			 service that hinders the display of user-generated content shall be
			 treated as a publisher or speaker of such content, and for other purposes.</official-title></form>

 <section id="HFB0198BB53F148BE9AC49F2B1BBF13CE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Biased Algorithm Deterrence Act of 2019</short-title></quote>.</text> </section><section id="H4C183FC26B44435F930F7A6F05EAB59D"><enum>2.</enum><header>Exception to protection from treatment as publisher or speaker</header><text display-inline="no-display-inline">Section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>) is amended—</text>
 <paragraph id="H5E9792802EBE454893CC429E51F49B0E"><enum>(1)</enum><text>in subsection (c), by adding at the end the following:</text> <quoted-block id="HAD8F8E6E803F42CF9819ABF10004890B"> <paragraph id="HED449B97B1924AD2AFADAD447A3D8A37"><enum>(3)</enum><header>Exception</header> <subparagraph id="H42829ABFEB2D4D0D8E69F1A7BCEDAB2F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), an owner or operator of a social media service that displays user-generated content in an order other than chronological order, delays the display of such content relative to other content, or otherwise hinders the display of such content relative to other content, if for a reason other than to restrict access to or availability of material described in paragraph (2)(A) or to carry out the direction of the user that generated such content, shall be treated as a publisher or speaker of such content.</text>
 </subparagraph><subparagraph id="HC45FB4E831EB4181A423A813585951A5"><enum>(B)</enum><header>Use of algorithms</header><text>If an algorithm of a social media service is used to engage in an action related to user-generated content that is described in subparagraph (A), such action shall be considered to be the action of the owner or operator of the social media service.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H6CCE70DC46BD479F987F84317F703F64"><enum>(2)</enum><text>in subsection (f), by adding at the end the following:</text> <quoted-block id="HDCF42C93F5EE4B13BA302C46EA798AEC"> <paragraph id="H2CA81B2A80C447EEA000E620461122A8"><enum>(5)</enum><header>Social media service</header><text display-inline="yes-display-inline">The term <quote>social media service</quote> means any interactive computer service provided over the internet that connects users for the purpose of such users engaging in dialogue, sharing information, collaborating, or otherwise interacting.</text>
 </paragraph><paragraph id="H73FBA00044C8422DBFB7119EC98A83CF"><enum>(6)</enum><header>User-generated content</header><text display-inline="yes-display-inline">The term <quote>user-generated content</quote> means content that is supplied on a social media service by an information content provider who is a user of such service.</text>
 </paragraph><paragraph id="H87A9C543C72C40AAB2596FA8E7A9034F"><enum>(7)</enum><header>Algorithm</header><text>The term <quote>algorithm</quote> means a computer program that performs any action described in subparagraph (A), (B), or (C) of paragraph (4).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
