			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To protect transportation personnel and passengers from sexual assault and harassment, and for
			 other purposes.</official-title></form>
	<legis-body id="H2C9165931F814734987BA7B69DB91620" style="OLC">
 <section id="HE11115167997471CB4F90C0927C19101" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Sexual Assault and Harassment in Transportation Act</short-title></quote>.</text> </section><section id="H1FD2562E83E748C28E84A2340C00204A" section-type="subsequent-section"><enum>2.</enum><header>Formal sexual assault and harassment policies on air carriers and foreign air carriers</header> <subsection id="HE3030970A0CB4EBBB73F0327F92102BB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">Chapter 417</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0D98CD8057E345C6B6158E5EAD29AD3B" style="USC">
					<section id="HBD74A0F32B5C4455B0CC9C3F2658D36A"><enum>41727.</enum><header>Formal sexual assault and harassment policies</header>
 <subsection id="H4CBC7CC78B2441019889BA80FD9FDCA8"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, each air carrier and foreign air carrier transporting passengers for compensation shall issue, in consultation with labor unions representing personnel of the air carrier or foreign air carrier, a formal policy with respect to transportation sexual assault or harassment incidents.</text>
 </subsection><subsection id="HFCC9A9A853594CA39CD810D6A3177CAF"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The policy required under subsection (a) shall include—</text> <paragraph id="HAB1D0D3BDDBF419CB9E23B2035425DF5"><enum>(1)</enum><text display-inline="yes-display-inline">a statement indicating that no transportation sexual assault or harassment incident is acceptable under any circumstance;</text>
 </paragraph><paragraph id="H40C7753FFEDC4248BC8D97B8E166254D"><enum>(2)</enum><text display-inline="yes-display-inline">procedures that facilitate the reporting of a transportation sexual assault or harassment incident, including—</text>
 <subparagraph id="H107D137A48E34B28949E74E9AF5CA739"><enum>(A)</enum><text>appropriate public outreach activities; and</text> </subparagraph><subparagraph id="HCBD571DF3A1A41C6A912DA7B39562A3D"><enum>(B)</enum><text>confidential phone and internet-based opportunities for reporting;</text>
 </subparagraph></paragraph><paragraph id="HB24456B7F1E040EDA3FE1C6B541E0C78"><enum>(3)</enum><text display-inline="yes-display-inline">procedures that personnel should follow upon the reporting of a transportation sexual assault or harassment incident, including actions to protect affected individuals from continued sexual assault or harassment and to notify law enforcement when appropriate;</text>
 </paragraph><paragraph id="H1F7445385498410BA6C43258181A4B4B"><enum>(4)</enum><text display-inline="yes-display-inline">procedures that may limit or prohibit, to the extent practicable, future travel with the air carrier or foreign air carrier by any passenger who causes a transportation sexual assault or harassment incident; and</text>
 </paragraph><paragraph id="H95211AEBE3004867BE5FAA77CB641E57"><enum>(5)</enum><text display-inline="yes-display-inline">training that is required for all appropriate personnel with respect to the policy required under subsection (a), including—</text>
 <subparagraph id="H7843EA8B0A6E4EAA9858E4CA3E60D77D"><enum>(A)</enum><text>specific training for personnel who may receive reports of transportation sexual assault or harassment incidents; and</text>
 </subparagraph><subparagraph id="HEEB84BEA64BE496798C529181BF30E8F"><enum>(B)</enum><text display-inline="yes-display-inline">recognizing and responding to potential human trafficking victims, in the same manner as required under section 44734(a)(4).</text>
 </subparagraph></paragraph></subsection><subsection id="H894B8581D83B4E939A941E546FE73ABA"><enum>(c)</enum><header>Passenger information</header><text display-inline="yes-display-inline">An air carrier or foreign air carrier described in subsection (a) shall prominently display, on the internet website of the air carrier or foreign air carrier and through the use of appropriate signage, a written statement that—</text>
 <paragraph id="HA803A09F4DE14578AB325D2939CB2B4A"><enum>(1)</enum><text display-inline="yes-display-inline">advises passengers and personnel that the carrier has adopted a formal policy with respect to transportation sexual assault or harassment incidents;</text>
 </paragraph><paragraph id="H96391EAB6C86420CB172ECB753E9D6AA"><enum>(2)</enum><text>informs passengers and personnel of the other major components of the carrier’s formal policy, including a statement indicating that no transportation sexual assault or harassment incident is acceptable under any circumstance; and</text>
 </paragraph><paragraph id="H015BE5A2A43D48B18FCCA3768D2A2AD7"><enum>(3)</enum><text display-inline="yes-display-inline">informs passengers and personnel of the procedure for reporting a transportation sexual assault or harassment incident.</text>
 </paragraph></subsection><subsection id="H4DB8DF3AAA6046A9B4137DC6FD854A47"><enum>(d)</enum><header>Standard of care</header><text display-inline="yes-display-inline">Compliance with the requirements of this section, and any policy issued thereunder, shall not determine whether the air carrier or foreign air carrier described in subsection (a) has acted with any requisite standard of care.</text>
 </subsection><subsection id="H5979C0E8D08B4AFBB9E18B6C05C50F92"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H007589A47BEC4E5EB41320148A7D33FF"><enum>(1)</enum><header>Personnel</header><text display-inline="yes-display-inline">The term <term>personnel</term> means an employee or contractor of an air carrier or foreign air carrier.</text>
 </paragraph><paragraph commented="no" id="HC6F22D44D5EF478C80114A4BB72E022F"><enum>(2)</enum><header>Sexual assault</header><text display-inline="yes-display-inline">The term <quote>sexual assault</quote> means the occurrence of an act that constitutes any nonconsensual sexual act proscribed by Federal, tribal, or State law, including when the victim lacks capacity to consent.</text>
 </paragraph><paragraph id="HE8343482B0B5484192BEC54FDFEF7E89"><enum>(3)</enum><header>Transportation sexual assault or harassment incident</header><text display-inline="yes-display-inline">The term <term>transportation sexual assault or harassment incident</term> means the occurrence, or reasonably suspected occurrence, of an act that—</text> <subparagraph id="H2E8A10A1BCF14867BA11521D1530AAD8"><enum>(A)</enum><text>constitutes sexual assault or sexual harassment; and</text>
 </subparagraph><subparagraph id="H7590374074AD4D289C445FCE280E9D27"><enum>(B)</enum><text>is committed—</text> <clause id="HD236DBB003A648D489086F5D536E08C2"><enum>(i)</enum><text display-inline="yes-display-inline">by a passenger or member of personnel of an air carrier or foreign air carrier against another passenger or member of personnel of an air carrier or foreign air carrier; and</text>
 </clause><clause id="H403FF00E1F0C4FDCA5C6ED2A83AF2628"><enum>(ii)</enum><text>within an aircraft or in an area in which passengers are entering or exiting an aircraft.</text> </clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="HC292324D18E944C6B6B71F123E1DA1B1"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

						<toc-entry level="section">41727. Formal sexual assault and harassment policies.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" id="H94BB1AD9B038446088B3925A5606CB3C"><enum>3.</enum><header>Formal sexual assault and harassment policies for certain motor carriers</header>
 <subsection commented="no" id="HF6AC1B9609764CD19006BB36736E5F48"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, each covered motor carrier shall issue, in consultation with labor unions representing personnel of the covered motor carrier, a formal policy with respect to transportation sexual assault or harassment incidents.</text>
 </subsection><subsection commented="no" id="H430E4513F8D74850B79B2A5167B43275"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The policy required under subsection (a) shall include—</text> <paragraph commented="no" id="HC5C684FA26774F1595EC028F7BCA6637"><enum>(1)</enum><text display-inline="yes-display-inline">a statement indicating that no transportation sexual assault or harassment incident is acceptable under any circumstance;</text>
 </paragraph><paragraph commented="no" id="H9545A44D61B54D5CABD1A50BFC5978B9"><enum>(2)</enum><text display-inline="yes-display-inline">procedures that facilitate the reporting of a transportation sexual assault or harassment incident, including—</text>
 <subparagraph commented="no" id="H4B5E8CED2D6248FBBA51F6B0B22D629B"><enum>(A)</enum><text>appropriate public outreach activities; and</text> </subparagraph><subparagraph commented="no" id="H7CD0EB0CD0244D438A702EFEAB4C9C69"><enum>(B)</enum><text>confidential phone and internet-based opportunities for reporting;</text>
 </subparagraph></paragraph><paragraph commented="no" id="H2272D140D0F54C0EAF95421D3E9ABBA4"><enum>(3)</enum><text display-inline="yes-display-inline">procedures that personnel should follow upon the reporting of a transportation sexual assault or harassment incident, including actions to protect affected individuals from continued sexual assault or harassment and to notify law enforcement when appropriate;</text>
 </paragraph><paragraph id="HF0B27FE9155146E69CDAB562500211B7"><enum>(4)</enum><text>procedures that may limit, to the extent practicable, future travel with the covered motor carrier by any passenger who causes a transportation sexual assault or harassment incident; and</text>
 </paragraph><paragraph id="H8D036B169E43460C8DBDE4C9E4932125"><enum>(5)</enum><text display-inline="yes-display-inline">training that is required for all appropriate personnel with respect to the policy required under subsection (a), including—</text>
 <subparagraph id="H3387A63FCA77463B812BE68D955520B8"><enum>(A)</enum><text display-inline="yes-display-inline">specific training for personnel who may receive reports of transportation sexual assault or harassment incidents; and</text>
 </subparagraph><subparagraph id="H133D5927AF22452187C6B5F20EA28562"><enum>(B)</enum><text display-inline="yes-display-inline">recognizing and responding to potential human trafficking victims.</text> </subparagraph></paragraph></subsection><subsection commented="no" id="HA0761156450E497AB0AFAC256240A9F9"><enum>(c)</enum><header>Passenger information</header><text>A covered motor carrier shall prominently display, on the internet website of the covered motor carrier and through the use of appropriate signage, a written statement that—</text>
 <paragraph commented="no" id="HAE6DEAB3291D40A48E7C98AD77E04E12"><enum>(1)</enum><text display-inline="yes-display-inline">advises passengers that the covered motor carrier has adopted a formal policy with respect to transportation sexual assault or harassment incidents;</text>
 </paragraph><paragraph id="H16646E4129E54BAEB92A320F3B98D03F"><enum>(2)</enum><text display-inline="yes-display-inline">informs passengers and personnel of the other major components of the covered motor carrier’s formal policy, including a statement indicating that no transportation sexual assault or harassment incident is acceptable under any circumstance; and</text>
 </paragraph><paragraph commented="no" id="H521880C7677044469CF18C70C5FF6F0E"><enum>(3)</enum><text display-inline="yes-display-inline">informs passengers of the procedure for reporting a transportation sexual assault or harassment incident.</text>
 </paragraph></subsection><subsection id="H11B323E3C4CC4E22BEA0B3587F7723F4"><enum>(d)</enum><header>Standard of care</header><text display-inline="yes-display-inline">Compliance with the requirements of this section, and any policy issued thereunder, shall not determine whether the covered motor carrier has acted with any requisite standard of care.</text>
 </subsection><subsection commented="no" id="H73610362BDD248BF98C53D6173590341"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph commented="no" id="H2742CF22C1634D02BAB4F033EFDAD2A9"><enum>(1)</enum><header>Personnel</header><text display-inline="yes-display-inline">The term <term>personnel</term> means an employee or contractor of a covered motor carrier.</text>
 </paragraph><paragraph commented="no" id="H04C5DE32D392402BA1C6CEBAFD860B36"><enum>(2)</enum><header>Covered motor carrier</header><text display-inline="yes-display-inline">The term <term>covered motor carrier</term> means a motor carrier of passengers that—</text> <subparagraph commented="no" id="H7401B5B8222F46148C75B7B96F5BEFB1"><enum>(A)</enum><text>conducts regularly scheduled intercity service; and</text>
 </subparagraph><subparagraph commented="no" id="HCDEDCEB8B81C4E1690992A049F4A5041"><enum>(B)</enum><text>is a Class I carrier (as that term is used in section 369.3(a) of title 49, Code of Federal Regulations).</text>
 </subparagraph></paragraph><paragraph commented="no" id="HCDAE79C4F4CE4F2E8788A68D2859FB16"><enum>(3)</enum><header>Sexual assault</header><text display-inline="yes-display-inline">The term <quote>sexual assault</quote> means the occurrence of an act that constitutes any nonconsensual sexual act proscribed by Federal, tribal, or State law, including when the victim lacks capacity to consent.</text>
 </paragraph><paragraph commented="no" id="HCCC03B8AFDBF41DB9C56027F58A54051"><enum>(4)</enum><header>Transportation sexual assault or harassment incident</header><text display-inline="yes-display-inline">The term <term>transportation sexual assault or harassment incident</term> means the occurrence, or reasonably suspected occurrence, of an act that—</text> <subparagraph commented="no" id="H9FF4C80A9BD94E0E9AFFE8C3E47E70DF"><enum>(A)</enum><text>constitutes sexual assault or sexual harassment; and</text>
 </subparagraph><subparagraph commented="no" id="H9C891F2AC3804903B7DC790D3C33C087"><enum>(B)</enum><text>is committed—</text> <clause commented="no" id="HAE891B651F68457F97F2F9E194667CC0"><enum>(i)</enum><text display-inline="yes-display-inline">by a passenger or member of personnel of covered motor carrier against another passenger or member of personnel of the covered motor carrier; and</text>
 </clause><clause commented="no" id="HFEA6985A971C497DBE5682FF600D5CF0"><enum>(ii)</enum><text>within a vehicle of the motor carrier or in an area in which passengers are entering or exiting such a vehicle.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="H2F49AF3FD3844BBC8821571B073983E0"><enum>4.</enum><header>Formal sexual assault and harassment policies on passenger commuter and intercity rail</header>
 <subsection id="H5D3C96EBF39D4869A606D21DFA1865CC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/241">Chapter 241</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H5A59D25D88224261BE6687A14641ABAB" style="USC"> <section id="HE1D6BB1DAEC843E9AD4C263FCC909FA4"><enum>24104.</enum><header>Formal sexual assault and harassment policies</header> <subsection id="H69E18928DCC04E3DA72FBD47265F9B50"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, each covered rail entity shall issue, in consultation with labor unions representing personnel with respect to the covered rail entity, a formal policy with respect to transportation sexual assault or harassment incidents.</text>
 </subsection><subsection id="H0385B82278DA4E77AFAB1AB0F4766C01"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The policy required under subsection (a) shall include—</text> <paragraph id="H7A62AEDF2AF74E279F4853F211638D40"><enum>(1)</enum><text display-inline="yes-display-inline">a statement indicating that no transportation sexual assault or harassment incident is acceptable under any circumstance;</text>
 </paragraph><paragraph id="H99D847199EC04C6199C500E73154A39E"><enum>(2)</enum><text display-inline="yes-display-inline">procedures that facilitate the reporting of a transportation sexual assault or harassment incident, including—</text>
 <subparagraph id="HDAC5F0ED38A945FEB2B24DA83622382A"><enum>(A)</enum><text>appropriate public outreach activities; and</text> </subparagraph><subparagraph id="H785C4D96562F456B9F273B22C6A6AEA0"><enum>(B)</enum><text>confidential phone and internet-based opportunities for reporting;</text>
 </subparagraph></paragraph><paragraph id="H777EFB26B1464028810FEE27C7AA96D7"><enum>(3)</enum><text display-inline="yes-display-inline">procedures that personnel should follow upon the reporting of a transportation sexual assault or harassment incident, including actions to protect affected individuals from continued sexual assault or harassment and to notify law enforcement when appropriate;</text>
 </paragraph><paragraph id="HD5E24249B92149C3AAEB562590610B98"><enum>(4)</enum><text display-inline="yes-display-inline">procedures that may limit or prohibit, to the extent practicable, future travel with the covered rail entity by any passenger who causes a transportation sexual assault or harassment incident; and</text>
 </paragraph><paragraph id="HC42F1E4E6FB541D6B0629BCCA546EC5E"><enum>(5)</enum><text display-inline="yes-display-inline">training that is required for all appropriate personnel with respect to the policy required under subsection (a), including—</text>
 <subparagraph id="H47D0825EA1AA4BBAB4203031D016E9FB"><enum>(A)</enum><text display-inline="yes-display-inline">specific training for personnel who may receive reports of transportation sexual assault or harassment incidents; and</text>
 </subparagraph><subparagraph id="HBE5ABF1E018F4A09AF195D1BDA7EEC04"><enum>(B)</enum><text>recognizing and responding to potential human trafficking victims.</text> </subparagraph></paragraph></subsection><subsection id="H2B494755464746CC9CAFE75DC1CD751F"><enum>(c)</enum><header>Passenger information</header><text display-inline="yes-display-inline">A covered rail entity shall prominently display, on the internet website of the entity and through the use of appropriate signage, a written statement that—</text>
 <paragraph id="H391C876800C14584A4CCB73B4EB731AF"><enum>(1)</enum><text display-inline="yes-display-inline">advises passengers and personnel that the covered rail entity has adopted a formal policy with respect to transportation sexual assault or harassment incidents;</text>
 </paragraph><paragraph id="H1A4EA94413544E2783FFE2CAB63DC8E4"><enum>(2)</enum><text display-inline="yes-display-inline">informs passengers and personnel of the other major components of the covered rail entity’s formal policy, including a statement indicating that no transportation sexual assault or harassment incident is acceptable under any circumstance; and</text>
 </paragraph><paragraph id="HC0AF2785F4894ED98A416C274B159A08"><enum>(3)</enum><text display-inline="yes-display-inline">informs passengers and personnel of the procedure for reporting a transportation sexual assault or harassment incident.</text>
 </paragraph></subsection><subsection id="HEEE16414B7764B4C843152AE9F63055E"><enum>(d)</enum><header>Standard of care</header><text display-inline="yes-display-inline">Compliance with the requirements of this section, and any policy issued thereunder, shall not determine whether the covered rail entity has acted with any requisite standard of care.</text>
 </subsection><subsection id="HBEDD37285F4D4F1B8E9D706DDAE716ED"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HF9B028B9ADDA4BA684AC7614310323CE"><enum>(1)</enum><header>Covered rail entity</header><text>The term <quote>covered rail entity</quote> means an entity providing commuter rail passenger transportation or intercity rail passenger transportation.</text>
 </paragraph><paragraph id="HFE26D903C3B34194843DAA450B3AB954"><enum>(2)</enum><header>Personnel</header><text display-inline="yes-display-inline">The term <term>personnel</term> means an employee or contractor of a covered rail entity.</text> </paragraph><paragraph commented="no" id="H9CEE9D0FEB47443BBE583F25D6C39BBE"><enum>(3)</enum><header>Sexual assault</header><text display-inline="yes-display-inline">The term <quote>sexual assault</quote> means the occurrence of an act that constitutes any nonconsensual sexual act proscribed by Federal, tribal, or State law, including when the victim lacks capacity to consent.</text>
 </paragraph><paragraph id="HFFE529711E1B439DAB32C961A5300965"><enum>(4)</enum><header>Transportation sexual assault or harassment incident</header><text display-inline="yes-display-inline">The term <term>transportation sexual assault or harassment incident</term> means the occurrence, or reasonably suspected occurrence, of an act that—</text> <subparagraph id="H7689A0DCB9E84BB39DDA6405667ECC9B"><enum>(A)</enum><text>constitutes sexual assault or sexual harassment; and</text>

 <subsection id="HAFC96A41415B4CA7A053283533CCDBE5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">Chapter 53</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HD9D263BF3264409481B02DB021B2FC71" style="USC"> <section id="HB6B6A8DC345E46A0AF523F7A3C8754D1"><enum>5341.</enum><header>Formal sexual assault and harassment policies</header> <subsection id="H91760F1898044AA8BA2BF279A02D67B5"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, each recipient of Federal funds under this chapter operating vehicles shall issue, in consultation with labor unions representing personnel with respect to the recipient, a formal policy with respect to transportation sexual assault or harassment incidents.</text>
 </subsection><subsection id="H559B7DE8222A464784726D492FD94985"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The policy required under subsection (a) shall include—</text> <paragraph id="HFDAF1CFE013145B8B9AE265EEA03C1ED"><enum>(1)</enum><text display-inline="yes-display-inline">a statement indicating that no transportation sexual assault or harassment incident is acceptable under any circumstance;</text>
 </paragraph><paragraph id="H960CB996979541EE8DB78FE916F341A3"><enum>(2)</enum><text display-inline="yes-display-inline">procedures that facilitate the reporting of a transportation sexual assault or harassment incident, including—</text>
 <subparagraph id="HEC399676D9174B6C910AF0EEA6DCE3FB"><enum>(A)</enum><text>appropriate public outreach activities; and</text> </subparagraph><subparagraph id="H135C1FD8BE8545B883B2E537804DFB92"><enum>(B)</enum><text>confidential phone and internet-based opportunities for reporting;</text>
 </subparagraph></paragraph><paragraph id="H091B3F5778B943809B5D8266AD388B1A"><enum>(3)</enum><text display-inline="yes-display-inline">procedures that personnel should follow upon the reporting of a transportation sexual assault or harassment incident, including actions to protect affected individuals from continued sexual assault or harassment and to notify law enforcement when appropriate;</text>
 </paragraph><paragraph id="H75B74E7872ED4078AA0115AB89B2B9D6"><enum>(4)</enum><text display-inline="yes-display-inline">procedures that may limit, to the extent practicable, future travel with the recipient entity by any passenger who causes a transportation sexual assault or harassment incident; and</text>
 </paragraph><paragraph id="H222AA0CB51374081B063F67948874439"><enum>(5)</enum><text display-inline="yes-display-inline">training that is required for all appropriate personnel with respect to the policy required under subsection (a), including—</text>
 <subparagraph id="HD99D5870B5914BAF94E44CDEF4214605"><enum>(A)</enum><text display-inline="yes-display-inline">specific training for personnel who may receive reports of transportation sexual assault or harassment incidents; and</text>
 </subparagraph><subparagraph id="HB20F493E4FFE4ED9B2D7DEA8E4F5B977"><enum>(B)</enum><text>recognizing and responding to potential human trafficking victims.</text> </subparagraph></paragraph></subsection><subsection id="H3A979D1C7ACD47ABAA9C3B8FC1233ADB"><enum>(c)</enum><header>Passenger information</header><text display-inline="yes-display-inline">A recipient entity shall prominently display, on the internet website of the entity and through the use of appropriate signage, a written statement that—</text>
 <paragraph id="H731687A1DBD74E15983828BBFF9247F2"><enum>(1)</enum><text display-inline="yes-display-inline">advises passengers and personnel that the recipient entity has adopted a formal policy with respect to transportation sexual assault or harassment incidents;</text>
 </paragraph><paragraph id="H2332C4FEE2144DF2ACDAB9653FC4369C"><enum>(2)</enum><text display-inline="yes-display-inline">informs passengers and personnel of the other major components of the recipient entity’s formal policy, including a statement indicating that no transportation sexual assault or harassment incident is acceptable under any circumstance; and</text>
 </paragraph><paragraph id="HB48B38AEC58240E5A0EEF7B175C22EF6"><enum>(3)</enum><text display-inline="yes-display-inline">informs passengers and personnel of the procedure for reporting a transportation sexual assault or harassment incident.</text>
 </paragraph></subsection><subsection id="HF0A5C5913194458F9995F1EDD2DA988E"><enum>(d)</enum><header>Standard of care</header><text display-inline="yes-display-inline">Compliance with the requirements of this section, and any policy issued thereunder, shall not determine whether the recipient entity has acted with any requisite standard of care.</text>
 </subsection><subsection id="HBC80F32301674F578B12013F0F01A755"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HA4E182D1B6474F4CAB4FB8508FFDCCCB"><enum>(1)</enum><header>Personnel</header><text display-inline="yes-display-inline">The term <term>personnel</term> means an employee or contractor of a recipient of Federal funds under this chapter.</text>
 </paragraph><paragraph commented="no" id="H3C1ED27D9E974B5AB5DAA4CE08BFB1B1"><enum>(2)</enum><header>Sexual assault</header><text display-inline="yes-display-inline">The term <quote>sexual assault</quote> means the occurrence of an act that constitutes any nonconsensual sexual act proscribed by Federal, tribal, or State law, including when the victim lacks capacity to consent.</text>
 </paragraph><paragraph id="H6B26C7F767524E66B3FAD34971BEB684"><enum>(3)</enum><header>Transportation sexual assault or harassment incident</header><text display-inline="yes-display-inline">The term <term>transportation sexual assault or harassment incident</term> means the occurrence, or reasonably suspected occurrence, of an act that—</text> <subparagraph id="H5400F8A020784B9187F2EA7DA9CB619C"><enum>(A)</enum><text>constitutes sexual assault or sexual harassment; and</text>
 </subparagraph><subparagraph id="HF27EAA6D4CD24F2282A09C14B454311F"><enum>(B)</enum><text>is committed—</text> <clause id="H6966793D7C2E48CE872C21136DC6C587"><enum>(i)</enum><text display-inline="yes-display-inline">by a passenger or member of personnel of recipient entity against another passenger or member of personnel of the recipient entity; and</text>
 </clause><clause id="H73A7EFB7EB1E4B9CB7FE62D40E857A84"><enum>(ii)</enum><text>within a vehicle of the recipient entity or in an area in which passengers are entering or exiting such a vehicle.</text>
									</clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H101AEC95B66F4B19B5DB06054EB31958"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

 <subsection id="H86B6FB35D6664107BB48E187A524237C"><enum>(a)</enum><header>In general</header><text>Section 3507(d) of title 46, United States Code, is amended—</text> <paragraph id="H41C75FEA830643D897AEADB6DD5123DE"><enum>(1)</enum><text>in paragraph (4), by striking <quote>and</quote> after the semicolon at the end;</text>
 </paragraph><paragraph id="H6A2D6F17E9A4463CB76AFE8A2EE65E92"><enum>(2)</enum><text>in paragraph (5), by striking the period at the end and inserting a semicolon; and</text> </paragraph><paragraph id="H702F2824C9784D16BD9DA1EA14566642"><enum>(3)</enum><text>by adding at the end the following:</text>

 </clause><clause id="H58EFF7A6163A433AAAD330D2414735BA" indent="up1"><enum>(ii)</enum><text>procedures that facilitate the reporting of a sexual assault or harassment incident, including—</text> <subclause id="H04623794651B490D8B0C5A4D84DBA793"><enum>(I)</enum><text>appropriate public outreach activities; and</text>
 </subclause><subclause id="HE631BFADA51B4495BB0AEC3140C9DB4B"><enum>(II)</enum><text>confidential phone and internet-based opportunities for reporting;</text> </subclause></clause><clause id="HBEC8990579CD4D14AA7AE2E2B5EDB756" indent="up1"><enum>(iii)</enum><text>procedures that personnel should follow upon the reporting of a sexual assault or harassment incident, including actions to protect affected individuals from continued sexual assault or harassment and how to provide the information and access required under paragraph (5);</text>
 </clause><clause id="HDE9536B485A54874B9FFA84AAEA4866D" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">procedures that may limit or prohibit, to the extent practicable, future travel on the vessel by any passenger who causes a transportation sexual assault or harassment incident; and</text>
 </clause><clause id="HFF59F0CD06C647188AABB2B5053A6183" indent="up1"><enum>(v)</enum><text display-inline="yes-display-inline">training that is required for all appropriate personnel with respect to the policy required under this paragraph, including—</text>
 <subclause id="H85109FBF88F04CB399D9026CE48E6821"><enum>(I)</enum><text>specific training for personnel who may receive reports of sexual assault or harassment incidents; and</text>
 </subclause><subclause id="HAFBD027CC72E4F7F9587E5E8C2870BC0"><enum>(II)</enum><text display-inline="yes-display-inline">recognizing and responding to potential human trafficking victims; and</text> </subclause></clause></subparagraph><subparagraph id="HA017853AAF9D4B2F876ED1469FBD0B95" indent="up1"><enum>(B)</enum><text>prominently display on the internet website of the vessel owner and, through the use of appropriate signage on each vessel, a written statement that—</text>
 <clause id="H69FC515D420443008A78726F398EB487"><enum>(i)</enum><text>advises passengers and crew members that the vessel owner has adopted a formal policy with respect to sexual assault or harassment incidents;</text>
 </clause><clause id="H85EC1DCFEFB440BCB2138B1FC5457071"><enum>(ii)</enum><text display-inline="yes-display-inline">informs passengers and personnel of the other major components of the vessel owner’s formal policy, including a statement indicating that no transportation sexual assault or harassment incident is acceptable under any circumstance; and</text>
 </clause><clause id="H73497D14FED04D758A91846332C5568F"><enum>(iii)</enum><text>informs passengers and crew members of the procedure for reporting a sexual assault or harassment incident; and</text>
 </clause></subparagraph></paragraph><paragraph id="H1C04C325386F469D8D29E95EE4D1A794"><enum>(7)</enum><text display-inline="yes-display-inline">have a formal policy in effect with respect to sexual assault or harassment incidents.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="HD395898BC7B2464DB685D167E3F77B13"><enum>(b)</enum><header>Reporting requirement</header><text>Section 3507(g)(3)(A)(i) of title 46, United States Code, is amended by inserting <quote>any sexual assault or harassment incident (as that term is defined in subsection (l) of this section) that constitutes a violation of law,</quote> after <quote>title 18 applies,</quote>.</text>
 </subsection><subsection id="H501F8253C7D0415ABF8663D706157D86"><enum>(c)</enum><header>Standard of care</header><text display-inline="yes-display-inline">Compliance with the requirements of the amendments made by this section, and any policy issued thereunder, shall not determine whether the applicable owner of a vessel covered by such amendments has acted with any requisite standard of care.</text>
 </subsection><subsection commented="no" id="HC9B7B691FF204092BBA165767C28CFF2"><enum>(d)</enum><header>Definitions</header><text>Section 3507(l) of title 46, United States Code, is amended to read as follows:</text> <quoted-block id="H5D87B923572048A4968E3101AA79B7D3" style="OLC"> <subsection id="H5D84CC72B61C4CA3B1A231288013818F"><enum>(l)</enum><header>Definitions</header> <paragraph id="H8936CA7725A841D69E2402971CA148A2"><enum>(1)</enum><header>Owner</header><text display-inline="yes-display-inline">In this section and section 3508, the term <quote>owner</quote> means the owner, charterer, managing operator, master, or other individual in charge of a vessel.</text>
 </paragraph><paragraph commented="no" id="HB387837D4EEB48AB8E16315F2531B114"><enum>(2)</enum><header>Sexual assault</header><text display-inline="yes-display-inline">The term <quote>sexual assault</quote> means the occurrence of an act that constitutes any nonconsensual sexual act proscribed by Federal, tribal, or State law, including when the victim lacks capacity to consent.</text>
 </paragraph><paragraph id="H8E4EDD9D303A44FB9E3F5E4D34916DCA"><enum>(3)</enum><header>Sexual assault or harassment incident</header><text display-inline="yes-display-inline">The term <term>sexual assault or harassment incident</term> means the occurrence, or reasonably suspected occurrence, of an act that—</text> <subparagraph id="H083764F96CAC41688FC01B15795C2129"><enum>(A)</enum><text>constitutes sexual assault or sexual harassment; and</text>
 </subparagraph><subparagraph commented="no" id="H771786170005493B99BFB14D18D15312"><enum>(B)</enum><text>is committed—</text> <clause commented="no" id="H0175AD893F7D49C388470FC02CF5055F"><enum>(i)</enum><text>by a passenger of a vessel to which this section applies or a member of the crew of such a vessel against another passenger of such vessel or a member of the crew of such a vessel; and</text>
 </clause><clause commented="no" id="H37032808E7484AB0BFF3B65189A040D0"><enum>(ii)</enum><text>within—</text> <subclause commented="no" id="HD4F6294B8FE0490BACAD741ABA132B4E"><enum>(I)</enum><text>such a vessel; or</text>
 </subclause><subclause commented="no" id="H58653A41BAD74DB8989AD8FBED58F724"><enum>(II)</enum><text>an area in which passengers are entering or exiting such a vessel.</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="HBE221182F432494E878A22D3C05A91D3"><enum>(e)</enum><header>Maintenance and placement of video surveillance equipment</header><text>Section 3507(b)(1) of title 46, United States Code, is amended—</text>
 <paragraph id="H0F0687C15C0E4609AF890F5878228814"><enum>(1)</enum><text>by striking <quote>The owner</quote> and inserting the following:</text> <quoted-block id="H77C416731FA8471786C8CFAE75D22CCC" style="OLC"> <subparagraph id="H3359457645974C0FBFF6DC0689110094"><enum>(A)</enum><header>In general</header><text>The owner</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>

 <subparagraph id="H72BDE5DD9EC64A878CD947A88060AF90"><enum>(B)</enum><header>Placement of video surveillance equipment</header><text>With regard to the placement of video surveillance equipment on a vessel under subparagraph (A), the owner shall—</text>
 <clause id="HB1ED376227884F0EACBCD87B5A42CEE5"><enum>(i)</enum><text>place video surveillance equipment in each passenger common area where a person has no reasonable expectation of privacy;</text>
 </clause><clause id="HE4DDD4F65CFB40AFB7694610ED0D12D1"><enum>(ii)</enum><text>place video surveillance equipment in other areas where a person has no reasonable expectation of privacy; and</text>
 </clause><clause id="H4CA914E35739460F9E1154BFDA9AF763"><enum>(iii)</enum><text>place video surveillance equipment in each area identified under clause (i) or (ii) in a manner that provides optimum surveillance of that area.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H0792E7CC3714441AB466BE5F9E77010F"><enum>(f)</enum><header>Notice of video surveillance</header><text>Section 3507(b), of title 46, United States Code, is further amended by inserting after paragraph (1) the following:</text>
				<quoted-block id="HA55929D464514533AAE5E2F3DCCF6844" style="OLC">
 <paragraph id="H55017C3BEACC492BAC39D51F182E1CE2"><enum>(2)</enum><header>Notice of video surveillance</header><text>The owner of a vessel to which this section applies shall provide clear and conspicuous signs on board the vessel notifying the public of the presence of video surveillance equipment.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HAE8344FDAAAC48B5A258A2BC3749CB27"><enum>(g)</enum><header>Access to video records</header><text>Section 3507(b), of title 46, United States Code, is further amended—</text> <paragraph id="H46DEDCC699834673B164F5B05548331C"><enum>(1)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text>
 </paragraph><paragraph id="HEFDE2246AEBF4E92983A098A510C3553"><enum>(2)</enum><text>in paragraph (3), as so redesignated—</text> <subparagraph id="H4B01DE96B3FC41F3BF3D557EE7048D0B"><enum>(A)</enum><text>by striking <quote>The owner</quote> and inserting the following:</text>
						<quoted-block id="HAEF4B35CA8934F8E91F73111FFF1AEBA" style="OLC">

 <subparagraph id="H96A1CE18BC2D49CD89DE8EA7DA360A88"><enum>(B)</enum><header>Civil actions</header><text>The owner of a vessel to which this section applies shall provide to any individual or the individual’s legal representative, upon written request, a copy of all records of video surveillance—</text>
 <clause id="H8A5166769AB8404CBD9FB27034D0598A"><enum>(i)</enum><text>in which the individual is a subject of the video surveillance; and</text> </clause><clause id="HCD561BD84FDC4196851E92A5E4F1A101"><enum>(ii)</enum><text>that may provide evidence in a civil action.</text>
 </clause></subparagraph><subparagraph commented="no" id="H16057707B7F14FFC9AF87639988F4934"><enum>(C)</enum><header>Limited access</header><text display-inline="yes-display-inline">The owner of a vessel to which this section applies shall ensure that access to records of video surveillance is limited to the purposes described in this paragraph.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></subsection><subsection id="H42E5DDA88B0D41D38527B868F8252DFE"><enum>(h)</enum><header>Retention requirements</header><text>Section 3507(b), of title 46, United States Code, is further amended by adding at the end the following:</text>
				<quoted-block id="HF0467296CE894FDC82045B5AB07507F7" style="OLC">
					<paragraph id="H526D9FFB686B4E0DA2FDF3289ABB25B6"><enum>(4)</enum><header>Retention requirements</header>
 <subparagraph id="H8E799CB47B7B4D7381D42D4E9323582B"><enum>(A)</enum><header>In general</header><text>The owner of a vessel to which this section applies shall retain all records of video surveillance for a voyage for not less than 90 days after the completion of the voyage. If an incident described in subsection (g)(3)(A)(i) is alleged and reported to law enforcement, all records of video surveillance from the voyage that the Federal Bureau of Investigation determines are relevant shall—</text>
 <clause id="HDFA9FF3BBDFF430D8B3BA4AAAB232C13"><enum>(i)</enum><text>be provided to the Federal Bureau of Investigation; and</text> </clause><clause id="HD1FE689ACA76496384B76016F3BAB332"><enum>(ii)</enum><text>be preserved by the vessel owner for not less than 5 years from the date of the alleged incident.</text>
 </clause></subparagraph><subparagraph id="HC7964EC3FBCD4F708C67B7FF3882D4CE"><enum>(B)</enum><header>Interim standards</header><text>Not later than 180 days after the date of enactment of the <short-title>Stop Sexual Assault and Harassment in Transportation Act</short-title>, the Commandant, in consultation with the Federal Bureau of Investigation, shall promulgate interim standards for the retention of records of video surveillance.</text>
 </subparagraph><subparagraph id="H43654F3AD0594639BEE2AE1CE703D775"><enum>(C)</enum><header>Final standards</header><text>Not later than 1 year after the date of enactment of the <short-title>Stop Sexual Assault and Harassment in Transportation Act</short-title>, the Commandant, in consultation with the Federal Bureau of Investigation, shall promulgate final standards for the retention of records of video surveillance.</text>
 </subparagraph><subparagraph id="HF2315151ADBA4DF2A12A234BCDC245D1"><enum>(D)</enum><header>Considerations</header><text>In promulgating standards under subparagraphs (B) and (C), the Commandant shall—</text> <clause id="H7A901D4450764466A78553E04EEA9FB7"><enum>(i)</enum><text>consider factors that would aid in the investigation of serious crimes, including crimes that go unreported until after the completion of a voyage;</text>
 </clause><clause id="H97212BD017C748CDAB82A456BC885BA4"><enum>(ii)</enum><text>consider the different types of video surveillance systems and storage requirements in creating standards both for vessels currently in operation and for vessels newly built;</text>
 </clause><clause id="H12CF7D57A2434C82B4AD2448010587F1"><enum>(iii)</enum><text>consider privacy, including standards for permissible access to and monitoring and use of the records of video surveillance; and</text>
 </clause><clause id="H8C7B8C48190B47498A1B3FF92138722B"><enum>(iv)</enum><text>consider technological advancements, including requirements to update technology.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H0205761A176045C9908CE1E5DA9D2537"><enum>(i)</enum><header>Implementation</header><text>Not later than 180 days after the date of enactment of this Act, the owner of a vessel to which section 3507 of title 46, United States Code, applies shall issue the formal policy with respect to sexual assault or harassment incidents required by the amendments made by this section.</text>
			</subsection></section><section id="HDDB64FE07AC64B1BB1355B87868B1719"><enum>7.</enum><header>Civil penalties for interference with certain transportation personnel</header>
 <subsection id="HA167E31CDAD644DD9DD769DB4849BA20"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/805">Chapter 805</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H9F6F6ADF3C194AFD9651C235F9A624F4" style="USC"> <section id="H95CFF5436ACB4CBE9CF479F992D2EF60"><enum>80505.</enum><header>Interference with certain transportation personnel </header> <subsection id="H292043D18EF34E06B05809E69631E26B"><enum>(a)</enum><header>General rule</header><text display-inline="yes-display-inline">An individual who physically or sexually assaults or threatens to physically or sexually assault an employee engaged in the transportation of passengers on behalf of a covered entity, or takes any action that poses an imminent threat to the safety of a vehicle of a covered entity that is transporting passengers, including rolling stock, motorcoaches, and ferries, is liable to the United States Government for a civil penalty of—</text>
 <paragraph id="HCE6E9A1DF2A74C37B47929172CAC03C1"><enum>(1)</enum><text>for calendar years 2019 through 2024, not more than $35,000;</text> </paragraph><paragraph id="HA63E2C64375B4B56A4A8498ECE8D1A91"><enum>(2)</enum><text>for calendar years 2025 through 2029, not more than $40,000; and</text>
 </paragraph><paragraph id="HBBC707F6032A487A9A0BB452B54F2963"><enum>(3)</enum><text>for calendar year 2030 and thereafter, not more than $45,000.</text> </paragraph></subsection><subsection id="HB2845DECE3F04E91802F7F96BDB54C84"><enum>(b)</enum><header>Compromise and setoff</header> <paragraph id="HC939F58FCBA44683BB7E5AEA742B0244"><enum>(1)</enum><header>Compromise</header><text>The Secretary of Transportation may compromise the amount of a civil penalty imposed under this section.</text>
 </paragraph><paragraph id="HBB6515C3C6F947709D19ADF75C704378"><enum>(2)</enum><header>Setoff</header><text>The United States Government may deduct the amount of a civil penalty imposed or compromised under this section from amounts the Government owes the person liable for the penalty.</text>
 </paragraph></subsection><subsection id="HF8159774C007465F9F6D6BA1F158533E"><enum>(c)</enum><header>Covered entity defined</header><text display-inline="yes-display-inline">In this section, the term <term>covered entity</term> means an entity that is 1 of the following:</text> <paragraph id="HCD175DC2A1B14EAC927B836B0B137D0F"><enum>(1)</enum><text>A recipient of Federal funds under chapter 53 of this title.</text>
 </paragraph><paragraph id="HA26ED873A00D4946892C9F3F5AA7016B"><enum>(2)</enum><text>A motor carrier of passengers that—</text> <subparagraph id="H15BA9131089C40A6935958F4F4AC9DD1"><enum>(A)</enum><text>conducts regularly scheduled intercity service; and</text>
 </subparagraph><subparagraph id="H58EC19FB61D14010A11A78996AF0E084"><enum>(B)</enum><text>is a Class I carrier (as that term is used in section 369.3(a) of title 49, Code of Federal Regulations).</text>
 </subparagraph></paragraph><paragraph id="H128FC32F3FCD4D69957CB6195B40F096"><enum>(3)</enum><text display-inline="yes-display-inline">An entity providing commuter rail passenger transportation or intercity rail passenger transportation (as those terms are defined in section 24102 of this title).</text>
 </paragraph><paragraph id="H84BF436811FD45F78ABEB657C50C8F97"><enum>(4)</enum><text>The owner of a vessel for which section 3507 of title 46 applies.</text> </paragraph><paragraph id="H58A7B9E5FD424DC39A97749527D94C94"><enum>(5)</enum><text>A transportation network company.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HEE2B494C47BC41668382EA5481B980CA"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/805">chapter 805</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/80504">section 80504</external-xref> the following:</text>

 </subsection><subsection id="HABDFD16F56974246B676A2E624ED9653"><enum>(c)</enum><header>Graduated fines for interference with cabin or flight crew</header><text display-inline="yes-display-inline">Section 46318(a) of title 49, United States Code, is amended by striking <quote>penalty of not more than $35,000.</quote> and inserting the following:</text> <quoted-block display-inline="yes-display-inline" id="H171CDC0DEBAB408D9D0B92CF8ABDE7A4" style="USC"> <text>penalty of—</text><paragraph id="H96D6051DAA9448E5BC4D4AF6064C57AC"><enum>(1)</enum><text>for calendar years 2019 through 2024, not more than $35,000;</text> </paragraph><paragraph id="H9038738A948645218126C695F71D2551"><enum>(2)</enum><text>for calendar years 2025 through 2029, not more than $40,000; and</text>
 </paragraph><paragraph id="HB711401102D744E8BD7E93651564D019"><enum>(3)</enum><text>for calendar year 2030 and thereafter, not more than $45,000.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section><section id="HA9FBB60C09E64893A2D6F49EB1A7B08E"><enum>8.</enum><header>Formal sexual assault and harassment policies for transportation network companies</header> <subsection id="H16AA8D441C2D42A5A0043901BCF257BF"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, each transportation network company shall issue, in consultation with labor unions representing TNC drivers of each such transportation network company, if applicable, a formal policy with respect to transportation sexual assault or harassment incidents.</text>
 </subsection><subsection id="HC698550D11944F1796D335216725CDD7"><enum>(b)</enum><header>Contents</header><text>The policy required under subsection (a) shall include—</text> <paragraph id="H33B81075256F481A94AA19D167D86AEA"><enum>(1)</enum><text>a statement indicating that no transportation sexual assault or harassment incident is acceptable under any circumstance;</text>
 </paragraph><paragraph id="HB26732DCEEC442F79FC6890A8D9A5179"><enum>(2)</enum><text>procedures that facilitate the reporting of a transportation sexual assault or harassment incident, including—</text>
 <subparagraph id="H5BA42FC1FBB5464A817705191115F95F"><enum>(A)</enum><text>appropriate public outreach activities; and</text> </subparagraph><subparagraph id="H79AF1B8DEC9248D8A96DDF2FEAF853EC"><enum>(B)</enum><text>confidential phone and internet-based opportunities for reporting;</text>
 </subparagraph></paragraph><paragraph id="HDABB802438F44E38A19D5B5403AD68A2"><enum>(3)</enum><text>procedures that TNC personnel should follow upon the reporting of a transportation sexual assault or harassment incident, including actions to protect affected individuals from continued sexual assault or harassment and to notify law enforcement when appropriate;</text>
 </paragraph><paragraph id="H2B183AF303104D3FB40448842174F726"><enum>(4)</enum><text display-inline="yes-display-inline">procedures that may limit or prohibit, to the extent practicable, future use of the transportation network company platform by any passenger or TNC driver who causes a transportation sexual assault or harassment incident; and</text>
 </paragraph><paragraph id="H56DD7F2CF295475C8C4082F8432B256F"><enum>(5)</enum><text display-inline="yes-display-inline">training that is required for all appropriate personnel with respect to the policy required under subsection (a), including—</text>
 <subparagraph id="H88C612B5610E4811BE8E8965AD76EA96"><enum>(A)</enum><text>specific training for such personnel who may receive reports of transportation sexual assault or harassment incidents; and</text>
 </subparagraph><subparagraph id="HCDBA07C9BCB74C9FBBDD8937AB3A7CDC"><enum>(B)</enum><text>recognizing and responding to potential human trafficking victims.</text> </subparagraph></paragraph></subsection><subsection id="HE39531A22D5541678A3F27A1385BFF84"><enum>(c)</enum><header>Passenger information</header><text display-inline="yes-display-inline">A transportation network company shall prominently display, on the internet website of the company and through the use of appropriate signage, a written statement that—</text>
 <paragraph id="H3FEC19C52E5E440C8B977FA51C76C1FD"><enum>(1)</enum><text display-inline="yes-display-inline">advises passengers that the transportation network company has adopted a formal policy with respect to transportation sexual assault or harassment incidents;</text>
 </paragraph><paragraph id="HD4576CF676C64B87A535BD68E12B9A7B"><enum>(2)</enum><text display-inline="yes-display-inline">informs passengers, TNC drivers, and TNC personnel of the other major components of the transportation network company’s formal policy, including a statement indicating that no transportation sexual assault or harassment incident is acceptable under any circumstance; and</text>
 </paragraph><paragraph id="H2E8BDD766D314DF695B7A8427DA6B385"><enum>(3)</enum><text>informs passengers of the procedure for reporting a transportation sexual assault or harassment incident.</text>
 </paragraph></subsection><subsection id="H74C9CEA9441146DDBD3660F02AE57476"><enum>(d)</enum><header>Standard of care</header><text display-inline="yes-display-inline">Compliance with the requirements of this section, and any policy issued thereunder, shall not determine whether the transportation network company has acted with any requisite standard of care.</text>
			</subsection></section><section display-inline="no-display-inline" id="H2EDE017AE0CA42A5B3AA9AD715E4F381" section-type="subsequent-section"><enum>9.</enum><header>Data collection</header>
 <subsection id="HD9262376DE3740BAA2925586185D409F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall establish a program to annually collect and maintain data from each covered entity on—</text>
 <paragraph id="HD4245442AEA249E4ADCF5344601E54C1"><enum>(1)</enum><text display-inline="yes-display-inline">the number of transportation sexual assault or harassment incidents reported to the covered entity, including—</text>
 <subparagraph id="H894B5457CDA549DBBC0227D6FE41E311"><enum>(A)</enum><text>the number of incidents committed against passengers; and</text> </subparagraph><subparagraph id="HA67EC67052444530AABDA15494EF4765"><enum>(B)</enum><text>the number of incidents committed against personnel or, in the case of a TNC, a TNC driver;</text>
 </subparagraph></paragraph><paragraph id="H0319711F56664FC49BC29CC6FAB84648"><enum>(2)</enum><text display-inline="yes-display-inline">the number of transportation sexual assault or harassment incidents reported to law enforcement by personnel of the covered entity; and</text>
 </paragraph><paragraph id="H8A3EAF54FFC74E21872410FFDBF2FAF2"><enum>(3)</enum><text display-inline="yes-display-inline">any transportation sexual assault or harassment incidents compiled and maintained under section 3507(g)(4)(A)(i) of title 46, United States Code.</text>
 </paragraph></subsection><subsection id="H2031CDC4FB814008B8145B25F9F8282A"><enum>(b)</enum><header>Data availability</header><text display-inline="yes-display-inline">Subject to subsection (c), the Secretary shall make available to the public on the primary internet website of the Department of Transportation the data collected and maintained under subsection (a).</text>
 </subsection><subsection id="H62861672C03040FE8487F323D1E01127"><enum>(c)</enum><header>Data protection</header><text display-inline="yes-display-inline">Data made available under subsection (b) shall be made available in a manner that—</text> <paragraph id="H1CCB5D68F3944147B1533A39FF6E492D"><enum>(1)</enum><text display-inline="yes-display-inline">protects the privacy and confidentiality of individuals involved in a transportation sexual assault or harassment incident;</text>
 </paragraph><paragraph id="HC63DA60E50444575B9E73B53AAF49333"><enum>(2)</enum><text>precludes the connection of the data to any individual covered entity; and</text> </paragraph><paragraph id="H32C013FBD04B4103B994D2BA6F8C9BA3"><enum>(3)</enum><text>is organized by mode of transportation.</text>
 </paragraph></subsection><subsection id="H1B0EFD8BDA7A4CD78AEB8DF701B862F1"><enum>(d)</enum><header>Paperwork reduction</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, does not apply to this Act.</text> </subsection></section><section id="H3F29B6F4719440508BEF1A0B5BCBEB9D"><enum>10.</enum><header>Criminal reporting process</header> <text display-inline="no-display-inline">The Attorney General, in coordination with the Secretary of Transportation, shall expand the process required to be established under section 339B of the FAA Reauthorization Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/254">Public Law 115–254</external-xref>) to provide for a streamlined process for any individuals involved in alleged transportation sexual assault or harassment incidents that constitute a violation of law to report those allegations to law enforcement in a manner that protects the privacy and confidentiality of individuals involved in such allegations and through the same primary internet websites as provided under subsection (b) of such section, as determined appropriate by the Attorney General.</text>
 </section><section id="H67C9074DDADF4439BAE07FC07B77651C"><enum>11.</enum><header>Inspector General report to Congress</header><text display-inline="no-display-inline">Not later than 18 months after the date of enactment of this Act, and every 2 years thereafter, the inspector general of the Department of Transportation shall assess compliance with the provisions of this Act and the amendments made by this Act, including the accuracy of the reporting of transportation sexual assault or harassment incidents by covered entities.</text>
		</section><section id="HD70DC1CF6CFB4564B9DA8A412BAD97FF"><enum>12.</enum><header>Definition of sexual harassment</header>
 <subsection id="H0DCC0A063EE84648A8C8B8E7E8C2BF77"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall develop, and publish in the Federal Register, a definition of sexual harassment for purposes of the implementation of this Act and the amendments made by this Act.</text>
 </subsection><subsection id="H998B762C97134DE3A1F9A0E157F0A8FE"><enum>(b)</enum><header>Consultation</header><text display-inline="yes-display-inline">In developing the definition under subsection (a), the Secretary shall consult with, and consider input from—</text>
 <paragraph id="H91968F72E3DC4EC58B0A4FE1C7E65557"><enum>(1)</enum><text>labor unions representing transportation workers employed by covered entities; and</text> </paragraph><paragraph id="HDE2E3DDB61F2401E9D7CA0A9C51B2C40"><enum>(2)</enum><text>national organizations that specialize in providing services to sexual assault victims.</text>
 </paragraph></subsection></section><section id="HFB90EA96E3B94FEBA16E31D78BBF5680"><enum>13.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HEEB8392B1A6D488E8514F5657426B8B9"><enum>(1)</enum><header>Covered entity</header><text display-inline="yes-display-inline">The term <term>covered entity</term> means an entity that is one of the following:</text>
 <subparagraph id="H1B6904E0159245379D80BEDB3D29608E"><enum>(A)</enum><text>An air carrier (as that term is defined in section 40102 of title 49, United States Code) that transports passengers for compensation.</text>
 </subparagraph><subparagraph id="H43D2BB44E40A415E91117DCF8A4CB719"><enum>(B)</enum><text display-inline="yes-display-inline">A foreign air carrier (as that term is defined in section 40102 of title 49, United States Code) that transports passengers for compensation.</text>
 </subparagraph><subparagraph id="H4178EDCED7FD4AD080992A2071DD7291"><enum>(C)</enum><text>A recipient of Federal funds under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code.</text> </subparagraph><subparagraph id="H12D7235564D143CDAD63EF71ED3669B1"><enum>(D)</enum><text>A motor carrier of passengers that—</text>
 <clause id="H6FD65B63BF2A4FCC98E79091CACEBFD6"><enum>(i)</enum><text>conducts regularly scheduled intercity service; and</text> </clause><clause id="HBB4F36C584514137AEC3641CBBA46CAA"><enum>(ii)</enum><text>is a Class I carrier (as that term is used in section 369.3(a) of title 49, Code of Federal Regulations).</text>
 </clause></subparagraph><subparagraph id="H3B62E6CE90914272B619DD78AE99BAD8"><enum>(E)</enum><text display-inline="yes-display-inline">An entity providing commuter rail passenger transportation or intercity rail passenger transportation (as those terms are defined in section 24102 of title 49, United States Code).</text>
 </subparagraph><subparagraph id="H523DE8F180E743D28D4A75A767D416E4"><enum>(F)</enum><text>The owner of a vessel for which section 3507 of title 46, United States Code, applies.</text> </subparagraph><subparagraph id="H90125F27F0E54664842B28C4D48D031A"><enum>(G)</enum><text>A transportation network company.</text>
 </subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HE87B6921E1204355A3BCAFB18D08E2F2"><enum>(2)</enum><header>Sexual assault</header><text display-inline="yes-display-inline">The term <quote>sexual assault</quote> means the occurrence of an act that constitutes any nonconsensual sexual act proscribed by Federal, tribal, or State law, including when the victim lacks capacity to consent.</text>
 </paragraph><paragraph display-inline="no-display-inline" id="HC2B6B179F0B64FFC984F6E953A1FF3D7"><enum>(3)</enum><header>TNC driver</header><text display-inline="yes-display-inline">The term <term>TNC driver</term> means an individual who is employed, contracted by, or otherwise affiliated with a transportation network company to provide transportation services (also known as ride-sharing) to the public.</text>
 </paragraph><paragraph id="H9931770DBCBF47DDBD828A054B24CF52"><enum>(4)</enum><header>TNC personnel</header><text display-inline="yes-display-inline">The term <quote>TNC personnel</quote> means an employee or contractor of a covered transportation network company, other than a TNC driver.</text>
 </paragraph><paragraph id="H987AADD0DEAD449D9C305C7A9481156E"><enum>(5)</enum><header>Transportation network company</header><text display-inline="yes-display-inline">The term <term>transportation network company</term>—</text> <subparagraph id="H0DFD8687BB874F2899B81D154D4C6E06"><enum>(A)</enum><text display-inline="yes-display-inline">means a corporation, partnership, sole proprietorship, or other entity, that uses a digital network to connect riders to drivers affiliated with the entity in order for the driver to transport the rider using a vehicle owned, leased, or otherwise authorized for use by the driver to a point chosen by the rider; and</text>
 </subparagraph><subparagraph id="H8D67C5876EBA4EDAB53F2C0F6C3A850B"><enum>(B)</enum><text>does not include a shared-expense carpool or vanpool arrangement that is not intended to generate profit for the driver.</text>
 </subparagraph></paragraph><paragraph id="HD55478B36A21438FA7D9D7CBCA3C228E"><enum>(6)</enum><header>Transportation sexual assault or harassment incident</header><text display-inline="yes-display-inline">The term <term>transportation sexual assault or harassment incident</term> means the occurrence, or reasonably suspected occurrence, of an act that—</text> <subparagraph id="HFA6905A8AF3B43B9B9D99F5D09524ED8"><enum>(A)</enum><text>constitutes sexual assault or sexual harassment; and</text>
 </subparagraph><subparagraph id="H0B4C0E48A4D447329BF7FB795ED4A7E8"><enum>(B)</enum><text>is committed—</text> <clause id="H181CFC7824E649CF9A738517C30C4223"><enum>(i)</enum><text display-inline="yes-display-inline">by a passenger or a member of the personnel of a covered entity, or in the case of a TNC, a TNC driver of the covered entity, against another passenger or member of personnel or TNC driver of the covered entity; and</text>
 </clause><clause id="H13EC0581409C4DB9804DD921E5C7F41A"><enum>(ii)</enum><text>within—</text> <subclause id="HD36B5A5EB58D47088BDC547FEB7B17ED"><enum>(I)</enum><text>a vehicle of the covered entity that is transporting passengers, including aircraft, rolling stock, motorcoaches, and ferries; or</text>
 </subclause><subclause id="HE49F97B073B045ADA2E8E456344568E6"><enum>(II)</enum><text>an area in which passengers are entering or exiting such a vehicle.</text> </subclause></clause></subparagraph></paragraph></section></legis-body></bill>
