			 content owned by another person, and for other purposes.</official-title></form>
	<legis-body id="H31156A7D15FD4990AEEF164D7BDD33FD" style="OLC">
 <section id="HAEF319235C8D4403A0035419BCCA51DD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ask Musicians For Music Act of 2019</short-title></quote>.</text> </section><section id="H146AD03B685043A8B42D8BAF812CB7F9"><enum>2.</enum><header>Transmission consent for terrestrial broadcasts</header> <subsection id="H4C8C4480185149C48C783F33A099B30A"><enum>(a)</enum><header>Right applicable to transmissions generally</header><text>Section 106(6) of title 17, United States Code, is amended by striking <quote>a digital</quote> and inserting <quote>an</quote>.</text>
 </subsection><subsection id="H5402330792F941D8BBA0268C7FC76E13"><enum>(b)</enum><header>Transmission consent</header><text>Section 114(d)(1)(A) of title 17, United States Code, is amended by adding after <quote>transmission</quote> the following: <quote>, except that, in the case of a transmission made by a radio station, the radio station shall obtain the express authority of the copyright owner of that sound recording for any such transmission (unless the transmission consists of services at a place of worship (or at another religious assembly) or incidental uses of a musical work)</quote>.</text>
			</subsection></section><section id="HC1CD3BCC020D4BDF84906A7B185706CB"><enum>3.</enum><header>Small broadcasters; public and educational radio</header>
			<subsection id="HD9C49DE4CF4B4A6C8F0696CB3C1543A2"><enum>(a)</enum><header>Small broadcasters</header>
 <paragraph id="H0E92B86DABB448758860D96E01283BE1"><enum>(1)</enum><header>In general</header><text>Consent required under section 2 shall be deemed satisfied by the payment of $500 per year by any radio station with revenues in that year of less than $1,000,000, including all revenues arising from or relating to the operation of the station, as calculated in accordance with generally accepted accounting principles in the United States.</text>
 </paragraph><paragraph id="H9FD2BE0FF76C478D94BD458815E73F56"><enum>(2)</enum><header>Affiliates</header><text>For the purposes of calculating revenues under paragraph (1) with respect to affiliated broadcast stations, revenues shall be allocated reasonably to individual stations that are associated with those revenues.</text>
 </paragraph></subsection><subsection id="H4D6C48BF253E45F88EDCF6C5FFEB1961"><enum>(b)</enum><header>Public broadcasters, college radio, and other noncommercial stations</header><text>Any negotiation to obtain the express authority of a copyright owner that is required with respect to a transmission made by a radio station under section 114(d)(1)(A) of title 17, United States Code, as amended by section 2(b), may not result in the payment of compensation in an amount that is more than $100 per year by any individual terrestrial broadcast station that is—</text>
 <paragraph id="H386DBE7A8E0349AA8D5F3925D62D10E5"><enum>(1)</enum><text>licensed by the Federal Communications Commission as an individual terrestrial broadcast station; and</text>
 </paragraph><paragraph id="HC47E4B2185EA40BFA159D389A723C95B"><enum>(2)</enum><text>a public broadcasting entity, as that term is defined in section 118(f) of title 17, United States Code.</text>
 </paragraph></subsection><subsection id="H9A1AA413E6D949699734C8CAD6D47955"><enum>(c)</enum><header>Designated agent</header><text>Payments made pursuant to subsections (a) and (b) shall be directed to the agent designated to distribute receipts from the licensing of digital transmissions in accordance with section 114(f) of title 17 and used to defray administrative costs as described in section 114(g)(3)(A) of title 17.</text>
			</subsection></section><section id="H3929A8A4DD3E4837856C94F6952D99C7"><enum>4.</enum><header>Conforming amendments</header>
 <subsection id="H013F3576447B4266BC88A368A0395F64"><enum>(a)</enum><header>Definition</header><text>Section 101 of title 17, United States Code, is amended by inserting after the item relating to <quote>architectural work</quote> the following:</text> <quoted-block id="HD2B6DD234A5241E6924C0950ACDD5132" style="OLC"> <text display-inline="no-display-inline">An ‘audio transmission’ is the communication of a sound recording, whether in digital, analog, or other format, whereby sounds are received beyond the place from which they are sent. An audio transmission does not include the transmission of any audiovisual work.</text><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HAD0A10D3273944C8BE8AC4F539D1D0E8"><enum>(b)</enum><header>Other conforming amendments</header><text>Title 17, United States Code, is amended—</text> <paragraph id="H79DCCE0CF8974093AEAB2D2FCF23928A"><enum>(1)</enum><text>in section 112(e)(8), by striking <quote>a digital audio transmission</quote> and inserting <quote>an audio transmission</quote>;</text>
 </paragraph><paragraph id="H399608F5EE724026AAC21B7D090B4227"><enum>(2)</enum><text>in section 114—</text> <subparagraph id="H644757FCC23B4A40AF7A0D465C3B52BE"><enum>(A)</enum><text>in subsection (d)—</text>
 <clause id="H2A8B6CAAE56745CBB8FDD158A2034D2F"><enum>(i)</enum><text>in paragraph (1)—</text> <subclause id="HED24C3C8B4DF4A53A4B4AA1DA54A37E2"><enum>(I)</enum><text>in the matter preceding subparagraph (A), by striking <quote>a digital</quote> and inserting <quote>an</quote>; and</text>
 </subclause><subclause id="H9850839EDB6E42C6922A2C391F8D5FA3"><enum>(II)</enum><text>in subparagraph (B)—</text> <item id="HB0021D4AE2134F69AA82B50E61A11D6D"><enum>(aa)</enum><text>by striking clauses (i) and (iii);</text>
 </item><item id="H1CF82861FDC444C1BD8D8D2881545B9E"><enum>(bb)</enum><text>by redesignating clauses (ii) and (iv) as clauses (i) and (ii), respectively; and</text> </item><item id="H8CE2E3060CB145D8A4DE8FE3673D47D0"><enum>(cc)</enum><text>in clause (ii), as so redesignated, by striking <quote>retransmission, whether or not simultaneous, is a</quote> and inserting <quote>retransmission is a non-simultaneous,</quote>;</text>
 </item></subclause></clause><clause id="H6B0D459C8CDD44CFA9931985BEBC46C3"><enum>(ii)</enum><text>in paragraph (2)—</text> <subclause id="H891E9146A8B347A1A4ACD913DA6EEC3C"><enum>(I)</enum><text>in the matter preceding subparagraph (A), by striking <quote>subscription digital</quote> and inserting <quote>subscription</quote>; and</text>
 </subclause><subclause id="H75D46D53D945439EAC764119A126910A"><enum>(II)</enum><text>in subparagraph (C)(viii), by striking <quote>digital signal</quote> and inserting <quote>signal</quote>; and</text> </subclause></clause><clause id="HF07B9CD487614F7B8559B3F13D264AEB"><enum>(iii)</enum><text>in paragraph (4)—</text>
