<section id="H15CEB4BE28914D10BD8DF617A0377C0E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pay Our Protectors Act of 2019</short-title></quote>.</text> </section> <section id="H11E4FD26F3FF44A6B22D2288AA879BEC" section-type="subsequent-section"><enum>2.</enum><header>Continuing appropriations for certain employees of the Department of Homeland Security and the Department of Justice</header> <subsection id="H45CA9F2838344765A8A3FE1ABDDE0FDD"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>covered excepted employee</term> means an officer or employee—</text> 
<paragraph id="idFD47588749FC460C9D5C81189C6248D9"><enum>(1)</enum><text>who is an officer or employee of an agency that is subject to a lapse in appropriations during fiscal year 2019;</text> </paragraph> <paragraph id="id96843806FB9B42F48050740C4AEF3455"><enum>(2)</enum><text>who is—</text> 
<subparagraph id="idDF90512C66354731B07465542BB25548"><enum>(A)</enum><text>an officer or employee of—</text> <clause id="id5461969C356247DB9994331C4714B394"><enum>(i)</enum><text>U.S. Customs and Border Protection;</text> </clause>
<clause id="id4D1699E39E33403090CF9B2C68895D88"><enum>(ii)</enum><text>U.S. Immigration and Customs Enforcement;</text> </clause> <clause id="idB6368E498139402FA53B8D79A8BFFAEE"><enum>(iii)</enum><text>the Transportation Safety Administration;</text> </clause>
<clause id="id64F946F6A6FC4525AE731C822CE09051"><enum>(iv)</enum><text>the Coast Guard;</text> </clause> <clause id="id3FB6976E87BD4F2ABCC13A3909178655"><enum>(v)</enum><text>the Federal Bureau of Investigation; or</text> </clause>
<clause id="id82E59616B3E94F6BBDF48C991CF2CBBB"><enum>(vi)</enum><text>the Central Intelligence Agency;</text> </clause></subparagraph> <subparagraph id="id7DDC92507820425CB7E3E4B793817416"><enum>(B)</enum><text>an attorney employed by the Department of Justice who prosecutes criminal offenses; or</text> </subparagraph>
<subparagraph id="idF27E068D4EFF4AFF8F6A35AADFD898AA"><enum>(C)</enum><text>an immigration judge employed by the Department of Justice; and</text> </subparagraph></paragraph> <paragraph id="idC38440D7CE734EB7BA185135AE6F3783"><enum>(3)</enum><text>who is an excepted employee or an employee performing emergency work, as such terms are defined by the Office of Personnel Management.</text> </paragraph></subsection>
<subsection id="id2A1EFB7EA3104CABBE1285EE2DF327F0"><enum>(b)</enum><header>Appropriation</header><text display-inline="yes-display-inline">There are hereby appropriated for fiscal year 2019, out of any money in the Treasury not otherwise appropriated, to the head of each agency that employs 1 or more covered excepted employees for any period during which interim or full-year appropriations for fiscal year 2019 are not in effect such sums as are necessary to provide pay and allowances to each covered excepted employee of the agency.</text> </subsection> <subsection id="HADC5B6EF16594233923560D2CB333E63"><enum>(c)</enum><header>Termination</header><text display-inline="yes-display-inline">Appropriations made available and authority granted under subsection (b) shall be available to the head of an agency until the earliest of—</text> 
<paragraph id="id87C0C0F3C70241C0BF87916CE7E3ED82"><enum>(1)</enum><text display-inline="yes-display-inline">the enactment into law of a regular appropriations Act providing appropriations for the agency for fiscal year 2019;</text> </paragraph> <paragraph id="idDAD4713F389D4ECBB5B0549A24CCBB48"><enum>(2)</enum><text>the enactment into law of a law providing continuing or regular appropriations for the agency for fiscal year 2019 that does not provide appropriations for the purpose for which amounts are appropriated under subsection (b); or</text> </paragraph>
<paragraph id="id9676A39BA73C427F92F00A4637A04CD5"><enum>(3)</enum><text>January 1, 2020.</text></paragraph></subsection> <subsection id="id6A6CA4DB1AF6405B9984B7B3630CE6FB"><enum>(d)</enum><header>Application</header><text>For a lapse in appropriations that is in effect on the date of enactment of this Act, each covered excepted employee shall be compensated for work performed during the lapse in appropriations during the period before such date of enactment at the standard rate of compensation for the covered excepted employee at the earliest date possible after such date of enactment.</text></subsection></section>
