<section id="H3BC284ECA9764670935760CBAAB1CE6D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Civilian Workforce Pay Raise Fairness Act of 2019</short-title></quote>.</text> </section> <section id="H6A3579A68CCD44F2951473DCC2AC6A08"><enum>2.</enum><header>Pay increase for certain Federal Government employees in 2019</header> <subsection id="idE54CE42F5A414547BA4754C1D72DDC9A"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="idA545F831D2A4452390BDBE7F77A83ECD"><enum>(1)</enum><text>the term <term>career appointee</term> has the meaning given the term in section 3132(a) of title 5, United States Code;</text> </paragraph> <paragraph id="idB56708BC9BA84FA3B97436839C7F8B49"><enum>(2)</enum><text>the term <term>excepted service</term> has the meaning given the term in section 2103 of title 5, United States Code;</text> </paragraph>
<paragraph id="idDF65B9125AF94C44AAF0BF2E6496B31A"><enum>(3)</enum><text>the term <term>FBI–DEA Senior Executive Service</term> means the personnel system described in section 3151(a) of title 5, United States Code; and</text> </paragraph> <paragraph id="idAFA2761A765F4296A812AE18C138F0F6"><enum>(4)</enum><text>the term <term>statutory pay system</term> has the meaning given the term in section 5302 of title 5, United States Code.</text> </paragraph></subsection>
<subsection id="H1D0310E488EF44899372EC85DCF176C1"><enum>(b)</enum><header>Statutory pay systems</header><text>For calendar year 2019, the percentage adjustment under section 5303 of title 5, United States Code, in the rates of basic pay under the statutory pay systems shall be 2.6 percent.</text> </subsection> <subsection id="H90303FA1404B40648E3EA53EDD19EBAB"><enum>(c)</enum><header>Prevailing rate employees</header><text>Notwithstanding the wage survey requirements under section 5343(b) of title 5, United States Code, for fiscal year 2019, the rates of basic pay (as in effect on September 30, 2018, under section 5343(a) of that title) for prevailing rate employees in each wage area and the rates of basic pay under sections 5348 and 5349 of that title shall be increased by 2.6 percent.</text> </subsection>
<subsection id="H4EBF4A6C9B3444D9B0B5F398108B275F"><enum>(d)</enum><header>Senior Executive Service career appointees</header><text display-inline="yes-display-inline">For calendar year 2019, the rate of basic pay for any career appointee and for any career position in the FBI–DEA Senior Executive Service shall be the rate of pay in effect for the position on December 31, 2018, increased by 2.6 percent.</text> </subsection> <subsection id="H4104C0BDE9F9421DBD85B55F191106C3"><enum>(e)</enum><header>Senior-Level and Scientific and Professional positions</header><text display-inline="yes-display-inline">For calendar year 2019, the rate of basic pay for any position to which section 5376 of title 5, United States Code, applies shall be the rate of pay in effect for the position on December 31, 2018, increased by 2.6 percent.</text> </subsection>
<subsection id="H77BBDBC209034AA997ECE84E6C162F07"><enum>(f)</enum><header>Excepted service</header><text display-inline="yes-display-inline">For calendar year 2019, the rate of basic pay for any position in the excepted service shall be the rate of pay in effect for the position on December 31, 2018, increased by 2.6 percent.</text> </subsection> <subsection id="H76DDF5CF4A8C45138C3AB11F5F5EA6AE"><enum>(g)</enum><header>Application</header> <paragraph id="HBC6213A5253F47A39E2F32DBB857800E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The adjustments in pay made under this Act shall apply beginning on the date of enactment of this Act.</text> </paragraph>
<paragraph id="HBEE0CC3102A04711824AB2174E59BFB8"><enum>(2)</enum><header>Other adjustments permitted; limits</header><text display-inline="yes-display-inline">Nothing in this Act may be construed to—</text> <subparagraph id="HD22A00033526404CA07440F8DD2B336D"><enum>(A)</enum><text display-inline="yes-display-inline">limit any other increase, including an allowance, a performance award, or a bonus, otherwise permitted under law to any rate of pay adjusted under this Act; or</text> </subparagraph>
<subparagraph id="H56ADF091474E44009C27437D05CA8F42"><enum>(B)</enum><text display-inline="yes-display-inline">waive any provision of law, rule, or regulation, including section 5307 of title 5, United States Code, limiting total aggregate pay.</text></subparagraph></paragraph></subsection></section> </legis-body> </bill>
