagraph id="id58c37b05698442e283b3bb4c9a0d4636"><enum>(B)</enum><header>Limitation</header><text>Federal funds made available to carry out this section shall not be used for the operation, maintenance, or replacement of the Musselshell-Judith Rural Water System.</text>
 </subparagraph><subparagraph id="id4b0711e98acf4e4abf4ff989976f65ee"><enum>(C)</enum><header>Title</header><text>Title to the Musselshell-Judith Rural Water System shall be held by the Authority.</text> </subparagraph></paragraph></subsection></section><section id="idE3C4ED6B17B6435D83B98BC59489A268"><enum>5.</enum><header>Dry-Redwater feasibility study</header> <subsection id="id644f42c7c8bc40cbb0f89fdf1d59856f"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph id="idA10B9FF108094599919340CAA4BB2F32"><enum>(1)</enum><header>Dry-Redwater Regional Water Authority</header><text>The term <term>Dry-Redwater Regional Water Authority</term> means—</text> <subparagraph id="idc17f138a-2570-4267-a13e-467b8da1a210"><enum>(A)</enum><text display-inline="yes-display-inline">the Dry-Redwater Regional Water Authority, a publicly owned nonprofit water authority formed in accordance with Mont. Code Ann. § 75–6–302 (2007); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5e30efae-47b8-4ddd-9572-6cf2cffe8a8f"><enum>(B)</enum><text display-inline="yes-display-inline">any nonprofit successor entity to the Authority described in subparagraph (A).</text> </subparagraph></paragraph><paragraph commented="no" id="id6ad6a90c-5a5c-44c5-9725-09352a934e9b"><enum>(2)</enum><header>Dry-Redwater Regional Water Authority System</header><text>The term <term>Dry-Redwater Regional Water Authority System</term> means the project entitled the <quote>Dry-Redwater Regional Water Authority System</quote>, with a project service area that includes—</text>
 <subparagraph commented="no" id="id73fa9858-0bd1-4250-9c5c-b61e41eafcc0"><enum>(A)</enum><text>Garfield and McCone Counties in the State;</text>
 </subparagraph><subparagraph commented="no" id="ida8bea06f-9bb0-4c7e-82ef-2661e56f7348"><enum>(B)</enum><text>the area west of the Yellowstone River in Dawson and Richland Counties in the State;</text>
 </subparagraph><subparagraph commented="no" id="idae1b9d57-dd74-43d1-9e75-094f3a00caca"><enum>(C)</enum><text>T. 15 N. (including the area north of the Township) in Prairie County in the State; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8a210605-e9a2-43b0-950c-e80726a20ce0"><enum>(D)</enum><text>the portion of McKenzie County, North Dakota, that includes all land that is located west of the Yellowstone River in the State of North Dakota.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA3943C633C9E4C5F80EC568FF2954CA4"><enum>(3)</enum><header>Reclamation feasibility standards</header><text display-inline="yes-display-inline">The term <term>reclamation feasibility standards</term> means the eligibility criteria and feasibility study requirements described in section 106 of the Reclamation Rural Water Supply Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/2405">43 U.S.C. 2405</external-xref>) (as in effect on September 29, 2016).</text>
 </paragraph><paragraph id="id0cc5b722533247faa2e934a61c98b970"><enum>(4)</enum><header>Submitted feasibility study</header><text>The term <term>submitted feasibility study</term> means the feasibility study entitled <quote>Dry-Redwater Regional Water System Feasibility Study</quote> (including revisions of the study), which received funding from the Bureau of Reclamation on September 1, 2010.</text>
				</paragraph></subsection><subsection id="id324b7b353e0146f4a3ecea3eeeefe5ca"><enum>(b)</enum><header>Study</header>
 <paragraph id="idB2BB559DBFE34A5CB5BB2933FD7E25A5"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Dry-Redwater Regional Water Authority, may undertake a study, including a review of the submitted feasibility study, to determine the feasibility of constructing the Dry-Redwater Regional Water System.</text>
 </paragraph><paragraph id="id7CF8AA74CC3B4BDDB6DAA2BCF5D603D2"><enum>(2)</enum><header>Requirement</header><text>The study under paragraph (1) shall comply with the reclamation feasibility standards.</text>
 </paragraph></subsection><subsection id="id4756c27126c449ce989e4b0f5c424839"><enum>(c)</enum><header>Cooperative agreement</header><text>If the Secretary determines that the study under subsection (b) does not comply with the reclamation feasibility standards, the Secretary may enter into a cooperative agreement with the Dry-Redwater Regional Water Authority to complete additional work to ensure that the study complies with the reclamation feasibility standards.</text>
 </subsection><subsection id="id4576a1473d674a29b3acbeada92a9a54"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary $5,000,000 to carry out this section.</text> </subsection><subsection id="id584a45c206884442b3929c30c7b1101c"><enum>(e)</enum><header>Termination</header><text>The authority provided by this section shall expire on the date that is 5 years after the date of enactment of this Act.</text>
 </subsection></section><section id="ida1246a81b407486cb2e8be932d7c2120"><enum>6.</enum><header>Water rights</header><text display-inline="no-display-inline">Nothing in this Act—</text> <paragraph id="idb78b21dd0a7e49419ec9800b4ec77793"><enum>(1)</enum><text>preempts or affects any State water law; or</text>
 </paragraph><paragraph id="idd565521a15624a73a9483b9498e79812"><enum>(2)</enum><text>affects any authority of a State, as in effect on the date of enactment of this Act, to manage water resources within that State.</text>
			</paragraph></section><section id="id77a8e6af62984f44b4be450003956af9"><enum>7.</enum><header>Authorization of appropriations</header>
 <subsection id="id433bafb53f4b4095919c9d6f20a51fd9"><enum>(a)</enum><header>Authorization</header><text>There is authorized to be appropriated to carry out the planning, design, and construction of the Musselshell-Judith Rural Water System, substantially in accordance with the cost estimate set forth in the feasibility report described in section 4(a), $56,650,000.</text>
 </subsection><subsection id="id705d2c6c15ee460ab52ba8053c1f7f3d"><enum>(b)</enum><header>Cost Indexing</header><text>The amount authorized to be appropriated under subsection (a) may be increased or decreased in accordance with ordinary fluctuations in development costs incurred after November 1, 2014, as indicated by any available engineering cost indices applicable to construction activities that are similar to the construction of the Musselshell-Judith Rural Water System.</text></subsection></section></legis-body></bill>
