			 fees and other expenses to prevailing parties in certain administrative
			 proceedings and court cases to which the United States is a party, and for
			 other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H52D8A6ACE2A04E42848C0D5A1A9071EB" style="OLC">
 <section id="H609A8629A6DB4BEEA0E7C667911DC6EF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Open Book on Equal Access to Justice Act</short-title></quote>.</text> </section><section id="H44415E2D7E564287823F645037348E5A"><enum>2.</enum><header>Modification of equal access to justice provisions</header> <subsection id="HE3E84FE265234C80843FC4570C6AB89D"><enum>(a)</enum><header>Agency proceedings</header><text>Section 504 of title 5, United States Code, is amended—</text>
 <paragraph id="HAE07620E70374321A78FA93BA01CD73A"><enum>(1)</enum><text>in subsection (c)(1), by striking <quote>, United States Code</quote>;</text> </paragraph><paragraph id="H3F69DDFA50BD4507A3F63FD7CE992AC3"><enum>(2)</enum><text>by redesignating subsection (f) as subsection (h); and</text>
 </paragraph><paragraph id="H32A4CD5A2E854C36B9A61B4C23A28387"><enum>(3)</enum><text>by striking subsection (e) and inserting the following:</text> <quoted-block id="HE902036F8ABF4754A4AB1AFE743E8FD9" style="OLC"> <subsection id="H7FAF8A836CE04B08B1C94C3FC0F2F0B7"><enum>(e)</enum><text display-inline="yes-display-inline">The Chairman of the Administrative Conference of the United States shall create and maintain online a searchable database containing the following information with respect to each award of fees and other expenses under this section:</text>
 <paragraph id="H7836462045774BAD9702B681D56F6189"><enum>(1)</enum><text>The case name and number of the adversary adjudication, if available.</text> </paragraph><paragraph id="H1A904FAD209D493D9AF9C21BDAC9D9FD"><enum>(2)</enum><text>The name of the agency involved in the adversary adjudication.</text>
 </paragraph><paragraph id="HEFA30D4C58DA463D9785BCD9F05CBC50"><enum>(3)</enum><text>A description of the claims in the adversary adjudication.</text> </paragraph><paragraph id="H028D1576B6D3401386A8B27E134C125D"><enum>(4)</enum><text>The name of each party to whom the award was made, as such party is identified in the order or other agency document making the award.</text>
 </paragraph><paragraph id="H159921DF1E484C8C9933C2E7CB130F1D"><enum>(5)</enum><text>The amount of the award.</text> </paragraph><paragraph id="H0E1C8910BBF24A0594583EEF02A6F6B9"><enum>(6)</enum><text>The basis for the finding that the position of the agency concerned was not substantially justified.</text>
 </paragraph></subsection><subsection id="H04D38B132D5F4DF5BB0213D4835BBFE6"><enum>(f)</enum><text>The online searchable database described in subsection (f) may not reveal any information the disclosure of which is prohibited by law or court order.</text>
 </subsection><subsection id="H2F7121297BAA43499C4FACA5A1D9BD21"><enum>(g)</enum><text>The head of each agency shall provide to the Chairman of the Administrative Conference of the United States all information requested by the Chairman to comply with the requirements of subsections (e) and (f) not later than 60 days after the date on which the request is made.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H97F8A7CF4981491D9EF552F14F3A4244"><enum>(b)</enum><header>Court cases</header><text>Section 2412(d) of title 28, United States Code, is amended by adding at the end the following:</text> <quoted-block id="HCE4D191995E5451496760168042F4ADE" style="OLC"> <paragraph id="HA87FC4BF44D64952B1C3C9964D48D55C" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The Chairman of the Administrative Conference shall create and maintain online a searchable database containing the following information with respect to each award of fees and other expenses under this section:</text>
 <subparagraph id="HC3A6C9FA98064940A439DF1739D83B97"><enum>(A)</enum><text>The case name and number.</text> </subparagraph><subparagraph id="HFBDC545AFF114A74A515CC8ACE8884F0"><enum>(B)</enum><text>The name of the agency involved in the case.</text>
 </subparagraph><subparagraph id="H41FCC1B8DF3F4981AA1E8DD805F8181F"><enum>(C)</enum><text>The name of each party to whom the award was made, as such party is identified in the order or other court document making the award.</text>
 </subparagraph><subparagraph id="HD1A9357F35A943BF8D78F3F77969D01E"><enum>(D)</enum><text>A description of the claims in the case.</text> </subparagraph><subparagraph id="H11F089A097A34B54B91339D47B4748B2"><enum>(E)</enum><text>The amount of the award.</text>
 </subparagraph><subparagraph id="HB67C5A3D8F944E5DA251FC0AB39655E6"><enum>(F)</enum><text>The basis for the finding that the position of the agency concerned was not substantially justified.</text>
 </subparagraph></paragraph><paragraph id="H4AC91871899B4F1295DE7183305C01E5" indent="up1"><enum>(6)</enum><text>The online searchable database described in paragraph (5) may not reveal any information the disclosure of which is prohibited by law or court order.</text>
 </paragraph><paragraph id="HDD6AE82531A440B8BEAD5AB3C24A64ED" indent="up1"><enum>(7)</enum><text>The head of each agency (including the Attorney General of the United States) shall provide to the Chairman of the Administrative Conference of the United States all information requested by the Chairman to comply with the requirements of paragraphs (5) and (6) not later than 60 days after the date on which the request is made.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H4B4CBC745D434F909B59D0991BCD453E"><enum>(c)</enum><header>Clerical amendments</header><text>Section 2412 of title 28, United States Code, is amended—</text> <paragraph id="H7CB6E8B024A9489986A218E04D5D3FEE"><enum>(1)</enum><text>in subsection (d)(3), by striking <quote>United States Code,</quote>; and</text>
 </paragraph><paragraph id="H4A3500FE8D1F478BB62FC7D92305CE47"><enum>(2)</enum><text>in subsection (e)—</text> <subparagraph id="H90CA2DDAC8BB401E8213825003E87103"><enum>(A)</enum><text>by striking <quote>of section 2412 of title 28, United States Code,</quote> and inserting <quote>of this section</quote>; and</text>
 </subparagraph><subparagraph id="H3A0C111FE1604387AA0AE8682BA873B3"><enum>(B)</enum><text>by striking <quote>of such title</quote> and inserting <quote>of this title</quote>.</text> </subparagraph></paragraph></subsection><subsection id="HB8128908D56446CDA0D538AEDA98B744"><enum>(d)</enum><header>Effective date</header> <paragraph id="H003BF2F902B946C59DA816B223E610E1"><enum>(1)</enum><header>In general</header><text>The amendments made by subsections (a) and (b) shall first apply with respect to awards of fees and other expenses that are made on or after the date of the enactment of this Act.</text>
 </paragraph><paragraph id="H34EC316D40494ACEA33DFC5F117A0451"><enum>(2)</enum><header>Online databases</header><text>The online databases required by section 504(e) of title 5, United States Code, and section 2412(d)(5) of title 28, United States Code, shall be established as soon as practicable after the date of the enactment of this Act, but in no case later than 1 year after the date of enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
