			 Rico, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H9D20D6C2D41B4027ACBABBDE4C8FE448" style="OLC">
 <section id="H1D92A8B87FDA4A51ACFCB30FCFCF87B2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Commission on the Federal Response to Natural Disasters in Puerto Rico Act of 2019</short-title></quote>.</text> </section><section id="H9DCBC023C97A4E18B43C6318E6C2828F"><enum>2.</enum><header>Establishment and purpose</header> <subsection id="HDDF4562B62A34E75941385839520408D"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established a National Commission on the Federal Response to Natural Disasters in Puerto Rico (in this Act referred to as the <quote>Commission</quote>).</text>
 </subsection><subsection id="H02D84097114C4BC08815F1166A55176F"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of the Commission is to examine the Federal preparedness, response, and recovery to the 2017 natural disasters in Puerto Rico, including the Federal Government’s consideration of the following aspects:</text>
 <paragraph id="H68C1147998E7422F8D86B280DA17A1B8"><enum>(1)</enum><text>Federal preparedness activities prior to Hurricanes Irma and Maria, including Federal plans for the 2017 hurricane season and decision making regarding prepositioning contracts and supplies.</text>
 </paragraph><paragraph id="HDE492A6C805649B3AF73CC5BBB2E53BA"><enum>(2)</enum><text>Federal response activities during Hurricanes Irma and Maria, including Federal coordination, distribution of assistance, and contracting.</text>
 </paragraph><paragraph id="HBFF029F8C4BE41A5A34AFA282A7E0C16"><enum>(3)</enum><text>Federal recovery activities after Hurricanes Irma and Maria, including Federal efforts to obtain accurate accounting of the death toll, damage impacts, and long-term rebuilding assistance for survivors.</text>
 </paragraph></subsection></section><section id="H7282AE81DF15490EAC7E3507BD0741B3"><enum>3.</enum><header>Considerations</header><text display-inline="no-display-inline">To carry out its examination, the Commission shall take into consideration the Federal preparedness, response, and recovery efforts in Puerto Rico as compared to other jurisdictions that were impacted by the 2017 hurricane season, as well as the following issues:</text>
 <paragraph id="H82F66D43EA2F4C429C20E3D6E7649AFA"><enum>(1)</enum><text>The impact and destruction of Hurricane Irma, Hurricane Maria, the resulting landslides, and flooding.</text>
 </paragraph><paragraph id="HFC560CC80FF5414D8AE59F8955068208"><enum>(2)</enum><text>The adequacy of the death toll methodology and processes, and whether previous death counts and mortality estimates slowed or otherwise affected Federal response efforts.</text>
 </paragraph><paragraph id="H3EB6531826E74005844EC3C157980D94"><enum>(3)</enum><text>The Federal emergency and contingency plans in place before the 2017 hurricane season.</text> </paragraph><paragraph id="HF87C4CDFF15B48348C8E0A94C86F58B5"><enum>(4)</enum><text>The Federal preparedness guidelines issued ahead of the 2017 hurricane season.</text>
 </paragraph><paragraph id="HCFE345F921F24C40AA94DDD3450CA217"><enum>(5)</enum><text>The vulnerability of Puerto Rico’s economic situation on Federal preparedness.</text> </paragraph><paragraph id="H9BA95848F3084FA7822CEEDC448DAAE7"><enum>(6)</enum><text>The implications of Puerto Rico’s reliance on imported oil for power generation.</text>
 </paragraph><paragraph id="HFBB17E697A3D41DA9FCD197F562C817D"><enum>(7)</enum><text>The adequacy of the telecommunications network in Puerto Rico.</text> </paragraph><paragraph id="H46C9A8717ECB4C469D33B88CD1BE98FD"><enum>(8)</enum><text>The capacity of the local government and Federal Government to quickly mobilize and respond to disasters and emergencies in Puerto Rico.</text>
 </paragraph><paragraph id="H108FE07E83804669B780CEA44A315CFD"><enum>(9)</enum><text>The impact of the uncertainty in long-term Federal health care funding on medical and emergency readiness.</text>
 </paragraph><paragraph id="H6C7C9E8F5DFA409F8FC7A01C754B24BD"><enum>(10)</enum><text>The implication of Puerto Rico’s treatment under the Internal Revenue Code of 1986 and its impact on readiness.</text>
 </paragraph><paragraph id="H2B64CEA5EFE14095B3F1EE2BF8DF601E"><enum>(11)</enum><text>The adequacy of available data and its effects on the Federal response.</text> </paragraph><paragraph id="HF41BA06E66CE4CB08847D260BD868A14"><enum>(12)</enum><text>The geographic, ecological, and infrastructure issues that could have affected response efforts.</text>
 </paragraph><paragraph id="H91D6763D5A324CE98EA5478F57580075"><enum>(13)</enum><text>A comparison of response efforts in other United States jurisdictions vis-a-vis efforts in Puerto Rico for the 2017 hurricane season.</text>
			</paragraph></section><section id="H5E78871347B34886A869DE65AA05DD76"><enum>4.</enum><header>Composition and compensation of Commission</header>
 <subsection id="HE2B5C40F981F4B44B1431B4FF581BCFB"><enum>(a)</enum><header>Members</header><text>The Commission shall be composed of 8 members, of whom two shall be appointed by the Speaker of the House of Representatives, two shall be appointed by the Majority Leader of the Senate, two shall be appointed by the Minority Leader of the House of Representatives, and two shall be appointed by the Minority Leader of the Senate.</text>
 </subsection><subsection id="H4F327641C5AE44C78FE1D47354A8AEA1"><enum>(b)</enum><header>Chair and Vice Chair</header><text>The Commission, by majority vote, shall choose a Chair and Vice Chair.</text> </subsection><subsection id="HF058DD4ADACD48E297AD3A2302A94507"><enum>(c)</enum><header>Qualifications and restrictions</header> <paragraph id="H75CB33E4EE0446A3854924EF025380FC"><enum>(1)</enum><header>In general</header><text>Individuals shall be selected for appointment on the Commission solely on the basis of their professional qualifications, experience, and expertise in relevant fields, including disaster response and emergency preparedness.</text>
 </paragraph><paragraph id="H43A5BE92CEDB4535BFDAD5AB4FECA92E"><enum>(2)</enum><header>Restrictions</header><text>Individuals may not be an officer or employee of the Federal Government or any State, or a current elected official of the local government.</text>
				</paragraph></subsection><subsection id="H916015B41643420BBE6894D0A83314B4"><enum>(d)</enum><header>Appointment</header>
 <paragraph id="H8F79FA22E5A844E097A68E9EF934548B"><enum>(1)</enum><header>In general</header><text>All members of the Commission shall be appointed not later than 30 days after the date of the enactment of this Act.</text>
 </paragraph><paragraph id="H4A3788BC35C347F6A618650D5C018E5A"><enum>(2)</enum><header>Presidential authority</header><text>The President shall have no authority to terminate the appointment of any member of the commission.</text> </paragraph></subsection><subsection id="H1D39A709556F471A8E8C4F100688BB67"><enum>(e)</enum><header>Vacancies</header><text>Any vacancy in the Commission shall not affect its powers, but shall be filled in the same manner in which the original appointment was made not later than 60 days after the date on which the vacancy occurs.</text>
			</subsection><subsection id="HA96CDA7BDF82481FB47409D980A681AC"><enum>(f)</enum><header>Compensation</header>
 <paragraph id="H68FC0D2D68D74DB2A22974BD1CE6B06E"><enum>(1)</enum><header>In general</header><text>Members of the Commission may be compensated for travel expenses necessary to conduct the work and services for the Commission.</text>
 </paragraph><paragraph id="H022E2804FC0A4C39A8A14563ED341D29"><enum>(2)</enum><header>Travel expenditures</header><text>Members shall be allowed travel expenditures, including per diem in lieu of subsistence, in the same manner as persons employed intermittently in the Government service are allowed expenses under section 5703 of title 5, United States Code.</text>
				</paragraph></subsection><subsection id="HB1C3ACAD31E24BF2B83E9D377111498C"><enum>(g)</enum><header>Staff</header>
 <paragraph id="H8D25ABFF0DEC49CA8FB4F568DBA1DFA9"><enum>(1)</enum><header>In general</header><text>With a majority vote of the Commission, members may recruit personnel to assist with the Commission’s work, including the creation of the report.</text>
 </paragraph><paragraph id="H201A675486E841288AE3EE1A71A51D82"><enum>(2)</enum><header>Personnel</header><text>Any such personnel may include private citizens, employees or detailees of the Federal Government, or employees of the territorial government.</text>
				</paragraph></subsection></section><section id="HFAE43E4B58404A52872955C884F86C42"><enum>5.</enum><header>Functions and powers of the Commission</header>
			<subsection id="H9FF1F2DE08C04D5F9B1585B4170761AD"><enum>(a)</enum><header>Quorum</header>
 <paragraph id="HADB3D710CA6F4328AFC46E232726A1CD"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date on which all members of the Commission have been appointed, the Commission shall meet and begin the operations of the Commission.</text>
 </paragraph><paragraph id="H09CFD306F3944E7B8A76FB07C0DF0BC5"><enum>(2)</enum><header>Subsequent meetings</header><text>Each subsequent meeting shall occur upon the call of the Chair or a majority of its members.</text> </paragraph><paragraph id="H39903058F7274CFC93E8F15B431876DA"><enum>(3)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum, but a lesser number may hold meetings.</text>
 </paragraph></subsection><subsection id="H6E6445BE63344A688C3D3C118B93BC0D"><enum>(b)</enum><header>Public meetings</header><text>The Commission shall host not less than 10 public meetings in locations that are accessible to individuals of every municipality with elected officials, local community leaders, academic institutions, for-profit and non-for-profit organizations, and individuals in Puerto Rico to the extent appropriate.</text>
 </subsection><subsection id="H0BBA26B5AED349398A068F2A79F26F64"><enum>(c)</enum><header>Written input</header><text>The Commission shall allow participants both in Puerto Rico and the mainland to provide written input to be included in an appendix of the final report.</text>
			</subsection><subsection id="H13BAA2002D5A4CE2AE061DD3A80033FB"><enum>(d)</enum><header>Hearings</header>
 <paragraph id="HCADC2C75D26E4FB0A7ABC677F917C68D"><enum>(1)</enum><header>In general</header><text>The Commission may hold hearings, take testimony, and receive evidence for its investigation.</text> </paragraph><paragraph id="H5B457C230CC8425395103BB97DD23FBC"><enum>(2)</enum><header>Protection of information</header><text>Any public hearings of the Commission shall be conducted in a manner consistent with the protection of information provided to or developed for or by the Commission as required by any applicable statute, regulation, or Executive order.</text>
 </paragraph></subsection><subsection id="HC0D191E3255942C1A03A1D6673B93EC6"><enum>(e)</enum><header>Subpoenas</header><text>The Commission may issue subpoenas requiring the attendance and testimony of witnesses, and requiring the submission of data, books, records, correspondence, memoranda, papers, documents, electronic files, metadata, tapes, and materials of any nature relating to any matter under investigation.</text>
 </subsection><subsection id="H41668C0CA0DA4266AF7A4B156DF10189"><enum>(f)</enum><header>Information from agencies</header><text>The Commission may secure directly from any executive department, bureau, agency, board, commission, office, independent establishment, or instrumentality of the Government, information, suggestions, estimates, and statistics.</text>
 </subsection><subsection id="HC6461B319C2D422F834DA189DFCB3B52"><enum>(g)</enum><header>GSA services</header><text>The Administrator of General Services shall provide to the Commission on a reimbursable basis administrative support and other services for the performance of the Commission’s functions.</text>
 </subsection><subsection id="HCE22959D967E4051A708357A033ABE35"><enum>(h)</enum><header>Federal assistance from other agencies</header><text>Departments and agencies of the United States may provide to the Commission such services, funds, facilities, staff, and other support services as they may determine advisable and as may be authorized by law.</text>
 </subsection><subsection id="H9D51B4F8A8F24283B73FD70C178E6F3C"><enum>(i)</enum><header>Postal services</header><text>The Commission may use the United States mails in the same manner and under the same conditions as other departments and agencies of the United States.</text>
			</subsection></section><section id="HC4BD200C7BA94D81924C58C16FC9A1BD"><enum>6.</enum><header>Reports of Commission</header>
 <subsection id="H01D851B8DE024DF5B6D61A572DB30586"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 12 months after the date of the enactment of this Act, the Commission shall submit to the President and Congress a final report on the causes and circumstances surrounding the natural disasters in Puerto Rico, including preparedness and immediate response, and providing recommendations to guard against future natural disasters outside of the continental United States, which shall contain findings, conclusions, and recommendations as have been agreed to by a majority of Commission members and shall—</text>
 <paragraph id="H5B7B744705034ECA94A76C5309E9629B"><enum>(1)</enum><text display-inline="yes-display-inline">be made available to the public in the English and Spanish languages;</text> </paragraph><paragraph id="HF5ACE66F8A1640F6ADAA2A6497DF8F07"><enum>(2)</enum><text display-inline="yes-display-inline">include findings for the issues described in section 2; and</text>
 </paragraph><paragraph id="H9B270ABE40554E5CA78AD7C09AFA49B7"><enum>(3)</enum><text>include—</text> <subparagraph display-inline="no-display-inline" id="H240B66655F204C2B87804B12F3447058"><enum>(A)</enum><text>the number and nature of complaints filed to the Inspectors General for Federal agencies responsible in the aftermath of the 2017 natural disasters;</text>
 </subparagraph><subparagraph id="HCE2D663411214A148B5551224B7F5119"><enum>(B)</enum><text>details on Federal procurement and acquisition practices in the aftermath of the 2017 natural disasters;</text>
 </subparagraph><subparagraph id="H0F86664A06BA4189888B00E1026FE41B"><enum>(C)</enum><text>details on disaster mitigation protocols given cultural and language differences; and</text> </subparagraph><subparagraph id="HB1BC37EBC0984B44AE07723514F1475C"><enum>(D)</enum><text>disaster response processes taking into account demographics (age, race, gender, income) and the impact on segments of the population with disabilities.</text>
 </subparagraph></paragraph></subsection><subsection id="H966331242E3A483193296D21DD49D376"><enum>(b)</enum><header>Appendix</header><text display-inline="yes-display-inline">An appendix to the final report shall include written input of participants in Puerto Rico and the mainland.</text>
 </subsection><subsection id="H4AB1F357CA5449949E267372F3D2A87B"><enum>(c)</enum><header>Interim report</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, the Commission shall provide to Congress an interim report.</text>
 </subsection></section><section id="HAE0C5819F0EA4F9A8B28DD26003751BE"><enum>7.</enum><header>Sunset</header><text display-inline="no-display-inline">The Commission shall terminate on the day that is 90 days after the date on which the final report is submitted.</text>
 </section><section id="H9A01A0037CCC40CAB2FE87C513D4535E"><enum>8.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated $3,000,000 to carry out this Act, to remain available until expended.</text></section></legis-body></bill>
