			 relating to political campaigns if such statements are made in the
			 ordinary course of carrying out its tax exempt purpose.</official-title></form>

 <section id="H461DE104FDAE4A3E981C85607BCE2ED1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>The Free Speech Fairness Act</short-title></quote>.</text> </section><section id="H493020B50F62454A8518AA53E57FAA70"><enum>2.</enum><header>Allowing <enum-in-header>501(c)(3)</enum-in-header> organization to make statements relating to political campaign in ordinary course of carrying out its tax exempt purpose</header> <subsection id="HDDD8108D8D3F4C78AD13B5917ED00893"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/501">Section 501</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H7438F8AF87B9450AAD8AA40090A72A1F" style="OLC">
					<subsection id="HA38D25660CA444F1B579EC68C1D5508E"><enum>(s)</enum><header>Special rule relating to political campaign statements of organization described in subsection <enum-in-header>(c)(3)</enum-in-header></header>
 <paragraph id="H96FE7CF4BA4942E898B472AD8197E603"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of subsection (c)(3) and sections 170(c)(2), 2055, 2106, 2522, and 4955, an organization shall not fail to be treated as organized and operated exclusively for a purpose described in subsection (c)(3), nor shall it be deemed to have participated in, or intervened in any political campaign on behalf of (or in opposition to) any candidate for public office, solely because of the content of any statement which—</text>
 <subparagraph id="HDC5DB33B71734FD08C06B5AB4F6A4E05"><enum>(A)</enum><text>is made in the ordinary course of the organization’s regular and customary activities in carrying out its exempt purpose, and</text>
 </subparagraph><subparagraph id="HB976DA2FCF3A49CBA946ACB94E0BDFAB"><enum>(B)</enum><text>results in the organization incurring not more than de minimis incremental expenses.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H8400F5EEDA87432CAF343A06CA9EDD8B"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years ending after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
