 by lapses in appropriations.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Government Employee Fair Treatment Act of 2019</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id9EA72DAAE9E94F3BA90BF3C0A56F0F0B" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Compensation for Federal and other government employees affected by a lapse in
 appropriations</header><text display-inline="no-display-inline">Section 1341 of title 31, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idACDAB116B2D54AA4BF21132AF2BF752D"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1), by striking <quote>An officer</quote> and inserting <quote>Except as specified in this subchapter or any other provision of law, an officer</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA6023A758F2C4DA989BDBC62F4404B7B"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id3867EADA91B749EEBCA200CFF1D7BCFC" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="id38A21883BC2F4C4EABFA134BA9B080D5"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idE07BEBFA9A094E1498B6511968C40473"><enum>(1)</enum><text display-inline="yes-display-inline">In this subsection—</text><subparagraph commented="no" display-inline="no-display-inline" id="id45DB1D3BA3A4473FBE3E2126E1E20BAC" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>covered lapse in appropriations</term> means any lapse in appropriations that begins on or after December 22, 2018;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id52856DFB6243457A82D06BFAADE702C1" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>District of Columbia public employer</term> means—</text><clause commented="no" display-inline="no-display-inline" id="id2520E9F4D7A746A7AEB291FDE2AB9981"><enum>(i)</enum><text display-inline="yes-display-inline">the District of Columbia Courts;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6AD4934BED6A4F95A80750A51A6EA9FB"><enum>(ii)</enum><text display-inline="yes-display-inline">the Public Defender Service for the District of Columbia; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id888FD5A24EA6413390241C2061154E71"><enum>(iii)</enum><text display-inline="yes-display-inline">the District of Columbia government;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF99489101071472A9257B35C19AE6601" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">the term <term>employee</term> includes an officer; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6AFD29627EA249C891CEE3536D2AD0D3" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">the term <term>excepted employee</term> means an excepted employee or an employee performing emergency work, as such terms are defined by the Office of Personnel Management or the appropriate District of Columbia public employer, as applicable.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFA1969B468A94910B04544730980C3A1" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Each employee of the United States Government or of a District of Columbia public employer furloughed as a result of a covered lapse in appropriations shall be paid for the period of the lapse in appropriations, and each excepted employee who is required to perform work during a covered lapse in appropriations shall be paid for such work, at the employee's standard rate of pay, at the earliest date possible after the lapse in appropriations ends, regardless of scheduled pay dates.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3d511db441e74cf3b728870fab8e6a93" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">During a covered lapse in appropriations, each excepted employee who is required to perform work shall be entitled to use leave under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, or any other applicable law governing the use of leave by the excepted employee, for which compensation shall be paid at the earliest date possible after the lapse in appropriations ends, regardless of scheduled pay dates.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
