		<section id="id08c384a80d6640fcb4aa9f1e12a87895" section-type="section-one"><enum>1.</enum><header>Provisional protected presence</header>
 <subsection id="id22551544BCC44C4C9367054AD57747F6"><enum>(a)</enum><header>In general</header><text>Chapter 4 of title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1221">8 U.S.C. 1221</external-xref> et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idF284D3FB670C457D9F3A216748A5B3E7" style="OLC">
					<section id="id07C6B74BDE164143B6DD14B50DB140B4" section-type="subsequent-section"><enum>244A.</enum><header>Provisional protected presence</header>
 <subsection id="id0DF6E9106BBD4C229C9564BBF07B601F"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="id05140525851a43039ef0e668561205ac"><enum>(1)</enum><header>DACA recipient</header><text>The term <term>DACA recipient</term> means an alien who is in deferred action status on the date of the enactment of this section pursuant to the Deferred Action for Childhood Arrivals (<quote>DACA</quote>) Program announced on June 15, 2012.</text>
 </paragraph><paragraph id="id8FE9314D9BA14D3E9A67610953903B3A"><enum>(2)</enum><header>Felony</header><text>The term <term>felony</term> means a Federal, State, or local criminal offense (excluding a State or local offense for which an essential element was the alien’s immigration status) punishable by imprisonment for a term exceeding one year.</text>
 </paragraph><paragraph id="id89d0c6cc1f5c4dd2922fac335f77716b"><enum>(3)</enum><header>Misdemeanor</header><text>The term <term>misdemeanor</term> means a Federal, State, or local criminal offense (excluding a State or local offense for which an essential element was the alien’s immigration status, a significant misdemeanor, and a minor traffic offense) for which—</text>
 <subparagraph id="id58F623E1B5DD40B0AF8462DBAF005866"><enum>(A)</enum><text>the maximum term of imprisonment is greater than five days and not greater than one year; and</text> </subparagraph><subparagraph id="id51E1621B459E439D8D4B8B8D287722C0"><enum>(B)</enum><text>the individual was sentenced to time in custody of 90 days or less.</text>
 </subparagraph></paragraph><paragraph id="id4d456d4e872c442b9bda74e969ae7826"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text> </paragraph><paragraph id="idF38ED34519C74A7FA04EA7E1A9C14443"><enum>(5)</enum><header>Significant misdemeanor</header><text>The term <term>significant misdemeanor</term> means a Federal, State, or local criminal offense (excluding a State or local offense for which an essential element was the alien’s immigration status) for which the maximum term of imprisonment is greater than five days and not greater than one year that—</text>
 <subparagraph id="id249A6B09F4144EEA86AAEA364C5EEAB2"><enum>(A)</enum><text>regardless of the sentence imposed, is a crime of domestic violence (as defined in section 237(a)(2)(E)(i)) or an offense of sexual abuse or exploitation, burglary, unlawful possession or use of a firearm, drug distribution or trafficking, or driving under the influence if the State law requires, as an element of the offense, the operation of a motor vehicle and a finding of impairment or a blood alcohol content of .08 or higher; or</text>
 </subparagraph><subparagraph id="id7F11ECEAEBF24F728CF11865DE26A676"><enum>(B)</enum><text>resulted in a sentence of time in custody of more than 90 days, excluding an offense for which the sentence was suspended.</text>
 </subparagraph></paragraph><paragraph id="idcf5e51c86a2f4fe892380949bb8e55d7"><enum>(6)</enum><header>Threat to national security</header><text>An alien is a <term>threat to national security</term> if the alien is—</text> <subparagraph id="id9B15B80C40504B00BA10B496F6C382A6"><enum>(A)</enum><text>inadmissible under section 212(a)(3); or</text>
 </subparagraph><subparagraph id="idB1A9E5E3AA574194A9F26DC0B7CD810D"><enum>(B)</enum><text>deportable under section 237(a)(4).</text> </subparagraph></paragraph><paragraph id="id9da6560aca6f4179bff7cb5c96cfeef4"><enum>(7)</enum><header>Threat to public safety</header><text>An alien is a <term>threat to public safety</term> if the alien—</text>
 <subparagraph id="id89CC782055BD4897A77268AB2C16034E"><enum>(A)</enum><text>has been convicted of an offense for which an element was participation in a criminal street gang (as defined in section 521(a) of title 18, United States Code); or</text>
 </subparagraph><subparagraph id="id91625D4182914504B82823144759AC50"><enum>(B)</enum><text>has engaged in a continuing criminal enterprise (as defined in section 408(c) of the Comprehensive Drug Abuse Prevention and Control Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/21/848">21 U.S.C. 848(c)</external-xref>)).</text>
 </subparagraph></paragraph></subsection><subsection id="id2d80af91964a4d40b56ab25103f136a9"><enum>(b)</enum><header>Authorization</header><text>The Secretary—</text> <paragraph id="idD8D73BAD76E14669BBF0C20DB3A27935"><enum>(1)</enum><text>shall grant provisional protected presence to an alien who files an application demonstrating that he or she meets the eligibility criteria under subsection (c) and pays the appropriate application fee;</text>
 </paragraph><paragraph id="id0b02b5f3a6c840c493c02cc3730ea30f"><enum>(2)</enum><text>may not remove such alien from the United States during the period in which such provisional protected presence is in effect unless such status is rescinded pursuant to subsection (g); and</text>
 </paragraph><paragraph id="id5d1685af2e424ed0bfd1321e636b726a"><enum>(3)</enum><text>shall provide such alien with employment authorization.</text> </paragraph></subsection><subsection id="id896d986d8c9e44d886eb42b1e2b190e4"><enum>(c)</enum><header>Eligibility criteria</header><text>An alien is eligible for provisional protected presence under this section and employment authorization if the alien—</text>
 <paragraph id="idd6e97fb081eb4092b04881a234fe007a"><enum>(1)</enum><text>was born after June 15, 1981;</text> </paragraph><paragraph id="idcdb2e0549ae4427fa86f43c704e01ee4"><enum>(2)</enum><text>entered the United States before attaining 16 years of age;</text>
 </paragraph><paragraph id="id757435cbca044d02851afa97e7ff995c"><enum>(3)</enum><text>continuously resided in the United States between June 15, 2007, and the date on which the alien files an application under this section;</text>
 </paragraph><paragraph id="iddcd56b94d32c4944a141b6e462c1b0bb"><enum>(4)</enum><text>was physically present in the United States on June 15, 2012, and on the date on which the alien files an application under this section;</text>
 </paragraph><paragraph id="idd2b5bf4391f5470bafa77a7984f57fda"><enum>(5)</enum><text>was unlawfully present in the United States on June 15, 2012;</text> </paragraph><paragraph id="id306c3a06fd7d40a48ae507e7b860f791"><enum>(6)</enum><text>on the date on which the alien files an application for provisional protected presence—</text>
 <subparagraph id="idE4B3BF6BE021473490B1EAFBB16C82EB"><enum>(A)</enum><text>is enrolled in school or in an education program assisting students in obtaining a regular high school diploma or its recognized equivalent under State law, or in passing a general educational development exam or other State-authorized exam;</text>
 </subparagraph><subparagraph id="id88D93A6108164120BF9060BA6F2987C7"><enum>(B)</enum><text>has graduated or obtained a certificate of completion from high school;</text> </subparagraph><subparagraph id="id859C5CFB748F4EF7ACC0F774026A9DE3"><enum>(C)</enum><text>has obtained a general educational development certificate; or</text>
 </subparagraph><subparagraph id="idB9ABEE62114649639CB4C608F718E08C"><enum>(D)</enum><text>is an honorably discharged veteran of the Coast Guard or Armed Forces of the United States;</text> </subparagraph></paragraph><paragraph id="iddde0246c931149c8887617a6a183ff8e"><enum>(7)</enum><text>has not been convicted of—</text>
 <subparagraph id="id2FAC2678F030402AABB3E363A3A7FF09"><enum>(A)</enum><text>a felony;</text> </subparagraph><subparagraph id="id66E62DF59F7C4F6394DC949E2F61C4F3"><enum>(B)</enum><text>a significant misdemeanor; or</text>
 </subparagraph><subparagraph id="id7F2EE3469ED94AFEACC2C2DFC36DBF55"><enum>(C)</enum><text>three or more misdemeanors not occurring on the same date and not arising out of the same act, omission, or scheme of misconduct;</text>
 </subparagraph></paragraph><paragraph id="idAFF8CF56B0E34B0A845E10D71AD4A974"><enum>(8)</enum><text>is a DACA recipient; and</text> </paragraph><paragraph id="idE1ECDFEC230E43B793E3D0238FF84362"><enum>(9)</enum><text>does not otherwise pose a threat to national security or a threat to public safety.</text>
 </paragraph></subsection><subsection id="ide894e6e8c3ca47bdb89305560e47cff0"><enum>(d)</enum><header>Duration of provisional protected presence and employment authorization</header><text>Provisional protected presence and the employment authorization provided under this section shall be effective until the date that is three years after the date of the enactment of this section.</text>
						</subsection><subsection id="id9f8d92972a3f40f796e9a1c46ab79b24"><enum>(e)</enum><header>Status during period of provisional protected presence</header>
 <paragraph id="id48D6096AA4B642D89D41DDB03BE7DDB5"><enum>(1)</enum><header>In general</header><text>An alien granted provisional protected presence is not considered to be unlawfully present in the United States during the period beginning on the date such status is granted and ending on the date described in subsection (d).</text>
 </paragraph><paragraph id="idCA8B16D7642249DD846525BB7120EF97"><enum>(2)</enum><header>Status outside period</header><text>The granting of provisional protected presence under this section does not excuse previous or subsequent periods of unlawful presence.</text>
							</paragraph></subsection><subsection id="id687339fded124b3bbfee369af0779909"><enum>(f)</enum><header>Application</header>
							<paragraph id="id99bbb14cb6e7458babb19df77b178936"><enum>(1)</enum><header>Age requirement</header>
 <subparagraph id="id4613195ce9474249b679aa11423affb1"><enum>(A)</enum><header>In general</header><text>An alien who has never been in removal proceedings, or whose proceedings have been terminated before making a request for provisional protected presence, shall be at least 15 years old on the date on which the alien submits an application under this section.</text>
 </subparagraph><subparagraph id="id3916bfb18c2143d1b3fd7f8fc32e48ca"><enum>(B)</enum><header>Exception</header><text>The age requirement set forth in subparagraph (A) shall not apply to an alien who, on the date on which the alien applies for provisional protected presence, is in removal proceedings, has a final removal order, or has a voluntary departure order.</text>
								</subparagraph></paragraph><paragraph id="idfc7971b4bada48baa21c7000c6070dd7"><enum>(2)</enum><header>Application fee</header>
 <subparagraph id="idA3BB389800E54D0BAA89ED6C9BD61DF0"><enum>(A)</enum><header>In general</header><text>The Secretary may require aliens applying for provisional protected presence and employment authorization under this section to pay a reasonable fee that is commensurate with the cost of processing the application.</text>
 </subparagraph><subparagraph id="idAE899B281E2C4B7CAA531DF85A37E4B4"><enum>(B)</enum><header>Exemption</header><text>An applicant may be exempted from paying the fee required under subparagraph (A) if the alien—</text> <clause id="id41e4ca4bb95d4131b29a14a1f760b610"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id4F25BAD6C7E447DBA9B208B2407F2DC7"><enum>(I)</enum><text>is younger than 18 years of age;</text>
 </subclause><subclause id="idF0F4F95EFD5B4EC2B9B1ED7464935ED4" indent="up1"><enum>(II)</enum><text>received total income during the 12-month period immediately preceding the date on which the alien files an application under this section that is less than 150 percent of the United States poverty level; and</text>
 </subclause><subclause id="id216190DCFD8C4B7BB149A21196EBF9E7" indent="up1"><enum>(III)</enum><text>is in foster care or otherwise lacking any parental or other familial support;</text> </subclause></clause><clause id="idc3a51e174cfa432ab8f20e7ead409658"><enum>(ii)</enum><text>is younger than 18 years of age and is homeless;</text>
 </clause><clause id="ide640f05a7e1c45aeb8cf403c4e9367dc"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id1356B1E8EB1B44D19C51EB28C028995E"><enum>(I)</enum><text>cannot care for himself or herself because of a serious, chronic disability; and</text> </subclause><subclause id="id81AB7BB053E840FF83BFC06393FB01B4" indent="up1"><enum>(II)</enum><text>received total income during the 12-month period immediately preceding the date on which the alien files an application under this section that is less than 150 percent of the United States poverty level; or</text>
 </subclause></clause><clause id="idbcbefd52c50e4fe484894cd3b1d474ce"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="id8AEF7996937840E3BFF26CCBFCDE0E04"><enum>(I)</enum><text>as of the date on which the alien files an application under this section, has accumulated $10,000 or more in debt in the past 12 months as a result of unreimbursed medical expenses incurred by the alien or an immediate family member of the alien; and</text>
 </subclause><subclause id="id86A1B036222448DA8725A33B3536C604" indent="up1"><enum>(II)</enum><text>received total income during the 12-month period immediately preceding the date on which the alien files an application under this section that is less than 150 percent of the United States poverty level.</text>
 </subclause></clause></subparagraph></paragraph><paragraph id="ida7d75760dbbc4390ab2e026d7d9bccda"><enum>(3)</enum><header>Removal stayed while application pending</header><text>The Secretary may not remove an alien from the United States who appears prima facie eligible for provisional protected presence while the alien’s application for provisional protected presence is pending.</text>
 </paragraph><paragraph id="ide9e03f154a86473e85f694d047e976d3"><enum>(4)</enum><header>Aliens not in immigration detention</header><text>An alien who is not in immigration detention, but who is in removal proceedings, is the subject of a final removal order, or is the subject of a voluntary departure order, may apply for provisional protected presence under this section if the alien appears prima facie eligible for provisional protected presence.</text>
 </paragraph><paragraph id="idf613f95a2d5b4c3da2a9189ac70c3e7f"><enum>(5)</enum><header>Aliens in immigration detention</header><text>The Secretary shall provide any alien in immigration detention, including any alien who is in removal proceedings, is the subject of a final removal order, or is the subject of a voluntary departure order, who appears prima facie eligible for provisional protected presence, upon request, with a reasonable opportunity to apply for provisional protected presence under this section.</text>
							</paragraph><paragraph id="id34ccde75a83742189cfcf7ec91cc2277"><enum>(6)</enum><header>Confidentiality</header>
 <subparagraph id="ida3ae722ac3a24026981f880684e69a8e"><enum>(A)</enum><header>In general</header><text>The Secretary shall protect information provided in applications for provisional protected presence under this section and in requests for consideration of DACA from disclosure to U.S. Immigration and Customs Enforcement and U.S. Customs and Border Protection for the purpose of immigration enforcement proceedings.</text>
 </subparagraph><subparagraph id="idbe8208395f264ba09e9d00242bc1c887"><enum>(B)</enum><header>Referrals prohibited</header><text>The Secretary may not refer individuals whose cases have been deferred pursuant to DACA or who have been granted provisional protected presence under this section to U.S. Immigration and Customs Enforcement.</text>
 </subparagraph><subparagraph id="id4098e68068f848bd85138d96fcdfd225"><enum>(C)</enum><header>Limited exception</header><text>The information submitted in applications for provisional protected presence under this section and in requests for consideration of DACA may be shared with national security and law enforcement agencies—</text>
 <clause id="idAAD54AB12D054BACB1FEDF5F7ECFA8BB"><enum>(i)</enum><text>for assistance in the consideration of the application for provisional protected presence;</text> </clause><clause id="id6385F4E161F04DB6AE71EEDCA4A6B175"><enum>(ii)</enum><text>to identify or prevent fraudulent claims;</text>
 </clause><clause id="idDB62DDF5A1D24DD999714239B97ABE3A"><enum>(iii)</enum><text>for national security purposes; and</text> </clause><clause id="id8E1F5D576C8543C09DDB382740C48CEB"><enum>(iv)</enum><text>for the investigation or prosecution of any felony not related to immigration status.</text>
 </clause></subparagraph></paragraph><paragraph id="id358DF8171D314AD488AD8A2B9ED8823B"><enum>(7)</enum><header>Acceptance of applications</header><text>Not later than 60 days after the date of the enactment of this section, the Secretary shall begin accepting applications for provisional protected presence and employment authorization.</text>
 </paragraph></subsection><subsection id="id3e80d80ea3ab4c8eb58c8ecba49662ed"><enum>(g)</enum><header>Rescission of provisional protected presence</header><text display-inline="yes-display-inline">The Secretary may not rescind an alien’s provisional protected presence or employment authorization granted under this section unless the Secretary determines that the alien—</text>
 <paragraph id="id2721dfd6264c4116b543771914822a05"><enum>(1)</enum><text>has been convicted of—</text> <subparagraph id="id62DDF956E9164EABB85879890C736D40"><enum>(A)</enum><text>a felony;</text>
 </subparagraph><subparagraph id="id88B815D801EF47E1AA7B9E4D0790B952"><enum>(B)</enum><text>a significant misdemeanor; or</text> </subparagraph><subparagraph id="id94644526F73743DA8E4A1DCCB2255433"><enum>(C)</enum><text>three or more misdemeanors not occurring on the same date and not arising out of the same act, omission, or scheme of misconduct;</text>
 </subparagraph></paragraph><paragraph id="id1666f9f5ad7c4ab39920367a4567c31a"><enum>(2)</enum><text>poses a threat to national security or a threat to public safety;</text> </paragraph><paragraph id="idefa41db651114c10864928a1de4f97e4"><enum>(3)</enum><text>has traveled outside of the United States without authorization from the Secretary; or</text>
 </paragraph><paragraph id="id97c3207ebab0460686872e056e954551"><enum>(4)</enum><text>has ceased to continuously reside in the United States.</text> </paragraph></subsection><subsection id="id73b1779870de4ca79a75309f1376cb3c"><enum>(h)</enum><header>Treatment of brief, casual, and innocent departures and certain other absences</header><text display-inline="yes-display-inline">For purposes of subsections (c)(3) and (g)(4), an alien shall not be considered to have failed to continuously reside in the United States due to—</text>
 <paragraph id="iddacba570cb9b4cc28898fe187a55091c"><enum>(1)</enum><text>brief, casual, and innocent absences from the United States during the period beginning on June 15, 2007, and ending on August 14, 2012; or</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8d04d7cec2b9449586be10654100d0d6"><enum>(2)</enum><text>travel outside of the United States on or after August 15, 2012, if such travel was authorized by the Secretary.</text>
 </paragraph></subsection><subsection id="id733ebd86571c4de2a06971284f501ae8"><enum>(i)</enum><header>Treatment of expunged convictions</header><text>For purposes of subsections (c)(7) and (g)(1), an expunged conviction shall not automatically be treated as a disqualifying felony, significant misdemeanor, or misdemeanor, but shall be evaluated on a case-by-case basis according to the nature and severity of the offense to determine whether, under the particular circumstances, the alien should be eligible for provisional protected presence under this section.</text>
						</subsection><subsection id="id7B36B92F04774C198CD2E8BF5D59349C"><enum>(j)</enum><header>Effect of deferred action under Deferred Action for Childhood Arrivals Program</header>
 <paragraph id="idc12b6ecbecea4f9a89f2140a177e6c1d"><enum>(1)</enum><header>Provisional protected presence</header><text>A DACA recipient is deemed to have provisional protected presence under this section through the expiration date of the alien’s deferred action status, as specified by the Secretary in conjunction with the approval of the alien’s DACA application.</text>
 </paragraph><paragraph id="id2d8e8767ee9042039190cee0234307c3"><enum>(2)</enum><header>Employment authorization</header><text>If a DACA recipient has been granted employment authorization by the Secretary in addition to deferred action, the employment authorization shall continue through the expiration date of the alien’s deferred action status, as specified by the Secretary in conjunction with the approval of the alien’s DACA application.</text>
 </paragraph><paragraph id="id5bb0f2bcbd174375b0a6d6e468a82831"><enum>(3)</enum><header>Effect of application</header><text>If a DACA recipient files an application for provisional protected presence under this section not later than the expiration date of the alien’s deferred action status, as specified by the Secretary in conjunction with the approval of the alien’s DACA application, the alien’s provisional protected presence, and any employment authorization, shall remain in effect pending the adjudication of such application.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				<quoted-block display-inline="no-display-inline" id="idADC3AC3478DE455DAF31ED784A1535C1" style="OLC">
					<section id="id9FE562B44CC64542A155462CAAC9630E"><enum>244B.</enum><header>Renewable provisional protected presence</header>
 <subsection id="id91cb47d395d044498d359545ee3a7926"><enum>(a)</enum><header>In general</header><text>The Secretary of Homeland Security (referred to in this section as the <quote>Secretary</quote>) shall grant provisional protected presence, for a period of 3 years and renewable indefinitely, to an alien who—</text>
 <paragraph id="id790424207e3c4a64b8bbcbefc3d0391b"><enum>(1)</enum><text>submits an application for such status to the Secretary not later than 21 years after the first day on which applications for such status are accepted;</text>
 </paragraph><paragraph id="id518b178e6565405090793da204293e39"><enum>(2)</enum><text>is admissible as an immigrant under this Act at the time of examination for such status, except that in the determination of the alien’s admissibility for purposes of this section, the Secretary shall apply the terms of section 244(c)(2)(A);</text>
 </paragraph><paragraph id="id92522790a073427abc24b0b42aa432f7"><enum>(3)</enum><text>was granted temporary protected status or deferred enforced departure on or before October 1, 2017;</text> </paragraph><paragraph id="id6e81f65681ac4b8788e0d5e8239d2016"><enum>(4)</enum><text>has been continuously physically present in the United States for a period of not less than 5 years immediately preceding the date of the enactment of this section; and</text>
 </paragraph><paragraph id="id7f5efe3d04cf433b9f50383d7873b893"><enum>(5)</enum><text>has not been convicted of—</text> <subparagraph id="id132cf11d4b284e19878bee2e340e582a"><enum>(A)</enum><text>a felony; nor</text>
 </subparagraph><subparagraph id="id0c9e87905ab04bd4a3b9f29549832af5"><enum>(B)</enum><text>2 or more misdemeanors not occurring on the same date and not arising out of the same act, omission, or scheme of misconduct.</text>
 </subparagraph></paragraph></subsection><subsection id="id09b4166e51354abb89f862bc950f630b"><enum>(b)</enum><header>Procedures</header><text>The Secretary shall establish a procedure allowing eligible individuals to apply for the relief available under this section without requiring placement in removal proceedings. Such procedure shall provide for the ability of a minor to apply for such relief, including through a legal guardian or counsel.</text>
 </subsection><subsection id="id2351106a71dc4011bf6310542b486af7"><enum>(c)</enum><header>Application fee</header><text>The Secretary may require an alien applying for provisional protected presence under this section to pay a reasonable fee that is commensurate with the cost of processing the application.</text>
 </subsection><subsection id="idce7a844a4ec24cabb9b035f6713c1bb8"><enum>(d)</enum><header>Submission of biometric and biographic data</header><text>The Secretary may not grant an alien provisional protected presence under this section unless the alien submits biometric and biographic data, in accordance with procedures established by the Secretary. The Secretary shall provide an alternative procedure for aliens who are unable to provide such biometric or biographic data because of a physical impairment.</text>
						</subsection><subsection id="id7cf6fbecc1ed40fa983992eba5b7a14e"><enum>(e)</enum><header>Background checks</header>
 <paragraph id="id964ff6c440e548ad9a0a057cf4aa0ffa"><enum>(1)</enum><header>Requirement for background checks</header><text>The Secretary shall use biometric, biographic, and other data that the Secretary determines appropriate—</text>
 <subparagraph id="idddfc617f85844d68a538d8b09e9f6722"><enum>(A)</enum><text>to conduct security and law enforcement background checks of an alien seeking provisional protected presence under this section; and</text>
 </subparagraph><subparagraph id="iddc55c17c60614eff808a170b654bf4fa"><enum>(B)</enum><text>to determine whether there is any criminal, national security, or other factor that would render the alien ineligible for such status.</text>
 </subparagraph></paragraph><paragraph id="id8e09bddf1b5b429a9da60ce1e3a11cfd"><enum>(2)</enum><header>Completion of background checks</header><text>The security and law enforcement background checks of an alien required under paragraph (1) shall be completed, to the satisfaction of the Secretary, before the date on which the Secretary grants such alien provisional protected presence under this section.</text>
 </paragraph><paragraph id="ide4b90dc42ec146448894b3a9b6de5acd"><enum>(3)</enum><header>Criminal records requests</header><text>The Secretary, in cooperation with the Secretary of State, shall seek to obtain information about any criminal activity the alien engaged in, or for which the alien was convicted in his or her country of nationality, country of citizenship, or country of last habitual residence, from INTERPOL, EUROPOL, or any other international or national law enforcement agency of the alien’s country of nationality, country of citizenship, or country of last habitual residence.</text>
 </paragraph></subsection><subsection id="id86b37ab716dc45429ce83c73c75ce098"><enum>(f)</enum><header>Treatment of brief, casual, and innocent departures</header><text>For purposes of subsection (a)(4), an alien shall not be considered to have failed to maintain continuous residence in the United States by virtue of brief, casual, and innocent absences from the United States.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idAC140E2A594844398C2FEA778D3DB91E"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note) is amended by inserting after the item relating to section 244 the following:</text>

			</subsection></section><section id="idD6E84E5D76BE49ACB5751462915ED8DC"><enum>2.</enum><header>Mandatory appropriations</header>
 <subsection id="idAD5CC285922743CFBBD51B92600955D9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary of Homeland Security and the Attorney General, as applicable, to remain available until expended—</text>
 <paragraph id="idDE33B53D91694D62BA84F5056904DBF0"><enum>(1)</enum><text display-inline="yes-display-inline">$5,700,000,000 for U.S. Customs and Border Protection for procurement, construction, and improvements;</text>
 </paragraph><paragraph id="idD6ECDECFAECB44CDAF48E94F5C787E5E"><enum>(2)</enum><text display-inline="yes-display-inline">$800,000,000 for urgent humanitarian needs to ensure the well-being of individuals taken into the custody of U.S. Customs and Border Protection, including for enhanced medical support, transportation, consumable supplies, and additional temporary facilities for processing and short-term custody of vulnerable aliens;</text>
 </paragraph><paragraph id="idAD7175442135439C8C38231823D1E7BB"><enum>(3)</enum><text display-inline="yes-display-inline">$563,000,000 for the Executive Office for Immigration Review to hire not fewer than 75 additional immigration judges and support staff to reduce the backlog of cases pending before the Executive Office for Immigration Review; and</text>
 </paragraph><paragraph id="idB6A7631513F546B0A767A1A48BF28DB8"><enum>(4)</enum><text display-inline="yes-display-inline">$211,000,000 to hire not fewer than 750 additional Border Patrol Agents to safeguard and secure the international borders of the United States.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD175969DD23E48919CAB125FC34908A3"><enum>(b)</enum><header display-inline="yes-display-inline">Receipt and
 acceptance</header><text display-inline="yes-display-inline">The Secretary of Homeland Security and the Attorney General, as applicable, shall be entitled to receive, shall accept, and shall use the funds transferred under subsection (a) for the purposes described in that subsection, without further appropriation.</text></subsection></section></legis-body></bill>
