			 Prevention Services Act, and for other purposes.</official-title></form>
	<legis-body id="HFC6B87673F0546AD88BAA1FAB14AAE71" style="OLC">
 <section id="HC109EFF49BC54A21A61616784BB2EE7F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Family First Transition Act</short-title></quote>.</text> </section><section id="H4447A307276C45F5BDDA230FD9B94A03"><enum>2.</enum><header>Evidence standard transition</header> <subsection id="H0602989F936E40D98F7062FD1606AE2D"><enum>(a)</enum><header>Temporary suspension of requirement that at least 50 percent of a State’s reimbursement for prevention and family services and programs be for programs and services that meet the well-Supported practice requirement</header><text display-inline="yes-display-inline">With respect to quarters in fiscal years 2020 and 2021, section 474(a)(6)(A) of the Social Security Act shall be applied without regard to clause (ii) of such section.</text>
 </subsection><subsection id="H1C008337AA834618B643D011637BEAB6"><enum>(b)</enum><header>Supported practices temporarily treated as well-Supported practices</header><text display-inline="yes-display-inline">With respect to quarters in fiscal years 2022 and 2023, practices that meet the criteria specified for supported practices in section 471(e)(4)(C) of the Social Security Act shall be considered well-supported practices for purposes of section 474(a)(6)(A)(ii) of such Act.</text>
			</subsection></section><section id="H05D6A3B297314446B4FCEFCD4E724DAB"><enum>3.</enum><header>Enhanced funding for transition activities</header>
			<subsection id="H369C308D5F2047CE849D15A6FA196382"><enum>(a)</enum><header>Transition funding</header>
 <paragraph id="HE0EAC23B286E42E88D58EF13CADD5DA3"><enum>(1)</enum><header>Appropriation</header><text>Out of any money in the Treasury of the United States not otherwise appropriated, there are appropriated to the Secretary of Health and Human Services (in this Act referred to as the <quote>Secretary</quote>) to carry out this subsection $500,000,000 for fiscal year 2020, which shall remain available through fiscal year 2021.</text>
				</paragraph><paragraph id="H8C639BE0027A47C5A5750D1173E84BA7"><enum>(2)</enum><header>Distribution of funds</header>
 <subparagraph id="H8D79B45450704850AA392B32ACF87CAF"><enum>(A)</enum><header>In general</header><text>The Secretary shall allot the amount appropriated by paragraph (1) of this subsection in accordance with section 423 of the Social Security Act, and shall pay each State to which an allotment is so made, the total amount so allotted, subject to subparagraph (B) of this paragraph.</text>
 </subparagraph><subparagraph id="HF9F9B9A048254293B72F07C8784774A2"><enum>(B)</enum><header>Reservation of funds for Indian tribes and tribal organizations</header><text display-inline="yes-display-inline">Before applying subparagraph (A) of this paragraph, the Secretary shall reserve 3 percent of the amount appropriated by paragraph (1) of this subsection for allotment to the Indian tribes and tribal organizations with a plan approved under subpart 1 of part B of title IV of the Social Security Act, based on each tribe or tribal organization’s share of the total tribal child population among all such tribes and tribal organizations.</text>
					</subparagraph></paragraph></subsection><subsection id="HC1FB935A26FE456A9A3B3FCCE6B24EDF"><enum>(b)</enum><header>Funding certainty for States with expiring demonstration projects</header>
 <paragraph id="H6FAA057F7C1B418DBC135B720356F2CD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Out of any money in the Treasury of the United States not otherwise appropriated, there are appropriated to the Secretary, for payment to each State that was operating a demonstration project approved under section 1130 of the Social Security Act on September 30, 2019, for each fiscal year specified in paragraph (2) of this subsection, an amount equal to the amount (if any) by which—</text>
					<subparagraph id="H0712F9BCCF6846F1827D8E7321D0D229"><enum>(A)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="HC9A8577808A84DDA97E7D55AF2B3921A"><enum>(i)</enum><text display-inline="yes-display-inline">the applicable percentage for the fiscal year so specified of the maximum capped allocation due to the State or sub-State jurisdiction for fiscal year 2019 for foster care maintenance, administration, or training costs, under the demonstration project, as specified in section 4.3 of the State waiver terms and conditions document capped allocation payment table in effect on August 31, 2019; or</text>
 </clause><clause id="HC1179DAF4B2A4BCDA73E556E0014CD13" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">if the terms and conditions do not specify a maximum amount payable for fiscal year 2019 for the State or sub-State jurisdiction (due to the use of a comparison jurisdiction to ensure cost neutrality), the final cost neutrality limit for the State or sub-State jurisdiction for fiscal year 2018, as most recently reported by the State or sub-State jurisdiction as of September 30, 2019, for foster care maintenance, administration or training costs under the demonstration project that were included in the waiver; exceeds</text>
 </clause></subparagraph><subparagraph id="H88271F7AB6CA49E5AACB05476DCC8924"><enum>(B)</enum><text display-inline="yes-display-inline">the total amount payable to the State or sub-State jurisdiction under part E of title IV of such Act for the fiscal year so specified for foster care expenditures (whether payable under paragraph (1) or (3) of section 474(a) of such Act) that were maintenance, administration, or training costs of the demonstration project taken into account by the Secretary in determining the total amount referred to in subparagraph (A) of this paragraph.</text>
 </subparagraph></paragraph><paragraph id="H4FD4B488AC89429FAC8E88D2E1817F9F"><enum>(2)</enum><header>Applicable percentage defined</header><text>In this paragraph, the term <term>applicable percentage</term> means—</text> <subparagraph id="H401AEAF52235412CB1105F54D42D376D"><enum>(A)</enum><text>90 percent, in the case of fiscal year 2020; or</text>
 </subparagraph><subparagraph id="HE21164E183BB4B40853867C034524350"><enum>(B)</enum><text>75 percent, in the case of fiscal year 2021.</text> </subparagraph></paragraph><paragraph id="H0BD4ABE3AF3445D69CA7C4596B59052F"><enum>(3)</enum><header>Special rule</header><text display-inline="yes-display-inline">The calculation under paragraph (1) with respect to a State shall be made without regard to—</text>
 <subparagraph id="HD05578F2C8294FBBA910627984F6303B"><enum>(A)</enum><text display-inline="yes-display-inline">any change approved after August 31, 2019, in the capped allocation or the terms and conditions referred to in subparagraph (A) with respect to the State; or</text>
 </subparagraph><subparagraph id="H36E8355231124056AC0CD1DFD745EB8A"><enum>(B)</enum><text>any change made after such date to the financial form submitted by the State that is used in determining the capped allocation.</text>
 </subparagraph></paragraph><paragraph id="H4B179F99A51D4EF5BD7E3A339C94A5C7"><enum>(4)</enum><header>Distribution of funds</header><text display-inline="yes-display-inline">Each State that receives funds under this subsection shall distribute the funds to jurisdictions in the State that were operating demonstration projects under section 1130 of the Social Security Act in a manner consistent with each sub-State jurisdiction’s proportionate loss as compared with fiscal year 2019.</text>
 </paragraph><paragraph id="H3B0567B72ADD4C7CB34103ACA86BD12E"><enum>(5)</enum><header>Reconciliation process</header><text display-inline="yes-display-inline">Each State seeking a payment under this subsection shall report expenditures pursuant to part E of title IV of the Social Security Act in a manner determined by the Secretary and the Secretary shall account for any revisions to spending for fiscal years 2020 and 2021 after the end of the respective fiscal year that are reported by the State agency administering the State plan approved under such part, and received by the Department of Health and Human Services, within 2 years after the last day of the fiscal quarter in which the expenditure was made.</text>
 </paragraph><paragraph id="HAE6D25EFA12646619140CED05AF697C5"><enum>(6)</enum><header>Availability of funds</header><text display-inline="yes-display-inline">The amounts made available for payments to States under this subsection for a fiscal year shall remain available through the end of the third succeeding fiscal year.</text>
				</paragraph></subsection><subsection id="H0CDFB185CA254CB6BD53DAD0CCACA6BC"><enum>(c)</enum><header>Use of funds</header>
 <paragraph id="HA58C648E8FAB4716A89B30C8D5C15EBB"><enum>(1)</enum><header>In general</header><text>In addition to the purposes specified in part B of title IV of the Social Security Act, a State may use funds provided under this section for activities previously funded under a demonstration project under section 1130 of such Act to reduce any adverse fiscal impacts as jurisdictions transition funding sources for the projects, and for activities directly associated with the implementation of title VII of division E of <external-xref legal-doc="public-law" parsable-cite="pl/115/123">Public Law 115–123</external-xref> (also known as the Family First Prevention Services Act).</text>
 </paragraph><paragraph id="H9E570C7BE04F48F4A75028FC4883A7E7"><enum>(2)</enum><header>Limitation</header><text>None of the funds provided under this section may be used to match Federal funds under any program.</text> </paragraph></subsection></section><section id="H95A29AC20AAC4ED9A95FD201EB846923"><enum>4.</enum><header>Reporting on enhanced funding for transition activities</header> <subsection id="HCD2BD6F5AD984DBEB900A4A35F811D04"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each State to which funds are paid under section 3 of this Act shall submit to the Secretary, in a manner specified by the Secretary, a written report on—</text>
 <paragraph id="H830562D7268345BF9AB9698158D6E1BB"><enum>(1)</enum><text display-inline="yes-display-inline">how the grant is used to implement each part of title VII of division E of <external-xref legal-doc="public-law" parsable-cite="pl/115/123">Public Law 115–123</external-xref> (also known as the Family First Prevention Services Act), with a separate statement with respect to each such part;</text>
 </paragraph><paragraph id="HBA27A94857A440C0B849EF572B72B4EA"><enum>(2)</enum><text>all programs, services, and operational costs to which the grant is put;</text> </paragraph><paragraph id="H686742942541479493007A9DD1632631"><enum>(3)</enum><text>the characteristics of the families and children served by use of the grant; and</text>
				</paragraph><paragraph id="HC6D8AADCD6204B38866F8E6809CFEFBE"><enum>(4)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H2E7B8CB02ED84EF2AB6EC805E857D35A"><enum>(A)</enum><text>the use by the State of amounts provided for each fiscal year to continue activities previously funded under a waiver provided under section 1130 of the Social Security Act; and</text>
					</subparagraph><subparagraph id="HCD799E992A894D1E8E755133627B5DD9" indent="up1"><enum>(B)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="HF2AA175B039F442AB01B6FED5E593542"><enum>(i)</enum><text>the plan of the State to transition the activities so that needed activities can be provided under the State plan approved under part E of title IV of the Social Security Act; or</text>
 </clause><clause id="HB8182E47F4364F369F482C89E41A84E4" indent="up1"><enum>(ii)</enum><text>if expenditures for the activities would not be eligible for payment under the State plan approved under such part E—</text>
 <subclause id="H0FCABFD856264A92AFECF1900B93C3CF"><enum>(I)</enum><text>the reason therefor; and</text> </subclause><subclause id="HEF0A13918D7242F293883A84E769404D"><enum>(II)</enum><text>the funding sources the State plans to use to cover the costs of needed activities.</text>
 </subclause></clause></subparagraph></paragraph></subsection><subsection id="HE66954C880284D348E1D3C8F9CC8681D"><enum>(b)</enum><header>Applicability of other laws</header><text>For purposes of subpart 2 of part B of title IV of the Social Security Act, each report required by subsection (a) of this section shall be considered to be required by section 432(a)(8) of such Act, and shall contain such additional information as the Secretary may require.</text>
 </subsection></section><section display-inline="no-display-inline" id="H77D70A7DE0634D048395F8C3D2EA6936"><enum>5.</enum><header>Definition of State</header><text display-inline="no-display-inline">In this Act, the term <term>State</term> has the meaning given the term in section 431(a)(4) of the Social Security Act.</text> </section><section id="HD0C64A76D6744C719791A5A885529EAE"><enum>6.</enum><header>Renaming of Title IV–B–2 of the Social Security Act</header><text display-inline="no-display-inline">The subpart heading for subpart 2 of part B of title IV of the Social Security Act is amended by striking <quote><header-in-text level="subpart" style="OLC">Promoting Safe and Stable Families</header-in-text></quote> and inserting <quote><header-in-text level="subpart" style="OLC">MaryLee Allen Promoting Safe and Stable Families Program</header-in-text></quote>.</text>
 </section><section id="HE30C30677C2C47638F43E61F12722F61"><enum>7.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect as if included in the Bipartisan Budget Act of 2018 on the date of the enactment of such Act.</text>
 </section><section id="H9EFF1C7A03DF481997C9647D746F012E"><enum>8.</enum><header>Technical correction</header><text display-inline="no-display-inline">Section 50701 of the Bipartisan Budget Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/42/1305">42 U.S.C. 1305</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/123">Public Law 115–123</external-xref>) is amended by striking <quote>Bipartisan Budget Act of 2018</quote> and inserting <quote>Family First Prevention Services Act</quote>.</text>
