		<official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/85">chapter 85</external-xref> of title 5, United States Code, to clarify that Federal employees excepted from
			 a furlough are eligible for unemployment compensation.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Unemployment Compensation Equality Act of 2019</short-title></quote>.</text>
		</section><section id="id67a1ad7ec466453191216f54eb429647"><enum>2.</enum><header>Clarification that  Federal employees excepted from a furlough are eligible for unemployment
			 compensation</header>
 <subsection id="id3FF0C46D1E6642528D7BA3C370389FD9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 8502 of title 5, United States Code, is amended—</text> <paragraph id="id15089DF1EB1F403BB373EA1F86BBE823"><enum>(1)</enum><text>by redesignating subsection (e) as subsection (f); and</text>
 </paragraph><paragraph id="idB3E8E12979864A689D05F992ACAEF10A"><enum>(2)</enum><text>by inserting after subsection (d) the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="idB62BF0CEB61F43D0B9B11C826077B84E" style="OLC"> <subsection id="idE58D0EC71E9E4915B15D1D65C1DF5377"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id4D118A07F39549F3981EE269300E781B"><enum>(1)</enum><text>With respect to any lapse in appropriations beginning on or after December 22, 2018, each excepted Federal employee shall be, solely for the purpose of determining eligibility for unemployment compensation under this subchapter, deemed for the duration of the lapse in appropriations to be—</text>
 <subparagraph id="idEA0BA97353E04443BC30D4054A1BAD0E" indent="up1"><enum>(A)</enum><text>totally separated from Federal service; and</text>
 </subparagraph><subparagraph id="idA79896D34A8041138273405C8206B811" indent="up1"><enum>(B)</enum><text>eligible for unemployment compensation benefits under this subchapter with no waiting period for such eligibility to accrue.</text>
 </subparagraph></paragraph><paragraph id="idE7743DE083B844B4BC506A3CBF2D67FA" indent="up1"><enum>(2)</enum><text>In this subsection, the term <term>excepted Federal employee</term> means a Federal employee who—</text> <subparagraph id="ide69c8313bc634814a517b56823e7df03"><enum>(A)</enum><text>is an excepted employee or an employee performing emergency work, as such terms are defined by the Office of Personnel Management; and</text>
 </subparagraph><subparagraph id="idcc6cf1ce094f44e4a6da0647ef4f649c"><enum>(B)</enum><text>is not being paid due to a lapse in appropriations.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="idA4601C79C5BA449E8FECA6C132427C8D"><enum>(b)</enum><header>Application</header><text>The amendments made by subsection (a) shall apply to weeks of unemployment beginning on or after December 22, 2018.</text>
