	<legis-body id="H529680AEA57D433DB5DFDAD3CE82572A" style="OLC">
 <section id="HA65672BDC7B5475E83D62079DC121473" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tribal Wildlife Corridors Act of 2019</short-title></quote>.</text> </section><section id="H23F527E642A8468688D35F5133E4F1EF"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="H5607C42B0A33411B97408C68CC7025B7"><enum>(1)</enum><header>Connectivity</header><text>The term <term>connectivity</term> means the degree to which the landscape or seascape facilitates native species movement.</text> </paragraph><paragraph id="H961506BA40EE4F6D97790DAD204DC129"><enum>(2)</enum><header>Corridor</header><text>The term <term>corridor</term> means a distinct component of a landscape or seascape that—</text>
 <subparagraph id="H731B0EB163584E7C912037653841BD8E"><enum>(A)</enum><text>provides habitat or ecological con­nec­tiv­i­ty; and</text> </subparagraph><subparagraph id="HA574EDC3EB3946C596AAD09E9ECB490C"><enum>(B)</enum><text>allows for fish, wildlife, or plant movement.</text>
 </subparagraph></paragraph><paragraph id="H1BD1592363EA4D8A9D583B747A691300"><enum>(3)</enum><header>Indian land</header><text>The term <term>Indian land</term> means land of an Indian tribe, or an Indian individual, that is—</text> <subparagraph id="H392F67123A2E468D8ED2159EC4144D51"><enum>(A)</enum><text>held in trust by the United States; or</text>
 </subparagraph><subparagraph id="HCAAE514964C24D228E8BD13997D12B32"><enum>(B)</enum><text>subject to a restriction against alienation imposed by the United States.</text> </subparagraph></paragraph><paragraph id="HA921DC878678426D9BFCC0E362155F6A"><enum>(4)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA367CDE6D43648ACBFF15D361215D572"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service, in consultation with the Bureau of Indian Affairs.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2F3F2217DF1E4A85AFD57ACC2C9DABCE"><enum>(6)</enum><header>Tribal Wildlife Corridor</header><text>The term <term>Tribal Wildlife Corridor</term> means a corridor established by the Secretary under section 3(a).</text> </paragraph></section><section id="HBA1E97D8B01943D1AE42593C0F359DAD"><enum>3.</enum><header>Establishment of Tribal Wildlife Corridors</header> <subsection id="H98E612D34396474D9CC9027F775BF944"><enum>(a)</enum><header>In general</header> <paragraph id="H69DC517E55CD48AE8D060BE458911A3A"><enum>(1)</enum><header>Nominations</header><text>An Indian tribe may nominate a corridor within Indian land of the Indian tribe as a Tribal Wildlife Corridor by submitting to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text>
 </paragraph><paragraph id="HFC2754809E0C457B8D9A3CE06448944A"><enum>(2)</enum><header>Determination</header><text>Not later than 90 days after the date on which the Secretary receives an application under paragraph (1), the Secretary shall determine whether the nominated Tribal Wildlife Corridor described in the application meets the criteria established under subsection (b).</text>
 </paragraph><paragraph id="HF20B2061BAAD44D69E439F0F37A95A49"><enum>(3)</enum><header>Publication</header><text>On approval of an application under paragraph (2), the Secretary shall publish in the Federal Register a notice of the establishment of the Tribal Wildlife Corridor, which shall include a map and legal description of the land designated as a Tribal Wildlife Corridor.</text>
				</paragraph></subsection><subsection id="H5F3121BEDEB943FBB3FF55ED95BA7295"><enum>(b)</enum><header>Criteria</header>
 <paragraph id="HE0B40EEE99C9484B84D739C9B8A664E1"><enum>(1)</enum><header>In general</header><text>Not later than 540 days after the date of enactment of this Act, the Secretary shall establish criteria for determining whether a corridor nominated by an Indian tribe under subsection (a)(1) qualifies as a Tribal Wildlife Corridor.</text>
 </paragraph><paragraph id="H8387E7FE583945B09A7EEB69B2DD9D2B"><enum>(2)</enum><header>Inclusions</header><text>The criteria established under paragraph (1) shall include, at a minimum, the following:</text> <subparagraph commented="no" id="HC5EFF05D19DB431F93B51025D4DC3005"><enum>(A)</enum><text>The restoration of historical habitat for the purposes of facilitating connectivity.</text>
 </subparagraph><subparagraph commented="no" id="HFDE15C8BA7D949F582A46DB4AE0C67A1"><enum>(B)</enum><text>The management of land for the purposes of facilitating connectivity.</text> </subparagraph><subparagraph commented="no" id="H57328DC7DDF847A781A5C857AD57A230"><enum>(C)</enum><text>The management of land to prevent the imposition of barriers that may hinder current or future connectivity.</text>
					</subparagraph></paragraph></subsection><subsection id="HC2729520807A405699F521BD46938C86"><enum>(c)</enum><header>Removal</header>
 <paragraph id="H1D6A784AB0C644E2ADB7D1130E68D725"><enum>(1)</enum><header>In general</header><text>An Indian tribe may elect to remove the designation of a Tribal Wildlife Corridor on the Indian land of the Indian tribe by notifying the Secretary.</text>
 </paragraph><paragraph id="HB8655538691E47A18EEA811FDB749B77"><enum>(2)</enum><header>Effect of removal</header><text>An Indian tribe that elects to remove a designation under paragraph (1) may not receive assistance under section 5 or 6.</text>
 </paragraph></subsection></section><section id="H97D215EA73384BB9A55ACA1E007F8EF2"><enum>4.</enum><header>Coordination of land use plans</header><text display-inline="no-display-inline">Section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>) is amended—</text> <paragraph id="HB653D5CBFCDE450693F0942B4E5C51B2"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>
 <subparagraph id="H36E4809AB7B64074A1B5FE94C94995A0"><enum>(A)</enum><text>by striking <quote>Indian tribes by</quote> and inserting the following: “Indian tribes—</text> <quoted-block display-inline="no-display-inline" id="HB2B38291C8894A4A8DA301945E1AFA7A" style="OLC"> <paragraph id="H45B130F73379407E95E4E741A374EB67"><enum>(1)</enum><text>by</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H377504C0327842079102978836CECC34"><enum>(B)</enum><text>in paragraph (1) (as so designated), by striking the period at the end and inserting <quote>; and</quote>; and</text> </subparagraph><subparagraph id="HC5AE9F5253C749EB9041246E9EA27D2B"><enum>(C)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HF121457B48A44456A067855B25428798" style="OLC">
 <paragraph id="HD3030B60FCC8451F911B66812576EBCE"><enum>(2)</enum><text>for the purposes of determining whether the land use plans for land in the National Forest System would provide additional connectivity to benefit the purposes of a Tribal Wildlife Corridor established under section 3(a) of the <short-title>Tribal Wildlife Corridors Act of 2019</short-title>.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="H731DAF237F324F7ABE5EC2B46B99F785"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H6E81997F29DF4BA48DD8B83FE3959BBD" style="OLC"> <subsection id="H38CE7CF740B3490B8E7408ED4F13BA96"><enum>(g)</enum><header>Tribal Wildlife Corridors</header><text>On the establishment of a Tribal Wildlife Corridor under section 3(a) of the <short-title>Tribal Wildlife Corridors Act of 2019</short-title>, the Secretary shall conduct a meaningful consultation with the Indian tribe that administers the Tribal Wildlife Corridor to determine whether, through the revision of one or more existing land use plans, the Tribal Wildlife Corridor can—</text>
 <paragraph id="HA6413B8A560D41FE850FCEB86A438643"><enum>(1)</enum><text>be expanded into public lands; or</text> </paragraph><paragraph id="H3E5849AFD7954FC28CE7CEFDB0F8BF7E"><enum>(2)</enum><text>otherwise benefit connectivity (as defined in section 2 of that Act) between public lands and the Tribal Wildlife Corridor.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H83671D1FF96D4C009796F41E31BF82C2"><enum>5.</enum><header>Technical assistance</header><text display-inline="no-display-inline">The Secretary shall provide to Indian tribes technical assistance relating to the establishment, management, and expansion of a Tribal Wildlife Corridor, including assistance with accessing wildlife data and working with private landowners to access Federal and State programs to improve wildlife habitat and connectivity on non-Federal land.</text>
		</section><section id="H7F7666FFA5024DDEAABC532DFEF87AF5"><enum>6.</enum><header>Availability of assistance</header>
			<subsection id="H4BCC64D957FB4CA598BEDBC92B03BFCC"><enum>(a)</enum><header>Conservation programs priority</header>
 <paragraph id="HB13B5E0B89194991BC2EAC994FAC0517"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In evaluating applications under conservation programs described in paragraph (2), the Secretary of Agriculture may give priority to an application for a project that would enhance connectivity through the expansion of a Tribal Wildlife Corridor.</text>
 </paragraph><paragraph id="H9D79F8AD817F4E8B9110A161E4989ACB"><enum>(2)</enum><header>Programs described</header><text display-inline="yes-display-inline">The conservation programs referred to in paragraph (1) are any of the following conservation programs administered by the Secretary of Agriculture:</text>
 <subparagraph id="HAD49B176C3A146F2BC17B58481317493"><enum>(A)</enum><text>The conservation reserve program established under subchapter B of chapter 1 of subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3831">16 U.S.C. 3831</external-xref> et seq.).</text>
 </subparagraph><subparagraph id="H183C29F76B47461793C53F1240549336"><enum>(B)</enum><text>The environmental quality incentives program established under subchapter A of chapter 4 of subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa">16 U.S.C. 3839aa</external-xref> et seq.).</text>
 </subparagraph><subparagraph commented="no" id="HFD4EFE3F5E394184842123C5E0A9650A"><enum>(C)</enum><text>The conservation stewardship program established under subchapter B of chapter 4 of subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-21">16 U.S.C. 3839aa–21</external-xref> et seq.).</text>
 </subparagraph><subparagraph id="HE5001AA040824696B9CB88AF69FD4BE5"><enum>(D)</enum><text>The agricultural conservation easement program established under subtitle H of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3865">16 U.S.C. 3865</external-xref> et seq.).</text>
					</subparagraph></paragraph></subsection><subsection id="H1759B565C6C24B2ABCF99D4D49001959"><enum>(b)</enum><header>Wildlife movements grant program</header>
 <paragraph id="HA02BD705CD8143CA990D52E4E072DBE0"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a Tribal Wildlife Corridor grant program to encourage wildlife movement in accordance with this Act.</text>
 </paragraph><paragraph id="H688995D1CADE42F8BDFCC3E4572C8F8E"><enum>(2)</enum><header>Grants</header><text>Beginning not later than 3 years after the date of enactment of this Act, the Secretary shall make grants under the program established under paragraph (1) to one or more Indian tribes to increase connectivity through Tribal Wildlife Corridors.</text>
 </paragraph></subsection></section><section id="H92462AA96B7D4DB99A04714DBBF9D515"><enum>7.</enum><header>Savings clause</header><text display-inline="no-display-inline">Nothing in this Act authorizes or affects the use of private property or Indian land.</text> </section></legis-body></bill>
