			 Area in Dickey County, North Dakota, to the Dickey-Sargent Irrigation
			 District, and for other purposes.</official-title></form>

 <section id="id9A8ABA2D12064C079112E0568C72E5B1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Garrison Diversion Unit Project Oakes Test Area Conveyance Act of 2019</short-title></quote>.</text> </section><section id="idE646227D58254A78843531E5E8694E7B"><enum>2.</enum><header>Conveyance of the Oakes Test Area of the Garrison Diversion Unit Project, North Dakota</header> <subsection id="id570df7e6a9684c2ca96d1e4905bb3157"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph id="id3fab73de352345dfa00eb464d0be8744"><enum>(1)</enum><header>Agreement</header><text>The term <term>Agreement</term> means a title transfer agreement between the United States and the District—</text> <subparagraph id="id26B2EC653FBF41B29F0B2EE51DF8AF83"><enum>(A)</enum><text>to determine the legal, operational, institutional, and financial terms related to the conveyance of the Oakes Test Area as required under subsection (b); and</text>
 </subparagraph><subparagraph id="idEB5B8A3BF5D04FB4A9C0E00E92226152"><enum>(B)</enum><text>to be entered into pursuant to the memorandum of agreement entitled <quote>Memorandum of Agreement Between United States of America Department of the Interior Bureau of Reclamation and Dickey-Sargent Irrigation District for the Purpose of Defining Roles and Responsibilities for Actions Required to Prepare for Title Transfer of Certain Facilities, Land, and Appurtenances at the Garrison Diversion Unit Project Oakes Test Area</quote>, dated December 18, 2018, and numbered 19AG620033.</text>
 </subparagraph></paragraph><paragraph id="id54D1B13B7D5F4871907DB0EB52AD6D25"><enum>(2)</enum><header>District</header><text>The term <term>District</term> means the Dickey-Sargent Irrigation District.</text> </paragraph><paragraph id="id6d0ee0b6eddd49a7a9b42d27df18a3cd"><enum>(3)</enum><header>Oakes Test Area</header><text>The term <term>Oakes Test Area</term> means the facilities, land, and appurtenances of the approximately 5,000-acre prototype irrigation test area authorized as part of the Garrison Diversion Unit Project in the James River Basin, as described in the Agreement.</text>
 </paragraph><paragraph id="id3F7D2E22438F438391D4D91081F19205"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph></subsection><subsection id="id20E20C0508EC4E48BEB1691D197DB090"><enum>(b)</enum><header>Conveyance to District</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall convey to the District all right, title, and interest of the United States in and to the Oakes Test Area, consistent with the terms and conditions of the Agreement.</text>
			</subsection><subsection id="id2e3dc4b1b78845b7abfb732c05260eeb"><enum>(c)</enum><header>Liability</header>
 <paragraph id="idCA800051140546F9AA0D0BA951108912"><enum>(1)</enum><header>In general</header><text>Effective on the date of conveyance to the District of the Oakes Test Area under this section, the United States shall not be held liable by any court for damages of any kind arising out of any act, omission, or occurrence relating to the Oakes Test Area, except for damages caused by acts of negligence committed by the United States or by an employee or agent of the United States prior to the date of conveyance.</text>
 </paragraph><paragraph id="id43E5CF1FF58A4B6FBE4705A71B901F6B"><enum>(2)</enum><header>Applicable law</header><text>Nothing in this section increases the liability of the United States beyond the liability provided in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code (commonly known as the <quote>Federal Tort Claims Act</quote>), on the date of enactment of this Act.</text>
 </paragraph></subsection><subsection id="id57911b3422f74d9ab619b7afa568cede"><enum>(d)</enum><header>Benefits</header><text>After the conveyance of the Oakes Test Area to the District under this section—</text> <paragraph id="iddcbc1c8fbb1843b8b29eaddfb79d0cfb"><enum>(1)</enum><text>the Oakes Test Area shall not be considered to be a part of a Federal reclamation project; and</text>
 </paragraph><paragraph id="id8f15bc70cc704b2c854f020c7665cb60"><enum>(2)</enum><text>the District shall not be eligible to receive any benefits with respect to any facility comprising that Oakes Test Area, other than benefits that would be available to a similarly situated person with respect to a facility that is not part of a Federal reclamation project.</text>
 </paragraph></subsection><subsection id="id40cf2debcb4a46dd9f2af65abfdde83f"><enum>(e)</enum><header>Communication</header><text>If the Secretary has not completed the conveyance required under subsection (b) by the date that is 1 year after the date of enactment of this Act, the Secretary shall submit to Congress a letter with sufficient detail that—</text>
 <paragraph id="id6941AD2E714248AE9E2F2E939DEA69C4"><enum>(1)</enum><text>explains the reasons the conveyance has not been completed; and</text> </paragraph><paragraph id="id9845C63257604BAF94534D8751FA912B"><enum>(2)</enum><text>specifies the date by which the conveyance will be completed.</text></paragraph></subsection></section></legis-body></bill>
