			 appropriate to address missing and murdered Indians, and for other
			 purposes.</official-title></form>

 <section commented="no" display-inline="no-display-inline" id="ida9133725-596c-4656-ab00-9eee47b3951d" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Savanna’s Act</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="id91ce1416-1157-4efb-9c69-d258c3264aa8" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings and purposes</header> <subsection commented="no" display-inline="no-display-inline" id="iddbcef1c4-c48d-478f-b70b-25c0d0813099"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id35b39378-09b5-408c-b9a6-90cb12c0c0a9"><enum>(1)</enum><text display-inline="yes-display-inline">On some reservations, Indian women are murdered at more than 10 times the national average.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id74d07ba0-a953-429a-b69c-9b9a6f679a49"><enum>(2)</enum><text display-inline="yes-display-inline">American Indians and Alaska Natives are 2.5 times as likely to experience violent crimes—and at least 2 times more likely to experience rape or sexual assault crimes—compared to all other races according to the National Congress of American Indians.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide994def7-7b77-446a-b37d-7ee0c64a1f87"><enum>(3)</enum><text display-inline="yes-display-inline">More than 4 in 5 American Indian and Alaska Native women, or 84.3 percent, have experienced violence in their lifetime according to the National Institute of Justice.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4411040a193d409ebedbfdbeede6cd1b"><enum>(4)</enum><text display-inline="yes-display-inline">More than 4 in 5 American Indian and Alaska Native men, or 81.6 percent, have experienced violence in their lifetime according to the National Institute of Justice.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4b0a6db7-2c4a-4748-8a54-314c66d9211b"><enum>(5)</enum><text display-inline="yes-display-inline">According to the Centers for Disease Control and Prevention, homicide is the third leading cause of death among American Indian and Alaska Native women between 10 and 24 years of age and the fifth leading cause of death for American Indian and Alaska Native women between 25 and 34 years of age.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9cc2b0a3-145a-4f3f-8cff-04ae110e0870"><enum>(6)</enum><text display-inline="yes-display-inline">Investigation into cases of missing and murdered Indian women is made difficult for Tribal law enforcement agencies due to a lack of resources, such as—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id44166d4b-d85c-442f-8de1-d306ebfc0ab1"><enum>(A)</enum><text display-inline="yes-display-inline">necessary training, equipment, or funding;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id497161ea-c2d0-44bb-841a-27bd78e41d3f"><enum>(B)</enum><text display-inline="yes-display-inline">a lack of interagency cooperation; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida00ba440-1bc9-4386-82ab-9026c00dfca7"><enum>(C)</enum><text display-inline="yes-display-inline">a lack of appropriate laws in place.</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc2bacd17-e886-4c3f-b0a0-84ee2355e799"><enum>(7)</enum><text display-inline="yes-display-inline">The complicated jurisdictional scheme that exists in Indian country—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id5a471910-b2e5-4835-b0af-b871ca8fc8fe"><enum>(A)</enum><text display-inline="yes-display-inline">has a significant negative impact on the ability to provide public safety to Indian communities;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0ce4ee4d-f1a5-4343-9e09-21d13bc9ea8f"><enum>(B)</enum><text display-inline="yes-display-inline">has been increasingly exploited by criminals; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id59657ea2-bb36-4ca9-b54e-b35e72fee074"><enum>(C)</enum><text display-inline="yes-display-inline">requires a high degree of commitment and cooperation among Tribal, Federal, and State law enforcement officials.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idae42bc00-537b-4863-8120-8865fe538db7"><enum>(b)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are—</text> <paragraph commented="no" display-inline="no-display-inline" id="id37a87205-2ed7-4bec-badb-d8c67e7fb020"><enum>(1)</enum><text display-inline="yes-display-inline">to clarify the responsibilities of Federal, State, Tribal, and local law enforcement agencies with respect to responding to cases of missing and murdered Indians;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id108c6210-c329-47b9-b2c2-98240f66b3ab"><enum>(2)</enum><text display-inline="yes-display-inline">to increase coordination and communication among Federal, State, Tribal, and local law enforcement agencies, including medical examiner and coroner offices;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3fce27b1-f0b4-4b46-b0ce-8e42b92b5c06"><enum>(3)</enum><text display-inline="yes-display-inline">to empower Tribal governments with the resources and information necessary to effectively respond to cases of missing and murdered Indians; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0551df0e-4d04-4051-a0a4-9371fb0e87a9"><enum>(4)</enum><text display-inline="yes-display-inline">to increase the collection of data related to missing and murdered Indian men and women and the sharing of information among Federal, State, and Tribal officials responsible for responding to and investigating cases of missing and murdered Indians.</text>
 </paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id3bc105a2-04ee-4b25-aa2e-d5c864af239b" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph commented="no" display-inline="no-display-inline" id="id2c53ea9f-0663-42e7-9018-fd5ecf94215b"><enum>(1)</enum><header display-inline="yes-display-inline">Databases</header><text display-inline="yes-display-inline">The term <term>databases</term> means—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idde2fd01e-726a-455c-a393-d84b29abab3c"><enum>(A)</enum><text display-inline="yes-display-inline">the National Crime Information Center database;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4dbb82e9-ed6d-4d86-9aa6-caf54afd0b6e"><enum>(B)</enum><text display-inline="yes-display-inline">the Combined DNA Index System;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1e1fa2fd-a46a-48be-a404-77a632afd122"><enum>(C)</enum><text display-inline="yes-display-inline">the Next Generation Identification System; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id90c77739-784b-4e8f-ac26-939579cda552"><enum>(D)</enum><text display-inline="yes-display-inline">any other database relevant to responding to cases of missing and murdered Indians, including that under the Violent Criminal Apprehension Program and the National Missing and Unidentified Persons System.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaab767ef-6328-4e2e-becf-abef1a0e70a3"><enum>(2)</enum><header display-inline="yes-display-inline">Indian</header><text display-inline="yes-display-inline">The term <term>Indian</term> means a member of an Indian Tribe.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbc8e0975-ca8c-4469-ab84-96a0823d0993"><enum>(3)</enum><header display-inline="yes-display-inline">Indian country</header><text display-inline="yes-display-inline">The term <term>Indian country</term> has the meaning given the term in section 1151 of title 18, United States Code.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8869A0633D724E0ABAF827BB3405C9C5"><enum>(4)</enum><header display-inline="yes-display-inline">Indian land</header><text display-inline="yes-display-inline">The term <term>Indian land</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id5FF8581DDCCD4C008346719CE9BF2D12"><enum>(A)</enum><text display-inline="yes-display-inline">Indian lands, as defined in section 3 of the Native American Business Development, Trade Promotion, and Tourism Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4302">25 U.S.C. 4302</external-xref>); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB43E2B35D71345689A57C1319504A7F7"><enum>(B)</enum><text display-inline="yes-display-inline">land owned by a Regional Corporation or Village Corporation, as such terms are defined in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>).</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id49483930-ccb1-4904-8c61-f66df58762f5"><enum>(5)</enum><header display-inline="yes-display-inline">Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term> in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id05ddfc25-7ef7-45fc-80a2-26f183a102d5"><enum>(6)</enum><header display-inline="yes-display-inline">Law enforcement agency</header><text display-inline="yes-display-inline">The term <term>law enforcement agency</term> means a Tribal, Federal, State, or local law enforcement agency.</text> </paragraph></section><section commented="no" display-inline="no-display-inline" id="id77e535c9-600c-4345-8056-f4fef861fe86" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Improving Tribal access to databases</header> <subsection commented="no" display-inline="no-display-inline" id="idf5fef115-193b-46fb-82ca-8aa37293278e"><enum>(a)</enum><header display-inline="yes-display-inline">Tribal enrollment information</header><text display-inline="yes-display-inline">The Attorney General shall provide training to law enforcement agencies regarding how to record the Tribal enrollment information or affiliation, as appropriate, of a victim in Federal databases.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id191b9922-d9c5-43f3-aad9-3f3eceaf0831"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation</header>
 <paragraph commented="no" display-inline="no-display-inline" id="iddcb433ba-9d4f-450b-b64a-4cd1e00248ea"><enum>(1)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Attorney General, in cooperation with the Secretary of the Interior, shall complete a formal consultation with Indian Tribes on how to further improve Tribal data relevance and access to databases.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2dec5fe5-6c0f-4af7-be69-002485883215"><enum>(2)</enum><header display-inline="yes-display-inline">Annual consultation</header><text display-inline="yes-display-inline">Section 903(b) of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/34/20126">34 U.S.C. 20126</external-xref>) is amended—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id659970e0-87e9-4df5-86c7-579cf0c921af"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id4d312590-c326-4b81-880f-d43a58c5729d" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="id009868ae-794e-4bba-95af-7e7bc9049f7d"><enum>(2)</enum><text display-inline="yes-display-inline">enhancing the safety of Indian women from domestic violence, dating violence, sexual assault, homicide, stalking, and sex trafficking;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc0911060-5180-4274-96f8-03c841f1b037"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id709984a2-4dc7-48e4-b598-a5b07edb6887"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id09757ed8-716b-4045-abf6-f655e1025253" style="OLC">
 <paragraph commented="no" display-inline="no-display-inline" id="id56d89e1d-320c-4f49-8eb0-0a5216833f63"><enum>(4)</enum><text display-inline="yes-display-inline">improving access to local, regional, State, and Federal crime information databases and criminal justice information systems.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3ad55c33ed1e4be296f891732e9f27f9"><enum>(c)</enum><header display-inline="yes-display-inline">Notification</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Attorney General shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="idDDF9B31A69804945ADE590507D1238C4"><enum>(1)</enum><text display-inline="yes-display-inline">develop and implement a dissemination strategy to notify United States citizens of the National Missing and Unidentified Persons System; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60b5a61a0a3741bab8370863e8260bf6"><enum>(2)</enum><text display-inline="yes-display-inline">conduct specific outreach to Indian Tribes regarding the ability to publicly enter information, through the National Missing and Unidentified Persons System or other non-law enforcement sensitive portal, regarding missing persons, which may include family members and other known acquaintances.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id52a209c3-a91d-4b79-9a18-29cc23b58af9" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Guidelines for responding to cases of missing and murdered Indians</header>
 <subsection commented="no" display-inline="no-display-inline" id="id327425fa963641a6b9a84377c7d69306"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the consultation described in section 4(b)(1) is completed, the Attorney General shall direct United States attorneys with jurisdiction to prosecute crimes in Indian country under sections 1152 and 1153 of title 18, United States Code, or any other provision of law, as part of the annual consultations on sexual violence by United States attorneys with Indian Tribes and Federal partners, to develop guidelines to respond to cases of missing and murdered Indians that shall include—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id6ed48323466841f4ae2097b6df301530"><enum>(1)</enum><text display-inline="yes-display-inline">guidelines on inter-jurisdictional cooperation among law enforcement agencies at the Tribal, Federal, State, and local levels, including inter-jurisdictional enforcement of protection orders and detailing specific responsibilities of each law enforcement agency;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA0658AF41D6D4EE4859F2B3C680E8306"><enum>(2)</enum><text display-inline="yes-display-inline">best practices in conducting searches for missing persons on Indian land;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id837f0a23699d4239bb4e95dc509c2074"><enum>(3)</enum><text display-inline="yes-display-inline">standards on the collection, reporting, and analysis of data and information on missing persons and unidentified human remains, and information on culturally appropriate identification and handling of human remains identified as Indian, including guidance stating that all appropriate information related to missing and murdered Indians be entered in a timely manner into applicable databases;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0f586631174c4ba2be11dbcd4bcd91a9"><enum>(4)</enum><text display-inline="yes-display-inline">guidance on which law enforcement agency is responsible for inputting information into appropriate databases under paragraph (3) if the Tribal law enforcement agency does not have access to those appropriate databases;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id318f1f2f61ae402580dc84c5fae6dbd8"><enum>(5)</enum><text display-inline="yes-display-inline">guidelines on improving law enforcement agency response rates and follow-up responses to cases of missing and murdered Indians; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd7189c0b15604573ac9742cfbe83dee3"><enum>(6)</enum><text display-inline="yes-display-inline">guidelines on ensuring access to culturally appropriate victim services for victims and their families.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3d634a84e72e496d8e0c36d305b92c2d"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">United States attorneys shall develop the guidelines required under subsection (a) in consultation with Indian Tribes and other Federal partners, including—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id43eb98d3648e4bbcbeb1c7c7890f2f08"><enum>(1)</enum><text display-inline="yes-display-inline">the Department of Justice;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd5d9474ba80e4c7493224571df4b89af"><enum>(2)</enum><text display-inline="yes-display-inline">the Federal Bureau of Investigation;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idab5b05646c7140d6a3df99c850e9c6b7"><enum>(3)</enum><text display-inline="yes-display-inline">the Bureau of Indian Affairs;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCA48CA8662074182A2764A58CC6A5A1C"><enum>(4)</enum><text display-inline="yes-display-inline">Tribal, State, and local law enforcement agencies;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF0D42E0362724203909AFF4BE53EDF41"><enum>(5)</enum><text display-inline="yes-display-inline">medical examiners;</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDE94224338DE42ADB3F28ECB308A0238"><enum>(6)</enum><text display-inline="yes-display-inline">coroners; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF545EEE31B94420CB5A6A8F635B38A25"><enum>(7)</enum><text display-inline="yes-display-inline">Tribal, State, and local organizations that provide victim services.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7d3fcf81dc6946569090029a9b20ed12"><enum>(c)</enum><header display-inline="yes-display-inline">Compliance</header> <paragraph commented="no" display-inline="no-display-inline" id="idFB31E38648B84A3F998A23311F93E4F0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 60 days after the next sexual violence response annual consultation occurs in each region after the date of enactment of this Act, the United States attorneys shall modify the sexual violence response guidelines to incorporate the guidelines developed under subsection (a) and implement such modified guidelines.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfbd9569aa71647dbb3c6247495fa0c7f"><enum>(2)</enum><header display-inline="yes-display-inline">Modification</header><text display-inline="yes-display-inline">Each Federal law enforcement agency shall modify the guidelines, policies, and protocols of the agency to incorporate the guidelines developed under subsection (a).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida51cd65588b747a6971fb2a74c4ba4c8"><enum>(3)</enum><header display-inline="yes-display-inline">Determination</header><text display-inline="yes-display-inline">Not later than the end of each fiscal year beginning after the date the guidelines are established under this section and incorporated under this subsection, the Attorney General shall determine whether each Tribal, State, and local law enforcement agency has incorporated guidelines into their respective guidelines, policies, and protocols.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id344b3ecba6cb41eb85302017041e67e9"><enum>(4)</enum><header display-inline="yes-display-inline">Preference</header><text display-inline="yes-display-inline">For each of fiscal years 2019 through 2023, for the fiscal year in which a grant was solicited, the Attorney General shall give affirmative preference to all National Institute of Justice and Office for Victims of Crime discretionary grant applications of a Tribal, State, or local law enforcement agency, or applications submitted on behalf of such law enforcement agencies by a local, State, or Tribal government, if the Attorney General has determined under paragraph (3) that the agency has incorporated the guidelines.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id763188d84d00489a813fc89a1bba6949"><enum>(d)</enum><header display-inline="yes-display-inline">Accountability</header><text display-inline="yes-display-inline">Not later than 30 days after compliance determinations are made each fiscal year in accordance with subsection (c)(3), the Attorney General shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="ide54dc78776d24358bde931cf737ea7b0"><enum>(1)</enum><text display-inline="yes-display-inline">disclose and publish, including on the website of the Department of Justice, the name of each Tribal, State, or local law enforcement agency that the Attorney General has determined has not incorporated guidelines in accordance with subsection (c)(3); and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8af664933c514d60ad5d41994e1fafd2"><enum>(2)</enum><text display-inline="yes-display-inline">if a law enforcement agency described in paragraph (1) subsequently receives a determination of compliance, the Attorney General shall—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id2ccc21a6be1348ab9b1a8016bbab3850"><enum>(A)</enum><text display-inline="yes-display-inline">immediately correct the applicable record; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id368c45f3ff1546e7bec49ac914c77d81"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 3 days after the determination, remove the record from the website of the Department of Justice and any other location where the record was published.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id20230f56f6d24e569c69b9714ba3324f"><enum>(e)</enum><header display-inline="yes-display-inline">Training and technical assistance</header><text display-inline="yes-display-inline">The Attorney General shall use the National Indian Country Training Initiative to provide training and technical assistance to Indian Tribes and law enforcement agencies on—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="idadeb12969dfb42a3ad420e6cdd35db62"><enum>(1)</enum><text display-inline="yes-display-inline">implementing the guidelines developed under subsection (a) or developing and implementing locally specific guidelines or protocols for responding to cases of missing and murdered Indians; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9dd99598f102434cba4e092122bafa18"><enum>(2)</enum><text display-inline="yes-display-inline">using the National Missing and Unidentified Persons System and accessing program services that will assist Indian Tribes with responding to cases of missing and murdered Indians.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id306e347f0c714f6e8b6ecbd9487e6cb5" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Annual reporting requirements</header>
 <subsection commented="no" display-inline="no-display-inline" id="id542ca07374394cffaf392b1a38291c4e"><enum>(a)</enum><header display-inline="yes-display-inline">Annual reporting</header><text display-inline="yes-display-inline">Beginning in the first fiscal year after the date of enactment of this Act, the Attorney General shall include in its annual Indian Country Investigations and Prosecutions report to Congress information that—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="ideb8a6328260049d7bd4563173a6822d7"><enum>(1)</enum><text display-inline="yes-display-inline">includes known statistics on missing Indians in the United States, available to the Department of Justice, including—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="ide6bd06aa5f724c54bd42f6f4b37ad6ef"><enum>(A)</enum><text display-inline="yes-display-inline">age;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2bba7256b9494367bdfd0956b208ce99"><enum>(B)</enum><text display-inline="yes-display-inline">gender;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7a5cabb1186248fd979712a7f899952a"><enum>(C)</enum><text display-inline="yes-display-inline">Tribal enrollment information or affiliation, if available;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf6c62c2b4be44798bd901e0728074f9e"><enum>(D)</enum><text display-inline="yes-display-inline">the current number of open cases per State;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb151df6e9a4a42c7bf9fcb0a0046f475"><enum>(E)</enum><text display-inline="yes-display-inline">the total number of closed cases per State each calendar year, from the most recent 10 calendar years; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7a869b6b9a5449f89aaefec6e43771d8"><enum>(F)</enum><text display-inline="yes-display-inline">other relevant information the Attorney General determines is appropriate;</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id08f2da96c1b7476c81315030816b6b82"><enum>(2)</enum><text display-inline="yes-display-inline">includes known statistics on murdered Indians in the United States, available to the Department of Justice, including—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idfa6ec8d68773433bb4cc409b3a327126"><enum>(A)</enum><text display-inline="yes-display-inline">age;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf102f6d6ae794d60ae146578392e5eb2"><enum>(B)</enum><text display-inline="yes-display-inline">gender;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3259473fffad4eacbfa1aaec8e31049b"><enum>(C)</enum><text display-inline="yes-display-inline">Tribal enrollment information or affiliation, if available;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id33971d47682c41a2ad4f10235fc868af"><enum>(D)</enum><text display-inline="yes-display-inline">the current number of open cases per State;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id72304c40b3ad4442aef3023ed770b0e3"><enum>(E)</enum><text display-inline="yes-display-inline">the total number of closed cases per State each calendar year, from the most recent 10 calendar years; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb66a13a051c9487baccb9ce526c817d3"><enum>(F)</enum><text display-inline="yes-display-inline">other relevant information the Attorney General determines is appropriate;</text> </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id330bfc6fb46d40f3a9e9d2a9f10f1cdc"><enum>(3)</enum><text display-inline="yes-display-inline">maintains victim privacy to the greatest extent possible by excluding information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd33f2a2aa61c47199af1d7d9661938f1"><enum>(4)</enum><text display-inline="yes-display-inline">includes—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id340411F6DF024374874BF2EE19A903DD"><enum>(A)</enum><text display-inline="yes-display-inline">an explanation of why the statistics described in paragraph (1) may not be comprehensive; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC2A90823AA0446698C8C64A8637DBA47"><enum>(B)</enum><text display-inline="yes-display-inline">recommendations on how data collection on missing and murdered Indians may be improved.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7cf303022bd3431980f74c83540cb78d"><enum>(b)</enum><header display-inline="yes-display-inline">Compliance</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id02c79f520d974fbdb06d3b9e9898ab66"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning in the first fiscal year after the date of enactment of this Act, and annually thereafter, for the purpose of compiling accurate data for the annual report required under subsection (a), the Attorney General shall request all Tribal, State, and local law enforcement agencies to submit to the Department of Justice, to the fullest extent possible, all relevant information required, as determined by the Attorney General.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf16439d4d94e405fabf93aed14f0d8eb"><enum>(2)</enum><header display-inline="yes-display-inline">Disclosure</header><text display-inline="yes-display-inline">The Attorney General shall disclose and publish annually, including on the website of the Department of Justice, the name of each Tribal, State, or local law enforcement agency that the Attorney General has determined has not submitted the information requested under paragraph (1) for the fiscal year in which the report was published.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id802e74cf45c645ed9db5d1f65b0003e3"><enum>(3)</enum><header display-inline="yes-display-inline">Preference</header><text display-inline="yes-display-inline">For each of fiscal years 2019 through 2023, for the fiscal year in which a grant was solicited, the Attorney General shall give affirmative preference to all Department of Justice discretionary grant applications of a Tribal, State, or local law enforcement agency, or applications submitted on behalf of such law enforcement agencies by a local, State, or Tribal government, that would aid in the implementation of the guidelines developed under section 5 or help address the issue of missing and murdered Indians, if the Attorney General has determined the agency has submitted the information requested under paragraph (1) for the fiscal year in which the report was published.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida4ec22997a854738883150b372619c51"><enum>(c)</enum><header display-inline="yes-display-inline">Inclusion of gender in missing and unidentified persons statistics</header><text display-inline="yes-display-inline">Beginning in the first calendar year after the date of enactment of this Act, and annually thereafter, the Federal Bureau of Investigation shall include gender in its annual statistics on missing and unidentified persons published on its public website.</text></subsection></section></legis-body></bill>
