 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border, Law Enforcement, Operational Control, and Sovereignty Act of 2019</short-title></quote>.</text> </section><section id="idEFF533131BE7451D8E31E44E8180A029" section-type="subsequent-section"><enum>2.</enum><header>Additional funding for border security</header> <subsection id="id46746E5232C8435E8160A8AB2443C9D1"><enum>(a)</enum><header>Transfer of certain revenue from duties to Secretary of Homeland Security</header> <paragraph id="idC5A3ACCA0C904E1CA5F9EF7FA6CBFAE4"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall transfer to the Secretary of Homeland Security from the general fund of the Treasury amounts determined by the Secretary of the Treasury to be equivalent to 50 percent of the amounts received into the general fund that are attributable to duties imposed under section 301 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2411">19 U.S.C. 2411</external-xref>) with respect to goods imported from the People’s Republic of China on or after July 6, 2018.</text>
				</paragraph><paragraph id="idF2DAE9ACBE4940308F03D9D622B3FD85"><enum>(2)</enum><header>Administration of transfers</header>
 <subparagraph id="id9E028B60BD864C36B11F17D4A51531CB"><enum>(A)</enum><header>In general</header><text>The amounts required to be transferred under paragraph (1) shall be transferred not less frequently than quarterly from the general fund of the Treasury to the Secretary of Homeland Security on the basis of estimates made by the Secretary of the Treasury of the amounts described in paragraph (1) that are received into the Treasury.</text>
 </subparagraph><subparagraph id="id39761FAE127A4172AAF62BB061B6ACAA"><enum>(B)</enum><header>Adjustments</header><text>Proper adjustments shall be made in the amounts described in paragraph (1) subsequently transferred under that paragraph to the extent prior estimates were in excess of, or less than, the amounts required to be transferred.</text>
 </subparagraph></paragraph></subsection><subsection id="id94CBCB02C1444D13B86DD81623E3DE71"><enum>(b)</enum><header>Use of funds for border security</header><text>Amounts transferred under subsection (a) shall be available, without further appropriation, to the Secretary of Homeland Security to install physical barriers and roads described in section 102 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (division C of <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1103">8 U.S.C. 1103</external-xref> note), including for the construction of fencing and road improvements described in subsection (b) of that section.</text>
