			 the Leech Lake Band of Ojibwe.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
 <section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Leech Lake Band of Ojibwe Reservation Restoration Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id811457a45b8547659e660648b8655e08" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Leech Lake Band of Ojibwe reservation restoration</header>
 <subsection commented="no" display-inline="no-display-inline" id="id2A2D70C8935146D59B6C0D2C03705210"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds that—</text> <paragraph commented="no" display-inline="no-display-inline" id="id44758C10069049608190CEA1C2E2C8FC"><enum>(1)</enum><text display-inline="yes-display-inline">the Federal land described in subsection (b)(1) was taken from members of the Leech Lake Band of Ojibwe during a period—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id83A184C99AC64A2494ED3BBB062F852D"><enum>(A)</enum><text display-inline="yes-display-inline">beginning in 1948;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0142FD5BC34D40E3A00AA495BDCBFE3C"><enum>(B)</enum><text display-inline="yes-display-inline">during which the Bureau of Indian Affairs incorrectly interpreted an order of the Secretary of the Interior to mean that the Department of the Interior had the authority to sell tribal allotments without the consent of a majority of the rightful landowners; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id721A50D6B46E458BBE360E7B7712DFF5"><enum>(C)</enum><text display-inline="yes-display-inline">ending in 1959, when the Secretary of the Interior was—</text> <clause commented="no" display-inline="no-display-inline" id="idDE5DC1457F68488E82C4B798C82D589C"><enum>(i)</enum><text display-inline="yes-display-inline">advised that sales described in subparagraph (B) were illegal; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id7AFC102BE60D4E6B92B1203E41F9EA75"><enum>(ii)</enum><text display-inline="yes-display-inline">ordered to cease conducting those sales;</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0001601C4C8841B9ABA6AF7B870D3BDA"><enum>(2)</enum><text display-inline="yes-display-inline">as a result of the Federal land described in subsection (b)(1) being taken from members of the Leech Lake Band of Ojibwe, the Leech Lake Band of Ojibwe hold the smallest percentage of its original reservation lands of any Ojibwe bands in Minnesota;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBCBFE9BA12144BEEA3138BB52A8F9FE7"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idC51946AC4F3D4F61B81495D4C2F106D9"><enum>(A)</enum><text display-inline="yes-display-inline">the applicable statute of limitations prohibits individuals from pursuing through litigation the return of the land taken as described in paragraph (1); but</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE37760BFF49F433EB004378F7B23760A" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">a Federal judge ruled that the land could be restored to the affected individuals through the legislative process;</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd02d9f40e0df4072881191a2ce376c6b"><enum>(4)</enum><text display-inline="yes-display-inline">a comprehensive review of the Federal land demonstrated that—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idF7E18F4E6B1C40C5AB4AA4C981E14776"><enum>(A)</enum><text display-inline="yes-display-inline">a portion of the Federal land is encumbered by—</text>
 <clause commented="no" display-inline="no-display-inline" id="id93030B666AA8413E882AAA18E9780DDB"><enum>(i)</enum><text display-inline="yes-display-inline">utility easements;</text> </clause><clause commented="no" display-inline="no-display-inline" id="id6B510240EA3C4C12AB0DA2B7207CDDBD"><enum>(ii)</enum><text display-inline="yes-display-inline">rights-of-way for roads; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idFBEEC1D1EB4D4516A558A9E0FD6F02A8"><enum>(iii)</enum><text display-inline="yes-display-inline">flowage and reservoir rights; and</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9EF308E5D026453CB2F5545EFA1F2C38"><enum>(B)</enum><text display-inline="yes-display-inline">there are no known cabins, campgrounds, lodges, or resorts located on any portion of the Federal land; and</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA1F416CB14614F608B92F45D85E9390F"><enum>(5)</enum><text display-inline="yes-display-inline">on reacquisition by the Tribe of the Federal land, the Tribe—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idC608C11AC6034A4A93C8C4BB89C12B04"><enum>(A)</enum><text display-inline="yes-display-inline">has pledged to respect the easements, rights-of-way, and other rights described in paragraph (4)(A); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB904C15451804BB1A90920B9DAAA8C59"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id33D5CCD5B71D4B0487D0888975BA5938"><enum>(i)</enum><text display-inline="yes-display-inline">does not intend immediately to modify the use of the Federal land; but</text> </clause><clause commented="no" display-inline="no-display-inline" id="idEEC7F04ECFFF40B7B4B98012E413362B" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">will keep the Federal land in tax-exempt fee status as part of the Chippewa National Forest until the Tribe develops a plan that allows for a gradual subdivision of some tracts for economic and residential development by the Tribe.</text>
 </clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6E94D52E8006441498C08F984C960C7D"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="idfe9b80b504e84ad09a5af551d457809b"><enum>(1)</enum><header display-inline="yes-display-inline">Federal land</header> <subparagraph commented="no" display-inline="no-display-inline" id="id6F79313A9AD142B2B654B25725390043"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>Federal land</term> means the approximately 11,760 acres of Federal land located in the Chippewa National Forest in Cass County, Minnesota, the boundaries of which shall be depicted on the map, and described in the legal description, submitted under subsection (d)(1)(B).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2A45554F66934680B44472DA2E29D319"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <term>Federal land</term> includes—</text> <clause commented="no" display-inline="no-display-inline" id="id94AF1D5EC18948E1A8AB75FF6608504B"><enum>(i)</enum><text display-inline="yes-display-inline">any improvement located on the Federal land described in subparagraph (A); and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id917F00DE52E845958E67AEE4D8994EBB"><enum>(ii)</enum><text display-inline="yes-display-inline">any appurtenance to the Federal land.</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id386d3350aa1f42f4927f2e522c4295f8"><enum>(2)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Agriculture.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id383f15b3899745f6aa49a7ed63db818c"><enum>(3)</enum><header display-inline="yes-display-inline">Tribe</header><text display-inline="yes-display-inline">The term <term>Tribe</term> means the Leech Lake Band of Ojibwe.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id281965D21DCA486B89A2AEEB8001EEB8"><enum>(c)</enum><header display-inline="yes-display-inline">Transfer to reservation</header> <paragraph commented="no" display-inline="no-display-inline" id="id3E4BC37E8E9848629AA45AFBACECCFF2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to valid existing rights and paragraph (2), the Secretary shall transfer to the administrative jurisdiction of the Secretary of the Interior all right, title, and interest of the United States in and to the Federal land.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1B371AEB9A484BDE8F9916F10DE4A440"><enum>(2)</enum><header display-inline="yes-display-inline">Treatment</header><text display-inline="yes-display-inline">Effective immediately on the transfer under paragraph (1), the Federal land shall be—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ida5522c18e40b4b748622ed4e57c60b3f"><enum>(A)</enum><text display-inline="yes-display-inline">held in trust by the United States for the benefit of the Tribe; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9bdc2f15a4b7464f8ebbce5e373a46d5"><enum>(B)</enum><text display-inline="yes-display-inline">considered to be a part of the reservation of the Tribe.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8ba1977863e54ddcb8209e688b54da0e"><enum>(d)</enum><header display-inline="yes-display-inline">Survey, map, and legal description</header> <paragraph commented="no" display-inline="no-display-inline" id="id8dd6cdb2d9cb4de7aec6daea1ed7ee2e"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idA2A1E6AE1A4B4C7CA58A6888A2416150"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of enactment of this Act, complete a plan of survey to establish the boundaries of the Federal land; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id957D3C65834B42FF999AF22D77A70734"><enum>(B)</enum><text display-inline="yes-display-inline">as soon as practicable after the date of enactment of this Act, submit a map and legal description of the Federal land to—</text>
 <clause commented="no" display-inline="no-display-inline" id="idef597d9309094e9984c4d3b8cd91c31a"><enum>(i)</enum><text display-inline="yes-display-inline">the Committee on Natural Resources of the House of Representatives; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id079bd6546f2443d094aa7db80e66cb84"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committee on Indian Affairs of the Senate.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e796693fe164d278edcb0a1119f8c01"><enum>(2)</enum><header display-inline="yes-display-inline">Force and effect</header><text display-inline="yes-display-inline">The map and legal description submitted under paragraph (1)(B) shall have the same force and effect as if included in this Act, except that the Secretary may correct any clerical or typographical error in the map or legal description.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id539018efbff741e593c3b52f2690ada5"><enum>(3)</enum><header display-inline="yes-display-inline">Public availability</header><text display-inline="yes-display-inline">The map and legal description submitted under paragraph (1)(B) shall be on file and available for public inspection in the office of the Secretary.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8e3fa86f517c4bb2815628bda33c9b67"><enum>(e)</enum><header display-inline="yes-display-inline">Administration</header>
 <paragraph commented="no" display-inline="no-display-inline" id="idd390a9b9cef74690be4b974d7bce719f"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise expressly provided in this section, nothing in this section affects any right or claim of the Tribe, as in existence on the date of enactment of this Act, to any land or interest in land.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA9F6EA5C6120447A9B9BFBCB0703804A"><enum>(2)</enum><header display-inline="yes-display-inline">Prohibitions</header>
 <subparagraph commented="no" display-inline="no-display-inline" id="iddd50788fa59145c69c26a294d91b96f8"><enum>(A)</enum><header display-inline="yes-display-inline">Exports of unprocessed logs</header><text display-inline="yes-display-inline">Federal law (including regulations) relating to the export of unprocessed logs harvested from Federal land shall apply to any unprocessed logs that are harvested from the Federal land.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id771ed8883b624f08bfe11f29fac68276"><enum>(B)</enum><header display-inline="yes-display-inline">Non-permissible use of land</header><text display-inline="yes-display-inline">The Federal land shall not be eligible or used for any gaming activity carried out under the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2701">25 U.S.C. 2701</external-xref> et seq.).</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id597d8dcdcde944ddae3b46d0ec6374b6"><enum>(3)</enum><header display-inline="yes-display-inline">Forest management</header><text display-inline="yes-display-inline">Any commercial forestry activity carried out on the Federal land shall be managed in accordance with applicable Federal law.</text></paragraph></subsection></section></legis-body></bill>
