			 and physical examinations, and other assessments an evaluation of whether
			 a member of the Armed Forces has been exposed to open burn pits or toxic
			 airborne chemicals, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Burn Pits Accountability Act</short-title></quote>.</text>
		</section><section id="H08D3305258F547A48E36885C7D9429DC" section-type="subsequent-section"><enum>2.</enum><header>Exposure to open burn pits and toxic airborne chemicals as part of periodic health assessments and
			 other physical examinations</header>
 <subsection id="H6D13731A277D4FAE9B9F45C385E8E61B"><enum>(a)</enum><header>Periodic health assessment</header><text display-inline="yes-display-inline">The Secretary of Defense shall ensure that any periodic health assessment provided to members of the Armed Forces includes an evaluation of whether the member has been—</text>
 <paragraph id="H87AC506C812E4BB4BC7A413742AE0198"><enum>(1)</enum><text display-inline="yes-display-inline">based or stationed at a location where an open burn pit was used; or</text> </paragraph><paragraph id="H83242C54C34C40B69545F0AC3B12E33F"><enum>(2)</enum><text>exposed to toxic airborne chemicals, including any information recorded as part of the Airborne Hazards and Open Burn Pit Registry.</text>
 </paragraph></subsection><subsection id="H3D9F3C90BAA742B99F9EA644A9C44EBF"><enum>(b)</enum><header>Separation history and physical examinations</header><text display-inline="yes-display-inline">Section 1145(a)(5) of title 10, United States Code, is amended by adding at the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HABBBDEAE0C0B4501837A7C41CBCDB1B6" style="USC">
 <subparagraph id="H191F0D328C6E4122BC591835B08D9157" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary concerned shall ensure that each physical examination of a member under subparagraph (A) includes an assessment of whether the member was—</text>
 <clause id="H4C78E7C457E94B50868A9D725764AA6C"><enum>(i)</enum><text>based or stationed at a location where an open burn pit, as defined in subsection (c) of section 201 of the Dignified Burial and Other Veterans' Benefits Improvement Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/260">Public Law 112–260</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/527">38 U.S.C. 527</external-xref> note), was used; or</text>
 </clause><clause id="H2F8DC36898F94687940B4BA56B378273"><enum>(ii)</enum><text display-inline="yes-display-inline">exposed to toxic airborne chemicals, including any information recorded as part of the registry established by the Secretary of Veterans Affairs under such section 201.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HF8323AD132B44829992E685DEF96B8CD"><enum>(c)</enum><header>Deployment assessments</header><text display-inline="yes-display-inline">Section 1074f(b)(2) of title 10, United States Code, is amended by adding at the end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HC8EF30206296462C80F393694F8FD673" style="USC">
 <subparagraph id="H4285CEDC019040469CB626806A9A9575" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">An assessment of whether the member was—</text> <clause id="H238EA4423F4F4AB095314E7032046EB9"><enum>(i)</enum><text>based or stationed at a location where an open burn pit, as defined in subsection (c) of section 201 of the Dignified Burial and Other Veterans' Benefits Improvement Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/260">Public Law 112–260</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/527">38 U.S.C. 527</external-xref> note), was used; or</text>
 </clause><clause id="HD91436F5FC194E018F7DAB9E819FFEA8"><enum>(ii)</enum><text display-inline="yes-display-inline">exposed to toxic airborne chemicals, including any information recorded as part of the registry established by the Secretary of Veterans Affairs under such section 201.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3FDAA61FD0D54A5DB14FAE80B0B00DF2"><enum>(d)</enum><header>Sharing of information</header>
 <paragraph id="H3648C80EFB7E41379F1DA376CD7E90F4"><enum>(1)</enum><header>DOD–VA</header><text display-inline="yes-display-inline">The Secretary of Defense and the Secretary of Veterans Affairs shall jointly enter into a memorandum of understanding providing for the sharing by the Department of Defense with the Department of Veterans Affairs of the results of covered evaluations regarding the exposure by a member of the Armed Forces to toxic airborne chemicals.</text>
 </paragraph><paragraph id="H0C5C66ECEB6B46B8B93DCA4445710D13"><enum>(2)</enum><header>Registry</header><text display-inline="yes-display-inline">If a covered evaluation of a member of the Armed Forces establishes that the member was based or stationed at a location where an open burn pit was used, or the member was exposed to toxic airborne chemicals, the member shall be enrolled in the Airborne Hazards and Open Burn Pit Registry, unless the member elects to not so enroll.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5813031D2642486A83C8E2A81FFD1E4E"><enum>(e)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to preclude eligibility for benefits under the laws administered by the Secretary of Veterans Affairs by reason of the open burn pit exposure history of a veteran not being recorded in a covered evaluation.</text>
 </subsection><subsection id="H8B87C260348E4A939AD2C634A0FB9443"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HBB0AEA48E7BE497E8E64FDABAA844B88"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>Airborne Hazards and Open Burn Pit Registry</term> means the registry established by the Secretary of Veterans Affairs under section 201 of the Dignified Burial and Other Veterans' Benefits Improvement Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/260">Public Law 112–260</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/527">38 U.S.C. 527</external-xref> note).</text>
 </paragraph><paragraph id="H43BF51286D6B4AF283800D8E651D95C0"><enum>(2)</enum><text>The term <term>covered evaluation</term> means—</text> <subparagraph id="H97BA05A5A95A47A6BA2D7CFEDBC6742E"><enum>(A)</enum><text display-inline="yes-display-inline">a periodic health assessment conducted in accordance with subsection (a);</text>
 </subparagraph><subparagraph id="HB9FCD7EB266E42068A0DE5D9A38F926A"><enum>(B)</enum><text display-inline="yes-display-inline">a separation history and physical examination conducted under section 1145(a)(5) of title 10, United States Code, as amended by this section; and</text>
 </subparagraph><subparagraph id="H43969A7DB13A4121B7E6C6B46F881A7D"><enum>(C)</enum><text>a deployment assessment conducted under section 1074f(b)(2) of such title, as amended by this section.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6F18BDEA7E2C4AF28CEA527AFD5DE4AE"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>open burn pit</term> has the meaning given that term in section 201(c) of the Dignified Burial and Other Veterans' Benefits Improvement Act of 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/260">Public Law 112–260</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/527">38 U.S.C. 527</external-xref> note).</text></paragraph></subsection></section></legis-body></bill>
