			 crimes involving sexual violence, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="id63BE59DAE83F4CAEA41DBC4948E62BBE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice for Native Survivors of Sexual Violence Act</short-title></quote>.</text> </section><section id="idD46D806360B2478FB9083897B06769AE" section-type="subsequent-section"><enum>2.</enum><header>Tribal jurisdiction over crimes of domestic, dating, or sexual violence, sex trafficking, or stalking</header><text display-inline="no-display-inline">Section 204 of <external-xref legal-doc="public-law" parsable-cite="pl/90/284">Public Law 90–284</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/25/1304">25 U.S.C. 1304</external-xref>) (commonly known as the <quote>Indian Civil Rights Act of 1968</quote>) is amended—</text>
 <paragraph id="idC2E6B7A82E604D55BC162B80A59A2F22"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">domestic violence</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">domestic, dating, or sexual violence, sex trafficking, or stalking</header-in-text></quote>;</text> </paragraph><paragraph id="id2337BB851D2448628F3074E9849D4EAD"><enum>(2)</enum><text>in subsection (a)—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idADBEDFC135094D35B0556CB4D7990181"><enum>(A)</enum><text>in paragraph (1), by striking <quote>means violence</quote> and inserting <quote>includes any violation of the criminal law of the Indian tribe that has jurisdiction over the Indian country where the violation occurs that is</quote>;</text>
 </subparagraph><subparagraph id="id7559FEBD75D54E8FB7475A91AF1CAA33"><enum>(B)</enum><text>in paragraph (2)—</text> <clause id="idF318779F4E3C4B5E863619CF73D7D073"><enum>(i)</enum><text>by striking <quote>means violence</quote> and inserting <quote>includes any violation of the criminal law of the Indian tribe that has jurisdiction over the Indian country where the violation occurs that is</quote>; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="ideaf97fe0ab5742cb9725f98b313a0547"><enum>(ii)</enum><text>by striking <quote>an Indian tribe that has jurisdiction over the Indian country where the violence occurs</quote> and inserting <quote>that Indian tribe</quote>;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0E8674211AA54414992EC98869F8CDDD"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>domestic violence</quote> and inserting <quote>tribal</quote>;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id922F66BEE83F499EB251F9DB40B2EB4B"><enum>(D)</enum><text>by redesignating paragraphs (6) and (7) as paragraphs (9) and (10), respectively;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAD61E02BB930405EAFF58EAE0805FB00"><enum>(E)</enum><text>by inserting after paragraph (5) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id08C2AF1131964861A77B316A873C52AA" style="OLC">
 <paragraph commented="no" id="idF10E5E3B63D1491EBD026A24849DBF16"><enum>(6)</enum><header>Related conduct</header><text>The term <term>related conduct</term> means conduct alleged to have been committed by a defendant that—</text> <subparagraph commented="no" id="id41EFB32DD0B0409D9948D59685BC5E21"><enum>(A)</enum><text>is a violation of the criminal law of the Indian tribe that has jurisdiction over the Indian country where the underlying offense occurred; and</text>
 </subparagraph><subparagraph commented="no" id="id153869EED1804EE7A09A447752C9012B"><enum>(B)</enum><text>occurs in connection with the exercise of special tribal criminal jurisdiction by that Indian tribe.</text>
							</subparagraph></paragraph><paragraph id="idC54DF83D523142DFBFA94692D2848497"><enum>(7)</enum><header>Sex trafficking</header>
 <subparagraph id="idC0D0008F495E4E0398E313568E342366"><enum>(A)</enum><header>In general</header><text>The term <term>sex trafficking</term> means conduct—</text> <clause id="id3c47fc395d7c49c996d210f7a22fbf1b"><enum>(i)</enum><text>consisting of—</text>
 <subclause id="id2866593DAC3D4D5294F3DC1C44E9F40D"><enum>(I)</enum><text>recruiting, enticing, harboring, transporting, providing, obtaining, advertising, maintaining, patronizing, or soliciting by any means a person; or</text>
 </subclause><subclause id="id11690c25d11b4e4cbea14046cb6a544d"><enum>(II)</enum><text>benefiting, financially or by receiving anything of value, from participation in a venture that has engaged in an act described in subclause (I); and</text>
 </subclause></clause><clause id="id945c98df19424378970d9a32a5662025"><enum>(ii)</enum><text>carried out with the knowledge, or, except where the act constituting the violation of clause (i) is advertising, in reckless disregard of the fact, that—</text>
 <subclause id="id91C8A18BCF144509B961A1525BDA3FDE"><enum>(I)</enum><text>means of force, threats of force, fraud, coercion, or any combination of such means will be used to cause the person to engage in a commercial sex act; or</text>
 </subclause><subclause id="id2E819A2D419F4320893F0458D591C66D"><enum>(II)</enum><text>the person has not attained the age of 18 years and will be caused to engage in a commercial sex act.</text>
 </subclause></clause></subparagraph><subparagraph id="id9805757A94B84F9284491B4C063DF838"><enum>(B)</enum><header>Definitions</header><text>In this paragraph, the terms <term>coercion</term> and <term>commercial sex act</term> have the meanings given the terms in section 1591(e) of title 18, United States Code.</text> </subparagraph></paragraph><paragraph id="idc5da4101b98242d49c448e80bad52ae5"><enum>(8)</enum><header>Sexual violence</header><text>The term <term>sexual violence</term> means any nonconsensual sexual act or contact proscribed by Federal, tribal, or State law, including in any case in which the victim lacks the capacity to consent to the act.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="id7DDC5B3C4D104E039055F04D2C86AAE2"><enum>(F)</enum><text>in paragraph (9) (as redesignated by subparagraph (D))—</text> <clause id="id17EB6AC8DA054D97BFB991D74EE0E456"><enum>(i)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">domestic violence</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">tribal</header-in-text></quote>; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idCF51A49AA33D4EF5B571D8466D3F1375"><enum>(ii)</enum><text>by striking <quote>domestic violence</quote> and inserting <quote>tribal</quote>; and</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7609C1170A6B4FD59D6D3E1A465AD83D"><enum>(G)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idD3BDB414EA9C47BEA2ACFBB1BB1A0C8B" style="OLC">
 <paragraph id="id76ac2f841b204b7f815772dbc81c0d8c"><enum>(11)</enum><header>Stalking</header><text>The term <term>stalking</term> means engaging in a course of conduct directed at a specific person that would cause a reasonable person—</text>
 <subparagraph id="id7d694c3c79d74d7cbf8c6436dfa9c1bd"><enum>(A)</enum><text>to fear for his or her safety or the safety of others; or</text> </subparagraph><subparagraph id="id75762bf8b46c45669eebc64ab17af93b"><enum>(B)</enum><text>to suffer substantial emotional distress.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="idC1761C0CDA604CCE9E0D4FB223BC8B0D"><enum>(3)</enum><text>in subsection (b)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id11F439412F5E49A1AE54EFD745C94844"><enum>(A)</enum><text>by striking <quote>domestic violence</quote> each place the term appears and inserting <quote>tribal</quote>; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7B7AEB1885554B6FBFA41637DD665707"><enum>(B)</enum><text>in paragraph (4)—</text> <clause commented="no" display-inline="no-display-inline" id="idE602DBCF1D704461B91836F50E47E343"><enum>(i)</enum><text>by striking subparagraph (B);</text>

 <paragraph id="id004912371581496CA6D4D85D2EAB1EE3"><enum>(3)</enum><header>Stalking</header><text>An act of stalking that occurs in the Indian country of the participating tribe.</text> </paragraph><paragraph id="id87CB0B3D94D9407D89BE9F5B1D01B8F0"><enum>(4)</enum><header>Sex trafficking</header><text>An act of sex trafficking that occurs in the Indian country of the participating tribe.</text>
 </paragraph><paragraph id="id91593DBFD928489DB0B008CA70CDCA4F"><enum>(5)</enum><header>Related conduct</header><text>An act of related conduct that occurs in the Indian country of the participating tribe.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id75A03F3CDF4149CC8D7EC082989BB65B"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (d), by striking <quote>domestic violence</quote> each place the term appears and inserting <quote>tribal</quote>; and</text>
