 <paragraph id="H66522DB717EA42A6807C961CB1BED118"><enum>(1)</enum><text display-inline="yes-display-inline">assist employers with special certificates issued under section 14(c) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/214">29 U.S.C. 214(c)</external-xref>) to transform their business and program models to models that support individuals with intellectual, developmental, mental health, and other disabilities to find and retain work in competitive integrated employment;</text>
 </paragraph><paragraph id="HB80533C0D5A14B0192B5FE6E37401431"><enum>(2)</enum><text>ensure individuals with disabilities, families, local and State governments, and other stakeholders are involved in the transformations described in paragraph (1);</text>
 </paragraph><paragraph id="HCB3D185EDC8A4A8DB04CFB545A199CD1"><enum>(3)</enum><text>ensure individuals employed in programs using such special certificates transition to competitive integrated employment positions and, as needed, to services that support them as needed in integrated home and community-based settings;</text>
 </paragraph><paragraph id="H1D229C9CE6D846A9BDCD388946ED622D"><enum>(4)</enum><text display-inline="yes-display-inline">identify models and processes for shifting business and program models from such special certificates to competitive integrated employment models and integrated community participation and wraparound models, and to share that information with other such special certificate holders, State and local entities, and other service providers for those with intellectual, developmental, mental health, and other disabilities; and</text>
 </paragraph><paragraph id="H690FE6400A7A4BA1B4B116A1A46986AB"><enum>(5)</enum><text display-inline="yes-display-inline">support State and local governments as they revise and implement their Olmstead plans to improve integrated employment options and home and community-based services options for all people with disabilities.</text>
			</paragraph></section><title id="H56C9AEDACF6B41518F08753B7CCB470B"><enum>I</enum><header>Competitive integrated employment transformation grant programs</header>
 <section id="HAB318AFA08A7431A84D54C0A65E53984"><enum>101.</enum><header>Program authorized</header><text display-inline="no-display-inline">From the amounts appropriated to carry out this title, the Secretary of Labor shall award grants under sections 102 and 103, on a competitive basis, to States and eligible entities to assist such States and entities to transform their business and program models from providing employment using special certificates issued under section 14(c) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/214">29 U.S.C. 214(c)</external-xref>) to models that support individuals with intellectual, developmental, and other disabilities by—</text>
 <paragraph id="H4FB6ECD30A2A41BBBE7BB85E3FFB3A85"><enum>(1)</enum><text>operating competitive integrated employment businesses;</text> </paragraph><paragraph id="H405AA58E2E9741879CFB871082EB5FFB"><enum>(2)</enum><text>assisting such individuals in finding and retaining work in competitive integrated employment; and</text>
 </paragraph><paragraph id="HDFF8C5578C124FD09EEEBA0CB3AA2B53"><enum>(3)</enum><text display-inline="yes-display-inline">providing integrated employment and integrated community participation and wraparound services (in this Act referred to as <quote>integrated services</quote>) for such individuals.</text>
				</paragraph></section><section id="HADCFD900D6744403B6D7CF8E2EF19438"><enum>102.</enum><header>State grant program</header>
				<subsection id="HA9962BB7D8804C59BD31B27DE8863702"><enum>(a)</enum><header>Application</header>
 <paragraph id="HA2A26DDE0BA74392BF37EED22DE07F70"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant under this section, a State shall submit an application to the Secretary at such time, in such manner, and including such information as the Secretary may reasonably require.</text>
 </paragraph><paragraph id="HD60D734108704BDC9C90FFAD15E33E0A"><enum>(2)</enum><header>Contents</header><text>Each application submitted under paragraph (1) shall include—</text> <subparagraph id="H1A011DF04040472AB0BFB7E6925AC1D5"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the status of the employers in the State providing employment using special certificates, including—</text>
 <clause id="H89B358C592C74D54ACDB5B2B7D18F7BD"><enum>(i)</enum><text display-inline="yes-display-inline">the number of employers providing employment using special certificates;</text> </clause><clause id="H3325E13A2BFD4D26A506ED19ADA0A80A"><enum>(ii)</enum><text>the number of such employers that provide competitive integrated employment, which shall include employers providing such employment in combination with integrated services;</text>
 </clause><clause id="HD2F1C6B48DAF42F19EE35964A74B00A1"><enum>(iii)</enum><text>the number of employees employed under a special certificate, disaggregated by employer;</text> </clause><clause id="H05370D852288408ABA023535D1DD7726"><enum>(iv)</enum><text>the average number of hours such an employee works per week (including the range and median of hours), disaggregated by employer, and reported for the State as a whole; and</text>
 </clause><clause id="H03BDEDAA9168456B9D685982A30D442B"><enum>(v)</enum><text display-inline="yes-display-inline">the average hourly wage for such an employee (including the range and median wage), disaggregated by employer, and reported for the State as a whole;</text>
 </clause></subparagraph><subparagraph id="H38A4106973A24AB1A059E32BB64EC5F1"><enum>(B)</enum><text>a description of activities to be funded under the grant, and the goals of such activities, including—</text>
 <clause id="H5A31C37A6A3B4FE5980E7D1AC80A3AA1"><enum>(i)</enum><text display-inline="yes-display-inline">the process to be used to identify each employer in the State that will transform its business and program models from providing employment using special certificates to providing competitive integrated employment or a combination of competitive integrated employment and integrated services, which, by the end of the 6-year grant period for the State, results in the discontinuation of employment using special certificates in the State, with the exception that any individual employed under a special certificate as of June 4, 1997, may continue to be employed in the employment setting in which such individual was employed as of the day before the date of enactment of this Act, without regard to whether such setting provides integrated employment or a combination of integrated employment and integrated services;</text>
 </clause><clause id="HB0F57E20DAF1485DA8D49CD42D1C453E"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of such employers in the State that will carry out a transformation described in clause (i);</text>
 </clause><clause id="HB947616BF93048F1A8D1EA374A2D844F"><enum>(iii)</enum><text>the service delivery infrastructure that will be implemented in the State to support individuals who have been employed under special certificates through such a transformation;</text>
 </clause><clause id="HADE7E4F0A5F44C97840979363475FE43"><enum>(iv)</enum><text display-inline="yes-display-inline">the integrated employment and integrated services that will be implemented in the State to support such individuals;</text>
 </clause><clause id="HB78DB13674E6416C85C00165E0FA9C73"><enum>(v)</enum><text>the timeline for phasing out employment using special certificates in the State;</text> </clause><clause id="H0BC153CF18A14F899059D09811058808"><enum>(vi)</enum><text display-inline="yes-display-inline">a timeline for the expansion of employers that will provide competitive integrated employment or a combination of competitive integrated employment and integrated services for individuals who have been employed under special certificates;</text>
 </clause><clause id="H3A2E8C182E9345D9AD5055F68861B5E6"><enum>(vii)</enum><text display-inline="yes-display-inline">a description of the expanded integrated employment and integrated services to be provided to such individuals as a result of a transformations described in clause (i); and</text>
 </clause><clause id="H3A14D3760E9E4E8B96F271F577AEF790"><enum>(viii)</enum><text>a description of the process to be used to engage stakeholders in such transformations;</text> </clause></subparagraph><subparagraph id="HE5C86AFDF46448F6A844FD7D100CC533"><enum>(C)</enum><text>a description of how the activities under the grant will coordinate and align Federal, State, and local programs, agencies, and funding in the transformations described in subparagraph (B)(i);</text>
 </subparagraph><subparagraph id="H3E542A75E8ED4589AF5CAF84EDC05ED9"><enum>(D)</enum><text>a description of the State’s evaluation plan to determine the impact of the grant;</text> </subparagraph><subparagraph id="HBAC49B0A0F9747B8833086F9D69A43C5"><enum>(E)</enum><text>assurances that—</text>
 <clause id="H34768184865E41E7A62F0E66EA7AB525"><enum>(i)</enum><text display-inline="yes-display-inline">the activities carried out under the grant will result in each employer in the State that provides employment using special certificates to transform as described in subparagraph (B)(i);</text>
 </clause><clause id="H6EFDF80F7C1445A2B6C55355DD987DA1"><enum>(ii)</enum><text>individuals with the most significant intellectual and developmental disabilities who will be impacted by such a transformation will be given priority in receiving the necessary supports and services to succeed during and after such a transformation;</text>
 </clause><clause commented="no" id="HC4FA1A28A678403EAF2416FDE7EC8088"><enum>(iii)</enum><text>each individual in the State who is employed under a special certificate will, as a result of such a transformation, be employed in competitive integrated employment or be so employed and receive the integrated services desired by the individual;</text>
 </clause><clause id="H94E71948DAAF42CFA3B9849380A4AB9A"><enum>(iv)</enum><text>the State agencies responsible for developmental disability services, Medicaid, education, vocational rehabilitation, mental health services, and other supports agree to be partners in the goals of the grant;</text>
 </clause><clause id="HE2F454A449254CB2A0E8668DEE9BD8AC"><enum>(v)</enum><text>the State will comply with requirements of the Secretary with respect to the collection of data and will require employers providing employment under special certificates in the State to comply with such requirements;</text>
 </clause><clause id="HA627EE3C1E4B4C39BA3FB005052DFE31"><enum>(vi)</enum><text>the State will cooperate with the evaluation under title IV by providing all data required and allow the evaluation of activities under the grant;</text>
 </clause><clause id="H4C17AB6DE77941E18EB1F4A97E2510D6"><enum>(vii)</enum><text>the State will create an advisory council described in paragraph (3) to monitor and guide the process of transforming business and program models of employers in the State; and</text>
 </clause><clause id="H2C6DD6B3877D495F9CBD8B9A6205757C"><enum>(viii)</enum><text display-inline="yes-display-inline">the State will cooperate with the nonprofit entity carrying out technical assistance and dissemination activities under title III; and</text>
 </clause></subparagraph><subparagraph id="H2302691107D54D70A44B40DACECEC72D"><enum>(F)</enum><text display-inline="yes-display-inline">such other information and assurances as the Secretary may reasonably require.</text> </subparagraph></paragraph><paragraph id="HA8002F2BE0804BCFAB9300A45A5E774E"><enum>(3)</enum><header>Members of the advisory council</header><text>A State receiving a grant under this section shall create an advisory council composed of the following:</text>
 <subparagraph commented="no" id="H312CF17ACF1D439F8D54CF9D790C6AFD"><enum>(A)</enum><text display-inline="yes-display-inline">At least 25 percent of the members are individuals with disabilities.</text> </subparagraph><subparagraph id="HB472C451BF924B688584E298398BC443"><enum>(B)</enum><text display-inline="yes-display-inline">Two family members of individuals with intellectual or developmental disabilities who are employed under a special certificate.</text>
 </subparagraph><subparagraph commented="no" id="H41791ED577B84D1F97E1586355F774F1"><enum>(C)</enum><text>Two employers providing competitive integrated employment.</text> </subparagraph><subparagraph id="HA5214C4893084B1EB027AD028F755B70"><enum>(D)</enum><text>Two employers providing employment under special certificates.</text>
 </subparagraph><subparagraph id="HE4810EDF94844881A32AF7631CD34543"><enum>(E)</enum><text display-inline="yes-display-inline">A representative of a nonprofit agency specializing in competitive integrated employment.</text> </subparagraph><subparagraph id="H806CEA13FA844226A0B166FCA2F24F3E"><enum>(F)</enum><text display-inline="yes-display-inline">A representative of the State developmental disability agency.</text>
 </subparagraph><subparagraph id="HE4C9A04B31124B2B8BD7AAA0F58743D5"><enum>(G)</enum><text display-inline="yes-display-inline">A representative of the State vocational rehabilitation agency, as such term is used under the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/701">29 U.S.C. 701</external-xref> et seq.).</text>
 </subparagraph><subparagraph id="HCBC8E1EC84D343B6BE90D09638099680"><enum>(H)</enum><text display-inline="yes-display-inline">A representative of an agency in the State described in paragraph (6) or (7) of section 8501 of title 41, United States Code.</text>
 </subparagraph><subparagraph id="H182CED0D6E0C4B44997119EB215028B5"><enum>(I)</enum><text display-inline="yes-display-inline">A representative of the State independent living centers, as such term is used under the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/701">29 U.S.C. 701</external-xref> et seq.).</text>
 </subparagraph><subparagraph commented="no" id="HF5C47EBF48E749EBA271031A0F19825E"><enum>(J)</enum><text display-inline="yes-display-inline"><italic> </italic>A representative of the State Council on Developmental Disabilities, as defined in section 102 of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15002">42 U.S.C. 15002</external-xref>).</text>
						</subparagraph><subparagraph commented="no" id="H6D50B14C0466442DB3C78570D1639A74"><enum>(K)</enum>
 <text>A representative of one of the State University Centers for Excellence in Developmental Disabilities Education, Research, and Service, established under subtitle D of title I of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15061">42 U.S.C. 15061</external-xref> et seq.).</text>
 </subparagraph><subparagraph id="H79FAD7D200C043AABB99452FD4BD5263"><enum>(L)</enum><text display-inline="yes-display-inline">Representatives of other State agency and disability organizations (such as the State Medicaid agencies, State Protection and Advocacy systems as defined in section 102 of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15002">42 U.S.C. 15002</external-xref>), and other disability related offices and groups with expertise in competitive integrated employment).</text>
 </subparagraph></paragraph></subsection><subsection id="H7C890BA6A9934A5392FEDD3B7E588E61"><enum>(b)</enum><header>Geographic diversity</header><text>To the extent practicable, the Secretary shall distribute grant funds under this section equitably among geographic areas of the United States, and take into account rural and urban diversity.</text>
 </subsection><subsection id="H7AC67007727C4142B28609EC00BC7D02"><enum>(c)</enum><header>Duration of awards</header><text>A grant under this section shall be awarded for a period of 6 years.</text> </subsection><subsection id="H1EE5C73747124B978E857FA131A96CBB"><enum>(d)</enum><header>Limit on award number</header><text>A State may only be awarded 1 grant under this section.</text>
 </subsection><subsection id="HD92ED416E6B44509A275D525348DBF87"><enum>(e)</enum><header>Amount of awards</header><text>A grant awarded under this section may not be made in an amount that is less than $2,000,000, or more than $10,000,000, for the 6-year grant period.</text>
				</subsection></section><section id="HDC0086E8C1D0498BB1FF8F34C2AE1FE4"><enum>103.</enum><header>Certificate holder grant program</header>
 <subsection id="H3396E45557C341E6821B8D38EB0047CE"><enum>(a)</enum><header>In general</header><text>To be eligible to receive a grant under this section, an eligible entity shall submit an application to the Secretary at such time, in such manner, and including such information as the Secretary may reasonably require.</text>
 </subsection><subsection id="HCEAD93FC3893463EAEE82B437C826F23"><enum>(b)</enum><header>Contents</header><text>Each application submitted under subsection (a) shall include—</text> <paragraph id="H002F7EF9A7A64451A3F7CD1E543A15C3"><enum>(1)</enum><text display-inline="yes-display-inline">the status of the eligible entity’s use of special certificates to employ individuals, including—</text>
 <subparagraph id="H8244BAA7AD9341A897AC39A018E9B01F"><enum>(A)</enum><text>the number of employees the eligible entity employs using such special certificates;</text> </subparagraph><subparagraph id="HD58BFBAB249B410A9EF8600CA32396EF"><enum>(B)</enum><text>the average, minimum, maximum, and range of hourly wages paid to employees employed using such special certificates during the previous year;</text>
 </subparagraph><subparagraph id="HEFF9A1BB9742451483880985D15B5149"><enum>(C)</enum><text>during the preceding 5-year period, the number of individuals who have been transitioned by the eligible entity from employment under such special certificates to competitive integrated employment; and</text>
 </subparagraph><subparagraph id="H6CAC4BCE85C94DAFB46E60395D2209D8"><enum>(D)</enum><text>a description of the business and program models (including the financial and organizational structure) of the eligible entity that is using the special certificates, including—</text>
 <clause id="H9915BE55D5F6453BAD83CB6F24BF0068"><enum>(i)</enum><text>the number of employees paid at a wage below the Federal minimum wage under section 6(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)</external-xref>) at the time of the application;</text>
 </clause><clause id="H244BC33472924615A1041D0FD04D0376"><enum>(ii)</enum><text>the number and type of contracts the entity has entered into during the preceding 3 fiscal years;</text> </clause><clause id="H850813D5546B42649698AEEE38782E53"><enum>(iii)</enum><text>the budget and the funding structure for the preceding 3 fiscal years;</text>
 </clause><clause id="H72D51D6058D24CF7844039EF4322ECD5"><enum>(iv)</enum><text>the human resource structure; and</text> </clause><clause id="HAE847151174F4DB49C0D69DC43A54520"><enum>(v)</enum><text>the community partners described in subsection (h)(2) that have partnered with the eligible entity;</text>
 </clause></subparagraph></paragraph><paragraph id="H47325A677CFD4AB88B152A7BACD5AA4F"><enum>(2)</enum><text>a description of activities to be funded under the grant, and the goals of the grant activities, including—</text>
 <subparagraph id="H5DEC7DCC581B46038B84189300721401"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the business and program models of competitive integrated employment or a combination of competitive integrated employment and integrated services into which the models of the eligible entity will transform, including the business plan, employment structure, and leadership organization;</text>
 </subparagraph><subparagraph commented="no" id="HBB7F4EEA4B06451FAB904ACEE96BE0C2"><enum>(B)</enum><text display-inline="yes-display-inline">a description of the evidence-based, integrated services—</text> <clause commented="no" id="H3CF9167571424479A619837DF6892E75"><enum>(i)</enum><text>to be provided by the eligible entity; or</text>
 </clause><clause commented="no" id="H4F5C01C802D34918BEFCC6C453EC080A"><enum>(ii)</enum><text>the eligible entity’s process for referring an individual requiring such services to a provider of such services to ensure that the individual receives such services;</text>
 </clause></subparagraph><subparagraph id="HBD03358BA3DE4953A04B75FEDED702CB"><enum>(C)</enum><text>after the transformation of the eligible entity’s business and program models as described in subparagraph (A), the number of employees that will be employed under such models;</text>
 </subparagraph><subparagraph id="H33220D89179D4A9BABF72EDC7AFD2F18"><enum>(D)</enum><text>the date on which the eligible entity will discontinue using special certificates, and the funding structure the eligible entity will use to provide competitive integrated employment or a combination of such employment and integrated services; and</text>
 </subparagraph><subparagraph id="HD45F6F408CAA4FDC9E12084521665E9B"><enum>(E)</enum><text display-inline="yes-display-inline">the process to be used for the transformation of the eligible entity’s business and program models as described in subparagraph (A), including—</text>
 <clause id="HD1CC0A8A54854B03A11024EED62D54B2"><enum>(i)</enum><text>redesign of contracts;</text> </clause><clause id="H429BAE1E5C894EC3AA4E8C5563E0DBDC"><enum>(ii)</enum><text>any changes in funding sources;</text>
 </clause><clause id="H72C131A1DBBF44C085CB73617B1CEF51"><enum>(iii)</enum><text>staff training on inclusive employment practices;</text> </clause><clause id="HCC89EB88B9C14ED598BA942004B72905"><enum>(iv)</enum><text>input from key stakeholders, including individuals with disabilities, their families, and other local stakeholders; and</text>
 </clause><clause id="H54BEA95D03CE4BC6A0363465CA3C06DB"><enum>(v)</enum><text>a description of the individuals who will be responsible for the development and implementation of such process;</text>
 </clause></subparagraph></paragraph><paragraph id="HEA28739AA9D74620BC750072FF87E6A9"><enum>(3)</enum><text>a timeline of activities to be implemented and goals to be reached on at least a quarterly basis during the 3-year grant period;</text>
 </paragraph><paragraph id="H9D67948134984F9298704489C8D7FA7C"><enum>(4)</enum><text>a description of how the activities under the grant will coordinate and align Federal, State, and local programs, agencies, and funding in the transformation described in paragraph (2)(A);</text>
 </paragraph><paragraph id="HF479228D73F54DBEA19BC575FF6704F2"><enum>(5)</enum><text>assurances that—</text> <subparagraph id="H8B93DD202EDA433BBFF399A29C95AA59"><enum>(A)</enum><text>the activities carried out under the grant will result in the transformation described in paragraph (2)(A);</text>
 </subparagraph><subparagraph commented="no" id="H9B041DEB5DAB4F0BB7C6C891E5FEE885"><enum>(B)</enum><text display-inline="yes-display-inline">individuals who are employed by the eligible entity under special certificates will be employed in competitive integrated employment or be so employed and receive the integrated services desired by the individual;</text>
 </subparagraph><subparagraph id="HC4F8A3514F684B3D90CD1CF078D38E1B"><enum>(C)</enum><text display-inline="yes-display-inline">the eligible entity will comply with the requirements of the Secretary with respect to the collection of data;</text>
 </subparagraph><subparagraph id="H323D1AD88F1A494D99DF161596DA2D97"><enum>(D)</enum><text>the eligible entity will cooperate with the evaluation described in title IV by providing all data required and allow evaluation of the activities under the grant; and</text>
 </subparagraph><subparagraph commented="no" id="HDE610D1E711444029181795E82E76DAC"><enum>(E)</enum><text>the eligible entity will cooperate with the nonprofit entity carrying out technical assistance and dissemination required under title III;</text>
 </subparagraph></paragraph><paragraph id="H168C0E9719134969B3FAE98239AFF9DC"><enum>(6)</enum><text>a description of the eligible entity’s evaluation plan to determine the impact of the grant;</text> </paragraph><paragraph id="HF86E628F0E2E4C40B7E809A2039EC0A8"><enum>(7)</enum><text display-inline="yes-display-inline">assurances of collaboration and support from all State entities (including the State Medicaid agency, the State developmental disability agency, and the State vocational rehabilitation agency) for whom the eligible entity is an approved provider of services; and</text>
 </paragraph><paragraph id="HDEC9A2571B9D4D25A0368DC34A6A5767"><enum>(8)</enum><text>such other information and assurances as the Secretary may reasonably require.</text> </paragraph></subsection><subsection id="H1BDD9BAB11E145DF95F32CD9570FB314"><enum>(c)</enum><header>Geographic diversity</header><text>To the extent practicable, the Secretary shall distribute grant funds under this section equitably among geographic areas of the United States, and shall take into account rural and urban diversity.</text>
 </subsection><subsection id="H8C59BAE80B76437F82E3732D589FBDD5"><enum>(d)</enum><header>Program size</header><text>To the extent practicable, the Secretary shall distribute grant funds under this section equitably among eligible entities providing employment using special certificates serving different numbers of individuals.</text>
				</subsection><subsection id="H3D4197B451F840F8853805F80209A6DF"><enum>(e)</enum><header>Duration of awards</header>
 <paragraph id="HF995F5EB1C9A4D609830E7A6BF6A0540"><enum>(1)</enum><header>Grant period</header><text>A grant awarded under this section shall be awarded for a period of 3 years.</text> </paragraph><paragraph id="HF2E435E92ADB455B8762ED022E99759E"><enum>(2)</enum><header>Grant cycles</header><text>Grants shall be awarded under this section in 2 grant cycles. Grants for the second grant cycle shall be awarded upon the expiration of the first 3-year grant period under this section.</text>
 </paragraph></subsection><subsection id="H503968251545417DAF3AA963B8E5230E"><enum>(f)</enum><header>Limit on award number</header><text>An eligible entity may only be awarded 1 grant under this section.</text> </subsection><subsection id="H416F635E0E0E46439CD074AF867B92B7"><enum>(g)</enum><header>Amount of awards</header><text display-inline="yes-display-inline">A grant awarded under this section may not be made in an amount that is less than $100,000, or more than $500,000, for the 3-year grant period.</text>
 </subsection><subsection id="HE40885C19C424E30B8C9D5A57FC2DA56"><enum>(h)</enum><header>Eligible entity defined</header><text>In this title, the term <term>eligible entity</term> means an entity that—</text> <paragraph id="H8F7AACF42A5C4126B3AE6F416488E903"><enum>(1)</enum><text>employs individuals under special certificates and is located in a State that did not receive a grant under section 102; and</text>
 </paragraph><paragraph id="H469ECB4806844D12BA81E5E49B9F892A"><enum>(2)</enum><text>partners with at least 2 entities with experience providing support to individuals with disabilities in competitive integrated employment, such as—</text>
 <subparagraph id="H296ABA93CFAE493390436CF1DFCD7A16"><enum>(A)</enum><text>an employer providing competitive integrated employment;</text> </subparagraph><subparagraph id="H43575C8435F54ACBB7F7D2F157A8FC18"><enum>(B)</enum><text>a State developmental disability agency;</text>
 </subparagraph><subparagraph id="id07984551E9744D409D6FEF1DDD427620"><enum>(C)</enum><text>a State mental health services agency;</text> </subparagraph><subparagraph id="H2AFF9A5CBF69489CB9B8E1B43A5EA116"><enum>(D)</enum><text display-inline="yes-display-inline">a representative of an agency described in paragraph (6) or (7) of section 8501 of title 41, United States Code;</text>
 </subparagraph><subparagraph id="HC78804ABE3C84D6C90777ACAB93C89C8"><enum>(E)</enum><text display-inline="yes-display-inline">a representative of the State Council on Developmental Disabilities, as defined in section 102 of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15002">42 U.S.C. 15002</external-xref>);</text>
 </subparagraph><subparagraph display-inline="no-display-inline" id="HA5447104CA614C2FAC2AFE216D06F60F"><enum>(F)</enum><text display-inline="yes-display-inline">a representative of the State vocational rehabilitation agency, as such term is used under the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/701">29 U.S.C. 701</external-xref> et seq.);</text>
 </subparagraph><subparagraph id="H8C344E8700CD4294980891C71EE3E30D"><enum>(G)</enum><text display-inline="yes-display-inline">a representative of the State independent living centers, as such term is used under the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/701">29 U.S.C. 701</external-xref> et seq.);</text>
 </subparagraph><subparagraph id="H9890243935B549618B62E02D3DFFEF3D"><enum>(H)</enum><text display-inline="yes-display-inline">a representative of one of the State University Centers for Excellence in Developmental Disabilities Education, Research, and Service, established under subtitle D of title I of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15061">42 U.S.C. 15061</external-xref> et seq.); and</text>
 </subparagraph><subparagraph id="H3CE8BBA483BC48ABB2407D6EDF33BE50"><enum>(I)</enum><text display-inline="yes-display-inline">a nonprofit agency specializing in competitive integrated employment.</text> </subparagraph></paragraph></subsection></section></title><title id="H235345B6ADDA4F1D9A9BD55BE063981B"><enum>II</enum><header>Phase out of special certificates under section 14<enum-in-header>(c)</enum-in-header> of the Fair Labor Standards Act of 1938</header> <section id="H077EF36E2DB243E1BA53556DB2A7A14C"><enum>201.</enum><header>Transition to fair wages for individuals with disabilities</header><text display-inline="no-display-inline">Subparagraph (A) of section 14(c)(1) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/214">29 U.S.C. 214(c)(1)</external-xref>) is amended to read as follows:</text>
				<quoted-block id="HEF78F1B9533A42EF960727EDB76EEDEB" style="OLC">
 <subparagraph id="HC116A2D83E1B4DE9A366C1AE163BD0EE"><enum>(A)</enum><text>at a rate that equals, or exceeds, the greater of—</text> <clause id="H17941AE46D09447C90437E3AE3073250"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="HCD3C5E5597454B2EB9044AFFD4A0DE8A"><enum>(I)</enum><text display-inline="yes-display-inline">50 percent of the wage rate in effect under section 6(a)(1), beginning 6 months after the date of enactment of the <short-title>Transformation to Competitive Employment Act</short-title>;</text>
 </subclause><subclause id="H04B4A4F7C748435AAFFBF8F4F149A218" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">60 percent of the wage rate in effect under section 6(a)(1), beginning 2 years after such date;</text> </subclause><subclause id="HBDE329DC56884FFD91815401D4C6E604" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">70 percent of the wage rate in effect under section 6(a)(1), beginning 3 years after such date;</text>
 </subclause><subclause id="HD8F71C8721294A15939C6016AA5FC4B0" indent="up1"><enum>(IV)</enum><text display-inline="yes-display-inline">80 percent of the wage rate in effect under section 6(a)(1), beginning 4 years after such date;</text> </subclause><subclause id="H665439A435594ED381F3DDE9C4E2F259" indent="up1"><enum>(V)</enum><text display-inline="yes-display-inline">90 percent of the wage rate in effect under section 6(a)(1), beginning 5 years after such date; and</text>
 </subclause><subclause id="H0CE6BE03B35146939F8B1882D8A1EA63" indent="up1"><enum>(VI)</enum><text>the wage rate in effect under section 6(a)(1), on the date that is 6 years after the date of enactment of the <short-title>Transformation to Competitive Employment Act</short-title>; or</text>
 </subclause></clause><clause id="HF7F502746686414E8701B7484E03A6F3"><enum>(ii)</enum><text display-inline="yes-display-inline">the wage rate in effect on the day before the date of enactment of the Transformation to Competitive Employment Act for the employment, under a special certificate issued under this paragraph, of the individual for whom the wage rate is determined under this paragraph.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H46696BE7ECFE4F6C81087680EA9622DB"><enum>202.</enum><header>Prohibition on new special certificates; sunset</header><text display-inline="no-display-inline">Section 14(c) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/214">29 U.S.C. 214(c)</external-xref>) (as amended by section 201), is further amended by adding at the end the following:</text>
				<quoted-block id="H86A0BAF1964745788DAF5A9D26373AFB" style="OLC">
 <paragraph id="HEC6B654630FA44C691C706FFBCDAE2B3" indent="up1"><enum>(6)</enum><header>Prohibition on new special certificates</header><text>Notwithstanding paragraph (1), the Secretary shall not issue a special certificate under this subsection to an employer that was not issued a special certificate under this subsection before the date of enactment of the <short-title>Transformation to Competitive Employment Act</short-title>.</text>
 </paragraph><paragraph id="HC691699945BB4A02A79603F4876695CC" indent="up1"><enum>(7)</enum><header>Sunset</header><text>Beginning on the day after the date on which the wage rate described in paragraph (1)(A)(i)(VI) takes effect, the authority to issue special certificates under paragraph (1) shall expire, and no special certificates issued under paragraph (1) shall have any legal effect.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="H06337EEECBF84094AEC334CF54D792CF"><enum>III</enum><header>Technical assistance and dissemination</header>
 <section id="HB6FA0E9948D5486F9832238640D5C4ED"><enum>301.</enum><header>Grant authorized</header><text display-inline="no-display-inline">From the amounts appropriated for this title, the Secretary (acting through the Office of Disability Employment Policy) shall award a grant to a nonprofit entity to—</text>
 <paragraph id="H9DDE5D849589432B8D88FA7971506DFD"><enum>(1)</enum><text display-inline="yes-display-inline">provide technical assistance to employers transforming their business and program models from providing employment for individuals with disabilities under special certificates to providing competitive integrated employment to such individuals; and</text>
 </paragraph><paragraph id="H55F764C167374CE19C762B3843AF64BF"><enum>(2)</enum><text>collect and disseminate learned practices on such transformations.</text> </paragraph></section><section id="HB181659CC9CC445FA5A43302F8134FA4"><enum>302.</enum><header>Application</header> <subsection id="H03E1ED9244CB40DC85D6B8C7165B7ED9"><enum>(a)</enum><header>In general</header><text>To be eligible to receive a grant under this section, a nonprofit entity shall submit an application to the Secretary at such time, in such manner, and including such information that the Secretary may reasonably require.</text>
 </subsection><subsection id="H972433BFCE8B41379E39070E53D1F2C6"><enum>(b)</enum><header>Contents</header><text>Each application submitted under subsection (a) shall include—</text> <paragraph id="HC8192477750E40009FD29F9077BA8A1D"><enum>(1)</enum><text>a description of the nonprofit entity’s expertise in providing technical assistance that shall include evidence of—</text>
 <subparagraph id="HB3B193DCB4784E24B0A382CBFD45E70E"><enum>(A)</enum><text>knowledge of transforming business and program models providing employment using special certificates to models providing competitive integrated employment;</text>
 </subparagraph><subparagraph id="H5E22FD43D30F43B39AAA10CAD6DABA0A"><enum>(B)</enum><text>knowledge of methods for supporting employers, including employers not receiving a grant under title I, to transform as described in subparagraph (A);</text>
 </subparagraph><subparagraph id="H14FB2ED1FE244333A4FCA52C5949C196"><enum>(C)</enum><text>experience working with nonprofit, for-profit, local, State, and Federal agencies focusing on employment of youth and adults with disabilities; and</text>
 </subparagraph><subparagraph id="H4D0F61AA03F04FF49A15242D9D7FD7D2"><enum>(D)</enum><text>experience working with individuals with disabilities and their families; and</text> </subparagraph></paragraph><paragraph id="HBC4336E3176B4D17AFECB44D68338107"><enum>(2)</enum><text>a description of the nonprofit entity’s expertise in providing, collecting, compiling, communicating, and disseminating information about program and systems change for programs serving individuals with disabilities that shall include—</text>
 <subparagraph id="H478C68691A09409381829A61198FB8E0"><enum>(A)</enum><text>expertise documenting program change;</text> </subparagraph><subparagraph id="HF07A2C3A02E34B2FA3259528DE41EB5C"><enum>(B)</enum><text>experience compiling recommended practices related to program transformations;</text>
 </subparagraph><subparagraph id="H31552A3F3FF44D93AFAA4C1D9C623940"><enum>(C)</enum><text>expertise regarding competitive integrated employment for youth and adults with disabilities;</text> </subparagraph><subparagraph id="HB3A74E4C2AEA4503AC5B3ED93E790A0B"><enum>(D)</enum><text>expertise working with individuals with disabilities and their families through systems change procedures;</text>
 </subparagraph><subparagraph id="H38C56CC138624120BC1636615BF69169"><enum>(E)</enum><text>expertise creating products to disseminate learned information, including through web-based means;</text> </subparagraph><subparagraph id="H3D491A9C2B24495781470A893AC79DCD"><enum>(F)</enum><text>experience creating websites to disseminate information; and</text>
 </subparagraph><subparagraph id="H00A0A858E7E84D03B9627BBC1F3BE1EC"><enum>(G)</enum><text>experience working with nonprofit, for-profit, local, State, and Federal agencies focusing on employment of youth and adults with disabilities.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" id="H116142D3C99647C9828830D87E1D3E5B"><enum>(c)</enum><header>Key personnel</header><text>A description of the individuals at the nonprofit entity who will be responsible for carrying out the activities of this title.</text>
 </subsection><subsection id="H76CB6E53A46E4DD7AB3861D35E1AFD05"><enum>(d)</enum><header>Duration of award</header><text>A grant under this section shall be awarded for a period of 6 years, and shall be non-renewable.</text> </subsection><subsection id="H9B7412BF94A9418186A78FFC5AEA1C63"><enum>(e)</enum><header>Nonprofit entity defined</header><text display-inline="yes-display-inline">In this title, the term <term>nonprofit entity</term> means a nonprofit entity with expertise in collecting, compiling, communicating, and disseminating information about program and systems change for programs serving individuals with disabilities.</text>
				</subsection></section></title><title id="H2E081182D91B4BAB8800C512C00C069D"><enum>IV</enum><header>Reporting and evaluation</header>
			<section id="H76DFD81216B74CC081F151D09F8AB025"><enum>401.</enum><header>Impact evaluation and reporting</header>
 <subsection id="H1AC928E49E184F67B46A30CE9711D2AA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, the Secretary shall enter into a contract with a nonprofit entity with experience in conducting evaluations of program and systems change efforts to—</text>
 <paragraph id="H8B2CF62A01964E97AB6F74CDCED83098"><enum>(1)</enum><text>conduct a multi-year evaluation on the impact of this Act, including the amendments made by this Act, with respect to individuals with disabilities (including individuals receiving a wage rate under section 14(c) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/214">29 U.S.C. 214(c)</external-xref>), as amended by title II of this Act); and</text>
 </paragraph><paragraph id="H17BF1836974343FD8EB2A160AF797E8A"><enum>(2)</enum><text>prepare the reports described in subsection (c).</text> </paragraph></subsection><subsection id="HFB674135A0824A87BEB4C107AC5E3AA1"><enum>(b)</enum><header>Evaluation</header><text display-inline="yes-display-inline">In carrying out subsection (a)(1), the nonprofit entity awarded a contract under this section shall evaluate—</text>
 <paragraph id="H5DC1F9A7957D481CB8D7F99ACEDA9E50"><enum>(1)</enum><text>changes in wages and employment for individuals described in subsection (a)(1); and</text> </paragraph><paragraph id="HBE8CC36A62B0477FA6DC91C203BAE4CC"><enum>(2)</enum><text>actions taken by employers and States to comply with the amendments made by title II and, in the case of an employer or State receiving funds under title I, to comply with the transformation requirements under such title.</text>
 </paragraph></subsection><subsection id="H6A724679F18D49F6B2392463CC253AD4"><enum>(c)</enum><header>Reports</header><text>The Secretary shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Labor of the House of Representatives, the following reports on the evaluation conducted under subsection (a)(1):</text>
 <paragraph id="H717CA1BB4C1F462AA98FCBD1FAC2566B"><enum>(1)</enum><text>An interim report on the evaluation, not later than 3 years after the evaluation commences under subsection (a)(1).</text>
 </paragraph><paragraph id="HE148168EB0EA4C36B387B152B5FA4BFF"><enum>(2)</enum><text>A final report on such evaluation, not later than 18 months after the date on which the legal effect of special certificates expire pursuant to paragraph (7) of section 14(c) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/214">29 U.S.C. 214(c)</external-xref>), as added by title II of this Act.</text>
 </paragraph></subsection></section><section id="HC954B5D61976455597D3CBCB5F2C4CA3"><enum>402.</enum><header>Wage and hour report</header><text display-inline="no-display-inline">For each year of the 6-year period described in section 14(c)(1)(A) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/214">29 U.S.C. 214(c)(1)(A)</external-xref>), as amended by title II of this Act, the Secretary (acting through the Administrator of the Wage and Hour Division of Department of Labor) shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Labor of the House of Representatives, an annual report summarizing practices of employers providing employment using special certificates which, with respect to the preceding year, shall include—</text>
 <paragraph id="H252401A037374E81B946C2DF08A9AFF2"><enum>(1)</enum><text display-inline="yes-display-inline">the number of employees paid a wage that is below the minimum wage specified under section 6(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)</external-xref>);</text>
 </paragraph><paragraph id="HB489A4BB14424D45BA3B5F8E68F2B5C2"><enum>(2)</enum><text display-inline="yes-display-inline">the type of employment setting (such as segregated employment, competitive integrated employment, non-employment, or seeking employment) and the integrated services provided by such employers;</text>
 </paragraph><paragraph id="HB1B101AD87AD4469A3C984BDC200F530"><enum>(3)</enum><text display-inline="yes-display-inline">the average hourly wage, minimum and maximum hourly wage, and average hours worked per week, disaggregated by employer and by State; and</text>
 </paragraph><paragraph id="HAF53DBE9D4AD4C50878BE93628BE9564"><enum>(4)</enum><text>the number of employees who have transitioned from employment provided under a special certificate to competitive integrated employment, disaggregated by employer and by State.</text>
				</paragraph></section></title><title id="HFD21C431CD404AABAEFE6270F66B8D7B"><enum>V</enum><header>General provisions</header>
 <section id="H709BE13FACC14F52AC064C3448063E78"><enum>501.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H419D68EFDF1C4F21A0AC1E54A471051C"><enum>(1)</enum><header>Competitive integrated employment</header><text display-inline="yes-display-inline">The term <term>competitive integrated employment</term> has the meaning given the term in section 7(5) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/705">29 U.S.C. 705(5)</external-xref>).</text>
				</paragraph><paragraph id="H05BEF452CC1C4FE9AB8657D5A34C257B"><enum>(2)</enum><header>Integrated community participation and wraparound services; integrated services</header>
 <subparagraph id="H6AB97CA05E3D4F9C9F6CA98AEE0F5358"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The terms <term>integrated community participation and wraparound services</term> or <term>integrated services</term> mean services—</text> <clause id="H6A9AC81F69574769B03C6573444C4479"><enum>(i)</enum><text>designed to assist individuals with disabilities in acquiring, retaining, and improving skills necessary to reside successfully in home and community-based settings;</text>
 </clause><clause id="HE724BB781ED148C7999082338D8BA9F6"><enum>(ii)</enum><text>provided consistent with written plans of care; and</text> </clause><clause id="H1E988E3DE7A74E2BAC8FC775C7DBEBE8"><enum>(iii)</enum><text>that meet the following requirements with respect to the setting in which the services are provided:</text>
 <subclause id="H5C3F919FC97A43E2B204BB14659A533D"><enum>(I)</enum><text>The services are provided to an individual in a setting that is in the community, which allows the individual to engage in community life, receive the services in the community, and have the same access to the community as an individual not receiving the services.</text>
 </subclause><subclause id="HB3F653A648894435B30FC91651596E4F"><enum>(II)</enum><text>Multiple service settings are provided as options to the individual receiving the services.</text> </subclause><subclause id="H5ED56E7E5FB4445AB2D67CFCCFB5701D"><enum>(III)</enum><text>The service setting optimizes individual initiative, autonomy, and independence.</text>
 </subclause><subclause id="HE3898BA5EFC5463287CA2B4D99377F8B"><enum>(IV)</enum><text>The service setting facilitates choice regarding services and supports, and choice regarding who provides the services.</text>
 </subclause></clause></subparagraph><subparagraph id="H0E6DB430499C472180A81F1676B563AD"><enum>(B)</enum><header>Exclusions</header><text>The following settings do not meet the requirements described in subparagraph (A)(iii):</text> <clause id="H91A83F6CCA354227BECF63AD9796906E"><enum>(i)</enum><text>A nursing facility.</text>
 </clause><clause id="HBE60D928978C4568A1C8D435152CC01D"><enum>(ii)</enum><text>An institution for mental diseases.</text> </clause><clause id="H0DACC732F5C54CF0BC905D614B7F060B"><enum>(iii)</enum><text>An intermediate care facility for individuals with intellectual disabilities.</text>
 </clause></subparagraph></paragraph><paragraph id="H834CC23093E748B98B5583E5D5624293"><enum>(3)</enum><header>Integrated employment</header><text display-inline="yes-display-inline">The term <term>integrated employment</term> has the meaning given the term <term>competitive integrated employment</term> in subparagraphs (B) and (C) of section 7(5) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/705">29 U.S.C. 705(5)</external-xref>).</text> </paragraph><paragraph id="H55720239646F4CBEA1EFB44EDC3257E0"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text>
 </paragraph><paragraph id="H4A768F06C1D74FD5B6F68062EFE21411"><enum>(5)</enum><header>Special certificate</header><text display-inline="yes-display-inline">The term <term>special certificate</term> means a special certificate issued under section 14(c) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/214">29 U.S.C. 214(c)</external-xref>).</text>
 </paragraph><paragraph id="H04BF8352D29D4DF4BB037E08A5983B2F"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means each of the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, and the territory of Guam.</text>
 </paragraph></section><section id="H2316BC1815A84CA0AF646D97B8869F6F"><enum>502.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this Act, $300,000,000 for fiscal years 2020 through 2025.</text></section></title></legis-body></bill>
